DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a regulation of the European Parliament and of the Council amending Council Regulation (EC)1030/2002 laying down a uniform format for residence permits for third-country nationals

(COM(2016)0434 – C8‑0247/2016 – 2016/0198(COD))

(Ordinary legislative procedure: first reading)

The European Parliament,

–  having regard to the Commission proposal to Parliament and the Council (COM(2016)0434),

–  having regard to Article 294(2) and Article 79(2)(a) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C8‑0247/2016),

–  having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

–  having regard to Rule 59 of its Rules of Procedure,

–  having regard to the report of the Committee on Civil Liberties, Justice and Home Affairs (A8-0065/2017),

1.  Adopts its position at first reading, taking over the Commission proposal;

2.  Calls on the Commission to refer the matter to Parliament again if it replaces, substantially amends or intends to substantially amend its proposal;

3.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

The Commission proposal at hand is technical rather than political in nature. It is based on the previous instruments on the issue (Regulation (EC) No 1030/2002[1], as last amended by Regulation (EC) No 380/2008[2]).

The proposal does not aim at a fully harmonized residence permit, as it should be cost-neutral and as it has been considered appropriate to allow those Member States that wish to give third-country nationals the same advantages as their own citizens, to add a contact chip for e-government purposes.

The present Regulation updates the Annex to provide for greater harmonization. Even if full uniformity is still not achieved and some divergences remain, the instrument presents a step forward. The proposal aims to ensure a uniform design and certain standard security features, to which optional features can be added.

Further harmonization of the residence permit helps border guards and other relevant authorities to conduct their tasks and contributes to the security of EU citizens and legal residents.

I consider Article 79 TFEU as the adequate legal basis with possible participation of the UK and Ireland based on Protocol 21. A greater uniformity can only be achieved if each Member State participates in the framework of one instrument.
