EXPLANATORY STATEMENT
1. The withdrawal of a Member State from the Union, in this case the United Kingdom, is an unprecedented situation for which the European Union must prepare, in the interests of its citizens, the common market and the maintenance of good economic and trade relations with the departing country, whether or not a withdrawal agreement is achieved.
2. If no agreement can be found between the EU27 and the UK, Parliament’s Transport and Tourism Committee has shown that:
* a ‘no deal’ would be an aggravating factor for both the United Kingdom and the European Union, and its impact would be exacerbated for the transport sector, threatening infrastructure managers and transport operators, the economic sectors dependent on it and the jobs it currently provides;
** the two countries sharing a land border with the United Kingdom, Ireland and France (via the Channel Tunnel), for whom the issue of reintroducing a common external border arises, should find tangible ways to maintain a high level of connectivity for their citizens and the fluidity of trade flows between them;
*** certain territories, those closest to the United Kingdom or which specialise in cross-Channel traffic, would be the most affected in a ‘no-deal’ scenario.
3. With this in mind, it is expected that a number of measures will be taken by the Commission in advance and that the CEF Regulation will be adapted to take into account the effects of a no-deal Brexit. These measures should prioritise:
* reconnecting Ireland to the North Sea – Mediterranean Corridor by new maritime freight routes, including all the ports of the core network of the corridor;
** incorporating Ireland into the Atlantic Corridor and, where appropriate, incorporating new French ports into the core network, taking into account existing flows;
*** mobilising the remaining CEF funds for the period 2019-2020 to adapt core network ports to the new flows between Ireland and the EU27, as well as to the new constraints associated with cross-Channel traffic.
4. While these are the first, most urgent measures in terms of EU support for the transport and tourism sectors, we should not forget the deeper and longer-term consequences of the UK’s departure, which will affect all the territories that, over the UK’s 45-year membership of the common market, have forged close ties which are essential to their socio-economic vitality. Consequently, new funding measures should also be deployed to help all transport stakeholders and territories adapt to the negative consequences of Brexit.

SHORT JUSTIFICATION
This Commission proposal addresses a particular set of circumstances around the intended withdrawal of United Kingdom from the European Union.
If the United Kingdom leaves the EU with a Withdrawal Agreement in place that maintains the EU acquis through a transition period to 31 December 2020, then the North Sea-Mediterranean (NSM) corridor will continue to run through the United Kingdom as at present. On 1 January 2021, it is intended that the new CEF legislation will come into force with appropriate adjustments to the TEN-T network.
If, however, the UK leaves as currently scheduled on 29 March 2019 without an agreement, a discontinuity will potentially exist in the TEN-T network NSM corridor between the English Channel/North Sea ports and Republic of Ireland ports. Similarly, in such circumstances the TEN-T corridor would end at the UK-Republic of Ireland border and would not include the port of Belfast.
The Commission proposal offers an appropriate solution to the potential legislative anomaly that potentially could arise and supports the designation of the ports of Zebrugge, Antwerp and Rotterdam as links within the TEN-T network NSM corridor to the Republic of Ireland ports, noting that the designation is based on existing traffic volumes among the posts. The Channel ports of Dunkirk and Calais will remain as designated ports on the corridor, in this instance as ports of exit and entry to the European Union.
This technical designation has no material effect on the position of any port nor will any traffic volumes be affected by the designation. However, the potential for disruption, as reported in a series of studies, to the channel ports in particular from the imposition of customs checks should the United Kingdom exit the Union without agreement or subsequently discontinue open customs arrangements with the Union is noted.
The port of Le Havre is not currently part of the TEN-T corridor linking to the Republic of Ireland and other ports in North West France do not currently meet TEN-T criteria. The reconsideration of the relationship of Ireland with the TEN-T North Sea/Mediterranean Corridor is only one aspect of the new transport situation Ireland will face, and in this context, the consideration of the relationship to the Atlantic corridor providing more direct links between Ireland and the other Member States is also thought relevant, including the designation of ports in France and Ireland itself as well as those designated in Belgium and the Netherlands. The relationship of the Republic of Ireland to the TEN-T network corridors and therefore the potential relationship to ports should be considered as a matter of urgency within the revision of the CEF legislation for the 2021-27 MFF, with a view to improving direct links between Ireland and the rest of the Union.
In line with the Report of the Regional Development Committee on the role of Cohesion Policy in Northern Ireland, the importance of continued economic activity and movement of people between the Republic of Ireland and Northern Ireland is highlighted along with the role of enhanced Transport links, including the TEN-T corridor in maintaining the objectives of the Good Friday/Belfast Agreement 1998.
