The European Parliament,

 having regard to the draft Council decision (06198/2013),

 having regard to the draft Protocol amending the Euro-Mediterranean Aviation Agreement between the European Community and its Member States, of the one part, and the Kingdom of Morocco, of the other part, to take account of the accession to the European Union of the Republic of Bulgaria and Romania,

 having regard to the request for consent submitted by the Council in accordance with Article 100(2) and Article 218(6), second subparagraph, point (a), and Article 218(8) first subparagraph, of the Treaty on the Functioning of the European Union (C9‑0006/2019),

 having regard to Rule 105(1) and (4) and Rule 114(7) of its Rules of Procedure,

 having regard to the recommendation of the Committee on Transport and Tourism (A9-0005/2020),

1. Gives its consent to conclusion of the Protocol;

2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States and of the Kingdom of Morocco.


 

EXPLANATORY STATEMENT

Background

The Euro-Mediterranean Aviation Agreement between the European Community and the Kingdom of Morocco was negotiated on the basis of a mandate given by the Council in December 2004.

The aim of the agreement is both to open markets and to move towards an alignment of aviation legislation on both sides. It also contains provisions concerning bilateral investment on both sides of the Mediterranean.

This agreement was signed on 12 December 2006; the consent for conclusion was given by the European Parliament on 24 October 2017(2006/0048 (NLE)).

Accession of the Republic of Bulgaria and Romania to the European Union

 

The Republic of Bulgaria and Romania acceded to the European Union on 1 January 2007. Pursuant to Article 6(2) of the Act concerning the Conditions of Accession, those two States undertook to accede to the Agreements and Conventions concluded or signed by the Member States and the Community acting jointly.

The Protocol to take account of the accession to the European Union of the Republic of Bulgaria and Romania has been negotiated between the Commission and the Authorities of the Kingdom of Morocco.

 

 

Main provisions of the Protocol

 

The purpose of the Protocol is to allow the Republic of Bulgaria and Romania to become a Party to the Euro-Mediterranean Aviation Agreement between the European Community and the Kingdom of Morocco. The Protocol will not introduce any changes to the substance of the Agreement. It provides for the necessary technical and linguistic adaptations of the Agreement that ensue from the accession of Bulgaria and Romania.

 

Procedure

The European Parliament first approved the conclusion of the Protocol, on 12 December 2007.

As the consequence of the entry into force of the Treaty of Lisbon on 1 December 2009, the European Union has replaced and succeeded the European Community.

In order to take into account the modification introduced by the Treaty of Lisbon, the Council decided, on 12 April 2013, to consult again the Parliament to obtain its consent.

In order to conclude the Protocol to take account of the accession to the European Union of the Republic of Bulgaria and Romania, the Council needs the consent of the European Parliament as required by Article 218 TFEU.

 

In accordance with Rules 105 and 114(5), (7) and (8) of Parliament’s rules of procedure, the committee responsible shall submit a recommendation for the approval or rejection of the proposed act. Parliament shall then take a decision by means of a single vote, and no amendments to the agreement may be tabled. Amendments in committee shall be admissible only if their aim is to reverse the recommendation proposed by the rapporteur.

 

Rapporteur’s position

This consent procedure is purely technical, due to the replacement in the text of the Protocol of the reference to “the European Community” by “the European Union”. The Parliament approved already the substance of the Protocol in 2007 and should keep its position.

In the light of the above, your Rapporteur suggests that the TRAN Committee should give a favourable recommendation on the conclusion of the Protocol.
