on the draft Council decision on the conclusion, on behalf of the Union, of the Euro-Mediterranean Aviation Agreement between the European Union and its Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part

The European Parliament,

 having regard to the draft Council decision (14209/2019),

 having regard to the draft Euro-Mediterranean Aviation Agreement between the European Union and its Member States, of the one part, and the Hashemite Kingdom of Jordan, of the other part (14366/2010);

 having regard to the request for consent submitted by the Council in accordance with Articles 100(2) and Article 218(6), second subparagraph, point (a)(v), and Article 218(7) of the Treaty on the Functioning of the European Union (C9‑0193/2019),

 having regard to Rule 105(1) and (4), and Rule 114(7) of its Rules of Procedure,

 having regard to the recommendation of the Committee on Transport and Tourism (A9-0086/2020),

1. Gives its consent to the conclusion of the agreement;

2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States and of Kingdom of Jordan.


 

EXPLANATORY STATEMENT

This Euro Mediterranean Aviation Agreement regulates relations in the field of aviation between the EU and its Member States and the Hashemite Kingdom of Jordan. It is concluded as part of the EU neighbourhood policy, one of the aims of which is to establish a common aviation area between the EU and its Mediterranean neighbours.

 

Procedure

 

This agreement has been negotiated by the Commission under an authorisation received from the Council in June 2007 and it was signed on 15 December 2010, subject to its conclusion at a later date, in accordance with Decision 2012/750/EU[1]. The European Parliament gave its consent to the conclusion of the Agreement on 15 November 2011[2]. Following the accession of Croatia into the EU the relevant Protocol on the accession of the Republic of Croatia to this Agreement was signed on 3 May 2016[3].

 

However, in order to take into account the entry into force of the Treaty of Lisbon as well as the legal modifications following the ruling of the European Court of Justice[4] relating to the wording of the Decision 2012/750/EU, the Council submitted, on 25 June 2019, the new decision for the consent of the Parliament.

 

In order to conclude the Agreement the Council needs the consent of the European Parliament as required by Article 218 TFEU.

 

In accordance with Rules 105 and 114(5), (7) and (8) of Parliament’s rules of procedure, the committee responsible shall submit a recommendation for the approval or rejection of the proposed act. Parliament shall then take a decision by means of a single vote, and no amendments to the Agreement may be tabled. Amendments in committee shall be admissible only if their aim is to reverse the recommendation proposed by the rapporteur.

 

Main provisions of the Agreement

 

This Agreement is part of the EU neighbourhood policy. It builds upon and replaces the framework of bilateral air transport agreements between the EU Member States and Jordan through the establishment of the Euro-Mediterranean Aviation Area between the EU and its Mediterranean Partners. It provides for gradual market opening in terms of access to routes and capacity on a reciprocal basis, ensures level playing field for economic operators based on the EU principles and provides for alignment of the Jordanian aviation legislation with EU legislation on issues such as safety, security and air traffic management.

 

Rapporteur’s position

 

This consent procedure is a purely technical one, to take into account the legal consequences of the entry into force of the Treaty of Lisbon and of the ruling of the Court of Justice (Case C-28/12) of 2015. In 2011, the Parliament already approved the substance of the Agreement and should keep its position.

 

In the light of the above, your Rapporteur suggests that the TRAN Committee should give a favourable recommendation on the conclusion of the Agreement.
