European Parliament resolution on the Commission delegated regulation of 20 October 2014 establishing a discard plan in the Baltic Sea (2014/2912(DEA))

The European Parliament,

–       having regard to Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the Common Fisheries Policy, amending Council Regulations (EC) No 1954/2003 and (EC) No 1224/2009 and repealing Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and Council Decision 2004/585/EC, and in particular Part III thereof(1),

–       having regard to Council Regulation (EC) No 2187/2005 of 21 December 2005 for the conservation of fishery resources through technical measures in the Baltic Sea, the Belts and the Sound, amending Regulation (EC) No 1434/98 and repealing Regulation (EC) No 88/98, and in particular Annex IV thereto(2),

–       having regard to Council Regulation (EC) No 1098/2007 of 18 September 2007 establishing a multiannual plan for the cod stocks in the Baltic Sea and the fisheries exploiting those stocks, amending Regulation (EEC) No 2847/93 and repealing Regulation (EC) No 779/97(3),

–       having regard to Article 290 of the Treaty on the Functioning of the European Union,

–       having regard to Rule 105(4) of its Rules of Procedure,

A.     whereas reducing the minimum conservation reference size for cod in the Baltic Sea, as proposed by the Commission, could potentially undermine the reproductive capacity of the stock;

B.     whereas the Council decision on total allowable catches (TACs) for cod stocks in 2015 seeks cuts to the quota (of 7 % in the western Baltic and 22 % in the eastern Baltic) in order to protect the species;

C.     whereas reducing the minimum conservation reference size for cod in the Baltic Sea from 38 cm to 35 cm incentivises the creation of a market for juvenile fish;

D.     whereas reducing the minimum conservation reference size for cod in the Baltic Sea removes an important incentive to make improvements as regards the use of more selective gears;

1.      Objects to Commission Delegated Regulation (EU) No …/... of 20 October 2014 establishing a discard plan in the Baltic Sea;

2.      Instructs its President to forward this resolution to the Commission and to notify it that the delegated regulation cannot enter into force;

3.      Calls on the Commission to submit a new delegated act within one month which takes account of the following recommendations:
