European Parliament resolution on the case of Nadiya Savchenko

(2015/2663(RSP))

The European Parliament,

- having regard to its most recent resolutions on the situation in Ukraine and Russia,

 

- having regard to the "Package of measures for the implementation of the Minsk agreements" adopted and signed in Minsk on 12 February 2015 and endorsed as a whole by UN Security Council resolution 2202 (2015) of 17 February 2015,

 

- having regard to the European Convention on Human Rights, ratified by the Russian Federation in May 1998,

 

- having regard to the provisions of International Humanitarian Law and, in particular, to the Third Geneva Convention relative to the Treatment of Prisoners of War of 12 August 1949,

 

– having regard to Rule 135 of its Rules of Procedure,

 

A. Whereas Lieutenant Nadiya Savchenko, an Ukrainian Air Force officer who volunteered to the Aidar battalion, was allegedly captured in full uniform in Eastern Ukraine on 18 June 2014 by the illegal armed forces of the so-called "Luhansk People’s Republic" during active hostilities taking place in the territory of Ukraine; whereas, a few days later, she was transferred to Russia and on 9 July 2014 the Russian authorities announced that the Ukrainian pilot was detained in a civilian detention center in Russia, facing charges of complicity in the killing of two Russian TV employees, the journalist Igor Kornelyuk and the sound engineer Anton Voloshin, during hostilities in Donbas;

 

B. Whereas the Russian Federation is claiming that Ms. Savchenko crossed the state borders by herself and, as a consequence, she has been accused of trespass;

 

C. Whereas Nadiya Savchenko became a member of the Verkhovna Rada and then she has been appointed as a representative of Ukraine to the Parliamentary Assembly of the Council of Europe (PACE) while still imprisoned; whereas PACE Resolution 2034 (2015) asked for her immediate release and for the respect of her European parliamentary immunity;

 

D. Whereas Nadiya Savchenko has been on a hunger strike for over three months in protest against her unlawful detention; whereas she has been subjected to involuntary psychiatric examinations and treatment; whereas Moscow-based courts rejected Nadiya Savchenko's appeals against her pre-trial detention; whereas, in the meantime, her health conditions have deteriorated; whereas the EU and several member states have expressed genuine humanitarian concern in this respect; whereas several appeals have been made to the United Nations Human Rights Council and the International Red Cross to secure Nadiya Savchenko’s release;

 

E. Whereas the "Package of measures for the implementation of the Minsk agreements" of 12 February 2015 provides for the release and exchange of all hostages and unlawfully detained persons related to the conflict in Ukraine;

 

F. Whereas the Russian Federation, as any other full member of the Council of Europe and of the Organisation for Security and Cooperation in Europe (OSCE), has to respect its commitments to the principles of democracy, the rule of law and respect for human rights; whereas the rights to proper treatment and fair trial need to be guaranteed for all detainees in the Russian Federation, including Nadiya Savchenko and all other Ukrainian citizens;

 

1. Calls for the immediate release of Nadiya Savchenko, in the context of the "Package of measures for the implementation of the Minsk agreements" and the commitment to release all hostages and detained persons involved in the conflict in Ukraine;

 

2. Believes that, despite the possible different legal interpretations, it is clear that the status of prisoner of war applies to the case of Nadiya Savchenko; points out to the questionable circumstance that lead to her capture and detention by the Russian authorities; invites the President of the Russian Federation to recognise this status and to make her eligible for prisoners exchange or to release her on humanitarian grounds;

 

3. Calls on the High Representative of the Union for Foreign Affairs and Security Policy, the European Commission, and the European External Action Service (EEAS) to continue to follow closely the case of Nadiya Savchenko, to raise it in different international fora and the meetings with the Russian authorities, and to keep the European Parliament informed about the outcome of these efforts;

 

4. Insists on the need for steady continuation of the exchange prisoners' process and its completion on an "all for all" basis, as agreed in the latest Minsk agreement;

 

5. Strongly condemns deliberate attacks against media professionals and associated personnel in armed conflicts; expresses its condolences to the families of the victims and calls for independent and impartial investigation of these deaths; welcomes the dialogue among journalists unions from Russia and Ukraine under the auspices of the OSCE Representative on Freedom of the Media and the adoption of the Vienna joint statement of 23 April 2015 expressing professional solidarity and condemning any attempt to use the deaths and the violations of the rights of journalists as tools for propaganda and incitement to hatred in the two countries;

 

6. Calls on all parties to act responsibly and to implement the Minsk package of measures in full and in good faith as it offers a way forward to a peaceful resolution of the conflict; reminds the important role, the commitments and the special responsibility of Russia in this respect; believes that the immediate release of Nadiya Savchenko will be a positive gesture proving the sincere willingness of Russia to contribute to a peaceful solution of the conflict in Eastern Ukraine;

 

7. Instructs its President to forward this resolution to the Council, the Commission, the High Representative of the Union for Foreign Affairs and Security Policy, the Governments and Parliaments of the Member States, the President, Government and Parliament of the Russian Federation and the President, Government and Parliament of Ukraine, as well as the Council of Europe and the OSCE.
