Motion for a European Parliament resolution on ATM withdrawals and the requirement for professional people and holders of VAT numbers to account for expenditure

The European Parliament,

–       having regard to Rule 133 of its Rules of Procedure,

A.     whereas the Italian Government is preparing, by means of delegated legislation, to approve a clause, 7a, instituting penalties for professional people and holders of VAT numbers who, after making an ATM withdrawal, are subsequently unable to account for the way in which they have spent the money;

B.     whereas the aim of this measure is said to be to trace payments and thus combat tax evasion;

C.     whereas this measure not only lacks any factual or legal justification but its only effect would be to impose on those to whom it applies yet another hateful obligation, compelling them to keep scrupulously every receipt concerning each euro that they spend;

D.     whereas a fiscal measure cannot and must not degenerate into monitoring with overtones of totalitarian State policing which manifestly breaches privacy standards;

1.      Calls on the Commission to ensure that the fiscal supervision policies of the Member States do not breach the fundamental rights of the European Union as established by the Charter of Fundamental Rights and the case-law of the Court of Justice;
