MOTION FOR A RESOLUTION on the implementation of updated provisions modifying the Safe Harbour Agreement between the EU and the USA

Motion for a European Parliament resolution on the implementation of updated provisions modifying the Safe Harbour Agreement between the EU and the USA

The European Parliament,

–  having regard to Directive 95/46/EC,

–  having regard to Decision C(2000) 2441 of 26 July 2000,

–  having regard to Decision 1247/2002/EC of 10 July 2002,

–  having regard to Articles 153 and 156 TFEU,

–  having regard to Rule 133 of its Rules of Procedure,

A.  whereas in an ever more globalised and interconnected world it is vital that data transferred via the internet should be protected;

B.  whereas progress has been made in the EU as regards the protection of data on the web, but whereas the recent datagate scandal highlighted the fact that there are still areas of weakness in the relevant EU rules;

C.  having regard to the ruling handed down yesterday by the Court of Justice of the European Union (CJEU) in Luxembourg annulling the Commission decision of 26 July 2000, which, under the Safe Harbour arrangements, deemed adequate the level of protection in the USA of personal data transferred from Europe to servers in the USA;

1.  Calls on the Commission, as a matter of urgency, to amend its previous decisions concerning the Safe Harbour Agreement in order to update them in the light of the CJEU ruling.
