Motion for a European Parliament resolution on the sale of babies through surrogate motherhood being legally equivalent to human trafficking and organ trafficking
The European Parliament,
– having regard to the European Convention on Human Rights and to the Charter of Fundamental Rights of the European Union,
– having regard to Rule 133 of its Rules of Procedure,
A. whereas human trafficking is a violation of fundamental rights, it transforms those trafficked into goods for sale and is an offence to their dignity and integrity;
B. whereas the family, formed biologically by a father and a mother, should receive the protection and assistance it needs to be able to perform its role to the full;
C. whereas assisted fertilisation techniques expose women to a variety of potential health problems;
D. whereas studies on the importance of the intrauterine ‘mother-child’ relationship and on prenatal bonding show this to be a fundamental relationship in the child’s normal and healthy emotional, social and mental development;
E. whereas in many countries surrogate motherhood is a crime, a woman who gives birth to a child is deemed to be its mother for all intents and purposes and prenatal agreements concerning the forthcoming birth are consequently invalid;
1. Calls on the Commission and the Council to initiate as soon as possible a process making the sale of babies through surrogate motherhood/wombs for rent/trafficking of women in childbed legally equivalent to human trafficking and organ trafficking.
