MOTION FOR A RESOLUTION on Vietnam

European Parliament resolution on Vietnam

(2016/2755(RSP))

The European Parliament,

-   having regard to its previous resolutions on Vietnam,

-  having regard to the Human Rights Dialogue between the EU and Vietnam of 15 December 2015,

-  having regard to the Statement by the Spokesperson of 18 December 2015 on the arrest of lawyer Nguyen Van Dai;

-  having regard to the draft Framework Agreement on Comprehensive Partnership and Cooperation between the European Union and its Member States, of the one part, and the Socialist Republic of Vietnam, of the other part (18204/2010),

-   having regard to the Universal Declaration of Human Rights of 1948,

-   having regard to the International Covenant on Civil and Political Rights of 1966,

-   having regard to Rule 135 of its Rules of Procedure,

A.  whereas the situation for human rights defenders and political activists in Vietnam has become increasingly tense in recent months; whereas there is a persistent pattern of arrests, harassment and physical assaults against human rights defenders, religious leaders, bloggers, government critics and social activists; whereas Nguyen Van Dai, a prominent lawyer and human rights defender, was arrested on 16 December 2015;

B.  whereas activists have complained on social media that they are being prevented from leaving their homes; whereas several activists have been physically attacked with no known investigation or arrest of any alleged perpetrators;   

C.  whereas freedom of religion and belief is repressed and the Catholic Church and non-recognised religions, such as the Unified Buddhist Church of Vietnam, the Protestant churches and others continue to suffer from severe religious persecution;

D.  whereas at the Human Rights Dialogue the EU raised the issues of restrictions to freedom of expression, freedom of the media and freedom of assembly; whereas the EU reiterated its serious concerns about harassment, arrest and detention of human rights defenders, activists and bloggers, like for example Nguyen Huu Vinh and his colleague Nguyen Thi Minh Thuy;

E.  whereas on 27 June 2012, Vietnam and the European Union signed a new Partnership and Cooperation Agreement; whereas Vietnam is a key partner country within ASEAN;

1.  Welcomes the strengthened partnership and the Human Rights Dialogue between the EU and Vietnam; notes that both sides had a detailed exchange of views on a wide range of human rights issues; underlines that the EU commended Vietnam for continued progress in socio-economic rights in Vietnam while expressing persisting concerns over political and civil rights;

2.  Expresses its deep concern about the continuing violations of human rights, including political intimidation, harassment, assaults, arbitrary arrests, heavy prison sentences and unfair trials, in Vietnam perpetrated against human rights defenders, religious leaders, bloggers, government critics and social activists;

3.  Urges the Vietnamese authorities to immediately and unconditionally release all human rights defenders, religious leaders, bloggers, government critics and social activists; calls on the Vietnamese authorities to cease all forms of repression against those who exercise their rights to freedom of expression, freedom of belief and freedom of assembly;

4.  Calls on the Vietnamese Government to issue a standing invitation to UN Special Procedures and in particular invitations to the Special Rapporteur on Freedom of Expression and the Special Rapporteur on the situation of Human Rights Defenders;

5.  Instructs its President to forward this resolution to the Council, the Commission, and the Vice‑President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy, the governments and parliaments of the Member States, the Government and Parliament of Vietnam, and the Secretary-General of ASEAN.
