MOTION FOR A RESOLUTION on Indonesia, notably the cases of Hosea Yeimo, Ismael Alua and the Governor of Jakarta

European Parliament resolution on Indonesia, notably the cases of Hosea Yeimo, Ismael Alua and the Governor of Jakarta

(2017/2506(RSP))

The European Parliament,

-having regard to the Universal Declaration of Human Rights of 10 December 1948,

 

-having regard to the International Covenant on Civil and Political Rights of 1966,

 

-having regard to the International Covenant on Economic, Social and Cultural Rights of 1966,

 

-having regard to the International Convention on the Elimination of All Forms of Racial Discrimination of 1969,

 

-having regard to the Convention against Torture and Other Cruel, Inhumane or degrading Treatment or Punishment of 1987,

 

-having regard to Article 106 and Article 110 of the Indonesian Criminal Code (KUHP),

 

-having regard to Rules 135(5) and 123(4) of its Rules of Procedure,

 

-having regard to the EU-Indonesia Partnership and Cooperation Agreement , which entered into force in May 2014.

 

A. whereas over 500 people, including children, were arrested on 19 December 2016 for coordinated peaceful demonstrations in six cities throughout Indonesia; whereas these people demonstrated for the right of self-determination;

 

B. whereas some of the activists had already been detained the night before the planned protests and some have been beaten and badly injured before the arrest; whereas most of the people who got arrested have been released without charge one day after the peaceful protests;

 

C. whereas Hosea Yeimo and Ismael Alua, two activists from the pro-independence student organisation KNPB (the West Papuan National Committee), incarcerated after the protest have been released by the Police but are still charged with rebellion under Article 106 and Article 110 of the Indonesian Criminal Code (KUHP);

 

D. whereas Yeimo and Alua, considered to be prisoners of conscience by Amnesty International, might face a prison sentence up to a lifelong imprisonment if they will get convicted under Article 106 KUHP;

 

E. whereas peaceful political activists are still being imprisoned in Indonesia of whom some have been sentenced to as long as 20 years imprisonment for attending, organising or participating in peaceful political activities or protests or possessing, raising, or waving the prohibited pro-independence Morning Star Flag of Papua;

F. whereas excessive force and firearms as well as torture and other ill-treatment is used against political activists and other accused of having links to the pro-independence groups;

 

G. whereas the Governor of Jakarta, Basuki Tjahaja Purnama (AKA “Ahok”), is being investigated by the Indonesian Police for alleged blasphemy, after strong protests against Ahok took place during the month of December;

 

H. whereas Ahok, a Christian, is the first member of Indonesia’s ethnic Chinese community to be elected Governor of Jakarta;

 

I. whereas minorities have increasingly come under attack in recent years in the country;

 

 

1.Welcomes the strong relationship between the EU and Indonesia and repeats the importance of the strong and long-standing political, economic and cultural ties between both parties;

 

2.Encourages the government of Indonesia to take all necessary measures to ensure that the rights of peaceful activists are protected and ensure an enabling environment is created for the realisation of the freedom of speech and freedom of peaceful demonstration;

 

3.Welcomes the release of Hosea Yeimo and Ismael Alua on 11 Juanuary by the Papuan Provincial Police Force;

 

4.Calls on the authorities in Indonesia to drop all charges against Hosea Yeimo and Ismael Alua; Calls on the Indonesian authorities to immediately release all other peaceful activist and political prisoners;

 

5.Insists that religious tolerance, freedom of speech and freedom of peaceful demonstration in Indonesia will be guaranteed immediately;

 

6.Strongly calls on the Indonesian authorities to respect the International Covenant on Civil and Political Rights, to which Indonesia is a state party, on freedom of expression, thought, conscience and religion, equality before the law and freedom from discrimination.  

 

7.Instructs its President to forwards this resolution to the Vice-President of the commission/High Representative of the Union of Foreign Affairs and Security Policy, the Commission, the Government and Parliament of Indonesia, the parliaments and governments of the Member States and the United Nations High Commissioner for Human Rights;
