Motion for a European Parliament resolution on the Kingdom of Morocco’s annexation of vast swathes of Western Sahara’s territorial waters

The European Parliament,

–  having regard to the Euro-Mediterranean Association Agreement between the European Union and Morocco;

–  having regard to the judgment of the Court of Justice of the European Union (CJEU) of 21 December 2016 on the territorial application of the Agreement between the European Union and the Kingdom of Morocco,

–  having regard to Rule 133 of its Rules of Procedure,

A.  whereas international law does not recognise any Moroccan sovereignty or jurisdiction over the territorial waters of Western Sahara south of latitude 27° 40 N, as the UN Charter, the UN Convention on the Law of the Sea, the International Court of Justice Advisory Opinion on Western Sahara of 1975 and the UN legal opinion of 2002 all confirm;

B.  whereas on 6 July 2017 the Moroccan Government passed a decree defining its maritime border with the Canary Islands and incorporating the sea off the coast of Western Sahara into its territorial waters;

1.  Condemns this unlawful decision by the Kingdom of Morocco;

2.  Urges the European Commission to enforce the CJEU judgment by excluding Western Sahara from the scope of its agreements with Morocco.
