  Der Präsident. - Als nächster Punkt der Tagesordnung folgt die Aussprache über die Anfrage zur mündlichen Beantwortung an die Kommission über die Sachverständigengruppe der Kommission zur Durchsetzung der Rechte des geistigen Eigentums von Pavel Svoboda, Jean-Marie Cavada und Angel Dzhambazki im Namen des Rechtsausschusses (O-000001/2015 – B8-0102/2015) (2014/2972(RSP)).

  Pavel Svoboda, author. - Mr President, let me briefly present the oral question on behalf of the Committee on Legal Affairs. As you know, this committee is responsible for the area of intellectual property rights. I dare to say that this area is of great interest for a large number of committee members who understand the importance of intellectual property rights in the 21st century.

I think that the Commission is of the same view, and I would like to thank the Commission for its quick reaction when providing us with its understanding of the issues raised in our question. While drafting this question, we have been motivated by the fact that, given the importance of intellectual property rights for the future growth of the European Union, we should use all our instruments in the most effective way in order to get the best information available. We could use the information obtained not only for the purposes of enforcement evaluation, but also, for example, while thinking about the future reform of copyright.

That is why we would like to ask the Commissioner to confirm that there will be no duplication of tasks between the observatory and the group of experts which the Commission would like to establish, according to the action plan on the enforcement of intellectual property rights, and that no related unnecessary financial implications will take place, and to confirm that Parliament will be invited to send experts who will take part in this proposed group of experts as observers.

  Elżbieta Bieńkowska, Member of the Commission. - Mr President, I want to thank the Committee on Legal Affairs and especially its Chairman, Mr Svoboda, for their question, because the answer will allow me to maybe explain more and put a decision in context. You asked about the setting up of a group of experts on the enforcement of intellectual property rights. So maybe just one short remark putting the decision into context.

Markets and technologies are constantly changing, and we need to keep up with them. We need to keep on finding new solutions to breaches of IPR, and we need to be targeted. We need to develop new enforcement tools. It is for this reason – and also because Member States cannot go alone with the issue – that in July last year an expert group was set up. It was a core part of our ten-point plan to improve IPR enforcement, and the Member States welcomed it.

Let me turn to the specifics of your question. First you asked about the tasks of the group and how they add value to the work of the Observatory. Second, you asked about the financial implications and whether there will be duplication.

The expert group, it has to be stressed, has a strict mission. It is to advise and assist the Commission on policy initiatives. Its members are the national authorities responsible for national IP policies, and it is to exchange experience and good practice. It will not gather data or conduct studies itself. Instead it will rely on work done at national, EU and international level, including, of course, the work done by the Observatory.

This is completely different, as we see it, from the role of the Observatory. The Observatory is there to facilitate and support the practical enforcement work. That includes improving understanding and raising awareness of the impact of IPR infringements, providing training, promoting enforcement tools and technology, and helping national enforcement authorities to work together. The Observatory supports national authorities, the private sector and EU institutions. Part of this is data collection; the data collected and reported by the Observatory supports the work of the Commission and the Member States. So the expert group focuses – just to repeat – on policy, best practices and monitoring, and the Observatory focuses on the day-to-day enforcement and the collection of data. They do not duplicate. On the contrary, they are complementary. So the group will not result in unnecessary expenditure.

Third, you wanted confirmation that you could send experts to an expert group meeting, and the answer is yes, absolutely you can – you will be very welcome. We apply the framework document on relations between the European Parliament and the European Commission, but equally important, I think, is that you should be part of this body and participate in this work. We have to work together on IPR enforcement. It would be really helpful if you would follow the group actively. I will also listen to your questions and remarks, because I think that it will help our future work. I hope that reassures you and answers your questions.

  Tadeusz Zwiefka, w imieniu grupy PPE. – Panie Przewodniczący! To pytanie z pozoru tylko wydaje się być pytaniem bezzasadnym, ale tak naprawdę oczekujemy tu w Parlamencie Europejskim, ale także w wielu innych środowiskach, zapowiadanej przez Komisję Europejską szerokiej reformy w obszarze praw własności intelektualnej – stąd każde działanie podejmowane przez Komisję jest bacznie obserwowane także w Parlamencie Europejskim. Powołanie grupy ekspertów nie jest ani niczym nowym, ani niczym zdrożnym. Nasze pytanie zostało skierowane do Komisji tylko i wyłącznie w tym celu, aby nie tylko sprawdzić, czy nie dochodzi do nakładania się na siebie zasięgów pracy Obserwatorium (OHIM) w Alicante tej grupy ekspertów, ponieważ byłoby to zupełnie niepotrzebne dublowanie tych samych działań. Idziemy o krok dalej – a mianowicie pytamy nie tylko o to, czy jest to dublowanie, ale także o to, na ile te instytucje, obie działające dla tej samej Unii Europejskiej, będą ze sobą współpracować. Pytanie zasadne o tyle, że część ekspertów powołanych przez Komisję Europejską do owej grupy ekspertów, to także ci sami eksperci, którzy pracują dla Obserwatorium (OHIM). Wydaje się, że jest czymś absolutnie niezbędnym, aby wszyscy mogli wzajemnie korzystać z informacji oraz doświadczeń zarówno obserwatorium jak i grupy ekspertów, także Parlament Europejski, a przede wszystkim Komisja Prawna, która tu w Parlamencie będzie odpowiedzialna za proponowaną reformę w obszarze praw własności intelektualnej.

  Dietmar Köster, im Namen der S&D-Fraktion. – Herr Präsident, meine Damen und Herren! Viele Studien bestätigen den wichtigen Beitrag von geistigen Eigentumsrechten für die EU-Wirtschaft. Dies bringt die Kommission mit dem angesprochenen Aktionsplan von 2014 auch zum Ausdruck, auch mit dem Plan, hierzu eine zusätzliche Expertengruppe einzurichten. Wir Sozialdemokraten unterstützen das Anliegen des EU-Aktionsplans. Die Verstöße gegen geistiges Eigentumsrecht verursachen einen hohen ökonomischen Schaden. Nach Schätzungen der OECD gehen der Weltwirtschaft durch Schutzrechtsverletzungen jedes Jahr insgesamt rund 200 Milliarden Euro verloren. Uns als Sozialdemokraten und S&D-Fraktion ist es ja doch besonders wichtig, dass besonders die Interessen der Kulturschaffenden in den Blick genommen werden. Das müsste im Aktionsplan stärker berücksichtigt werden, und das müsste auch stärker in den Fokus der Expertengruppe genommen werden.

Sollte die Kommission zu diesem Schluss kommen, fordern wir als Sozialdemokraten eine eindeutige Aufgabenbeschreibung, so wie es ja gerade zum Teil von der Kommission erfolgte. Ich denke, das wäre gut, wenn wir als Rechtsausschuss und als Parlamentarier das auch noch einmal schriftlich nachlesen könnten. Es ist unverzichtbar, dass sowohl Europaparlamentarier als auch Akteure der Zivilgesellschaft daran beteiligt werden, wie zum Beispiel Verbraucherschutzorganisationen, Gewerkschaften und gerade auch die Kulturschaffenden. Voraussetzung für die Einrichtung einer Expertengruppe ist aus unserer Sicht die enge Zusammenarbeit mit den parlamentarischen Gremien.

  Ангел Джамбазки, от името на групата ECR. – Г-н председателстващ, уважаеми колеги, уважаема г-жо Комисар, важно е да се подчертае важността на защитата на интелектуалната собственост и силно негативното въздействие на нарушенията върху тази собственост за икономиката като цяло, за работната ръка, за стимула за иновации и творчество.

Да не отваряме и разговора за сивата икономика, която се облагодетелства от липсата и неспазването на необходимото в тази сфера законодателство. Разбира се, необходимо е добро прилагане на правата върху интелектуалната собственост, но не и за сметка на данъкоплатеца, не и разхищавайки обществени средства, които в държави с нисък стандарт биха означавали препитанието на стотици семейства.

Необходимо ли е наистина създаването на тази група при условие че Обсерваторията вече се занимава с това и една от работните ѝ групи е изцяло заета точно с прилагането и защитата на правата върху интелектуалната собственост? Обсерваторията дори има свои наблюдатели в Европейския парламент, в число и аз, а експертната група дори това не предвижда. Не смятате ли, че е най-малкото по-практично пряко избраните да имат наблюдение върху работата на тази експертна група, за да можем да докладваме и да правим отчет пред своите колеги в Европейския парламент и пред нашите избиратели за работата, извършена в тази област?

Имах честта и удоволствието да присъствам на пленарното заседание на Обсерваторията през октомври миналата година и получавам необходимата информация за тяхната дейност, за което, разбира се, благодаря и вярвам в усилията за бъдеща ползотворна работа. Комисията по правни въпроси също ги кани често на заседания, на които те представят информация за дейността и развитието в сферата.

Отново питам, необходимо ли е допълнително разхищаване на средства и как може да бъде обяснена тази необходимост от създаването на нова такава експертна група?

  António Marinho e Pinto, em nome do Grupo ALDE. – Senhor Presidente, caros Colegas, os direitos de autor protegem-se em vida do autor. O prazo de setenta anos para a proteção da dimensão patrimonial dos direitos de autor relativos a uma criação intelectual após a morte do respetivo autor constitui uma aberração do ponto de vista jurídico e económico. Além disso, é um privilégio inadmissível nos tempos atuais, sem qualquer justificação aceitável.

Esse longo período de tempo não protege os autores mas sim as pessoas que não têm qualquer ligação legítima ao ato de criação. Ele prolonga, após a morte do autor, uma situação ilegítima de exclusividade de monopólio que, sendo compreensível durante a vida do criador, se torna inaceitável após a sua morte, pois impede, ou pelo menos restringe, a fruição da obra pelo grande público.

Esse privilégio é mais próprio de conceções privatísticas do tempo do Código Civil de Napoleão do que de um tempo como o atual, em que se procura democratizar o acesso à cultura e à fruição generalizada das obras de arte. O regime jurídico atual prolonga por um período demasiado longo uma situação de exclusividade de monopólio em favor dos herdeiros do criador intelectual, fazendo com que só eles, ou quem eles designarem, possam divulgar a obra. No limite, podem até impedir a sua divulgação, ou seja, podem até impedir que durante setenta anos, depois da morte do autor, a sua obra não seja divulgada ou conhecida do público.

Vejamos se este regime se aplicasse, por exemplo, às patentes de medicamentos, em que o medicamento pudesse ser protegido durante setenta anos após a morte do autor. Por tudo isso, Senhor Presidente, Senhora Comissária, Senhores Deputados, é urgente diminuir rapidamente e drasticamente o prazo de setenta anos para um limite não superior a vinte ou trinta anos.

Fim ao protecionismo, sim à liberdade de fruição das criações intelectuais e das obras de arte.

  Jiří Maštálka, za skupinu GUE/NGL. – Pane předsedající, přivítal jsem položení otázky k ústnímu zodpovězení Komisi z podnětu Výboru pro právní záležitosti. Považuji za nezbytné, aby Evropský parlament byl dostatečně zapojen do činnosti expertů v oblasti modernizace práva duševního vlastnictví, které musí adekvátně reagovat na rychlý rozvoj a vývoj tohoto sektoru, zejména co se týká internetu. Tuto otázku bych však poněkud rozšířil a doplnil. Oblast práva duševního vlastnictví je mimořádně důležitou oblastí s ohledem na to, že v odvětví kultury a umělecké tvorby v Evropě je přímo zaměstnáno více než 7 milionů Evropanů a jde o odvětví, které přitahuje mladé pracovníky – 19 % pracovních míst je obsazeno lidmi, kteří jsou mladší než 30 let. Toto odvětví rostlo z hlediska zaměstnanosti navzdory ekonomické krizi. Chci se proto zeptat Komise, jaká je její představa o reformě práva duševního vlastnictví, jak do budoucna dokáže zachovat systém duševního vlastnictví, který udrží kreativitu a zajistí návratnost investic, a jak zajistí rovnováhu mezi právní ochranou autorů a tvůrců a přístupem veřejnosti k dílům. V neposlední řadě bych rád dostal odpověď na otázku, jakým způsobem ovlivní jednání o smlouvě TTIP ochranu a rozvoj duševního vlastnictví z hlediska EU.

  Julia Reda, on behalf of the Verts/ALE Group. – Mr President, in December 2014 Commissioner Oettinger went on record to answer three questions I had tabled under Rule 130 regarding this current incarnation of the Commission’s group of experts on the enforcement of intellectual property rights. He announced he would have the list of members of this expert group published along with ‘all relevant documents, including agendas and minutes of each meeting’. So far, 13 out of the 28 Member State authorities remain unlisted in the register entry for this expert group. No minutes for the first and only meeting so far have been published. Meeting documents of this first meeting also remain unpublished.

So, while the answer to my parliamentary question came from Commissioner Oettinger and not from the Commissioner in charge, the open task remains the same. Therefore, do get serious on the transparency and proper record-keeping of this group. Will the Commission commit itself to deliver these basic requirements on a specific date?

Along with my fellow colleagues from the Committee on Legal Affairs, I agree that it is important that there is no duplication in the setting-up of this expert group and the OHIM Observatory. The Commission should also comment on such a possible overlap and the apparent disconnect of this expert group from its predecessors also set up by the Commission in previous years. The burden of proof is on the Commission to show that this expert group will go beyond the OHIM Observatory and its rather extensive mandate. If such an added benefit exists, it would rather call for the readjustment of the EU Observatory mandate.

So far no observer status has been given to Members of this Parliament but there are no procedural reasons not to, as Article 53 of the Commission decision on setting up these expert groups allows the Chair to assign observer status to every entity listed in Rule 8(3) of the horizontal rules for Commission expert groups. Therefore, the Commission should assign observer status to Parliament and it should do so immediately. The Committee on Legal Affairs will be happy to follow the work of this working group very actively.

Finally, I would like to know if the purpose of this expert group is about to go in the same direction as that of the OHIM Observatory, whose work programme for this year expressly includes the public domain and open licensing. It is very important when developing measures for intellectual property enforcement to analyse how they affect creative works in the public domain or under a free licence model.

  Laura Ferrara, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, un'adeguata e intelligente protezione dei diritti di proprietà intellettuale, che incentivi gli investimenti, l'innovazione e la creatività, costituisce uno strumento fondamentale per aiutare l'Europa ad uscire dalla crisi.

In tale contesto, le violazioni su scala commerciale dei diritti di proprietà intellettuale sono estremamente dannose e costituiscono un grande pericolo sotto molteplici punti di vista. Genera particolare allarme la circostanza che tali illeciti sono riconducibili prevalentemente alle organizzazioni criminali e alle mafie di tutta Europa, che dalla contraffazione ricavano proventi enormi. A subire i danni sono innanzitutto le imprese, che perdono ricavi e quote di mercato, lo Stato, in termini di mancate entrate tributarie, e, non ultimo, i cittadini, che mettono a rischio salute e sicurezza.

Sarebbe pertanto importante capire se il gruppo di esperti istituito dalla Commissione dispone di strumenti più incisivi rispetto a quelli dell'Osservatorio dell'UAMI per il contrasto delle violazioni sistemiche dei diritti di proprietà intellettuale e, inoltre, quali azioni concrete potrà promuovere o stimolare nella lotta contro gli illeciti contraffattori posti in essere dalle organizzazioni mafiose o paramafiose.

  Sabine Verheyen (PPE). - Herr Präsident, liebe Kolleginnen und Kollegen! Die Bekämpfung von Verletzungen der Rechte des geistigen Eigentums ist besonders für die Kultur- und Kreativwirtschaft von besonderer Bedeutung. Die Europäische Union ist in Sachen industrieller Innovation, neuem Design und kreativer Wirtschaft führend. Und damit dies auch in Zukunft so bleibt, muss die Zusammenarbeit bei der Bekämpfung von Verletzungen des geistigen Eigentums weiter fortgeführt und auch intensiviert werden. Aus diesem Grund begrüße ich grundsätzlich die im EU-Aktionsplan zur Durchsetzung der Rechte des geistigen Eigentums von der Kommission angekündigte Einsetzung einer Sachverständigengruppe zur Durchsetzung eben genau dieser Rechte und die Pläne, die Arbeit mit der Beobachtungsstelle, mit OHIM, weiter zu intensivieren.

Allerdings muss hier auch nochmal darauf hingewiesen werden, dass die klare Aufgabenstellung dieser neuen Expertengruppe sich nicht mit den hinzugezogenen Experten der Beobachtungsstelle überschneidet – auch hier gibt es ja bereits entsprechende Expertengruppen. Ich möchte an dieser Stelle auch unterstützen, dass die Einbeziehung auch von Vertretern des Parlamentes und der zuständigen Ausschüsse genau wie bei der Beobachtungsstelle von außerordentlicher Wichtigkeit ist.

Die Europäische Union kann es sich nicht leisten, dass ihre Kultur- und Kreativwirtschaft sowie ihre große Kreativindustrie unter den zum Teil massiven Verletzungen des geistigen Eigentums leiden. Es ist aus diesem Grunde von enormer Wichtigkeit, sich mit allen Akteuren auszutauschen und eben auch die Kultur- und Kreativschaffenden mit an den Tisch zu holen, auch in dieser neuen Expertengruppe. Es sollten Strukturen geschaffen werden, die es kleinen und einzelnen Akteuren erleichtern, ihre Rechte auch durchzusetzen. Wenn die Europäische Union ihre Vorreiterrolle als Innovationsstandort für neue Designs, Technik und Kultur behalten möchte, ist eine bessere Zusammenarbeit bei der Bekämpfung von Verletzungen des geistigen Eigentums auf allen Ebenen unabdingbar.

  Paul Rübig (PPE), Frage nach dem Verfahren der „blauen Karte“. – Herr Präsident! Meine Frage bezieht sich auf bilaterale Handelsabkommen. Welche Chancen sehen wir hier, diese Punkte anzusprechen und auch die europäischen Interessen durchzusetzen?

  Sabine Verheyen (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Ich denke, dass es sehr wichtig ist, dass wir die Abkommen bzw. die Vereinbarungen, die wir im Parlament getroffen haben, gerade auch bezüglich der Kreativwirtschaft und der kulturellen Aspekte in den Verhandlungen zum Beispiel zum internationalen Handelsabkommen TTIP, ausschließen und klarmachen, dass wir an dieser Stelle eine besondere Berücksichtigung unserer europäischen Besonderheiten haben wollen. Dies sollte auch in diesem Gremium beratend bei der Kommission mit zur Sprache kommen, dass wir hier auch an dieser Stelle die Position der europäischen Kreativschaffenden deutlicher und stärker mit berücksichtigen.

  Catherine Stihler (S&D). - Mr President, I too would like to thank the Committee on Legal Affairs for putting IPR enforcement on the agenda of this week’s plenary and to thank Commissioner Bieńkowska for her clear response on what the role of the expert group and the role of the Observatory will be.

To create a digital single market requires action on IPR enforcement, as consumers require complete trust in the goods which they are purchasing online and that they do not infringe IPR. If you consider that 39% of EU GDP, worth EUR 4.7 trillion annually, relates to IPR intensive industries, which account for 35% of all employment in the EU, those who commit IP crime deny revenue to national tax authorities, damage consumer trust and discourage entrepreneurs and SMEs from innovating and investing, particularly in the digital space.

I welcome the Commission’s initiative and the proposed ten-point plan on IPR enforcement and the clarity on what the Commission’s expert group will do and what the Observatory does in this field. I am pleased that the Commission will allow MEPs to observe their expert group and hope that the MEPs chosen will reflect the range of committees in this House which share an interest in IPR enforcement.

  Beatrix von Storch (ECR). - Herr Präsident, liebe Kollegen – die, die noch da sind! Wir reden heute über den Beschluss der Kommission zur Einsetzung einer Expertengruppe für die Durchsetzung von Immaterialgüterrechten. Dazu zwei Anmerkungen: Wir haben einen gemeinsamen Binnenmarkt. Das ist gut, und das ist wichtig, und daran will auch niemand rütteln. Aber was wir eben auch haben, ist ein Amt dafür: das Harmonisierungsamt für den Binnenmarkt. Dort ist der Schutz der Immaterialgüterrechte bereits angesiedelt. Wenn die Kommission jetzt also eine weitere Expertengruppe einsetzt, genau für dieses Thema, dann erinnert das an ein beliebtes Spiel. Auf Deutsch sagt man dazu: „Wenn du nicht mehr weiter weißt, dann gründe einen Arbeitskreis.“

Es erscheint so, als weiß die eine Hand nicht, was die andere tut. Oder noch schlimmer: Die eine Hand weiß gar nicht, dass es die andere gibt. Wenn es das hier in diesem Fall nicht ist, dann will ich das eigentliche Problem ansprechen, dass es weniger die Schaffung von Doppelstrukturen ist, um die es hier offensichtlich geht. Wir haben alle, glaube ich, nicht verstanden, was die Kommissarin uns hier auseinandergesetzt hat, warum es keine Doppelstruktur ist. Auf jeden Fall, bei mir ist das nicht angekommen.

Das Problem ist, dass wir, wenn wir die Zustimmung der Bürger für die Europäische Union steigern wollen, nicht mehr Arbeitskreise und Ämter schaffen sollen, sondern abschaffen müssen.

  Bill Etheridge (EFDD), blue-card question. – I was really interested in your speech. I am a new person here, I was only elected in May, but the thing that I have noticed, and I wonder if you would agree, is that the main thing this place is really good at is creating new committees, new bureaucracy and new ways of shuffling paper rather than actually attending to some efficient business. Would you agree that that is the main strength of this place?

  Beatrix von Storch (ECR), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Ja, ich würde denken, in dem Sinne Ihrer Frage ist das sicherlich ein weiterer wichtiger Beitrag dazu. Es werden weitere Gremien geschaffen. Die Bürger fragen sich, wozu sind die da. Das steigert den Frust der Bürger in der Europäischen Union gegen eben diese, und die Frau Kommissarin hat ja eben gerade versucht, uns zu erklären, was der Unterschied ist zwischen der bestehenden Gruppe, dem bestehenden Amt, und dem neu geschaffenen Expertenamt oder der Expertengruppe. Wenn ich jetzt in die Runde fragen würde: Wer kann das definieren? Ich glaube, keiner kann genau sagen, was eigentlich der Unterschied ist zwischen dem neu geschaffenen Amt und dem schon bestehenden Amt. Insofern ein weiterer Frust.

  Javier Couso Permuy (GUE/NGL). - Señor Presidente, también hay que dar las gracias a los señores Svoboda, Cavada y Dzhambazki por haber abierto este debate en torno a la propiedad intelectual y su protección.

Lo que pasa es que el enfoque de la pregunta pasa por alto el verdadero problema, porque, para tener un debate global, deberíamos estar hablando de la garantía del acceso universal a la cultura, de la vulneración del derecho a la privacidad en internet, de la libertad de expresión —tengo que decir que en mi país, España, se pueden cerrar páginas web sin orden judicial— o de la falta de apoyo a los creadores, mientras se hacen leyes para favorecer a las grandes empresas distribuidoras.

Abramos un debate integral que hable de que las empresas se hagan cargo del coste por el canon para que sean justamente retribuidos los creadores; discutamos sobre la entidad encargada de defender los derechos de autor —que, a nuestro juicio, debería ser una entidad pública que garantice el acceso a la cultura—, y demos un impulso a los métodos alternativos, como las licencias Creative Commons, para que los autores decidan cómo quieren explotar su trabajo.

  Isabella Adinolfi (EFDD). - Signor Presidente, onorevoli colleghi, signora Commissario, l'applicazione delle regole a protezione della proprietà intellettuale rappresenta un aspetto fondamentale per la realizzazione del mercato unico digitale.

Al riguardo, prescindendo da quelli che sono i compiti specifici che verranno assegnati al gruppo di esperti, vorrei fare una considerazione di carattere generale. Ritengo che l'attività e i compiti di questo gruppo debbano essere guidati ed ispirati al rispetto e alla tutela delle libertà e dei diritti sanciti dalla Carta dei diritti fondamentali dell'Unione europea, nonché dalle Costituzioni nazionali, naturalmente.

Dico ciò pensando a quello che è accaduto, e continua purtroppo ad accadere, in Italia con l'AGCOM, l'autorità amministrativa cosiddetta indipendente, che a dispregio di basilari diritti fondamentali, come la libertà di espressione e il diritto di cronaca e di difesa, applica in maniera pedissequa il regolamento in materia di tutela del diritto d'autore sulle reti di comunicazione elettronica da essa stessa emanato.

I diritti e le libertà fondamentali sono la condizione indispensabile per la tutela della proprietà intellettuale e la realizzazione del mercato unico digitale.

  Daniel Buda (PPE). - Domnule Președinte, doamnă comisar, doamnelor și domnilor colegi, proprietatea intelectuală a fost și va fi una dintre prioritățile Uniunii Europene, evoluția societății umane având ca fundament creativitatea și inventivitatea.

Industriile de profil contribuie cu aproximativ 38,6 % la produsul intern al Uniunii Europene, iar apărarea acestor drepturi are ca scop promovarea capacității oamenilor de a crea concepte și valori care duc la dezvoltarea economică a societății și la creșterea numărului locurilor de muncă.

Europa însăși este atractivă pentru investitori datorită cadrului legislativ care păstrează și promovează drepturile de proprietate intelectuală.

Salut și încurajez orice demers inițiat la nivelul Uniunii Europene venit în acest sens.

Sarcinile atribuite Oficiului pentru Armonizare în cadrul Pieței Interne și crearea Observatorului aduc plusvaloare procesului de creare a unei colaborări eficiente și coordonate la nivel național, european și mondial, având ca scop combaterea încălcării drepturilor de proprietate intelectuală și dezvoltarea sectoarelor creative din Uniunea Europeană. Cu toate acestea, sunt de părere că trebuie evitate posibilele suprapuneri ale responsabilităților Observatorului cu cele trasate în sarcina grupului de experți.

Susțin instituirea unui cadru funcțional simplificat, prin stabilirea clară a atribuțiilor celor două entități pentru eficientizarea activității și utilizarea responsabilă a capitalului uman și material și, nu în ultimul rând, pentru reducerea costurilor inutile.

Am convingerea că atât Parlamentul, cât și Comisia vor susține în continuare armonizarea progresivă a acestui sector.

  Γιώργος Γραμματικάκης (S&D). - Κύριε Πρόεδρε, εγώ πρώτα απ’ όλα θα πάρω 10 δευτερόλεπτα από την αρχή για να συμμεριστώ την αγωνία του συναδέλφου μου Μανώλη Γλέζου για την τραγωδία που ζει η Ελλάδα, για την ανάγκη να στηριχθεί η Ελλάδα, γιατί αλλιώς θα είναι και αγωνία της Ευρώπης.

Έχω την τιμή να είμαι εισηγητής του Σοσιαλιστικού Κόμματος (ο Πρόεδρος διακόπτει τον ομιλητή για να του υπενθυμίσει ότι πρέπει να είναι όρθιος όταν ομιλεί) στην Επιτροπή Πολιτισμού σχετικά με το σπουδαίο αυτό θέμα, δηλαδή τα θέματα της πνευματικής ιδιοκτησίας, ιδιαίτερα σ’ αυτή την περίοδο της οικονομικής κρίσης. Δεν θα επαναλάβω όσα είπαν οι συνάδελφοι αλλά ομολογώ ότι, ενώ ορισμένες από τις απαντήσεις ήταν ικανοποιητικές, εξακολουθούν να είναι θολές στα εξής κύρια θέματα –και έτσι εξακολουθούν οι ανησυχίες μου–:

Σε ποιο στάδιο βρίσκεται η σύσταση αυτής της ομάδας των εμπειρογνωμόνων; Ποιο είναι το σχετικό χρονοδιάγραμμα, αν υπάρχει; Με ποια κριτήρια γίνεται η επιλογή των εμπειρογνωμόνων; Βασικά ερωτήματα! Ποιες είναι οι προγραμματισμένες συναντήσεις;

Και τέλος, –και εδώ υπάρχουν ερωτήματα– ποιο θα είναι το πλαίσιο συνεργασίας αυτής της ομάδας εμπειρογνωμόνων με τις αρχές των κρατών μελών; Θα υπάρχει πλήρης διαφάνεια;

  Pablo Echenique (GUE/NGL). - Señor Presidente, nuestras leyes consagran la propiedad privada como uno de los pilares fundamentales de nuestra convivencia. Esto estará muy bien, pero hay otros derechos que a veces colisionan con este y, además, no todas las propiedades privadas se respetan por igual. En mi país, por ejemplo, si una familia humilde no puede pagar la hipoteca, se respeta la propiedad privada del banco, y la familia se va a la calle. Sin embargo, si una gran corporación quiere construir una presa en un valle y recrecer un pantano, se expropian pueblos enteros y no pasa nada.

Con la economía de la información y el conocimiento pasa lo mismo. La propiedad intelectual puede ser un buen principio general, pero no puede servir para impedir que los enfermos de hepatitis C reciban la medicación que necesitan con urgencia. No puede servir para que a las personas con discapacidad visual se les impida acceder a obras escritas, en clara violación del Tratado de Marrakech. La economía y los principios que la sustentan deben estar al servicio de las personas, y no al revés.

  Rosa Estaràs Ferragut (PPE). - Señor Presidente, efectivamente en el año 2012 se creó el Observatorio Europeo de las Vulneraciones de los Derechos de la Propiedad Intelectual como una red de expertos y de partes interesadas, y se reguló este Observatorio por reglamento. Se intentaba sin duda proteger los derechos de propiedad intelectual. La Oficina de Armonización del Mercado Interior era la encargada de financiar las actividades de este Observatorio.

Ahora, según se decidió en septiembre del año 2014, parece que se va a crear de manera complementaria un grupo de expertos —como nos ha dicho la Comisaria— con un cometido político pero complementario; pero es muy oportuna la pregunta para poder hacer un llamamiento a evitar la duplicación de funciones, dado que el dinero público es escaso y, por lo tanto, queremos recalcar que no debe existir duplicidad.

El Observatorio tiene la labor de aconsejar y ayudar a las autoridades nacionales, sensibilizar sobre este tema y, en definitiva, sobre su labor propiamente dicha.

Acabo diciendo que, efectivamente, España ratificó el Tratado de Marrakech, que es muy importante para las personas con discapacidad visual, aunque comprendo que no tiene nada que ver con el tema que hoy nos ocupa.

  Victor Negrescu (S&D). - Comisia Europeană a creat acest grup de experți. Mă întreb, însă, de ce mai era nevoie de acest grup, dacă avem deja un plan de acțiune clar și precis pentru protejarea dreptului la proprietate intelectuală. Dacă totuși avem această echipă de experți, atunci solicit Comisiei să utilizez acești specialiști pentru a accelera implementarea soluțiilor propuse și să nu mai tergiverseze o acțiune concretă.

Avem mai degrabă nevoie de un calendar clar de acțiune. Sunt trei direcții clare în domeniu: informarea consumatorilor, sprijinirea și protecția inovației, blocarea distribuției produselor copiate. Fără o acțiune imediată, companiile inovative europene pierd fonduri importante. Cercetătorii creativi părăsesc Europa pentru că ideile lor nu sunt protejate sau susținute, cum este cazul antreprenorilor digitali, iar cetățenii sunt păcăliți de produse care de multe ori nu respectă normele privind protecția consumatorilor. Nu uitați, când vorbim de proprietate intelectuală, vorbim de un drept și solicit Comisiei Europene să nu caute alte soluții când ar trebui, în mod normal, să acționeze direct.

F'dinja diġitali, infurzar traskurat fil-konfront ta' vjolazzjoni fuq skala kummerċjali tagħmel ħafna ħsara. Meħud kont tal-importanza soċjali u ekonomika li ġġorr magħha l-protezzjoni tal-IPR, hija meħtieġa koperazzjoni aktar effettiva u msaħħa bejn il-partijiet interessati f'kull livell iżda mhux duplikazzjoni ta' rwoli jew gruppi paralleli. L-Ewropa dejjem sabet il-forza tagħha fl-unità u mhux fil-frammentazzjoni.

  Milan Zver (PPE). - Rad bi se zahvalil kolegu Svobodi in skupini, ki predlaga ustanovitev ekspertne komisije, ki bo skupaj z opazovalnim odborom ustrezno uredila to področje. Želim, da bo v njej tudi član Odbora za kulturo Evropskega parlamenta.

Dobro je, da Evropska komisija želi izboljšati uveljavljanje pravic intelektualne lastnine. A kot so moji kolegi že opozorili, tudi želim, da različne inštitucije v okviru Evropske komisije ne bi podvajale svojih nalog, svojega dela.

Skupina za intelektualno lastnino ne sme opravljati istih nalog, kot se že opravljajo. Vprašanje intelektualne lastnine je pomembno, med drugim tudi zato, ker pomembno vpliva na napredek Evropske unije na področju enotnega digitalnega trga, ki lahko v naslednjih letih prinese najmanj 220 tisoč novih delovnih mest.

S pravilno zaščito intelektualne lastnine lahko zmanjšamo uvoz nezakonitih proizvodov. Paziti pa moramo, da s tem ne povečamo birokratskih bremen za podjetja.

Z varovanjem pravic intelektualne lastnine, na primer s patenti, blagovnimi znamkami, lahko zagotovimo, da družbe, izumitelji in ustvarjalci pridobijo ustrezen zaslužek za svoje intelektualno delo.

A ne smemo pozabiti, da mora biti vse, ali pa čim več, kar je ustvarjeno v družbi, kar človeštvo ustvari, tudi dostopno, na drugi strani, ljudem.

  Alessia Maria Mosca (S&D). - Signor Presidente, onorevoli colleghi, non aggiungo altre osservazioni sull'importanza della tutela della proprietà intellettuale per la competitività del nostro sistema. Supporto anche io e condivido questa interrogazione orale, anche perché sottolinea la necessità di rendere sempre quanto più coerenti possibile le azioni d'implementazione delle proprie strategie. Aggiungo che questa coerenza deve essere garantita anche tra l'azione interna e l'azione esterna dell'Unione europea, con le dovute accezioni che sono state già richiamate durante questo dibattito.

La Commissione ha pubblicato nel luglio 2014 la nuova strategia di tutela della proprietà intellettuale nel rapporto con i partner commerciali terzi, su cui il Parlamento europeo sta predisponendo una propria relazione d'iniziativa, che include la tutela dei marchi, dei brevetti e delle indicazioni geografiche.

Chiediamo quindi alla Commissione, nel rispondere a questa interrogazione, anche di specificare quali strumenti intenda mettere in campo per garantire che la proprietà intellettuale sia garantita non solo nel mercato interno ma anche nel rapporto con i partner terzi.

  Evelyn Regner (S&D). - Herr Präsident, sehr geehrte Frau Kommissarin! Sie haben es jetzt schon vielstimmig gehört: Es geht um geistiges Eigentum, es geht um Copyright, es geht um ein Thema, bei dem viele Unternehmen sehr viel Geld im Spiel haben. Es gibt da schon wirklich gewaltige kommerzielle Interessen. Deshalb macht es natürlich Sinn, sich dieses Themas genauer anzunehmen. Es geht um ein Gegenwarts- und noch mehr um ein Zukunftsthema. Deshalb macht es Sinn, jetzt auch eine Expertengruppe einzusetzen.

OHIM als Agentur hat natürlich sehr wertvolle Aufgaben. Allerdings gilt es, diese Aufgaben zu ergänzen. Und diese Expertengruppe ist nicht eine „L’art pour l’art“ oder ein zusätzlicher Arbeitskreis, muss allerdings in ihrem Mandat klar eine Aufgabe bekommen. Da ist es ganz besonders wichtig, dass das Europäische Parlament eine Kontrollfunktion hat, dass hier gleichberechtigt entsprechend eine Teilnahme in der Expertengruppe möglich ist und damit das Europäische Parlament auch seine Checks-and-balances-Aufgabe wahrnehmen kann. Da macht das Ganze Sinn.

  José Blanco López (S&D). - Señor Presidente, yo también me quiero sumar a los que piden redoblar los esfuerzos en la lucha contra la vulneración de los derechos de propiedad intelectual. Sobran duplicidades administrativas y lo que falta es eficacia, precisamente para garantizar los derechos de autor.

El sector de la cultura es primordial para el desarrollo económico y para la imagen de la Unión Europea y de sus Estados miembros; un sector que genera un 6,5 % del producto interior bruto y muchísimo empleo. Son necesarios marcos regulatorios claros. No se pueden seguir devaluando los derechos de autores y artistas, de forma contradictoria, muchas veces, con la legislación comunitaria. Son necesarios marcos claros que impidan ataques como los recibidos en países como el mío, España, que impone una ley de propiedad intelectual sin diálogo, de dudosa constitucionalidad y que vulnera, con toda seguridad, la normativa europea.

  Nicola Caputo (S&D). - Signor Presidente, onorevoli colleghi, sostenere la lotta contro le violazioni dei diritti di proprietà intellettuale rappresenta un'ineludibile priorità specie in una società interconnessa come quella odierna. È infatti agevole assistere a una progressiva riduzione della privacy nelle comunicazioni, così come nello scambio di informazioni digitali tra consumatori e detentori di banche dati, dati che vengono raccolti e utilizzati anche all'insaputa dei legittimi proprietari.

Sono quindi favorevole alla creazione di una sempre maggiore sinergia con le attività svolte da tale autorità, purché venga mantenuto e rispettato il criterio dell'efficienza ed economicità.

Sono altresì favorevole all'eventuale partecipazione alle attività da parte del Parlamento, con l'invito di esperti alle riunioni in veste di osservatori per agevolare lo scambio delle migliori pratiche, e sono convinto della necessità che venga approntata, da parte delle autorità riceventi i dati, ogni misura regolamentare, tecnica e operativa necessaria a garantire la protezione delle informazioni riservate in questione.

  Angelika Niebler (PPE). - Herr Präsident, verehrte Frau Kommissarin, liebe Kolleginnen und Kollegen! Es ist ganz wichtig, die Leistungen unserer kreativen Köpfe in ganz Europa zu schützen. Insofern bin ich für einen starken Urheberrechts-, Patentrechts- und Markenrechtsschutz und denke, dass die Einrichtung der Expertengruppe letztes Jahr eine sinnvolle Idee war.

Jetzt haben wir aber festgestellt, dass natürlich auch das Markenamt in Alicante sich dieser Aufgabe annimmt. Wir haben eine neue Kommission, die sich zum Ziel gesetzt hat, Bürokratie abzubauen, schlanke Strukturen zu fördern, und deshalb glaube ich, dass man auf diese Doppelstruktur, die es jetzt gibt, verzichten kann.

Die Expertengruppe ist überholt. Wir werden uns im Parlament ja auch in den nächsten Wochen und Monaten intensiv mit der Frage beschäftigen, wie wir vor allen Dingen das Urheberrecht weiterentwickeln in diesem vereinten Europa, im Hinblick auch auf die Digitalisierung unseres Lebens, unserer Wertschöpfungsketten. Hier müssen wir die Diskussion führen und nicht die Expertengruppe. Insofern glaube ich, dass wir auf die Expertengruppe verzichten können.

Ein Dankeschön an unseren Vorsitzenden im Rechtsausschuss, der diese Debatte angestoßen hat. Ich glaube, es ist notwendig, hierüber zu diskutieren.

  Ivan Jakovčić (ALDE). - Gospodine predsjedniče, radna grupa, komisija, koja je ustanovljena od eksperata definitivno nam je potrebna. Ne prihvaćam teze da nije potrebna, zato što je upravo kreativnost, intelektualno vlasništvo, ali nažalost šarenilo donekle u zakonodavstvu, a pogotovo u praksi je europski problem. Imamo jedinstveno tržište, al nemamo do kraja raščišćeno intelektualno vlasništvo i nemamo do kraja raščišćena autorska prava i način njihove zaštite.

Zato plediram da s jedne strane pravni dio, a s druge strane praksa, postanu jedinstveni u Europi zbog našeg jedinstvenog tržišta. Kreativnost Europe i ono što mi imamo u Europi je uvijek bilo naše, možda i najveće, bogatstvo. Kreativnost i intelekt koji imaju naši umjetnici, koji imaju naši proizvođači, koji imaju naši kreatori je nešto što gotovo nitko drugi u svijetu praktički nema. Na tome je Europa izgradila svoju ekonomiju i mislim da je treba i dalje graditi na tome.

  Νότης Μαριάς (ECR). - Κύριε Πρόεδρε, το θέμα που συζητούμε είναι πραγματικά σοβαρό. Αλλά οι απαντήσεις που πήραμε από την Επιτροπή δεν είναι ξεκάθαρες και μάλλον έχουν περιπλέξει τα ζητήματα.

Η πνευματική ιδιοκτησία είναι δεδομένο ότι συμβάλλει στην ανάπτυξη της οικονομίας, στηρίζει την οικονομία της γνώσης, που θέλουμε όλοι να έχουμε στην Ευρωπαϊκή Ένωση, στηρίζει την ψηφιακή αγορά και βεβαίως στηρίζει και τις επενδύσεις στην έρευνα. Ταυτόχρονα υπάρχει αθέμιτος ανταγωνισμός από τρίτες χώρες, από διάφορους κύκλους οι οποίοι παραβιάζουν τα δικαιώματα προστασίας της πνευματικής ιδιοκτησίας.

Οι εξελίξεις σίγουρα τρέχουν και πρέπει να τις παρακολουθεί κανείς από κοντά, για να μπορεί να παίρνει τις πρωτοβουλίες που χρειάζονται. Είναι σίγουρο όμως ότι ο τομέας αυτός της προστασίας της πνευματικής ιδιοκτησίας ανήκει κατ’ αρχάς στα κράτη μέλη και πρέπει να υπάρχει συντονισμός μεταξύ των κρατών μελών.

Νομίζω ότι η ομάδα εμπειρογνωμόνων αποκτά σημαντική εξουσία και περιορίζει τις αρμοδιότητες του Παρατηρητηρίου του Αλικάντε. Πρέπει να πάρει επιπλέον ρόλο και το Ευρωπαϊκό Κοινοβούλιο.

  Maria Grapini (S&D). - Domnule Președinte, protejarea drepturilor de proprietate intelectuală și a drepturilor de autor este extrem de importantă și mă bucur că astăzi avem discuția aici, în Parlament.

Nu am înțeles însă, doamnă comisar, și poate în răspunsuri ne spuneți, grupul de experți s-a gândit sau v-ați gândit să avem instrumente specifice? Pentru că una este să protejezi un desen industrial, o creație în industrie și alta este să protejezi o creație literară, de film, de muzică, de teatru. Știm foarte bine că acum, când vorbim, se piratează foarte mult în domeniul filmului, în domeniul creației artistice, al muzicii. Acești oameni au un cost și nu-și pot recupera, practic, investiția făcută și, evident, munca lor.

V-ați gândit să găsiți instrumente specifice pentru fiecare domeniu?

Și să nu uităm, doamnă comisar, am spus-o încă de la audierea comisarilor: este nevoie să reglementăm și să avem și măsuri de apărare comercială în interiorul pieței Uniunii Europene; de multe ori reglementăm excesiv în interior și lăsăm în afară, fără nicio barieră, intrarea produselor în piața Uniunii Europene.

  Elżbieta Bieńkowska, Member of the Commission. - Mr President, honourable Members, I would like to thank you for your questions and remarks. We have listened very closely and carefully to them.

It has to be said that the issue of the enforcement of IPR is only a part of the broader action of the Commission on the modernisation of the IPR framework at EU level. The question which should be answered first is that concerning duplication of group experts in the Office for Harmonisation in the Internal Market (OHIM).

Ms Regner, I would like to thank you very much because you were very much to the point. First, the OHIM agency, according to the mandate, cannot advise the Commission. The agency is working on the current issues and cases. It is collecting data. We need to have a body consisting of the Member State experts to advise us for the future and on the next steps to take. It is much broader than just focusing, as the agency is doing, on the current ongoing cases and day-to-day work. It should also be said – for example to Mr Dzhambazki but many of you asked about it – that no new money has been dedicated to the activities of the expert group.

Secondly, Mr Köster asked about the mandate. It is of course public and available online. This is a Commission decision. We can provide each one of you with the information if necessary.

In responding to Ms Reda, of course the minutes are also public. There has been only one meeting of the expert group and the minutes have not yet been adopted. According to the mandate, they will of course be transparent and published as soon as the whole documentation provided by Member States and adopted by the group is available.

Thank you very much for your remarks on the cultural sector. This is of course extremely important and will be discussed as a part of the digital single market. This is part of copyright reform. The Commission is very aware of the sensitivities of the copyright reform and IPR will be an important part of the digital single market strategy, while the discussion on copyright reform is of course in line with this.

Regarding the concrete mechanism we will provide, the first thing is the copyright review and then we have to go through the IPR Enforcement Directive and look at why it is not working. It was approved in 2004. Then we will work on the trademark package and the trademarks and trade secrets. Let me remind you that there is ongoing legislative reform on the trademarks and trade secrets which will help companies better to protect their innovations.

To conclude, after the few measures dealing with current issues, the expert group will advise us in what way we need to go further. Only two Member States have not appointed their experts to the expert group, not thirteen. Members of the European Parliament are invited to participate in the expert group meetings and we count on your expertise on this.

In the coming months we will all be focused on the implementation of the ten-point action plan. The expert group was one of the points of the action plan.
