  Puhemies. – Esityslistalla on seuraavana Antonio Tajanin talous- ja raha-asioiden valiokunnan puolesta laatima mietintö ehdotuksesta Euroopan parlamentin ja neuvoston direktiiviksi maksupalveluista sisämarkkinoilla, direktiivien 2002/65/EY, 2013/36/EU ja 2009/110/EY muuttamisesta ja direktiivin 2007/64/EY kumoamisesta (COM(2013)0547 – C7-0230/2013 – 2013/0264(COD)) (A8-0266/2015).

  Antonio Tajani, Relatore . Signora Presidente, onorevoli colleghi, Vicepresidente della Commissione, domani approveremo il testo di compromesso sulla nuova direttiva sui servizi di pagamento nel mercato interno.

Questa direttiva si aggiunge al regolamento sulle commissioni interbancarie di cui è stato relatore l'onorevole Zalba e completa il pacchetto di proposte legislative sul mercato europeo dei pagamenti presentato dal commissario Barnier durante la scorsa legislatura, pacchetto che ho condiviso e sostenuto anche nella mia veste precedente di Vicepresidente della Commissione europea.

Il compromesso finale ha ricevuto il sostegno di tutti i gruppi politici ed è stato approvato all'unanimità in commissione ECON. Ringrazio quindi la squadra negoziale del Parlamento europeo che, sotto la guida del presidente Ferber, ha raggiunto ottimi risultati durante i difficili negoziati con il Consiglio. Ringrazio altresì tutti i relatori ombra che hanno attivamente contribuito alla redazione di un buon testo legislativo.

In Europa, il mercato dei pagamenti al dettaglio è dinamico e si è molto rinnovato rispetto agli ultimi anni. Il 34% dei cittadini europei compie ormai quasi esclusivamente acquisti online e oltre il 50% possiede uno smartphone che gli garantisce accesso al mondo dei pagamenti tramite dispositivo mobile. Per alcuni comparti dell'economia, ad esempio il settore dei viaggi, la maggior parte delle vendite avviene ormai solo via Internet.

Il provvedimento che stiamo per approvare regolerà i servizi di pagamento via Internet, ovvero quei servizi che intervengo nel rapporto tra esercente e banca dell'acquirente, permettendo di effettuare pagamenti senza carta di credito. Le nuove norme disciplineranno anche l'attività dei servizi di informazione sui conti correnti. Questi servizi forniscono all'utente informazioni online aggregate su uno o più conti utilizzati per effettuare i pagamenti. Si tratta di un servizio che permette soprattutto a piccole imprese ed artigiani di avere un quadro generale della propria situazione finanziaria in qualsiasi momento.

L'accordo finale permetterà anche di ridurre il rischio di frodi. Tutti i fornitori di servizi di pagamento saranno infatti obbligati ad adottare tecnologie di comunicazioni sicure, autenticate o criptate, che saranno regolarmente valutate e aggiornate dall'Autorità bancaria europea. I principali beneficiari della nuova direttiva però saranno i consumatori, i quali potranno usufruire di costi ridotti e di una maggiore tutela giuridica.

Inoltre, grazie agli emendamenti proposti dal Parlamento europeo ed adottati i consumatori avranno una serie di vantaggi: primo, riceveranno gratuitamente informazioni sulle transazioni effettuate; secondo avranno diritto a un rimborso incondizionato nel caso di frodi e pagamenti non autorizzati. Inoltre con questa direttiva risolviamo i problemi che cittadini e imprese incontrano tutti i giorni quando effettuano pagamenti online o via dispositivo mobile.

Apriamo il mercato altresì a nuovi operatori e riduciamo i costi di un sistema troppo frammentato e caro, il cui costo complessivo oggi ammonta a circa 130 miliardi di euro l'anno. La nuova direttiva che domani il Parlamento approverà in via definitiva rafforzerà la competitività del mercato europeo dei pagamenti, incentivando l'innovazione e la sicurezza in un settore che è in continua trasformazione. Considerata la crescita esponenziale del commercio elettronico, le nuove regole daranno un impulso decisivo allo sviluppo di un mercato unico sempre più vicino alle esigenze di consumatori e imprese.

  Jyrki Katainen, Vice-President of the Commission. Madam President, I would like to acknowledge the effort and hard work of Vice-President Tajani in achieving a balanced, fair and forward-looking text that will allow for innovation and greater choice for consumers. I also wish to thank the shadow rapporteurs for their diligent and dedicated work: Olle Ludvigsson, Sophia in ’t Veld, Ashley Fox, Eva Joly, Matt Carthy and Marco Valli.

Payments, particularly cross-border internet payments, are essential for our single market. What is happening in the field of payments is a striking illustration of digital revolution. The original Payments Service Directive (PSD I) was adopted in 2007 and has proved to be an enormous success. It has brought real benefits to all stakeholders, especially consumers, with faster payments and clear refund rights, and it provided the legal basis for the Single European Payments Area.

However, financial services have evolved since 2007. When the first PSD was adopted it created an opportunity for banks to provide payment services. These new players developed significantly to the extent that they are often the main innovators on the market. Now our mobile phone, our banking applications or a third-party provider may well be our favourite way of making payments.

Digitisation, new players and new processes have brought real benefits to European citizens, but also new risks, notably in terms of security issues that have to be addressed. This is why the revision of the original Payment Services Directive is particularly timely.

What does the second Payment Services Directive (PSD II) bring to the European payments market? Firstly, it allows for further technological developments and new market entrants while increasing security of payments to prevent fraud. Secondly, it introduces enhanced consumer protection, for example in the case of loss or theft of a payment card. Thirdly, taken together with the regulation on interchange fees adopted in May 2015, it reduces costs for both retailers and consumers and contributes to the creation of genuine EU-wide payment markets.

New, safer and cheaper services have emerged in the area of internet payments. These services have developed massively in some Member States, overtaking cards for internet payments, and I trust this will rapidly happen elsewhere. Other services known as account information services allow consumers to have a global view of their financial situation and thus help budgeting and financial planning.

The creation of a level playing field for newcomers and incumbents alike will ensure that all actors operate to the same standards under the same authorisation and licensing procedures. This directive represents a major step forward for the payments market in Europe. High security standards will need to be implemented by all payment services providers for electronic payment transactions. At the same time, security should not unnecessarily impair convenience. Some flexibility will be possible, in particular for low-value and low-risk payment situations. It will be the task of the European Banking Authority (EBA) task to prepare draft regulatory technical standards on security and the authentication of customers.

The Directorate-General for Financial Stability, Financial Services and Capital Markets Union (DG FISMA) will work with Member States to ensure consistent transposition across the European Union and will hold transposition workshops starting early next year, 2016.

I am very satisfied that the main objectives – competition, innovation and the development of the internal market in payments – are fully met in this text. I hope we have a very fruitful discussion, and once more I want to thank this House for the work done under the leadership of Vice-President Tajani.

  Pablo Zalba Bidegain, en nombre del Grupo PPE.Señora Presidenta, vicepresidente Katainen, señorías, como bien ha dicho el vicepresidente Tajani, esta Directiva complementará el trabajo realizado en el Reglamento, del cual tuve el honor de ser ponente. Por tanto, permítanme, en primer lugar, felicitar al ponente, mi querido amigo Antonio, por el gran trabajo realizado, así como a los ponentes alternativos. También me gustaría agradecer el trabajo que, en la pasada legislatura, hizo nuestro antiguo colega Diogo Feio al respecto y, por supuesto, como ha dicho el vicepresidente Tajani, el trabajo que realizó el comisario Barnier.

Cuando empecé a trabajar en el Reglamento de las tasas de intercambio, nos marcamos una serie de objetivos. En primer lugar, incrementar la transparencia en todo el proceso de pagos con tarjeta. En segundo lugar, que los ciudadanos europeos pagaran menos comisiones cuando pagasen con sus tarjetas de crédito. En tercer lugar, buscar aumentar los pagos con tarjeta, lo que contribuiría a luchar contra el fraude fiscal. Un cuarto objetivo, sin duda alguna, era fortalecer el mercado único. Y por último, como bien ha dicho Antonio, fomentar y promover la innovación en un campo como el de los medios de pago, donde continuamente estamos viendo nuevas e innovativas fórmulas de pago.

Hoy podemos decir que, una vez que se implemente esta Directiva, complementada con el Reglamento de tasas de intercambio, estos objetivos, sin duda alguna, se van a cumplir. Por tanto, queridos colegas, podemos estar satisfechos.

  Olle Ludvigsson, för S&D-gruppen. Fru talman! Jag ser positivt på den uppgörelse om betaltjänstdirektivet som vi ska rösta om i morgon. Förhandlingarna har varit hårda. Jag hade föredragit ett starkare inre marknadsperspektiv och ett ännu starkare konsumentperspektiv. Sett till helheten är dock den slutgiltiga kompromissen riktigt bra.

Jag skulle vilja peka på tre förbättringar som de nya reglerna för med sig. För det första kommer konkurrensen att skärpas. Olika typer av bankoberoende aktörer kommer att kunna konkurrera med bankerna på ett mer rättvist och rimligt sätt.

De så kallade tredjepartsaktörerna, som erbjuder betalningsinitiering eller kontoinformation, ska inkluderas i regelverket på i princip samma villkor som alla andra. Det skapar säkerhet och trygghet för konsumenterna. Samtidigt ger det dessa aktörer det tillträde som de behöver för att affärsmodellen ska kunna fungera. Bankerna ska inte kunna hindra dem från att leverera sina tjänster.

Därutöver ska även bankoberoende betalningssystem ges mer schyssta förutsättningar. Nya informationskrav ska säkerställa att sådana system ska fungera mer effektivt.

Allt detta kommer att ge en mer hälsosam konkurrenssituation på betalmarknaden. Det kommer i sin tur att gynna såväl konsumenten som samhället i stort.

För det andra kommer lagstiftningen att främja innovation när det gäller både teknologiska framsteg och affärsmodeller. Detta blir en viktig effekt av att dörrarna för nya aktörer öppnas upp.

Vi ser nu hur den digitala revolutionen sveper även över betalmarknaden. Allt talar för att mycket kommer att hända under de närmaste åren. Det uppdaterade direktivet kommer att fungera som en stabil grund för denna utveckling. Massor av konsumenter kommer att kunna dra nytta av bättre betaltjänster. Det tycker jag faktiskt är helt utmärkt.

För det tredje kommer de nya reglerna även i andra avseenden att stärka konsumenternas roll. Det handlar till exempel om betydligt snävare bestämmelser för tilläggsavgifter, om striktare krav på företag vad gäller transaktioner där slutbeloppet inte först är känt samt om att reducera ansvaret för ärliga konsumenter vid icke-auktoriserade transaktioner.

Sammantaget är slutsatsen tydlig. På en mer konkurrensutsatt marknad och innovativ marknad kommer det att bli enklare, billigare, tryggare för konsumenten att betala. Det är helt klart ett steg i rätt riktning.

Jag vill också passa på att tacka föredraganden och alla skuggföredragandena för ett utmärkt samarbete under denna process.

  Stanisław Ożóg, w imieniu grupy ECR. Pani Przewodnicząca! Uważam, że cel działania, którym jest dostosowanie dotychczas obowiązujących przepisów do dynamicznie zmieniającego się rynku płatności elektronicznych, został osiągnięty. Nowa dyrektywa nie tylko gwarantuje uregulowaną sytuację prawną dla wielu nowo powstałych form płatności, zwiększa bezpieczeństwo konsumenta, który tych płatności dokonuje, ale przede wszystkim reguluje w wielu przypadkach sytuację odpowiedniej konkurencji na rynkach płatniczych, oferując wszystkim operatorom na rynku równe szanse. Szczególnie doceniam tutaj fakt, że w pracach nad tym tekstem i Parlament, i Rada starały się być ostrożne, aby wprowadzić przepisy, które są neutralne technologicznie.

  Cora van Nieuwenhuizen, namens de ALDE Fractie. Misschien hebben sommigen in deze zaal het ook wel eens meegemaakt. Ik wilde kortgeleden op een website vanuit een andere lidstaat een aankoop doen met een Nederlandse kredietkaart en die betaling werd geweigerd omdat ik geen kredietkaart gebruikte uit het land van die website. Niet alleen bij aankoop van producten, maar ook bij online betaalde diensten gebeurt dit nog veel te vaak en dat is natuurlijk verschrikkelijk irritant. Dus ik heb goede hoop dat, mede op basis van artikel 64 van deze richtlijn betalingsdiensten, dit soort ergerlijke zaken voortaan tot het verleden gaan behoren.

De richtlijn betalingsdiensten moet zorgen voor betere toegang tot betalingsdiensten en lagere kosten en risico's voor de consument. Dit past perfect bij de doelen van de digitale interne market waarvoor de Commissie binnenkort met voorstellen komt. Het heeft mij daarom ook verbaasd dat er binnen het hele verhaal van de digitale interne markt niet één verwijzing is in het initiatiefverslag naar de betalingsdiensten. Ik denk dat het heel goed is dat we in die digitale interne markt ook speciale aandacht hebben voor dit aspect en ik roep alle collega's op om daar voortvarend naar te kijken. Ik eindig graag met de complimenten aan collega Tajani en alle schaduwrapporteurs voor dit uitstekende werk.

  Matt Carthy, on behalf of the GUE/NGL Group. Madam President, just to record my thanks also to the rapporteur and his team for what was a very tedious and sometimes very technical set of trilogue meetings. This Payment Services Directive creates, in my view, some positive prospects, particularly for small and medium and budding start-up enterprises, by opening up the bank industry to third-party providers. Not only does this opening create possibly more employment and business opportunities but, very importantly, it allows for more consumer choice.

Unsurprisingly, the European Banking Federation has vigorously opposed this directive, and their concerns have been couched under data protection or security fears. But in fact, to me, these issues are for the most part not only unfounded but are actually a ruse to deflect attention from the fact that vested financial interests do not wish to see their current dominant position put in jeopardy.

The impact of the Payment Services Directive (PSD 2) when it becomes law will inevitably lead to increased competition for existing banks: the chance of collaboration for third-party providers on the creation of app stores, for example, leading to increased loyalty between collaborators and consumers and also, in some cases, to banks being cut out of the payment loop.

Crucially, the regulation seeks to strengthen consumer protection and regulate operators who previously functioned with no regulatory or supervisory framework at all, so to speak. All players will now be forced to comply with financial regulation, which is crucial for any economic activity. I will be supporting this directive tomorrow.

  Eva Joly, au nom du groupe Verts/ALE. Madame la Présidente, Monsieur le Commissaire, chers collègues, je tiens à remercier le rapporteur, M. Tajani, ainsi que les rapporteurs fictifs, notamment Olle Ludvigsson et Sophie in't Veld, pour leur engagement sur le dossier.

L'équipe de négociation a défendu avec sérieux le bon compromis qui avait été trouvé lors de la précédente législature. Demain, le Parlement pourra entériner un texte qui fait progresser les droits des consommateurs. En s'alignant sur la directive sur la protection des données, il assurera une plus grande protection des données personnelles. En encadrant l'utilisation des nouveaux moyens de paiement et en interdisant les surfacturations, le texte va réduire les rentes indécentes de certains acteurs du marché.

Il est néanmoins dommage que le Conseil se soit encore concentré sur la défense de quelques exceptions qui réduiront le champ d'application de la nouvelle directive.

  Marco Valli, a nome del gruppo EFDD. Signora Presidente, onorevoli colleghi, lo scopo della revisione di questa direttiva del 2002 sui servizi di pagamento è di aumentare la concorrenza e l'efficienza nel settore dei pagamenti, assicurando condizioni eque per la tutela dei consumatori.

Quindi prendo di buon grado il lavoro che è stato fatto dal presidente Tajani, che però purtroppo noi non abbiamo potuto seguire nella scorsa legislatura, perché non abbiamo potuto partecipare al processo emendativo iniziale, perché ovviamente non eravamo rappresentati ancora in questo Parlamento. Abbiamo comunque apprezzato il testo votato dal Parlamento e il suo contenuto e abbiamo seguito con attenzione i triloghi che sono stati fatti sotto la Presidenza lettone.

Da un lato appunto sono stati fatti sicuramente diversi passi in avanti sia attraverso l'inclusione nella direttiva di ulteriori fornitori di servizi di pagamento come le carte di credito, sia nell'ambito dell'accesso alle informazioni prevedendo frodi e abusi. Dall'altro il team negoziale, per chiudere, ha dovuto accettare qualche piccolo compromesso a ribasso su alcuni punti: un'esenzione per il settore delle telecomunicazioni voluta dal Consiglio a condizione che il valore di ogni singola operazione non superi 50 euro, oltre 100 euro mensili; il diritto di recesso per il consumatore è gratuito e garantito solo dopo sei mesi, mentre il Parlamento l'avrebbe voluto gratuito sempre; un innalzamento della soglia da 1 milione a 3 milioni di euro di transazioni annuali, come la clausola necessaria per derogare alle disposizioni della direttiva, aumentando così il numero di fornitori che possono beneficiare dell'esenzione.

Mi rallegro comunque perché devo dire che il presente Tajani ha fatto un buon lavoro durante le negoziazioni e quindi rispetto ad altre negoziazioni ho visto sicuramente una buona negoziazione da parte del Parlamento e quindi domani vedremo come delegazione se votare a favore o al massimo pensare a un'astensione.

  Markus Ferber (PPE). Herr Präsident, liebe Kolleginnen, liebe Kollegen, lieber Antonio! Uns ging es ja darum, bei den Verhandlungen, die ich dankenswerterweise im Trilog leiten durfte, eine Balance zu finden, dass die neuen technologischen Möglichkeiten eingeführt werden können, dass wir einen sicheren Rechtsrahmen haben, dass wir einen optimalen Verbraucherschutz, einen optimalen Datenschutz garantieren, dass wir es aber auf der anderen Seite auch ermöglichen, dass Internetanbieter sich auf dem Markt entwickeln können, und dass auch Banken nicht mehr in die Lage versetzt werden, solche Zahlungsdienste und Zahlungsauslösungen zu blockieren.

Wenn ich das mal unter diesem Stichwort zusammenfassen darf: Da haben wir miteinander einen großen Erfolg erzielt, dass wir einen einheitlichen Rechtsrahmen in Europa haben, der diese technischen Möglichkeiten ermöglicht, aber gleichzeitig auch Verbraucherschutz und Datenschutz sicherstellt. Und wir haben dafür gesorgt, dass auch die Aufsichtsbehörden entsprechenden Zugang bekommen, damit auch sichergestellt ist, dass die Spielregeln eingehalten werden. Ich denke, das gehört auch mit dazu und muss mit angeführt werden.

Die Banken – und das ist auch richtig – dürfen Zahlungsaufforderungen nicht mehr automatisch blockieren, was sie in der Vergangenheit gemacht haben, weil die alte Zahlungsdiensterichtlinie aus einer Zeit stammt, in der es die Smartphones noch nicht gab, und damals überhaupt nicht mit dieser Herausforderung zu arbeiten war. Der Verbraucher haftet nur noch bei grober Fahrlässigkeit. Ich halte es für einen wichtigen Fortschritt, dass der Verbraucherschutz hier auch wirklich auf die Ebenen übertragen wird, die dafür verantwortlich sind. Auch da hatten wir in der alten Zahlungsdiensterichtlinie eine Lücke, das war bisher nicht sauber abgedeckt.

Das heißt, wir haben auf der einen Seite einen Anreiz geschaffen, dass sich auch in Europa Start-ups mit dem Thema Zahlungsdienste im weitesten Sinne beschäftigen können, aber gleichzeitig einen Rechtsrahmen dafür, dass dies nicht auf dem Rücken der Verbraucher oder zu Lasten der Sicherheit stattfindet. Das heißt, Zugang zu Kontendaten findet nicht statt.

Deswegen ist das ein sehr guter Kompromiss, der hier gefunden wurde. Herzlichen Dank an Antonio Tajani! Wir werden morgen zustimmen.

  Paul Rübig (PPE), Frage nach dem Verfahren der „blauen Karte“. Der Kollege Ferber hat sehr gut beschrieben, welche Vorteile das System hat. Mich würde vor allem interessieren, wie das für die kleinen und mittleren Betriebe ausschaut, weil die natürlich jetzt auch neue Möglichkeiten erhalten. Könnten wir das vielleicht kurz erfahren?

  Markus Ferber (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. Lieber Kollege Rübig! Da bin ich natürlich ein bisschen überfordert, jetzt die Arbeit des Berichterstatters oder gar der Kommission zu übernehmen. Aber ich kann nur sagen, dass für Start-ups eine Ausnahmeregelung gemacht wird, bis sie drei Millionen Umsatz haben, sodass ein Eintreten in den Markt möglich ist. Das ist, glaube ich, der ganz entscheidende Punkt für junge, innovative Unternehmen. Für den Mittelstand wird es interessant, auch das Internet als Vermarktungstool zu benutzen, weil jetzt auch Bezahlsysteme zur Verfügung stehen, bei denen man sich drauf verlassen kann, dass grenzüberschreitend auch wirklich die Rechnungen bezahlt werden. Darum, denke ich, ergibt sich da eine Reihe von Möglichkeiten, die innovative kleine und mittlere Unternehmen auch nutzen werden können.

  Renato Soru (S&D). Signora Presidente, onorevoli colleghi, la rapida evoluzione tecnologica di questi ultimi anni aveva sicuramente reso necessaria una revisione delle norme che regolano questo settore.

E questa revisione giunge anche in un momento molto opportuno dato l'affacciarsi di nuovi operatori nel mercato delle transazioni elettroniche, penso ai produttori di apparati mobili o addirittura ai produttori di sistemi operativi che regolano ormai i nostri oggetti e che minacciano di occupare una parte rilevante delle transazioni finanziarie, per cui era molto importante che si creassero i presupposti per la nascita e per il rafforzamento di un vero e proprio sistema europeo di pagamenti elettronici.

Ci sono crescenti opportunità e potenzialità che iniziano a manifestarsi in termini di risparmio dei costi, efficienza e praticità d'uso per gli utenti, controllo dei comportamenti fiscali, sicurezza nella logistica, ma anche alcune criticità per le quali è stato bene aumentare la soglia di attenzione, in particolare per quanto riguarda il trattamento dei dati, la trasparenza e l'informazione.

Concordo anch'io sul fatto che sia un ottimo provvedimento e mi congratulo quindi con i relatori, con il relatore principale e con tutti i relatori ombra. Vorrei ricordare che in questi giorni è in discussione in commissione e presto approderà in Aula il provvedimento sul Digital Single Market. È evidente che non c'è un Digital Single Market se contemporaneamente non c'è anche un sistema di pagamenti digitali e il sistema dei pagamenti digitali diventa quindi fondamentale che sia coerente e adeguato alle grandi aspettative che ci sono e che tutti noi poniamo nel Digital Single Market.

L'Europa pensa che il Digital Single Market giocherà un ruolo importante nella crescita economica e nella creazione di lavoro.

  Jana Žitňanská (ECR). Každým dňom viac a viac ľudí vykonáva svoje platby elektronicky alebo prostredníctvom smartfónu. V Európskej únii však žije 30 miliónov ľudí so zrakovým postihnutím, ktorí aj napriek existencii moderných technológií tieto služby nemôžu naplno využívať. Mrzí ma, že o prekážkach, ktorým čelia, ale najmä o opatreniach, ktoré by ich pomohli odstrániť, nie je v predkladanej správe ani zmienka. Chcem pripomenúť, že Európska únia je signatárom dohovoru OSN o právach osôb so zdravotným postihnutím, a preto je našou povinnosťou pamätať aj na túto skupinu obyvateľov a spotrebiteľov. Je našou povinnosťou postarať sa o to, aby aj oni mali v 21. storočí bezproblémový prístup k moderným platobným službám.

  Miguel Viegas (GUE/NGL). Senhor Presidente, acompanhamos muitas das preocupações dos agentes económicos, designadamente ao nível da falta de transparência relativamente aos custos reais dos cartões de pagamento, às barreiras à entrada no mercado de pagamentos e às comissões de intercâmbios multilaterais. Os dados do Banco Central Europeu apontam para uma enorme desproporção entre os custos dessas operações e os valores cobrados aos beneficiários e consumidores. São necessários, por isso, mais estudos sobre os custos reais dos métodos de pagamento eletrónicos e a falta de transparência no que respeita a esta matéria.

Posto isto, seria desejável que esta diretiva conferisse a cada cidadão o direito de abrir uma conta com serviços bancários mínimos e gratuitos, tendo em conta as vantagens que isso traz para a sociedade em geral. Pese embora o esforço desta iniciativa legislativa, temos ainda um complexo produto legislativo, onde se pretende avançar numa direção, mas criando ao mesmo tempo condições para contornar a legislação. A não aplicação de qualquer limite às comissões cobradas pelos bancos aos terceiros prestadores de serviços de pagamento é apenas um exemplo.

Doamnă președintă, buna funcționare a serviciilor de plăți reprezintă un fundament al oricărei piețe eficiente, de aceea nu pot decât să salut inițiativa Comisiei Europene de a veni cu o nouă directivă care să creeze un cadru legal armonizat, pentru a avea un sistem integrat de servicii de plăți în Uniunea Europeană și desigur că mulțumesc domnului Tajani, precum și celorlalți care au lucrat la acest raport foarte bun.

În ultimii ani, digitalizarea economiilor a multiplicat numărul furnizorilor de servicii de plăți, în special al celor bazați pe internet. Avem nevoie mai mult ca oricând de transparență, securitate, competiție corectă și eficiență în domeniul serviciilor de plăți. Avem nevoie de protecția consumatorilor care apelează la aceste servicii de plăți. Serviciile de plăți reprezintă un bun public, de aceea este nevoie și de întărirea activității de supraveghere a furnizorilor de servicii de plăți.

  Emmanuel Maurel (S&D). Madame la Présidente, Monsieur le rapporteur, chers collègues, nous sommes tous favorables à ce que la loi accompagne l'innovation technologique, accompagne l'innovation des usages, comme ces nouveaux services de paiement en ligne dont il est question aujourd'hui.

Je crois que nous sommes tous collectivement satisfaits que l'Europe voie émerger chez elle des acteurs de ce secteur des FinTech. Mais cette satisfaction ne doit pas nous conduire à une forme d'enthousiasme un peu aveugle. Il y a un certain nombre d'objectifs politiques que nous nous fixons: la sécurité des achats, l'égalité entre les établissements de paiement et, bien sûr, la protection des données, car nous sommes des régulateurs. Il est important, au moment où l'on discute de cette directive, de rappeler que nous disons oui à l'innovation, mais non à la dérégulation. C'est cela qui doit guider notre action.

De ce point de vue, même si c'est un projet de directive qui a été longuement discuté, longuement mûri, sur cette question spécifique de la protection des données, les garanties ne sont pas forcément toujours suffisantes.

On a parlé des banques, tout à l'heure, et ce n'est pas moi qui vais les défendre, mais nous les avons soumises, légitimement, à de fortes exigences. Les paiements via les banques sont plus sécurisés et, quand nous faisons des sondages, nous remarquons que les consommateurs, qui effectuent un paiement en ligne ont, eux-mêmes, davantage confiance dans leur banque.

Il y a un autre débat. Nous nous sommes battus pour la sécurité et la protection des données et, d'ailleurs, la Cour de justice de l'Union européenne elle-même vient finalement de nous donner raison, avec son arrêt sur l'accord "Safe Harbor". Ce que je veux dire, très simplement et rapidement, c'est que oui, il faut créer des définitions et des statuts pour ces nouveaux usages mais il faut être patient face à de telles transformations. Il ne faut pas effacer les garanties pour accélérer une évolution qui demande encore à se confirmer.

Par conséquent, je pense vraiment qu'il faut créer des règles communes et s'y tenir. L'innovation, oui! La dérégulation, non!

Magam is azok közé tartozom, akik azt gondolják, hogy itt egy nagyon szép és tényleg előremutató munkát végeztek a szerzők. Ugyanakkor Ön is számtalan még elvégzendő feladatra utalt. Mire ezekkel végzünk, a még Ön által is jelzett jövőbeni feladatokkal, nem múlik-e el ennek az egésznek az időállósága a technológiai fejlődés fényében?

Les choses vont très très vite et, en tant que législateur, nous devons accompagner cette évolution et, en même temps, établir sans arrêt des règles, des règles de conduite, de nouvelles normes. Donc, de ce point de vue, c'est ce que je disais, il n'y a pas de règles s'il n'y a pas de garanties, et notamment sur un point fondamental: la garantie de la protection des données. En tout cas, moi, je pense – mais vous aussi, j'en suis sûr – que c'est notre objectif principal. Il y a ce conflit que nous devons régler entre des innovations technologiques qui sont rapides et notre rôle de législateur qui est plus lent. On doit s'adapter, mais on doit toujours s'adapter avec l'objectif qui est le nôtre objectif de faire en sorte que nos concitoyens, qui sont aussi des consommateurs, soient protégés, et notamment dans leurs libertés fondamentales.

  Andreas Schwab (PPE). Frau Präsidentin, Herr Vizepräsident, meine Damen und Herren, liebe Kolleginnen und Kollegen! Ich glaube, dass wir uns hier im Hause über alle Parteigrenzen hinweg einig sind, dass dem Berichterstatter Antonio Tajani Dank gebührt und dass uns auch die inhaltlichen Ergebnisse der Zahlungsdienste im Binnenmarkt zufriedenstellen. Ich begrüße das sehr, weil ich glaube, dass uns an zwei Stellen wichtige Erfolge gelungen sind. Zum Ersten: Wir haben für die neuen digitalen Bezahlverfahren ein wirkliches level playing field hergestellt. Dies wird nichtsdestotrotz dazu führen, dass das in Europa bisher vorherrschende Universalbankmodell an der Stelle weiter unter Druck kommen wird. Und es werden weitere segmentierte sektorale Bankangebote hinzukommen, die natürlich hier alle am Ende unter den gleichen Vorgaben arbeiten müssen, unter den gleichen Sicherheits-, unter den gleichen Wettbewerbsvorgaben wie die bestehenden Anbieter, damit wir tatsächlich auch ein einheitliches level playing field behalten können.

Zum Zweiten: Es ist wichtig, dass wir die Abstimmung zwischen der von der Kommission im Jahr 2013 vorgelegten Richtlinie zur Internet-, zur IT-Sicherheit, Cyber Security, auf der einen Seite und der Richtlinie über Zahlungsdienste genau hinbekommen, weil wir natürlich an der Schnittstelle zwischen Zahlungsdiensten und klassischen kritischen Infrastrukturen, zu denen auch Banken und Versicherungen gehören, im digitalen Zeitalter besondere Vorsichtsmaßnahmen treffen müssen. Da ich selber Berichterstatter für die IT-Security-Richtlinie bin, glaube ich, sagen zu können, dass die Vorschläge, dass die Vorgaben aus dieser Richtlinie absolut mustergültig sind.

Zuletzt freut mich natürlich, dass die Verbraucherinnen und Verbraucher von dieser Zahlungsdienstrichtlinie am Ende einen wesentlichen Vorteil dadurch haben werden, dass zum Einen ihre Daten geschützt sind und sie zum Zweiten auch – wie vorher bereits angesprochen wurde – darauf vertrauen können, dass die Dienstleistungen sie mit einem hohen Schutzaufwand schützen sollen und sie nur bei grober Fahrlässigkeit haften. Das schafft für Verbraucherinnen und Verbraucher in Europa ein Umfeld, das den Binnenmarkt gerade im digitalen Umfeld stärkt.

  Evelyn Regner (S&D). Frau Präsidentin! Es kommt selten vor, dass wir einen Bericht diskutieren, in dem nicht doch noch ein, zwei oder drei Haare in der Suppe zu finden wären. Der ist aber wirklich gut. Es konnte einiges für die europäischen Konsumentinnen und Konsumenten erreicht werden. Die Vorschriften schützen diese zukünftig vor Missbrauch und Betrug im Onlinehandel und schonen auch ihre Geldbörse. Es ist erfreulich, dass bei den missbräuchlichen Zahlungen mit Zahlungsinstrumenten der Betrag von 150 Euro auf 50 Euro gesenkt wurde. Ich möchte aber an dieser Stelle auch auf die verbraucherfreundliche österreichische Regelung hinweisen. Hier ist es nämlich so, dass, wenn den Verbraucher keine Schuld trifft, für ihn bei einem Verlust auch keine Kosten anfallen.

Schließlich möchte ich einen weiteren positiven Aspekt erwähnen, nämlich dass wir an Vorschriften – wie der achtwöchigen Frist für die Rückbuchung von Lastschriften – nicht gerüttelt haben, denn das ist ein wichtiges Recht, das die Konsumenten schon seit Jahren kennen, und insofern Gratulation an den Berichterstatter.

Signora Presidente, onorevoli colleghi, come è stato giustamente osservato occorre rivolgere un ringraziamento doveroso a chi ha trattato questa materia e in particolare al relatore Tajani per aver individuato uno dei punti cruciali in termini di tutela del consumatore delle piccole e medie imprese all'interno della grande partita dell'Agenda digitale sulla quale questo Parlamento e la Commissione si stanno misurando.

Noi sappiamo che la necessità di costituire un vero mercato unico dei pagamenti è ostacolata da una serie di barriere di carattere tecnico e legale sulle quali non possiamo non intervenire con l'approccio che giustamente è stato individuato nel lavoro di modifica alla direttiva sui servizi di pagamento di cui trattiamo oggi e che andrà in votazione domani.

I costi di questo ritardo sono enormi. Si è parlato di più di 120 miliardi di euro all'anno, che possono essere tolti da un sistema che normalmente poi carica questi costi sui soggetti più deboli che citavamo all'inizio e le formule sono molte, abbiamo le carte di debito, la telefonia mobile, le carte emesse anche dai supermercati. Tutto questo per evitare che la modalità più costosa per effettuare i pagamenti, cioè l'utilizzo dei contanti, venga lentamente ridotta al minimo. La Commissione – ne abbiamo parlato diverse volte anche nei nostri gruppi di lavoro – ha stimato che una transazione elettronica costa pochi centesimi di euro, mentre invece una transazione effettuata attraverso il pagamento con contanti può arrivare ad avere un costo unitario fino a 55 centesimi.

Bene, siamo certi che attraverso queste novità i soggetti citati avranno reali, concrete e attese utilità di cui spesso ci troviamo a discutere, ad una condizione, che gli operatori che verranno chiamati ad occuparsi di questi servizi siano posti in reale concorrenza e questo per noi consentirà di avere quei tre grandi strumenti che sono la trasparenza, la velocità e la riduzione dei costi, che aiutano i tre grandi soggetti che a noi stanno più simpatici, cioè i consumatori, le start-up e le piccole e medie imprese.

Għal dan il-għan, l-Unjoni Ewropea teħtieġ tiżgura li s-servizz ta’ pagament ikun affordabbli u aċċessibbli għal kulħadd biex il-konsumaturi u n-negozji jkunu jistgħu jibbenefikaw verament mis-suq intern.

Madankollu, ħafna drabi, il-konsumaturi ma jħossuhomx komdi speċjalment meta jkunu qed jixtru online u meta l-bejjiegħa jkunu bbażati f’pajjiż ieħor. Il-konsumturi huma ġustament inkwetati minħabba li ħafna jesperjenzaw problemi ta’ frodi fir-rigward tal-pagamenti u nuqqas ta’ informazzjoni jew aċċess għar-rimedju meta dan ikun il-każ.

Għalhekk l-iżvilupp kontinwu tas-suq intern għall-pagamenti elettroniċi huwa kruċjali biex ikun hemm għażla akbar ta’ prezzijiet aħjar filwaqt li b’hekk tissaħħaħ il-fiduċja u l-kunfidenza fis-suq intern.

Għalhekk, il-vot ta’ għada fil-Parlament huwa pass kruċjali lejn il-ħolqien ta’ suq intern għall-pagamenti kollha fl-Unjoni Ewropea u jiżgura ħlasijiet elettroniċi orħos u b’serħan il-moħħ, titwessa’ l-għażla għall-konsumatur kif ukoll jistimula l-kompetizzjoni u l-innovazzjoni fis-suq intern. Din id-Direttiva flimkien ma’ regolamenti dwar limitu massimu tat-tariffi huma eżempju ċar ta’ kif iċ-ċittadin jista’ jiggwadanja. Ser ikun hemm miżuri biex jittejbu d-drittijiet tal-konsumatur u jsaħħu l-ħarsien kontra l-frodi, abbużi potenzjali u problemi ta’ ħlas.

  Seán Kelly (PPE). Madam President, I welcome this report by my friend and colleague Antonio Tajani and I thank him for his good work, in particular in agreeing a text which, judging by comments and speeches from all sides of the House, will be met with approval tomorrow and voted on accordingly.

It is important that the single market for payment services is modernised and strengthened, and this will bring significant added benefits in encouraging innovation, increasing competition and improving security. By improving cross-border payments in terms of harmonising a fragmented market for card, online and mobile payments, we can significantly increase the opportunities for SMEs and new entrepreneurial start-up companies to succeed and compete in the single market. This is vital.

The proposal will widen consumer choice by ensuring that a payer using an online account has the right to use payment software devices provided by an authorised third party and have transactions executed on their behalf by the provider. It will also remove barriers to entry by reducing costs and moving us closer to a truly single market which we all hope for, and I think this will be a welcome step.

I also think it will be wonderful for SMEs who are the drivers of the economy, and I have spoken already this week on the importance of giving indigenous SMEs the best possible chance to reap the benefits of the European market. As has been mentioned already, it will help us on the economic recovery front and particularly in stimulating competition. Where Europe is concerned, we need to emphasise competitiveness so that businesses will want to locate here.

Finally, as rapporteur for the Data Protection Regulation for the Committee on Industry, Research and Energy, I welcome in particular some key points in this report recognising that the user’s personal data is transmitted through safe channels and that it is shared only with the user’s consent and to the minimum possible extent. This will help to allay the fears of many and will help the whole business to grow. So I think this is a wonderful development. Well done Mr Tajani and everybody involved.

  Stanislav Polčák (PPE). Paní předsedající, já bych chtěl tento návrh Evropské komise podpořit. Pro mě zapadá do jiných návrhů, které jsme zde dnes nebo v předchozích dnech probírali. Nepochybně se jedná o evropský platební rozkaz, který má za cíl usnadnění vymáhání práva v přeshraničních sporech. Nepochybně jde i o ten předchozí bod, který se týkal kapitálových trhů. A pokud jde o tento bod, chtěl bych vyzdvihnout skutečně větší bezpečí, kterého se dostane evropským spotřebitelům. To je, myslím, hodnota, za kterou stojí za to bojovat a pro kterou vítám tuto iniciativu Evropské komise.

Maximální stropy snížení nákladů, pokud jde právě o platby, a obecně vytvoření jednotného druhu plateb je věc, kterou, myslím si, bychom měli podporovat bez ohledu na politickou příslušnost. Já se k této odpovědnosti hlásím a velmi vítám tuto iniciativu Evropské komise.

Κυρία Πρόεδρε, θα ήθελα να συγχαρώ τον εισηγητή, τον κύριο Tajani για την έκθεση σχετικά με τη δημιουργία ενός Ενιαίου Χώρου Πληρωμών, μέσα στον οποίο οι πολίτες και οι επιχειρήσεις μπορούν να κάνουν διασυνοριακές πληρωμές, με την ίδια ευκολία, ασφάλεια και αποτελεσματικότητα που μπορούν και στο εσωτερικό των χωρών τους, πληρώνοντας τα ίδια τέλη.

Ο ορθός τρόπος λειτουργίας της εσωτερικής αγοράς προϋποθέτει ένα ασφαλές σύστημα πληρωμών, προκειμένου να υποστηριχθεί η ανάπτυξη της οικονομίας στην Ένωση και να διασφαλιστεί ότι οι καταναλωτές θα επωφεληθούν από τη διαφάνεια στις υπηρεσίες πληρωμών. Είναι, επομένως, σαφές ότι όλα τα κράτη μέλη θα πρέπει να μεριμνούν, ώστε οι κανόνες πρόσβασης στις υπηρεσίες πληρωμής να είναι αντικειμενικοί και αμερόληπτοι και επίσης να υπάρχει ασφάλεια στις ηλεκτρονικές συναλλαγές. Με αυτό τον τρόπο θα σταματήσουν οι φραγμοί μεταξύ των εθνικών αγορών ενώ θα συμβάλει η εσωτερική αγορά στη δημιουργία ηλεκτρονικού εμπορίου. Ταυτόχρονα, όμως, θα ήθελα να επισημάνω ότι η Ευρωπαϊκή Ένωση δεν δικαιούται να αποκλείσει από την ενιαία αγορά τους ηλικιωμένους, αλλά και άλλες μερίδες καταναλωτών, επιβάλλοντας την υποχρεωτική χρήση καρτών και οδηγώντας έτσι στη «αχρήματη» κοινωνία.

  Ivan Jakovčić (ALDE). Gospođo predsjednice, ovaj novi način reguliranja platnog prometa na unutarnjem tržištu doživljavam kao jačanje unutarnjeg tržišta. Doživljavam i kao veliku pomoć za srednja i mala poduzeća, obrtnike, fizičke osobe. Kao jednu veliku pobjedu malih potrošača.

Mislim da se radi o još jednom važnom momentu – klasičnoj win-win situaciji gdje dobivamo dodatnu sigurnost koju tako neophodno trebamo na tržištu kada govorimo o plaćanjima putem interneta gdje još uvijek doživljavamo razne prevare. Imamo niže troškove, jeftinije poslovanje, kvalitetnije informacije koje ćemo moći pružiti svima onima koji će koristiti ove usluge.

Zato čestitam svima onima koji su radili na ovom dokumentu i sigurno da ćemo svi sutra glasovati za.

  Jyrki Katainen, vice ordförande för kommissionen. – Fru talman! Först skulle jag vilja tacka alla ledamöter för denna debatt. Det här förslaget är ett bra exempel på saker som EU kan göra i varje dags utmaningar för vanliga människor och företag.

Madam President, I have listened very carefully to what Members of Parliament have said here and there seems to be very wide agreement on the necessity to foster innovation and allow competition, while ensuring high levels of consumer protection and safe and secure payment transactions.

This text is balanced and fair. I do not want to use too much of your valuable time, but I would just like to say that, because this issue is something that touches many people on the ground and also small and medium-sized enterprises, it would make a lot of sense if Members here who have participated in this work and who understand the value of the proposal can help to publicise this, to ensure that people really understand that there are new opportunities coming, and that this is one of the examples of where we need a more integrated Europe. This is a concrete issue that may sound very technical, and indeed it is quite technical, but its impact on everybody’s lives is not technical: it has a lot of impact. So I want to once more thank Mr Tajani, as rapporteur, and also Mr Ferber for chairing the trilogue on this very important topic.

  Antonio Tajani, relatore. Signora Presidente, onorevoli colleghi, condivido l'analisi del Vicepresidente Katainen.

Domani daremo un segnale positivo ai cittadini e agli imprenditori e ai piccoli e medi artigiani dell'Unione europea. Il Parlamento europeo, grazie al lavoro congiunto e con il sostegno forte della Commissione che ha dato vita a questa iniziativa, dà un segnale positivo. L'Europa non è nemica dei cittadini, l'Europa vuole essere vicina ai cittadini cercando di risolvere i propri problemi. È vero che si tratta di un testo molto tecnico, però la sostanza è molto politica. Quindi, credo che sia giusto raccogliere l'appello del Vicepresidente Katainen di fare in modo di pubblicizzare questo testo, soprattutto per i giovani, i futuri consumatori. L'onorevole Rübig chiedeva quali sono i vantaggi per i piccoli e medi imprenditori; soprattutto per i piccolissimi, per gli artigiani, i vantaggi saranno innumerevoli perché tutta la filosofia di questa direttiva va in questa direzione.

Vice-President Katainen, I remember your strong engagement during your work as Prime Minister in your country, where your work favoured small and medium-sized companies. Now we need your strong engagement over the coming months and year.

It is important to control the implementation of this directive in every Member State. Your power and the European Commission’s power is very important to us, as is the fact of having your engagement on this. People want your support and they want our support, but it is important that the implementation of this directive is controlled and checked each year.

  Eva Paunova (PPE), in writing. Without an integrated payments market on the European level, we cannot have a functioning internal market for goods and services, nor a digital single market or a truly competitive EU economy.

In the new economic model and the modern European society, an increasing number of citizens prefer to shop online, yet only 1 in 7 completes purchases across borders. This is a consequence of the fragmentation along national lines we see in important areas of the payments market, such as card, internet and mobile payments.

The revision of the Payment Services Directive will change that. It will also bolster e-commerce and provide significant advantages for the European consumers, whose interest is at the heart of every piece of legislation we in the EU institutions produce. I therefore welcome the new measures contained in PSD II, such as enhanced legal protection, information on transactions and unconditional refund in case of unauthorised payments and fraud.

By creating a competitive level playing field we will provide consumers with greater choice, transparency and security when making retail payments. On the business side, this certainty and stability will allow for competition and innovation, and thus more opportunities for Europeans to reap the benefits of the digital single market.
