  Andrejs Mamikins (S&D). – Priekšsēdētājas kundze! Apstākļi, par kuriem ir runāts šajā normatīvās rezolūcijas projektā, ir pilnībā attiecināmi uz jebkuru citu mūsu ikdienas dzīves jomu. Gan ceļojumu pakalpojumu sniedzēji, gan pārtikas ražotāji, gan dažādu līgumu sastādītāji un vairākas citas iestādes nereti nesniedz visu nepieciešamo informāciju, lai patērētājs varētu izdarīt pilnībā apjēgtu izvēli.

Vairāk par to pat, ja kaut kas ir iekļauts ar komercpraksi nodarbinātu kompāniju darbības noteikumos un to klientu brīvi pieejamā tiesību sarakstā, tās var atteikties izpildīt savas saistības. Tas nav pareizi — pret to ir jācīnās un konkrēti ceļojumu pakalpojumu sniedzēju gadījumā to klientiem skaidri jāsaprot, cik tas maksā, kā arī pastāv vai nepastāv jebkuri papildpakalpojumi, par kuriem kāda nepārprotama iemesla dēļ viņiem nāktos maksāt vēlāk. Tāpēc es atbalstu šo dokumentu. Paldies!

  Marijana Petir (PPE). – (početak govora je nerazumljiv) na direktivu koja je napisana u vrijeme kad je kupovanje bilo mnogo jednostavnije i kad se nije moglo sve obavljati preko interneta. Ljudi su postali sve zainteresiraniji za samostalno odabiranje paketa putovanja, raznih pogodnosti, te je bitno osigurati zaštitu njihovih prava, stoga je izmjena ova Direktive bila nužna.

No, želim također istaknuti da treba voditi računa i o zaštiti poduzetnika u turizmu kako naše odluke ne bi imale dalekosežne posljedice na konkurentnost i profitabilnost hotelske industrije. Dobro je da su poslušana upozorenja struke kako bi se izbjegli mogući problemi koji bi doveli do opterećenja novim davanjima, koja bi potom povećala cijenu proizvoda i usluga, a mnogi hoteli ne bi bili u mogućnosti platiti ta nova davanja te bi prestali nuditi specifične proizvode, po kojima je primjerice i Hrvatska već sada prepoznatljiva turistička destinacija.

Nadam se također da ovaj prijedlog direktive neće dovesti do drugačijeg obračuna PDV-a nekih hotelskih proizvoda, na štetu hotelijera, ali i na štetu naravno krajnjih korisnika, turista. Stoga pozivam da se otvori ozbiljna rasprava o turizmu u Europskom parlamentu jer je riječ o gospodarskoj grani koja je nepravedno zanemarena.

  Seán Kelly (PPE). – Madam President, I support this report as well, particularly as currently two-thirds of package travel sales take place online. This is a huge increase in recent years, so an updated directive suitable for the digital age is much needed. This proposal meets the challenges of both the modern environment and traditional sales. Package travel is becoming increasingly popular, and this directive protects both the consumer and businesses by setting clear standards for liability, cancellation, reimbursement and a limit for post-contractual price increase. If a package travel service goes bankrupt, measures in place mean that payments already made by customers are secured through clear insolvency provisions.

  William (The Earl of) Dartmouth (EFDD), in writing. ‒ UKIP has voted in favour of rejecting the Council position at second reading. Whilst we are great advocates of increasing consumer rights, we are against the full harmonisation that this Directive requires. In 2014 a UK government report had stated that this proposal was ‘far from perfect’. UKIP believes that if national governments had the opportunity to update their own consumer protection laws they would be able to pass legislation that is the best fit for their consumers.

  Clara Eugenia Aguilera García (S&D), por escrito. ‒ He votado a favor de esta Directiva porque, dados los cambios en el mercado turístico y la creciente tendencia de los consumidores a reservar sus vacaciones en línea, era necesario modernizar y adaptar la legislación a la era digital.

Con la aprobación de dicha Directiva, se refuerzan los derechos de los consumidores: en primer lugar, al cubrir nuevos modelos de reserva ̶ páginas enlazadas ̶ , los viajes combinados formados por varios servicios de viaje (vuelo, hotel o alquiler de vehículo) y comprados en línea contarán con la misma protección que los paquetes contratados en agencias de viajes, ya que dichas ofertas enlazadas en las que el nombre del cliente, los detalles de pago y la dirección de correo electrónico se transfieran de un proveedor a otro y se concluya un segundo contrato en menos de 24 horas después de la adquisición del servicio, se considerarán viaje combinado a efectos de la legislación.

Y, en segundo lugar, al recibir información detallada sobre sus derechos, los viajeros tendrán más opciones para cancelar el contrato, y deberán contar por anticipado con información clara sobre quién es el responsable en caso de problemas. También gozarán de mayor protección en caso de insolvencia de los empresarios.

  Marina Albiol Guzmán (GUE/NGL), por escrito. ‒ Este informe forma parte del proceso de adopción de la Directiva del Parlamento Europeo y del Consejo relativa a los viajes combinados y los servicios asistidos de viaje, por la que se modifican el Reglamento (CE) nº 2006/2004 y la Directiva 2011/83/UE del Parlamento Europeo y del Consejo y por la que se deroga la Directiva 90/314/CEE del Consejo. La propuesta del Consejo recoge las preocupaciones del Parlamento en el sentido de una armonización al alza de los derechos del consumidor en el ámbito de esta regulación turística.

Por todo ello, nuestra posición es favorable.

  Louis Aliot (ENF), par écrit. ‒ J'ai voté en faveur du rejet de l'amendement sur les voyages à forfait et prestations de voyage assistées. Ce texte, qui vise à favoriser au maximum les prestations de voyages à "portée de clic" dans le but de stimuler le marché, a comme conséquence de fausser la concurrence du marché et de centraliser l'offre au détriment des PME. De plus, je regrette que l'harmonisation des législations, la mise en œuvre du marché unique, ainsi que la distorsion de la concurrence au bénéfice des acteurs économiques puissants soient des thèmes absents de ce texte.

  Martina Anderson (GUE/NGL), in writing. ‒ I abstained on this report which primarily dealt with the scope of protection for travellers when purchasing combinations of travel services.

My reasons for abstaining were threefold. First, the scope provided for full harmonisation such that the rights of travellers and business competitiveness received equal protection. It is my belief that consumers’ rights cannot be best served when business competitiveness needs to be served as well through full harmonisation. Second, the consequence of price change in the report is such that in case of a change in the cost of fuel, a traveller may be asked to pay more money. There was however no provision in the text that allowed the alternate to benefit the traveller in case the price of fuel decreased.

Finally, in Ireland the tourism industry consists mostly of SMEs. According to this report, these SMEs would have to take out insolvency protection on behalf of larger providers than themselves when they come to be classified as a package travel provider, or, a Linked Travel Arrangement.

This report does not adequately protect a tourism industry dominated by SMEs and for this reason, I abstained.

  Νίκος Ανδρουλάκης ( S&D), γραπτώς. ‒ Ψήφισα υπέρ του να υιοθετηθεί το αποτέλεσμα της συμφωνίας μεταξύ Συμβουλίου και Ευρωπαϊκού Κοινοβουλίου, καθώς με τη συγκεκριμένη πρόταση αναθεωρείται μετά από 25 χρόνια η νομοθεσία σχετικά με τα οργανωμένα ταξίδια, ενισχύοντας τα δικαιώματα των καταναλωτών, επικαιροποιώντας τις διατάξεις βάσει της νομολογίας, της εμπειρίας, αλλά και των τεχνολογικών εξελίξεων των τελευταίων 25 χρόνων.

  Marie-Christine Arnautu (ENF), par écrit. ‒ Ce rapport propose de rejeter la position du Conseil qui a pour objectif d'harmoniser les législations nationales relatives aux voyages à forfait et aux prestations de voyage assistées ou liées. Cela se fera bien évidemment dans le cadre de la création d'un marché unique du numérique. Ces voyages à forfait comprennent un ensemble de prestations proposées au client à un prix fixe par un tour opérateur. Le rapport préconise de favoriser cette activité sur internet afin de stimuler le marché.

Toutefois, une telle centralisation de l'offre de prestations liées risque de fausser la concurrence au détriment des TPE/PME qui ne pourront rivaliser avec les gros groupes.

J’ai donc voté pour l'amendement de rejet de la position du Conseil.

  Jonathan Arnott (EFDD), in writing. ‒ I note that the British government has described these changes as being ‘far from perfect’. I also note that the legislation explicitly calls for maximum harmonisation of this directive. I therefore supported the rejection amendment.

  Zigmantas Balčytis (S&D), raštu. ‒ Balsavau už šį pasiūlymą, kurio tikslas‒ suteikti daugiau teisių organizuotas keliones įsigyjantiems keliautojams. Prekyba internetu bei pigių avialinijų siūlomos paslaugos pakeitė kelionių pirkimo įpročius, todėl šiuo metu daugelis organizuotų kelionių nepatenka į ES taisyklių, galiojančių nuo 1990 m., apimtį. Siekiant užtikrinti deramą keliautojų apsaugą, atnaujintos taisyklės patikslins organizuotų kelionių, kurias sudaro kartu įsigytos skirtingos paslaugos (skrydžiai, nakvynė ir automobilio nuoma), nuostatas. Svarbu, kad nepriklausomai nuo to, ar organizuota kelionė įsigyjama biure ar internetu, keliautojams būtų suteikta vienoda vartotojų apsaugą. Taip pat kelionių organizatoriai savo klientams turės pateikti išsamią informaciją dėl būsimos kelionės ir aiškiai įvardinti, kas bus atsakingas už tinkamą kelionės paketo vykdymą.

  Nicolas Bay (ENF), par écrit. ‒ Que ceux qui consultent VoteWatch ne s'y trompent pas: j'ai voté pour l'amendement déposé par le groupe EFDD qui demandait le rejet de cette directive qui risque une fois de plus de favoriser les poids lourds du secteur au détriment des petites et moyennes entreprises.

  Hugues Bayet (S&D), par écrit. ‒ J'ai soutenu ce rapport qui permet de mieux protéger les citoyens européens qui achètent des voyages à forfait en ligne. Cela leur permettra notamment d'éviter les désagréments liés à une augmentation de prix non justifiable, à la faillite de son opérateur, à des changements horaires exagérés ou en cas d'imprévus.

  Ivo Belet (PPE), schriftelijk. ‒ Het akkoord over de pakketreizen is een stap in de goede richting, maar is nog niet perfect. We hadden eigenlijk graag een veel betere consumentenbescherming gezien voor doorklikboekingen, waarbij consumenten bijvoorbeeld via de website van de luchtvaartmaatschappij ook een overnachting bijboeken.

We moeten ook goed opletten dat de vele kmo’s in de sector niet in het gedrang komen. De nieuwe regelgeving moet daarom snel en grondig geëvalueerd en, indien nodig, bijgestuurd worden door de Europese Commissie.

Nu moeten we echter vooruit kijken. Het akkoord tilt de bescherming voor reizigers naar een hoger niveau en beschermt hen ook bij onlinereservaties. Het is nu aan de lidstaten om dit akkoord zo verstandig mogelijk om te zetten in de nationale wetgeving.

  Dominique Bilde (ENF), par écrit. ‒ Ce texte propose une harmonisation des législations relatives aux voyages à forfait et aux prestations de voyage "assistées" ou "liées". C'est une mise en œuvre supplémentaire du marché unique numérique. On veut ainsi favoriser facilement les prestations de voyages en ligne. Si l'intention est bonne, ce système peut entraîner des abus notamment par une centralisation de l'offre qui nuirait aux TPE/PME au détriment des gros groupes (cf. Google qui s'est rendu coupable de favoriser ses partenaires ou filiales et donc de fausser la concurrence).

Les associations ont alerté aussi sur les pressions exercées par les lobbies du secteur du transport puisque vouloir améliorer entraîne en réalité une harmonisation supplémentaire du marché intérieur. J'ai donc voté pour la recommandation de vote sur l'amendement de rejet de l'EFDD afin d'éviter une harmonisation des législations et afin d'éviter les risques d'abus de position dominante et de concurrence faussée au profit de grands groupes.

  Mara Bizzotto (ENF), per iscritto. ‒ Ho votato a favore della reiezione della relazione Collin-Langen su "pacchetti turistici e servizi turistici collegati". Si tratta di un testo confuso e poco chiaro soprattutto per quanto riguarda la definizione di "servizi collegati". Gli effetti disastrosi di normative europee votate con troppa leggerezza, come la direttiva Servizi, sono purtroppo sotto gli occhi di tutti. Per questo motivo non ho sostenuto questo provvedimento i cui effetti verso categorie professionali quali le guide turistiche, le guide alpine o i maestri di sci sono poco chiari e potenzialmente dannosi.

  José Blanco López (S&D), por escrito. ‒ Se hacía necesario revisar el marco jurídico que regula los contratos de viajes combinados. Esta propuesta pretende clarificar y modernizar el alcance de la protección y la información de los viajeros en la compra de estos servicios, mejorando sus derechos conforme a los cambios provocados por internet. Las nuevas normas aumentarán la transparencia y fortalecerán la protección de los consumidores sobre los servicios de viaje online.

La Eurocámara ha sido capaz de garantizar que la protección de los viajeros frente a la insolvencia del empresario cubra todos los gastos razonablemente previsibles y todos los pagos realizados por el viajero en relación con el paquete. Se han clarificado los derechos de los viajeros, en particular sobre la reducción de los precios, la compensación (incluyendo los daños no materiales) y la mala ejecución del contrato. La carga de la prueba ha sido desplazada a los organizadores. Además, el plazo para presentar una queja se ha prolongado dos años. En 2018 se verificará si es necesario un ajuste de la definición de «paquete de viaje».

Por todo esto, entre otras cuestiones, he votado a favor de este informe.

  Vilija Blinkevičiūtė (S&D), raštu. ‒ Balsavau dėl šio pranešimo, nes juo Parlamentas pritarė naujai Europos Parlamento ir Tarybos direktyvai dėl kelionės paslaugų paketų ir susijusių kelionės paslaugų rinkinių. Nuo šiol, nesvarbu, ar organizuota kelionė įsigyjama biure, ar internetu, keliautojams bus suteikta vienoda apsauga. Turistai turės daugiau galimybių nemokamai atšaukti kelionę, o kelionių organizatoriai turės pateikti išsamesnę informaciją apie būsimą kelionę ir už ją atsakingus asmenis. Parlamentas taip pat įtraukė nuostatą, kuria remiantis organizuota kelione laikomos kartu įsigytos skirtingos paslaugos, pavyzdžiui, skrydžiai, nakvynė ir automobilio nuoma. Net jei skirtingos kelionės paslaugos įsigyjamos vienu mokėjimu – nesvarbu, internete, biure ar telefonu, tokiam užsakymui galios tos pačios keliautojų teisės kaip ir organizuotiems keliautojams.

Az internetes értékesítés jelentősen megváltoztatta a foglalási szokásokat, így mára számos önállóan szervezett út nem tartozik a kilencvenes évekből származó uniós szabályok hatálya alá, vagy nem egyértelműen fogalmazza meg az utasok jogait. Ezen oknál fogva szavazatommal támogattam az utazásokra vonatkozó uniós fogyasztóvédelmi szabályok módosítását, hiszen ezzel a jövőben ugyanazok az előírások lesznek érvényesek a repülőjáratot, szállodafoglalást vagy autóbérlést is tartalmazó, interneten foglalt szervezett utazásokra, mint amelyeket utazási irodában vásárolnak. A módosított szabályok értelmében mielőtt a nyaralók aláírják a szerződést, az utazásszervezőknek vagy az utazás értékesítőinek egyértelműen el kell magyarázniuk, hogy csomagról van szó. Emellett az utast tájékoztatni kell jogairól és arról, hogy ki viseli az anyagi felelősséget abban az esetben, ha valami probléma merül fel. Üdvözlendő, hogy az EP azt is bevetette az új szabályok közé, hogy az utazásszervezőknek kötelező előre tájékoztatni az utast a tervezett indulási és érkezési időpontról és az esetlegesen felmerülő további költségek jellegéről.

  Franc Bogovič (PPE), pisno. ‒ Veseli me, da je bilo predlagana direktiva sprejeta, saj bo po mojem mnenju pripomoglo k kvalitetnejši turistični ponudbi v EU.

Turizem je ena izmed najpomembnejših gospodarskih panog v EU. Področja ponudbe turističnih paketov, ki jih zajema direktiva, predstavljajo znaten del trga potovanj, ki se je od sprejetja trenutno veljavne direktive o paketnih potovanjih izjemno spremnil. Današnji dan potovalne storitve niso le kombinacija tradicionalnih turističnih paketov, ampak se prilagajajo posamezniku. Današnji potnik je tudi bistveno bolj zahteven kot nekdaj, zato se mu mora trg ustrezno prilagajati.

Pomembno vlogo pri ponudbi turističnih aranžmajev danes igra tudi splet, kjer se trg tovrstnih produktov izjemno hitro spreminja. Zato mora zakonodaja slediti razvoju paketnih potovanj, predvsem spletnih, še intenzivneje ščititi potnike oz. potrošnike ter zmanjševati administrativna bremena za ponudnike tovrstnih storitev, predvsem mala in srednja podjetja.

Prepričan sem, da sprejeta direktiva nedvomno izpolnjuje te kriterije in predstavlja kvalitetno podlago za nadaljevanje rasti evropskega turizma!

  Biljana Borzan (S&D), napisan. ‒ Čak 35 posto putovanja kupujemo online podrazumijevajući da smo zaštićeni. Međutim, istina je drugačija. Građani koji su kupovali putovanja nisu bili zaštićeni, i naknade za otkazivanja ili promjene u rezervaciji su im u pravilu oko 3 puta skuplje nego onima koji kupuju putovanja u agencijama. Kupci tako izgube oko milijardu eura godišnje.

Sugrađani mi se nerijetko žale da neke internetske stranice na kojima rezerviraju hotele ili kupuju prijevozne karte naplaćuju veću proviziju u Hrvatskoj nego u drugim državama članicama. To je problem na koji konstantno upozoravam. Nova direktiva će omogućiti kupcu da vidi sastavnice konačne cijene i učiniti cijeli proces transparentnijim. Također, trgovac je obavezan dati kontakte za hitne i nepredviđene situacije što će smanjiti prevare.

  Marie-Christine Boutonnet (ENF), par écrit. ‒ J'ai voté pour l'amendement de rejet de ce texte car prétendre améliorer les législations relatives aux voyages à forfait et prestations de voyages assistées est un faux prétexte pour harmoniser davantage le marché intérieur alors que le secteur du tourisme est déjà très protecteur du consommateur.

  Lynn Boylan (GUE/NGL), in writing. ‒ On the Collin-Langen (IMCO) ‘Package travel and linked travel arrangement’, I abstained. Whilst I acknowledge that there were positive aspects to this report, especially regarding improving and protecting consumer rights, there were lingering concerns, particularly on the level of harmonisation involved for implementation, as it is based on the assumption that it is suitable for all 28 Member States.

Also, at the European Council of Ministers during the summer Ireland withdrew its support, citing that it risks hindering innovation and competition. There are also data protection concerns, and the degree of compensation for consumers around cancellations of packages by a travel organiser was not adequately addressed.

  Steeve Briois (ENF), par écrit. ‒ Dans le cadre de la création d'un marché unique numérique, cette proposition vise à harmoniser les législations nationales relatives aux voyages à forfait et aux prestations de voyage assistées ou liées. Ce type de voyage regroupe un ensemble de prestations proposées au client à un prix fixe par un tour opérateur. Le texte propose notamment de favoriser cette activité sur internet afin de stimuler le marché.

Seulement ce rapport ne prête pas suffisamment d'importance aux dérives que pourraient entrainer l'application de cette mesure. La centralisation de l'offre de prestations liées risque de fausser la concurrence au détriment des TPE/PME qui n'auront pas les moyens suffisants pour rivaliser avec les acteurs économiques les plus puissants. Par ailleurs, ils prétendent améliorer la protection des consommateurs pour mieux accélérer la convergence des législations nationales.

C'est pourquoi j'ai voté pour le rejet de cette résolution.

  Daniel Buda (PPE), în scris. ‒ Eforturile considerabile depuse de-a lungul anilor în Uniune cu scopul de a consolida dreptul la informare al cetățenilor săi sunt demersuri care trebuie susținute prin legiferare în toate domeniile care oferă servicii. Cu atât mai mult trebuie să vorbim de transparență și corectă informare în ceea ce privește furnizarea de servicii de către particulari spre alți particulari, deoarece în această ecuație cei care au nevoie de protecție sunt beneficiarii de servicii, iar Uniunea trebuie să le asigure un cadru optim în care să-și poată exercita dreptul la libera circulație, garantat prin tratatele UE.

Susțin poziția Comisiei asupra modului în care acest cadru de desfășurare a serviciilor de călătorie va fi asigurat și aliniat la normele democratice, pentru a-i proteja pe cei care utilizează serviciile.

Am votat în favoarea instituirii unor practici comerciale loiale prin crearea unui cadru legal în care entitățile care își comercializează serviciile online să nu ofere servicii suplimentare într-o manieră ascunsă, neclară sau ambiguă, cum ar fi aceea de ascundere a opțiunii de a nu rezerva alte servicii suplimentare. Consider că doar în această manieră putem vorbi de un drept la informare efectiv și de o transparență reală în furnizarea de servicii.

  Gianluca Buonanno (ENF), per iscritto. ‒ Voto a favore del ritiro della proposta. Il testo è fortemente sfavorevole alle guide turistiche e ad altre categorie collegate come le guide alpine e i maestri di sci.

  Cristian-Silviu Buşoi (PPE), în scris. ‒ Susțin proiectul de rezoluție legislativă a PE referitoare la poziția în primă lectură a Consiliului în vederea adoptării unei directive a Parlamentului European și a Consiliului privind pachetele de servicii de călătorie și serviciile de călătorie asociate, de modificare a Regulamentului (CE) nr. 2006/2004 și a Directivei 2011/83/UE a Parlamentului European și a Consiliului și de abrogare a Directivei 90/314/CEE a Consiliului (09173/3/2015 – C8-0281/2015 – 2013/0246(COD)).

Modificarea regulamentului vizează modernizarea normelor privind pachetele de servicii de călătorie, includerea combinațiilor personalizate de servicii de călătorie, în special a celor achiziționate online, cu scopul de spori în același timp siguranța juridică și transparența atât pentru călători, cât și pentru întreprinderi. Un alt beneficiu este reducerea prejudiciilor aduse consumatorilor prin acordarea unor drepturi suplimentare pentru rezilierea unui contract și stabilirea unor norme mai stricte în ceea ce privește creșterea prețurilor și, totodată, să asigure o concurență mai loială între întreprinderile de turism.

Y, en segundo lugar, al recibir información detallada sobre sus derechos, los viajeros tendrán más opciones para cancelar el contrato, y deberán contar por anticipado con información clara sobre quién es el responsable en caso de problemas. También gozarán de mayor protección en caso de insolvencia de los empresarios.

Il turismo svolge un ruolo preponderante nelle economie dell'Unione e i viaggi, le vacanze e i pacchetti turistici rappresentano una porzione significativa del mercato del turismo. Il mercato ha però subito profondi cambiamenti negli ultimi anni, poiché ai canali di distribuzione tradizionali si è aggiunto Internet, che ha modificato l'offerta dei servizi turistici, rendendoli sempre più personalizzati. Molte di queste combinazioni non sono ricomprese nella disciplina prevista dalla direttiva 90/314/CEE ed è fondamentale aggiornarla. La nuova direttiva non solo estende la tutela a tutti i recenti sviluppi del settore, ma aumenta considerevolmente la trasparenza e rafforza la certezza giuridica per viaggiatori e professionisti. Pertanto, ho deciso di approvare il presente testo.

  Matt Carthy (GUE/NGL), in writing. ‒ I abstained on this report which primarily dealt with the scope of protection for travellers when purchasing combinations of travel services.

My reasons for abstaining were threefold. First, the scope provided for full harmonisation such that the rights of travellers and business competitiveness received equal protection. It is my belief that consumers’ rights cannot be best served when business competitiveness needs to be served as well through full harmonisation. Second, the consequence of price change in the report is such that in case of a change in the cost of fuel, a traveller may be asked to pay more money. There was however no provision in the text that allowed the alternate to benefit the traveller in case the price of fuel decreased.

Finally, in Ireland the tourism industry consists mostly of SMEs. According to this report, these SMEs would have to take out insolvency protection on behalf of larger providers than themselves when they come to be classified as a package travel provider, or, a Linked Travel Arrangement.

This report does not adequately protect a tourism industry dominated by SMEs and for this reason, I abstained.

Da maggio 2013, tuttavia, la Commissione ha interrotto la redazione dei piani di implementazione e diviene dunque difficile valutare ora i progressi effettuati. Ho pertanto votato a favore di questa relazione nella quale si richiede un rapporto di implementazione per la verifica delle azioni intraprese, incluso l'uso delle risorse finanziarie. Uno dei problemi principali della legislazione europea in materia di turismo risiede proprio nel fatto che le risorse ad esso allocate sono davvero irrisorie e che la maggior parte delle azioni intraprese necessitano di fondi in differenti programmi di finanziamento non integrati tra di loro.

Rappresentando i servizi turistici la categoria più popolare di prodotti acquistati online, il legislatore europeo è intervenuto per adeguare la tutela dei viaggiatori alle sfide poste dalle nuove tecnologie. La Commissione europea ha a tal fine proposto un regolamento che modifica le direttive 2006/2004/CE e 2011/83/UE e che sostituisce la direttiva 90/314/CEE. La relazione chiarisce che si tratta di una direttiva di completa armonizzazione nell'interesse di consumatori e prestatori di servizi. Le nuove disposizioni si applicano ai settore online e offline per i viaggi d'affari e modificano sostanzialmente il meccanismo di protezione da insolvenza. È inoltre offerta ai viaggiatori la possibilità di sostituire il proprio con un pacchetto equivalente qualora l'organizzatore alterasse unilateralmente un elemento principale del contratto di viaggio. La proposta stabilisce sanzioni e chiarisce l'ambito della tutela dei viaggiatori per l'acquisto di combinazioni di servizi di viaggio includendo nella definizione diverse forme di pacchetti on-line e viaggi organizzati. Si ampliano le deroghe in materia di contratti accessori per allargarli ai servizi ausiliari forniti come elemento legato al pacchetto, e si chiarisce il concetto di "organizzazione assistita di viaggio", rinominata "organizzazione collegata di viaggio".

  Alberto Cirio (PPE), per iscritto. ‒ Ho votato a favore di questa proposta perché penso che, per tutelare al meglio l'importantissimo settore del turismo in Europa, sia molto importante bloccare quelle pratiche attraverso le quali i servizi turistici, che offrono pacchetti online, offrono servizi aggiuntivi in modo nascosto, oscuro o ambiguo.

Mi espongo sempre contro qualsiasi tipo di frode per avere un'Europa più seria, trasparente e pulita possibile, soprattutto in un settore come quello turistico dove l'Europa ha un serio vantaggio competitivo e non può perderlo a causa della mancanza di fiducia. È una questione di tutela delle imprese che sul territorio, quotidianamente, si ingegnano per offrire servizi ai turisti, ma è il più grande baluardo di difesa delle nostre terre, così ricche di storia e cultura, ma spesso depauperate da pratiche commerciali scorrette.

Os consumidores europeus encontravam-se menos protegidos, na medida em que as normas existentes não preveem estas situações ou abrangem-nas de forma pouco clara pois foram concebidas apenas para as viagens organizadas tradicionais.

O status quo atual, de não aplicação às viagens feitas online e de legislação dispersa dos Estados-Membros para a sua regulação, gera incerteza entre os consumidores quanto aos direitos que lhes assistem, criando também dúvidas entre os operadores quanto às suas responsabilidades e fragmentando o Mercado Interno.

Apoio o Relatório Collin-Langen por considerar urgente a reforma da Diretiva Viagens organizadas, tendo-se alcançado um acordo entre o PE e o Conselho que coloca em equilíbrio um elevado nível de defesa do consumidor e a promoção de um espaço livre para a circulação de mercadorias e serviços além fronteiras.

Os consumidores têm que estar no centro do Mercado Interno, sendo agora reconhecida, por um lado, uma maior transparência e o reforço da proteção dos consumidores e, por outro lado, a harmonização desejada que propicia equidade às empresas.

  Therese Comodini Cachia (PPE), in writing. ‒ Malta, along with other Member States, has expressed serious concerns on this proposal during all stages of the discussions of this file. In this regard a common statement was co-signed by Belgium, Estonia, Ireland, Malta, the Netherlands and Slovakia when the vote for a political agreement during the Competitiveness Council was taken. The aspects of this proposal are at odds with the aims of the Digital Single Market Strategy which seeks to overcome barriers to the full utilisation of the internet and digital technologies for the benefit of consumers and businesses alike. The proposal risks stifling innovation and hindering the competitiveness of our tourism sector, ultimately creating higher prices and less choice for consumers.

La propuesta del Consejo recoge las preocupaciones del Parlamento en el sentido de una armonización al alza de los derechos del consumidor en el ámbito de esta regulación turística.

  Andrea Cozzolino (S&D), per iscritto. ‒ La straordinaria ricchezza del patrimonio artistico e paesaggistico europeo rende l'industria turistica un importante elemento per la crescita in Europa. Tuttavia, questa industria deve rimanere competitiva, anche attraverso una maggiore tutela dei viaggiatori. La risoluzione del Parlamento europeo, che giunge dopo un lungo iter legislativo, garantisce una maggiore armonizzazione e trasparenza delle regole in materia di pacchetti turistici e servizi turistici collegati e una maggiore tutela per i viaggiatori, rafforzando in questo modo il mercato del turismo europeo. Per questo motivo ho votato in favore della risoluzione.

  Pál Csáky (PPE), írásban. ‒ A digitális világ térnyerése, az internetes értékesítés megnövekedése jelentősen megváltoztatta a foglalási szokásokat, így mára számos önállóan szervezett út nem tartozik a kilencvenes évekből származó uniós szabályok hatálya alá, vagy nem egyértelműen fogalmazza meg az utasok jogait. Ezen oknál fogva szavazatommal támogattam az utazásokra vonatkozó uniós fogyasztóvédelmi szabályok módosítását, hiszen ezzel az utazók védelme erősödik. A jövőben ugyanazok az előírások lesznek érvényesek a repülőjáratot, szállodafoglalást vagy autóbérlést is tartalmazó, interneten foglalt szervezett utazásokra, mint amelyeket utazási irodában vásárolnak.

  Miriam Dalli (S&D), in writing. ‒ I voted in favour of rejecting the Council position because I have serious concerns on the proposal as it stands. While I acknowledge that the old package travel directive is in need of revision due to enormous changes in the travel market, and while I support the improvement of consumer protection and insolvency protection I could not support this report due to the inclusion of practices that can harm the Maltese touristic industry. A regulation needs to be smart and self-explanatory and must be enforceable, however I have doubts whether this is the case with this proposal. The main concern is that the new Directive might lead to burden and bureaucracy for SMEs in Malta, advantage third countries, and create a high degree of legal uncertainty especially due to the broad and ambitious definitions on what constitutes a package. Therefore also after reviewing the position of the main interested parties I voted against this directive.

  Viorica Dăncilă (S&D), în scris. ‒ Într-o Europă a liberei circulații a cetățenilor, garantarea dreptului acestora de a fi bine informați în legătură cu serviciile de care pot beneficia pe parcursul călătoriilor în Europa și în afara ei este necesar și benefic pentru toate părțile.

În plus, călătorii trebuie să aibă acces la mijloace adecvate pentru a putea face recurs în cazul apariției unor probleme în perioada în care beneficiază de serviciile respective, fie că vorbim de călătoria ca atare sau de un sejur, mai ales în cazul prestațiilor achiziționate pe internet.

  Nicola Danti (S&D), per iscritto. ‒ L'approvazione dell'accordo raggiunto con il Consiglio in materia di pacchetti turistici e servizi turistici assistiti aggiorna e rende più efficace la normativa europea che regola il settore degli acquisti di pacchetti viaggio, ancora fermo alla direttiva 314 del 1990, quando Internet e gli acquisti online non erano diffusi.

Ritengo positivo che la direttiva abbia rafforzato il livello di protezione dei consumatori, comparando l'acquisto di pacchetti viaggio e di servizi turistici tradizionali a quelli online. In particolare, le norme che sono state approvate oggi consentiranno a 120 milioni di viaggiatori di acquistare pacchetti personalizzati, godendo degli stessi diritti e tutele di coloro che comprano pacchetti preconfezionati o servizi turistici assistiti.

Il cambiamento e l'evoluzione delle esigenze dei consumatori e delle imprese nel mercato dei viaggi, dovuto all'avvento dell'era digitale, rendevano necessario un nuovo intervento normativo da parte delle istituzioni europee. Con l'approvazione della nuova direttiva, da adesso verrà garantita ai consumatori una maggiore tutela e informazione dei propri diritti.

  Michel Dantin (PPE), par écrit. ‒ Ce rapport propose une série de mesures afin d'offrir aux acheteurs en ligne de "voyages à forfait" (réservation d'un voyage tout-en-un), le même degré de protection légale que les voyageurs qui passent par une agence de voyages. Les organisateurs de voyages auront désormais l’obligation de communiquer les heures approximatives de départ et de retour et une indication de la nature des éventuels frais supplémentaires. Les voyageurs pourront annuler un contrat et récupérer leur argent si le prix augmente de plus de 8% ou si des événements "inévitables" comme des catastrophes naturelles ou des attaques terroristes frappent le lieu de destination. Ils pourront également obtenir des informations claires à l'avance sur le responsable en dernier ressort en cas de problème. Considérant que ce rapport renforce la protection des consommateurs lors de leurs achats sur internet, j’ai soutenu ce rapport.

  Rachida Dati (PPE), par écrit. – Par l'adoption de ce texte, le Parlement a souhaité garantir aux consommateurs européens un niveau de protection élevé lorsqu'il s'agit de contrats de voyages à forfait et des prestations de voyages assistés. Des règles harmonisées au niveau européen participent au renforcement de la confiance des consommateurs et favorisent le tourisme, secteur d'importance majeure pour les économies européennes. Il me semblait notamment important de combler les lacunes juridiques concernant les forfaits et prestations de voyage vendus en ligne.

  Philippe De Backer (ALDE), schriftelijk. – Steeds meer vakantiegangers boeken online een gecombineerd vakantiepakket. Naast een vliegtuigticket reserveren zij ineens een huurauto en boeken ze een hotelovernachting. Met de goedkeuring van de richtlijn worden de 120 miljoen Europese reizigers die online pakketreizen boeken, beter beschermd. De nieuwe rechten zullen de schade voor reizigers in de Europese Unie jaarlijks met 430 miljoen euro verminderen. Reizigers zullen onder andere meer mogelijkheden hebben om hun reis kosteloos te annuleren bij een onaangekondigde hogere kostprijs of bij een natuurramp of terroristische aanval.

Emellett az utast tájékoztatni kell jogairól és arról, hogy ki viseli az anyagi felelősséget abban az esetben, ha valami probléma merül fel. Üdvözlendő, hogy az EP azt is bevetette az új szabályok közé, hogy az utazásszervezőknek kötelező előre tájékoztatni az utast a tervezett indulási és érkezési időpontról és az esetlegesen felmerülő további költségek jellegéről.

  Mireille D'Ornano (ENF), par écrit. ‒ Cette proposition visait à favoriser les voyages "tout inclus", par internet. En harmonisant les législations européennes afin de permettre un développement accru de cette méthode de vente de voyages, ce texte tente de stimuler l’économie touristique.

S’il est bénéfique que les prestataires de voyages voient leurs démarches facilitées, permettant d’être plus efficaces sur le marché, il faut néanmoins prendre garde à ce que ces pratiques n’induisent pas un clientélisme aboutissant à un abus de position dominante vis-à-vis des acteurs locaux.

Il ne faut pas non plus que ce développement se fasse uniquement par le numérique, sans aucune présence physique. Or aucun de ces arguments n’a été développé dans ce texte. C’est pourquoi je voterai pour l’amendement de rejet de ce texte.

Тази реформа изяснява и подобрява положението на потребителите, като в същото време намалява пречките за туристическите оператори в предоставянето на информация и предлага подобрения на националните схеми за защита на несъстоятелността.

Това, което не съществуваше до момента в директивата за пакетните туристически пътувания и трябваше да бъде пригодено към развитието и промените на пазара, е липсата на защита на потребителите при купуването на „пакетна услуга“. Когато тази пакетна услуга бива купувана онлайн, някои защити, като например репатриране в случай на несъстоятелност на туроператор, не бяха налице до момента.

  Γεώργιος Επιτήδειος ( NI), γραπτώς. ‒ Το Ευρωπαϊκό Κοινοβούλιο απορρίπτει τη θέση του Συμβουλίου σε πρώτη ανάγνωση, συνεπώς και εμείς συντασσόμαστε με τη θέση αυτή του Ευρωπαϊκού Κοινοβουλίου. Πιο συγκεκριμένα πρέπει να εμποδίσουμε αθέμιτες εμπορικές πρακτικές ορισμένων εταιρειών που παρέχουν ταξιδιωτικές υπηρεσίες και κατά τη διάρκεια της παροχής αυτής των υπηρεσιών τους διαδικτυακά παρέχουν ταυτοχρόνως και άλλες υπηρεσίες με τρόπο ασαφή, διφορούμενο και συγκεκαλυμμένο. Για τους παραπάνω λόγους καταψήφισα τη σύσταση για δεύτερη ανάγνωση.

  Rosa Estaràs Ferragut (PPE), por escrito. ‒ La nueva normativa sobre paquetes de vacaciones se aplicará a dos tipos de contrato: los combinados ofrecidos por los operadores o diseñados por el viajero y un nuevo método de reserva, denominado «viajes enlazados», en el que el comprador es guiado, por ejemplo tras reservar un billete de avión, para contratar un nuevo servicio, como un coche alquilado, a través de un enlace.

Esta mejor regulación de los viajes combinados permitirá que los viajeros tengan más opciones de cancelación, y deberán contar por anticipado con información clara sobre quién es el responsable en caso de problemas.

Antes de que el viajero adquiera ninguna responsabilidad contractual, el vendedor debe dejar claro que está contratando un paquete e informar al usuario de sus derechos y de cuál es la entidad responsable en caso de que algo vaya mal. Además, los consumidores podrán cancelar su viaje combinado y recuperar su dinero si el precio total sube más del 8 % o por circunstancias excepcionales e inevitables en el lugar de destino.

Con las nuevas normas, los derechos de los consumidores se ven reforzados, al cubrir nuevos modelos de reserva y recibir información detallada sobre sus derechos, sin olvidar los intereses de la industria.

  José Manuel Fernandes (PPE), por escrito. ‒ A diretiva sobre as viagens organizadas tem data de 1990 e está elaborada tendo em conta o facto de a grande maioria dos europeus reservar as suas férias através de agências de viagens e não pela internet. Ora, era importante haver uma atualização, adaptando a diretiva à era digital, e reforçar os direitos dos consumidores, como o de rescindir o contrato se o aumento de preço for superior a 8%, de ser repatriado no caso de o operador turístico abrir falência e de receber assistência se algo correr mal durante as férias.

As viagens personalizadas não são abrangidas pelas normas em vigor ou são-no de forma ambígua, fazendo com que os consumidores não estejam seguros dos seus direitos e os operadores não saibam quais são exatamente as suas obrigações. Esta atualização significa que passarão a estar também protegidos mais 120 milhões de consumidores que compram estas fórmulas de viagem personalizadas, de acordo com dados da Comissão Europeia.

A Comissão Europeia propõe que o operador tenha o direito de aumentar o preço em função dos custos de combustível, dos impostos e das flutuações das taxas de câmbio, o que claramente coloca o consumidor numa situação de fragilidade. Por outro lado, o organizador/retalhista está obrigado a fornecer proteção em caso de insolvência, a fim de garantir o repatriamento dos viajantes e o reembolso dos pagamentos efetuados. Porém, esta obrigação só prevalece para os organizadores de viagens organizadas e os retalhistas que proponham a aquisição de serviços combinados de viagem.

Apesar de tudo isto, esta proposta resolve alguns problemas atualmente existentes, uma vez que a diretiva se encontra obsoleta, tendo em conta o aparecimento de operadores digitais, o que cria condições de desvantagem para inúmeras PME do sector, razão pela qual, mesmo não sendo esta proposta totalmente positiva, na sua versão atual que merece o acordo do Conselho e da Comissão Europeia, votámos contra a proposta do grupo EFDD de rejeitar, pura e simplesmente, a alteração da diretiva, o que inviabilizaria qualquer melhoria face à situação atualmente existente.

Táto revízia bude prospešná pre spotrebiteľov, ale aj pre poskytovateľov služieb. Revízia prinesie efektívnejšie pravidlá pri ochrane cestujúcich pri insolvencii poskytovateľa služby, prísnejšie pravidlá pre obchodníkov, pokiaľ balík cestovnej služby nebude zodpovedať požiadavkám spotrebiteľov, a v neposlednom rade zlepšenie ochrany cestujúcich v prípade znemožnenia návratu v dôsledku nepredvídateľných skutočností a okolností.

Für mich steht der Schutz der Verbraucherinnen und Verbraucher an erster Stelle, und darum stimme ich der Richtlinie in vollem Umfang zu.

I strongly support more effective rules on insolvency protection for travellers in case of the trader’s insolvency; stricter liability of traders in case of underperformance of the package; improved pre-contractual information requirements and termination rights; and better protection in cases where the traveller’s return is impossible because of unavoidable and extraordinary circumstances.

I believe that the compromise reached after a difficult negotiation regarding definitions of linked travel arrangements and travel packages represents a satisfactory result. It is very important that the definition of linked travel arrangements has been widened in order to ensure adequate protection for travellers. Moreover, I welcome the obtaining by the European Parliament of an appropriate review process by 2018 of these definitions by the European Commission, accompanied if necessary by legislative proposals, in order to verify ‘whether an adjustment or broadening of the definition of travel packages is appropriate’.

Ezen oknál fogva, szavazatommal támogattam az utazásokra vonatkozó uniós fogyasztóvédelmi szabályok módosítását, hiszen ezzel a jövőben ugyanazok az előírások lesznek érvényesek a repülőjáratot, szállodafoglalást vagy autóbérlést is tartalmazó, interneten foglalt szervezett utazásokra, mint amelyeket utazási irodában vásárolnak. A módosított szabályok értelmében mielőtt a nyaralók aláírják a szerződést, az utazásszervezőknek vagy az utazás értékesítőinek egyértelműen el kell magyarázniuk, hogy csomagról van szó. Emellett az utast tájékoztatni kell jogairól és arról, hogy ki viseli az anyagi felelősséget abban az esetben, ha valami probléma merül fel. Üdvözlendő, hogy az EP azt is bevetette az új szabályok közé, hogy az utazásszervezőknek kötelező előre tájékoztatni az utast a tervezett indulási és érkezési időpontról és az esetlegesen felmerülő további költségek jellegéről.

Con la aprobación de dicha Directiva se refuerzan los derechos de los consumidores: en primer lugar, al cubrir nuevos modelos de reserva ̶ páginas enlazadas ̶ , los viajes combinados formados por varios servicios de viaje (vuelo, hotel o alquiler de vehículo) y comprados en línea contarán con la misma protección que los paquetes contratados en agencias de viajes, ya que dichas ofertas enlazadas en las que el nombre del cliente, los detalles de pago y la dirección de correo electrónico se transfieran de un proveedor a otro y se concluya un segundo contrato en menos de 24 horas después de la adquisición del servicio, se considerarán viaje combinado a efectos de la legislación.

Y, en segundo lugar, al recibir información detallada sobre sus derechos, los viajeros tendrán más opciones para cancelar el contrato, y deberán contar por anticipado con información clara sobre quién es el responsable en caso de problemas. También gozarán de mayor protección en caso de insolvencia de los empresarios.

  Elena Gentile (S&D), per iscritto. ‒ Ho votato a favore della raccomandazione del Parlamento europeo per la seconda lettura del Consiglio concernente la direttiva del Parlamento europeo e del Consiglio relativa ai pacchetti turistici e ai servizi turistici collegati perché credo che l'evoluzione del mercato dei servizi turistici offerti in rete richieda un adeguamento della legislazione vigente.

Ritengo essenziale infatti che l'UE metta in campo una legislazione forte che tuteli i diritti dei consumatori-viaggiatori, combatta le pratiche commerciali sleali e i falsi annunci commerciali e garantisca anche le autorità pubbliche. Più trasparenza e maggiori controlli, dunque, per i pacchetti turistici acquistati on line. Si tratta di un tema complesso per via delle diverse nozioni di "pacchetto turistico" nei diversi paesi. Perciò è importante la spinta del Parlamento europeo per una maggiore uniformità della normativa.

Importanti sono le previsioni relative all'insolvenza dell'operatore turistico, ai diritti dei viaggiatori in tema di riduzione dei prezzi, compensazione dei danni immateriali, estensione del termine per presentare reclami e mancato rispetto del contratto. Sollecito quindi il Consiglio a una rapida e definitiva approvazione del pacchetto in seconda lettura, per mettere nero su bianco queste garanzie a tutela di tutti i cittadini europei e delle stesse imprese turistiche.

  Jens Gieseke (PPE), schriftlich. ‒ Ich habe mich für den Schutz der Bürger bei der Buchung von Reisen über das Internet eingesetzt. Ein immer größerer Teil der Reisen wird heute online gebucht. Auch dort ist es wichtig, dass der Schutz der Bürger gewährleistet ist. Beispielsweise muss die unbewusste Buchung von zusätzlichen Reiseoptionen unterbunden werden. Hierzu braucht es einheitliche Standards und Regeln. Gleichzeitig darf dies nicht zu Überregulierung bei kleinen und mittleren Tourismusbetrieben führen.

Era hora de actualizar la legislación europea para tener en cuenta el creciente papel que internet juega en la configuración de los viajes de los ciudadanos, que ya no acuden tanto a una agencia de viajes sino que prefieren personalizar sus viajes contratando el transporte y el alojamiento en distintas webs. La nueva Directiva que aprobamos hoy aclara y moderniza el ámbito de protección de los viajeros que adquieren combinaciones de servicios de viajes para el mismo viaje o vacación, garantizando que estén mejor informados sobre los servicios que adquieren y ofreciéndoles soluciones más claras si algo va mal.

In an increasingly digital age, it is imperative that we address the imbalance in protections and regulatory requirements between online and more traditional modes of transaction. Only once this is achieved can we move towards an increased single market in this sector and facilitate greater and more efficient levels of cross-border selling and buying.

Improvements to the rules applying to national schemes of insolvency protection are also a welcome development in addition to the proposed deregulation in respect of business-to-business sales.

When combined, this report will contribute to a more clearly defined and further-reaching package travel directive. It is for these reasons that I voted in favour of the Council’s position.

Le texte présenté, qui s'inscrit dans le cadre du marché unique numérique, vise à harmoniser les législations dans le domaine des prestataires de services de voyage qui commercialisent leurs services en ligne.

Il s'agit principalement de combattre les services additionnels cachés, peu claires ou ambigus, qui visent par exemple à cacher aux consommateurs qu'il est possible de ne pas réserver certains services.

Toutefois, le texte présenté passe à côté du principal problème. Il ne s'oppose pas aux abus de position dominante qui ont été progressivement instaurés par les opérateurs numériques les plus puissants.

Ces abus prennent la forme suivante: le consommateur qui recherche sur internet une prestation de voyage se voit proposer des choix "fléchés", c'est-à-dire que les moteurs de recherche lui donnent comme réponses des entreprises qui sont liées contractuellement avec eux. Parfois, les entreprises qui sont ainsi promues font elles-mêmes partie du même groupe de sociétés que le moteur de recherche.

Le résultat, c'est que les acteurs économiques les plus importants sont évidemment favorisés au détriment des petites et moyennes entreprises.

  Tania González Peñas (GUE/NGL), por escrito. ‒Hemos votado en contra de la enmienda de UKIP, que impedía que esta resolución legislativa pasara a segunda lectura. Al no pasar esta enmienda, y teniendo en cuenta el procedimiento legislativo, no hubo votación del informe, sino que pasa automáticamente a segunda lectura. Esta Resolución contiene aspectos positivos como la protección al consumidor, mayor información y soluciones en lo que se refiere a la contratación de paquetes de viajes y vacacionales. Sin embargo, hay aspectos que deben mejorarse, y que a través de la Comisión de IMCO, como ampliar el alcance de esta legislación, resolver ambigüedades en los casos de cambio de tarifas, compensaciones económicas, etc.

I accidentally supported the amendment to reject the Council position at first reading and have since corrected my vote. It has become necessary to adapt the legislative framework established by the 1990 directive to online market developments, remove ambiguities and close legislative gaps given the evolution of the travel market and the ever increasing role played by the internet in how consumers research, organise and purchase travel products. This directive will increase consumer rights with stricter controls on price surcharges, a requirement to pass price reductions and compensation for non-material damages, etc., as well as covering business travellers under the directive so that SMEs and independent workers can also benefit from its protection.

The report strengthens travellers’ insolvency protection and also gives travellers the possibility of taking up an equivalent package when the organiser alters a main component of the package travel contract unilaterally.   Mary Honeyball (S&D), in writing. ‒ The travel market has changed dramatically in recent years with the move towards online booking. A revision to the legislation is therefore necessary to strengthen the rights of travellers in Europe and bring new booking models within the scope of the rules.

This is a positive proposal for consumers and businesses. It will guarantee more effective rules on insolvency protection for travellers in cases of trader’s insolvency and well as stricter liability for traders in case of underperformance. Importantly, travellers will have the right to cancel the contract and get a refund if the price increases by more than 8% or if unavoidable events strike the place of destination.

  Филиз Хюсменова (ALDE), в писмена форма. ‒ Уважаеми г-н Председател, от приемането на Директивата относно пакетните туристически пътувания през 1990 г. до днес пазарът на туристическите услуги се разви внушително в следствие на възможностите, предоставени на потребителите от широката употреба на интернет. Независимо от това, много от предоставяните туристически услуги се оказаха в „сивата зона“.

Видна е необходимостта от преразглеждане на законодателството в тази сфера. Вярвам, че предложението за актуализиране на действащите правила на Европейския съюз относно ваканционните пакети среща нуждите и на потребителите, и на бизнеса в този бързо развиващ се сектор, като адаптира настоящата регламентация към съвременните специфики на пазара и отстранява законодателните непълноти.

От потребителска гледна точка, предложението за изменение осигурява по-ясна закрила за правата на европейските потребители. Освен това, предложението за изменение установява равни възможности за операторите, като отстранява пречките за осъществяване на трансгранична търговия.

Ето защо подкрепям изменението на Директивата относно пакетните туристически пътувания и смятам, че тя ще подобри нашата икономика, като позволи на туристическия бизнес да разшири своя обхват, подобрявайки същевременно защитеността на потребителите чрез по-ясни и хармонизирани правила.

  Peter Jahr (PPE), schriftlich. ‒ In Europas Wirtschaft spielt der Tourismus eine immer zentralere Rolle und auch Pauschalreisen erfreuen sich zunehmend an Beliebtheit. Dass diese Art von Reisen über das Internet gebucht wird, zeigt ein hohes Kundenvertrauen in Online-Dienste. Neue Märkte, das bedeutet vor allem auch neue Herausforderungen. Beispielsweise entwickelte sich die Untugend, bei sogenannten Pauschalreisen anfallende Zusatzkosten nicht sichtbar auszuweisen. Hier schafft die Richtlinie Rechtsklarheit. Alle mit einer Pauschalreise verbundenen Zusatzkosten sowie die Option, diese Zusatzkosten abzuwählen, müssen für den Verbraucher eindeutig sichtbar sein. Zugleich zielt die Direktive auf das Funktionieren eines einheitlichen Binnenmarkts ab und steht als hervorragendes Beispiel dafür, dass die Europäische Union nicht nur wirtschaftliche Ziele verfolgt, sondern auch im Sinne des europäischen Verbrauchers handelt.

  Ivan Jakovčić (ALDE), napisan. ‒ Glasao sam za nacrt zakonodavne rezolucije Europskog parlamenta o stajalištu Vijeća u prvom čitanju radi donošenja direktiva Parlamenta i Vijeća o putovanjima u paket aranžmanima i povezanim putnim aranžmanima, o izmjeni Uredbe (EZ) br. 2006/2004 i Direktive 2011/83/EU te o stavljanju izvan snage Direktive Vijeća 90/314/EEZ, jer se time prihvaća stajalište Vijeća u prvom čitanju.

Turizam ima ključnu ulogu u europskom gospodarstvu te je važan pokretač rasta u svim zemljama članicama. Držim da je potrebno podignuti razinu sigurnosti među trgovcima i potrošačima te unaprijediti funkcioniranje unutarnjeg tržišta u navedenom području. Potrebno je također osigurati ravnopravne uvjete i ukloniti pravne prepreke kako bi se sektor mogao razviti u skladu s ostalim politikama i ciljevima Europske unije, te stoga podržavam ovu preporuku.

  Jean-François Jalkh (ENF), par écrit. ‒ Cette proposition tend à harmoniser les législations nationales relatives aux voyages à forfait et aux prestations de voyage assistées ou liées, ce dans le cadre de la création d'un marché unique numérique. Ces voyages à forfait comprennent un ensemble de prestations proposées au client à un prix fixe par un tour opérateur. La proposition propose notamment de favoriser cette activité sur internet afin de stimuler le marché.

Toutefois, ce rapport une telle centralisation de l'offre de prestations liées risque de fausser la concurrence au détriment des TPE/PME qui ne pourront rivaliser avec les gros groupes.

J’ai donc voté en faveur de l'amendement de rejet.

  Diane James (EFDD), in writing. – I and my fellow MEPs have voted in favour of rejecting the Council position at second reading. Whilst we are great advocates of increasing consumer rights we are against the full harmonisation that this directive requires. In 2014 a UK government report stated that this proposal was ‘far from perfect’. I believe that if national governments had the opportunity to update their own consumer protection laws they would be able to pass legislation that is the best fit for their consumers.

  Karin Kadenbach (S&D), schriftlich. ‒ Mit der Überarbeitung der Pauschalreiserichtline haben wir eine dringend notwendige Novellierung der 25 Jahre alten Gesetzgebung auf diesem Gebiet. Zu oft werden im Internet Flüge, Hotels und Mietwagen mit einem einzigen Klick erworben, und wenn eine der Leistungen ausfällt, berufen sich Verkäufer gerne darauf, dass sie lediglich Vermittler waren. Das darf nicht sein. Unsere Bürgerinnen und Bürger verdienen einen besseren Schutz, wenn sie verschiedene Reiseleistungen bei einem Anbieter buchen. Als Sozialdemokratinnen und Sozialdemokraten unterstützen wir es, Reiseanbieter in die Verantwortung zu nehmen, wenn Teile des bei Ihnen erworbenen Pakets nicht erbracht werden. Für mich steht der Schutz der Verbraucherinnen und Verbraucher an erster Stelle und darum stimme ich der Richtlinie in vollem Umfang zu.

  Othmar Karas (PPE), schriftlich. ‒ Die ÖVP-Delegation hat im EP den EFDD-Änderungsantrag abgelehnt, weil wir Verbesserungen für den Mittelstand erreicht und Verbraucher mehr Schutz erhalten haben. Ich war mir der Probleme der Gastronomie und Hotellerie bewusst und habe durch ständigen Austausch mit Berichterstatterin Collin-Langen, der WKÖ, Verbraucherschützern sowie Stakeholdern den Anliegen der Branche Gehör verschafft. Als Präsident der KMU-Intergruppe habe ich mit HOTREC eine Veranstaltung organisiert, um die Sorgen der heimischen Gastronomie und Hotellerie offen zu diskutieren.

Die gesamte Last für eine ausbalancierte, praktikable Richtlinie lag beim EP, weil die österreichische Bundesregierung keine gemeinsame Verhandlungsposition hatte und daher im Entscheidungsprozess ausfiel. Dagegen zu sein ist zu wenig. Das EP konnte erreichen, dass erst eine Pauschalreise begründet wird, wenn die touristische Dienstleistung mindestens 25 % der gesamten Pauschalreise ausmacht. Auch die Klarstellung, was nicht unter touristische Dienstleistung fällt, ist ein Erfolg. Die EK wird nach drei Jahren überprüfen, wie die Richtlinie und insbesondere die „Click-through“-Bestimmung umgesetzt wurden und ob Änderungen notwendig sind.

Der Richtlinie wurden einige Giftzähne gezogen, trotzdem bleiben Unsicherheiten mangels klarer Definition und zu geringem Prozentsatz für touristische Dienstleistungen. Politische Handlungsspielräume müssen nun bestmöglich genützt werden, um eine praktikable Umsetzung für Gastronomie und Hotellerie in Österreich zu gewährleisten.

  Krišjānis Kariņš (PPE), rakstiski. ‒ Viena no daudzajām Eiropas Savienības priekšrocībām un mērķiem ir neierobežota cilvēku, preču un pakalpojumu kustība pāri dalībvalstu robežām. Iedzīvotāji arvien biežāk izmanto digitālās pasaules piedāvātās plašās iespējas, un tas attiecas arī uz ceļojumu iegādi internetā. Tomēr šādus pirkumus veicot, iedzīvotājiem ļoti svarīgi ir zināt viņu tiesības un iespējas. Tāpēc Eiropas Parlamenta plenārsesijā Strasbūrā es atbalstīju priekšlikumu Eiropas Parlamenta un Padomes direktīvai, kas pastiprina un paplašina ceļotāju tiesības un uzliek pienākumu katru ceļotāju pārskatāmā un saprotamā veidā informēt par viņa tiesībām, tādējādi stiprinot patērētāju tiesību aizsardzību. Šis priekšlikums paredz skaidru informācijas nodrošināšanu pirms ceļotājs slēdz līgumu un iegādājas ceļojuma pakotni, tādējādi, sarežģījumu gadījumā, ceļotājs skaidri zina, kurš būs atbildīgs un kādas tiesības viņam tiek piemērotas. Tiek paplašinātas arī ceļotāju tiesības lauzt attiecīgos līgumus. Šis ir lielisks ieguvums ES ceļotājiem un arī tūrisma industrijai, jo novecojušais regulējums tiek mainīts uz pārredzamiem, vienotiem noteikumiem, kas veicinās uzticību un līdz ar to arī tirdzniecību.

  Afzal Khan (S&D), in writing. ‒ I stood behind the Travel Package because it seeks to protect consumers as well as businesses by improving pre-contractual information requirements and termination rights, increasing the effectiveness of insolvency protection for travellers in the case of trader’s insolvency. Trader liability will be reinforced in the case of underperformance of the package and consumers will be better protected in the case of impossible return due to unavoidable and extraordinary circumstances.

  Elisabeth Köstinger (PPE), schriftlich. ‒ Die Ablehnung des EFDD-Änderungsantrags von mir beruht auf den notwendigen Verbesserungen für den Mittelstand und den Schutz der Verbraucher.

Mir sind die Probleme für Hotellerie und Gastronomie bekannt und ich nehme sie sehr ernst: Um die Interessen dieser Branchen zu berücksichtigen, war ich in engem Kontakt mit Berichterstatterin Collin-Langen. Zusätzlich diskutierte ich mit zahlreichen Interessenvertretern von WKO, Verbraucherschutz sowie Vertretern der betroffenen Branchen.

Da auf nationaler Regierungsebene keine gemeinsame Position erreicht werden konnte, lag die Verantwortung allein beim Europäischen Parlament. Wir konnten nun erreichen, dass eine Pauschalreise erst vorliegt, sobald die touristische Dienstleistung mindestens 25 % der gesamten Pauschalreise ausmacht.

Außerdem sind nun erfreulicherweise auch die Ausnahmen der touristischen Dienstleistung genau definiert und klar geregelt. Wir befinden uns somit auf dem richtigen Weg!

Die Überprüfung der EK nach drei Jahren wird zeigen, wie die Richtlinie tatsächlich umgesetzt wurde und ob weitere Anpassungen nötig sein werden. Im politischen Diskurs werde ich mich jedenfalls weiterhin für eine Umsetzung im Sinne der Gastronomie und Hotellerie einsetzen, insbesondere hinsichtlich der Erhöhung des Prozentanteils der touristischen Dienstleistung an der gesamten Pauschalreise.

  Stelios Kouloglou (GUE/NGL), in writing. ‒ This report proposes a review of the existing regulation in order to strengthen the control of torture tools. The main points of this report are: the prohibition of online and offline marketing, to set up a regular reporting, to review the system by the European Commission and to consider that EU exports to third countries do not contribute to inhuman practices. Last but not least, the European Union will also have to update it lists with goods and substances which are banned for exports. I voted in favour of this report, since it improves the Commission’s proposal.

  Béla Kovács (NI), írásban. – Ha valamely szolgáltatási szektorban indokolt európai szintű szabályozás bevezetése, fenntartása, úgy a turizmus és az ehhez kapcsolódó ágazatok esetében ez feltétlenül igaz. Az EFDD által benyújtott módosítás a szabályozás elutasítását javasolja, ami számomra elfogadhatatlan, mert ellentétes a fogyasztóvédelmi elvekkel. A turizmus – mint határokon átnyúló gazdasági és népjóléti szektor – szabályozása értelemszerűen csak nemzetközi szinten lehetséges.

  Giovanni La Via (PPE), per iscritto. – Ho deciso di dare voto contrario a questa raccomandazione. Le nuove disposizioni prevedono l'applicazione di norme di armonizzazione, sia al settore online che offline, per i viaggi d'affari nell'interesse dei consumatori e delle imprese. Per quanto sia apprezzabile lo sforzo di voler rendere ancora più coerenti le norme in questo settore, ritengo che la disciplina di tutela del consumatore e degli operatori turistici sia già efficace e non necessiti di modifiche che ne altererebbero l'attuale buon funzionamento.

  Gabrielius Landsbergis (PPE), in writing. ‒ I am in favour of this text. This is a case of the EU responding and adapting to the changing and ever-modernising environment, where packaged sales and linked travel arrangements are becoming more and more popular. The new directive provides better consumer protection by setting clear standards on cancellation terms that limit post-contractual price increase to 8% (and establishing the right to cancel the arrangement free of charge in case of higher increases in price), ensuring the return of payments to customers in case of bankruptcy of a service provider though insolvency provisions, and so on. These new rules will protect the 120 million Europeans that use combined travel arrangements. The Commission estimates that the implementation of the new rules will reduce damages to consumers by about €430 million annually.

  Marine Le Pen (ENF), par écrit. ‒ Le Conseil envisage d’harmoniser les législations relatives aux voyages à forfait et aux prestations de voyage "assistées" ou "liées" afin de faciliter les prestations de voyages en ligne. Il s’agit donc d’une mise en œuvre accrue du marché unique numérique. Si on peut de prime abord saluer une telle initiative, ce système est susceptible de déboucher sur un certain nombre d’abus et d’externalités négatives notamment pour les TPE/PME qui devront faire face à un centralisation accrue de l’offre qui soutiendrait les grands groupes (Google favorise de manière notoire ses partenaires et ses filiales).

Les associations sont d’ailleurs critiques notamment sur la pression exercée par les lobbies du secteur des transports. Cependant, le vote en l’espèce concerne un amendement de rejet de la proposition du Conseil afin d’éviter les abus de position dominante et de concurrence faussée au profit des grands groupes.

  Philippe Loiseau (ENF), par écrit. ‒ Le vote portait ici sur un amendement de rejet du texte.

Ce rapport tend à harmoniser les législations relatives aux voyages à forfait et aux prestations de voyage "assistées" ou "liées". Si ces offres de voyage tout-en-un, facilement accessibles, sont pratiques pour tout le monde, elles faussent la concurrence sur le marché des prestataires de vacances. En effet, ce texte cherche à faciliter l'orientation de nos choix dans nos recherches numériques, et à focaliser l'attention du consommateur sur des partenaires prédéfinis, mis en avant par des sites tels que Google... Tout ceci se fait au profit de grands groupes, et logiquement au détriment des PME, qui ne peuvent s'aligner sur une telle centralisation de l'offre.

Deux facteurs, éludés des débats, ont motivé mon vote: la mise en oeuvre du marché unique numérique, que ce rapport renforcerait, et la situation de position dominante et de distorsion de la concurrence au détriment des plus petites entreprises, qu'il développerait.

Pour ces deux raisons, j'ai voté pour l'amendement de rejet, et donc CONTRE le texte en lui-même.

  Javi López (S&D), por escrito. – He votado a favor de esta Directiva porque, dados los cambios en el mercado turístico y la creciente tendencia de los consumidores a reservar sus vacaciones en línea, era necesario modernizar y adaptar la legislación a la era digital.

Con la aprobación de dicha Directiva se refuerzan los derechos de los consumidores: en primer lugar, al cubrir nuevos modelos de reserva ̶ páginas enlazadas ̶ , los viajes combinados formados por varios servicios de viaje (vuelo, hotel o alquiler de vehículo) y comprados en línea contarán con la misma protección que los paquetes contratados en agencias de viajes, ya que dichas ofertas enlazadas en las que el nombre del cliente, los detalles de pago y la dirección de correo electrónico se transfieran de un proveedor a otro y se concluya un segundo contrato en menos de 24 horas después de la adquisición del servicio, se considerarán viaje combinado a efectos de la legislación.

Y, en segundo lugar, al recibir información detallada sobre sus derechos, los viajeros tendrán más opciones para cancelar el contrato, y deberán contar por anticipado con información clara sobre quién es el responsable en caso de problemas. También gozarán de mayor protección en caso de insolvencia de los empresarios.

  Paloma López Bermejo (GUE/NGL), por escrito. ‒ Este informe forma parte del proceso de adopción de la Directiva del Parlamento Europeo y del Consejo relativa a los viajes combinados y los servicios asistidos de viaje, por la que se modifican el Reglamento (CE) nº 2006/2004 y la Directiva 2011/83/UE del Parlamento Europeo y del Consejo y por la que se deroga la Directiva 90/314/CEE del Consejo. La propuesta del Consejo recoge las preocupaciones del Parlamento en el sentido de una armonización al alza de los derechos del consumidor en el ámbito de esta regulación turística.

Por todo ello, nuestra posición es favorable.

  Antonio López-Istúriz White (PPE), por escrito. ‒ El texto presentado para adaptar los viajes combinados - aquellos que cuentan con varios elementos, como vuelo y alquiler de vehículo - y servicios asistidos de viaje a la era digital ha contado con un gran respaldo por parte de mi grupo político por varios motivos.

En primer lugar, la legislación actual data de 1990, cuando el mercado turístico ha cambiado enormemente con Internet y las reservas online. La nueva normativa garantizará a los viajeros la misma protección que si hubiesen comprado sus viajes combinados en una agencia de viajes. Además, los consumidores se verán beneficiados por la cobertura de nuevos modelos de reserva, contarán con mayor información sobre sus derechos y podrán modificar o cancelar sus viajes por causas excepcionales en el lugar de destino tales como desastres naturales, y aun así recuperar el dinero.

Se estima que hasta 120 millones de turistas compradores de viajes combinados se verán beneficiados por la nueva normativa y que sus pérdidas se verán reducidas hasta 430 millones de euros al año.

Considero, por lo tanto, que esta recomendación cumple plenamente con el objetivo de modernizar a la Directiva anterior y así he votado a su favor.

  Ivana Maletić (PPE), napisan. ‒ Turizam ima središnju ulogu u europskom gospodarstvu s 1,8 milijuna uglavnom malih i srednjih poduzeća, koja zapošljavaju 5,2 posto ukupne radne snage. Europska komisija je predložila modernizaciju Direktive u svrhu bolje zaštite putnika pri kupnji paket aranžmana i povezanih putnih aranžmana. Time bi se osiguralo i bolje funkcioniranje unutarnjeg tržišta.

Potrebno je, između ostalog, regulirati odredbe o sadržaju i predstavljanju paketa te izdavanju njihovih potvrda i odrediti mogućnosti promjene cijena aranžmana. Podržala sam izvješće zastupnice Birgit Collin-Langen zbog važnosti podizanja zaštite putnika i jačanja povjerenja u organizirana putovanja.

  Andrejs Mamikins (S&D), rakstiski. ‒ Noteikti vēl būtu loģiski, lai šāda tipa “ķeksīši” — kas atzīmē jebkurus maksas pakalpojumus kompāniju tiešsaistē — netiktu automātiski izvēlēti. Ja patērētājs gribēs kaut ko tādu izvēlēties, viņš vai viņa to izdarīs paši.

Kamēr uz brīva tirgus balstītā, kā arī jebkurā citā ekonomiskā sistēmā, viens no galvenajiem ar komercpraksi nodarbināto kompāniju pastāvēšanas principiem ir peļņas gūšana, tai jānotiek likumiem un taisnīguma principiem atbilstošos apstākļos. Citādāk cietīs gan šādu kompāniju reputācija, gan arī to peļņa, jo klienti vismaz vienkārša principa dēļ centīsies sākt izmantot konkurentu pakalpojumus, pat ja tie maksā vairāk un negodīgai kompānijai pieder monopola statuss.

  Vladimír Maňka (S&D), písomne ‒ navrhovaná smernica Rady posilňuje práva spotrebiteľov v oblasti balíka cestovných služieb pri online rezerváciách, keď si môžu spotrebitelia vyskladať požadované služby.

Zintenzívňujú sa požiadavky a podmienky na predchádzajúcu informovanosť spotrebiteľa, zvyšuje sa zodpovednosť obchodníkov a ochrana spotrebiteľov pred platobnou neschopnosťou organizátorov a poskytovateľov služieb. V konečnom dôsledku sa zaručí transparentnosť poskytovania služieb v oblasti cestovného ruchu, eliminujú nekalé obchodné praktiky poskytovateľov služieb a zvýši právna ochrana spotrebiteľa.

  Νότης Μαριάς ( ECR), γραπτώς. ‒ Στην από 26/10/2015 ομιλία μου στην Ολομέλεια του Ευρωπαϊκού Κοινοβουλίου, διατύπωσα συγκεκριμένες επιφυλάξεις σε σχέση με την εν λόγω σύσταση για δεύτερη ανάγνωση.

  Dominique Martin (ENF), par écrit. ‒ Nous avons voté contre cet amendement de rejet. Si cet amendement était passé la position du Conseil européen aurait été invalidée et la procédure interrompue. Ce texte propose une harmonisation des législations relatives aux voyages à forfait et aux prestations de voyages 'liées". L’on entend par "liées" ces prestations vers lesquelles nous sommes orientés lors des réservations de voyages. Dans le cadre du développement du marché unique numérique, ce texte permettrait de faciliter au maximum les prestations de voyage à "portée de clic". Bien que partant de bonnes intentions, ce texte fait malheureusement l’impasse sur les risques d’abus: en effet cette stratégie de prestations "liées" permet aux prestataires de favoriser leurs propres partenaires et leurs filiales, faussant ainsi la concurrence. Nous nous opposons à cette dérive.

  David Martin (S&D), in writing. ‒ I welcome the fact that as a result of this vote, package holidays, consisting of a flight, hotel or car-hire and purchased online for an all-in price or through linked webpages, will get the same protection as packages bought in travel agencies.

  Jiří Maštálka (GUE/NGL), písemně. ‒ Od přijetí příslušené směrnice v roce 2004 se odvětví cestovního ruchu značně změnilo. Zejména proto, že čím dále více spotřebitelů dává přednost nákupům zájezdů prostřednictvím internetu, kde je prodejce schopen sestavit zájezd přesně „šitý na míru“ každému jednotlivému zákazníkovi, což s sebou ovšem přináší i řadu rizik v podobě nejasných, zavádějících nebo neúplných informací poskytovaných prodejci nabízených produktů. Cílem novely směrnice musí být zvýšení transparentnosti a v konečném důsledku tak zvýšení ochrany klienta, tedy spotřebitele. Směrnice tedy nově zavádí např. povinnost upozornit cestující ještě před provedením platby na to, zda si vybrali soubornou cestovní službu nebo spojené cestovní služby, a na to, jaká je v tom případě úroveň jejich ochrany. S velkou většinou prvků obsažených v novelizovaném textu souhlasím, např. s tím, že klíčové informace, například o zásadních náležitostech cestovních služeb nebo cenách, uváděné v inzertních materiálech, na internetových stránkách pořadatele nebo v katalozích v rámci poskytování informací před uzavřením smlouvy by měly být závazné, pokud si pořadatel nevyhradí právo tyto prvky změnit a jasně a zřetelně to nesdělí cestujícímu ještě před uzavřením smlouvy. Dále je třeba jasně formulovat právo cestujícího od smlouvy odstoupit. Text jsem podpořil.

  Barbara Matera (PPE), per iscritto. ‒ Con il mio voto contrario all'emendamento presentato dal gruppo politico EFDD, che proponeva di bocciare la proposta del Consiglio, intendo mostrare la mia volontà all'avanzamento dell'iter legislativo della relazione del collega Collin-Langen.

  Georg Mayer (ENF), schriftlich. ‒ Der Bericht verbessert zwar die Rechtsstellung von Urlaubern, dies geschieht aber auf Kosten von unverhältnismäßig hohen Mehrbelastungen, insbesondere von kleinen und mittelständischen Reisedienstleistern.

  Jean-Luc Mélenchon (GUE/NGL), par écrit. ‒ Il s’agit de réviser la directive de 1990 sur les offres de voyages globales (comprenant transport, hébergement et autres services) considérant le développement des offres en ligne et la complexité de ces offres. La législation proposée oscille entre une volonté de protection des consommateurs et une harmonisation visant à limiter les coûts de mise en conformité "inutiles" pour les entreprises.

Au final elle permet de mieux informer les voyageurs, notamment sur les recours et compensations en cas de problème. Mais de nombreux cas de figure ne sont pas couverts par la directive, par exemple quand l'offre transport plus hébergement est proposée par un transporteur (comme c'est le cas pour la SNCF). De plus de nombreuses failles persistent: le prix de l’offre globale peut être révisé à la hausse si le prix du carburant augmente. Une offre peut être résiliée à la dernière minute et sans indemnisation si le nombre minimum de participants n’est pas atteint...

En bref, la directive permet aux entreprises de continuer à mettre les détails importants de leur offre en petits caractères, tout en bas du contrat. Je m’abstiens pour ne pas m'opposer aux maigres avancées contenues dans ce texte.

  Nuno Melo (PPE), por escrito. ‒ O Parlamento Europeu aprovou a revisão da diretiva sobre as viagens organizadas (criada em 1990). Esta atualização legislativa é de grande relevância numa era cada vez mais digital, em que os consumidores reservam cada vez mais viagens pela internet. É fundamental que haja uma adequação e vigilância reforçada dos direitos dos consumidores num equilíbrio com a proteção da liberdade de circulação.

  Miroslav Mikolášik (PPE), písomne. ‒ Keďže cestovný ruch zohráva v hospodárstvach Únie dôležitú úloh, pričom na jej hrubom domácom produkte sa spolu s príbuznými odvetviami podieľa približne 10 percentami, vítam, že predložená pozícia Rady k prijatiu smernice o balíkoch cestovných služieb a dohodách o spojených cestovných službách odráža politickú dohodu, ku ktorej dospeli Európsky parlament a Rada v záujme úspešného a promptného prijatia smernice. Súčasné pravidlá týkajúce sa tejto problematiky totiž pochádzajú z roku 1990, keď neexistoval internet, letecké spoločnosti neboli liberalizované a na trhu v oblasti cestovného ruchu sa ponúkali najmä hotové dovolenky. Dnes si však podľa štatistík takmer štvrtina dovolenkárov kupuje dovolenky upravené na mieru, pričom 35 percent z celého predaja cestovných služieb sa uskutočňuje online. Považujem preto za veľmi potrebné, aby 120 miliónov dovolenkárov kupujúcich dovolenky upravené na mieru malo tie isté práva, ako dovolenkári, ktorí sa rozhodnú pre hotové balíky, čo prijatie smernice zabezpečí. Zavedie sa ňou zároveň aj veľmi potrebná právna zrozumiteľnosť a istota pre podnikateľské subjekty, a to v rámci trhu celej Únie. Ochrana poskytovaná podľa predpisov členských štátov tak bude porovnateľnejšia, čím sa posilní základ pre vzájomné uznávanie.

  Marlene Mizzi (S&D), in writing. ‒ I support the improvement of consumer protection in the field of dynamic packages and the revision of the Package Travel Directive, but in my opinion the final text of the Directive voted on 27 October would lead to extra burden and bureaucracy for SMEs in Malta and create a high degree of legal uncertainty, especially due to the broad and ambitious definitions on what constitutes a package instead of improving the situation for consumers and SMEs. I therefore voted against the results of the second reading agreement of the revision of the Package Travel Directive.

  Csaba Molnár (S&D), írásban. ‒ A turizmus központi szerepet játszik napjaink európai gazdaságában. Az európai idegenforgalmi ágazat a maga 1,8 millió (többnyire kis- és közép-) vállalkozásával, a munkaerő 5,2%-ának foglalkoztatásával az Unión belüli növekedés egyik motorja. Az európai utazási és idegenforgalmi ágazat a kapcsolódó területeket is beleértve az Unió GDP-jének mintegy 10%-át állítja elő. Az idegenforgalmi piac ugyanakkor jelentős fejlődésen ment keresztül a 90/314/EGK irányelv elfogadása óta.

Az utazási szolgáltatások fölkínálásában az internet egyre növekvő fontosságú közvetítő közeg lett. Számos így fölkínált szolgáltatás a jog szürke zónájába tartozik, vagy egyszerűen kívül esik a 90/314/EGK irányelv hatókörén. Szükségessé vált emiatt a 90/314/EGK irányelv korszerűsítése, hogy a jogi kereteket hozzáigazítsuk a piac fejlődéséhez, kiszűrjük a kétértelmű rendelkezéseket és bezárjuk a jogi kiskapukat. A Bizottság mindennek érdekében európai parlamenti és tanácsi irányelv elfogadására tett javaslatot. Az Európai Parlament e javaslattal kapcsolatban első olvasatban kialakította álláspontját. Erre való tekintettel a Belső Piaci és Fogyasztóvédelmi Bizottság azt javasolta, hogy az EP második olvasatban támogassa a Tanács első olvasatban elfogadott álláspontját. A tervezetről ennek megfelelően szavaztam.

  Cláudia Monteiro de Aguiar (PPE), por escrito. ‒ Foi hoje aprovada a revisão da Diretiva sobre as viagens organizadas e serviços de viagens conexos, que datava de 1990. Esta recomendação para segunda leitura referente à posição do Conselho em primeira leitura adapta esta diretiva à era digital e ao facto que 60% dos consumidores reserva e compra as suas férias pela Internet.

Os viajantes que utilizam a Internet estarão agora mais protegidos quanto ao respetivo contrato e também devem ter ao dispor um número de telefone de emergência ou um ponto de contacto com o organizador ou a agência de viagens. O reforço dos seus direitos de consumidores abrange também as questões de receber assistência se algo correr mal durante as férias, de ser repatriado no caso de o operador turístico abrir falência e de rescindir o contrato se o aumento de preço for superior a 8%.

Votei favoravelmente esta proposta que os Estados-Membros devem transpor em dois anos para a legislação nacional, passando as novas regras a ser aplicáveis seis meses depois.

  Sophie Montel (ENF), par écrit. – Le Conseil envisage d’harmoniser les législations relatives aux voyages à forfait et aux prestations de voyage "assistées" ou "liées" afin de faciliter les prestations de voyages en ligne. Il s’agit donc d’une mise en œuvre accrue du marché unique numérique. Si on peut de prime abord saluer une telle initiative, ce système est susceptible de déboucher sur un certain nombre d’abus et d’externalités négatives notamment pour les TPE/PME qui devront faire face à un centralisation accrue de l’offre qui soutiendrait les grands groupes (Google favorise de manière notoire ses partenaires et ses filiales).

Les associations sont d’ailleurs critiques notamment sur la pression exercée par les lobbies du secteur des transports. Cependant, le vote en l’espèce concerne un amendement de rejet de la proposition du Conseil afin d’éviter les abus de position dominante et de concurrence faussée au profit des grands groupes.

  Claude Moraes (S&D), in writing. ‒ The travel package proposal represents a positive solution for consumers and businesses. It will guarantee more effective rules on insolvency protection for travellers in case of the trader’s insolvency; stricter liability of traders in case of underperformance of the package; improved pre-contractual information requirements and termination rights; and better protection in cases where the traveller’s return is impossible because of unavoidable and extraordinary circumstances.

  Nadine Morano (PPE), par écrit. ‒ J’ai voté en faveur de ce texte relatif aux voyages à forfait et aux prestations de voyage assistées. Les évolutions sur le marché du voyage et notamment la tendance croissante des réservations en ligne appelaient l’adaptation de la directive qui datait de 1990. La nouvelle directive élargit la définition du voyage à forfait pour y faire figurer la plupart des réservations de voyages comprenant différents éléments (vol, réservation d’hôtel, location de voiture…).

Elle y inclut les "prestations reliées", pour lesquelles les données de l'internaute sont automatiquement reprises entre les différentes étapes de la réservation, par une ou plusieurs entreprises entretenant des liens commerciaux. Les dispositions votées permettront aux voyageurs qui achètent des vacances à forfait en ligne de bénéficier de la même protection que des prestations achetées dans une agence de voyages.

De plus, il sera possible d'annuler gratuitement un voyage à forfait si son prix augmente de plus de 8% ou si des événements "inévitables" comme des catastrophes naturelles ou des attaques terroristes frappent le lieu de destination. Trois nuitées devront en outre être offertes au vacancier quand des circonstances exceptionnelles et inévitables empêchent son rapatriement.

  József Nagy (PPE), írásban. ‒ Üdvözlöm ezt a jelentést, hiszen újra egy olyan témában hoz az EU fogyasztóbarát szabályozást, mely polgárok millióit érinti.

Felgyorsult világunkban egyre gyakrabban döntünk úgy egy utazás mellett, hogy az internetet böngészve választjuk ki az úti célt, a szállást, a repülőt vagy egyéb járművet, illetve a szabadsághoz hozzákapcsolódó egyéb szolgáltatásokat. Ezt már a szolgáltatók is felismerték, s egyre több csomag-ajánlattal találkozhat az ember, sokszor bizony jóval kedvezőbb áron, mint azt a hagyományos utazási irodák kínálják. Ráadásul mindezt az ember otthon a fotelből eléri - jóval nagyobb választási lehetőségek figyelembevételével, mint ha beballag egy hagyományos irodába.

Legfőbb ideje viszont a fogyasztóvédelem megerősítésének e téren is. Éppen ezért rendkívül fontosnak tartom, hogy az új szabályozás értelmében a szolgáltatók kötelesek részletesen és átláthatóan tájékoztatni a fogyasztót a szerződés minden feltételéről, hiszen az internetes kattintgatásokkal meglepő végösszegeket lehet azért könnyen összehozni, illetve hogy a vásárló visszaléphet a szerződéstől, ha a csomag-szolgáltatás árát 8 %-kal megemelné a szolgáltató. Ráadásul az előre nem látható körülményekre felkészülve, ilyen foglalások esetében is jogosult lesz az ember 3 plusz napos szállás-biztosításra.

Úgy gondolom, az Európai Parlament jó munkát végzett ezzel a jelentéssel, hiszen az eredeti bizottsági javaslatot sokkal fogyasztóbarátabbá sikerült módosítanunk a tárgyalások során.

  Norica Nicolai (ALDE), in writing. ‒ I voted in favour of this package as I believe it is in the interests of all Europeans to have a streamlined, modern and secure legislation on travel packages and arrangements. Tourism is one of the most stable and important sectors of the economy in all of the EU. Tourist numbers are only increasing across the board and revenues made from this industry are helping to keep tens of thousands of families financed. As more and more packages are trans-border, as more intra-Union and external travellers want to see more, to travel more, we need to have a full set of regulations that allow agencies, travel operators, transport companies and the tourists themselves a full range of options and modern terminology, protect their rights, ensure compensation and security and boost this sector of the economy. I believe this document makes an important step in this direction so I voted in its favour!

  Luděk Niedermayer (PPE), písemně. ‒ Vítám, že cestovatelé, kteří si svou dovolenou sestavují sami a kupují třeba ubytování nebo letenku skrze propojené weby, budou mít v Evropské unii stejné právo na ochranu jako klienti cestovních kanceláří. Nová pravidla zohledňují nárůst počtu lidí, kteří si dovolenou sestavují podle svých potřeb přes internet u navzájem provázaných poskytovatelů služeb. Případy, kdy jsou cestující například po rezervaci letu vedeni pomocí webového odkazu k rezervaci doplňkových služeb, třeba pronájmu auta, se budou považovat za soubornou smlouvu. Pořadatelé a prodejci budou muset dát cestujícím jasně najevo, že jde o souborné služby, a informovat je o tom, kdo nese odpovědnost v případě komplikací.

  Liadh Ní Riada (GUE/NGL), in writing. – On the Collin-Langen (IMCO) ‘Package travel and linked travel arrangement’, I abstained. Whilst I acknowledge that there were positive aspects to this report, especially regarding improving and protecting consumer rights, there were lingering concerns, particularly on the level of harmonisation involved for implementation as it is based on the assumption that it is suitable for all 28 Member States.

Also, at the European Council of Ministers during the summer Ireland withdrew its support, citing that it risks hindering innovation and competition. There are also data protection concerns, and the degree of compensation for consumers around cancellations of packages by a travel organiser was not adequately addressed.

  Franz Obermayr (ENF), schriftlich. ‒ Ich habe mich gegen diesen Bericht ausgesprochen. Der Bericht verbessert zwar die Rechtsstellung von Urlaubern, jedoch nur auf Kosten von unverhältnismäßig hohen Mehrbelastungen insbesondere von kleinen und mittleren Reisedienstleistern.

Atkreiptinas dėmesys į tai, kad vis dažniau įsigyjant internetu šiuo metu galiojančio teisinio reguliavimo sritis pasidarė neaiški ir nebeaktuali. Todėl būtinos naujos taisyklės, kad keleiviams ES taptų paprastesnis ir saugesnis. Keliautojams turi būti taikoma vienoda apsauga neatsižvelgiant į tai, ar kelionė įsigyjama biure, ar internetu, keliautojams bus suteikta vienoda apsauga.

ES turi būti taikomos suderintos bendros privalomos keliautojų apsaugos taisyklės. Būtina aukšto lygio vartotojų apsaugą. Ypatingas dėmesys turi būti skiriamas tais atvejais, kai kelionės organizatoriai arba paslaugų teikėjai tampa nemokūs.

Pažymėtina, jog siekiant gerinti konkurenciją šioje rinkoje, kelionių sektoriaus įmonėms reikia sudaryti vienodas sąlygas. Be to, įmonėms turėtų būti sumažinama finansinė ir administracinė našta ir pašalinamos teisinės tarpvalstybinės prekybos kliūtys.

Whilst we are great advocates of increasing consumer rights, we are against the full harmonisation that this directive requires. In 2014 a UK government report had stated that this proposal was ‘far from perfect’. UKIP believes that if national governments had the opportunity to update their own consumer protection laws they would be able to pass legislation that is the best fit for their consumers.

  Marijana Petir (PPE), napisan. ‒ Svatko se od nas barem jednom našao u situaciji odbijanja kreditne kartice ili nemogućnosti da riješi smještaj na mjestu dolaska na neku destinaciju, a zbog nepredviđenih okolnosti. Možda Vam se dogodilo da Vam rent-a-car naplati osiguranje veće od najma automobila bez posebnog obrazloženja ili uz obrazloženje da niste shvatili prodavača usluga koji nije ista kompanija od koje iznajmljujete auto, a koji vam je prešutio kako trebate pročitati mala slova na internetskoj stranici na koju nema poveznice.

Takva su iskustva traumatična ako ste nekoliko tisuća kilometara od svoga doma u zemlji u kojoj možda imate i jezičnu barijeru. Iako mi Hrvati nemamo novaca za česta putovanja svijetom, smatram kako doživljaj i usluga koju nudimo u Hrvatskoj mora biti odlična za naše goste, a ne traumatična zbog neodgovornog ponašanja turističkih agencija. Zato pozdravljam ovu novu direktivu i poboljšanja koja donosi prema potrošačima.

Nažalost, ona ne rješava pitanja zaštite prava hotelijera prilikom otkazivanja turističkih aranžmana u posljednji čas niti u potpunosti štiti interese tog sektora koji je perjanica hrvatskog turizma, zbog toga smatram da je nužno provesti detaljnu raspravu o turizmu u Europskom parlamentu.

  Tonino Picula (S&D), napisan. ‒ Podržavam nacrt direktive stoga što teži uspostavljanju jasnijih, modernijih i učinkovitijih smjernica za zaštitu putnika i za pružanje informacija potrebnih potencijalnim kupcima putnih paket aranžmana. Najznačajnije odredbe su pritom mogućnost zaštite za putnike od eventualne nesolventnosti organizatora u slučaju nepredviđenih okolnosti, koja bi pokrila sve razumne predviđene troškove i uplate putnika vezane uz paket, te veća prava putnika i veća odgovornost organizatora putovanja u slučajevima nepravilne provedbe ugovora, nagle promjene cijena te potrebe za odštetom u slučaju materijalne i nematerijalne štete.

U slučaju nepravilne provedbe ugovora, teret dokazivanja je na organizatoru putovanja, kao i obveza da putniku pronađe prikladni alternativni aranžman, ili mu unutar dva tjedna omogući kompenzaciju u slučaju da takav alternativni aranžman nije u mogućnosti ponuditi. Prijedlog direktive predviđa i jasnije određenje predugovornih informacija i informacija o pravima raskidanja ugovora koje se trebaju pružiti kupcima.

Usvajanjem ovakve direktive omogućili bismo našim građanima priliku da bezbrižno i manje stresno uživaju u pravima koja im pripadaju u sklopu zajedničkog unutarnjeg tržišta Europske unije, da se slobodno kreću i zasluženo provode svoje slobodne dane putujući i upoznavajući nove zemlje i kulture.

  Andrej Plenković (PPE), napisan. ‒ Turizam danas igra središnju ulogu u europskom gospodarstvu. Kod 1,8 milijuna tvrtki, uglavnom malih i srednjih poduzeća, koje zapošljavaju 5,2 % od ukupne radne snage, Europska turistička industrija je ključna za rast EU-a, s obzirom da ukupan doprinos europskog putovanja i turizma, uključujući i srodne sektore, čini oko 10 % BDP-a EU-a. Internet postaje sve važniji medij za ponudu turističkih usluga, stoga je potrebno prilagoditi zakonodavni okvir na tržištu, ukloniti nejasnoće i zatvoriti zakonske praznine.

Predložena direktiva nastoji razjasniti i modernizirati opseg zaštite putnika pri kupnji kombinacije turističkih usluga za isto putovanje ili odmor dovođenjem svog djelokruga različitih oblika online paketa i putnih aranžmana. Izvješće želi osigurati da su putnici bolje informirani o uslugama koje kupuju te im pružiti jasnu pomoć u slučaju poteškoća. Također, regulira mogućnost i posljedice promjene cijena, sadrži dodatne obveze za prava za putnika te potrebne potpore putnika, regulira odgovornost organizatora i obveze pružanja pomoći putnicima.

Podržavam ovo izvješće za poboljšanje funkcioniranja unutarnjeg tržišta i postizanje visoke razine zaštite potrošača kroz usklađivanje zemalja članica zakonodavnim, regulatornim i upravnim propisima o paketima i drugim kombinacijama turističkih usluga.

  Salvatore Domenico Pogliese (PPE), per iscritto. ‒ La direttiva 90/314/CEE del Consiglio garantisce il diritto dei consumatori a ricevere le informazioni essenziali prima e dopo la firma di un contratto per l'acquisto di un pacchetto viaggio. Oramai i viaggiatori sono sempre più interessati a scegliere personalmente tutti gli elementi del loro pacchetto turistico ma le norme in vigore non coprono adeguatamente gli acquisti on-line. Per questo motivo, la Commissione europea ha proposto un regolamento che modifica le direttive 2006/2004 e 2011/83/UE e sostituisce la direttiva 90/314 /CEE. La proposta della Commissione stabilisce sanzioni precise e chiarisce l'ambito di applicazione della tutela dei viaggiatori per l'acquisto di combinazioni di servizi di viaggio (per lo stesso viaggio o pacchetto) includendo diverse forme di pacchetti on-line e viaggi organizzati. Le nuove norme copriranno gli ulteriori 120 milioni di consumatori che preferiscono prenotare on-line i loro pacchetti turistici. Ritengo necessario adattare il quadro legislativo vigente agli sviluppi del settore turistico al fine di eliminare le zone grigie e colmare le lacune normative. In questo modo l'UE sarà in grado di rispondere al meglio alle richieste dei propri cittadini connesse all’utilizzo di Internet nel settore turistico. Per queste ragioni ho votato a favore di questa proposta.

  Tomasz Piotr Poręba (ECR), na piśmie. ‒ Sprawozdanie zawiera wnioski z negocjacji między instytucjami towarzyszących drugiemu czytaniu na temat zmiany dyrektywy w sprawie zorganizowanych podróży, wakacji i wycieczek. Dyrektywa ta obowiązuje od ponad dwudziestu lat i jest postrzegana jako skuteczne i przydatne narzędzie ochrony konsumentów w branży podróży i turystyki. Nowelizacja dyrektywy ma na celu dostosowanie ustawodawstwa do nowych praktyk w branży turystycznej, m.in. odchodzenia od kompleksowych pakietów wakacyjnych na rzecz wakacji organizowanych samodzielnie za pośrednictwem Internetu. Takie rezerwacje nie są objęte ochroną przewidzianą na mocy dyrektywy, na przykład w przypadku powrotu konsumenta do kraju w razie bankructwa firmy świadczącej usługi podróży. Celem dyrektywy jest rozwiązanie tego konfliktu przy jednoczesnym utrzymaniu zdolności podmiotów świadczących usługi turystyczne online do innowacji i proponowania konsumentom najlepszych ofert. Dlatego poparłem nowelizację, która przyczyni się do wyjaśnienia i poprawy sytuacji konsumentów, a jednocześnie zmniejszy obciążenia spoczywające na organizatorach imprez turystycznych.

  Jiří Pospíšil (PPE), písemně. ‒ Podpořil jsem předložený návrh reformy cestovního balíčku. Jeho hlavním obsahem bylo jeho přizpůsobení současné digitální éře, což považuji za vhodné opatření v rámci jednotného evropského trhu. Řada občanů mé země využívá pravidelně cestovní služby zejména z okolních zemí, a i proto považuji lepší ochranu spotřebitelů v této oblasti za potřebnou.

  Franck Proust (PPE), par écrit. ‒ Du fait du développement des NTIC et de l'apparition de nouvelles applications mobiles, les pratiques de production, distribution et réservation de voyages à forfait et de voyages assistées se sont modifiées. Dans ce contexte, la Commission a proposé une nouvelle directive afin d'adapter le texte européen initial aux nouvelles pratiques du marché. J'ai approuvé ces modifications qui offriront un cadre législatif rénové pour ce type de services.

  Paulo Rangel (PPE), por escrito. ‒ Votei a favor por entender que é importante harmonizar os direitos e as obrigações decorrentes dos contratos de viagens organizadas e dos serviços de viagem conexos, a fim de criar um verdadeiro mercado interno dos consumidores nesse domínio.

  Evelyn Regner (S&D), schriftlich. ‒ Mit der Überarbeitung der Pauschalreiserichtline haben wir eine längst überfällige Überarbeitung der 25 Jahre alten Gesetzgebung. Immer öfter werden im Internet Flüge, Hotels und Mietwagen mit einem einzigen Klick erworben, und wenn eine der Leistungen ausfällt, berufen sich Verkäufer gerne darauf, dass sie lediglich Vermittler waren. Das darf nicht sein. Unsere Bürgerinnen und Bürger verdienen einen besseren Schutz, wenn sie verschiedene Reiseleistungen bei einem Anbieter buchen. Als Sozialdemokratinnen und Sozialdemokraten unterstützen wir es, Reiseanbieter in die Verantwortung zu nehmen, wenn Teile des bei ihnen erworbenen Pakets nicht erbracht werden. Für mich steht der Schutz der Verbraucherinnen und Verbraucher an erster Stelle, und darum stimme ich der Richtlinie in vollem Umfang zu.

  Frédérique Ries (ALDE), par écrit. ‒ Ce mardi, le Parlement européen a voté une directive qui va permettre aux 120 millions de citoyens européens qui réservent leurs voyages combinés en ligne d'avoir la même protection que ceux qui réservent dans une agence de voyage.

Les règles étaient jusqu'alors inscrites dans une loi de 1990, une époque révolue où internet n'était même pas né! La nouvelle législation prend désormais en compte la nouvelle façon dont les voyageurs planifient leurs voyages combinés à l'aide des nouveaux outils technologiques et efface cette injustice apparue dans le traitement des consommateurs.

Grace à ces nouvelles règles, le voyageur va bénéficier de toute une série de droits en cas de problème: rapatriement et remboursement en cas de faillite du tour-opérateur, prise en charge par l'organisateur de 3 nuits en cas d'évènement inévitable et imprévisible comme une catastrophe naturelle ou un attentat terroriste qui empêcherait le voyageur de repartir chez lui dans les délais prévus. Le voyageur aura également le droit d'annuler son voyage sans supporter des frais supplémentaires si son prix augmente de plus de 8% ou en cas de changements significatifs des caractéristiques principales du voyage telles que la date du voyage, l'horaire du vol ou la catégorie touristique d'hébergement.

  Dominique Riquet (ALDE), par écrit. ‒ Alors que les voyages à forfait connaissent une envolée en Europe depuis plus d'une décennie, il convenait de remettre à jour la législation européenne sur cette pratique qui consiste à proposer plusieurs prestations de services, comprenant entre autres le transport et l'hébergement, vendues par package.

J'ai ainsi voté pour cette directive qui souhaite renforcer les droits des consommateurs des voyages à forfait en proposant une plus grande souplesse dans l'annulation des voyages, notamment quand le prix du forfait augmente de plus de 8 %, et l'obligation pour les organisateurs de voyages de fournir plus d'informations sur les droits et les responsabilités des voyageurs.

Il est indéniable que ces mesures permettront de dynamiser le tourisme en Europe et c'est pourquoi je me félicite de l'adoption de ce texte.

  Robert Rochefort (ALDE), par écrit. ‒ J'ai voté contre la proposition de rejet de la position du Conseil sur les voyages à forfait et les prestations de voyage assistées.

J'ai au contraire souhaité que notre Assemblée puisse donner son feu vert à ce texte, qui modernise utilement une directive de 1990, pour l'adapter aux nouveaux modes d'achat des voyages et à la tendance croissante des achats individuels en ligne.

C'est ainsi que d'ici deux ans et demi, des droits très concrets vont s'appliquer aux consommateurs qui réservent eux-mêmes un vol, une voiture ou un séjour en "package" sans passer par une agence de voyage classique.

Sont notamment prévus davantage d'informations sur les droits en amont du processus de réservation, plus de protection contre les cas de faillite, la possibilité de prise en compte comme condition d'annulation de circonstances exceptionnelles, comme des catastrophes naturelles ou des attaques terroristes, ou encore le droit d'annulation en cas d'augmentation injustifiée de prix (de plus de 8 %). Par ailleurs, les intérêts économiques des opérateurs, agences de voyages et hôtels a été prise en compte, avec la réduction de certaines charges administratives et l'intérêt d'établir des règles uniformes dans l'Union.

  Inmaculada Rodríguez-Piñero Fernández (S&D), por escrito. ‒ Se hacía necesario revisar el marco jurídico que regula los contratos de viajes combinados. Esta propuesta pretende clarificar y modernizar el alcance de la protección y la información de los viajeros en la compra de estos servicios, mejorando sus derechos conforme a los cambios provocados por internet. Las nuevas normas aumentarán la transparencia y fortalecerán la protección de los consumidores sobre los servicios de viaje online.

La Eurocámara ha sido capaz de garantizar que la protección de los viajeros frente a la insolvencia del empresario cubra todos los gastos razonablemente previsibles y todos los pagos realizados por el viajero en relación con el paquete. Se han clarificado los derechos de los viajeros, en particular sobre la reducción de los precios, la compensación (incluyendo los daños no materiales) y la mala ejecución del contrato. La carga de la prueba ha sido desplazada a los organizadores. Además, el plazo para presentar una queja se ha prolongado dos años. En 2018 se verificará si es necesario un ajuste de la definición de «paquete de viaje».

Por todo esto, entre otras cuestiones, he votado a favor de este informe.

  Claude Rolin (PPE), par écrit. ‒ Désormais, les consommateurs qui achètent en ligne un billet d'avion ou des prestations de voyages bénéficieront, à l'avenir, du même niveau de protection que ceux qui recourent à une agence de voyage.

Nous avons aujourd'hui approuvé définitivement l'adaptation de la directive concernant les voyages à forfait et les prestations de voyage assistées. Avec cette législation révisée, les droits des voyageurs en Europe sont globalement renforcés. De nouveaux modèles de réservation sont désormais inclus dans son champ d'application et les voyageurs sont informés en détail de leurs droits.

Entre autres innovations, cette législation prévoit: - le droit du consommateur à l'annulation d'un voyage à forfait dont le prix aurait augmenté de plus de 8 % sans justification; - le droit du consommateur de bénéficier de trois nuits d'hébergement prises en charge par l'organisateur si le consommateur est empêché, pour une raison imprévisible, de rentrer chez lui; - la protection du consommateur contre la faillite des organisations de voyages à forfait; - la possibilité offerte au voyageur d'annuler sans frais un contrat en cas de circonstances exceptionnelles.

Les États membres auront deux ans pour transposer en droit interne cette directive qui répond au besoin urgent de moderniser l'ancienne directive datant de 1990.

  Fernando Ruas (PPE), por escrito. ‒ O Turismo e, muito concretamente, as viagens, incluindo os sectores conexos, representam cerca de 10% do Produto Interno Bruto da União Europeia. A adoção em 1990 da Diretiva n.º 90/314/CEE relativa às viagens organizadas reconheceu a importância dos direitos dos viajantes europeus, sempre que adquirissem férias organizadas, tipicamente constituídas por transporte e alojamento.

Contudo, estamos em 2015 - na era digital e com uma estrutura do mercado de transportes diferente e muito mais complexa do que em 1990, quando a Internet praticamente não existia. Com a generalização do seu uso e a liberalização dos transportes aéreos, tornou-se fundamental rever a diretiva, conferindo maior clareza e amplitude ao seu conteúdo e âmbito de aplicação, bem como maior proteção aos consumidores europeus no que respeita a este segmento de viagens organizadas e serviços de viagens conexos.

Em termos concretos, sublinho a necessidade das medidas de adaptação à era digital, os direitos de assistência e repatriação em caso de falência, a rescisão do contrato em caso de aumento injustificado do preço, pelo que subscrevo este relatório que, além de sustentar uma revisão urgente da diretiva, promove ainda a harmonização do mercado interno em termos regulatórios e garante a defesa e proteção dos consumidores e empresas.

  Tokia Saïfi (PPE), par écrit. ‒ J'ai voté en faveur de ce rapport concernant les voyages à forfait et les prestations de voyage assistées.

Les vacances à forfait peuvent concerner un vol, une réservation d'hôtel ou une location de voitures achetés en ligne par un voyageur lui-même. Désormais, grâce à cette directive, ces voyageurs vont pouvoir bénéficier de la même protection que lorsqu'ils ont recours à une agence de voyages.

Étant donné la tendance croissante des achats en ligne, nous devions travailler à la modernisation de l'ancienne directive datant de 1990.

Le nouveau texte, adapté à notre époque, permettra de renforcer les droits des voyageurs ainsi que leur accès à une information complète, tout en prenant en compte les intérêts économiques des agences de voyage, hôtels et opérateurs.

Ce rapport représente la finalisation d'un accord en deuxième lecture; les États vont désormais avoir deux ans pour transposer ces règles en droit national.

  Massimiliano Salini (PPE), per iscritto. ‒ Ho espresso il mio voto contrario alla proposta da parte della Commissione europea di introdurre un nuovo regolamento volto a sostituire la direttiva 90/314/CEE e a modificare le direttive 2006/2004/CE e 2011/83/UE in quanto ritengo che tale regolamento sia poco efficace ed esaustivo.

  Lola Sánchez Caldentey (GUE/NGL), por escrito. ‒ Hemos votado en contra de la enmienda de UKIP, que impedía que esta resolución legislativa pasara a segunda lectura. Al no pasar esta enmienda, y teniendo en cuenta el procedimiento legislativo, no hubo votación del informe, sino que pasa automáticamente a segunda lectura. Esta Resolución contiene aspectos positivos como la protección al consumidor, mayor información y soluciones en lo que se refiere a la contratación de paquetes de viajes y vacacionales. Sin embargo, hay aspectos que deben mejorarse, y que a través de la Comisión de IMCO, como ampliar el alcance de esta legislación, resolver ambigüedades en los casos de cambio de tarifas, compensaciones económicas, etc.

  Olga Sehnalová (S&D), písemně. ‒ Podpořila jsem výsledný text směrnice o souborných cestovních službách, protože je nezbytné uzpůsobit pravidla stávajícím trendům většího využívání internetu jako nástroje pro pořizování dovolené, od cesty, přes ubytování až po dodatkové služby, jako je například nájem automobilu v místě pobytu. Spotřebitelé, kteří si objednávají cestovní služby prostřednictvím cestovních balíčků a přes internet, budou využívat stejné úrovně ochrany podobně jako ti, kteří využívají služeb klasických cestovních kanceláří. Za důležitá ustanovení, která se podařilo prosadit Evropskému parlamentu, považuji zejména poskytnutí přehledných a jasných informací o cestovní nabídce a odpovědnosti v případě komplikací, možnost odstoupit od smlouvy v případě podstatné změny obchodních podmínek, či vyšší míru ochrany cestujících v případě znemožnění návratu kvůli nevyhnutelným a neočekávatelným situacím.

  Lidia Senra Rodríguez (GUE/NGL), por escrito. ‒ Este informe forma parte del proceso de adopción de la Directiva del Parlamento Europeo y del Consejo relativa a los viajes combinados y los servicios asistidos de viaje, por la que se modifican el Reglamento (CE) nº 2006/2004 y la Directiva 2011/83/UE del Parlamento Europeo y del Consejo y por la que se deroga la Directiva 90/314/CEE del Consejo. La propuesta del Consejo recoge las preocupaciones del Parlamento en el sentido de una armonización al alza de los derechos del consumidor en el ámbito de esta regulación turística.

Por todo ello, nuestra posición es favorable.

  Remo Sernagiotto (ECR), per iscritto. ‒ Nel corso degli ultimi anni, il ruolo delle agenzie viaggio è stato ridimensionato in seguito alla crescita dell'offerta di voli economici e delle vendite di pacchetti turistici on line. La precedente direttiva del 1990 che riguardava i pacchetti turistici assistiti è considerata un esempio di successo e utilità della protezione dei consumatori per i viaggi "tutto compreso". Dal momento che da allora il modo in cui i viaggiatori pianificano e acquistano i loro viaggi è cambiato sostanzialmente, era necessaria una revisione della normativa al fine di ampliare la definizione di "pacchetti turistici" e includervi i servizi turistici prenotati autonomamente in rete. Pertanto, ho votato a favore di questa riforma che garantirà sicuramente ai consumatori e ai viaggiatori una tutela maggiore prevedendo anche la possibilità di recedere dal contratto in condizioni eccezionali ed inevitabili, opportunità che fino ad ora non era prevista.

  Siôn Simon (S&D), in writing. ‒ I voted in favour of the travel package proposals because they represent a positive solution for both businesses and, very importantly, consumers. It will mean that there will be more effective rules on insolvency problems and guarantee stricter liability of traders in the cases of underperformance of the package.

  Branislav Škripek (ECR), písomne. ‒ Smernica o cestovných službách predstavuje užitočnú legislatívu na ochranu spotrebiteľov. Z dôvodu nárastu využívania internetového obchodu v tejto oblasti je potrebná jej revízia. Preto som hlasoval za odmietnutie pozmeňovacieho návrhu, ktorý požadoval, aby Európsky parlament zamietol pozíciu Rady v prvom čítaní a pozastavil celý proces revízie.

  Davor Škrlec (Verts/ALE), napisan. ‒ Ključni zadatak Europske unije je stvoriti regulatorni okvir kojim bi se potrošačima osigurala dovoljna zaštita da mogu pouzdano putovati bilo gdje u Uniji. Istovremeno, treba osigurati ravnopravne uvjete poduzećima koja se bave putovanjima kako bi se ostvarila što veća tržišna konkurentnost.

Komisija je predložila reviziju koja se uglavnom sastoji od razjašnjenja opsega i definicije paketnih aranžmana i „potpomognutih aranžmana putovanja”, informacije o obavezama prema potrošačima i sadržajima ugovora, pravila za zaštitu potrošača protiv nelikvidnosti poslodavaca, pravila u slučaju izmjene ugovora i dr.

Obzirom kako je ključna točka mog Kluba zastupnika doseći visoke standarde zaštite potrošača, te u isto vrijeme izbjeći složene odredbe koje ugrožavaju situaciju malih trgovaca u sektoru putničkih agencija, na plenarnoj sjednici glasao sam protiv prijedloga o ukidanju amandmana 1. od strane Vijeća. Smatram kako smo s tim sporazumom u mogućnosti postići ravnotežu između prava potrošača i potrebe očuvanja malih trgovaca te bismo mogli ukloniti tradiciju nepoštene poslovne prakse „velikih” poslodavaca.

  Monika Smolková (S&D), písomne ‒ cestovný ruch zohráva v hospodárstvach Únie veľmi dôležitú úlohu, o čom svedčí skutočnosť, že v ňom pôsobí približne 1,8 milióna najmä malých a stredných podnikov a tieto zamestnávajú asi 5,2 % celkového počtu pracovných síl. Za nemenej dôležité považujem aj to, že cestovný ruch a jeho súvisiace odvetvia predstavujú okolo 10 % HDP EÚ.

Som rada, že aj vďaka smernici o balíku cestovných služieb a dohodám spojených s cestovnými službami sa v poslednom období podarilo zvýšiť kvalitu služieb cestovného ruchu. Žiaľ, sme naďalej svedkami toho, že sa ešte stále objavujú poskytovatelia služieb cestovného ruchu, ktorí vďaka nekalým obchodným praktikám zneužívajú spotrebiteľov. Podporila som uznesenie, lebo som presvedčená, že v záujme ochrany spotrebiteľov v celej EÚ je potrebné prijať také opatrenia, ktoré zabránia poskytovateľom služieb cestovného ruchu uvádzať na trh také služby, ktoré ponúkajú skrytým, nejasným alebo nejednoznačným spôsobom. Verím, že vyššou kvalitou poskytovaných služieb cestovného ruchu sa zvýši dôvera cestujúcich a dopyt v rámci EÚ aj mimo nej, a súčasne sa zväčší istota, pružnosť a možnosť výberu. Rovnako očakávam, že sa postupne odstránia nejednoznačnosti a medzery v právnych predpisoch cestovného ruchu, a tým potvrdíme, že EÚ je poprednou svetovou destináciou cestovného ruchu.

  Igor Šoltes (Verts/ALE), pisno. ‒ S spremembo direktive o paketnih potovanjih in pomoči pri organizaciji potovanja smo dosegli, da bodo potrošniki bolje obveščeni o storitvi, ki jo kupijo.

Potrošnikom direktiva zagotavlja pridobitev vseh ključnih informacije pred in po podpisu pogodbe o paketnem potovanju. Zagotovi se jim večjo zaščito v primeru, da se cena paketnega potovanja brez upravičenih razlogov zviša, ali če pride do kakršnih koli drugih sprememb, kot je na primer čas odhoda in prihoda potovanja.

Potrošniki so zaščiteni tudi v primeru, če se cena celotnega paketa zviša za več kot osem odstotkov, saj se takrat lahko odločijo, da na potovanje ne gredo, denar pa se jim vrne. Potrošniki so zaščiteni tudi v primeru, ko pride do insolventnosti organizatorja potovanja.

Glede na vse napisano menim, da je revizija uredbe dobra, in sem vesel, da smo skupaj s Svetom in Komisijo po trdih pogajanjih uspeli doseči kompromis in pripraviti dober tekst uredbe, ki bo služila tako potrošnikom kot tudi podjetjem.

Zaradi navedenih razlogov podpiram uredbo in sem glasoval proti amandmaju, ki ga je vložila skupina EFDD, katerega namen je bilo zavrniti pozicijo Evropskega sveta in s tem posledično tudi novo uredbo.

  Renato Soru (S&D), per iscritto. ‒ Mi sono espresso in modo favorevole sulla relazione riguardante i pacchetti turistici e i servizi turistici collegati, che adegua una direttiva europea a protezione dei viaggiatori datata 1990 ai cambiamenti nel mercato dei viaggi, con particolare riferimento alla prenotazione di viaggi online.

La revisione della legislazione che abbiamo approvato determina un notevole rafforzamento dei diritti dei viaggiatori che comprano servizi turistici online. Infatti, coloro che acquistano un pacchetto turistico su internet con la formula "tutto compreso" o tramite pagine web collegate, riceveranno la stessa protezione di chi acquista un pacchetto turistico presso le agenzie di viaggio.

Inoltre, ai viaggiatori saranno fornite più opzioni per annullare un contratto, attraverso una maggiore informazione sui propri diritti e su chi sia responsabile in caso di problemi, come l'insolvenza del fornitore di servizi. Ritengo particolarmente apprezzabile l'approccio della relatrice che ha saputo coniugare protezione dei consumatori e interessi economici dell’industria, quali operatori turistici, agenzie di viaggio e strutture alberghiere.

  Bart Staes (Verts/ALE), schriftelijk. ‒ Pakketreizen zijn aangeboden vakanties waarbij verschillende elementen, zoals transport, accommodatie en activiteiten, zijn inbegrepen in de prijs. Er bestaat al een Europese richtlijn die deze kwestie behandelt, maar die dateert van 1990 en is niet meer actueel aangezien bepaalde marktstructuren, zoals het gebruik van internet, niet zijn opgenomen in de tekst. De nieuwe richtlijn moet ervoor zorgen dat er een gezonde balans is tussen consumentenbescherming en de noodzaak om kleinhandelaren in deze sector te beschermen. Na een tweede lezing door het Parlement wordt er in de tekst een duidelijke omschrijving gegeven van deze pakketreizen en van de verschillen met gekoppelde reisarrangementen. Dit zorgt voor een overzichtelijke afbakening van de verschillende sectoren waardoor consumenten op een transparantere wijze geïnformeerd worden.

Voor mij was het belangrijk dat de consument beschermd bleef, terwijl tegelijkertijd ook moet worden voorkomen dat kleinhandelaren, die vaak betere en duurzame reisarrangementen aanbieden, overrompeld worden door grote bedrijven die de markt volledig overnemen. Omdat deze balans in de tekst is opgenomen, steun ik deze richtlijn. Noodzakelijk is wel dat dit alles een goede follow-up krijgt opdat deze maatregelen geen lege doos blijven en goed toegepast worden.

  Ivan Štefanec (PPE), písomne. ‒ Reagujeme na rozmach digitálneho podnikania a s tým spojené nové druhy služieb. Zákazníci už nebudú diskriminovaní na základe toho, či si službu objednajú bežnou cestou alebo prostredníctvom internetu. Vnímam to ako dôležitý krok k dokončeniu jednotného trhu.

  Richard Sulík (ECR), písomne ‒ hlasovania o návrhu som sa zdržal. Vítam síce opatrenia zacielené na zníženie administratívnej záťaže, no nesúhlasím so zavádzaním nových regulácií, ktoré majú „chrániť“ zákazníka. Najlepšou ochranou zákazníka je konkurencia na trhu. Zvyšovanie regulačnej záťaže však zvyšuje bariéry pre vstup na trh, a tak v konečnom dôsledku konkurenciu poškodzuje. Akúkoľvek „ochranu“ si navyše zákazníci v konečnom dôsledku aj tak platia sami, či už vo forme vyšších cien alebo vo forme menej kvalitných služieb.

  Patricija Šulin (PPE), pisno. ‒ Glasovala sem proti priporočilu za drugo obravnavo o paketnem potovanju in pomoč pri organizaciji potovanja. Dandanes, v dobi informatizacije, imamo številne modele rezervacij potovanj preko spleta, ki jih obstoječa direktiva iz leta 1990 ne zajema. Zato potrebujemo novo direktivo, ki bo zajela vse nove in dodatne elemente. Vendar pri tem priporočilu smo se premalo posvetili nepoštenim poslovnim praksam in preganjanju le teh. Na spletu se namreč soočamo s ponudniki, ki svoje storitve ponujajo na dvoumen in nejasen način, s tem pa zavajajo potnike. Temu bi morali nameniti večjo pozornost, predvsem glede odkrivanja in preprečevanja.

Πιο συγκεκριμένα πρέπει να εμποδίσουμε αθέμιτες εμπορικές πρακτικές ορισμένων εταιρειών που παρέχουν ταξιδιωτικές υπηρεσίες και κατά τη διάρκεια της παροχής αυτής των υπηρεσιών τους διαδικτυακά παρέχουν ταυτοχρόνως και άλλες υπηρεσίες με τρόπο ασαφή, διφορούμενο και συγκεκαλυμμένο.

  Adam Szejnfeld (PPE), na piśmie. ‒ Przemysł turystyczny, niestety zwykle niedoceniany, w większości państw jest bardzo często generatorem wzrostu gospodarczego i ma znaczący wpływ na poziom PKB. Unia Europejska powinna zatem działać na rzecz rozwoju tego sektora. Jednym z ważniejszych elementów powinno być po pierwsze wspieranie, głównie w dostępie do zewnętrznych źródeł finansowania, zwłaszcza tych małych i średnich przedsiębiorców. Z drugiej strony, konieczne jest podejmowanie kroków w celu deregulacji sektora turystycznego. Trzeba jednocześnie pamiętać o konsumentach usług turystycznych, którzy, ze względu na specyfikę sektora, wymagają szczególnej ochrony. Jak wiemy, połączenie tych wszystkich elementów i odpowiednie wyważenie oraz utrzymanie symetrii w relacji przedsiębiorca-klient w branży turystycznej jest niebywale trudne.

Uważam, że stanowisko Rady w pierwszym czytaniu w sprawie imprez turystycznych i powiązanych usług turystycznych nie było właściwe, dlatego zdecydowałem się zagłosować przeciwko zaleceniom do drugiego czytania Parlamentu Europejskiego i wierzę, że w przyszłości uda się znaleźć taki kompromis, który weźmie pod uwagę interes zarówno dostawców, jak i odbiorców usług turystycznych.

  Charles Tannock (ECR), in writing. ‒ In the 20 years since these regulations were introduced, the travel industry has greatly changed. Gone are the days when holidaymakers would visit their local travel agency and place faith in the comprehensive travel insurance on offer. Today people are using the internet to find the best deals, often doing so by booking many months in advance – it is a great example of the free market providing choice and competition. Consumers should, however, feel confident that they are protected in cases where a product that is sold fails to conform to what is ultimately provided, and against company bankruptcy. The measures outlined in this report deliver those protections and so I am pleased to vote in favour.

Nous avons voulu faire en sorte que les vacanciers combinant leurs propres "forfaits" vacances à partir de services de voyage vendus en ligne soient mieux protégés car ils ne bénéficient pas de la même couverture que ceux qui passent par des agences de voyage traditionnelles. C'est un pas dans la direction d'une meilleure protection des droits du consommateur européen

The aim of the report is to adopt a directive on package travel and linked travel arrangements, amending Regulation (EC) No 2006/2004 and Directive 2011/83/EU of the European Parliament and of the Council and repealing Council Directive 90/314/EEC. The revised laws improve consumer rights, by putting in place stricter controls on price surcharges, a requirement to pass on price reductions to customers, compensation for non-material damages and refunds of all payments in case providers go bankrupt.

  Patrizia Toia (S&D), per iscritto. ‒ Nel corso di questi 25 anni molto è cambiato, anche nel settore del turismo. Per questa ragione ho votato a favore della relazione della collega Collin-Langen. I consumatori, grazie anche al rapido sviluppo delle tecnologie digitali, sono sempre alla ricerca di combinazioni personalizzate e di prodotti adatti alle loro esigenze e aspettative. Per questo è necessaria una modernizzazione delle norme europee, perché tutti i consumatori siano tutelati e possano decidere liberamente che tipo di contratto di viaggio sottoscrivere, senza temere di incorrere in clausole ambigue o non chiare. I miglioramenti al testo, apportati dal Parlamento, sono molto significativi per quanto riguarda le informazioni contrattuali e precontrattuali, poste al centro del provvedimento. Dobbiamo garantire a persone e utenti di conoscere cosa stanno acquistando e quali siano i diritti acquisiti.

  Miguel Urbán Crespo (GUE/NGL), por escrito. ‒ Hemos votado en contra de la enmienda de UKIP, que impedía que esta resolución legislativa pasara a segunda lectura. Al no pasar esta enmienda, y teniendo en cuenta el procedimiento legislativo, no hubo votación del informe, sino que pasa automáticamente a segunda lectura. Esta Resolución contiene aspectos positivos como la protección al consumidor, mayor información y soluciones en lo que se refiere a la contratación de paquetes de viajes y vacacionales. Sin embargo, hay aspectos que deben mejorarse, y que a través de la Comisión de IMCO, como ampliar el alcance de esta legislación, resolver ambigüedades en los casos de cambio de tarifas, compensaciones económicas, etc.

  Inese Vaidere (PPE), rakstiski. – Ņemot vērā, ka tūrisma jomā ir notikušas ievērojamas pārmaiņas, jo sevišķi ar interneta lietotāju skaita pieaugumu, skaidrs, ka līdzšinējā likumdošana par kompleksajiem ceļojumiem no 1990. gada neatbilst šī brīža situācijai.

Mūsdienu patērētāji aizvien vairāk ir ieinteresēti paši izvēlēties dažādus komplekso ceļojumu elementus, bieži no vairākiem saistītu ceļojumu pakalpojumu tirgotājiem, darot to tiešsaistē. Tādējādi rodas t.s. "pelēkās zonas", kad patērētājiem nav skaidrības par to, kāda aizsardzība viņiem pienākas, ja rodas problēmas, bet tirgotājiem nav skaidrības par saviem pienākumiem.

Arī Latvijā diemžēl ir bijuši gadījumi, kad ceļotājam ierodoties galamērķī, atklājas, ka solītā viesnīca vai pakalpojums ne tuvu neatbilst tam, kas tika solīts. Savukārt, sazinoties ar tūrisma aģentūru, jo sevišķi, ja brauciens iegādāts internetā, atklājas, ka tā ir bankrotējusi vai nav sasniedzama.

Tādēļ esmu gandarīta, ka atjaunotā likumdošana aizsargās vēl vairāk Eiropas ceļotāju, aptverot tos, kuri savas brīvdienas rezervē, izmantojot digitālos plašsaziņas līdzekļus. Šie ceļotāji ne tikai labāk tiks informēti par savām tiesībām, bet arī aizsargāti gadījumos, kad pirms ceļojuma vai tā gaitā rodas kādas neparedzētas problēmas. Atjaunotie noteikumi paredz, ka pirms ceļotājs slēgs līgumu, organizētājiem un tirgotājiem būs skaidri jānorāda, kas ietilpst ceļojuma komplektā, jāinformē par tiesībām un arī jānorāda, kurš būs atbildīgs dažādos sarežģījumos.

  Ivo Vajgl (ALDE), in writing. ‒ I voted in favour of this text concerning package travel and linked travel arrangements, as it brings regulation up to date with the developments in the travel market. The new rules will extend the protection of the 1990 EU Package Travel Directive to cover not only traditional package holidays, but also to give clear protection to 120 million consumers who book other forms of combined travel, e.g. a self-chosen combination on a website of a flight plus hotel or car rental, which is something very common nowadays. There will always be protection in cases where travel services are advertised as a package or when they are offered at a total or inclusive price. These provisions bring benefits to consumers, as they are expected to reduce damages to consumers by about €430 million a year due to the reinforced rights. At the same time, these provisions bring benefits to the businesses too, as they will reduce administrative burdens and bring down compliance costs for traders from €11 to €8 per package sold.

  Ángela Vallina (GUE/NGL), por escrito. ‒ Este informe forma parte del proceso de adopción de la Directiva del Parlamento Europeo y del Consejo relativa a los viajes combinados y los servicios asistidos de viaje, por la que se modifican el Reglamento (CE) nº 2006/2004 y la Directiva 2011/83/UE del Parlamento Europeo y del Consejo y por la que se deroga la Directiva 90/314/CEE del Consejo. La propuesta del Consejo recoge las preocupaciones del Parlamento en el sentido de una armonización al alza de los derechos del consumidor en el ámbito de esta regulación turística.

Por todo ello, nuestra posición es favorable.

  Derek Vaughan (S&D), in writing. ‒ I welcomed this move, as it highlights the need for a European tourism sector that is sustainable, responsible and accessible across Europe. Tourism is a vital cornerstone of the Welsh economy, bringing in UKP 1 billion in Cardiff alone. It is crucial that consumer concerns in this area are recognised. Labour will continue to work with consumer groups, safety organisations and industry representatives to prevent rare but devastating cases where inadequate health and safety rules have led to tragedies, including deaths from carbon monoxide poisoning. We need to work hard together to ensure rigorous safety standards across Europe, so that all holiday makers can have the peace of mind that their dream holiday is not going to turn into a nightmare.

  Hilde Vautmans (ALDE), schriftelijk. ‒ Er bestaat al geruime tijd Europese wetgeving rond bescherming van burgers die pakketreizen of reisarrangementen bestellen. Deze bescherming bestond echter nog niet voor mensen die reizen, transport, hotels, enz. los van elkaar boekten, bijvoorbeeld via het internet. Daarom stemde ik voor deze aanbeveling.

  Miguel Viegas (GUE/NGL), por escrito. ‒ O objetivo é assegurar que o viajante, quando compra serviços de viagem conexos, esteja protegido em caso de insolvência do operador que fornece o serviço de viagem conexo. Por conseguinte, o viajante terá o direito de ser repatriado se a insolvência do operador responsável pelo transporte de passageiros fizer com que o viajante fique preso no seu destino.

Por outro lado, antes de concluir o contrato que dá origem ao serviço conexo, o operador tem que informar o viajante, através de formulários normalizados, de que não beneficiará dos direitos garantidos pela diretiva, exceto da proteção contra a insolvência.

São elementos positivos mas que não tocam no verdadeiro problema dos monopólios privados na área de transporte que vieram ocupar o serviço público e se transformaram num sorvedor de recursos públicos em detrimento da qualidade e universalidade do serviço.

  Harald Vilimsky (ENF), schriftlich. ‒ Der Bericht verbessert zwar die Rechtsstellung von Urlaubern, dies geschieht aber auf Kosten von unverhältnismäßig hohen Mehrbelastungen, insbesondere von kleinen und mittelständischen Reisedienstleistern.

  Daniele Viotti (S&D), per iscritto. ‒ Ho votato a favore di questo testo perché credo fermamente nell'importanza di Internet per la promozione del turismo. Per sviluppare questo settore è necessario tutelare i consumatori di servizi turistici comprati on-line. Abbiamo chiarito quali sono i diritti dei viaggiatori nei casi di riduzione del prezzo, compensazione dei danni materiali e non e altro ancora. È un importante passo avanti nella definizione dei diritti dei turisti nell'era del digitale.

  Josef Weidenholzer (S&D), schriftlich. ‒ Mit der Überarbeitung der Pauschalreiserichtlinie haben wir eine dringend notwendige Novellierung der 25 Jahre alten Gesetzgebung auf diesem Gebiet. Zu oft werden im Internet Flüge, Hotels und Mietwagen mit einem einzigen Klick erworben, und wenn eine der Leistungen ausfällt, berufen sich Verkäufer gerne darauf, dass sie lediglich Vermittler waren. Das darf nicht sein. Unsere Bürgerinnen und Bürger verdienen einen besseren Schutz, wenn sie verschiedene Reiseleistungen bei einem Anbieter buchen. Als Sozialdemokrat unterstütze ich es, Reiseanbieter in die Verantwortung zu nehmen, wenn Teile des bei ihnen erworbenen Pakets nicht erbracht werden. Für mich steht der Schutz der Verbraucherinnen und Verbraucher an erster Stelle, und darum stimme ich der Richtlinie in vollem Umfang zu.

  Pablo Zalba Bidegain (PPE), por escrito. ‒ Estoy de acuerdo con este informe, ya que, efectivamente, Internet es una herramienta que tiene un gran impacto hoy en día y que ha originado que muchas áreas de negocio hayan tenido que reestructurar su oferta e incluso sus actividades, para amoldarse a esta nueva era digital. Concretamente, en el sector de los viajes se aprecia este impacto, pues cada vez son más las personas que organizan y reservan sus viajes a través de esta herramienta.

Con ello, el tipo de viaje también ha variado, pues Internet ofrece la posibilidad de contemplar un abanico muy superior de posibilidades de viaje, que se traduce en paquetes totalmente personalizados. El problema es que hasta ahora no existían leyes que cubriesen por completo a este perfil de clientes y ello les situaba en una situación delicada. Por ello, me parece muy positivo que la UE haya decidido actualizar su legislación, ya que será muy positiva para los ciudadanos europeos porque les beneficia y les aporta seguridad.

  Tomáš Zdechovský (PPE), písemně. ‒ Rozhodl jsem se hlasovat pro tuto směrnici posilující práva spotřebitelů-cestovatelů při sjednávání a absolvování zájezdů. Při sjednávání a především absolvování zájezdů se cestovatel vydává zcela do rukou cestovní kanceláře, ať už se jedná o dopravu, ubytování či stravu. Jsem přesvědčen, že jasná definice toho, co se rozumí zájezdem, zlepšení ochrany v případě insolvence poskytovatele zájezdu či vyjasnění rozsahu poskytovaných informací před uzavřením smlouvy povede nejen ke spokojenosti cestovatelů, ale v důsledku toho i ke zvýšení objemu zájezdů.

  Roberts Zīle (ECR), rakstiski. ‒ Es atbalstīju Parlamenta un Padomes panākto vienošanos par jaunu regulējumu kompleksiem ceļojumiem, jo jaunā direktīva pielāgo vecos, 1990. gadā pieņemtos noteikumus šodienas digitālā tirgus iespējām, kad daudzi patērētāji ceļojuma pakalpojumus iegādājas internetā. Mūsdienu digitālajā laikmetā ir svarīgi, lai patērētāji, kas iegādājas ceļojumus internetā, ir tikpat labi aizsargāti kā tie, kuri tos pērk no ceļojumu aģentūrām. Tagad patērētāju tiesību aizsardzība attieksies ne tikai uz ceļojumu paketēm, ko pērk no ceļojumu aģentūrām, kā tas bijis līdz šim, bet arī uz t. s. „kompleksajiem ceļojumiem”, ko patērētājs iegādājas internetā, galvenokārt caur vietnēm, kuras piedāvā dažādus ceļojuma pakalpojumus, piemēram, aviobiļetes, viesnīcas rezervāciju un mašīnas īri. Tas pats attieksies uz pakalpojumiem, ko tirgotājs reklamē un pārdod klientam pēc tam, kad viņš jau iegādājies no viņa pamatpakalpojumu (piemēram, piedāvājums īrēt automašīnu, kas parādās aviosabiedrības mājas lapā pēc lidmašīnas biļetes iegādes). Jaunie noteikumi skar tādas jomas kā ceļotāju tiesības lauzt līgumu un saņemt izsmeļošu informāciju par to, kam jāuzņemas atbildība sarežģījumu situācijās. Līdz šim dažādās problemātiskās situācijās nebija skaidrs, no kura operatora prasīt atbildību un kā ceļotājs ir aizsargāts, un jaunā direktīva ievieš vairāk skaidrības.

  Дамиано Дзофоли (S&D), per iscritto. ‒ Mi rallegro del voto odierno che permette di fare un passo ulteriore per aggiornare le norme europee vigenti, risalenti al 1990, sui pacchetti turistici. Molti prodotti oggi disponibili non sono contemplati dalla direttiva del 1990 e in altri casi rimangono in una zona grigia dal punto di vista legale. Vista quindi la crescita dell'offerta di voli economici e di vendite online, che hanno cambiato il modo con cui i viaggiatori acquistano i loro viaggi, è fondamentale una nuova legislazione che vada a tutelare i clienti che acquistano pacchetti turistici online, in modo che abbiano le stesse garanzie di chi passa dalle agenzie di viaggio convenzionali. Tra le tutele che garantiranno l'effettiva protezione del consumatore, è importante sottolineare la disponibilità di tutte le informazioni specifiche prima di sottoscrivere un contratto e la possibilità di annullare un pacchetto nel caso in cui, prima della partenza, il suo prezzo dovesse aumentare di oltre l'8%. Grazie alla nuova direttiva, poi, si potrà ampliare la definizione di pacchetto turistico, includendovi tanti servizi che oggi si possono prenotare online ma che non erano inclusi nella normativa del 1990.

  Inês Cristina Zuber (GUE/NGL), por escrito. ‒ A proposta de diretiva da Comissão expressa o objetivo de clarificar e modernizar o âmbito da proteção dos viajantes quando compra serviços de viagens conexos. A Comissão Europeia propõe que o operador tenha o direito de aumentar o preço em função dos custos de combustível, dos impostos e das flutuações das taxas de câmbio, o que claramente coloca o consumidor numa situação muito frágil. Por outro lado, o organizador/retalhista está obrigado a fornecer proteção em caso de insolvência, a fim de garantir o repatriamento dos viajantes e o reembolso dos pagamentos efetuados. Porém, esta obrigação só prevalece para os organizadores de viagens organizadas e os retalhistas que proponham a aquisição de serviços combinados de viagem. Embora a proposta que está em cima da mesa, por parte do Conselho Europeu e da Comissão Europeia, não seja totalmente positiva, nomeadamente para quem compra viagens, votámos contra a proposta do grupo EFDD de rejeitar a alteração da diretiva, uma diretiva que está obsoleta – tendo em conta o aparecimento de operadores digitais – e que coloca em desvantagem as PME do sector.

  Marco Zullo (EFDD), per iscritto. – Ho votato a favore della relazione perché introduce importanti novità per chi confeziona da sé il proprio pacchetto turistico personalizzato, offrendo una garanzia maggiore all'utente e definendo le responsabilità del venditore. Tra le migliorie troviamo la cancellazione della vacanza senza penali se il costo del pacchetto aumenta dell'8%, un massimo di tre pernottamenti addizionali gratuiti se il viaggio di ritorno subisce ritardi dovuti a condizioni atmosferiche particolarmente avverse, il rimpatrio e il rimborso totale nel caso di insolvenza del venditore.

La direttiva sui pacchetti viaggio era necessaria perché la normativa in vigore risale al 1990, quando gli unici pacchetti esistenti erano quelli creati dai tour operator. Oggi, grazie a Internet, il consumatore può invece personalizzare il pacchetto offerto, scegliendo trasporti, hotel e altri servizi, come il noleggio auto, con la conseguente difficoltà di individuare il responsabile per i singoli servizi all'interno del pacchetto.

La nuova direttiva copre quindi i pacchetti organizzati confezionati dal tour operator, i pacchetti personalizzati assemblati dal consumatore e acquistati da un solo operatore e l'organizzazione assistita, ovvero la combinazione di servizi venduti da un unico intermediario ma come servizi separati, ai quali vengono estesi anche i principi stabiliti nella direttiva di venticinque anni fa.
