  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die Aussprache über den Bericht von Anneliese Dodds und Luděk Niedermayer im Namen des Ausschusses für Wirtschaft und Währung mit Empfehlungen an die Kommission zur transparenteren Gestaltung, Koordinierung und Annäherung der Politik im Bereich der Körperschaftsteuer in der Union (2015/2010(INL)) (A8-0349/2015).

  Anneliese Dodds, rapporteur. Mr President, aggressive tax avoidance and evasion cost the European Union EUR 1 trillion a year. That is a huge loss for Member States, but it is an even bigger loss for the people who live in the Member States. Their public services have, in many cases, been cut to the bone while the taxes they pay have been hiked. It is also hugely unfair for those small and medium—sized businesses that pay their fair share of tax. How can they compete against giant multinationals which can get their tax bills down to almost nothing?

There is a wider impact too – less tangible, but no less important. Scandals like LuxLeaks have severely undermined the public’s trust, not just in the Luxembourg Government but in tax administrations and governments across Europe. I find it impossible to explain to my constituents why giant companies like Facebook can get away with paying less in corporate tax, in a country like the UK, than the average citizen does per year in income tax.

The time for hand—wringing is well and truly over. Now we need to take the hard decisions necessary to sort out the corporate tax system. Both the Commission and Member States will have to take action which, in the short term, will almost certainly be challenged by vested interests but, by stopping the vicious cycle of beggar—thy—neighbour policies, they can make their economies more efficient and help rebuild public trust in both tax authorities and governments.

As with the Ferreira—Theurer report, this report shows that there is a strong consensus in the House for real hard—hitting action to be taken against tax dodging. That consensus is quite remarkable. It extends across every single political group in this Parliament. Individual MEPs from across this House have submitted amendments that have strengthened the text as, of course, have the shadow rapporteurs whose contribution has been essential.

Above all, I want warmly to thank my co—rapporteur, Luděk Niedermayer, for all his incredible hard work and that of his team. Despite the inevitable differences between us, we have managed to create a text that is simultaneously comprehensive, practical and radical. As rapporteurs, we were given the brief of improving transparency, coordination and convergence in corporate tax. To achieve this, we drew on the work of the special committee and our own consultations with a variety of stakeholders, experts and academics.

Four key measures stand out from our recommendations on transparency. First, all companies that operate across borders should report where they make their profits and where they pay their taxes. A ‘fair taxpayer’ label should be awarded to companies which engage in good tax practice. EU countries should tell each other when they introduce a new, potentially harmful, tax measure, and there must be much better protection for whistleblowers who report tax dodging.

When it comes to coordination, businesses underlined to us time and time again the need for the EU to implement a full Common Consolidated Corporate Tax Base (CCCTB). This would not set common tax rates, but would clean up the process of defining taxable assets and activities and greatly simplify tax administration.

Finally, when it comes to convergence we need clearer guidelines on tax—related state aid and a common, objective definition of tax havens. We then need to apply the definition to prevent those companies that use tax havens benefiting from EU funds. The constituency of the UK Prime Minister, for example, that of Witney in his hometown, includes 25 properties registered to tax havens and huge swathes of countryside owned in tax havens, which benefit from Common Agricultural Policy funds. We have to end this farce.

To conclude, I hope that, throughout the debate to come and the vote that will follow it, we will see a continuation of our consensus so far, as a parliament, to take timely, targeted and practical measures to end tax dodging.

  Luděk Niedermayer, rapporteur. Mr President, let me start by saying that it was a great pleasure to work with Anneliese Dodds and with all the other shadow rapporteurs on this fascinating economic and political subject, and on an area in which we can really make things better.

Anneliese Dodds talked about the revenues lost by governments. We do not know exactly what they amount to: the estimates start at tens of billions of euros a year, but there may be hundreds of billions. In any case, it is a lot of money.

An even more important issue is the fact that a market in which some companies pay taxes and some do not pay is not a fair market. We must address this issue. It is not a static issue: if we do not act, the situation will just get worse, and those who pay taxes, including employees and small businesses, will have to pay more because of the others who do not pay. This is an issue that has undermined the credibility of states and governments. So we must act.

We must act decisively but we must act smartly: not everything that can be done should be done. Luckily, there is enough expertise, on which we were able to build our report. I would mention the expertise of the Commission and the OECD, academics, civil society and businesses. Consequently, we have tried to put together the report with well defined, clear recommendations that are feasible and well justified.

Let me look at it from a different perspective. The first area I want to mention concerns implementation of the recommendations that were the outcome of the OECD/G20 Base Erosion and Profit Shifting (BEPS) project. The G20 and the Commission asked the OECD to tackle this issue at global level. The results are well thought-out economic measures which have been endorsed by the governments of many countries. including the G20 and developing countries. There is no excuse for us not to implement these measures briskly. The measures concern, for example, country-by-country reporting, patent boxes, hybrid mismatches and permanent establishment.

The second issue I want to highlight is the re-launch of the Common Consolidated Corporate Tax Base project (CCCTB). The CCCTB project has benefits both for governments, as it will generate more secure revenue collection, and, importantly, for businesses because it will substantially reduce and simplify tax compliance. There is no alternative to CCCTB if we want to tackle the issue. There is no other measure that would be as effective and as efficient at the end of the day.

Lastly, let me mention some proposals that are EU specific. We want a Code of Conduct Group to function better. We want, effectively and jointly, to act against tax havens. There is the corporate social responsibility initiative that Anneliese Dodds mentioned and, last but not least, we want to work with regular estimates of the tax gap arising in the area of corporate taxation. I am very pleased that we are on the same wavelength as the Commission because we have in mind the same proposals, and I believe we will be able to convince the governments to go forward.

Let me now conclude, first by thanking Anneliese Dodds for her wonderful cooperation, and all the shadow rapporteurs for their input. I look forward to the debate here and, more importantly, I believe we will gain support for the report tomorrow. I hope this is not the end. It is a start, and at the end of the day – though rather sooner than later – we will achieve the improvement that we want.

  Christos Stylianides, Member of the Commission. Mr President, I am here on behalf of my dear colleague Pierre Moscovici to express the Commission’s positions on this specific subject. Once again, Parliament is making its position on tax transparency very clear. I would particularly like to thank the rapporteurs, but also everyone else who has contributed to the drafting of this excellent report. It is rich in proposals and recommendations that will assist the Commission in moving forward on this subject of common interest.

Like you, the Commission wants transparent, fair and modern taxation to become the norm in the European Union. The Commission has already taken firm steps this year to address aggressive tax planning, but we need to advance further and faster. That is why the Commission will, at the beginning of next year, present strong measures to combat tax fraud, tax evasion and aggressive tax planning within the European Union.

The package which the Commission will present will be comprehensive. It will include both legislative and non-legislative initiatives. It will address both internal EU aspects and external aspects – it will contain an external strategy towards third countries. It will also include measures stemming not just from the discussions that have taken place in the EU but also internationally. For all these measures, the Commission counts on the active support of this Parliament.

Let me now come back to the main recommendations of the report. First of all, I would like to assure you that the Commission is maintaining the pace on the subject of country-by-country reporting. For us, the best way forward is to complete the impact assessment which is planned for the first quarter of 2016. We will then have the necessary data so as to be able to make appropriate proposals to the co-legislators.

The Commission also wants to relaunch and make rapid progress on the Common Consolidated Corporate Tax Base project (CCCTB). In 2016 we intend to propose a two-step approach so that Member States reach an agreement as soon as possible. As a first step, Member States should agree on a common tax base. The consolidation would follow as a second step. I would like to stress again: the Commission remains fully committed to consolidation, but we want to overcome the current prolonged stalemate. Pending the adoption and implementation of the CCCTB, the measures included in the OECD/G20 BEPS package should be implemented in the EU rapidly and in a coordinated way. What we want to avoid at all costs is a patchwork of 28 national approaches to implementing the BEPS recommendations. A coordinated European approach towards the BEPS package is therefore essential. As regards Parliament’s recommendations on transfer pricing, I would like to stress that the Joint Transfer Pricing Forum of the EU is currently looking into the most coherent and effective implementation within the EU of the OECD guidelines.

This debate, as you know, also concerns the Commission’s own internal instruments. I am thinking first of the European Semester. The Commission is, of course, ready to continue to use all the instruments at its disposal to combat tax evasion, including in the framework of the European Semester.

You are also aware of our views on state aid. Firstly, the Commission is willing to provide further guidance in the medium term to Member States and market participants on the application of state aid rules to the tax planning practices of companies. Secondly, however, to do this, the Commission first needs to close a sufficient number of cases so as to be able to assess on that basis what form of guidance would provide the necessary clarity for both Member States and market players. Thirdly, as regards the rules for recovery of state aid, these rules are based on the longstanding jurisprudence of the Court of Justice of the European Union.

A fairer distribution of tax revenues amongst Member States is a discussion that goes beyond the issue of state aid. The Commission will participate in this debate of course, bringing all relevant services into the discussion. In this way, dear colleagues, the European Parliament has a crucial role to play in maintaining political pressure and in supporting the action of the Commission in the field of taxation. The Commission, of course, counts on your support in all aspects.

  Massimiliano Salini, relatore per parere della commissione per l'industria, la ricerca e l'energia. Signor Presidente, onorevoli colleghi, ringrazio anzitutto i due relatori, e i corelatori per il lavoro che hanno svolto. Dal punto di vista della commissione industria, la prospettiva prefigurata da questo lavoro è molto interessante. Noi abbiamo, i relatori lo hanno ricordato, un principale obiettivo, fare in modo che in Europa i piccoli che non possono permettersi il lusso del turismo fiscale, che i grandi invece possono permettersi, siano messi nelle condizioni di battagliare ad armi pari in un mercato maturo.

Bisogna pagare tasse giuste e pagarle tutti. Abbiamo 28 sistemi fiscali diversi e qui si creano le condizioni perché attraverso alcuni strumenti, come la giustamente richiamata base imponibile consolidata, sia resa possibile una progressiva marcia di avvicinamento ad un sistema fiscale europeo compatibile con lo sviluppo economico europeo, affinché in Europa si cresca e ci sia uno Stato sociale all'altezza delle esigenze dei nostri cittadini.

  Burkhard Balz, im Namen der PPE-Fraktion. Herr Präsident! Eine Vorbemerkung möchte ich machen: Ich hätte mir außerordentlich gewünscht, die luxemburgische Ratspräsidentschaft heute Abend bei dieser, wie ich finde, doch sehr wichtigen Debatte hier im Saal zu haben, gerade weil Minister Gramegna ja das auch als einen seiner Schwerpunkte für diese sechs Monate genannt hat. Und wenn ich jetzt hier auf die Ratsseite schaue und niemanden sehe, dann finde ich das beschämend.

Herr Präsident! Wir müssen erreichen, dass die Mitgliedstaaten nicht länger auf der Bremse stehen, sondern neuere und bessere Regeln zulassen, und zwar Regeln, die zu einem wirklich fairen Steuerwettbewerb führen, die Steuerfreibriefe für multinationale Konzerne der Vergangenheit angehören lassen, die für den Binnenmarkt der EU Vorteile bringen und die Wettbewerbsfähigkeit des europäischen Unternehmenssektors insgesamt und damit auch global stärken und die am Ende auch Vereinfachung statt mehr Steuerbürokratie bedeuten.

Dafür müssen wir essenzielle Gesetzgebungsvorhaben wie die gemeinsame konsolidierte Bemessungsgrundlage bei der Körperschaftsteuer zielstrebig vorantreiben. Wir respektieren natürlich die Steuersouveränität der Mitgliedstaaten, aber ein Verstecken dahinter kann es eben auch nicht mehr geben, gerade wenn mit der Koordinierung für alle gemeinsam mehr erreichbar ist.

Die OECD hat international wesentliche Fortschritte beim Kampf gegen die Steuervermeidung und Gewinnverlagerung initiiert. Deswegen müssen wir diesen Aktionsplan weiter genau verfolgen und sicherstellen, dass Steuerflucht und Steuerhinterziehung in Europa und international keine Chance mehr bekommen.

  Marco Valli (EFDD), Domanda "cartellino blu". Onorevole Balczó, visto che ha attaccato giustamente l'assenza del ministro Gramegna qui in quest'Aula, mi chiedo allora perché all'interno di questa relazione non diamo una responsabilità politica al governo del Lussemburgo e alla figura di Juncker, che è il politico che ha sostenuto per più di quindici anni queste politiche elusive. Se non diamo responsabilità politica agli Stati che stanno appunto portando avanti politiche elusive, non riusciremo mai a risolvere il problema. Quindi è d'accordo a inserire il nome di Juncker in questa relazione?

  Burkhard Balz (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. Erneut ein schöner Versuch von Ihnen, Herr Valli, hier das Ganze in der Tat in eine – wie ich finde – falsche Richtung zu politisieren.

Das ist natürlich nicht das, was wir sehen und was wir wollen, und Pierre Gramegna gehört, glaube ich, auch einer anderen politischen Fraktion als der meinen an. Ich hätte mir wirklich gewünscht, dass hier die Ratspräsidentschaft sehr aktiv an dieser Debatte teilgenommen hätte. Das hätte heute Abend ein klares Signal geben müssen. Aber, wie gesagt, die Bänke sind leer.

  Hugues Bayet, au nom du groupe S&D. Monsieur le Président, je tiens tout d'abord à féliciter ma collègue Anneliese Dodds et tous les rapporteurs pour ce travail. Je pense que le rapport – vous l'avez entendu – contient des mesures précises et ambitieuses pour renforcer la convergence des politiques en matière d'impôts sur les sociétés et, je dirais indirectement, pour lutter efficacement contre la fraude fiscale des multinationales. Je pense que c'est d'ailleurs une constante au sein de ce Parlement européen, depuis l'éclatement des scandales SwissLeaks et LuxLeaks; nous avons mesuré très vite la nécessité de réagir pour mettre en œuvre plusieurs actions coordonnées mais poursuivant le même objectif, à savoir: enfin plus de justice fiscale au niveau européen.

Je me réjouis de la mise aux voix demain du rapport Niedermayer/Dodds. On peut citer également notre rapport ambitieux de la commission spéciale TAXE, dont le mandat est d'ailleurs prolongé de six mois – ce dont je me réjouis –, mais on peut aussi épingler le rapport sur l'échange automatique des rulings entre les États membres, celui sur la fiscalité dans les pays en voie de développement ou encore le rapport sur les droits des actionnaires.

Tout cela pour vous dire que si le mal est connu, nous connaissons également les remèdes. Il appartient maintenant à la Commission et aux États membres de se mettre en route pour se saisir de nos propositions et les transformer, évidemment, en règles applicables. On a entendu de nombreux et de beaux discours, c'est très bien. Mais aujourd'hui, on attend les actes. Je pense que c'est l'immense majorité de nos concitoyens européens qui se sentent, à juste titre, floués par cette situation. On l'a encore vu récemment: dans mon propre pays, la Belgique, la presse nous révèle que le fisc belge aurait ouvert, à la fin de la semaine dernière, une enquête sur les accords très avantageux conclus entre le Grand-Duché de Luxembourg et des PME belges, prévoyant des taux d'imposition de 1,5 à 0 %.

Monsieur Juncker, Mesdames et Messieurs les Commissaires, Mesdames et Messieurs les 28 chefs d'État et de gouvernement, montrez-moi que je me trompe, montrez-moi que j'ai tort de vous trouver si peu concernés. Arrêtons les paroles, passons aux actes! Je compte sur vous, Monsieur le Commissaire, pour avancer.

  Λευτέρης Χριστοφόρου ( PPE), ερώτηση με "γαλάζια κάρτα". Πραγματικά, θα ήθελα να μάθω εάν όλα όσα ακούγονται αποτελούν φορολογική δικαιοσύνη. Εξηγούμαι. Συμφωνούμε να χτυπήσουμε τη φοροαπάτη, τη φοροδιαφυγή, τους φορολογικούς παραδείσους, το ευνοϊκό περιβάλλον που δημιουργούνται για πολυεθνικές επιχειρήσεις και εταιρείες. Αλλά αποτελεί άραγε φορολογική δικαιοσύνη ένας κοινός φορολογικός συντελεστής για όλες τις χώρες; Ο φορολογικός συντελεστής και η άσκηση φορολογικής πολιτικής είναι στα μέτρα της κοινωνικής οικονομικής πολιτικής μιας ελεύθερης οικονομίας και αγοράς. Μήπως θα κάνουμε και ενιαίο ΦΠΑ...;

  Hugues Bayet (S&D), réponse "carton bleu". Oui, je pense que, vraiment, on ne s'en sortira pour lutter contre l'évasion fiscale qu'avec une harmonisation. Tant qu'il y aura 28 systèmes fiscaux différents dans les États membres, on ne s'en sortira pas.

Alors, vous pouvez ne pas nous soutenir. Si le PPE ou l'ALDE n'en ont pas envie, c'est leur choix. Personnellement, je pense qu'il faut le faire. Cela fait des années qu'on nous promet des améliorations, cela fait des années qu'il y a des milliards d'euros qui ne rentrent pas dans les caisses publiques. Si cela ne va pas, on réévaluera notre proposition dans quelques années, mais plutôt que de dire que cela ne marchera pas, je pense qu'il est plus que temps d'avancer et de solutionner ce problème.

  Bernd Lucke, im Namen der ECR-Fraktion. Herr Präsident, meine sehr verehrten Damen und Herren! Wir wissen alle, in der Europäischen Union, in ihren Mitgliedstaaten findet eine große Steuervermeidung statt: durch multinationale Konzerne, durch eine große Anzahl von multinationalen Konzernen – nicht durch alle, aber durch viele.

Das schadet den Steuerzahlern und das schadet den Wettbewerbern dieser multinationalen Konzerne. Deshalb ist es eine Herausforderung für die Gesetzgeber in der Europäischen Union, dem entgegenzutreten. Es ist aber wichtig, dass die EU und ihre Organe gemeinsam mit den Gesetzgebern der Mitgliedstaaten agieren. Es ist wichtig, dass sie das gemeinsam tun. Es ist auch nötig, dass sie das gemeinsam tun, denn die Vorschläge, die wir hier gemacht haben, die zu einem guten Teil gute und weiterführende Vorschläge sind, können wir nur dann umsetzen, wenn wir auch die Zustimmung der Mitgliedstaaten dafür haben. Sonst kriegen wir die Zustimmung des Rates nicht.

Deshalb ist es wichtig, dass wir ganz klar machen, dass es hier nicht darum geht, irgendwie in die Kompetenz der Mitgliedstaaten einzugreifen, Steuerangelegenheiten zu regeln, dass sie die Kompetenzverteilung aufrechterhalten – die Mitgliedstaaten sind für die Steuergesetzgebung zuständig, und die Kommission ist für den Wettbewerb zuständig.

Wenn wir das nicht respektieren, werden wir nicht vorankommen. Im Bereich des Wettbewerbs, im Bereich der Wettbewerbsaufsicht ist genug zu tun. Allein aus Luxemburg, wissen wir, gibt es mehr als 5000 Fälle von möglicher Staatsbeihilfe durch steuerliche Maßnahmen. Die Kommission hat in 25 Jahren nur 65 derartige Fälle aufarbeiten können. Wir brauchen mehr Ressourcen für die COMP. Wir müssen die Kommission in einer zentralen Vollmacht stärken.

  Sylvie Goulard, au nom du groupe ALDE. Monsieur le Président, Monsieur le Commissaire, je voudrais d'abord remercier les rapporteurs qui ont fait, là aussi, œuvre collective très utile et cela vient bien compléter le travail de la commission TAXE. J'ai quand même un peu l'impression qu'on se raconte ici une vieille histoire, qu'on est en train de vieillir, en train de se raconter toujours les mêmes choses sur un sujet qui est malheureusement – et j'attire votre attention, Monsieur le Commissaire, sur cette réalité – de plus en plus au centre du rejet de l'Europe par les citoyens.

Nous avons péché à deux égards. Le premier, c'est le marché intérieur. Nous avons expliqué aux gens qu'en Europe, il n'y aurait pas de différences selon le lieu géographique où s'implante une activité. C'est valable pour une multitude d'autres règles, normes et réglementations qui concernent la main-d'œuvre. En revanche, pour tout ce qui est fiscal, il demeure cette anomalie totale qui est d'accepter qu'à l'intérieur du marché unique, selon l'endroit où vous vous installez, vous bénéficiez finalement de conditions complètement différentes; à partir de là, une concurrence déloyale a lieu entre les États membres – cela a été rappelé, cette question de concurrence n'est pas des moindres. Donc à cet égard, je crois qu'il est vraiment urgent que la Commission s'attelle à nouveau à la question de la base commune consolidée pour l'impôt sur les sociétés. C'est tout simplement une question de marché intérieur.

D'autre part, il y a une autre dimension particulièrement regrettable: avec l'introduction de l'euro et le contrôle mutuel des budgets, on se retrouve avec des États qui se vantent d'avoir une notation triple A mais qui, pendant ce temps, dérobent les ressources fiscales des petits camarades, ce qui leur permet d'améliorer leurs propres performances. On a vu aussi que, dans un pays comme la Grèce, ce n'est pas tout à fait neutre qu'on n'ait jamais osé affronter – j'avais essayé de le faire dans le two-pack – la question de la fraude et de l'évasion fiscales des personnes particulièrement fortunées en Grèce.

Il y a donc urgence, c'est la seule chose à retenir. Il y a urgence à agir, à cesser de multiplier les rapports, les résolutions. Prenez vos responsabilités!

  Matt Carthy, on behalf of the GUE/NGL Group. Mr President, I would like to thank the rapporteurs and the shadow rapporteurs for their efforts. There are a number of positive aspects in this report, specifically the focus on tax transparency and the need to address tax avoidance tools such as patent boxes.

However, I have to say I am fundamentally concerned with the remarks that I have already heard again here tonight that the intention behind this report is to introduce tax harmony across Europe by the back door. It does not serve the interests of, for example, ordinary Irish people to have sovereignty relinquished through attempted tax harmonisation. It is absolutely and fundamentally the right of governments in each state to legislate in the best interests of their people, particularly the setting of tax rates. For our part, my party will continue to demand that genuine and credible actions are taken around corporate tax evasion, specifically in relation to the evidence which suggests that the effective rate of tax paid by multinationals and large corporations is in fact much lower than the 12.5% headline rate in Ireland.

Mr Bayet and others said that whether Groups do or do not support tax harmonisation is almost irrelevant: the fact of the matter is that it is on the public record that citizens do not support it. In fact, they have stated time and time again their view that all matters relating to the setting of tax rates must remain a matter of national competency and the European Parliament has no right to attempt to attack tax sovereignty in this way. Therefore I regret to say I will be unable to support this report.

  Molly Scott Cato, on behalf of the Verts/ALE Group. Mr President, across our continent we see the state shrinking and being unable to fulfil its essential duties. Part of the reason for this is the failure of corporations to pay adequate tax to fund the very services that they use.

I congratulate the rapporteurs on this file for making concrete recommendations on public country-by-country reporting, tax havens and sanctions against EU companies using them. Today we are challenging the Commission to introduce these into law across the European Union to demonstrate that they will resist the power of corporate lobbying and act for the people of Europe.

What has been less encouraging is the way all groups, apart from the Greens, have had Members who have put national interest above our continent’s interest. This is deeply short-sighted, since the corporations are deliberately using these variable policies on tax and the self-interest of Member States to push us all into a race to the bottom that only they can win. We are supposed to be working together for fair taxation, not dividing along national lines. Competition should be in innovation and between companies, not between Member States competing to attract companies.

Finally, I would urge colleagues to support our amendment calling for a fund to protect whistle-blowers, using money clawed back from illegal sweetheart deals. The whistle-blowers have made our work possible and we should not allow them to be treated as criminals.

  Marco Valli, a nome del gruppo EFDD. Signor Presidente, onorevoli colleghi, la giustizia fiscale è un tema fortemente sentito in Europa e ho lavorato duramente con molti colleghi nella commissione Taxe per cercare di indagare su questo scandalo che è scoppiato lo scorso anno, che ha visto Juncker al centro di questa pratica che per tanti anni, per più di 18 anni, il Lussemburgo ha messo in atto sotto la sua presidenza ed ha portato avanti queste pratiche per far pagare fino a meno dell'1% di tasse alle multinazionali che entravano ed entrano ancora con un tappeto rosso all'interno del ministero delle Finanze del Lussemburgo.

E quindi se noi non diamo una responsabilità politica in queste relazioni, dicendo quali sono i paesi e chi sono i responsabili, Juncker ad esempio, Dijsselbloem, che anche lui ha una responsabilità politica, visto che l'Olanda è un altro paese che non rispetta queste pratiche di buon costume che dovrebbero essere tra gli Stati e quindi il mio timore è che alcuni governi europei non abbiano la minima intenzione di cambiare le regole.

E ci sono delle dichiarazioni molto interessanti che ha fatto di recente ad esempio Gramegna che si lamentava che le regole europee sugli aiuti di Stato non dessero certezza al business delle imprese. Cioè che business hanno le imprese in Lussemburgo? Lo sappiamo tutti che business hanno le imprese a Lussemburgo e quindi, per quanto ci siano tante cose interessanti e che condividiamo in questa relazione, dal country by country reporting pubblico allo scambio automatico d'informazioni, se non diamo la responsabilità politica a queste persone e non la smettiamo di sostenerle alla Presidenza di questa Commissione europea e degli europei non avremo mai provvedimenti sicuri contro l'elusione fiscale.

  Bernard Monot, au nom du groupe ENF. Monsieur le Président, Monsieur le Commissaire, chers collègues, ce rapport d'initiative a le mérite d'exister, mais il est largement redondant avec le rapport de la commission spéciale TAXE. Je vais donc répéter la position que nous avons adoptée préalablement.

Tout d'abord, sur le constat: nous déplorons le temps qu'il a fallu aux institutions européennes pour prendre la mesure des ravages de l'optimisation fiscale agressive. Merci aux lanceurs d'alerte! Le manque à gagner pour la France serait de 15 milliards d'euros par an, probablement dix fois plus pour l'Union. Mais je doute de la sincérité des intentions lorsque l'on sait que M. Juncker est le principal artisan du scandale des LuxLeaks. Idem pour M. Dijsselbloem, qui est le ministre des finances des Pays-Bas, une des plaques tournantes de montage qui permettent aux multinationales comme Facebook, Starbucks et Amazon de ne payer aucun impôt ou presque.

Alors quelle réponse donner? Il faut tout à la fois préserver la souveraineté des États en matière fiscale et lutter contre ces pratiques. Le Front national s'est associé à tous les textes en faveur de la transparence fiscale mais refuse catégoriquement d'aller vers une union fiscale. Je salue donc à nouveau les initiatives visant à contrôler les prix de transfert, à instaurer la transparence en matière de rescrits et à harmoniser les bases en matière d'impôt sur les sociétés. J'aurais, en revanche, aimé des sanctions plus claires contre les cabinets de conseil qui aident à l'optimisation abusive.

Au-delà de cela, il est évident qu'un pays comme la France ne fera pas l'économie d'une réflexion sur le niveau de ses prélèvements obligatoires. Il n'existe des paradis fiscaux qu'en comparaison avec les enfers fiscaux; c'est un autre sujet, mais il est lié.

Nous devons renforcer notre attractivité fiscale nationale pour plus de lisibilité et de stabilité, notamment par une baisse des prélèvements. Il faudra en France un pacte État-stratège et entreprises afin de générer de la confiance et de favoriser la création de valeur.

  Othmar Karas (PPE). Herr Präsident, Herr Kommissar, meine Damen und Herren! Wir benötigen eine europäische Steuerpolitik. Das heißt aber nicht, dass wir vereinheitlichen wollen, wie hoch besteuert wird, sondern dass wir vereinheitlichen wollen, was und wo besteuert wird. Das muss europaweit gemacht werden.

Die Einstimmigkeit blockiert eine europäische Steuerpolitik. Die Einstimmigkeit führt zu Verzögerungen, zu Scheinlösungen, zu Halbherzigkeiten, sie fährt über die handlungswillige Mehrheit drüber, und sie schaltet das Europäische Parlament aus. Die Finanztransaktionssteuer ist ein Beispiel dafür, wie fragmentiert eine europäische Lösung ist, wenn die Einstimmigkeit aufrecht erhalten bleibt.

Was wir dringend benötigen – und da bitte ich die Kommission, den Ball aufzugreifen, den dieser Bericht neuerlich auf den Elferpunkt stellt: Wir benötigen länderspezifische Berichtspflichten für multinationale Konzerne, denn sie sind ein weiteres Mittel für mehr Transparenz und Fairness. Wir benötigen eine Harmonisierung der Bemessungsgrundlagen der Unternehmensbesteuerung in Europa. Wir benötigen eine Harmonisierung der Steuersysteme, die binnenmarktrelevant sind. Darum geht es uns. Bitte setzen wir den Bericht so rasch wie möglich um!

  Olle Ludvigsson (S&D). Herr talman! Jag ser i stora drag positivt på det betänkande som vi ska rösta om i morgon. Arbetet mot aggressiv skatteplanering behöver förstärkas. Därför är det helt rätt att vi i parlamentet nu driver denna dagordning framåt.

Det handlar inte bara om att säkra resurser till sådant som skola, sjukvård och infrastruktur. Det handlar också om att säkra en sund och rättvis konkurrens mellan stora och små företag.

Jag vill lyfta fram tre centrala prioriteringar:

För det första bör BEPS-riktlinjerna, som OECD och G20 tagit fram, implementeras på ett ambitiöst och noggrant vis inom EU.

För det andra bör EU-kraven på land-för-land-rapportering för stora företag utvidgas till att omfatta alla branscher.

För det tredje bör det inom EU skapas en gemensam konsoliderad bolagsskattebas. Den bör bli obligatorisk och måste utformas så att de mindre länderna inte missgynnas.

Min förhoppning är nu att EU-kommissionen fångar upp dessa signaler och ser till att intensifiera arbetet redan i början av nästa år. Självklart vill jag också tacka föredragandena och skuggföredragandena för ett gott genomfört arbete.

  Michael Theurer (ALDE). Herr Präsident, liebe Kolleginnen und Kollegen! Der TAXE-Bericht hat ja die Mängel eindeutig ans Tageslicht gebracht, die wir im europäischen Steuerwettbewerb haben. Wir haben einen Binnenmarkt mit offenen Grenzen – Freiheit des Kapitalverkehrs –, und durch die Kombination von 28 überkomplexen Steuersystemen entstehen Schlupflöcher, die dringend geschlossen werden müssen.

Ich beglückwünsche die beiden Berichterstatter dazu, dass sie jetzt konkrete Forderungen an die Kommission vorlegen. Und wir von der ALDE-Fraktion als Liberale fordern ganz eindeutige Gesetzesvorschläge, die zum Beispiel dafür sorgen, dass eine gemeinsame Körperschaftsteuerbasis eingeführt wird, damit der Wettbewerb nicht mehr über die Verschiebung der Steuerbasis stattfindet, sondern über Steuersätze. Und wir wollen eben auch einen automatischen, vollständigen Informationsaustausch. Wir wollen auch, dass die BEPS-Empfehlungen der OECD verbindlich umgesetzt werden. Es darf nicht so sein, dass das nur Empfehlungen sind, wir brauchen hier eine gemeinsame europäische Rechtsgrundlage. Nur dann erreichen wir das level playing field. Darum geht es jetzt!

  Steven Woolfe (EFDD). Mr President, socialism is the philosophy of failure, the creed of ignorance and the gospel of envy; its inherent virtue is the equal sharing of misery. So said Winston Churchill. Well, if he was in this place today, he would see that once again. The Socialists are trying to impose the equal sharing of misery across all of Europe by imposing the idea that we should have a consolidated harmonised corporate tax policy across Europe. The belief is that tax harmonisation is tax justice. If we harmonise our taxes, things will get better. Just as they said that if we harmonised the euro, the economy would get better; if we harmonised the economy in Europe, things would get better. Only look at Greece. We said if we harmonised our borders, things would get better. The only thing that is harmonised in this place is the inherent inequality of thinking of people who think harmonisation will actually work.

  Werner Langen (PPE). Herr Präsident! Ich möchte zuerst den Berichterstattern danken. Die haben eine gute Arbeit gemacht, eine tolle Auflistung, mehr als nur eine Wunschliste. Aber der Druck, den wir ausüben wollen, der fehlt hier. Ich sehe Herrn Moscovici nicht, der hat sich vertreten lassen. Die Luxemburger – die Hauptbetroffenen – sind gegangen. Ich finde es eine Provokation, wie der Rat hier in dieser Frage mit uns umspringt. Die hätten schon aus Anerkennung des Parlaments da sitzen müssen, selbst wenn sie nichts hätten sagen können. Deshalb müssen wir den Druck erhöhen. Nur das hilft!

Ich bin für eine öffentliche Berichterstattung des country-by-country reporting – für eine öffentliche! Denn nur dann wird der Druck so groß sein, dass es am Ende nicht mehr umgangen werden kann. Es sind auch nicht die Großunternehmen, die die Lücken nutzen, die Hauptschuldigen, sondern das sind die Staaten, insbesondere die kleinen Staaten und die Inseln – wie Gibraltar oder die Kanalinseln – aus den großen Staaten: Großbritannien.

Das hat doch nichts mit der Kompetenz der Mitgliedstaaten zu tun, das ist ein unfairer Steuerwettbewerb zulasten der Arbeitnehmer, der kleinen und mittleren Unternehmen, zulasten der großen Staaten. Es liegt auch nicht daran, wie Herr Lucke gesagt hat, dass wir nicht genug Leute in der Wettbewerbsdirektion haben. Nein, es liegt am Unwillen der Mitgliedstaaten. Ich habe 15 Jahre hier erlebt, wie Luxemburg, Österreich und andere die Quellenbesteuerung der Zinserträge verhindert haben. Das muss ein Ende haben.

  Jeppe Kofod (S&D). Mr President, first of all I would like to thank the rapporteurs for their great effort and excellent work. If LuxLeaks has showed us anything it is that without transparency we will not get tax justice. Without transparency, multinational companies will again and again find ways to avoid paying their taxes, while citizens and small companies pay their taxes and see the big companies hide profits in tax havens. This must stop.

Therefore, the Social Democrats have fought for country-by-country reporting. It has to be mandatory. It has to be public. This means that all companies that operate cross-border must publicly report on their profits and the tax that they are paying. It will secure fair competition between small- and medium-sized enterprises and multinational companies, and it will protect our tax base. It will enable all of us to protect the future of our welfare state in Europe, and it will deliver tax justice.

  Sander Loones (ECR). Kleine ondernemingen betalen al te hoge belastingen en grote ondernemingen te lage en dat stoot mensen tegen de borst. Voeg daar dan nog eens Luxleaks aan toe en dan krijg je de ideale cocktail om internationaal afspraken te maken. Helaas, de Commissie en het Europees Parlement hebben die context wat misbruikt om hun eigen agenda naar voor te schuiven en te spreken over taksharmonisatie, belastingharmonisatie. Ik ben er eerder al op ingegaan bij mijn commentaar op de takscommissie. Daar heb ik een lans gebroken voor gezonde fiscale concurrentie.

Betekent dit dat we niets moeten doen, dat we niets moeten veranderen? Natuurlijk niet. We moeten onze fiscaliteit aanpakken en vereenvoudigen, zodat grensoverschrijdend ondernemen gemakkelijker wordt. We moeten vooral ook die lacunes wegwerken in ons fiscale systeem en daar kijk ik naar wat de OESO heeft ontwikkeld, het BEPS-actieplan. Laten we hier in dit Parlement, maar ook in de lidstaten kijken hoe we die aanbevelingen zo snel mogelijk kunnen invoeren en we eenieder eindelijk die oplossingen kunnen geven die nodig zijn.

  Cora van Nieuwenhuizen (ALDE). Ik wil allereerst de rapporteurs, Anneliese Dodds en Luděk Niedermayer, bedanken voor al het ongelooflijk harde werk dat zij hebben verzet. Er liggen nu heel goede voornemens, maar daarmee zijn we er nog niet, want er is een globaal probleem. Wereldwijd bereiken we nog niet alles, wanneer we een soort cordon fiscal om Europa heen leggen; bedrijven vluchten dan gewoon naar buiten Europa.

Dus ik zou eigenlijk meneer Moscovici - helaas is hij er niet - willen aanzetten om inspiratie te putten uit wat zijn collega Fabius onlangs heeft bereikt, namelijk om toch waar het onwaarschijnlijk leek wereldwijd alle landen bij elkaar te krijgen in één akkoord; de commissaris zou dat ook moeten proberen op het gebied van de belastingen. En verder zou ik graag nog willen benadrukken dat we met Tax 2 - het klinkt bijna als een vervolgfilm op een eerdere movie - met volle kracht verder moeten gaan; het mag namelijk geen slap aftreksel worden van Tax 1.

Ik ben het eens met de heer Moscovici: we moeten daar waar de waarde wordt toegevoegd belasting betalen. Alleen over de criteria in dezen moeten we nog met elkaar discussiëren.

  Gunnar Hökmark (PPE). Mr President, Mr Woolfe quoted Winston Churchill – what Churchill would have said if he was here. And I can very much agree with what Winston Churchill would have said if he was here. But the difference between you and Winston Churchill, Mr Woolfe, is that he wanted to be here. He laid the ground for a lot of this cooperation: he actually gave his name to one of our buildings here. There is a huge difference between you, Mr Woolfe, and Winston Churchill – so better let others quote Winston Churchill in this plenary, rather than yourself, because you do not want even to be here.

Thanks are due to the rapporteurs who did extremely good work on a complicated subject. It is important to underline that tax is, and will remain, a national competence. It will be different in different countries and there is, I would add, sound and fair competition in relation to tax. But what we need to do is to fight unfair tax competition; we need to fight illegal tax avoidance; and we need to fight the use by Member States and governments of tax agreements as a hidden state aid, for that undermines prosperity and competition. We need to ensure that Europe can be the centre for global leaders, addressing the problems and the complexities they have in striving to be the best companies in the world.

  Sergio Gaetano Cofferati (S&D). Signor Presidente, onorevoli colleghi, signor Commissario, come Lei sa, nel corso degli ultimi anni si sono evidenziati alcuni fenomeni negativi in Europa.

Il primo è oramai acclarato, senza un'armonizzazione fiscale non c'è una politica di crescita degna di questo nome. Non solo, ma la mancata lealtà sul piano dei comportamenti fiscali da parte delle imprese normalmente penalizza le più piccole, cioè quella parte più attiva e più stimolante del nostro modo di produrre. Nello stesso tempo ha preso corpo una concorrenza sleale tra gli Stati e tra le imprese, perché se invece di investire in ricerca ed innovazione del prodotto e del processo, le aziende vanno alla ricerca del luogo dove pagare meno tasse, noi non saremo mai competitivi nel sistema globale.

Per questa ragione le raccomandazioni che sono contenute nella relazione di iniziativa legislativa sono molto importanti. Abbiamo bisogno di una base comune perché le tasse vengano pagate allo stesso modo in ragione delle caratteristiche dell'impresa. Abbiamo bisogno di una rendicontazione, paese per paese, perché tutto sia trasparente e le tasse si paghino lì dove si produce ricchezza.

  Pirkko Ruohonen-Lerner (ECR). Arvoisa puhemies, on ilo tehdä työtä oikeudenmukaisemman verotuksen puolesta. Iloitsen myös siitä että, meitä on paljon. Yritys, joka ei maksa veroja maahan, jossa se toimii, nauttii rehellisten yritysten ja kansalaisten ylläpitämistä palveluista. Veronkiertäjät saavat käyttöönsä koulutettua työvoimaa, ne saavat käyttää julkisia palveluja, ne saavat käyttää muiden veroilla rakennettuja moottoriteitä ja rautateitä ja niin edespäin. Toisin sanoen veronkiertäjäyritykset ja niiden toiminnasta vastuussa olevat tahot ovat pahimman luokan pummeja, ja näiden pummien toiminta pitää saada julkisuuteen, jotta kansalaiset ja kuluttajat voivat boikotoida niitä. Mielestäni veronkiertäjäyritykset pitää sulkea kokonaan kaikkialla julkisista hankinnoista pois, jotta rehelliset saavat paremmat mahdollisuudet pärjätä kilpailussa.

  Tibor Szanyi (S&D). Elnök Úr! Én is gratulálok a szerzőknek. Dodds Asszonynak mondtam is, hogy ez nem egy jelentés, ez egy valódi kézikönyv, hogy mit kell csinálni az Európai Unióban. Én a politika bal oldaláról nem tudok mást mondani, mint azt, hogy ha igaz az a szám, hogy 160–190 milliárd eurónyi adót nem fizetnek be a nagy cégek, akkor azt mondom, hogy ez pont annyi, mint az Unió egész éves költségvetése. Nahát a kormányok egyfelől hagynak ennyit elmenni, másfelől meg nagyon fukarok, amikor hozzá kell járulni a közöshöz. De az emberek Európáját akarják, az emberek szociális Európát akarnak, és ebben kevés válasz az, hogy hát igen, az adóügy, az tagországi kompetencia.

Az adóügyek elrendezését nem az Úristen, nem a Mindenható döntötte el, ezt mi emberek tettük, hát ezt meg lehet változtatni. Igenis közös fiskális unió kell, közös vámok, közös illetékek, közös adóügy, és ideértem az áfa kérdését is, mert nem lehet az, hogy egyik országban 0, a másik országban meg 27% az élelmiszerekre vetített áfa.

Egy szó, mint száz, végezetül: nem lehet az, hogy a nagyvállalatok kevesebb adót fizessenek, mint a kis- és középvállalkozások.

  Elisa Ferreira (S&D). Senhor Presidente, caros Colegas, começo por agradecer, muito sinceramente, o trabalho feito pelos dois correlatores, a Senhora Dodds e o Senhor Niedermayer. Foi um trabalho excelente e aqui ficam abordadas neste relatório todas as questões importantes que queremos tratar em matéria de fiscalidade das empresas. De facto, também este relatório está exatamente na linha de tudo o que foi feito por este Parlamento e pela Comissão Especial TAXE para impulsionar uma mudança de fundo na política de impostos diretos a nível europeu. Impostos diretos sobre as empresas, naturalmente.

Há uma coerência total entre estes dois textos, e assim tem de continuar a ser relativamente à nova legislação que venha a ser produzida, e esperamos que amanhã, no voto, haja também, em relação a este relatório, um voto fortemente maioritário.

Estes dois relatórios são já pedras fundamentais da nossa agenda e vão funcionar como um guião para a pressão política que temos de continuar a fazer para assegurar que as empresas pagarão a parte justa de impostos na União Europeia. (Eu penso que tenho dois minutos, Senhor Presidente.) Esperamos que depois do relatório TAXE, o apoio formal do Parlamento a este relatório de iniciativa legislativa leve, de facto, a Comissão a continuar a produzir os textos legislativos a que se comprometeu e também leve o Conselho a sair da posição insustentável de se refugiar na unanimidade para nunca mover em matéria de fiscalidade, em particular a obrigação de reporte de país a país, público, dos lucros das empresas e dos impostos pagos em cada país, a instituição imediata de uma base consolidada como obrigatória para os impostos sobre os lucros das empresas, a criação de uma lista de paraísos fiscais com sanções para as empresas que os utilizam, a proteção dos lançadores de alerta, a troca automática de informações entre os Estados—Membros sobre os acordos fiscais antecipados, a obrigação de notificação pelos governos de todas as novas medidas fiscais adotadas a nível nacional.

Estes são apenas alguns exemplos de uma nova agenda que a Europa tem, necessariamente, de implementar.

Gospodine predsjedniče, čestitam izvjestiteljima, kolegi Niedermayeru i kolegici Dodds na izvrsnom izvješću u kojem je dan detaljan pregled problema s kojima se suočavamo zbog agresivnog poreznog planiranja i domišljatog izbjegavanja plaćanja poreza s jedne strane, ali i zbog netransparentne, često nedosljedne porezne politike oporezivanja dobiti koja je podložna tumačenjima.

Nekoordiniran i nejasan porezni sustav ne ide nikome u prilog, niti državama niti poduzetnicima, a najmanje građanima i razvoju rastućeg gospodarstva pune zaposlenosti koje želimo. Godišnje gubimo 50-70 milijardi eura zbog izbjegavanja plaćanja poreza. To su sredstva oduzeta inovacijama, znanosti, novim radnim mjestima. Veliki doprinos ovog izvješća su i nove mjere koje kolege predlažu, a kojima će se značajno pomoći izbjegavanju nepoštene porezne prakse.

  Nicola Caputo (S&D). Signor Presidente, onorevoli colleghi, in un contesto caratterizzato da carenza di investimenti e di crescita, un sistema di regole comunitarie si dimostra veramente protettivo della salute economico-finanziara dell'Unione solo se impone trasparenza, coordinamento e convergenza nelle politiche sulle imposte societarie.

È noto che con i ruling fiscali numerose società hanno beneficiato di aliquote d'imposta inferiore all'1% sugli utili poi trasferiti in Lussemburgo e che l'elusione fiscale potrebbe comportare per l'Unione perdite di gettito fino a 190 miliardi di euro annui con costi e oneri amministrativi significativi per cittadini e imprese PMI. Concordo con la relazione e con le raccomandazioni proposte, in particolare quella sulla notifica obbligatoria delle nuove misure fiscali e sull'estensione a tutti i ruling dello scambio automatico di informazioni.

Vi è assoluta necessità inoltre di una definizione comune e stringente di "paradisi fiscali" così come di un adeguamento della definizione di "stabile organizzazione societaria" contribuendo a ridurre volatilità dei mercati e aumentando la fiducia delle imprese.

  Ruža Tomašić (ECR). Gospodine predsjedniče, ovo je izvješće samo jedan u nizu pokušaja da se ozakoni porezna represija na razini čitave Unije i kazni poduzetnije države članice koje su poticajnom poreznom politikom privukle ulagače.

Neki u ovome domu izgleda zaboravljaju da su članice Europske unije još uvijek samostalne države te bi kao takve trebale imati pravo pametnom poreznom politikom stvoriti kvalitetno ozračje za ulagače na svom teritoriju. Ako ih već ne nagrađujemo za takvo ponašanje, a trebali bismo, jer u Europu privlače ulaganja iz cijelog svijeta, barem ih ostavimo na miru.

Izbjegavanje plaćanja poreza štetna je praksa koju treba kažnjavati, ali ne i koristiti kao izliku za rat protiv biznisa, jer to može dovesti samo do novog vala gašenja radnih mjesta i odljeva kapitala i mozgova iz Europe pa porez više neće imati tko ni plaćati.

  Bronis Ropė (Verts/ALE). Gerb. komisare, „LuxLeaks“ skandalo faktai šokiruoja. Negautos Sąjungos įplaukos kukliausiais skaičiavimais sudaro apie 50 proc. viso Sąjungos metinio biudžeto. Šie piktnaudžiavimai vyko turtingiausioje, solidarumą deklaruojančioje Europos Sąjungos valstybėje. Ir daromi tuo metu, kai visi veržiasi diržus, kovodami su krize. Taip pat tenka konstatuoti, kad agresyvi mokesčių vengimo praktika tapo kasdienine stambių korporacijų veiklos strategija. Iš šio atvejo išvadas turi padaryti ne tik teisėsauga, bet ir mes, politikai. Sveikinu pranešime akcentuojamas geresnio mokesčių administravimo ir skaidrumo didinimo priemones. Kartu pabrėžiu, kad pasigedau rekomendacijų dėl bendros Europos Sąjungos mokestinės politikos supaprastinimo. Visų pirma tam, kad verslui nekiltų noras kurti sukčiavimo landų.

  Barbara Kappel (ENF). Herr Präsident! Eine Studie im Auftrag des Europäischen Parlaments belegt, dass den Mitgliedstaaten der Europäischen Union jedes Jahr 190 Milliarden Euro durch Gewinnverlagerungen, steuerliche Sonderregelungen, ineffiziente Steuererhebungen und ähnliche Praktiken verlorengehen. Die Bekämpfung aggressiver Steuerplanung multinationaler Konzerne hat angesichts dieses Volumens höchste Priorität, und der vorliegende Bericht leistet hier einen wertvollen Beitrag zur transparenten Gestaltung, Koordinierung und Harmonisierung im Bereich der Körperschaftsteuer der EU. Mein Dank gilt deshalb den Berichterstattern.

Den hohen Stellenwert, den der Kampf gegen Steuervermeidung und Steuerumgehung hat, zeigen auch die Verlängerung des Mandates für den TAXE-Ausschuss, der Bericht über den automatischen Austausch von Steuervorbescheiden und Verrechnungspreisvereinbarungen und der Bericht des TAXE-Sonderausschusses sowie die BEPS-Initiative der OECD.

Im vorliegenden Bericht findet sich eine Reihe von Maßnahmen, die darauf abzielen, fairen Steuerwettbewerb zwischen Konzernen und KMU zu gewährleisten und sicherzustellen, dass die Besteuerung tatsächlich am Ort der Leistungserbringung erfolgt. Erreicht werden soll dies durch eine gemeinsame Körperschaftsteuer-Bemessungsgrundlage, länderspezifische Berichterstattung und Einführung eines „Fair Tax Payer“-

  Stanislav Polčák (PPE). Pane předsedající, já bych chtěl rovněž vyzdvihnout kvalitu předložené zprávy a chci poděkovat zpravodajům. Uvědomuju si, že ta otázka je vysoce nejen odborná, ale i politická. Já si myslím, že je samozřejmě nepochybné, že některé prvky zdaňování by měly být harmonizovány, měly by být jednotné. O tom si myslím, že snad není ani základní míra sporu.

Nicméně, nejsem si jistý, jestli společný daňový základ by měl být tou cestou, kterou se Evropa vydá. Já jsem si vědom toho, že není možné konstruovat evropskou dohodu, když vlastně chybí celosvětová dohoda, ale to, co vytvořili v Lucembursku a nejen tam, tak si myslím, že je skutečně nekalou daňovou soutěží. Je to praxe, která pokřivuje trh, která je založena na libovůli, a myslím si, že je to taková rána pod pás vůči ostatním členským státům a občanům, kteří věří ve společnou Evropu. Proto podporuji to, co už bylo předloženo, a myslím si, že to představuje vhodný základ pro další úvahy.

  Ramón Jáuregui Atondo (S&D). Señor Presidente, quería simplemente decir que la soberanía nacional, que algunos reclaman para la política fiscal, está provocando de manera clara y evidente competencia desleal entre los Estados, competencia desleal entre grandes y pequeñas empresas, paraísos fiscales donde se elude la fiscalidad. Esto es evidente, todo el mundo lo sabe.

Y creo que este informe que han hecho los ponentes ―a los que yo quiero felicitar expresamente― constituye, junto al informe «Tax», una verdadera hoja de ruta para los próximos cinco años que nos va a servir mucho, porque hay un descontento social muy importante en Europa que reclama una fiscalidad justa. Y esto es lo que tenemos que hacer en los próximos años.

  Christos Stylianides, Member of the Commission. Mr President, I would like to thank you for this very interesting and comprehensive debate. I saw that there is an impressive level of consensus regarding the main recommendations of the report. We all seem to agree that what is needed today is a revived corporate tax policy tailored to the reality of the 21st century. Tax systems need to become more transparent, definitely more coordinated and more convergent, and tax competition needs to be fair. The Commission is willing and ready to work hard towards these goals and we count strongly, of course, on Parliament’s support.

Let me now address, in this very strict timeframe of two minutes, a point which was raised by many of you. There were many calls for implementation of the recommendations of the OECD/G20 Base Erosion and Profit Shifting (BEPS) project. The new tax package which the Commission will present at the beginning of next year will address many of your concerns. I would like to be able to give you more details but it would be premature to do so before all the elements of the package have been finalised and agreed upon by the Commission. The Commission is working hard and, as soon as we are able to, we will present the package to you, but be assured that we have carefully considered and taken into account the issues that you have raised.

Finally, I would like to congratulate you all again on this very timely, comprehensive and clear report with its inspiring ideas. There is no time for ‘business as usual’. All of us – Parliament, Commission and Council – have to work rapidly and efficiently together for the benefit of our citizens and businesses, and of course our single market.

My last remark: this is not the end; as the rapporteur has already said, this is only the beginning.

  Anneliese Dodds, rapporteur. Mr President, I am sorry to have again been scheduled as the first speaker. I am very much looking forward to what my co-rapporteur has to say as well, and I am grateful to colleagues for their comments. It is a shame that Mr Woolfe, Mr Carthy and Ms Tomašić have left, because the first thing I wanted to do was to correct the misconception that they stated in this Chamber. This report in no place calls for tax harmonisation or for a harmonised tax rate across Europe. It does not state that anywhere. Yet time and time again, that argument has been wheeled out to block action against tax dodging.

How on earth is it fair that some huge companies’ tax advisers are able to play off definitional ambiguities about what is taxable in different countries? That is not about competition. In fact it is barely compatible, I would say, with the single market. It certainly is not fair and it is harming small businesses right across Europe. So please, let us stop using that excuse to block action on tax dodging.

If the report is approved tomorrow, as you all know the Commission will have a year to implement its recommendations or to explain why it cannot implement those recommendations. I very much welcome what we heard today coming from the Commission. But as others have stated, much of the battle here will be with Member States. All of them say they want to do something against tax dodging, but when it comes to the detail they have been less forthcoming. I hope that colleagues will continue to support action in this area.

We do not have the luxury of years and years to procrastinate and hope for the best on this issue. We need the billions of euros that are being lost because of tax dodging now for revenues for Member States. We need a level playing field now for our small businesses, and we need a level playing field now for our constituents, many of whose tax bills have increased, while those for some large multinationals have been reduced to almost zero. We have got to rise to this policy challenge now.

  Luděk Niedermayer, rapporteur. Mr President, let me thank all colleagues for their kind words. After working for many months with Anneliese I am not surprised that she made the same comment I would make concerning the remarks of some of my colleagues.

As a former economist, I am sure that the current situation is not sustainable and I believe that no country is currently benefiting from the current situation or will benefit from it in the future. So we need a change. The questions are quite simple. Do we want to allow some firms to benefit from very low effective taxation and ask others to pay in their place? Do we want to allow some countries to redirect, intentionally or unintentionally, tax revenues from the budget of other countries to their budget? Do we want to allow or encourage some firms to benefit from very low taxation, thus creating a tax advantage and unfair conditions on the market? I guess the answer is and should be ‘no’.

I believe that we should allow countries to compete on taxation, but on fair and transparent grounds. We should aim for lower taxes, but lower taxes for everyone, not only for some. I hope that Parliament will support the report tomorrow.

Κύριε Πρόεδρε, η αποτελεσματικότητα του φορολογικού συστήματος βασίζεται στη διαφάνεια, στο συντονισμό και στη σύγκλιση των πολιτικών σχετικά με το φόρο που επιβάλλεται στα κέρδη των εταιριών στην Ε.Ε. Βέβαια, σε πολλά κράτη-μέλη της ΕΕ παρατηρούνται πρακτικές «επιθετικού φορολογικού σχεδιασμού» καθώς και συναλλαγές εντός του Ομίλου και εταιρική φοροδιαφυγή και φοροαποφυγή, με αποτέλεσμα να παρατηρούμε απώλεια φορολογικών εσόδων της τάξης των 50-70 δις ευρώ ετησίως. Με τούτες τις «ενδοομιλικές» συναλλαγές άλλωστε οι πολυεθνικές εταιρίες μπόρεσαν να φοροαποφεύγουν με αποτέλεσμα τα κέρδη τους να φορολογούνται με ελάχιστους συντελεστές σε αντίστοιχους φορολογικούς παραδείσους. Φυσικά, αυτό είχε σαν αποτέλεσμα μείωση των φορολογικών εσόδων στις χώρες στις οποίες πραγματοποιούν τα κέρδη τους. Είναι επομένως σαφές ότι τέτοιες πρακτικές δρουν ενάντια στη διαφάνεια στον τομέα της φορολογίας. Καθίσταται έτσι αναγκαία η πάταξη της φοροδιαφυγής σε όλες τις χώρες της ΕΕ. Επιπλέον, είναι αναγκαίο να υπάρχει αυτόματη ανταλλαγή πληροφοριών για τις διάφορες χρηματοοικονομικές δραστηριότητες. Θα πρέπει επίσης να χτυπηθεί η φορολογική ανομία και η προσφυγή των πολυεθνικών στους φορολογικούς παραδείσους. Τα κέρδη κάθε εταιρείας θα πρέπει να φορολογούνται στη χώρα όπου αυτά πραγματοποιούνται.
