  Czesław Adam Siekierski, autor. Panie Przewodniczący! Postawione pytanie przez dwie komisje Parlamentu Europejskiego ma strategiczne znaczenie dla postępu, rozwoju i innowacji w sektorze rolnictwa. Dotyczy ono problemów patentowych w obszarze postępu biologicznego, a więc w obszarze, gdzie istotne są bardzo prawa natury.

Otrzymaliście Państwo wszyscy to pytanie, dlatego nie będę go tu odczytywał. Pozwólcie, że przedstawię ze swojej strony kilka komentarzy. Rolnictwo charakteryzuje się specyficznym procesem wytwarzania, bowiem w procesie produkcji mamy do czynienia z żywymi organizmami roślin i zwierząt. Słusznie więc reprezentacja rolników Copa-Cogeca w swoim stanowisku skierowanym do Parlamentu wskazuje na to, że prawo patentowe wywodzące się z sektora technologii przemysłu trudno przenieść do procesów biologicznych. Natura, rośliny, istniejący materiał genetyczny nie są przecież wynalazkami. Patentowanie cech roślin nie tylko wpłynie na ograniczenie innowacyjności, ale rozbuduje administrowanie i koszty charakterystyczne dla wynalazczości.

Główne obawy dotyczą ograniczenia dostępu w procesie hodowli roślin do materiału biologicznego objętego patentem, uzyskana bowiem nowa wartość zawarta w podwyższeniu jakości roślin powinna stawać się dobrem wspólnym. Należy jednak pamiętać i brać pod uwagę finansowanie postępu rolniczego, jeśli chcemy, aby jego efekty były wartością wspólną.

Nasze oczekiwania wobec Komisji Europejskiej nakładają na nią wyjątkowo trudne zadania pogodzenia różnych interesów. Uważamy jednak, że bezpieczeństwo żywnościowe, zachowanie bioróżnorodności, możliwości dostępu i wyboru przez rolników określonych odmian są ich prawem. Chcemy jednocześnie utrzymać pracę hodowlane prowadzone w małych i średnich firmach, aby nie zostały one wyparte z branży przez duże firmy tego sektora. Reasumując, chcemy więc, aby Komisja Europejska wyjaśniła sytuację prawną dotyczącą spraw patentowych w obszarze hodowli roślin.

  Pavel Svoboda, author. Mr President, the Committee on Legal Affairs, which I have the honour of chairing, was in charge of Directive 98/44 on the legal protection of biological inventions when it was adopted. The Directive contains, inter alia, certain exclusions from patentability. Article 4 of the Directive excludes plant and animal varieties and essentially biological processes for the production of plants and animals from patentability provisions, reflected in the implementation regulation of the European Patent Convention. Article 53b of the Convention itself prohibits patents on plant varieties and on essentially biological processes for breeding.

However, as a result of consecutive decisions by the European Patent Office (EPO), the content of these exceptions has been eroded. Parliament already adopted a Resolution on this matter in 2012. Unfortunately, it did not have much impact on the decisions of the Patent Office. In two precedent-setting decisions of March this year, the enlarged Board of Appeal of the Office declared that, while processes for conventional breeding cannot be patented, plants and animals stemming from these processes are patentable.

Speaking on behalf of the Committee responsible in this Parliament for the application of EU law, I would like to emphasise the need to ensure that the EPO demonstrates appropriate respect for EU law. The EPO will play a central role in the implementation of the European Patent with unitary effect. It is, therefore, worth bearing in mind that Article 27c of the Agreement on a Unified Patent Court states that ‘the rights conferred by a patent shall not extend to […] the use of biological material for the purpose of breeding or discovering and developing other plant varieties’.

I hope that this second attempt by this House to bring its concerns to the attention of the European Patent Office will help to convince the Commission to raise the matter with the EPO and will help to prevent, and possibly reverse, interpretations of law which erode carefully considered exceptions to patentability and patent protection.

  Christos Stylianides, Member of the Commission. Mr President, on behalf of my colleague Elżbieta Bieńkowska, I wish to thank you for giving the Commission the opportunity to address Parliament on the important issues surrounding patenting and plant breeding rights.

Let me start by reassuring you that the Commission is well aware of these issues. More specifically, we are aware of the breeders’ concerns related to the patentability of plant traits that pre-exist in a plant obtained by essentially biological processes. We are aware that breeders fear having more limited access to biological material. The Commission has been closely following the discussion in both the Agriculture Council and the Committee on Agriculture and Rural Development of the European Parliament following the rulings of the Enlarged Board of Appeal of the European Patent Office.

In order to help address the concerns raised by breeders, the Commission is currently analysing this issue with the objective of finding a quick and workable solution for all the stakeholders involved. For this very reason, the Commission will be cooperating with the forthcoming Dutch Presidency that has supported such a pragmatic approach which does not entail the need to revise the Biotech Directive. Our wish is to avoid creating long-standing legal uncertainty for the biotech sector when revising or recasting the Biotech Directive. In particular, this could hinder the development of new biotech products for the benefit of European consumers. The re-opening of the Directive would not only put the specific breeders’ issue under the spotlight, but would also trigger discussions on issues that the Directive and subsequent decisions of the Court of Justice of the European Union have clarified. Examples of these issues are the limit on the patentability for inventions relating to embryonic stem cells and the scope of protection of inventions relating to genes.

The solutions brought forward by the Directive and the subsequent decisions of the Court have integrated ethical considerations. They are considered to offer the appropriate balance, by both researchers and the industrial sectors most linked to biotechnological inventions. Having said that, the Commission is highly aware of its task to monitor scientific and legal developments as well as their implications on current patent law in the biotechnological field in Europe. The Commission is also aware of its responsibility to report on these issues to Parliament, the Council and the broad public as well.

Before concluding, let me stress that a Biotech expert group has been set up with a mandate to provide the Commission with expertise, analysis and comments on the rapid evolutions in this field. The Group is discussing, among other issues, the patentability of products obtained by essentially biological processes and the report that this Group will soon produce will further support our analysis.

I wish to assure the House that the Commission is giving high importance to working on a timely and pragmatic resolution of this issue so that the current legal uncertainty is resolved in the interests of all concerned. We will, of course, keep Parliament informed of any progress.

  Albert Deß, im Namen der PPE-Fraktion. Herr Präsident, Vertreter der Kommission, liebe Kolleginnen und Kollegen! Fraktionsübergreifend waren wir uns hier immer mit großer Mehrheit einig, dass die Züchtung von Pflanzen und Tieren nicht patentiert werden darf, dass auf Pflanzen und Tiere keine Patente erteilt werden dürfen. Über Jahrtausende hinweg hat die Landwirtschaft ohne Patente Züchtung betreiben können, und dabei muss es auch bleiben. Die Möglichkeit der Weiterzüchtung von Sorten und Rassen muss der Landwirtschaft ohne Behinderung durch Patente gesichert werden. Die Ernährungssicherung erfordert, dass sich die Landwirtschaft ohne Patente von Großkonzernen weiterentwickeln kann.

Das Urteil der Großen Beschwerdekammer des Europäischen Patentamts zu Brokkoli und Tomaten vom 25.3.2015 ist mir schlichtweg unverständlich. Dieses Urteil ist auch die Ursache für diese Anfrage an die Kommission und auch für den Entschließungsantrag, der heute eingebracht wird. EVP, S&D, ECR und ALDE haben heute hier eine gemeinsame Entschließung vorgeschlagen, um die Kommission aufzufordern, hier eine Klarstellung vorzunehmen, damit auch in Zukunft die biologische Vielfalt für die Landwirtschaft und für alle Beteiligten gewährleistet ist. Das ist das Ziel unserer Anfrage und unseres Entschließungsantrags.

  Paolo De Castro, a nome del gruppo S&D. Signor Presidente, onorevoli colleghi, signor Commissario, come ha detto l'onorevole Albert Dess poco fa, la commissione agricoltura di questo Parlamento ha ritenuto necessario questo dibattito per chiedere all'esecutivo di chiarire alcune ambiguità nella normativa sulla protezione giuridica delle invenzioni biotecnologiche.

C'è un largo consenso sulla non brevettabilità dei procedimenti essenziali biologici di produzione di vegetali e di animali, come chiaramente espresso all'articolo 4 della direttiva 98/44/CE. Tuttavia alcune recenti decisioni dell'Ufficio europeo dei brevetti richiedono maggiore chiarezza sull'interpretazione giuridica della legislazione europea in materia.

L'innovazione in agricoltura e lo sviluppo di nuove varietà vegetali sono cruciali per rispondere alle sfide della sicurezza alimentare e del cambiamento climatico e allo stesso tempo possono dare notevole impulso alle piccole e medie imprese europee. Se da una parte i brevetti servono proprio a stimolare la competitività e l'innovazione salvaguardando l'investimento economico, in alcuni casi possono rappresentare un freno allo sviluppo innovativo, in particolare quando sono implicati processi biologici essenziali utilizzati negli anni dagli agricoltori in maniera libera.

Ci auguriamo che, in vista delle decisioni future dell'Ufficio europeo dei brevetti, si possa fare chiarezza, trovando il giusto punto di equilibrio tra la difesa della proprietà intellettuale e il legittimo accesso e utilizzo di materiale biologico proveniente da procedimenti essenzialmente biologici.

  Bas Belder, namens de ECR-Fractie. Mijnheer de commissaris, als we een innovatieve plantveredelingssector willen houden, dan moeten we patenten op plantmateriaal nú een halt toeroepen. Zo niet, dan ontstaat er een ware race op eigenschappen uit de natuur. De sector komt daardoor vast te zitten, en ik vind het ook ethisch gezien onjuist.

 

Plantmateriaal hoort niet thuis in patentrecht; voor planten is er immers het specifieke kwekersrecht. Het basisprincipe van het kwekersrecht is de volledige kwekersvrijstelling. Hierdoor kunnen kwekers immers variëteit op variëteit maken. Dit basisprincipe moeten we blijven waarborgen.

 

Commissaris, "geen octrooi op leven". Samen met mijn collega’s ontving ik een petitie met die titel met meer dan 17.000 handtekeningen. Wij geven deze petitie graag door aan uw collega, commissaris Bieńkowska.

 

Commissaris, het is hoog tijd dat de loophole in de wetgeving gesloten wordt. Duidelijkheid is nodig en urgent. In de resolutie vraagt het EP aan de Commissie om dit snel en goed te doen. De Commissie is nu aan zet.

  Jan Huitema, namens de ALDE-Fractie. Kwekers gebruiken natuurlijke eigenschappen van groenten en fruit en andere planten om verder mee te kweken. Hiermee worden nieuwe smaken of kleuren gekweekt in bijvoorbeeld tulpen of tomaten. Recentelijk is het mogelijk geworden deze natuurlijke eigenschappen te patenteren. Dit is gevaarlijk, zowel kwekers als consumenten kunnen hiervan de dupe worden.

Wanneer iemand op een natuurlijke manier een nieuwe eigenschap in een broccoli of tomaat kweekt, wil je niet dat iemand hierop een patent kan aanvragen. Je creëert een monopolie op een eigenschap van groenten of fruit en dus ook op onze voedselvoorziening. De natuurlijke eigenschappen van planten zijn dan niet meer voor alle kwekers vrij beschikbaar.

Dit brengt innovatie in gevaar en kan consequenties hebben op de variëteit aan rassen. Onze kleine en middelgrote kwekers, boeren en tuinders behoren tot de wereldtop in het verbeteren van plantenrassen en het ontwikkelen van nieuwe zaden. Zaden die in hun gewicht soms meer waard zijn dan goud. Als je echt iets hebt uitgevonden moet je het kunnen patenteren. Maar de natuurlijke eigenschappen van planten moeten vrij gebruikt kunnen worden.

Twee maanden geleden heb ik dit onderwerp in de Landbouwcommissie aangekaart. Ik ben verheugd dat nu een grote meerderheid van het Europees Parlement deze oproep steunt. Ik roep ook de Nederlandse staatssecretaris Van Dam op om tijdens het Nederlands voorzitterschap van de Europese Unie actie te ondernemen.

Het Europees Parlement is luid en duidelijk. De Commissie moet ruim baan geven aan innovatie en waarborgen dat de natuurlijke eigenschappen van planten voor iedereen beschikbaar blijven.

  Anja Hazekamp, namens de GUE/NGL-Fractie. Groenten, granen, peulvruchten en fruit vormen de basis van een gezonde en goede voeding. Deze zijn in Europa van uitstekende kwaliteit en al eeuwen bewaarden boeren en later veredelaars elk jaar de zaden en producten om daar weer nieuwe verbeterde producten van te maken.

Het veredelen van die groenterassen heeft er bijvoorbeeld toe geleid dat we nu honderden soorten aardappelen hebben. Sommige zijn geschikt voor frietjes, sommige zijn geschikt voor de puree en andere zijn juist weer heel erg geschikt om op droge of heel natte grond te verbouwen. Op deze sector kunnen we echt heel erg trots zijn en het is dan ook belangrijk dat we die producten, de zaden vrij toegankelijk houden. Dat is belangrijk voor biodiversiteit, dat is belangrijk voor de innovatie in deze sector.

En dat kan niet als agrofood-bedrijven patenten aanvragen op producten die zijn ontstaan uit wezenlijk biologische processen. Eigenschappen uit de natuur behoren aan niemand of misschien wel aan iedereen toe. Maar ze behoren in ieder geval niet toe aan Monsanto en Syngenta. Het zou slecht zijn als deze multinationals gaan bepalen welke rassen we wel of niet gaan verbouwen in Europa. Deze bedrijven willen geen concurrentie en de markt kent geen ethiek.

Voorzitter, het is te gek voor woorden! Boeren moeten gewoon vrij toegang hebben tot deze zaden. Dat betekent bijvoorbeeld een uitgebreide kwekersvrijstelling in de Europese regelgeving. Want gaan we op deze weg door, dan gaan we monopolieposities creëren in onze voedselvoorziening en zulke machtsposities en ook het daaruit voortvloeiende biodiversiteitsverlies zijn gevaren voor onze voedselzekerheid hier en elders op de wereld.

Commissie, doe uw werk, zorg voor een kwekersvrijstelling in de Europese octrooiregelgeving. Voorts ben ik van mening dat de Europese landbouwsubsidies moeten worden afgeschaft.

  Martin Häusling, im Namen der Verts/ALE-Fraktion. Herr Präsident, Herr Kommissar, meine lieben Kolleginnen und Kollegen! Ich gehöre zu den Mitverfassern der ersten Entschließung aus dem Jahr 2012, die sich mit dem Thema beschäftigt hat.

Wir haben im Wesentlichen genau das gesagt, was heute auch Gegenstand der neuen Entschließung ist. Wir können hoffen, dass die Kommission endlich aus ihrem Tiefschlaf aufwacht und das ernst nimmt, was wir schon vor drei Jahren beschlossen haben. Es ist unverständlich – muss ich ehrlich sagen –, denn wir haben schon damals dieselben Befürchtungen geäußert. Die Innovation wird eingeschränkt, denn gerade die kleinen Unternehmen, die Kleinzüchter, sind ja die, die die Sache voranbringen. Es wird das Landwirte-Privileg gefährdet, und die Kommission sollte sich Gedanken machen, ob wir weiterhin das akzeptieren, was das Europäische Patentamt an Rechtsetzung seit Jahren tut.

Wir reden über Brokkoli-Patente, über Patente für Tomaten oder Paprika, während Verfahren eindeutig biologische Züchtungsverfahren sind, die das Patentamt patentiert hat. Das ist eine Rechtspraxis, die wir einfach nicht akzeptieren können. Da muss die Kommission endlich einschreiten, weil das nämlich gegen die Richtlinie 98/44/EG verstößt, und das ist sozusagen Gesetz.

Dann ist halt die Frage: Warum macht das Patentamt das? Man kann sich die Frage durchaus stellen. Na gut, das ist doch ganz einfach: Das Patentamt verdient mit der Erteilung von Patenten Geld, und es wird von selber nicht aufhören. Deshalb muss der Gesetzgeber einschreiten. Der zweite Punkt ist: Natürlich versuchen immer mehr große Unternehmen, sich durch die Sicherung von Patenten den Markt von Konkurrenten freizuhalten. Das wird in erster Linie die europäische Saatgutindustrie oder die europäischen Landwirte betreffen, weil das Großunternehmen sind, die nichts mit der Masse der Züchter in Europa zu tun haben. Auch deshalb müsste die Kommission einschreiten.

Ich habe heute vernommen, dass die Kommission gesagt hat: Sie beobachtet die Materie. Sie hat auch die Diskussion beobachtet, und sie analysiert jetzt. Sie sind uns bis heute einen Bericht zu den Auswirkungen schuldig geblieben. Die Aufforderung haben Sie seit 2003, seitdem sind Sie dieser Aufforderung nicht nachgekommen. Also wann erwachen Sie aus Ihrem Tiefschlaf, liebe Kommission, wann beschäftigen Sie sich endlich mit diesen ernstzunehmenden Problemen, und wann geben Sie den Landwirten und Züchtern eine Antwort?

Eine Anmerkung noch: Wir haben Änderungsanträge eingebracht zu dem, was Sie wahrscheinlich vergessen haben: Das Landwirte-Privileg muss noch in dieser Entschließung untergebracht werden.

  John Stuart Agnew, on behalf of the EFDD Group. Mr President, without the efforts of commercial plant breeders we would not have kept abreast with the challenge of feeding a growing population. Having farmed since 1971, I have witnessed all the improvements produced by fertilisers, pesticides and mechanisation.

In my opinion, though, the biggest single factor in increasing yields has been improved crop varieties. These provide the potential from which all else flows. For every successful variety there may be 10 expensive failures, and the winners must bear not only their own costs, but those of the losers as well. Our commercial plant breeders therefore need the assurance that their work will bring significant financial rewards and not simply provide a shortcut to others who can quickly build on a novel feature that took many years to isolate and consistently replicate itself within a stable variety.

In the past, it was usually safe to assume that by the time a competitor breeder had taken advantage of breeders’ privilege and brought a successor variety to the market, the original variety would have had its few years at the top of the hit parade, earned its royalties and been superseded. Skill and technology, though, is now so advanced and correspondingly expensive that occasionally a breeder can produce something that is a step change or a defining moment in the history of plant breeding. The implications of this need to be recognised and catered for. Having watched the EU make a complete hash of legislating on the topic of GM crops, I do not want this institution to spoil yet more innovation in plant breeding.

I would like to see my own country, Britain, take the lead in this field and consult with the whole agricultural industry, because a balance must be struck between maintaining the confidence of the breeders in the principle that a successful idea will yield a financial reward, but, on the other hand, the concern that the market will be permanently cornered and subsequent potential improvements discouraged. The debate then becomes a very straightforward decision on the amount of time a breeder can have the exclusive use of his variety. I believe the industry in the UK is more than capable of reaching a decision on this with minimal interference from politicians. A system may develop where the breeder of a high-flying variety may take the option of purchasing a longer period of purdah from the government, to the benefit of the taxpayer – a simple commercial decision, taken within agreed limits.

We do not need to get involved in semantic arguments about the difference between a discovery and an invention. We just need to let the plant breeders have their moment in the sun. Now, let us never forget that a farmer can always multiply up old varieties himself if he feels that this is a more economic choice, thereby waving two fingers at the perceived greed of big business. This inconvertible reality will always ensure that this issue remains rooted in the ground, the earth, the soil and the dirt, just where a seed belongs.

  Philippe Loiseau, au nom du groupe ENF. Monsieur le Président, la décision de l'OEB de libéraliser les brevets et les droits des sélectionneurs de semences est une très mauvaise chose. Cela équivaut à donner un blanc-seing aux multinationales telles que Syngenta, Monsanto, etc., en leur permettant de prendre le contrôle, en réalité, de notre alimentation. C'est quelque chose de très grave, à mon sens.

C'est en effet un danger pour notre souveraineté alimentaire car cette politique de l'OEB favorisera la concentration du marché, renforcera la dépendance des agriculteurs à l'égard de quelques multinationales – comme vous le savez – et aura inévitablement des conséquences sur les consommateurs. En outre, nous aurons moins de contrôle sur la fabrication, qui sera de plus en plus standardisée. Avec ce projet, les groupes industriels pourront organiser le contrôle de toutes les semences, y compris celles que les agriculteurs prélèvent directement sur leur récolte.

De plus, cette nouvelle contrainte restreindra l'accès au marché des semences traditionnelles locales et biologiques. En France et en Europe, le secteur semencier est constitué par de nombreuses PME et coopératives. Au niveau mondial, au contraire, dix entreprises se partagent 60 % du marché. Or, cette concentration, ajoutée aux questions de propriété intellectuelle, nuira au maintien d'une agriculture diversifiée.

L'industrie semencière doit être, au contraire, sous contrôle afin d'éviter tout monopole et toute pratique douteuse, contre lesquels sont déposés des recours, comme en 2013 contre un brevet délivré à Syngenta lui garantissant les droits exclusifs sur tous les poivrons présentant une résistance aux mouches blanches. Ce brevet interdisait aux agriculteurs et aux sélectionneurs d'utiliser ces plantes sans avoir payé des droits de licence à Syngenta. Or, il ne s'agissait pas d'une invention, mais d'une découverte par croisement d'espèces. Un autre recours a été déposé fin mai 2014 contre un brevet européen détenu par Monsanto sur des tomates résistantes à un champignon. Il s'agissait, là encore, d'une découverte que s'est appropriée la multinationale.

Cette privatisation du vivant menace les petites et moyennes entreprises de semences, qui risquent, en effet, de voir leurs propres variétés tomber sous le coup d'un brevet. Ce fut le cas, par exemple, de l'entreprise française Gautier, qui est obligée, depuis 2013, de payer le semencier hollandais Zwaan pour commercialiser une laitue résistante à un puceron qu'elle avait elle-même sélectionnée depuis longtemps. C'est tout de même aberrant!

Les certificats d'obtention végétale étaient déjà contestables puisqu'ils remettaient en cause la possibilité pour les agriculteurs de ressemer gratuitement leurs propres semences. Mais en dépit de cette contrainte, ces certificats d'obtention végétale protégeaient tout de même nos semenciers et agriculteurs du brevetage. Cette pratique plus coûteuse encore, et bien plus restrictive, est déjà en vigueur aux États-Unis.

Aujourd'hui, la décision scandaleuse de l'OEB et le silence incompréhensible de la Commission européenne remettent gravement en cause ce qui avait été adopté, sans enthousiasme, comme un rempart efficace. Plus grave encore, cette décision pose, une fois de plus, la question de l'alignement du droit européen sur celui des États-Unis, dans le but évidemment de ne pas freiner les négociations commerciales en cours. Si, pour atteindre cet objectif, la Commission européenne a l'intention de piétiner le texte adopté en 2012, qu'elle le dise franchement!

  Tadeusz Zwiefka (PPE). Panie Przewodniczący! Szanowny Panie Komisarzu! Koleżanki i Koledzy! Chciałbym przypomnieć, że Parlament Europejski nie tak dawno, bo w 2012 r., przyjął rezolucję, w której w niezwykle jasny i precyzyjny sposób wyraził swoje stanowisko w kwestiach dotyczących interpretacji przepisów, zarówno europejskiej konwencji patentowej, jak i tzw. dyrektywy o biopatencie. W 2012 r., czyli raptem trzy lata temu, warto by pamiętać, co tam zostało zapisane. Dyrektywa mówi jasno: możliwość udzielania patentu jest wyłączona, czyli jest niemożliwa, dla odmian roślin i ras zwierząt, a także dla czysto biologicznych procesów wytwarzania roślin i zwierząt, na przykład poprzez krzyżowanie czy selekcję. To dosyć jasne i precyzyjne słowa, dlatego trudno zrozumieć decyzję Rady Apelacyjnej Europejskiego Urzędu Patentowego. Zwracam uwagę, że to rada apelacyjna, czyli taki swoisty sąd, a nie urząd patentowy, podjął tę decyzję – decyzję budzącą nasze obawy co do zawężenia interpretacji istniejących przepisów, co w konsekwencji może godzić w utrzymanie jak najszerszej różnorodności biologicznej. Także hodowcy wyrażają swoje poważne obawy, że w ten oto sposób otwiera się takie boczne drzwi, furtkę, do patentowania odmian roślin, a w konsekwencji do ograniczania możliwości dostępu do zwiększania wydajności upraw. Dlatego zwracamy się z pytaniem do Komisji Europejskiej o jasną interpretację unijnych przepisów i prosimy także o przekazanie nam informacji co do sprawozdania dotyczącego rozwoju wpływu prawa patentowego w działaniach biotechnologicznych.

  Sergio Gaetano Cofferati (S&D). Signor Presidente, onorevoli colleghi, signor Commissario, come ha ben sentito, tutte le famiglie politiche sono preoccupate da questo comportamento della Commissione che interpreta le direttive di volta in volta in maniera difforme.

Nel caso specifico la contrarietà che Le è stata espressa all'uso dei brevetti nasce proprio dal ricorso che la Commissione ha fatto all'Ufficio europeo, soprattutto perché il tema in oggetto di questa ulteriore richiesta di interpretazione è per noi molto delicato, riguarda la biodiversità, perché l'idea di brevettare il materiale vegetale non è solo sbagliato, è pericoloso.

Richiamo la Sua attenzione su due aspetti. Il primo, chi è che può promuovere una brevettazione di massa? Le grandi aziende. In questo settore, l'innovazione e la ricerca verso la biodiversità è sempre stata patrimonio delle piccole aziende, che hanno assolto a un compito meritorio e che per questa ragione devono essere protette e aiutate. Secondo tema: se si va verso una concentrazione prodotta dai brevetti è chiaro che questa non si fermerà soltanto ai prodotti oggi in esame, ma diventerà il criterio, il sistema che verrà adottato per l'intera filiera, dalla produzione agricola fino a quella alimentare, introducendo novità negative che verrebbero in contraddizione, in contrapposizione a quello che invece è stato il passo in avanti importante che l'Unione ha fatto nella difesa della biodiversità e nella ricerca e nell'innovazione collegata a questa specie.

Mr Cofferati, would you agree that one of the reasons that plant breeding is getting into the hands of larger corporations is the expense of registering and going through the whole process of bringing these materials to the market? It is only the big corporations that are able to do this. Would you also agree that the farmer does have the option of multiplying up an old variety and waving goodbye to the large corporations? Seed is the one item on a farm we can produce ourselves. We do not need anyone’s help to do it. Would you agree?

Le faccio notare che, a differenza di quello che è capitato storicamente nei settori produttivi industriali in agricoltura, l'innovazione e la ricerca non sono mai state sviluppate verso il nuovo da parte delle grandi aziende. Sono sempre stati i piccoli produttori che hanno costruito posizioni di nicchia, che poi si sono estese, a guardare con interesse, con competizione positiva ai temi della biodiversità. Se noi apriamo uno spazio nel quale potranno inserirsi le aziende più grandi, qui avremo l'effetto opposto di quello che si è avuto storicamente nell'industria, i grandi distruggeranno l'innovazione.

  James Nicholson (ECR). Mr President, when two patents were granted by the European Patent Office on broccoli and tomatoes in March, the implications of those decisions in the long term were enormous. Over 300 applications for patents on plant material are currently awaiting decision by the European Patent Office. One patent has already led to claims of 900 varieties.

European legislation is currently based on plant breeders’ rights, as has been said, and does not allow for patents in plant varieties. Essentially, it is a biological process. However, through claims on the products obtained from those two processes, varieties are in practice being patented. Patents granted for plant traits and varieties obtained through biological processes set a dangerous precedent. We need clarity from the Commission on this issue. Plant breeders need to be able to equip themselves better for the future, and I have to say, Commissioner, you were less than persuasive in your opening remarks. I hope you do better when you wind up.

Gospodine predsjedniče, svakako „da” za istraživanje u poljoprivredi i svakako „da” za inovativnost u poljoprivredi, ali jedno sigurno i čvrsto „ne” za patente u poljoprivredi i jedno čvrsto i sigurno „ne” za monopole u poljoprivredi. Ovo što je danas učinjeno i što je Ured za patente učinio upravo vodi ka velikoj opasnosti jer dovodi naše zajedničke vrijednosti u pitanje. Dovodi u pitanje bioraznolikost europskog kontinenta. Dovodi u pitanje i sigurnost hrane. Dovodi u pitanje slobodu uzgoja. Mi kao Europski parlament moramo biti jedinstveni i jasno reći Komisiji da očekujemo da Ured za patente povuče svoje odluke jer se definitivno mora znati da se život naprosto ne može patentirati.

Ne želim umanjiti važnost i ulogu koju države članice trebaju imati u tom dijelu jer i one mogu iznimno sačuvati bioraznolikost, ali sam siguran da jedan princip zajedničke suradnje europskog i nacionalnog nivoa moramo zadržati u ovom dijelu poslovanja.

Mr President, the fact that we already have a directive and a 2012 resolution on this matter makes the issue clear: that the EPO’s Enlarged Board of Appeal has again issued a finding to create the possibility to patent biological processes, and this is unacceptable, Commissioner. What we are witnessing is entrepreneurship on the part of the Patent Office, the logic of whose entire existence depends on the granting of patents. If we allow this sort of practice to continue, then we threaten food production, food security, plant innovation and biotechnology and essentially give further power to multinationals over our food supply.

What the EPO has done with its decision of 25 March 2012 basically amounts to commercialisation of the natural world. It is my understanding – and maybe the Commissioner can clarify this – that there are currently 260 such patent applications pending in the pipeline, which is why the Commission must urgently clarify and consider revising Directive 98/44/EC so that unrestricted access to biological material is safeguarded.

  Michel Dantin (PPE). Monsieur le Président, Monsieur le Commissaire, l'amélioration des plantes est un secteur particulièrement innovant. En témoignent, d'une part, les investissements élevés dans la recherche et le développement, de l'ordre de 15 % du chiffre d'affaires du secteur, et, d'autre part, le progrès génétique apporté aux agriculteurs du monde entier. Les opérateurs ont, certes, besoin d'un cadre et d'outils de protection clairs et opérants, mais nous devons aussi respecter un certain nombre de principes éthiques par rapport au monde du vivant.

Le droit sui generis créé par la convention UPOV et le certificat d'obtention végétale, qui le matérialise, demeurent les outils les mieux adaptés à la protection des variétés végétales, et nous devons défendre leur utilisation exclusive à cet effet, soutenant ainsi l'exclusion des variétés végétales du champ de la brevetabilité. L'accélération des processus d'innovation entraîne, en matière de création variétale, un décalage entre le pas de temps de l'innovation et celui de l'obsolescence commerciale.

Nous attendons donc de la Commission une sécurisation de ce secteur important pour notre économie.

Monsieur le Président, Monsieur le Commissaire, comme nous le savons, le droit international et la directive 98/44/CE sur les brevets interdisent explicitement la brevetabilité des variétés végétales, des procédés essentiellement biologiques, des races animales et des caractères natifs, y compris lorsque ceux-ci sont obtenus par des procédés naturels.

Or, par une large interprétation surprenante et contestable du droit sur les brevets, la Grande Chambre de l'Office européen des brevets a franchi, dans sa décision de mars dernier, un pas dangereux en faveur de la brevetabilité des plantes issues de procédés essentiellement biologiques. Le danger de ne plus permettre à tout sélectionneur d'accéder à des variétés existantes et de les utiliser pour créer de nouvelles variétés, ainsi qu'à tout agriculteur de puiser ses propres semences dans ses récoltes, est avéré, mais aussi celui de permettre seulement à quelques groupes puissants, capables d'obtenir des brevets, de se constituer un monopole sur le vivant dans un seul but commercial et financier, plutôt que d'œuvrer en faveur de l'innovation et du progrès partagé.

Pour ces raisons, j'appelle la Commission comme les États membres à clarifier et à faire respecter le droit international.

  Janusz Wojciechowski (ECR). Panie Przewodniczący! Cieszę się, że na tej sali panuje w zasadzie jednomyślność co do potrzeby ścisłego zakazu patentowania odmian roślin i ras zwierząt. Człowiek nie jest wynalazcą życia i nie ma prawa patentować żywych organizmów. To jest przeciwko postępowi, to utrudnia naturalny rozwój rolnictwa. Patentowanie powoduje również to, że bezpieczeństwo żywnościowe pozostawałoby w rękach koncernów biotechnologicznych, że my, wszyscy rolnicy, ale także wszyscy konsumenci byliby zakładnikami takich koncernów. Nie jest to bezpieczna, nie jest to dobra droga, dlatego dobrze, że Parlament Europejski wyraża silny sprzeciw wobec takiej praktyki patentowania żywych organizmów. Dlatego popieram wspólny, bardzo dobry projekt rezolucji.

  Miguel Viegas (GUE/NGL). Senhor Presidente, o que está aqui em causa é a privatização da biodiversidade, a apropriação privada do património genético da humanidade, que foi construído ao longo de séculos de História por gerações de agricultores e criadores. Este passo, dado recentemente pelo Instituto Europeu de Patentes, é inqualificável. Neste sentido, a resolução é positiva. Reforça, aliás, posições já tomadas por esta Assembleia e vai igualmente ao encontro do artigo 53.º da Convenção Europeia de Patentes.

Contudo, devemos ir mais longe. Devemos garantir a proteção integral dos genes nativos, impedindo a sua própria apropriação privada que atenta fortemente contra os agricultores e criadores que passariam a estar nas mãos das multinacionais. Insistimos na ideia de que o património genético da humanidade, a biodiversidade, deve constituir um bem público. Devemos criar mecanismos de proteção que impeçam qualquer apropriação privada deste património. Este património deve ser protegido, valorizado e colocado ao serviço da humanidade e do desenvolvimento.

  Esther Herranz García (PPE). Señor Presidente, estimados colegas, nos encontramos ante dos decisiones de la Oficina Europea de Patentes que no podemos dejar pasar por alto por la inseguridad y los perjuicios que pueden causar al sector de la investigación en el sector primario. Es importante que se siga respetando el modelo actual, con la excepción de los obtentores, para que estos puedan seguir usando las variedades vegetales en el sector agrícola.

Si bien es cierto que la propiedad intelectual ha de estar salvaguardada para no desincentivar determinadas investigaciones, durante años el modelo existente actualmente ha funcionado muy bien y ha permitido que se realice en toda Europa una importantísima labor de innovación y desarrollo, que ha conseguido, gracias al esfuerzo de todos los europeos que se dedican a ello, que nuestro sector agroalimentario alcance las más altas cotas de calidad y reconocimiento a nivel mundial.

La exención de los obtentores ha de ser respetada, y ha de seguir permitiéndose que se investigue sin necesidad de pagar licencias o cánones. De lo contrario, estaríamos empezando a cavar la tumba de un sector de innovación muy importante para la economía de muchas regiones europeas, sobre todo regiones vinculadas al mundo rural. Y no solo eso, también se pondría en serio riesgo la diversidad de variedades vegetales de que ahora gozamos y se coartaría la libertad de elección de los propios consumidores europeos.

Espero que la Comisión sea plenamente consciente de esta problemática que ahora se deriva de la perjudicial interpretación que la Oficina Europea de Patentes ha hecho del artículo 53, letra b), del Convenio sobre la Patente Europea con sus recientes decisiones. Y también espero que se pongan los medios para que se garantice el futuro del sector agroalimentario.

  Clara Eugenia Aguilera García (S&D). Señor Presidente, señor Comisario, hoy, todos los portavoces de todos los grupos de esta Cámara coincidimos en gran medida, y es que han generado grandes dudas las decisiones de la Alta Cámara de Recursos de la Oficina Europea de Patentes, y, por tanto, creo que es su obligación aclarar esta situación como parte del trabajo de la Comisión y especialmente de su cartera.

Estas grandes dudas se refieren a una Directiva, un modelo —el actual—, que ―coincido con la señora Herranz― es un modelo que es bueno, pero no son tan buenas las decisiones que ha tomado la Oficina Europea de Patentes, especialmente las últimas dos decisiones que han causado esta gran confusión.

Es necesario aclarar especialmente los artículos 4, 12 y 13, a fin de garantizar esa claridad jurídica en la prohibición de patentar productos obtenidos por procesos esencialmente biológicos.

Como decía, la Oficina Europea de Patentes ha generado esa duda, que la Comisión debe sin duda aclarar en cuanto a la aplicación de la normativa.

  Ангел Джамбазки (ECR). Г-н Председател, колеги, решението на европейското патентно ведомство отпреди близо 7 месеца стана причина за днешния дебат. Това решение създаде прецедент. Засегнати от него са множество земеделци и целият Европейски съюз. За тях то е противоречие със съществуващите международни конвенции и европейски норми. Малки и средни предприятия в сектора се чувстват застрашени от международните гиганти и смятат, че се нарушава конкурентоспособността им.

Изключително важно е в този случай да бъде предприет балансиран подход. Трябва да съумеем да насърчим развитието на иновациите от една страна, но от друга страна трябва да разграничим ситуациите, при които биологичните характеристики са получени с цел научноизследователска и развойна дейност. И кога тези получени биологични характеристики се използват за лични цели и се комерсиализират.

Когато говорим за тази комерсиализация, смятам, че попадаме в различна категория от тази на развитието на научноизследователската дейност. Важно е да успеем да разграничим тези ситуации и да съумеем да постигнем баланс, защото колкото по-широки са изключенията, толкова по-малък ще бъде обхватът на правилата.

  Marijana Petir (PPE). – Gospodine predsjedniče, poljoprivrednici su kroz povijest, ali i danas u svijetu, prvi uzgajivači sjemena. Njihova uloga važna je za sigurnost opskrbe hranom, biološku raznolikost, prilagodbu klimatskim promjenama i zbog toga poljoprivrednici moraju zadržati pravo da uzgajaju vlastito sjeme, prilagođeno lokalnim uvjetima. Biljne sorte su normalno zaštićene pravima biljnih sorti, što je bolja forma od intelektualnog vlasništva jer dozvoljava poljoprivrednicima korištenje zaštićenih sorti kako bi kreirali nove. Patenti nasuprot tome blokiraju protok genetičkih resursa, ometaju istraživanje i vode do monopola.

Europsko zakonodavstvo ne dozvoljava patentiranje sorti životinja i biljaka te neophodnih bioloških procesa u proizvodnji biljaka i životinja. Žestoko se protivim patentiranju života i ogorčena sam na odluku Europskog ureda za patente koji je u predmetu „o rajčici i brokuli“ presudio da biljni proizvodi koji dolaze iz konvencionalnih uzgoja mogu biti zaštićeni kao patenti. Smatram takvu odluku protuzakonitom i neetičkom te očekujem od Europske komisije hitnu reakciju. Zalažem se da se poljoprivrednicima nesmetano omogući vlastiti uzgoj sjemena jer oni su njegovi čuvari već tisućljećima.

Monsieur le Président, Monsieur le Commissaire, les imperfections dans la rédaction des textes applicables permettent à l'industrie semencière de s'approprier des caractéristiques végétales qui préexistent dans la nature et appartiennent donc à notre patrimoine commun, à notre domaine public. Derrière les appréciations juridiques et techniques, c'est là tout l'enjeu du débat actuel.

Le sérieux de l'examen de l'état de l'art antérieur qui, au sein de l'Office européen des brevets, est censé éviter l'appropriation privée sur des éléments de notre domaine public, est gravement menacé, d'une part, par les objectifs de rendement en termes de délivrance de brevets, tout à fait insoutenables, et, d'autre part, par des problèmes de gestion de l'Office d'une extrême gravité. Il faut savoir que ceux-ci ont conduit à de nombreux suicides au sein de l'Office et à des condamnations de la part des juridictions de La Haye, que le président de l'Office refuse d'appliquer. Cette situation déplorable ne peut perdurer. C'est inacceptable!

Quelles mesures la Commission compte-t-elle adopter pour mettre fin à ces graves dérives qui mettent en danger les conditions dans lesquelles nos opérateurs académiques, les PME du secteur et les agriculteurs peuvent exprimer leur capacité d'innovation?

  Beata Gosiewska (ECR). Szanowni Państwo! Cieszę się bardzo, że jesteśmy jednomyślni i sprzeciwiamy się możliwości patentowania odmian roślin i ras zwierząt. Parlament Europejski już w 2012 r. jasno się w tej sprawie wypowiedział. Natomiast ostatnie decyzje umożliwiające jednak patentowanie roślin zmuszają nas do zadania pytania, w czyim interesie jest patentowanie odmian roślin i ras zwierząt. Kto nagina prawo, aby czerpać zyski? Myślę, że Parlament Europejski i Komisja powinny bronić praw rolników i hodowców zwierząt. Artykuł 4 dyrektywy jasno mówi, że wyłącza się możliwość udzielania patentów na odmiany roślin i rasy zwierząt, w związku z tym wzywam Komisję, aby reagowała szybko i skutecznie w tej sprawie, bo do tego jesteśmy powołani, aby bronić praw rolników i hodowców zwierząt.

  Annie Schreijer-Pierik (PPE). Voorzitter, dankzij de ontwikkeling van nieuwe plantenrassen zijn onze boeren en tuinders vandaag de dag in staat om 7 miljard mensen te voeden. Om werkgelegenheid en voedselzekerheid in de toekomst te garanderen is het behoud van de kleine veredelaars en hun kennis van heel groot belang. Die kennis dreigt verloren te gaan nu de multinationals de markt domineren.

De oorzaak is het octrooirecht. Door natuurlijke planteneigenschappen te octrooieren droogt de vijver voor de kleine veredelaars steeds verder op. Door erkenning van slechts 20 octrooien, commissaris, vallen er nu al 900 variëteiten onder de exclusiviteit van de octrooihouders. Dat is nu al een feit.

Het zijn vrijwel altijd machtige niet-Europese bedrijven die het kapitaal bezitten om massaal planteneigenschappen op te kopen en dan denk ik aan Monsanto. Via het kwekersrecht is ooit afgesproken elkaar er niet van te weerhouden rassen verder te ontwikkelen. Dat basisrecht is geschonden.

Voorzitter, als de Europese Commissie nu niet ingrijpt is monopolisering van de veredelingssector een feit. Er is grote onrust in Nederland, ik heb dit al vaak hier naar voren gebracht en ik hoop op een duidelijk antwoord van onze commissaris.

Die vier Punkte, die für uns wichtig sind, sind von meinen Kollegen genannt worden: Es geht erstens um Verhinderung von Monopolbildung. Es geht zweitens um wissenschaftliche Freiheit, das sogenannte Züchterprivileg, wobei mich das Wort Privileg schon wieder ärgert. Das ist kein Privileg, sondern es geht ganz einfach darum, dass die Züchter auch ihre wissenschaftliche Freiheit behalten, es geht darum, dass der Landwirt Wahlfreiheit behält, und es geht darum, dass Lebewesen nicht patentiert werden dürfen.

Meine Bitte nochmal: Dieser Entschließungsantrag ist ein Weckruf an die Kommission. Die eigentliche Praxis des Patentamts verstößt ja gegen unsere politischen Überzeugungen. Sie müssen jetzt klären: Liegt es an der Rechtsgrundlage, oder liegt es an der Umsetzung? Wenn es an der Rechtsgrundlage liegt, dann müssen wir die Rechtsgrundlage verändern. Liegt es an der Umsetzung, dann brauchen die Patentämter entsprechende Handreichungen.

  Maria Grapini (S&D). Domnule președinte, domnule comisar, decizia recentă a Oficiului European de Brevete nu face altceva decât să creeze un nou obstacol pentru cei mici. Dreptul de brevetare al Oficiului European nu trebuie să obstrucționeze inovarea și nu trebuie să creeze probleme IMM-urilor, micilor producători.

Doamna comisar Bieńkowska, chiar dumneavoastră, domnule Juncker, ne vorbiți des despre importanța inovării, necesitatea susținerii IMM-urilor, dar nu sunt suficiente vorbele. Comisia are obligația să se asigure că pe teren nu se întâmplă exact invers. Aveți acum ocazia, domnule comisar, să demonstrați că înțelegeți acest lucru. Nu se poate ca un oficiu, fie el și de brevetare, să anuleze o reglementare a Parlamentului European printr-o interpretare îngustă. Este important să se găsească un echilibru între reglementările în domeniul proprietății intelectuale și dezvoltarea biotehnologiei.

Domnule comisar, Comisia trebuie să dea un răspuns foarte clar Parlamentului și producătorilor din domeniu privind această problemă. Nu lăsați să se blocheze dezvoltarea biotehnologiei, competitivitatea, inovarea. Țineți cont și de viteza de decizie, domnule comisar. Producătorii nu pot aștepta luni de zile, chiar ani.

În încheiere, vă doresc Crăciun fericit, dar gândiți-vă că de munca dumneavoastră depinde și calitatea vieții oamenilor.

  Νότης Μαριάς ( ECR). Κύριε πρόεδρε, είναι εντελώς απαράδεκτη η πρόσφατη απόφαση του Ευρωπαϊκού Οργανισμού Διπλωμάτων Ευρεσιτεχνίας που χορηγεί δίπλωμα ευρεσιτεχνίας χαρακτηριστικά φυτικών ποικιλιών που αναπτύχθηκαν μέσω βιολογικών διαδικασιών. Η απόφαση αυτή αποτελεί απειλή για την παραγωγή των τροφίμων και την επισιτιστική ασφάλεια, καθώς υπονομεύει τη διαθεσιμότητα τους. Είναι μια εξέλιξη που θα μπορούσε να οδηγήσει σε μονοπώλιο τμημάτων της αγοράς τροφίμων και να δώσει τον ουσιαστικό ένοχο της αγροτικής παραγωγής στις πολυεθνικές του αγροτοδιατροφικού τομέα, συντρίβοντας ταυτόχρονα τους μικρούς και μεσαίους καλλιεργητές αλλά και κτηνοτρόφους, προς όφελος των μεγάλων παραγωγών της Γερμανίας και της Γαλλίας. Οι μεγάλες πολυεθνικές χρησιμοποιούν τα διπλώματα ευρεσιτεχνίας για να βγάλουν υπερκέρδη και για να καθορίζουν πλέον τις οικονομικές εξελίξεις στη γεωργία και την κτηνοτροφία, αδιαφορώντας για το γεγονός ότι περιθωριοποιούν τους μικροκαλλιεργητές και στερούν τις κοινωνίες και τους πολίτες από χρήσιμα αγροτικά αγαθά, τα οποία πλέον μετατρέπουν σε πανάκριβα καταναλωτικά προϊόντα. Απαιτείται άμεση παρέμβαση της Ευρωπαϊκής Ένωσης. Ευχαριστώ.

  Bronis Ropė (Verts/ALE). Komisijos atsakyme buvo daug kalbama apie būtinybę apsaugoti biotechnologijos pramonę, tačiau man atrodo, kad žemdirbių teisių apsauga mums turėtų būti viena svarbiausių. Mes puikiai žinome, kad didžioji dalis ūkininkų patys užsiima selekcija. Negalime leisti sunaikinti mažuosius ūkininkus primetant jiems būtinybę mokėti net už tradicinės selekcijos būdu išvestas veisles. Mieli kolegos, šiandien noriu užduoti klausimą – ką privalome ginti – ar stambias korporacijas, ar ūkininkus ir vartotojus? Jei renkatės ūkininkus, tuomet kviečiu palaikyti žaliųjų registruotus pakeitimus, ypač apsaugant ūkininkus, kad jie nebūtų paduodami į teismą dėl netyčinio jų veislių užteršimo patentuoto augalo žiedadulkėm.

Igazából ennek a mai vitának azért van egy-két olyan tanulsága, amiről most még kevesebbet beszéltünk, de talán később érdemes lesz, és itt elsősorban a Bizottsághoz szeretnék fordulni. Ugye a nagy cégek, főleg a multinacionális cégek valóban monopolhelyzetre törekszenek, de azért a kapitalizmus már csak úgy működik ugye, hogy szeretnék, hogyha az ő befektetéseiknek, tehát a kutatásra költött pénzeknek valahogyan garantált visszajövetele lenne. Amennyiben azt mondjuk nekik, hogy ezt ne csináljátok – amúgy én is azt mondom, ne csinálják –, akkor viszont az európai kutatóintézeteknek, az európai akadémiáknak kellene az élére állni a fejlődésnek, és ebből a szempontból úgy gondolom, hogy a Bizottságnak érdemes lenne átgondolni, miként tudja az innovációt segíteni az európai közösség az adófizetők pénzéből az akadémiai kutatások szintjén. Én ezt javaslom.

  Christos Stylianides, Member of the Commission. Mr President, I have listened carefully to the exchanges on the issues surrounding plant-related patents and plant breeders’ rights. I would like to thank the honourable Members for all their comments. I personally share some – and maybe several – of the concerns mentioned, and I intend to convey all these concerns to my colleague Elżbieta Bieńkowska, who is in charge of this matter.

In closing, I will stress again a few key points.

I could see the political will here to clarify the current legal situation on this issue, and I wish to assure you that the Commission is already considering all possible solutions. I am convinced that a pragmatic way of ensuring legal clarity can be found without the need to revise the Biotech Directive. We are ready to cooperate with the forthcoming Dutch Presidency in looking for workable and well-balanced solutions that can be put in place quickly and can be used by all parties involved.

  Ricardo Serrão Santos (S&D), por escrito. É fundamental salvaguardar o direito dos agricultores de utilizar e reproduzir material genético vegetal. Isto em escala suficiente para, sem comprometer a qualidade, permitir a continuidade de práticas tradicionais e ancestrais, como a troca de sementes na horticultura e agricultura, que contribuem para preservar a diversidade de variedades vegetais, sobretudo daquelas com pouco interesse comercial. Devemos garantir um quadro regulamentar que promova esta diversidade porque é dela que depende a resiliência dos ecossistemas e, em última instância, a preservação da paisagem natural tal como a conhecemos hoje.
