  Ignazio Corrao, Autore. Signor Presidente, onorevoli colleghi, gli accordi di libero scambio dell'Unione europea si basano innanzitutto su criteri economici, prendendo in considerazione, nell'ambito della politica coerente, il rispetto delle norme ambientali e sociali, compresi i diritti umani. I diritti umani vengono menzionati nel preambolo dell'accordo, che però non è vincolante.

La Malesia, per quanto riguarda i diritti umani delle popolazioni autoctone e delle minoranze, purtroppo è ancora molto in ritardo e ci sono numerose violazioni. I diritti fondiari sono una grande preoccupazione delle ONG, lo Stato prevede la costruzione di cinquanta dighe idrauliche nell'Est del paese entro il 2030 a grave a danno dell'ambiente e delle terre delle popolazioni autoctone. Dighe che potrebbero portare allo spostamento di decine di migliaia di abitanti ed inondare centinaia di chilometri quadrati di foresta tropicale.

Ci sono grossi problemi di corruzione, lo Stato di Sarawak è oggetto di speculazione da parte di tutti gli investitori stranieri. Secondo le ONG, l'80 per cento della foresta pluviale è già stata distrutta per far posto alle piantagioni di olio di palma. La Malesia è di fatto uno dei paesi più corrotti del mondo. Ora io dico, utilizziamo lo strumento degli accordi di libero scambio per rafforzare questa difesa dei diritti umani perché è la nostra occasione.

  Mark Demesmaeker, Auteur. Maleisië glijdt af naar een autoritaire staat. Vandaag is het er riskant om vreedzaam te manifesteren en om bijvoorbeeld een geel T-shirt te dragen, want die kleur werd synoniem van landverraad. Zoveel angst voor de democratie belooft weinig goeds.

Het Nationaal Front - of Barisan Nasional - is al 58 jaar aan de macht, maar baseert haar legitimiteit nog altijd op archaïsche koloniale wetten: vrijheid van meningsuiting en pers kunnen te gemakkelijk beperkt worden. De wetsvoorstellen zijn in hoge mate gebaseerd op de sharia. En verklaarde Maleisië niet dat het zichzelf wenst te profileren als een gematigde moslimstaat die de strijd aangaat tegen het islamitische extremisme?

En wat met de rechten van de minderheidsgroepen? De inheemse volkeren als de Orang Asli blijven kampen met het probleem van erkenning van hun eigendomsrechten.

Ik roep de regering op om de parlementaire democratie te respecteren. De Unie moet druk uitoefenen en hiervoor de lopende onderhandelingen over het vrijhandelsakkoord en de partnerschaps- en samenwerkingsovereenkomst aangrijpen.

  Barbara Lochbihler, Verfasserin. Herr Präsident! In Malaysia werden restriktive Gesetze dazu genutzt, das Recht auf Versammlungs- und Meinungsfreiheit massiv einzuschränken.

Vor allem Akteure der Zivilgesellschaft, die sich kritisch über die Regierung äußern, riskieren, inhaftiert zu werden, und bekommen politisch motivierte Gerichtsverfahren. Kritische Stimmen werden regelmäßig mit Anklagen wegen angeblich staatsgefährdenden Aktivitäten konfrontiert. Dieser SeditionAct von 1948 stammt noch aus der Kolonialzeit.

Allein im ersten Halbjahr dieses Jahres wurden mehr als 40 Personen wegen angeblich staatsgefährdender Aktivitäten verhört, inhaftiert oder angeklagt. So wurde der Blogger und politische Aktivist Khalid Ismath im Oktober von einem Gericht auf der Basis des Kommunikations- und Multimediagesetzes und dieses SeditionActs wegen Veröffentlichungen angeklagt, in denen er Machtmissbrauch kritisiert.

Auch aufgrund von Sicherheitsgesetzen wurden Menschen verhaftet, so der Politiker Khairuddin Abu Hassan, der im September festgenommen wurde, weil er über die Korruptionsaffäre eines staatlichen Investments Unternehmens berichtet hat.

Deshalb fordern wir von der malaysischen Regierung die Freilassung und Aufhebung der Anklagen für all diejenigen, die aufgrund ihrer friedlichen Ausübung ihrer Rechte auf Versammlungs- und Meinungsfreiheit verfolgt werden und die Reform oder Abschaffung dieser Gesetzen. Dazu gehört auch das im Dezember beschlossene Gesetz des Nationalen Sicherheitsrats, Freiheitsrechte noch weiter einzuschränken.

  Cecilia Wikström, författare. – Herr talman! Ja, utvecklingen i Malaysia när det gäller inskränkningarna för yttrandefriheten och andra grundläggande friheter, den är alarmerande.

Regeringen gör sitt bästa för att tysta kritiker och den politiska oppositionen och därför måste parlamentet idag beklaga att situationen för de mänskliga rättigheterna har satts ur spel, och att lagstiftningen tillåter att man ger sig på företrädare för civilsamhället, akademiker, medier och opposition.

Därför uppmanar vi i resolutionen regeringen att omedelbart frige de politiska fångarna och vanliga människor som bara använt sin yttrandefrihet men som inte på något sätt utgör någon fara eller risk för landets säkerhet, och dessutom omedelbart stoppa den tilltagande förföljelsen och våldet riktad mot hbtq-personer i landet.

Det är viktigt att vi antar den akuta resolutionen om det politiska läget i Malaysia idag. Vi måste visa för regimen att yttrandefrihet är en grundläggande mänsklig rättighet som inte får inskränkas någonstans. Detta är EU:s viktigaste uppdrag att värna de grundläggande rättigheterna både på hemmaplan här i Europa och i resten av världen.

Mr President, our resolution here today reaffirms our commitment to and our friendship with the Malaysian people and it is because of this commitment and friendship that we share our concerns here today: concerns about the sedition act which Malaysia had committed to repeal, but instead renewed and strengthened; concerns about the new Security Act, which was adopted without any public debate or involvement of civil society and which gives widespread powers to the National Security Council to declare a state of emergency; and, more generally, concern about the atmosphere in which opposition politicians, journalists and civil society find it increasingly difficult to function.

We share these concerns not because we enjoy criticising Malaysia but because we feel that these issues are so important to mention and that they should be the starting point of a constructive dialogue both within Malaysia and also in the bilateral relations between Malaysia and the EU, especially at a time when our bilateral relations are growing ever stronger.

  Marie-Christine Vergiat, auteure. Monsieur le Président, Anwar Ibrahim est en quelque sorte un symbole. Ce libéral est tombé en disgrâce du fait de sa gestion de la crise asiatique à la fin des années 90, par laquelle il a imposé une cure d'austérité très dure, mais il a aussi annulé un certain nombre de méga-projets industriels opaques, ce qui est insupportable dans un pays où la corruption règne en maître. Il a créé le Pakatan Rakyat en tentant de dépasser les clivages communautaires. Chaque succès électoral l'a conduit en prison pour sodomie, une infamie dans un pays ultra-conservateur du point de vue des mœurs.

Les lois sécuritaires et liberticides se multiplient. Minorités, LGBTI et femmes en sont les premières victimes, mais aussi journalistes, intellectuels, militants des ONG et opposants politiques. La lutte contre le terrorisme est un prétexte à une répression tous azimuts. Le gouvernement en place s'enfonce dans la violence pour préserver les intérêts d'une élite et sauvegarder son pouvoir.

Seule une meilleure répartition des richesses et un dialogue politique respectueux de toutes les composantes culturelles peuvent sortir le pays de l'impasse dans laquelle il s'enferme, en instrumentalisant la question religieuse, au risque de sombrer dans l'extrémisme du même nom. Là aussi, il y a urgence à agir.

  Pier Antonio Panzeri, Autore. Signor Presidente, onorevoli colleghi, in Malesia si è registrata una notevole restrizione delle libertà di parola a causa di leggi penali utilizzate per mettere a tacere le voci critiche.

Preoccupa in particolare la legge sulla sedizione, che ha permesso dall'inizio del 2015 di accusare e arrestare più di cento persone. Anwar Ibrahim, ex leader dell'opposizione, è stato condannato con l'accusa di sodomia, come è stato ricordato nel febbraio 2015, e gli sono state negate adeguate cure mediche. Il fumettista malese Ulhaque è stato accusato, ai sensi della legge sulla sedizione, per alcuni tweet critici nei confronti del governo in riferimento alla condanna di Ibrahim. I media stanno affrontando difficoltà crescenti nel riportare le accuse di corruzione mosse contro il primo ministro e le persone LGBTI malesi sono criminalizzate in base alla legge antisodomia.

Bisogna ricordare che la Malesia è membro del Consiglio sicurezza delle Nazioni Unite e attuale presidente dell'ASEAN. La richiesta del Parlamento europeo è chiara: rilasciare i condannati, ritirare il progetto di legge del Consiglio di sicurezza nazionale, in particolare per quanto riguarda gli ampi poteri concessi al primo ministro ed è giusto mantenere un equilibrio tra salvaguardare la sicurezza nazionale e, per noi, l'imperativo di proteggere i diritti civili e i diritti politici.

  Seán Kelly, on behalf of the PPE Group. Mr President, as a member of the ASEAN Delegation, I am well aware of the growing trade relations between the EU and Malaysia. Indeed, it is second only to trade with Singapore.

But while trade is improving, the opportunities within Malaysia for free speech and freedom of expression are deteriorating. Particularly worrying is their strengthening of their sedition law. Instead of repealing it, as previously announced, they have strengthened it. This has had serious implications for freedom of expression, with several people arrested, charged or investigated as a result of this. This is not acceptable.

They have also taken for themselves the power to declare a state of emergency if they feel it is warranted, and the treatment of LGBTI people is ridiculous. At a time when we are moving in the opposite direction – even in my own country – and giving them equal rights in all facets of life, it is unacceptable that a growing trading partner of ours is moving in the opposite direction. We have to address these things in our relations with Malaysia.

  Neena Gill, on behalf of the S&D Group. Mr President, I had the opportunity to visit Malaysia recently and was surprised to find that the perception we collectively hold about the country really is divorced from reality. Yes, it is modern and dynamic, but underneath the surface of its Western-style economy we see a state that is increasingly authoritarian, where politicians and commentators cannot speak freely.

The spike in the number of people facing charges under the Sedition Act, and the recent passing of the National Security Council bill that gives sweeping powers to the Prime Minister and security forces, are prime examples of increasing repression. Ironically, Malaysia hosted the Global Anti-Corruption Conference in September.

I would ask the Prime Minister: why not allow your own anti-corruption commission to conduct transparent investigations into corruption charges against you? Why not allow the media to report on it and allow people to peacefully express their views in the streets? Why not honour the pledges to repeal the Sedition Act and make sure security laws actually contribute to more security for people, rather than using them as a tool for repression? Why be afraid of open dialogue with the opposition and civil society, including Anwar Ibrahim and all the academics, activists and bloggers facing charges? Why not let the country’s brightest minds contribute to making Malaysia a beacon for development and democracy?

The Malaysian authorities and Prime Minister Razak seem to fear that taking these steps will weaken their position. The exact opposite is, however, true.

  António Marinho e Pinto, em nome do Grupo ALDE. Senhor Presidente, as violações dos direitos humanos na Malásia, como em muitos países do mundo, ocorrem predominantemente através de um sistema de justiça pervertido, com leis iníquas, como a lei de sedição. O poder político usa os tribunais para perseguir os seus opositores e mesmo eliminá-los através de aberrantes condenações à morte.

Há mais de mil cidadãos que aguardam nas prisões da Malásia que o Estado os mate. Há dois meios complementares para combater as violações dos direitos humanos na Malásia e no mundo: sanções económicas, incluindo o congelamento de acordos comerciais com estes países, por um lado, e, por outro, o reforço do Tribunal Penal Internacional. É preciso dizer de forma clara que o desrespeito pelos direitos fundamentais da pessoa humana não compensa, não pode compensar, pois que trará prejuízos económicos aos seus violadores, os quais, também, mais cedo ou mais tarde, acabarão por responder perante a justiça penal internacional.

Δεν χωράει αμφιβολία ότι η κατάσταση στη Μαλαισία δεν είναι καθόλου καλή και ότι σε καμία περίπτωση δεν συνάδει με τις ευρωπαϊκές αρχές και αξίες, όπως o καθένας μας τις αντιλαμβάνεται. Πράγματι, η Μαλαισία εξελίσσεται πολύ γρήγορα σε ένα αστυνομικό κράτος με περιορισμένη ελευθερία της έκφρασης, με πολιτικές διώξεις και με κατασκευασμένες κατηγορίες. Επιπλέον, η διαφθορά λαμβάνει τρομακτικές διαστάσεις. Σε κάθε περίπτωση όμως, κανείς δεν έχει ορίσει την Ένωση παγκόσμιο επιτηρητή, ούτε της έχει δώσει την εξουσία να παρεμβαίνει και μάλιστα τόσο απροκάλυπτα στα εσωτερικά τρίτων ανεξαρτήτων κρατών. Ούτε κατέχουμε την απόλυτη αλήθεια, ούτε μπορούμε να πούμε πως όλα αυτά δε συμβαίνουν στις χώρες της Ευρώπης. Και πολιτικές διώξεις έχουμε, και κατηγορίες κατασκευασμένες και κατευθυνόμενες κατά πολιτικών αντιπάλων έχουμε, παρεμβάσεις στη Δικαιοσύνη έχουμε, ψευδομάρτυρες σε αφθονία διαθέτουμε και, αντίστοιχα, ασυλία παραχωρούμε ανάλογα με τις πολιτικές πεποιθήσεις του καθενός. Όσο για τη διαφθορά, κάθε λίγους μήνες έχουμε και ένα καινούργιο σκάνδαλο στην Ευρώπη, με εξαφανισμένα χρήματα, αδήλωτα, και δωράκια από μεγάλες εταιρείες. Θεωρώ συνεπώς πως πάει πολύ να κουνάμε το δάχτυλο σε ολόκληρο τον κόσμο, προσκολλημένοι ακόμη σε μετααποικιοκρατικά συμπλέγματα, χωρίς κυρίως να έχουμε πρώτα βάλει τάξη στα του οίκου μας. Τέλος, αν όντως θέλουμε να πιέσουμε τη Μαλαισία ή οποιαδήποτε άλλη χώρα να σεβαστεί τα ανθρώπινα δικαιώματα και τις πολιτικές ελευθερίες, ας δοκιμάσουμε έναν άλλο τρόπο. Ας διακόψουμε κάθε εμπορική επαφή με το συγκεκριμένο κράτος και κάθε οικονομική ενίσχυση, αφού υπάρχουν διεφθαρμένοι πολιτικοί αξιωματούχοι, όπως λέτε, και ελλοχεύει ο κίνδυνος να οικειοποιηθούν τα χρήματα και ας απαγορεύσουμε στις μεγάλες ευρωπαϊκές πολυεθνικές εταιρίες οποιεσδήποτε δραστηριότητες σε εκείνη τη χώρα, αν έχουμε το σθένος. Διαφορετικά, κρατήστε την υποκρισία σας εντός των ευρωπαϊκών συνόρων.

  Marc Tarabella (S&D). – Monsieur le Président, Monsieur le Commissaire, chers collègues, alors que la Malaisie est un pays dont la croissance est remarquable et rapide, et qu'elle fait figure de modèle en ce sens pour la région du Sud-Est asiatique, comment peut-elle rester accrochée à des pratiques du passé, telles que la torture ou la peine de mort? Bien que la Malaisie ait signé un certain nombre de conventions internationales, force est de constater que les droits de l'homme ne font pas encore partie des priorités et qu'il y a même une certaine régression.

Pour rappel, la Malaisie fait partie des 58 pays qui n'ont toujours pas aboli la peine de mort. Elle fait également partie des 38 États ayant voté contre la résolution pour un moratoire sur l'application de la peine de mort, adoptée lors de l'Assemblée générale des Nations unies du 18 décembre 2014, là où d'autres se sont simplement abstenus, ce qui démontre une volonté de ne pas évoluer en ce domaine.

Mais si la Malaisie peut être un exemple sur le plan économique, pourquoi ne pourrait-elle pas faire de même dans les domaines qui ont tout autant d'importance pour la population, à savoir les libertés fondamentales des citoyens?

  Ryszard Czarnecki (ECR), pytanie zadane przez podniesienie niebieskiej kartki. Bardzo dziękuję panu posłowi Tarabella za przyjęcie mojego pytania. Znam Pańskie zaangażowanie, jeśli chodzi o obronę praw człowieka na świecie. W tej konkretnej sprawie zapytam, i pytam o to często w Europarlamencie, bo czy nie jest tak, że my musimy zaangażować bardziej Komisję Europejską i Radę, nawet państwa członkowskie do presji ekonomicznej na te państwa, które nie przestrzegają praw człowieka? Ten instrument byłoby, jak sądzę, bardziej skuteczny. Co Pan o tym sądzi, Panie Pośle?

  Marc Tarabella (S&D), réponse "carton bleu". Je partage tout à fait votre préoccupation, Monsieur Czarnecki, Monsieur  le Vice-président. En effet, lorsqu'il s'agit de prendre position, par exemple, sur des traités de libre-échange, on devrait – et on le fait certainement – mettre dans la balance le fait de pouvoir progresser en termes de droits humains. On l'a fait avec toute une série de pays, je pense notamment à l'accord avec la Colombie, par exemple, qui était particulier puisqu'on se souvient qu'un syndicaliste assassiné sur deux dans le monde était en Colombie.

Il y a certainement eu des progrès, mais nous devons en faire plus. Il faut donc accorder la priorité en tous cas d'abord au respect des droits humains et au progrès, puis au business et pas l'inverse, ou au moins les mettre sur un pied d'égalité.

  Jiří Pospíšil (PPE). Pane předsedající, já chci podpořit své předřečníky v otázce lidských práv v Malajsii. Zabývám se právními státy v jednotlivých státech světa. Musím říci, že Malajsie se bohužel neblíží modelu právního státu. Už to zde bylo zmiňováno.

Platí tam například zákon o rozvratné činnosti, který byl přijat v roce 1948, v době koloniální éry Malajsie. Tento zákon jasně umožňuje každého za verbální kritiku vlády stíhat. Nedávno, během podzimu tohoto roku ústavní soud Malajsie řekl, že tento zákon je v pořádku, že je v souladu s malajsijskou ústavou. Vidíme, že to je zcela jasné politické rozhodnutí tamního ústavního soudu.

Druhým problémem je podoba trestního práva. Dnes čeká ve věznicích až tisíc lidí na popravu v Malajsii. Tamní trestní zákoník je velmi vágní. Já se tedy přimlouvám, vážený pane komisaři, k tomu, co říkali moji kolegové. Je třeba s Malajsií komunikovat, spolupracovat, ale měli bychom s ní uzavírat dohody jenom v případě, že bude ochotna napravit svůj právní stát a odstranit zákony, které z Malajsie nedělají právní stát.

Κύριε Πρόεδρε, η έλλειψη ελευθερίας της έκφρασης, η θρησκευτική καταπίεση, οι διακρίσεις σε βάρος των αυτόχθονων πληθυσμών και των μεταναστών στη Μαλαισία είναι πλέον στην ημερήσια διάταξη. Η μαλαισιανή κυβέρνηση, με το πρόσχημα της αντιμετώπισης της τρομοκρατίας, συλλαμβάνει και, επικαλούμενη λόγους εθνικής ασφάλειας, φυλακίζει επ' αόριστον οποιοδήποτε πρόσωπο θεωρείται δήθεν ύποπτο, ενώ οι συλλήψεις εκείνων που αγωνίζονται για τα ανθρώπινα δικαιώματα είναι συχνές. Επιπλέον, η κυβέρνηση της χώρας έχει επιβάλει περιορισμούς όσον αφορά την ελευθερία του λόγου και γι αυτό έχει χαρακτηριστεί ως μια απ' τις χώρες με το χειρότερο βαθμό στην ελευθερία της έκφρασης, μια χώρα όπου εφαρμόζεται η σαρία.

Οι περιπτώσεις όπου οι μαλαισιανές αρχές έχουν επιβάλει κυρώσεις για δημοσιεύματα που εναντιώνονται στην κυβέρνηση είναι πολλές. Απέναντι στην καταπάτηση των ανθρωπίνων δικαιωμάτων στη Μαλαισία, η Ευρωπαϊκή Ένωση καλείται να ασκήσει πίεση στην κυβέρνηση της χώρας, προκειμένου να καταργήσει η δεύτερη το νόμο περί ανταρσίας και να κατοχυρώσει τα δικαιώματα της ελευθερίας της έκφρασης, του συνέρχεσθαι και όλα όσα στηρίζονται στο διεθνές σύμφωνο ατομικών και πολιτικών δικαιωμάτων.

A Czarnecki-Tarabella vitához hozzáfűzném, hogy a tegnapi Preda-jelentés közben többször is elhangzott, hogy igenis a Tanács és a Bizottság tehetne többet azért, jó példát mutatva, hogy tagállamain számon kéri az emberi jogok, beleértve a kisebbségekhez tartozók jogainak is a tiszteletben tartását. Önmagában az a tény, hogy Malajzia történetében összesen 7 alkalommal történt vádemelés szodómia bűntette miatt, és ebből két alkalommal Anwar Ibrahim ellenzéki vezető volt a célpont sok mindent elmond az ott uralkodó állapotokról. A politikai ellenlábasok igazságszolgáltatási eszközökkel történő eltávolítása mindenképpen tükrözi a hatalom félelmét attól, hogy az ellenzék felülkerekedhet egy demokratikus választáson. Az Anwar Ibrahim melletti kiállás számomra azt is jelzi, hogy erősödik az ellenzék Malajziában, és belátható időn belül elkerülhetetlen lesz a hatalom meghátrálása. Az Európai Uniónak nem az a feladata, hogy beavatkozzon Malajzia belpolitikájába, csupán nyomatékosíthatjuk, hogy az általunk vallott értékek tiszteletét minden fontos kereskedelmi partnerünktől elvárjuk.

  Fabio Massimo Castaldo (EFDD). Signor Presidente, onorevoli colleghi, Sedition Act, Printing Presses and Publications Act, Peaceful Assembly Act, Communications and Multimedia Act, la lista degli atti legislativi e delle diverse riforme del codice penale che colpiscono in Malesia l'esercizio della libertà di espressione e di riunione è lunghissima purtroppo.

Il paese soffre anche di un elevato dumping sociale, la corruzione è estesa fino alle più alte sfere di governo, e una politicizzazione forzata della magistratura ha portato a processi contro l'opposizione e i dissidenti politici e anche contro i giornalisti, come è accaduto per esempio per l'ex leader dell'opposizione Anwar Ibrahim, adesso in carcere con un'accusa francamente ridicola, che peraltro fa anche capire quanto ormai le Corti islamiche e la sharia abbiano preso il sopravvento all'interno del paese. Per non parlare poi della sistematica distruzione dell'ambiente e dei progetti folli del governo a cui ha accennato l'onorevole Corrao in precedenza.

Come Unione europea noi siamo un mercato di più di 500 milioni di persone, siamo una superpotenza economica e i nostri accordi commerciali possono essere l'arma definitiva per divenire anche una superpotenza dei diritti umani. Noi possiamo farlo. Se non ora quando? Europa svegliati e pretendi dai nostri partner il rispetto di quei diritti sacrosanti riconosciuti a ogni uomo.

  Pavel Svoboda (PPE). Pane předsedající, rád bych věřil, že naše dnešní diskuse a dnešní usnesení bude vnímáno jako součást diskuse s partnerem, se kterým nás, doufám, pojí společný zájem na spolupráci.

Rád bych připomenul k tomu, co už tady řekli předřečníci o situaci právního státu v Malajsii, že rozvojová spolupráce, obchodní dohody, které uzavírá Evropská unie, jsou podmíněny dodržováním lidských práv. A proto bych rád vyzval Evropskou komisi, aby v tomto ohledu přitlačila, aby to vzala vážně a uplatňovala podmíněnost rozvojové a obchodní spolupráce se zeměmi, jako je Malajsie tak, aby došlo k opravdovému zlepšení situace lidských práv v této zemi.

  Christos Stylianides, Member of the Commission. Mr President, Malaysia holds a prominent place for the European Union in the South-East Asia region. Malaysia currently holds the presidency of ASEAN at a time when important decisions are being taken towards creating an ASEAN Economic Community. Our bilateral ties have strengthened significantly through enhanced trade and investment, political dialogue and a variety of cooperation activities. But against this background, the European Union is concerned about some of the developments that have taken place in this country since 2014, developments which have affected freedom of expression and the rule of law.

We are notably concerned about the increase of the use of the so-called Sedition Act, as well as about the judiciary decisions regarding Mr Anwar Ibrahim, the leader of the opposition. As regards freedom of expression and as you all recall, the EU regrets the increasing use since 2014 of the Sedition Act, despite the Prime Minister’s pledge to repeal it. In this context, I would like to recall that in April 2015 the High Representative expressed public concern that this step would have implications for the exercise of freedom of expression.

The High Representative raised serious concerns regarding the due process of law after the conviction by the Federal Court of Malaysia and the five—year imprisonment of the opposition leader in February this year. Mr Anwar had initially been acquitted before the decision was overturned. As a consequence he was deprived of his civil rights and lost his seat as a Member of Parliament.

On 8 December, the European Union concluded the negotiation of a new—generation Partnership and Cooperation Agreement (PCA) with Malaysia. The European Parliament has repeatedly called for the conclusion of this negotiation, which started in 2011. The new Agreement includes specific provisions on human rights and the rule of law which will allow for an enhanced engagement on these matters, in particular through the establishment of a meaningful, broad-based human rights dialogue. During the negotiations, Malaysia agreed to recognise that respect for democratic principles, human rights and the rule of law constitute an essential element of the Agreement.

We will continue to engage with the Government of Malaysia to step up our cooperation in the promotion of human rights, including as regards LGBTI issues bilaterally as well as at the regional level with ASEAN.
