  Laima Liucija Andrikienė (PPE), in writing. ‒ I have given my consent to the recommendation concerning Community statistics relating to external trade with non-member countries (delegated and implementing acts). In the light of the changes brought by the Lisbon Treaty and by the subsequent adoption of Regulation (EU) No 182/2011 (on implementing acts), the Commission was required to adapt the decision-making rules in trade policy to the new regime of delegated and implementing acts. Most of the legislation in the field of the Common Commercial Policy has been aligned to the new constitutional regime (Trade Omnibus I and Trade Omnibus II). The Commission committed to amend Regulation (EC) No 471/2009 on Community statistics, which is the only legislative act in the field of the Common Commercial Policy referring to the regulatory procedure with scrutiny. Following the adoption of the new Inter-institutional agreement on Better law-making in December 2015, the European Parliament and the Council were able to reach an agreement on the regulation in question, which was overwhelmingly approved by the Committee on International Trade of the European Parliament and by the Council.

  Νίκος Ανδρουλάκης (S&D), γραπτώς. ‒ Υπερψήφισα τη σύσταση για τη δεύτερη ανάγνωση σχετικά με τη θέση του Συμβουλίου σε πρώτη ανάγνωση ενόψει της έγκρισης του κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου που αφορά την τροποποίηση του κανονισμού (ΕΚ) αριθ. 471/2009 για τις κοινοτικές στατιστικές του εξωτερικού εμπορίου με τις τρίτες χώρες όσον αφορά την ανάθεση κατ’ εξουσιοδότηση και εκτελεστικών αρμοδιοτήτων στην Επιτροπή για την έγκριση ορισμένων μέτρων, διότι το τελικό κείμενο αποτελεί συμβιβασμό του Συμβουλίου με το Κοινοβούλιο.

  Marie-Christine Arnautu (ENF), par écrit. ‒ Le règlement (CE) n° 471/2009 concerne les statistiques communautaires relatives au commerce extérieur avec les pays tiers.

L’objectif de cette décision est de déterminer précisément les pouvoirs dont dispose la Commission et de fixer la procédure appropriée pour lui permettre d’adopter des mesures pour les statistiques du commerce extérieur en vertu de ces pouvoirs. L’objectif général est de supprimer, d’ici à la fin de la septième législature du Parlement et dans l’ensemble des instruments législatifs, toutes les dispositions renvoyant à la procédure de réglementation avec contrôle et de les remplacer par des procédures avec actes délégués et compétences d’exécution.

Le règlement (CE) n° 471/2009 du Parlement européen et du Conseil confère à la Commission le pouvoir d'exécuter certaines des dispositions de ce règlement. Afin d'aligner le règlement (CE) n° 471/2009 sur les articles 290 et 291 du TFUE, les compétences d'exécution conférées à la Commission par ce règlement doivent être remplacées par le pouvoir d'adopter des actes délégués et des actes d'exécution.

La disparition des procédures de réglementation avec contrôle pour les remplacer par des actes délégués et des compétences d’exécution est une mesure technique rendue obligatoire par l’adoption du TFUE.

J’ai donc voté pour.

  Jean Arthuis (ALDE), par écrit. ‒ J'ai voté en faveur de cette recommandation car dans un objectif d'allègement des charges administratives pesant sur les entreprises, la Commission promeut dans cette documentation une simplification de la législation en matière de statistiques communautaires. Cette ambition se double d'une volonté de fixer des priorités de collecte de données afin de mieux étudier les mutations du monde économique.

  Hugues Bayet (S&D), par écrit. ‒ J’ai décidé de voter en faveur de cette recommandation, m’inscrivant dans la suite de l’excellent travail réalisé par mes collègues de la commission INTA.

Les modifications dont il est question dans ce texte consistent fondamentalement en la mise en conformité des procédures appliquées en matière de statistiques, pour deux points précis, avec le droit de l’Union relatif au nouveau régime d'actes délégués et d'actes d'exécution tel qu’issu du traité de Lisbonne.

  Brando Benifei (S&D), per iscritto. ‒ Oggi ho votato a favore della relazione Lange, che approva la posizione del consiglio in prima lettura sulla modifica il regolamento (CE) n. 471/2009, relativo alle statistiche comunitarie del commercio estero con i paesi terzi.

Si tratta di un provvedimento di natura tecnica che riguarda il conferimento alla Commissione dei poteri delegati e di esecuzione per l'adozione di alcune misure specifiche. Il testo tiene conto dei bilanciamenti sui contenuti che sono stati resi possibili a seguito dell’approvazione dell’accordo interistituzionale "Legiferare meglio" che ha consentito di superare lo stallo dei negoziati.

  Xabier Benito Ziluaga (GUE/NGL), por escrito. ‒ He votado a favor de este informe en segunda lectura. Ya existe un acuerdo bajo el marco «Legislar mejor», que establece, entre otras cosas, una solución horizontal relativa a la consulta de expertos de los Estados miembros en la preparación de actos delegados.

La adopción del nuevo Acuerdo interinstitucional «Legislar mejor» en diciembre de 2015, permitió que los equipos negociadores del Parlamento y el Consejo alcanzaran un acuerdo sobre el Reglamento en cuestión.

  Dominique Bilde (ENF), par écrit. ‒ J’ai voté en faveur de ce rapport sur la position du Conseil en première lecture en vue de l'adoption d'un règlement du Parlement européen et du Conseil modifiant le règlement (CE) n° 471/2009 concernant les statistiques communautaires relatives au commerce extérieur avec les pays tiers en ce qui concerne les pouvoirs délégués et les compétences d'exécution conférés à la Commission pour l'adoption de certaines mesures.

Le règlement prévoit notamment la disparition des procédures de réglementation avec contrôle, et ce, pour les remplacer par des procédures avec actes délégués et compétences d’exécution.

Il ne s’agit là que d’une simple mise en conformité avec les traités, et notamment le TFUE qui prévoient ce remplacement dans ses articles 290 et 291.

  Mara Bizzotto (ENF), per iscritto. ‒ Pur trattandosi di un provvedimento tecnico che normalmente non porrebbe particolari problemi, permane il mio scetticismo a causa dell'uso disinvolto e poco trasparente da parte della Commissione dello strumento degli atti delegati.   José Blanco López (S&D), por escrito. ‒ Tras los cambios introducidos por el Tratado de Lisboa y la posterior adopción del Reglamento (UE) n.º 182/2011, se hizo necesario adaptar las normas de toma de decisiones en materia de política comercial al nuevo régimen de actos delegados y de ejecución. La mayor parte de la legislación en el ámbito de la política comercial común se ha armonizado a través de los Reglamentos comerciales generales Trade Omnibus I y II y varias armonizaciones individuales posteriores. Había quedado pendiente de adaptación, sin embargo, el Reglamento (CE) n.º 471/2009 sobre estadísticas comunitarias.

Tras las negociaciones y el acuerdo con la Comisión y el Consejo, la Comisión INTA del Parlamento Europeo aprobó por abrumadora mayoría el texto acordado, que hoy ha sido sometido a votación en el Pleno y que ha contado con mi apoyo.

  Vilija Blinkevičiūtė (S&D), raštu. ‒ Balsavau dėl šio pranešimo, nes juo Parlamentas pritarė bendrai pozicijai su Taryba dėl reglamento dėl Bendrijos statistikos, susijusios su išorės prekyba su ES nepriklausančiomis šalimis. Atsižvelgdama į pokyčius, kuriuos lėmė Lisabonos sutartis ir vėliau priimtas Reglamentas (ES) Nr. 182/2011 (dėl įgyvendinimo aktų), Komisija turėjo atitinkamai pritaikyti prekybos politikai taikomas sprendimų priėmimo taisykles. Komisija įsipareigojo pateikti pasiūlymą dėl antrojo nuostatų derinimo taikant komiteto procedūrą etapo – kad būtų derinami teisėkūros procedūra priimti aktai, kuriuose numatyta reguliavimo procedūra su tikrinimu.

Il s'agit ici d'une mesure purement technique.

  Renata Briano (S&D), per iscritto. ‒ Il regolamento (CE) n. 223/2009 del Parlamento europeo e del Consiglio, dell'11 marzo 2009, relativo alle statistiche europee, definisce il sistema statistico europeo (SSE) come una partnership tra l'autorità statistica europea, ossia la Commissione (Eurostat), gli istituti nazionali di statistica (INS) e le altre autorità nazionali preposte, in ciascuno Stato membro, allo sviluppo, alla produzione e alla diffusione di statistiche europee.

Il comitato del sistema statistico europeo (comitato SSE), istituito ai sensi dell'articolo 7 del regolamento (CE) n. 223/2009, è considerato il comitato-ombrello in seno all'SSE. Esso assiste la Commissione nell'esercizio delle competenze di esecuzione in taluni settori statistici. Tali settori non comprendevano l'aspetto commerciale e l'analisi dei flussi import/export tra Unione e paesi terzi. Con il presente regolamento si amplia la portata dell'analisi statistica, si razionalizza e uniforma il metodo e si rendono più utili i dati fruibili alla pubblica consultazione.

  Steeve Briois (ENF), par écrit. ‒ Ce texte porte sur le règlement n° 471/2009 concernant les statistiques communautaires relatives au commerce extérieur avec les pays tiers. Ce règlement vise à déterminer les prérogatives de la Commission européenne lui permettant d’adopter des mesures pour les statistiques du commerce extérieur.

Concrètement, seront supprimées dans l’ensemble des instruments législatifs toutes les dispositions renvoyant à la procédure de réglementation avec contrôle afin de les remplacer par des procédures avec actes délégués et compétences d’exécution.

J’ai voté en faveur de cette mesure technique, rendue obligatoire par l’adoption du traité sur le fonctionnement de l’Union européenne (TFUE).

  Daniel Buda (PPE), în scris. ‒ În contextul modificărilor aduse de Tratatul de la Lisabona și prin adoptarea ulterioară a Regulamentului (UE) nr. 182/2011 (privind actele delegate), Comisiei i s-a solicitat să își adapteze normele de adoptare a deciziilor din cadrul politicii comerciale la noul regim al actelor delegate și al actelor de punere în aplicare.

Astfel, majoritatea actelor legislative din domeniul politicii comerciale comune au fost aliniate la noul regim constituțional prin intermediul actelor Omnibus I și II privind comerțul și al altor câteva alinieri individuale ulterioare.

Am acordat un vot favorabil, având în vedere faptul că, până la sfârșitul celei de a 7-a legislaturi, Comisia și-a luat angajamentul de a elabora a doua serie de alinieri privind procedura comitetelor cu privire la actele legislative care prevăd procedura de reglementare cu control.

  Nicola Caputo (S&D), per iscritto. ‒ Oggi ho votato a favore della relazione in questione, che aggiorna il regolamento sulla raccolta delle statistiche del commercio estero con i paesi terzi. Alla luce dei cambiamenti introdotti dal trattato di Lisbona e della conseguente adozione del regolamento (UE) n. 182/2011 (sugli atti di esecuzione), la Commissione ha dovuto adeguare le regole decisionali in materia di politica commerciale al nuovo regime degli atti delegati e degli atti di esecuzione.

La maggior parte della normativa nel settore della politica commerciale comune è stata allineata al nuovo regime costituzionale tramite gli strumenti Omnibus I e II in materia di scambi commerciali e con vari allineamenti specifici successivi.

La Commissione ha proposto di modificare il regolamento (CE) n. 471/2009 relativo alle statistiche comunitarie, che è l'unico atto legislativo nel settore della politica commerciale comune a fare riferimento alla procedura di regolamentazione con controllo.

  David Casa (PPE), in writing. ‒ I voted in favour of this report as in its current state the agreement is essentially in line with the original Commission proposal with the exceptions of some minor changes. The agreement also now takes into consideration the outcome of the inter-institutional agreement on better law-making adopted in Plenary in March 2016. The aim of the Commission proposal is to amend Regulation 471/2009 on Community statistics relating to trade with non-member countries to the new institutional context of delegated and implementing acts.

  Fabio Massimo Castaldo (EFDD), per iscritto. – In linea con il trattato di Lisbona, la Commissione ha dovuto adeguare le regole decisionali in materia di politica commerciale al regime degli atti delegati e atti di esecuzione.

Gran parte della normativa nel settore della politica commerciale comune è stata modificata nei termini richiesti tramite gli strumenti Omnibus I e II in materia di scambi commerciali (Trade Omnibus I e II) e con modifiche puntuali successive. La Commissione si è inoltre impegnata a presentare una seconda serie di modifiche della procedura di comitologia entro la fine della settima legislatura. In tale contesto, viene proposta la modifica del regolamento (CE) n. 471/2009 relativo alle statistiche comunitarie, che è l'unico atto legislativo nel settore della politica commerciale comune a fare riferimento alla ex procedura di regolamentazione con controllo. Si tratta di un adeguamento necessario e dettato dal trattato, ho quindi votato a favore.

  Λευτέρης Χριστοφόρου (PPE), γραπτώς. ‒ Στηρίζουμε την τροποποίηση του κανονισμού (ΕΚ) αριθ. 471/2009 σχετικά με τις κοινοτικές στατιστικές, ο οποίος είναι η μόνη νομοθετική πράξη στο πεδίο της κοινής εμπορικής πολιτικής που παραπέμπει στην κανονιστική διαδικασία με έλεγχο.

  Κώστας Χρυσόγονος (GUE/NGL), γραπτώς. ‒ Ψηφίσαμε ως προς τη σύσταση ενόψει της έγκρισης του κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου που αφορά την τροποποίηση του κανονισμού (ΕΚ) αριθ. 471/2009 για τις κοινοτικές στατιστικές του εξωτερικού εμπορίου με τις τρίτες χώρες όσον αφορά την ανάθεση κατ’ εξουσιοδότηση και εκτελεστικών αρμοδιοτήτων στην Επιτροπή για την έγκριση ορισμένων μέτρων. Πρόκειται για μια διαδικασία τυπικής φύσεως ως προς την οποία δεν εκφράστηκαν αντιρρήσεις σε αυτό το στάδιο από καμία πλευρά. Ως εκ τούτου ψήφισα θετικά.

  Alberto Cirio (PPE), per iscritto. ‒ Accolgo favorevolmente la proposta della Commissione, volta alla modifica delle statistiche inerenti al commercio estero con paesi terzi.

Si tratta di un provvedimento di carattere tecnico, che consente di adattare le regole decisionali relative alla politica commerciale al nuovo regime di atti delegati e atti d'esecuzione, in linea con quanto previsto dal trattato di Lisbona. Il mio voto a favore giunge dalla considerazione che, implementando il regime di atti delegati, il Parlamento e dunque l'intera popolazione europea potrà avere maggiore controllo e consapevolezza riguardo all'elaborazione di dati inerenti la bilancia commerciale. Infatti, una conoscenza profonda e una miglior interpretazione delle informazioni su esportazioni e importazioni sono basilari per l'organizzazione e la pianificazione della nostra politica industriale.

Ricordando l'eccellenza delle nostre piccole e medie imprese e il loro ruolo all'interno del tessuto industriale europeo, grazie ad una maggiore consapevolezza dei risultati economici conseguiti, si potrà perseguire una strategia diretta all'internazionalizzazione con riflessi positivi per tutti.

  Lara Comi (PPE), per iscritto. ‒ Ho votato a favore del provvedimento in quanto, in seguito ai cambiamenti introdotti dal trattato di Lisbona e alla conseguente adozione del regolamento (UE) n. 182/2011 sugli atti di esecuzione, si è reso necessario un adeguamento delle regole decisionali in materia di politica commerciale da parte della Commissione con particolare riferimento al regolamento 471/2009, inerente alle statistiche comunitarie relative al commercio estero con i paesi terzi, che rappresenta l'unico atto legislativo nel settore della politica commerciale comune che fa riferimento alla procedura di regolamentazione con controllo.

  Edward Czesak (ECR), na piśmie. ‒ Celem rozporządzenia jest dostosowanie rozporządzenia (WE) nr 421/2009 w sprawie statystyk dotyczących handlu zagranicznego z państwami trzecimi do TFUE pod względem przekazywania Komisji uprawnień delegowanych i wykonawczych do przyjęcia niektórych środków.

Po głosowaniu w pierwszym czytaniu na posiedzeniu plenarnym w dniu 12 marca 2014 r. PE i Rada prowadziły negocjacje z zamiarem zawarcia porozumienia na wczesnym etapie drugiego czytania na podstawie stanowiska Rady w pierwszym czytaniu, które PE może zatwierdzić jako odzwierciedlające kompromis osiągnięty między współprawodawcami i obejmujące kombinację aktów delegowanych, aktów wykonawczych, a także przenoszące pewne kwestie do podstawowego aktu ustawodawczego. Jedna kwestia pozostaje nierozstrzygnięta: konsultacje z ekspertami z państw członkowskich w trakcie przygotowywania aktów delegowanych, na które nalegała Rada. To właśnie wtedy postanowiono o zawieszeniu negocjacji w oczekiwaniu na wynik porozumienia międzyinstytucjonalnego w sprawie lepszego stanowienia prawa. Po przyjęciu tego porozumienia międzyinstytucjonalnego projekt rozporządzenia został odpowiednio zmieniony.

ECR wspiera zrównoważony wynik negocjacji następujących po porozumieniu międzyinstytucjonalnym w sprawie lepszego stanowienia prawa, a w konsekwencji również rekomendację przeprowadzenia drugiego czytania bez poprawek. Zagłosowałem za.

  Nicola Danti (S&D), per iscritto. ‒ Mi sono espresso a favore circa l'armonizzazione delle regole decisionali in materia di politica commerciale UE, con particolare riferimento al nuovo regime degli atti delegati e di esecuzione della Commissione europea.

Dopo lunghi negoziati, si è finalmente giunti ad un compromesso costituito dal presente provvedimento, il quale prevede l'adeguamento del vecchio regime di "comitatologia" alle regole intervenute in seguito all'entrata in vigore del trattato di Lisbona e del regolamento UE del 2011 sugli atti di esecuzione, il quale consentirebbe di realizzare sistematicamente indagini statistiche a livello comunitario in materia di commercio estero.

Un passo in avanti, quindi, verso una maggiore efficienza dell'azione europea in ambito commerciale.

  Michel Dantin (PPE), par écrit. ‒ Le présent rapport concerne les statistiques relatives au commerce extérieur de l’Union avec les pays tiers. Il s’attache principalement aux règles de mise en œuvre pratique de la législation européenne en la matière, que sont les actes d’exécution et les actes délégués.

Considérant que ce rapport permet d’harmoniser et de fiabiliser les données relatives au commerce extérieur afin d’établir des accords commerciaux en toute connaissance de cause, j’ai soutenu ce rapport.

  Rachida Dati (PPE), par écrit. – J’ai soutenu ce texte qui permet d’aligner le règlement sur les statistiques communautaires relatives au commerce extérieur avec les pays tiers sur les nouvelles règles du traité sur le fonctionnement de l’Union européenne concernant les pouvoirs délégués et d’exécution de la Commission.

Il est évident que nous devons adapter les législations en cohérence avec les règles institutionnelles en vigueur.

L’objet de ce texte est de déterminer précisément les pouvoirs dont dispose la Commission et de fixer les procédures nécessaires à l’adoption de mesures statistiques. Le règlement (CE) n° 471/2009 du Parlement européen et du Conseil confère à la Commission le pouvoir d’exécuter certaines dispositions de ce règlement. J’ai donc voté pour ce texte.

Neste contexto, a Comissão propôs a alteração do Regulamento relativo às estatísticas comunitárias. A adoção do novo Acordo Interinstitucional «Legislar Melhor» permitiu que as equipas de negociação do Parlamento e do Conselho chegassem a acordo relativamente ao regulamento em questão.   João Ferreira (GUE/NGL), por escrito. ‒ À luz das alterações introduzidas pelo Tratado de Lisboa – das quais frontalmente discordamos – e pela posterior adoção do Regulamento (UE) n.º 182/2011 (sobre os atos de execução), a Comissão teve de adaptar as regras de tomada de decisão em matéria de política comercial ao novo regime de atos delegados e de execução. A maior parte da legislação no domínio da política comercial comum foi alinhada pelo novo regime, através dos regulamentos «Trade Omnibus» I e II e de vários alinhamentos individuais posteriores.

Neste contexto, a Comissão propôs a alteração do Regulamento (CE) n.º 471/2009 relativo às estatísticas comunitárias, o qual constitui o único ato legislativo no domínio da política comercial comum que se refere ao procedimento de regulamentação com controlo.

Na sequência da aprovação da posição do Parlamento em primeira leitura na sessão plenária de 12 de março de 2014, tiveram início negociações informais com a Presidência italiana tendo em vista chegar rapidamente a um acordo em segunda leitura.

Após várias rondas de trílogos, as negociações foram suspensas na pendência da adoção do novo Acordo Interinstitucional «Legislar melhor» que prevê, nomeadamente, uma solução horizontal no que se refere à consulta de peritos dos Estados-Membros aquando da preparação de atos delegados. Abstivemo-nos.

  Doru-Claudian Frunzulică (S&D), in writing. ‒ This file aligns the previous comitology regime to the post-Lisbon Treaty rules on delegated and implementing acts in order to enable the systematic production of Community statistics in the field of external trade. The final compromise involves a mix of delegated acts and implementing acts and also moves certain issues to the basic legislative act, a compromise that balanced the interests of the co-legislators.

After the initial agreement resulting from two trilogues in December 2014, the Council refused to accept its outcome due to one unresolved issue: the consultation of Member States’ experts in the preparation of delegated acts. The negotiations were therefore suspended until December 2015, when the new Inter-institutional Agreement on Better law making was agreed and a new horizontal formulation for the issue in question had been found.

The text adopted in Council is in accordance with the compromise reached with Parliament. I therefore supported the outcome.

  Ildikó Gáll-Pelcz (PPE), írásban. ‒ Jóváhagytam az EU harmadik országokkal folytatott külkereskedelmére vonatkozó statisztikáról szóló 471/2009/EK rendelet módosításáról szóló európai parlamenti és tanácsi rendelet elfogadása céljából első olvasatban kialakított tanácsi álláspontot. A Lisszaboni Szerződés következtében bevezetett módosítások felszólították a Bizottságot, hogy a kereskedelempolitikával kapcsolatos döntéshozatali szabályokat igazítsa hozzá a felhatalmazáson alapuló jogi aktusok és a végrehajtási aktusok új rendszeréhez. A közös kereskedelempolitika területére vonatkozó legtöbb jogszabály összehangolásra került az új alkotmányos rendszerrel.

Mivel a Bizottság elkötelezte magát a komitológiai kiigazítások második hullámának a 7. parlamenti ciklus végéig történő megvalósítása mellett, ennek értelmében javasolták a közösségi statisztikákról szóló szóban forgó rendelet módosítását, amely az egyetlen olyan jogalkotási aktus a közös kereskedelempolitika területén, amelyben szerepel az ellenőrzéssel történő szabályozási bizottsági eljárás.

  Beata Gosiewska (ECR), na piśmie. ‒ Głosowałam za zaleceniem do drugiego czytania dotyczącym stanowiska Rady w pierwszym czytaniu w sprawie przyjęcia rozporządzenia Parlamentu Europejskiego i Rady zmieniającego rozporządzenie (WE) nr 471/2009 w sprawie statystyk Wspólnoty dotyczących handlu zagranicznego z państwami trzecimi w odniesieniu do powierzenia Komisji uprawnień delegowanych i wykonawczych do przyjmowania niektórych środków.

W związku ze zmianami po wejściu w życie traktatu lizbońskiego i przyjęciu rozporządzenia (UE) nr 182/2011 (w sprawie aktów wykonawczych) Komisja musiała dostosować zasady podejmowania decyzji w polityce handlowej do nowego systemu aktów delegowanych i wykonawczych. Większość przepisów ustawodawczych w tej dziedzinie dostosowano za pomocą aktu zbiorczego oraz w drodze kilku dostosowań indywidualnych. Komisja zobowiązała się przedstawić do końca siódmej kadencji drugi zbiór dostosowań procedury komitetowej w odniesieniu do aktów ustawodawczych obejmujących procedurę regulacyjną połączoną z kontrolą. Wobec tego Komisja zaproponowała wprowadzenie zmian do rozporządzenia (WE) nr 471/2009 w sprawie statystyk Wspólnoty, które jest jedynym aktem ustawodawczym w dziedzinie wspólnej polityki handlowej odnoszącym się do procedury regulacyjnej połączonej z kontrolą.

W mojej ocenie można poprzeć stanowisko Rady w tym zakresie.

Na Odboru za međunarodnu trgovinu Europskog parlamenta ove je godine usuglašeni tekst na glasovanju odobren velikom većinom.

  Vladimír Maňka (S&D), písomne ‒ EP svojím uznesením postúpil do druhého čítania návrh nariadenia Európskeho parlamentu a Rady, ktorým sa mení nariadenie (ES) č. 471/2009 o štatistike Spoločenstva o zahraničnom obchode s nečlenskými krajinami, pokiaľ ide o prenesenie delegovaných a vykonávacích právomocí na Komisiu s cieľom prijať určité opatrenia. Podporujem návrh, aby transparentným a dôsledným uplatnením rozdelenia právomoci Komisie na prijímanie delegovaných a vykonávacích právomocí došlo k odstráneniu všetkých ustanovení odkazujúcich na regulačný postup s kontrolou a aby sa stanovil vhodný postup na prijímanie opatrení. Tento postup povedie aj k zjednodušeniu Európskeho štatistického systému.

  Jean-Luc Mélenchon (GUE/NGL), par écrit. ‒ La proposition de la Commission à l'examen vise à aligner le règlement du Parlement européen et du Conseil du 6 mai 2009 concernant les statistiques communautaires relatives au commerce extérieur avec les pays tiers aux dispositions contenues dans le traité de Lisbonne. Le texte délègue à la Commission le pouvoir d'adopter des actes en ce qui concerne: la liste des procédures douanières ou des destinations douanières admises ou l'exclusion de biens ou de mouvements des statistiques relatives au commerce extérieur. Les statistiques sont un enjeu politique qu'on ne peut laisser à la discrétion de la Commission, d'autant plus que ce sera sur la base de statistiques impartiales que nous mettrons en place le protectionnisme solidaire.   Louis Michel (ALDE), par écrit. – Déléguer des compétences d’exécution à la Commission, sous le contrôle de comités de représentants des États membres dans le cadre de la « comitologie », se justifie pour des raisons d’uniformité et existe depuis les années 1960. Toutefois, le traité de Lisbonne a introduit une réforme majeure en distinguant les actes d’exécution des actes délégués, mettant le Parlement européen sur un pied d’égalité avec le Conseil et la Commission, augmentant d’autant les pouvoirs du Parlement européen dans la sphère exécutive. Ainsi, le Parlement peut désormais faire pression sur la Commission et le Conseil en menaçant de bloquer une décision législative en codécision ou une décision budgétaire. Avec le traité de Lisbonne, le législateur dispose du droit d’opposition pour quelque motif que ce soit, et du droit de révoquer purement et simplement la délégation ou un acte individuel. Il s’agit là d’un outil de pression conséquent sur la Commission. Pour ma part, et dans le cadre de l’accord interinstitutionnel « Mieux légiférer », je soutiens une procédure de délégation qui permette au législateur de se concentrer sur l’essentiel, à condition que la compétence déléguée à la Commission soit bien encadrée et mise en application de manière tout à fait transparente.

  Miroslav Mikolášik (PPE), písomne – Lisabonská zmluva zaviedla niekoľko zmien, v rámci ktorých Komisia musela prispôsobiť pravidlá rozhodovania v obchodnej politike novému režimu delegovaných a vykonávacích aktov. Prostredníctvom súhrnného aktu pre obchod I. a II. bola väčšina právnych predpisov v oblasti spoločnej obchodnej politiky zosúladená, ďalšia konsolidácia je potrebná v oblasti legislatívnych aktov týkajúcich sa regulačného postupu s kontrolou. Jediným legislatívnym aktom v tejto oblasti je nariadenie (ES) č. 471/2009 o štatistike Spoločenstva. Prijatie medziinštitucionálnej dohody o lepšej tvorbe práva umožnilo dosiahnuť dohodu o tomto nariadení a poskytlo horizontálne riešenie v otázke konzultácie odborníkov členských štátov pri príprave delegovaných aktov. Dohoda bola schválená Výborom pre medzinárodný obchod (INTA), ako aj Radou, ktorej pozíciu podporujem svojím hlasom.

  Csaba Molnár (S&D), írásban. ‒ A Közösség harmadik országokkal folytatott külkereskedelmére vonatkozó statisztikáról szóló 471/2009/EK rendeletnek bizonyos intézkedések elfogadása érdekében a Bizottságra ruházandó felhatalmazáson alapuló és végrehajtási hatáskörök tekintetében történő módosításáról szóló európai parlamenti és tanácsi rendelet tervezetéről a Parlament 2014. március 12-én első olvasatban kialakította álláspontját. Az ezt követően megkezdett háromoldalú tárgyalásokat több fordulót követően felfüggesztették a jogalkotás minőségének javításáról szóló új intézményközi megállapodás elfogadásáig. E megállapodás 2015. decemberi elfogadását követően a Parlament és a Tanács tárgyalócsoportjai megállapodásra jutottak a kérdéses rendelet vonatkozásában.

A Tanács 2016. június 16-án fogadta el első olvasatbeli álláspontját, megerősítve a megállapodást. A Nemzetközi Kereskedelmi Bizottság jelentésében azt javasolja, hogy a Parlament értsen egyet a Tanács első olvasatban elfogadott álláspontjával, és ezzel a rendeletet a Tanács álláspontjának megfelelően emelje jogerőre. Ennek megfelelően szavaztam.

  Bernard Monot (ENF), par écrit. ‒ Le rapport propose des amendements à une proposition de règlement instaurant un système obligatoire de statistiques sur les prix du gaz et de l'électricité en secteur résidentiel. La suppression de la délégation à la commission (amendements 1, 3, 6) va dans le bon sens. Certaines idées du rapporteur plus souverainistes et plus pro-industrie ont cependant été mises de côté en commission ITRE. Aussi, la proposition de la Commission n'est pas souhaitable du fait d'un niveau de contrainte trop élevé pour les États et les entreprises et d'une délégation injustifiée à la Commission. Após várias rondas de trílogos, as negociações foram suspensas na pendência da adoção do novo Acordo Interinstitucional «Legislar melhor» que prevê, nomeadamente, uma solução horizontal no que se refere à consulta de peritos dos Estados-Membros aquando da preparação de atos delegados“.

Voto assim favoravelmente o acordo celebrado em primeira leitura com vista a continuar o processo de negociações com o Conselho para que se chegue a um entendimento profícuo e interessante para ambas as partes.

  Alessandra Mussolini (PPE), per iscritto. ‒ Mi sono espressa positivamente sulla relazione sulle Statistiche del commercio estero con i paesi terzi, in quanto, alla luce delle modifiche introdotte dal trattato di Lisbona e alla successiva adozione del regolamento (UE) n. 182/2011 sugli atti di esecuzione, la Commissione ha adeguato le regole decisionali in materia di politica commerciale al nuovo regime degli atti delegati e degli atti di esecuzione.

In particolare, la Commissione mira a modificare il regolamento 471/2009 inerente alle statistiche comunitarie relative al commercio estero con i paesi terzi, che rappresenta l'unico atto legislativo nel settore della politica commerciale comune che fa riferimento alla procedura di regolamentazione con controllo.

  Tonino Picula (S&D), napisan. ‒ Većina propisa u području zajedničke trgovinske politike usklađena je s novim ustavnim poretkom preko Združenih zakona o trgovini I i II te u nekoliko naknadnih pojedinačnih usklađivanja. Komisija je preuzela obvezu do kraja sedmog parlamentarnog saziva predstaviti sljedeći niz usklađivanja u okviru postupka komitologije za one zakonodavne akte za koje je predviđen regulatorni postupak s kontrolom.

Komisija je u tom smislu predložila izmjenu Uredbe (EZ) br. 471/2009 o statistici Zajednice, jedinom zakonodavnom aktu u području zajedničke trgovinske politike u kojem se navodi regulatorni postupak s kontrolom. Donošenje novog Međuinstitucijskog sporazuma u prosincu 2015. omogućilo je tako pregovaračkim timovima Parlamenta i Vijeća da postignu dogovor o predmetnoj uredbi.

Usuglašeni tekst predstavljen je 21. travnja 2016. odboru INTA na glasovanje o odobrenju i tada je odobren velikom većinom glasova. Predsjednik Odbora je na temelju izglasanog odobrenja istoga dana u dopisu predsjedniku Odbora stalnih predstavnika (COREPER) uputio preporuku da se na plenarnoj sjednici stajalište Vijeća potvrdi u prvom čitanju bez izmjena. Po pravnoj i jezičnoj provjeri Vijeće je 16. lipnja 2016. usvojilo svoje stajalište u prvom čitanju i time potvrdilo dogovor. U svjetlu gore navedenoga, podržavam stajalište izvjestitelja da se stajalište Vijeća u prvom čitanju odobri bez izmjena.

Así será posible crear estadísticas en terreno del comercio exterior.

Con la aprobación del «Better law Making» la aplicación se realizará con carácter horizontal, por lo que se permitirá la consulta a los expertos de los Estados miembros para preparar los actos delegados. Por todo ello, he votado a favor.

  Bronis Ropė (Verts/ALE), raštu. ‒ Balsavau dėl šio pranešimo. Dėl kurio Europos Parlamentas jau balsuoja antrą kartą. Pirmąjį kartą 2014 m. kovo 12 d. plenariniame posėdyje patvirtinus pranešimą, Italijai pirmininkaujant Tarybai buvo pradėtos neoficialios derybos tam, kad ankstyvu antrojo svarstymo etapu būtų galima pasiekti susitarimą.

Tačiau Tarpinstitucinio susitarimo dėl geresnės teisėkūros rengimo metu, trišalio dialogo derybos buvo sustabdytos. 2015 m. gruodžio mėn. šį naują Tarpinstitucinį susitarimą dėl geresnės teisėkūros priėmus, Parlamento ir Tarybos derybų grupėms buvo sudarytos sąlygos susitarti dėl šio reglamento.

  Fernando Ruas (PPE), por escrito. ‒ Votei de forma favorável a proposta de recomendação em segunda leitura do Parlamento Europeu referente à alteração do Regulamento n.º 471/2009 do Conselho relativo às estatísticas comunitárias do comércio externo com países terceiros.

Trata-se de uma alteração que surge na sequência das alterações introduzidas pelo Tratado de Lisboa e pelo Regulamento n.º 182/2011 sobre atos de execução em matéria de política comercial, ao abrigo da qual a Comissão Europeia se comprometeu a apresentar uma segunda fase de alinhamentos de comitologia - método de controlo dos países da UE sobre a forma como a Comissão Europeia aplica a legislação europeia.

Esse alinhamento implica a alteração ao Regulamento n.º 471/2009 sobre estatísticas comunitárias, já que constitui o único ato legislativo no domínio da política comercial comum que se refere ao procedimento de comitologia relativo a uma regulamentação com controlo.

A dificuldade na definição de um acordo nesta matéria prendeu-se com o atraso na adoção do novo Acordo Interinstitucional “Legislar Melhor”, que ocorreu em dezembro de 2015, entre as equipas de negociação do Parlamento e do Conselho, tendo posteriormente este Regulamento sido aprovado por larga maioria na Comissão de Comércio Internacional em abril de 2016.

Na základe zmien, ktoré priniesla Lisabonská zmluva, Komisia bola nútená navrhnúť zmeny nariadenia (ES) č. 471/2009 o štatistike Spoločenstva, ktoré je jediným legislatívnym aktom v oblasti spoločnej obchodnej politiky týkajúcej sa regulačného postupu s kontrolou. Nakoniec po veľmi zložitých rokovaniach a prijatím medziinštitucionálnej dohody o lepšej tvorbe práva v decembri 2015 sa dosiahla dohoda medzi Parlamentom a Radou o tomto nariadení.

  Monika Smolková (S&D), písomne ‒ Podporila som návrh legislatívneho uznesenia EP k pozícii Rady v prvom čítaní na účely prijatia nariadenia Európskeho parlamentu a Rady, ktorým sa mení nariadenie č. 471/2009 o štatistike Spoločenstva o zahraničnom obchode s nečlenskými krajinami, pokiaľ ide o prenesenie delegovaných a vykonávaných právomocí na Komisiu s cieľom prijať určité opatrenia. V súvislosti so zmenami, ktoré priniesla Lisabonská zmluva bola Komisia nútená prispôsobiť pravidlá rozhodovania v obchodnej politike novému režimu delegovaných a vykonávacích aktov. Preto v tejto súvislosti Komisia navrhla zmeny nariadenia č. 471/2009 o štatistike Spoločenstva, ktoré je jediným legislatívnym aktom v oblasti spoločnej obchodnej politiky týkajúci sa regulačného postupu s kontrolou. Po prijatí pozície Parlamentu v prvom čítaní v pléne 12. marca 2014 sa začali neformálne rokovania s cieľom dosiahnuť dohodu v druhom čítaní. Po niekoľkých kolách trialógov sa rokovania prerušili, ale prijatie Medziinštitucionálnej dohody o lepšej tvorbe práva v decembri 2015 umožnilo rokovacím tímom Parlamentu a Rady dosiahnuť dohodu o tomto nariadení. Text dohody bol schválený na výbore INTA, preto sme v pléne schválili pozíciu Rady v prvom čítaní bezo zmien.

  Dubravka Šuica (PPE), napisan. ‒ U svjetlu izmjena do kojih je došlo Ugovorom iz Lisabona, a zatim i donošenja Uredbe (EU) br.182/201, Komisija je pravila o donošenju odluka u trgovinskoj politici morala prilagoditi novom režimu provedbenih i delegiranih akata. Komisija je predložila izmjenu Uredbe (EZ) br. 471/2009 o statistici Zajednice, jedinom zakonodavnom aktu u području zajedničke trgovinske politike u kojem se navodi regulatorni postupak s kontrolom.

Donošenjem Međuinstitucijskog sporazuma u prosincu 2015. omogućeno je tako pregovaračkim timovima Parlamenta i Vijeća da postignu dogovor o predmetnoj uredbi. Po pravnoj i jezičnoj provjeri Vijeće je 16. lipnja 2016. usvojilo svoje stajalište u prvom čitanju.

Podržavam preporuku za drugo čitanje o stajalištu Vijeća u prvom čitanju radi donošenja uredbe Europskog parlamenta i Vijeća o izmjeni Uredbe (EZ) br. 471/2009 o statistici Zajednice u vezi s vanjskom trgovinom sa zemljama nečlanicama u vezi s dodjelom delegiranih i provedbenih ovlasti Komisiji radi donošenja određenih mjera.

  Pavel Svoboda (PPE), písemně. ‒ Hlasoval jsem pro vyslovení souhlasu ze strany Evropského parlamentu s postojem Rady, pokud jde o nařízení Evropského parlamentu a Rady, kterým se mění nařízení Rady (ES) č. 471/2009 o statistice Společenství týkající se zahraničního obchodu se třetími zeměmi, pokud jde o svěření přenesených a prováděcích pravomocí Komisi pro účely přijímání některých opatření, protože je potřeba přizpůsobit pravidla pro rozhodovací postupy v obchodní politice novému režimu aktů v přenesené pravomoci a prováděcích aktů. Komise se tedy zavázala, že do konce 7. volebního období předloží druhou vlnu přizpůsobení postupu projednávání ve výborech týkající se právních aktů odkazujících na regulativní postup s kontrolou a navrhla změnu nařízení o statistice Společenství. K projednávání dochází až nyní, jelikož nové znění nyní již reflektuje také nově uzavřenou interinstitucionální dohodu o zlepšení tvorby právních předpisů.

A jogszabálytervezet tükrözi a Lisszaboni Szerződés nyomán előállt intézményi változások, valamint a jogszabályalkotás minősége javításának (’Better Law-making’) követelménye által szükségessé vált, a komitológiai szabályokat érintő módosításokat, az Unió nemzetközi kereskedelemre, valamint statisztikai adatszolgáltatása vonatkozó kompetenciája alapján.

This file aligns the previous comitology regime to the post-Lisbon Treaty rules on delegated and implementing acts in order to enable the systematic production of Community statistics in the field of external trade. The final compromise involves a mix of delegated acts, implementing acts, and also moving certain issues to the basic legislative act, a compromise that balanced the interests of the co-legislators. The text adopted in the Council is in accordance with the compromise reached with Parliament. I therefore support this report.

Des négociations informelles ont débuté sous la présidence italienne, à la suite de l'adoption de la position du Parlement en plénière et en première lecture le 12 mars 2014, en vue de parvenir rapidement à un accord en deuxième lecture. Après plusieurs cycles de trilogue, les négociations ont été suspendues dans l'attente du nouvel accord interinstitutionnel "Mieux légiférer" qui prévoit, entre autres, une solution horizontale pour la consultation des experts des États membres lors de la préparation des actes délégués.

L'adoption du nouvel accord interinstitutionnel "Mieux légiférer" en décembre 2015 a ainsi permis aux équipes de négociateurs du Parlement et du Conseil de trouver un accord sur le règlement à l'examen.

Le texte de l'accord a été présenté à la commission INTA pour être soumis à un vote d'approbation, le 21 avril 2016, et a été approuvé à une très grande majorité. Compte tenu de ce résultat, le président de la commission a recommandé au Parlement en séance plénière de voter pour.

I voted in favour of the regulation on Statistics relating to external trade with non-member countries, as this will allow the newly negotiated decision-making rules to finally be adopted. In fact, negotiations regarding these new rules had been suspended while waiting for the Inter-institutional Agreement on Better Law-making to be adopted in 2015, which provides among other things for a horizontal solution regarding the consultation of Member States’ experts in preparation of delegated acts.

  Ruža Tomašić (ECR), napisan. ‒ Slažem se s promjenom uredbe o statistici Zajednice u vezi s vanjskom trgovinom sa zemljama nečlanicama u vezi s dodjelom delegiranih i provedbenih ovlasti Komisiji radi donošenja određenih mjera jer smatram da Komisija treba prilagoditi pravila o donošenju odluka u trgovinskoj politici novom režimu provedbenih i delegiranih akata.

Većina propisa koji se odnose na zajedničku trgovinsku politiku usklađeni su s novim sustavnim poretkom. S obzirom da Komisija pri pripremi i izradi delegiranih akata treba osigurati da se njima ne nameće dodatni administrativni teret državama članicama i njihovim predstavnicima, glasovala sam pozitivno.

La adopción del nuevo Acuerdo interinstitucional «Legislar mejor» en diciembre de 2015, permitió que los equipos negociadores del Parlamento y el Consejo alcanzaran un acuerdo sobre el Reglamento en cuestión.

  Ivo Vajgl (ALDE), in writing. ‒ I voted in favour of the recommendation for second reading on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council amending Regulation (EC) No 471/2009 on Community statistics relating to external trade with non-member countries as regards the conferral of delegated and implementing powers on the Commission for the adoption of certain measures. In the light of the changes brought about by the Lisbon Treaty and by the subsequent adoption of Regulation (EU) No 182/2011 (on implementing acts), the Commission was required to adapt the decision making rules in trade policy to the new regime of delegated and implementing acts. The Commission committed itself to come up with the second wave of comitology alignments – concerning legislative acts containing the regulatory procedure with scrutiny – by the end of the 7th legislature. The agreed text was presented to the Committee on International Trade (INTA) for a vote of approval on 21 April 2016, and was approved by an overwhelming majority.

  Hilde Vautmans (ALDE), schriftelijk. ‒ Ik stemde voor deze aanbeveling. Het gaat om institutionele aanpassingen op het gebied van de bevoegdheid Handel van de Europese Commissie. In het licht van de veranderingen als gevolg van het Verdrag van Lissabon was de Commissie verplicht om de besluitvormingsregels inzake handelsbeleid aan te passen aan het nieuwe stelsel van gedelegeerde en uitvoeringshandelingen.

  Miguel Viegas (GUE/NGL), por escrito. ‒ Na sequência da aprovação da posição do Parlamento em primeira leitura, na sessão plenária de 12 de março de 2014, tiveram início negociações informais com a Presidência italiana, tendo em vista chegar rapidamente a um acordo em segunda leitura.

Após várias rondas de trílogos, as negociações foram suspensas na pendência da adoção do novo Acordo Interinstitucional «Legislar melhor», que prevê, nomeadamente, uma solução horizontal no que se refere à consulta de peritos dos Estados-Membros aquando da preparação de atos delegados.

  Iuliu Winkler (PPE), în scris. ‒ Am votat recomandarea PE referitoare la poziția Consiliului în vederea adoptării unui regulament al PE și al Consiliului privind statisticile comunitare referitoare la comerțul exterior cu țările terțe în ceea ce privește acordarea de competențe delegate și de executare. Recomandarea PE vine ca urmare a modificărilor aduse de Tratatul de la Lisabona, Comisiei solicitându-i-se să-și adapteze normele de adoptare a deciziilor din cadrul politicii comerciale la noul regim al actelor delegate și al actelor de punere în aplicare. Adoptarea noului Acord interinstituțional privind o mai bună legiferare a permis, astfel, echipelor de negociere ale Parlamentului și Consiliului să ajungă la un acord cu privire la regulamentul respectiv.

  Pablo Zalba Bidegain (PPE), por escrito. ‒ He votado a favor de este informe ya que se trata simplemente de adaptarnos a nuestro nuevo marco jurídico. Era necesario adaptar las normas de toma de decisiones en materia de política comercial al nuevo régimen de actos delegados y de ejecución.

  Milan Zver (PPE), pisno. ‒ Komisija je morala zaradi sprememb, ki jih je uvedla Lizbonska pogodba, in posledično sprejetja Uredbe (EU) št. 182/2011 (o izvedbenih aktih) prilagoditi pravila o sprejemanju odločitev v trgovinski politiki novemu režimu delegiranih in izvedbenih aktov.

Komisija se je zavezala, da bo do konca 7. zakonodajnega obdobja pripravila drugi val uskladitev s postopkom komitologije v zvezi z zakonodajnimi akti, ki vsebujejo regulativni postopek s pregledom. V okviru tega je Komisija predlagala spremembo Uredbe (ES) št. 471/2009 o statistiki Skupnosti, ki je edini zakonodajni akt na področju skupne trgovinske politike, ki se nanaša na regulativni postopek s pregledom.

V skladu z navedenim sem podprl Priporočilo za drugo obravnavo o stališču Sveta v prvi obravnavi z namenom sprejetja Uredbe Evropskega parlamenta in Sveta o spremembi Uredbe (ES) št. 471/2009 o statistiki Skupnosti o zunanji trgovini z državami nečlanicami v zvezi s podelitvijo delegiranih in izvedbenih pooblastil Komisiji za sprejetje nekaterih ukrepov.
