  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die Aussprache über

  Axel Voss, stellvertr. Verfasser. – Herr Präsident, sehr geehrte Frau Kommissarin Jourová, sehr geehrter Herr Vertreter des Rates! Ich danke Ihnen beiden, dass Sie heute hier anwesend sind. Seit 2013 werden Eurojust und die Europäische Staatsanwaltschaft im Rat verhandelt, und zu beiden konnte bislang keine allgemeine Ausrichtung erzielt werden. Die slowakische Ratspräsidentschaft ist sehr ambitioniert und hat angekündigt, bei der Europäischen Staatsanwaltschaft auch entscheidende Schritte zu tätigen, sodass die Europäische Staatsanwaltschaft auch in den Haupttagesordnungspunkt des JI-Rates in der kommenden Woche darstellt. Es sieht so aus, als ob sich das Dossier der Europäischen Staatsanwaltschaft auf der Zielgeraden befindet, und auch Frau Kommissarin Jourová hat ja mehrfach wiederholt, dass die Europäische Staatsanwaltschaft von absoluter Priorität für sie sei.

Wir als Parlament haben aber noch sehr viele offene Fragen und freuen uns, dass wir uns heute Abend diese Zeit für diese gemeinsame Aussprache nehmen. Ich möchte die Kollegin Frau Matera entschuldigen, da sie heute leider nicht hier sein kann. Sie in ihrer Kapazität als Berichterstatterin für die Europäische Staatsanwaltschaft, und ich in meiner Funktion als Berichterstatter für Eurojust haben nun zusammen mit S&D, ALDE und den Grünen auch an einem gemeinsamen Entschließungsantrag gearbeitet, und hierzu sprechen wir uns fraktionsübergreifend und gemeinschaftlich für folgende Punkte aus: Wir befürworten die Europäische Staatsanwaltschaft und auch die Errichtung der Europäischen Staatsanwaltschaft. Wir fordern den Rat auf, die Kompetenzen der Europäische Staatsanwaltschaft zu erläutern – sowohl die Ermittlungs- als auch die Anklagekompetenzen. Wir bedauern, dass bei Kompetenzstreitigkeiten zwischen Europäischer Staatsanwaltschaft und den einzelstaatlichen Strafverfolgungsbehörden die endgültige Entscheidung nicht bei einem unabhängigen Gericht wie dem Gerichtshof der Europäischen Union liegt. Wir sprechen uns für die Unabhängigkeit der Europäischen Staatsanwaltschaft aus und sprechen in diesem Zusammenhang auch die Rechtshilfe sowie den Zugang zu Informationen an. Wir fordern den Rat auf, die Verhandlung zur PIF-Richtlinie zu beenden. In diesem Zusammenhang wollen wir auch die Aufnahme des Mehrwertsteuerbetrugs in den Anwendungsbereich der PIF-Richtlinie haben.

Gleichermaßen fordern wir die Kommission auf, eine Einschätzung abzugeben, inwiefern sich die kollegiale Struktur einer Staatsanwaltschaft auf Eurojust auswirken wird. Wir unterstreichen die Rolle und Wichtigkeit von Eurojust, und wir fordern den Rat auf, die Beziehung zwischen der Staatsanwaltschaft Eurojust und dem OLAF auch eindeutig zu regeln. Schlussendlich sprechen wir uns auch dafür aus, dass Eurojust und die Staatsanwaltschaft von einem Standort aus operieren sollen.

Organisierte Kriminalität kennt keine Grenzen, und organisierte Gruppen und Terroristen agieren global. Aber auch Delikte, die den EU-Haushalt betreffen, sind grenzübergreifend. Und grenzübergreifender Betrug wie Mehrwertsteuerkarussellbetrug, aber auch jede Form des Betrugs gegenüber dem EU—Haushalt ist auch ein Betrug an unseren Bürgerinnen und Bürgern. Deswegen appellieren wir an den Rat, die Verhandlungen insbesondere zu der Europäische Staatsanwaltschaft entscheidend voranzutreiben.

Dennoch gibt es für uns eine Menge ungeklärter Fragen. Die kollegiale Struktur der Europäischen Staatsanwaltschaft ist nach meiner Auffassung vollkommen übertrieben und nach meinem Verständnis eigentlich auch nicht das, was der Gesetzgeber in Artikel 86 des Vertrages wollte. Wie stellt sich der Rat das System vom Europäischen Staatsanwalt und den 28 Vertretern vor? Wer soll das alles zahlen? Woher kommen diese Gelder? Ist das tatsächlich so notwendig? Und kreieren wir damit nicht ein Gremium, welches in seiner Struktur Eurojust ähnelt, sich aber in der Realität nur einer Kompetenz widmet, nämlich dem Betrug gegenüber dem EU-Haushalt?

Das ist eine wichtige Aufgabe, die auch die Verträge mit Artikel 86 fordern. Dennoch sollten wir hier auch die Kirche im Dorf lassen – das wäre ja gerade so, als ob wir hier im Europäischen Parlament auch 28 Stellvertreter unseres Parlamentspräsidenten hätten, was dann wie eine Kommission wäre, und das wird eben ein sehr teures Unterfangen.

Ich will auch gar nicht die Wichtigkeit der schnellen Schaffung der Europäischen Staatsanwaltschaft unterminieren. Nur muss man auch sehen, dass wir nicht etwas erreichen sollten, was zusätzliche Bürokratie oder nicht notwendige Bürokratie schafft. Deswegen sollten auch die Staatsanwaltschaft und Eurojust an einem Ort und unter einem Dach operieren, und so ist es wohl auch der Wille des Gesetzgebers in Artikel 86.

Eurojust hat steigende Fallzahlen zu vermerken – Cyberkriminalität, Terrorismus, Migrationskrise –, und gleichzeitig sollen aber Stellen gestrichen werden oder auch der Haushalt schrumpfen. Das passt eigentlich nicht zu den derzeitigen Anforderungen.

Welche genauen Auswirkungen sind nun für Eurojust zu erwarten? Welche finanziellen Auswirkungen hat die Entstehung der Staatsanwaltschaft auf Eurojust? Was bedeutet das für das Personal? Wie viele Stellen sollen gestrichen werden? Was bedeutet das für die Infrastruktur? Wie soll sich die operationelle Zusammenarbeit zwischen Eurojust und Staatsanwaltschaft gestalten? Und worauf ich eigentlich besonders Wert lege: Dass wir ein ganz klares Verfahren haben werden – und keine doppelten Strukturen oder Kompetenzen in der Zusammenarbeit mit der Europäischen Staatsanwaltschaft nämlich mit Eurojust und mit Europol.

Was soll in diesem Zusammenhang mit dem OLAF werden? Wie soll die Zusammenarbeit mit den nationalen Staatsanwaltschaften verlaufen? Wie soll die Zusammenarbeit mit den nationalen Steuerbehörden gestaltet werden? Wie sind die Strafverfolgungsbefugnisse, wenn der Täter oder die Täter mehrere Verbrechen zu unterschiedlichen Zeiten begehen? Und wie sind die Befugnisse, wenn die gleiche Handlungen mehrere Straftatbestände zugleich erfüllt? Und wie gehen wir damit dann um?

  Ivan Korčok, President-in-Office of the Council. – Mr President, the author of the question rightly reminds us that this proposal has been on the table for quite some time, for three years exactly. I remember when it was placed under the leadership of Madam Reding. It is no surprise that this has been on the table for some time, given the sensitivity of this proposal, because in fact the regulation deals with many complex issues which lie at the heart of the criminal law systems of the Member States.

Let me update you on the state of play of our work. After very intensive and constructive work, we have now reached a point where the Member States agree on most of the provisions in the draft Regulation, and it looks possible that negotiations in Council can be concluded in the near future. The Presidency is treating the discussions with the highest priority with the objective of closing the file by the end of the year. In this context, we are ready to work – let me underscore this –very closely with Parliament.

Let me briefly mention one issue that has been raised in earlier contacts with Parliament and which is very important for all of us, namely the need to ensure that the Office is both independent and efficient. Let me explain in more detail: the current structure of the Office builds on the idea that the College Member of a given Member State will be in charge of investigations and prosecutions in his or her Member State of origin, and will supervise them. This organisation has been chosen mainly for practical reasons, in particular with a view to ensuring the efficiency of the Office.

The legal systems and cultures of the Member States still vary to a considerable degree, and it is clear that only a prosecutor with his or her background in a given legal system will be able to know exactly what actions are most appropriate and efficient in that given state.

I can assure you that the Council wishes to ensure that there is no ambiguity on these issues. The Council remains convinced that the structure proposed in the current text fully ensures the independence of each European Prosecutor and of the Office as such. I also believe that the current Council text is, by and large, in line with the main wishes and expectations of Parliament.

A detailed picture of the state of play on the draft European Public Prosecutor’s Office (EPPO) regulation, containing all the provisions of the regulation that ministers have preliminarily agreed upon, is freely accessible. This draft should be very close to final outcome. However the documents still do not include a number of provisions: on judicial review, cooperation between the EPPO and Eurojust and relations with third countries. These provisions will be included in a new consolidated version, which will hopefully be completed in the coming weeks. The main task of the Presidency is now to ensure that outstanding reservations are resolved and that the few remaining gaps in the text are filled. In other words, the Council is relatively close to an agreement on the full text.

As noted in your question, it is also clear that the EPPO regulation must be made coherent with the Eurojust regulation and with the directive on the protection of the Union’s financial interests or ‘PIF directive’. The Council adopted its general approach on the Eurojust regulation in March last year and is ready to start negotiations with Parliament at any time. Certain provisions need to be coordinated with the EPPO regulation, but we do not foresee major difficulties.

The Council agrees with the Committee on Civil Liberties, Justice and Home Affairs (LIBE) that it would be useful to ensure that the PIF directive is adopted before or at least around the time of adoption of the regulation. The negotiations on the PIF directive have been on hold since last year, but I am confident that the Council and Parliament will find a compromise solution in the near future.

As regards the financial analysis, the Commission is studying this important but complex issue, and it is likely that the Commissioner is better placed to reply to this question. From the point of view of the Council, I would like to underline that it is generally agreed that Eurojust must continue to have sufficient resources to fulfil its tasks in an efficient manner. The EPPO regulation should, for this reason, a priori not have any significant impact on the Eurojust budget.

Finally, the exact nature of the operational, organisational and administrative links between the EPPO and Eurojust is one of the last issues which are still under discussion in the Council. The Council is working on a model according to which the EPPO may rely on the support and resources of the administration of Eurojust, and where Eurojust will provide certain services to the EPPO. Whether there is a need to define these services, or if this could be left to the two bodies, is still under discussion.

It is thus still too early to give a detailed account of the links between the EPPO and Eurojust. We will come back to you with a more precise reply in the coming months. Let me however assure you that our aim is to ensure that the bodies complement each other, and that there is no duplication of work. The creation of the EPPO must not lead to any weakening of Eurojust.

  Věra Jourová, Member of the Commission. – Mr President, honourable Members, as we all know, we face some crucial challenges in Europe in the area of security, but also regarding our prosperity.

We have a problem because crime does not know borders, as Mr Voss said before. This goes for big scope crime against EU money, including big cross—border VAT fraud. Crime is harming our economies and decreasing taxpayers’ trust. It is our duty to fight against this crime, which can be done only by joining forces. I am speaking about a pan-European issue that cannot be resolved by national authorities only. As you may know, Eurojust and OLAF are not equipped to lead criminal investigations and prosecutions, and national authorities are facing limits in addressing fraud cases, either for political or resources reasons. That is why I see the European Public Prosecutor as a specialised body dealing with financial crime in the EU, having the necessary competence to investigate and prosecute. We need a European Public Prosecutor to deal with the alleged fraud cases we all read about in some cohesion countries, but we also need it to tackle the big VAT fraud cases, especially in the cross-border context – our very conservative estimation is around EUR 50 billion in revenues lost every year due to VAT fraud, and the real figure is probably much higher. We need an effective answer to these negative impacts on the EU budget, but also on national budgets.

So, where are we on this? I know, replying to questions one and two, we are – as you also heard from the Presidency – in the final stages of our negotiations, and the Commission fully supports the efforts of the Slovak Presidency to achieve a political deal on this by the end of this year. We are hopeful that the Council will be able to finalise the remaining chapters of the proposal for a regulation on the establishment of the EPPO, in particular the provisions on the judicial control of the Office and on relations with third countries and international organisations, with non-participating Member States and relations with Eurojust, in October. Provisions with respect to staff matters relating to the setting—up of the EPPO would also need to be added. At the Justice and Home Affairs Council on 14 October, the Slovak Presidency will present a complete consolidated text to seek the conceptual support of the Council on the revised provisions.

From the perspective of the Commission, the current Council text should still be improved on several points. Two should be highlighted in particular at this stage. The first one relates to competence. The priority competence of the EPPO on cases of fraud affecting the Union’s financial interests demands that the EPPO have access to information on all PIF cases. The EPPO needs to have competence to fight at least serious cross-border VAT fraud. Also, the rules on ancillary competence must not lead to a restriction of the EPPO’s core competence in the PIF area.

The second point is on efficiency, because the efficiency of the EPPO requires a flexible mechanism to redistribute work at central level between the European prosecutors, even if the general principle that European prosecutors supervise cases being handled in their respective Member States is maintained. As already stated on numerous previous occasions, the EPPO can only be launched with confidence if we streamline the rules concerning its competence, and strengthen the guarantees of independence, as well as the provisions on procedural rights. In addition, given that its material competence is defined by reference to the PIF Directive, finalising the directive is essential for setting up the EPPO.

Now let me reply to questions three and four. The EPPO, as a specialised body for financial crime, is to be seen as part of our overall structure in the European Union to combat crime effectively. Since Eurojust will no longer work on financial crimes against the EU budget (so-called ‘PIF cases’), it will be able to focus on the fight against terrorist threats or other crimes such as trafficking, drugs, and in our cooperation with neighbouring countries. In accordance with Article 31 of the Financial Regulation, the Commission’s services undertook an analysis of the financial impact of the changed EPPO structure and competence following the Council compromises. This paper, with initial working estimates, will be shared with you in parallel with Ministers, at the Justice and Home Affairs Council on 14 October. This estimate also takes into account the synergies and the future relationship between the EPPO and Eurojust. The Council model chosen for the EPPO, based on governance by a College, will create the need for new posts in the EPPO’s central office, but as a result of the EPPO’s shared, rather than exclusive, competence it will overall lead to a reduction of posts at central level when compared to the original Commission proposal. This will have an impact on costs. The cost implications of European delegated prosecutors (so-called EDPs) are still under discussion. It depends on how many EDPs will be appointed by the Member States.

As regards benefits, the Commission expects that the inclusion of VAT fraud into the EPPO’s competence will bring considerable benefits in comparison to today’s situation where especially large intra-Community VAT fraud cases often remain undetected or are not followed up effectively.

As regards the involvement of national parliaments, the Council supports the approach proposed by the Commission whereby the European Chief Prosecutor or one of the deputies may be requested to appear before national parliaments to give account of the general activities of the EPPO. Such appearances should be without prejudice to the EPPO’s obligation of discretion and confidentiality as regards individual cases and personal data.

Axel Voss raised a lot of other questions here, and I can confirm what you also heard from the Minister that we are ready to come back between October and December, when we will go through a decisive period for the final version of EPPO and reply to all your questions, both regarding the text and regarding the relation between the EPPO, Eurojust and OLAF, and all the other practical matters, especially the financial conditions. I only wanted to declare here today that we are working on the cost—benefit conditions for the EPPO, with full regard and full respect to the value of money, which means that we need to do the right thing, to do it in the right way, and to do it for the least possible money. So this is our aim, and that is also why we are working now on a very precise financial analysis.

As for Eurojust, I am not someone who would like to establish a new body for combating serious crime in Europe by devastating the other one. I see the clear picture of combating crime in Europe, standing on three very strong legs: one is OLAF, which has to continue its work; the second is Eurojust, which should focus more on crimes other than financial crime; and the third is the EPPO, with full prosecuting competence. I believe that for the near future, from 2019 we will be able to do this reorganisation so that we will be able at European level to address all of the serious crime which the Member States cannot investigate and prosecute efficiently. It is all about this. We are not replacing here the prosecution at national level; we are setting up a layer above it so that we are jointly more successful.

Finally, let me thank Madam Viviane Reding, who is the mother of the proposal, for giving me the chance to continue what she started. I can only declare here that I will try to be a good stepmother to this proposal and I will do my best to push it to a successful result.

  Sylvia-Yvonne Kaufmann, im Namen der S&D-Fraktion. – Herr Präsident! Irgendwie komme ich mir vor wie in dem Film „Und täglich grüßt das Murmeltier“. Warum? Weil die Kommission jedes Jahr aufs Neue in ihrem Bericht zum Schutz der finanziellen Interessen der EU dasselbe feststellt, nämlich dass die nationalen Behörden nur in begrenztem Umfang Verdachtsfälle zulasten des EU-Haushalts verfolgen, die ihnen vom OLAF übermittelt wurden. Es ist nicht hinnehmbar, dass diese Straftaten nur unzureichend aufgeklärt werden und Betrüger nicht vor Gericht landen. Von daher ist es richtig, eine Europäische Staatsanwaltschaft zu schaffen.

Doch für die Verhandlungen im Rat zu diesem europäischen Projekt kann es kein Freifahrschein geben. Die Europäische Staatsanwaltschaft ergibt nur Sinn, wenn sie einen echten Mehrwert für den Schutz europäischer Steuergelder bedeutet. Ich möchte drei Punkte nennen, die sichergestellt werden müssen: Erstens – das spielte auch hier eine Rolle – gibt es einen untrennbaren Zusammenhang zwischen der sogenannten PIF—Richtlinie und der Europäischen Staatsanwaltschaft. Bei der PIF—Richtlinie muss festgelegt werden, bei welchen Straftaten die Behörden ermitteln und anklagen können. Mehrwertsteuerbetrug muss auf jeden Fall dabei sein.

Zweitens muss Effizienz gesichert sein, und hier muss die Arbeitsteilung mit den nationalen Behörden klar geregelt werden. Drittens muss die Unabhängigkeit der Europäischen Staatsanwaltschaft sichergestellt sein. Hierauf ist besonders zu achten – gerade mit Blick auf die vorgesehene automatische Verbindung eines Europäischen Staatsanwalts zu Fällen aus seinem eigenen Herkunftsland.

Nur wenn diese und weitere Punkte erfüllt sind, können wir am Ende Ja sagen zu einer europäischen Lösung, die europäische Steuergelder wirksam schützt.

  Helga Stevens, namens de ECR-Fractie. – Uiteraard ben ik voorstander van effectieve fraudebestrijding en een betere besteding van overheidsmiddelen. Fraude moet onderzocht worden met volledige medewerking van alle lidstaten.

De oprichting van het Europees Openbaar Ministerie, het EPPO, is echter geen juiste oplossing. Naast het OLAF, dat nu verantwoordelijk is voor de bestrijding van administratieve fraude, hebben we Eurojust. Dit agentschap, dat instaat voor de gerechtelijke samenwerking, moet volgens artikel 86 van het Verdrag betreffende de werking van de Europese Unie bovendien de basis vormen voor het EPPO.

Naast de overbodige oprichting van een derde agentschap, is er ook de kwestie van de bevoegdheidsafbakening. Het EPPO is bevoegd voor de in de PIF-richtlijn vermelde misdrijven, maar die richtlijn is nog maar een ontwerp van wet.

Als de invalshoek en timing van het Commissievoorstel volledig verkeerd zitten, zijn we niet goed bezig. Commissaris Jourová, doe gewoon het werk opnieuw, en deze keer goed.

  Nathalie Griesbeck, au nom du groupe ALDE. – Monsieur le Président, il y a 40 ans, est née l'idée de créer un parquet européen. 40 ans plus tard, et depuis 2013, une proposition législative est sur la table. Aujourd'hui, après trois années de négociations entre les États avec le Conseil, que reste-t-il au fond? Trois ou quatre points.

En premier lieu, nous voulions un parquet européen compétent pour la grande criminalité transfrontalière, les crimes transnationaux, les affaires transnationales de terrorisme, puisque si les criminels et les crimes n'ont pas de frontières, nos enquêtes et nos poursuites pénales ne doivent pas en avoir non plus. C'est l'adage populaire: il faut que les gendarmes aient au moins les mêmes armes que les voleurs. Que reste-t-il?

Premièrement, un parquet européen qui ne sera compétent que pour la protection des intérêts financiers de l'Union. C'est vrai que, dans le contexte actuel, avec l'augmentation de la grande criminalité organisée et des réseaux criminels, c'était le moment de limiter les compétences d'un tel parquet. Deuxièmement, un parquet européen, qui plus est, limité au sein même de cette compétence de lutte contre la fraude aux intérêts financiers de l'Union puisque le Conseil a introduit des seuils limitatifs. Ainsi, dans le cas d'un cofinancement, si l'Union n'apporte pas plus de 50 % de la somme investie, le parquet ne sera pas compétent. Or, chacun sait, et spécialement dans les institutions européennes, que l'Union finance la plupart du temps des projets à moins de 50 %. Troisièmement, un parquet européen non compétent lorsque la fraude est liée à une autre forme de criminalité, telle que la traite ou encore le blanchiment d'argent. Quatrièmement, un parquet européen non compétent sur la fraude à la TVA – Madame la Commissaire, vous en avez rappelé le principe et vous avez rappelé le manque à gagner estimatif que cela représente –, puisque le Conseil refuse d'intégrer la TVA dans la directive sur la protection des intérêts financiers de l'Union. Or, il s'agit là d'une fraude transfrontalière par excellence.

En deuxième lieu, et c'est une évidence, nous voulons un parquet européen indépendant qui puisse mener ses enquêtes et ses investigations en toute indépendance par rapport aux intérêts nationaux. Que reste-t-il, là aussi? Un parquet européen dont la structure sera décentralisée, un parquet à l'organisation complexe ligoté par l'omniprésence du lien national, un parquet qui ne sera pas compétent en dernier ressort, puisqu'en cas de conflits de répartition de compétences entre une autorité nationale et le parquet, c'est l'autorité nationale qui décidera en dernier ressort.

Madame la Commissaire, le résultat des négociations au sein du Conseil est tout simplement inquiétant. Le Conseil a décortiqué la proposition initiale et l'a vidée de son sens, celle d'un parquet européen qui soit fort, ambitieux, efficace et, surtout, indépendant. Nous sommes nombreux à nous interroger au sein de cette maison sur la plus-value de ce parquet. Les chapitres sur les compétences devraient absolument être rouverts.

Sachez, pour conclure, que l'approbation du Parlement sur le parquet n'est pas une chose acquise. Oui, nous sommes pour la mise en place d'un parquet européen, mais pas à n'importe quel prix.

  Jan Philipp Albrecht, im Namen der Verts/ALE-Fraktion. – Herr Präsident, Frau Kommissarin, Herr Minister, werte Kollegen! Vor etwa sieben Jahren hat der Vertrag von Lissabon zum ersten Mal eine Rechtsgrundlage für die Schaffung einer europäischen Staatsanwaltschaft vorgesehen. Seither sind viele Jahre vergangen – wir haben es eben auch gehört –, viele Jahre der Verhandlung.

Wir haben hier im Haus einen Sonderausschuss zur Bekämpfung der organisierten Kriminalität, der Geldwäsche und der Korruption gehabt, in dem mehr als deutlich geworden ist, wie wichtig es ist, dass in diesen Straftaten von einer unabhängigen Europäischen Staatsanwaltschaft grenzübergreifend ermittelt wird, und deswegen ist es gut, dass die Präsidentschaft das jetzt in die Hand nimmt und wir offenbar auf den letzten Metern sind, zu einer Einigung zu kommen.

Aber es gibt noch ein paar offene Fragen, und ich möchte einige dazugeben: Wieviele Mitgliedstaaten werden am Ende dabei sein? Denn es wird darauf ankommen, dass möglichst viele Mitgliedstaaten tatsächlich bei dieser Europäischen Staatsanwaltschaft mitmachen. Es kann nicht sein, dass alle Mitgliedstaaten in jüngster Zeit immer wieder nach Kooperationen und Koordination rufen, aber am Ende niemand durch eine solche gemeinsame Staatsanwaltschaft koordiniert werden will. Das muss klar gemacht werden, und da müssen wir auch ein bisschen Nachdruck hinter geben, dass alle dabei sind.

Und wie weit geht der Anwendungsbereich? Ich glaube es ist hier klar geworden: Das Europäische Parlament steht klar dafür, dass die großen Betrugsvorgänge mit Mehrwertsteuer mit in den Anwendungsbereich einbezogen werden. Ich glaube, es ist wichtig, dass das jetzt auch nochmal geregelt wird.

Und ganz zuletzt ist es wichtig, dass wir weitermachen bei der Schaffung von gemeinsamen Mindeststandards im Strafverfahren. Denn auch in der Zusammenarbeit mit den nationalen Strafverfolgungsbehörden brauchen wir gemeinsam Verfahrensstandards.

  Gerard Batten, on behalf of the EFDD Group. – Mr President, this resolution calls for the Commission to get on with the job of installing the European Public Prosecutor. The UK supposedly has an opt-out from the jurisdiction of the Public Prosecutor, but this is effectively worthless. The Prosecutor could easily bypass the UK’s opt—out by using the legal instruments and institutions that the UK has already subjected itself to through the auspices of the Member States. Unsurprisingly enough, that brings me onto the subject of Brexit. When the UK leaves the EU, we must repeal all the legal instruments we have enacted, such as the European Arrest Warrant, and withdraw from legal institutions such as Eurojust. We must replace them with genuine cooperative measures such as those that existed before, for example the European Convention on Extradition and Interpol – but all suitably revised, of course, to ensure that the protection of the rights of British citizens under our own law is the priority.

  Gilles Lebreton, au nom du groupe ENF. – Monsieur le Président, l'idée de créer un parquet européen a tout juste vingt ans, mais elle a tellement suscité d'inquiétude qu'elle n'a pas abouti. La Commission de Bruxelles tente néanmoins, depuis 2013, d'en relancer le projet. De façon surprenante, la présidence slovaque vole aujourd'hui à son secours.

Je suis résolument hostile à la création d'un parquet européen. La justice pénale est, et doit rester, une prérogative des États. En France, elle est rendue au nom du peuple français. Cette conception s'oppose à ce qu'elle soit transférée, même partiellement, à un monstre bureaucratique et antidémocratique. En matière de justice pénale, c'est d'une simple coopération dont les États européens ont besoin, et non d'une intégration.

Comme moi, le Sénat français a d'ailleurs dénoncé ce projet qu'il juge trop centralisateur. Il estime, à juste titre, qu'il viole le principe de subsidiarité. Mais selon moi, le principe de subsidiarité est un leurre. Pour l'Union, comme le disait Philippe Séguin, ce n'est pas un principe juridique, mais un principe d'efficacité qu'elle instrumentalise pour faire ce qu'elle veut, quand elle veut. L'essentiel est dit, le reste est secondaire. Le reste, c'est la question parlementaire qui demande quand le parquet européen sera créé. Moi, j'ai une réponse qui correspond à mon vœu: jamais.

  Ingeborg Gräßle (PPE). – Herr Präsident, Frau Kommissarin, Herr Ratspräsident! Nur Mut! Ich möchte die slowakische Ratspräsidentschaft als Berichterstatterin zusammen mit dem Kollegen López Aguilar für die PIF-Richtlinie ausdrücklich ermutigen, zu einem Ende zu kommen. Seit Juli 2015 warten wir darauf, dass der Rat sich endlich auf etwas einigen kann. Nur Mut, wir zählen auf Sie! Wir brauchen dies. Wir brauchen endlich ein besseres Recht in dieser materiellen Domäne, und ich glaube, dass das, was auf dem Tisch liegt, sehr ausgewogen ist. Wir wollen, dass die Mehrwertsteuer – und das ist der eigentliche Knackpunkt – in den Anwendungsbereich der Richtlinie einbezogen wird. Fälle, die mindestens zwei Länder betreffen und bei denen mindestens 100 000 EUR Schaden entstanden sind oder auch wenn EU-Bedienstete oder Mitglieder der Institutionen betroffen sind.

Wir glauben, dass Europa einen Quantensprung vorwärtskommt, und wir sind Frau Kommissarin Jourová auch sehr verbunden, dass sie als „Stiefmutter“ dieses wichtige Dossier mit aufgreift und vorantreibt. Wir möchten Sie nachdrücklich ermutigen: Geben Sie diesem Europa einen wirklichen Mehrwert und hören Sie nicht auf die Ränder in diesem Parlament, die nicht wissen, was sie tun, und auch nicht wissen wovon sie reden. Das haben wir ja heute Abend auch wieder sehr eindrucksvoll gesehen. Wir brauchen den Europäischen Staatsanwalt, und wir brauchen eine vernünftige PIF-Richtlinie, weil wir nur so zu einer wirklichen Verbrechensbekämpfung kommen. Wir können nicht damit leben, dass das organisierte Verbrechen die Rechtslücken im Gemeinsamen Markt ausnutzt und weiter ausnutzt und gegen uns verwendet.

  Juan Fernando López Aguilar (S&D). – Señor Presidente, Ministro, Comisaria, lo ha dicho la colega Gräßle: por supuesto que apoyo la puesta en marcha de una Fiscalía Europea sobre la base legal del artículo 86 del Tratado de Funcionamiento de la Unión Europea.

La apoyé como ministro de Justicia del Gobierno de España y como presidente de la Comisión de Libertades, Justicia e Interior. Pero, previo y más urgente es todavía que este Parlamento actúe como legislador penal sobre la base del artículo 83, que es el que permite que el Parlamento pueda legislar penalmente contra los atentados transfronterizos a los intereses financieros de la Unión y, particularmente, el fraude del IVA, que importa cantidades billonarias, porque este es un paso previo al contenido que debe cumplir la Fiscalía Europea, y resulta que está bloqueado por el Consejo.

Yo pido a la Comisión que se comprometa, como guardiana de los Tratados, a llenar de contenido este papel del Parlamento Europeo como legislador penal; que desbloquee la Directiva de protección de intereses financieros de la Unión, porque ese es el primer paso para que la Fiscalía Europea pueda, con independencia y con un sistema de recursos adecuado y en cooperación con las jurisdicciones nacionales, hacer lo que tiene que hacer: primero, proteger los intereses financieros de la Unión con el desbloqueo de la Directiva PIF.

  Kazimierz Michał Ujazdowski (ECR). – Panie Przewodniczący! Skrajność jest wrogiem dobrego. Nie akceptuję tych głosów, które ponaglają prezydencję, żeby zbudowała prokuraturę scentralizowaną, nieufającą państwom. Właśnie potrzebujemy czasu, delikatności i wspólnej zgody w tej sprawie. Więc nie mogę w żadnym razie zgodzić się z tym, co mówili tutaj przedstawiciele grupy S&D i ALDE. Jeśli prokuratura powstanie, to właśnie jako struktura kolegialna i kooperująca z państwami. Dlatego chcę docenić wysiłek prezydencji w tej sferze.

Jest też oczywiście delikatna kwestia kształtu dyrektywy PIF. To nie jest oczywiste, że oszustwa związane z podatkiem VAT mają być w domenie europejskiej, tym bardziej że w 90 % przypadków to właśnie państwa są poszkodowane z powodu tych oszustw. W każdym razie apeluję o racjonalność i o zgodę z poczuciem wspólnego zaufania i aby dać czas prezydencji na dokończenie tej pracy.

U aħna għalhekk qegħdin insejħu lill-Kunsill biex jipprovdilna sett ta’ kompetenzi li huma ċari u li mhumiex ambigwi għal dan l-uffiċċju. Fl-istess ħin, aħna rridu niżguraw li r-relazzjonijiet bejn il-Eurojust u l-Olaf huma ċċarati ħalli nkunu nistgħu naraw id-differenzi ċari bejn ir-rwoli differenti ta’ dawn l-organizzazzjonijiet fil-protezzjoni tal-interessi finanzjarji tal-Unjoni Ewropea.   Inés Ayala Sender (S&D). – Señor Presidente, desde la experiencia, en la Comisión de Control Presupuestario llevamos tiempo reclamando la creación de esta Fiscalía Europea que me hubiese gustado que hubiera sido más fuerte, más europea y unívoca. Pero antes de seguir acumulando retrasos preferimos dar la bienvenida a este Reglamento que personifica un pilar fundamental para poder desarrollar la ley penal europea y hacer frente así a la criminalidad cada vez más transnacional y transfronteriza en todas sus formas.

Animamos al Consejo y a la Comisión a dotar a esta Fiscalía de verdaderos y suficientes medios para que este Reglamento no quede reducido, una vez más, a una capa añadida a las legislaciones y fiscalías nacionales, que seguirán pudiendo imponer límites y obstáculos.

Damos igualmente la bienvenida a la cooperación acrecentada con Eurojust, pero necesitamos y exigimos que el mandato de esta Fiscalía venga definido amplia y definitivamente en la Directiva PIF, que es el marco de garantías que da capacidad y participación al órgano democrático por antonomasia que es este Parlamento.

  Carlos Coelho (PPE). – Senhor Presidente, Senhor Presidente do Conselho, Senhora Comissária, este Parlamento há já muito tempo vem defendendo a necessidade de a União Europeia ter meios para sancionar crimes de natureza transfronteiriça, nomeadamente aqueles que atentem contra os interesses financeiros da União.

Só em 2014 perderam-se quase 160 mil milhões de euros em receitas de IVA. Estou certo de que a criação da Procuradoria Europeia é um desígnio que todos reconhecemos como desejável. Contudo, já diz a sabedoria popular que o diabo está nos detalhes. E aqui permanece o desacordo e a inércia quando necessitamos, pelo contrário, de uma ação rápida e de uma posição clara. Uma posição clara sobre as competências da Procuradoria. Uma posição clara sobre a relação com o Eurojust. Uma posição clara sobre a estrutura da Procuradoria que acautele as melhores práticas internacionais, como a sua independência. Uma posição clara sobre os direitos processuais. Uma posição clara sobre o controlo jurisdicional a que estaria sujeita.

Este Parlamento já tornou bem clara a sua posição e torna a fazê-lo através da resolução que iremos aprovar. Creio que a Procuradoria Europeia deve tornar-se uma realidade a breve trecho, respeitando as tradições constitucionais dos Estados-Membros e os mais altos padrões internacionais. E o Parlamento deve continuar a agir neste sentido. Se é certo que o estabelecimento desta Procuradoria não poderá ser feito de qualquer forma e a qualquer custo, o custo da sua inexistência afigura-se cada vez mais incompreensível.

  Caterina Chinnici (S&D). – Signor Presidente, onorevoli colleghi, inizio subito manifestando l'auspicio che il dibattito di questa sera possa contribuire davvero a dare slancio al negoziato sull'istituzione della procura europea che si trascina da troppo tempo.

Mi rendo conto delle difficoltà nella formulazione del testo, ma occorre guardare all'obiettivo finale, contrastare efficacemente i reati contro gli interessi dell'Unione che, lo abbiamo detto, superano i confini nazionali e contro i quali soltanto un soggetto veramente indipendente dalle autorità nazionali e dalle Istituzioni dell'Unione potrà raggiungere risultati adeguati. Un soggetto che abbia competenza primaria nell'indagare e perseguire i reati previsti dalla direttiva PIF, compresi quelli relativi all'IVA.

La creazione di una procura europea, organo specializzato nel contrasto a reati finanziari contro gli interessi dell'Unione, senza sovrapposizione di competenze con Eurojust e Olaf, con adeguate risorse e con una collaborazione degli Stati membri che vada oltre la logica della sola cooperazione, è un progetto ambizioso al quale però occorre dare attuazione per tutelare adeguatamente gli interessi finanziari dell'Unione.

  Csaba Sógor (PPE). – Mr President, fraud against the financial interests of the EU and our taxpayers, including big VAT fraud, amounts to tens of billions of euros each year. In order to be able to detect and prosecute such crimes, it is clear that we need to build a strong, independent and efficient EPPO that is equipped with sufficient investigative probe powers. In this process, it is vital that the competences of the various related European institutions are clear. We need to ensure that Eurojust, EPPO and OLAF do not duplicate work and do not step on each other’s toes, but form a coherent wall in the fight against fraud. A good division of competences could also free Eurojust from the work it currently does in this field and allow it to concentrate on other crucial criminal areas such as the fight against terrorism and other threats.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, έχω τονίσει πολλές φορές στην αίθουσα αυτή τη σημασία που έχει η πάταξη του οικονομικού εγκλήματος, της φοροδιαφυγής και της φοροαποφυγής μέσα στην Ευρωπαϊκή Ένωση. Είναι πραγματικά εξοργιστικό, όταν στην Ελλάδα επιβάλλονται φορομπηχτικές πολιτικές, οι ίδιοι που επιβάλλουν αυτή την πολιτική να κάνουν τα στραβά μάτια μπροστά στη λειτουργία φορολογικών παραδείσων μέσα στην Ευρωπαϊκή Ένωση, φορολογικών παραδείσων που κερδίζουν από την φορολεηλασία της Ελλάδας και των άλλων χωρών του Νότου.

Γιατί άραγε η OLAF, ενώ έχει συσταθεί προκειμένου να πατάξει τη διαφθορά και την απάτη εντός των κρατών μελών, δεν κάνει τίποτε για να συμβάλλει επιβοηθητικά σ’ αυτό το έργο; Γιατί άραγε η Επιτροπή δεν κάνει τίποτε για να προστατεύσει καλύτερα τους καταγγέλλοντες δυσλειτουργίες, ανθρώπους που σήμερα απειλούνται με ποινές φυλάκισης στο Λουξεμβούργο; Γιατί λοιπόν οι πολίτες να εμπιστευθούν την Ευρωπαϊκή Εισαγγελία στην Ευρωπαϊκή Ένωση, τώρα που επιχειρεί να βάλει χέρι σε υποθέσεις οικονομικού εγκλήματος που μέχρι στιγμής ενέπιπταν στο πεδίο ευθύνης των εθνικών αρχών; Αυτά είναι σημαντικά ερωτήματα, κύριε Πρόεδρε.

  Věra Jourová, Member of the Commission. – Mr President, I have here some very short concluding remarks but I cannot resist, I would like to react to some of your questions and comments.

Why are we establishing an EPPO which needs to have clear added-value? We see the statistics of OLAF: on average only about 40% of the recommendations of OLAF are sent to the Member States with a clear purpose: investigate and prosecute. We have been saying for years: what can we do? The Member States do not prosecute and we cannot remain helpless. We must act here. I am not criticising any specific Member State, but this is the general situation.

VAT: yes, it must be included in PIF and the EPPO because, besides the many arguments which you have set out here, we have also case law. We have the case which clearly stipulates that VAT is a source for the financial budget.

With regards to VAT, believe me, it is not easy to push the EPPO towards its final adoption because we needed to open the second line of negotiations vis-a-vis the ministers of finance and vis-a-vis the tax authorities, because we will need also all these authorities to be on our side. Then, especially, when the EPPO is working fully, we will need not only national prosecutors, but also the police, tax authorities – and whistle-blowers – to cooperate with the EPPO. We will need the cooperation of a very wide and complex puzzle of institutions at the Member States’ level. So that is why we need to do this right and in a convincing way so that it will bring real added value.

This added value can be, and must be, measured by finance. Of course these are the benefits which we speak about: the money which will one day be brought back to national budgets and the EU budget. We are working on setting up the proper threshold for structural funds and agricultural funds and customs: at the moment this is EUR 10 000, but we will continue to discuss this. For VAT it should be really only a big scope of fraud, so we speak about three or five million euro for cross-border VAT fraud.

I want to have the EPPO doing big things. It should not be established, as I said before, to replace national prosecution; it must do only big things creating big benefits. Yes, we need unanimity in the Council. So this will need a very strong push in regard to several Member States. For me it is clear that the cohesion countries, especially, must be there because it would not be logically if we established the EPPO to prosecute fraud on EU funds without having some of the Member States which receive the money, which receive more than they contribute. So here I have had, along with my colleagues, a lot of work in some of the Member States.

The final point: speaking about the benefits. I spoke about the financial benefits, but here we must be fully aware that it is the thrust of the people in Europe, taxpayers, at stake.

I am always absolutely frustrated when I hear the critics, and I read the articles of the critics of the EU, who say that structural funds are only a source for fraud and corruption. Where is all that ethos? This is the policy of solidarity. The rich countries are contributing money to the poorer countries and the critics say it is only there to be stolen and cheated on, and all those benefits, all those good projects, all the jobs and all that prosperity, which has been created over years thanks to this money, is forgotten.

I think that we need to act here and to show taxpayers and all those critics that yes, this is the distribution of massive amounts of money, but the money is well managed and controlled. It is our duty to act, and to create the EPPO as a really strong, competent and functioning European body.

We have three decisive months ahead of us and I count on your support so that we will manage first the negotiations in the Council and also the consent in Parliament to be achieved in a reasonably short time.

  Ivan Korčok, President-in-Office of the Council. – Mr President, I would like to thank the honourable Members for all the interventions and statements made which, in my view, clearly show the importance they attach to the establishment of EPPO. At the same time, we have heard you highlight many aspects that we need to address in the remaining period of negotiations during the Slovak Presidency.

I would like to make just two points here in my concluding remarks. First of all, it is clear to the Presidency that we need to ensure that outstanding reservations are lifted in the period remaining and that the gaps in the text must be addressed properly. I dare say that we are close to finalising the text and getting an agreement on it. We will, of course, include some of the outstanding provisions, like judicial review cooperation between EPPO and Eurojust, in the new consolidated version.

Second, as many of you have indicated, it is vital that the EPPO Regulation be made coherent with the Eurojust Regulation and with the PIF Directive. It is clear that we need to make progress on this because the PIF Directive should contain the substantive law to be applied by EPPO. So that message is well taken, Mrs Gräßle, and the Presidency will try to address it in the remaining period.

I wish to thank Members once again and look forward to further cooperation.

  Laura Ferrara (EFDD), per iscritto. – Ieri la commissione LIBE ha votato la relazione sulla lotta alla criminalità organizzata e alla corruzione, fenomeni che incidono notevolmente sulle frodi che si commettono ai danni degli interessi finanziari dell'Unione europea. Anche in questa relazione è stata reiterata la richiesta di avere una Procura europea indipendente in grado di indagare, perseguire e portare in giudizio gli autori di reati ed è stata sottolineata la necessità di una chiara definizione dei suoi poteri e delle procedure. Auspichiamo quindi che la direttiva PIF venga adottata in tempi brevi affinché si conosca chiaramente la tipologia di reati che la costituenda Procura sarà competente a trattare.

La notevole capacità dei gruppi criminali di costruire relazioni internazionali, di ramificarsi in diversi Stati membri e di dare una forma apparentemente legale alle proprie attività spinge ad evidenziare ancora una volta l'importanza di estendere, come previsto dall'articolo 86 TFUE, le attribuzioni della Procura europea alla lotta contro altre forme di criminalità grave, anche di tipo mafioso, che presentano una dimensione transnazionale.

  Benedek Jávor (Verts/ALE), írásban. – Az Európai Főügyészség formálása során a Tanács már épp eléggé felvizezte az eredeti bizottsági javaslatot az Ügyészi Kollégium megteremtésével, a nemzeti ügyészek hatáskörének megnövelésével és az EPPO hatáskörének gyengítésével. De van pár dolog, amiből – álláspontom szerint – sem a Bizottság, sem a Parlament nem engedhet: Nem engedhetjük, hogy az Európai Főügyészség csak azon ügyekre láthasson rá, amelyeket a nemzeti ügyészek az EPPO hatáskörébe esőnek gondolnak, hanem rá kell látnia minden ügyre, hogy megvizsgálhassa azok tényleges hatásköri hovatartozását. Az áfának mindenképpen benne kell maradnia az Unió Pénzügyi Érdekeinek védelméről szóló (PIF) direktívában, s ezáltal a főügyészség hatáskörébe kell kerülnie.

Éppen ezért az sem megengedhető, hogy csak 50% feletti uniós érintettség esetén lehessen az ügyészségnek hatásköre, hiszen az áfa európai vonzata szükségszerűen a fenti értékhatár alatt van. Az áfa ugyanis a Bíróság által is elismerten az Unió saját pénzügyi forrásának minősül, s mint ilyet, meg kell tudnia érdemben védeni, különösen akkor, ha az EU számos országában népszerű a határokon átnyúló áfacsalások rendszere, melyet a tagországok hatóságai nem tudnak vagy akarnak hatékonyan felderíteni. Ezek teljesülése nélkül a Bizottságnak vissza kell vonnia a javaslatát, és adott esetben meg kell fontolnia, hogy egy ügyészség helyett az Európai Unió Csaláselleni Hivatalának adjanak megfelelő hatásköröket.

  Емил Радев (PPE), в писмена форма. – Ефективната борба на европейско ниво срещу злоупотребата с европейски средства изисква ефективни мерки, отново на европейско ниво, които да засилят сътрудничеството между държавите членки в тази сфера. Още по-важно е да се гарантира, че политически и икономически кръгове няма да влияят върху разследванията и делата за такива злоупотреби. Поради тази причина изграждането на силна, независима и активна Европейска прокуратура е изключително важно.

Вярвам, че тя трябва да има широки и ясни правомощия и компетенции, включително в борбата срещу ДДС измамите, и да бъде гарантирана нейната независимост от националните прокуратури. В същото време е нужно процесуалните права на заподозрените и обвинените да бъдат защитени, защото все пак това е в основата на всяко едно демократично и законно разследване. Вярвам, че европейската прокуратура ще допринесе за засилване на борбата срещу измамите с европейски средства и в България. Това ще спомогне повече пари да стигат до хората, които наистина се нуждая от тях за развитие на предприемачество, земеделие, иновации.

Затова, в името на европейския и българския просперитет, призовавам държавите членки да достигнат до съгласие и да приемат предложението за Европейска прокуратура в рамките на Съвета, защото ЕС има нужда от нея.

  Tomáš Zdechovský (PPE), písemně. – Při zřízení jakéhokoliv nového úřadu je velice důležité stanovit jeho kompetence a především jeho vztahy k již existujícím strukturám. To se však v případě Úřadu evropského veřejného žalobce nestalo a do dnešního dne zůstává mnoho otázek neodpovězených. Je tedy nutné, aby Evropská komise vyjasnila nejen vazby mezi tímto úřadem, Eurojustem a úřadem OLAF, ale také vyhodnotila dopady, které tento nový úřad bude mít na ostatní agentury. Jeho finanční nároky se jistě projeví v rozpočtu Eurojustu, stejně jako jeho činnost zásadně ovlivní samotnou činnost Eurojustu. Je tedy nutné co nejdříve ustanovit efektivní rámec aktivit a vazeb nového Úřadu evropského veřejného žalobce.

  Janusz Zemke (S&D), na piśmie. – Z uznaniem odnoszę się do postępów prac legislacyjnych w Radzie, która w ostatnim czasie przyjęła pełny skonsolidowany tekst projektu rozporządzenia w sprawie ustanowienia Prokuratury Europejskiej. Powołanie tej agencji będzie bowiem zwieńczeniem wieloletniej debaty i starań Parlamentu Europejskiego oraz Komisji, by wyposażyć Unię Europejską w kompetencje w zakresie prawnokarnej ochrony jej własnych interesów budżetowych. Zanim jednak Prokuratura rozpocznie działalność, istnieje obecnie jeszcze parę kwestii problematycznych, które wymagają rozwiązania. W pierwszej kolejności niezbędne jest przyjęcie nowej dyrektywy PIF, która doprecyzuje zakres przedmiotowy kompetencji Prokuratury. Wydaje się, że istotne dylematy, jakie pojawiały się podczas prac legislacyjnych w Radzie (adekwatna podstawa prawna, kwestia podatku VAT) i blokowały ten proces – zostały rozstrzygnięte przez Trybunał Sprawiedliwości w sprawie Taricco. Konieczne jest także dokończenie reformy organu współpracy sądowej w sprawach karnych Eurojust, z którym Prokuratura – na mocy postanowień traktatu – ma być ściśle powiązana. Dzięki przyjętemu w ostatnim czasie rozporządzeniu PE i Rady w sprawie Europolu Prokuratura będzie miała istotne wsparcie w zakresie wymiany informacji operacyjnych. Są to warunki graniczne, by Rada mogła przystąpić do finalnego etapu tworzenia Prokuratury, która – jak wiadomo już dziś – będzie funkcjonowała w okrojonym formacie wzmocnionej współpracy.
