  Jo Leinen (S&D). – Mr President, I would like to ask you to make contact with the Commission and Council in order to push for the refusal of the accreditation of the designated US Ambassador, Ted Malloch. Mr Malloch has shown extreme hostility towards the European Union and the core idea of European integration. I think he should be persona non grata in Brussels.

  Anna Maria Corazza Bildt (PPE). – Mr President, I would like to share the concern of many of us at the resumption of massive heavy shelling in eastern Ukraine, where nine people have been killed, 26 wounded, thousands of civilians have been displaced, and hundreds of thousands of civilians are without basic supplies. I don’t know if it is a coincidence that this weekend, on Saturday, President Putin and President Trump had a phone call, but the EU should react. I am happy that the High Representative is here with us to call for a ceasefire, for humanitarian aid and to restore the political process.

  Anna Elżbieta Fotyga (ECR). – Mr President, I would like to raise the issue already mentioned by Ms Corazza Bildt. Unfortunately, the situation in eastern Ukraine and the humanitarian crisis in Avdiyivka, the destruction of critical infrastructure and the deaths of civilians require our debate here in the plenary. Therefore, I propose to add this point to the agenda. Please vote on this.

  Peter Lundgren (EFDD). – Mr President, today a new item will be added to the agenda: managing the migration in the Mediterranean. With regard to this proposal, the EFDD Group would highlight that our member, Beatrix von Storch, already tabled a major interpellation on managing the migration in the Mediterranean. This issue is already in the pipeline for parliamentary follow-up with the High Representative. Mr President, could you please confirm that the major interpellation tabled by the EFDD Group shall not be dismissed on the grounds that a debate on a similar issue is taking place today?

  Nigel Farage (EFDD). – Mr President, can I respond to the somewhat bizarre Communist intervention from the German Member Jo Leinen who wants us to ban and bar … (Loud objections, catcalls and whistles from the floor) … Oh, isn’t this just the European House of democracy! So you shout me down before I’ve even said anything? Well, Mr President, these people’s minds aren’t very open. Can I just point out that it would be somewhat bizarre to bar and ban Ted Roosevelt Malloch from any engagement with the European Union, given that he hasn’t even been appointed yet.

  Νότης Μαριάς ( ECR). – Κύριε Πρόεδρε, θα ήθελα να ενημερώσω εσάς και το Σώμα για μια ιδιαίτερα επικίνδυνη εξέλιξη ενάντια στο δικαίωμα των ευρωβουλευτών να ασκούν ελεύθερα το λειτούργημά τους. Στις 24 Ιανουαρίου και κατά τη συνεδρίαση της Επιτροπής Αναφορών της οποίας είμαι μέλος, εξέφρασα τις απόψεις μου και στήριξα με τη ψήφο μου, για λόγους προστασίας της δημόσιας υγείας και του περιβάλλοντος, την αναφορά δύο πολιτών της Ευρωπαϊκής Ένωσης κατά των εξορύξεων χρυσού στη Χαλκιδική. Προχθές έλαβα επιστολή από την εταιρεία «Ελληνικός Χρυσός» που διενεργεί τις παραπάνω εξορύξεις χρυσού, η οποία επιστολή στην ουσία ποινικοποιεί το δικαίωμα μου της ελεύθερης έκφρασης γνώμης και ψήφου κατά την άσκηση των καθηκόντων μου ως ευρωβουλευτή. Καταγγέλλω αυτήν την απειλητική συμπεριφορά της εταιρείας «Ελληνικός Χρυσός». Δηλώνω ότι δεν πτοούμαι από τις απειλές τους και καλώ εσάς, κύριε Πρόεδρε του Ευρωπαϊκού Κοινοβουλίου, να προβείτε στις δέουσες ενέργειες προκειμένου να διασφαλιστεί το δικαίωμά μας να ασκούμε τα καθήκοντά μας ελεύθερα ως ευρωβουλευτές και να μην υφιστάμεθα απειλές από οποιαδήποτε ιδιωτική επιχείρηση.

  Ana Gomes (S&D). – Mr President, besides supporting my colleague, Jo Leinen, in his request that the person designated as Ambassador to the EU will not be accepted, I want to hear you, Mr President – as President of this Parliament and on behalf of this Parliament – to clearly condemn the measures that President Trump has announced in the US banning Muslims from certain countries as illegal, against international law and our principles as allies, racist, xenophobic, discriminatory and inviting terror reactions.

  Николай Бареков (ECR). – Г-н Председател, бих искал да информирам Европейския парламент, че днес в моята родина България отбелязваме деня на жертвите от комунистическия терор. Милиони български семейства, включително и моето, са жертви на този терор. Искам Парламентът да почете този факт, без, разбира се, да обиждам колегите отляво. Това са исторически събития, но трябва да склоним глава пред тях, защото много хора в цяла Европа загубиха живота си.

  Presidente. – Sono state presentate le seguenti proposte di modifica.

Mercoledì 1° febbraio: una dichiarazione del Vicepresidente della Commissione/Alto rappresentante dell'Unione per gli affari esteri e la politica di sicurezza sulle restrizioni di viaggio a seguito degli ordini esecutivi del Presidente degli Stati Uniti è aggiunta come primo punto all'ordine del giorno, seguita da un giro di interventi di oratori dei gruppi politici.

Secondo punto – una dichiarazione del Vicepresidente della Commissione/Alto rappresentante dell'Unione per gli affari esteri e la politica di sicurezza sulla gestione della migrazione lungo la rotta del Mediterraneo centrale è aggiunta come terzo punto all'ordine del giorno, dopo la dichiarazione della Commissione sullo stato dell'Unione dell'energia.

Terzo – l'interrogazione orale sui pesticidi biologici a basso rischio è rinviata alla tornata di febbraio II.

Di conseguenza la seduta sarà prolungata fino alle ore 24.00.

Comunico di aver ricevuto inoltre la seguente richiesta. Mercoledì 1° febbraio il gruppo Europa delle Nazioni e della Libertà ha chiesto che una dichiarazione del Vicepresidente della Commissione/Alto rappresentante dell'Unione per gli affari esteri e la politica di sicurezza sulle attività segrete del Servizio europeo per l'azione esterna sia aggiunta come secondo punto dopo la dichiarazione del Vicepresidente della Commissione/Alto rappresentante sulle restrizioni di viaggio a seguito degli ordini esecutivi del Presidente degli Stati Uniti.

  Georg Mayer, im Namen der ENF-Fraktion. – Herr Präsident! Ich möchte für unsere Fraktion die Einschiebung eines Tagesordnungspunkts beantragen. Sie haben schon gesagt: nach dem Tagesordnungspunkt „Reiseeinschränkungen des US-Präsidenten“. Es geht uns da um das EU Intelligence Analysis Centre (INTCEN) – welch ein klingender Name für einen Geheimdienst. Dieser Dienst ist völlig im Dunkeln entstanden. Es gibt keine gesetzliche Grundlage für diesen Dienst. Noch dazu hat das Parlament hier im Haus keine Einschaltmöglichkeit bzw. keine Kontrollmöglichkeit für diesen Dienst. Das ist auch einzigartig in der Welt, dass so ein Geheimdienst nicht vom Parlament kontrolliert werden kann.

Insofern stelle ich folgenden Antrag für meine Fraktion: Die Rolle des INTCEN im Allgemeinen und im Besonderen im Zusammenhang mit dem Putschversuch in der Türkei im Juli 2016 hier zu debattieren. Ich weiß, es ist ein langer Tag heute, aber ich würde vorschlagen, diesen Tagesordnungspunkt nur mit einem Redner abzuhandeln.

  Presidente. – Per giovedì 2 febbraio 2017 il gruppo del Partito Popolare Europeo e il gruppo dell'Alleanza dei Democratici e dei Liberali per l'Europa hanno chiesto che una dichiarazione della Commissione su democrazia e giustizia in Romania sia aggiunta come primo punto. Di conseguenza le votazioni inizierebbero alle 11.30 e non alle 11.00.

  Manfred Weber, im Namen der PPE-Fraktion. – Herr Präsident, liebe Kolleginnen und Kollegen! Das Vertrauen der Bürger in den Staat ist die Grundlage unseres Staatsverständnisses, und wenn Korruption stattfindet, dann wird dieses Grundprinzip des Vertrauens in den Staat massiv erschüttert. Deswegen ist der Kampf gegen Korruption der Kampf für Europa und für Rechtsstaatlichkeit. Wir erleben jetzt in Rumänien leider Gottes, dass das Strafrecht heute Nacht mit Dekretsanordnungen der Regierung außer Kraft gesetzt wird. Über 2 000 aktuelle Fälle, die eigentlich Korruptionsfällen im Land nachgehen sollten, werden damit ad acta gelegt, und auch der Parteivorsitzende der Sozialisten wird damit freigesprochen, obwohl er bereits als jemand verurteilt ist, der korrupt ist.

Deswegen glauben wir, dass es ein Anlass ist, über diese Entwicklungen in Rumänien zu diskutieren. Wenn der Staat käuflich ist, durch Korruption, dann ist dies ein ganz schwerwiegender Eingriff. Wir respektieren, dass Hunderttausende von Menschen in Rumänien auf der Straße sind und dagegen demonstrieren. Wir unterstützen den Präsidenten Rumäniens, der gegen diese Initiativen protestiert und seine Macht einsetzt. Das Europäische Parlament muss sich mit dieser Frage beschäftigen.

  Norica Nicolai, în numele grupului ALDE. – Domnule președinte, Grupul ALDE solicită o dezbatere în acest Parlament, nu în spatele ușilor închise, așa cum s-au mai tranșat în vechime chestiuni care au ținut de România și dorim, domnule președinte, să avem o dezbatere despre starea democrației și a justiției în România. Am vrea ca această dezbatere să răspundă la câteva întrebări și întrebările pe care le pun nu îmi aparțin mie, ca om politic, ci aparțin comunității magistraților din România. Am vrea ca această dezbatere să răspundă la următoarele întrebări: este politica penală atributul guvernelor sau al instanțelor judecătorești? Sunt deciziile Curții Constituționale, într-un stat de drept, facultative pentru magistrați, judecători sau procurori, sau sunt obligatorii? Este nevoie ca conflictele între puterile politice ale statului să fie manageriate de puterea judecătorească? Este nevoie ca parlamentele să mai adopte legi? Este nevoie ca legile care guvernează funcționarea justiției să fie înfăptuite, alături de serviciile secrete, prin forme administrative și prin nu prin lege?

Deci sunt întrebări la care este nevoie de un răspuns și magistrații din România, domnule președinte, cer acest răspuns și această dezbatere în plenul Parlamentului European și salutăm dezbaterea de mâine.

  Presidente. – Mi pare che le due proposte, seppur formulate con termini diversi, possano essere riunificate. Quindi mi sembra di poter mettere all'attenzione della Plenaria una proposta unica per avere una dichiarazione della Commissione sulla democrazia e la giustizia in Romania. Quindi abbiamo ascoltato la proposta congiunta PPE/ALDE.

  Maria João Rodrigues, on behalf of the S&D Group. – Mr President, the S&D position is in favour of having a plenary discussion about democracy and justice in Romania. and as this is being proposed in particular by the ALDE Group. We also think that we need to clarify facts by complementing this debate in plenary with a proper discussion in the Committee on Civil Liberties, Justice and Home Affairs. We feel that we should also send a fact—finding mission to Romania to check what is really happening.

We consider that it is particularly important to clarify these points: not only the purpose of the legislative package adopted yesterday, but also the way the prison system works in Romania, as well as the way the judicial system works. So this is our proposal: a debate in plenary, a debate in the Committee on Civil Liberties, Justice and Home Affairs, and a fact-finding mission to Romania.

Wenn die Sozialisten dem zustimmen, dann können wir das so machen, aber ein weiteres Verzögern, ein weiteres Vertagen der Debatte würde aus unserer Sicht nicht richtig sein. Okay? Dann würden wir es so unterstützen.

Rodrigues in modo che ci sia una discussione in Plenaria e poi un dibattito in LIBE, per poi inviare una missione in Romania. Siamo d'accordo? Metto in votazione le tre proposte congiunte.

  Presidente. – On. Harms, avevo ascoltato attentamente l'intervento dell'on. Fotyga, ma il regolamento prevede che la richiesta di modifica dell'ordine del giorno sia presentata almeno un'ora prima della discussione a nome di un gruppo. Questa richiesta non è arrivata, è stata fatta dall'onorevole, io l'ho ascoltata in Aula, quindi non posso modificare. C'è il nuovo regolamento, quindi bisogna rispettare il regolamento.
