  Die Präsidentin. – Als nächster Punkt der Tagesordnung folgt die Aussprache über die Empfehlung für die zweite Lesung des Haushaltskontrollausschusses und des Ausschusses für bürgerliche Freiheiten, Justiz und Inneres betreffend den Standpunkt des Rates in erster Lesung im Hinblick auf den Erlass der Richtlinie des Europäischen Parlaments und des Rates über die strafrechtliche Bekämpfung von gegen die finanziellen Interessen der Europäischen Union gerichtetem Betrug [06182/1/2017 - C8-0150/2017 - 2012/0193(COD)] (Berichterstatter: Ingeborg Gräßle, Juan Fernando López Aguilar) (A8-0230/2017).

  Ingeborg Gräßle, Berichterstatterin. – Frau Präsidentin, Herr Kommissar, Frau Kommissarin! Ich möchte vor allem Frau Kommissarin Jourová zu einer tollen Leistung sehr herzlich beglückwünschen. Heute ist ein großer Tag für die Europäische Union und für die Betrugsbekämpfung. Ich begrüße sehr herzlich Kommissar Oettinger, der sich vier Jahre zähe Verhandlungen erspart hat, aber jetzt doch rechtzeitig zum Erfolg am Ende noch an Bord gekommen ist. Wir sind davon überzeugt, dass wir heute bei dem Schutz der finanziellen Interessen der Europäischen Union und bei den neuen Kompetenzen für die Europäische Kommission einen wirklichen Meilenstein vorangekommen sind.

Wir haben den Abschluss eines Gesetzgebungsverfahrens zur Richtlinie über die strafrechtliche Bekämpfung von gegen die finanziellen Interessen der Union gerichteten Betrug – die sogenannte PIF-Richtlinie –, ein sperriger Begriff. Wir haben es mit einem historischen Moment zu tun, weil wir eine wesentliche Rechtslücke innerhalb der EU beseitigen und den Schritt hin zum Europäischen Staatsanwalt tun. Der Haushaltskontrollausschuss fordert seit 20 Jahren die Einrichtung einer solchen Europäischen Finanzstaatsanwaltschaft, und jetzt sind wir endlich so weit. Ich freue mich, dass es immerhin noch vor Mitternacht möglich war. Ich bedaure außerordentlich, Frau Präsidentin, dass dieses Haus sich mit allen möglichen Randfragen beschäftigt, aber es nicht möglich war, diesen wesentlichen Teil eines wirklichen Vorankommens der Europäischen Union und einer wirklichen europäischen Einigung, zu einer christlichen Zeit auf die Tagesordnung zu setzen, wo vielleicht irgendjemand auch noch zuschaut.

Ich bedaure außerordentlich – und ich weiß zu schätzen, dass der Kollege McAllister hier noch mit uns im Sitzungssaal weilt – dass dieses Parlament es nicht mehr zu unterscheiden weiß, was wichtig ist und was unwichtig ist. Das ist ein Meilenstein für das Europäische Parlament. Ich buche es mal unter persönlichem Racheakt ab, dass wir uns jetzt um diese Uhrzeit treffen – mir macht es nichts aus, ich kann sowieso nachts nicht schlafen.

Ich möchte Ihnen sagen, dass diese Abstimmung einen Schlusspunkt hinter viereinhalb Jahre hartnäckige Arbeit an dieser Richtlinie setzt. Im April 2014, kurz vor der Europawahl, hat das Parlament seinen Standpunkt in erster Lesung beschlossen. Ich möchte mich auch sehr herzlich beim Kollegen López Aguilar dem Ko-Berichterstatter aus dem Innenausschuss, bedanken. Wir haben von Oktober 2014 bis Dezember 2016 Triloge durchgeführt mit einer fast eineinhalbjährigen Pause von Juni 2015 bis Oktober 2016, weil der Rat sich geweigert hat, die Kernforderung des Parlaments zu akzeptieren – eine Einbeziehung der Mehrwertsteuer in den Anwendungsbereich der Richtlinie.

Der letztlich erzielte Kompromisstext kann sich aus Parlamentssicht durchaus sehen lassen. Insbesondere die Einbeziehung der Mehrwertsteuer ist ein ganz wichtiger Schritt. Ich möchte mich bei der slowakischen Ratspräsidentschaft bedanken – auch wenn auf Ratsseite alle schon im Bett liegen. Ich möchte mich sehr herzlich beim Rat bedanken, dass die verschiedenen Ratspräsidentschaften es immer wieder möglich gemacht haben, in dieser schwierigen Sache weiterzumachen. Nicht unerwähnt möchte ich auch die italienische, die lettische und die niederländische Ratspräsidentschaft lassen, unter denen ebenfalls wesentliche Verhandlungsfortschritte erzielt werden konnten. Ich möchte mich auch bei den vielen engagierten Mitarbeitern der Kommission bedanken, aber vor allem bei Ihnen, Frau Kommissarin Jourová. Ohne Ihren kontinuierlichen und beharrlichen konstruktiven Einsatz wäre das sicherlich nicht möglich gewesen.

Wir legen heute das Fundament der Europäischen Finanzstaatsanwaltschaft, der sogenannten EPPO. Die PIV-Richtlinie harmonisiert die Definitionen für einschlägige Straftaten – unter anderem Betrug, aktive und passive Korruption, missbräuchliche Mittelverwendung – und legt ein Mindestniveau für die zugehörigen Höchststrafen fest. Für eben diese Straftaten wird dann die EPPO eine Ermittlungskompetenz bekommen. Sie wird auch die Möglichkeit haben, ab zehn Millionen Euro Schaden bei Mehrwertsteuerbetrug zu ermitteln, wenn mindestens zwei Mitgliedstaaten betroffen sind.

Ich möchte Ihnen sagen: Heute ist ein guter Tag für die Europäische Union, für die Finanzen der Europäischen Union, und deswegen glaube ich, dass wir auf keinen Fall ruhen sollten, die EPPO jetzt zu einem Erfolg zu machen.

Frau Präsidentin, ich habe so lange auf den Moment gewartet, deswegen habe ich mich entschlossen, die Redezeit brutal ist zu überziehen, also mir müssen Sie heute das Mikro abklemmen, weil ich finde, dass es wirklich ein guter Tag für die Betrugsbekämpfung ist.

  Juan Fernando López Aguilar, ponente. – Señora presidenta: gracias, comisaria Jourová y comisario Oettinger por estar aquí, en esta hora avanzada de la noche, al filo de la medianoche.

Después de horas de debatir orientaciones estratégicas, recomendaciones y la situación en países sobre los que la Unión Europea no puede legislar porque no tiene ninguna jurisdicción sobre ellos... ¡por fin una iniciativa legislativa!

Por fin una pieza legislativa en debate en esta Cámara; nada menos que la que expresa mejor la dimensión política, incluso la ambición constitucional de la Unión Europea, porque es legislación penal europea, por fin, en la protección de los intereses financieros de la Unión, en la protección del presupuesto europeo contra el fraude de escala europea.

Han sido años de debate en los que agradezco enormemente la cooperación de la ponente por la Comisión CONT, la señora Gräßle. Hemos trabajado durante más de cuatro años para cumplir este objetivo del espacio de libertad, justicia y seguridad, esta Directiva que armoniza legislación europea, haciendo del fraude contra el presupuesto europeo un objetivo del Derecho penal europeo que será necesario para poner en marcha la Fiscalía Europea, prevista en el artículo 86, con la protección de los intereses financieros como primera competencia, pero cabe esperar que —en desarrollo del artículo 83 del Tratado de Funcionamiento de la Unión Europea— ampliable a otros delitos graves de escala transnacional.

Pues bien, aquí tenemos efectivamente una discusión de las que merecen la pena, porque se trata de evitar que el fraude pueda someterse al forum shopping, es decir, a la elección de la legislación más favorable, armonizando la legislación de respuesta penal de los Estados miembros. Y esto es lo que hace exactamente esta Directiva con respecto del fraude, la corrupción, la apropiación indebida y la malversación, estableciendo, por fin, penas mínimas, sanciones mínimas y una pena de hasta cuatro años de prisión por estos delitos —por supuesto, opcional para el juez, a decidir por el juez—.

Pero el objetivo realmente importante es que el Parlamento ha entrado en diálogo con el Consejo, y este diálogo ha durado nada menos que dos años y medio, porque adoptamos la primera lectura en abril de 2014 y hemos estado discutiendo con el Consejo cuatro problemas principales... Incluir el fraude del IVA como objetivo del Derecho penal europeo, resistido por el Consejo.

Por fin hemos conseguido asegurar que este recurso financiero de la Unión —porque es efectivamente un recurso presupuestario de la Unión— sea objeto de esta Directiva. El compromiso final establece que el fraude al IVA tendrá que importar efectivamente una cantidad significativa —más de 10 millones de euros— y que tendrá que tener carácter transfronterizo, es decir, involucrar al menos a dos Estados miembros de la Unión.

En segundo lugar, la discusión sobre el fraude en las licitaciones públicas que tiene escala europea, y el Consejo se compromete a considerar el asunto en la aplicación futura de la Directiva.

Sanciones mínimas y máximas: una sanción mínima, aplicable en toda la Unión, para los delitos de fraude y los delitos conexos, con un compromiso de, al menos, hasta cuatro años de prisión, siempre que la defraudación importe, al menos, cien millones de euros. Es un objetivo necesario para proteger los intereses financieros de la Unión.

Y la discusión con respecto del periodo de prescripción, que es lo que resulta siempre más heterogéneo y divergente en las legislaciones nacionales de los Estados miembros: hemos establecido un plazo estándar de, al menos, cinco años a partir de la fecha del presunto delito, pero rebajable hasta tres en el caso de que se haya producido una interrupción del periodo de prescripción por la legislación nacional, de acuerdo con las consideraciones oportunas en el proceso cuando el sospechoso ha huido del país o ha debido ser extraditado antes de que se pueda continuar el proceso.

Nos encontramos, por tanto, con una pieza de Derecho penal europeo.

Por fin, legislación penal europea que cumple el objetivo señalado por el Tratado de Lisboa, espacio de libertad, justicia y seguridad, necesaria para que el Consejo, por fin, pueda adoptar su cooperación reforzada, poner en marcha la Fiscalía Europea, que será, sin duda ninguna, una consecución de esta legislatura tan ayuna de logros legislativos en el desarrollo del espacio de libertad, justicia y seguridad.

Esta legislatura, que ha arrastrado los pies en cumplir los objetivos del Tratado de Lisboa, hoy, por fin, está marcando un gol en la verdadera puerta.

  Věra Jourová, Member of the Commission. – Madam President, it is pleasure to be in the Parliament today together with my colleague, Commissioner Oettinger. Yes, to achieve the consensus on how we are going to fight against fraud against the Union’s financial interests by means of criminal law, this is a historical moment. I am happy to be here at this historical moment in spite of the late hour.

I would particularly like to thank the two co—rapporteurs, Ms Gräßle and Mr López Aguilar. Without your tireless efforts and your continuous support in moving this initiative forward, we would not be here today. A quarter of a century after the adoption of the Convention on the Protection of the European Communities’ Financial Interests, it was time to modernise the legislative framework on the protection of the EU budget.

The Directive updates the definitions of criminal offences affecting the Union’s financial interests. It also introduces common rules as regards sanctions and statute of limitations linked to these offences. The Anti—Fraud Directive is a decisive step forward and, in combination with the European Public Prosecutor’s Office, we are entering a new era.

The Anti-Fraud Directive will essentially frame the activities of the European Public Prosecutor’s Office (EPPO). It will provide the material scope for the investigations and prosecutions of criminal offences falling within its competence, and will ensure that the EPPO can rely on harmonised definitions of these offences across the Member States.

The Council reached a general approach on the EPPO in enhanced cooperation in June, and this Chamber will soon be asked for consent. I am confident that the EPPO Regulation can be adopted as soon as possible with a strong backing from Parliament. I am happy that 20 Member States have already notified their participation in the EPPO.

This will make it an efficient tool to protect the financial interests of the EU, and I invite more Member States to join. The work has just started. It has not finished with the adoption in the Council. I will finish now because I know that we are in a hurry here. I will now be happy to hear my colleague, Mr Oettinger.

  Günther Oettinger, Mitglied der Kommission. – Frau Präsidentin, meine Damen und Herren Abgeordneten, Frau Kollegin Gräßle, lieber Herr Abgeordneter López Aguilar, liebe Kollegin Jourová, meine Damen und Herren! Betrug, Untreue, Bestechung, Korruption sind Straftaten von erheblichem finanziellem Gewicht. Aber wenn sie gegen ein öffentliches Budget gehen – egal ob auf nationaler Ebene oder hier in Europa –, dann sind sie auch demokratiegefährdend. Denn wenn wir zulassen, dass man sich am europäischen Haushalt bereichern und damit den Steuerzahler und Bürger schädigen kann, dann wirkt dies demokratiefeindlich. Deswegen ist der heutige Schritt etwas, das mit dem Haushalt und den demokratischen Prinzipien der Europäischen Union zu tun hat.

Bisher gab es nur eine Konvention des Rates – immerhin. Die ist über 20 Jahre alt. Heute schaffen Sie parlamentarisches Recht. Wir stärken die Rechtsgrundlage für alle Aktivitäten unserer Dienste gegen Korruption, Bestechung, Untreue und Straftaten dieser Art mit dieser PIF-Richtlinie und mit der von uns in Vorbereitung befindlichen Reform der OLAF-Verordnung, mit OLAF wie bisher und EPPO neu. Auf der Grundlage der EPPO-Verordnung haben wir Rechtsgrundlagen und Organe und Instrumente, die – so glaube ich – beachtlich sind, die dem europäischen Bürger entsprechen und die für Glaubwürdigkeit und Ehrlichkeit bei europäischen Haushaltsprogrammen einen großen Beitrag leisten. Ich bin dafür den Berichterstattern, dem Parlament, der Kollegin Jourová und ihren Diensten dankbar, und ich sage in meiner Verantwortung für OLAF und EPPO zu: Wir werden alles tun, dass beide Institutionen hervorragend und abgestimmt arbeiten.

Ich will Sie bitten, auch die EPPO-Verordnung alsbald in Rechtskraft zu setzen. Dann haben wir in 20 Mitgliedstaaten eine Europäische Staatsanwaltschaft, und das OLAF arbeitet mit ihr. Und in den anderen sieben, acht Mitgliedstaaten wird das OLAF wie bisher die Arbeit machen und den nationalen Staatsanwaltschaften zuarbeiten.

Im Zuge der Stellenentwicklung EPPO/OLAF werden wir alles tun, damit die EPPO gut starten kann und das OLAF nicht geschwächt wird – entlang der Aufgaben, die in allen europäischen Mitgliedstaaten bleiben.

In der Tat ein guter Tag und ein Erfolg der Hartnäckigkeit von Ihnen, den Berichterstattern im Europäischen Parlament!

  Tomáš Zdechovský, za skupinu PPE. – Paní předsedající, jsem moc rád za tento kompromis, který byl po tak dlouhé době dosažen, protože je nesmírně důležité, aby Evropská unie konečně zavedla opatření, které zajistí účinnou ochranu jejích finančních zájmů. Cením si, že při vyjednávání se podařila jedna velmi důležitá věc, a to zahrnutí podvodů na DPH do působnosti této směrnice.

Vzhledem k naší úzce propojené evropské integraci je pro mě naprosto nemyslitelné, že právě podvody na DPH a s nimi spojená trestně právní opatření stály mimo směrnici. Vždyť i samotná úmluva o ochraně finančních zájmů s tímto zahrnutím DPH počítá. I přesto vidím tuto novou směrnici pouze jako počáteční krok ve společném vývoji Evropské unie v této oblasti, v oblasti ochrany finančních zájmu Evropské unie.

Dámy a pánové, zde je především nutná spolupráce nejen s členskými státy Evropské unie, Europolem, Eurojustem, ale také s Úřadem veřejného žalobce, který se musí na ochraně finančních zájmů Evropské unie co nejrychleji začít podílet. Zde doposud Evropská unie zaostává. A je potřeba ji co nejrychleji posílit, a to právě na úrovni Evropské unie. Je nutné bojovat především proti daňovým podvodům, které jsou v Evropské unii stále častější, a jejich napojení na organizovanou trestnou činnost a financování terorismu, které představuje pro Evropskou unii velikánskou hrozbu.

Dámy a pánové, když se ptáte, proč europoslanci nejsou v 9 hodin ráno na zasedání, je to většinou proto, že do večera mluví právě o takovýchto směrnicích.

  Inés Ayala Sender, en nombre del Grupo S&D. – Señora presidenta, sí, cada año, en ingresos, el fraude del IVA les cuesta a los contribuyentes del orden de 50 000 millones de euros. Imagínense, en el momento en el que empezamos, señor Oettinger, a hablar de los próximos presupuestos, de la necesidad de encontrar recursos. De ahí que quiera dar mi mayor felicitación a los coponentes, a la señora Gräßle y al señor López Aguilar, por haber logrado llevar a buen puerto este barco y, por supuesto, a los comisarios, la señora Jourová y el señor Oettinger. Les felicito enormemente, no solamente por hacer historia en cuanto a lo que es la ley penal y conseguir luchar contra el fraude de los recursos del presupuesto europeo y darle esa base legal al fiscal, sino porque también, en cierta manera, hoy hemos rescatado el IVA, lo hemos defendido de aquellos que en algún momento y en alguna secretaría de Estado, en Berlín concretamente, querían acabar con el IVA como recurso propio del presupuesto europeo. En ese sentido, yo también me felicito esta noche.

  Κώστας Χρυσόγονος, εξ ονόματος της ομάδας GUE/NGL. – Κυρία Πρόεδρε, λυπάμαι γιατί η συζήτηση για ένα τόσο σοβαρό θέμα, όπως η απάτη σε βάρος των οικονομικών συμφερόντων της Ευρωπαϊκής Ένωσης, γίνεται σε τόσο προχωρημένη ώρα μπροστά σε σχεδόν άδεια έδρανα. 600 εκατομμύρια ευρώ τον χρόνο εκτιμά η Ευρωπαϊκή Επιτροπή ότι είναι οι απώλειες της Ευρωπαϊκής Ένωσης από απάτες οι οποίες διαπράττονται σε βάρος των συμφερόντων της. Έχουν οι ευρωπαίοι πολίτες 600 εκατομμύρια ευρώ τον χρόνο για να σπαταλούν κατ’ αυτόν τον τρόπο; Προφανώς όχι. Είναι αναγκαίο να τιμωρείται ποινικά η απάτη σε ευρωπαϊκό επίπεδο; Προφανώς ναι. Δεν μπορεί όμως αυτό να γίνεται καθ’ υπέρβαση των ορίων κατανομής της αρμοδιότητας μεταξύ της Ένωσης και των κρατών μελών, που θέτει η ίδια η ιδρυτική συνθήκη και γι’ αυτόν τον λόγο η τελική μας ψήφος στο θέμα θα εξαρτηθεί από το κατά πόσον θα γίνουν δεκτές οι τροπολογίες μας που αφορούν ιδίως τα ελάχιστα όρια ποινικών κυρώσεων ή όχι.

  Benedek Jávor, a Verts/ALE képviselőcsoport nevében. – Elnök Asszony! Szeretnék köszönetet mondani az előadóknak is, Aguilar úrnak és Gräßle asszonynak. Egyetértek velük, hogy egy történelmi jelentőségű lépésről van szó, amikor ez a parlament végre eljutott oda, hogy megalkossuk ezt a szabályozást. Az Európai Parlament különösen sikerként könyvelheti el, hogy sikerült elérni, hogy az áfaszabályozás, az áfával kapcsolatos bűncselekmények is az irányelv hatálya alá tartozzanak. Tehát egy rendkívül fontos előrelépésről van szó, ugyanakkor ez csak egy első lépés. Nyilvánvaló, hogy a szabályozás csak az alapja annak, hogy hatékonyan fel tudjunk lépni a korrupciós bűncselekményekkel szemben Európában.

Ehhez intézményekre is szükség van, elsősorban az Európai Ügyészségre, amely hatékonyan képes feltárni, kivizsgálni és büntetni az ilyen bűncselekményeket. Sajnos az Európai Ügyészség úgy jön lére Európában, hogy annak nem lesz minden tagállam tagja. Köztük olyan országok sem vesznek részt az együttműködésben, amelyek kiemelt haszonélvezői az uniós forrásoknak. Így attól félek, tisztelt képviselőtársaim, hogy az Európai Ügyészség nem lesz képes ellenőrizni pont azokban az országokban az uniós pénzek felhasználását, ahol azok a leginkább veszélyeztetettek.

  Petri Sarvamaa (PPE). – Madam President, first of all, I would like to thank the rapporteurs for their very important work on this very important file. Maybe it is only natural that we are here in the middle of the night in the Parliament building, speaking about this extremely important affair in the true spirit of prolongation, because, after all, it was the Council that prolonged this process for quite a while. But now we can all be happy to have reached the final outcome.

This particular directive will form an essential part of the fight against fraud against the EU budget. Having common rules designed to protect the financial interests of the Union is not only necessary, but it also makes the recovery of misused funds significantly easier and more efficient.

Even more, the directive is an important step for the effective functioning of the future European Public Prosecutor’s Office, which will soon be established through enhanced cooperation. Unfortunately, the Council could not agree with all of Parliament’s views on the harmonisation of criminal matters affecting the EU budget. But I am glad that, for the most important issues, our hard-working rapporteurs were able to include review clauses in the final text.

Overall, this directive is a very positive step towards a better functioning union in the fight against fraud. Achieving concrete measures for the protection of the EU’s financial interests is the key to ensuring the most reliable and efficient use of European taxpayers’ money. So, once again, my sincere compliments to the rapporteurs on their excellent work.

  Caterina Chinnici (S&D). – Signora Presidente, onorevoli colleghi, signora commissaria Jourová, signor commissario Oettinger, io ringrazio innanzitutto i relatori per il difficile ma importante lavoro svolto attraverso anni di intensi negoziati per definire il testo della direttiva PIF che, insieme all'ormai prossima istituzione della Procura europea, rappresenta una tappa fondamentale del percorso verso l'armonizzazione del diritto penale e costituirà la spina dorsale del nuovo sistema penale di contrasto alle frodi e alla corruzione, che hanno pesato sul bilancio UE per circa mille miliardi di euro.

Tra le disposizioni più significative della direttiva c'è il richiamo alla normativa dell'Unione in materia di contrasto al riciclaggio e alla corruzione, fondamentale per colpire le attività dei gruppi criminali che, attraverso questi reati, reperiscono denaro da impiegare nelle proprie attività illecite. Particolarmente importante – come è stato detto – è anche l'introduzione nel testo legislativo delle frodi IVA, che rappresenta un passo in avanti fondamentale per garantire una tutela più completa contro i reati finanziari a danno dell'Unione.

  Claudia Schmidt (PPE). – Frau Präsidentin, Frau Kommissarin! Der Abschluss der Verhandlungen der Richtlinie darüber, dass Geld und die finanziellen Interessen der Europäischen Union besser zu schützen sind, ist – finde ich – wirklich ein historischer Moment. Google, Starbucks und Amazon suchten sich die Länder mit den besten Steuervorteilen aus, Kriminelle suchten sich die Länder mit der schwächsten Justiz aus. Genau deswegen brauchen wir die Europäische Staatsanwaltschaft. Jedes Jahr entgehen dem EU-Haushalt 50 Mrd. EUR wegen Mehrwertsteuerbetrug, in meinem Heimatland Österreich sind es zwischen 2 und 3,5 Mrd. EUR. Es besteht also dringender Handlungsbedarf.

Seit dem europäischen Binnenmarkt sind die Ländergrenzen für Waren- und Personenverkehr gefallen. Gleichzeitig machen Kriminalität und organisiertes Verbrechen nicht mehr vor Ländergrenzen Halt. Jetzt endlich wurde festgelegt, welche Befugnisse die Europäische Staatsanwaltschaft haben wird. Damit ist die Rechtsgrundlage für die Arbeit dieser Behörde geschaffen worden.

Vor allem die Durchgriffsrechte der Europäischen Staatsanwaltschaft auf nationale Behörden sind sehr wichtig – ein erster Schritt in Richtung gemeinsames europäisches Strafrecht. 20 Staaten sind dabei, und es wurden verbindliche Mindest- und Höchststrafmaße festgelegt. Wir starten jetzt mit dem Europäischen Staatsanwalt, der den Schutz der finanziellen Interessen der EU zum Ziel hat.

Eines muss klar sein: Betrug mit EU-Geldern ist Betrug mit Steuergeldern. Geldwäsche, Korruption und Ausschreibungsbetrug muss der Garaus gemacht werden. Und, Frau Kommissarin, eine Bitte: Liebe Grüße an Herrn Juncker. Es ist jetzt 0.10 Uhr, und ich – ein Mitglied des lächerlichen Europäischen Parlaments – bin anwesend.

  Pascal Arimont (PPE). – Frau Präsidentin, Frau Kommissarin Jourová, liebe Ingeborg Gräßle! Wenn europäische Gelder durch Betrug veruntreut werden, dann muss die EU auch eigene Waffen in die Hand kriegen, um sich zu wehren. Das erwarten die Bürger von uns. Unterschiedliche Definitionen des Betrugs und inkohärentes Vorgehen der Mitgliedstaaten laden die Betrüger nahezu ein, diesen Betrug zu begehen, und eine Verfolgung wird dementsprechend auch sehr schwierig. Diese Einigung, diese Richtlinie ist daher ein großer Schritt in die richtige Richtung.

Ich begrüße ausdrücklich, dass man den Mehrwertsteuerbetrug auch in diese Richtlinie hineingepackt hat. 170 Milliarden – schätzt man – gehen den Mitgliedstaaten pro Jahr verloren, das ist mehr, als der gesamte EU-Haushalt für sämtliche Politikbereiche ausgibt. Wichtig in diesem Zusammenhang ist auch die Schaffung eines Europäischen Staatsanwaltes. Europäische Betrugsfälle müssen europäisch verfolgt, untersucht und bestraft werden. Dabei bleibe ich, diese Meinung ist gut, und diese Richtlinie ist ein Meilenstein, und es ist nicht lächerlich oder ridicule diesen heute Abend 0.10 Uhr zehn gebührend zu würdigen.

  Věra Jourová, Member of the Commission. – Madam President, many Members mentioned the inclusion of VAT as a big achievement. I must say that this is very much thanks to the continuous pressure from Parliament’s side, because I understood from the beginning of the negotiations that this was a red line for the Parliament.

So we opened the second negotiating front with the ministers of finance and we achieved something which all through 2015 nobody believed we would manage, namely to have VAT under the Anti-Fraud Directive and the EPPO as well. So thank you again for this continuous pressure, which helped us a lot in the tough negotiations.

Some Members mentioned the time it took and the lengthy processes for both the Anti—Fraud Directive and the EPPO. We all knew over this process that it was worth investing time and energy in this, because we knew for sure that we were fighting for something good.

We were doing it not only because of the worrying statistics and the money which was being stolen or going into the pockets of corrupt people, but only because there was much more at stake than the money itself, namely the trust of EU taxpayers. I see this as a very important historical moment, since we can now say to Europeans that we are doing our best to protect their money.

I would like to thank Parliament once again. I count on your support tomorrow and in a few weeks’ time in this plenary when you will debate and vote on the EPPO.

  Ingeborg Gräßle, Berichterstatterin. – Frau Präsidentin, Frau Kommissarin! Ich möchte mich bei den Kolleginnen und Kollegen sehr herzlich bedanken und möchte auf die Formalien zu sprechen kommen. Wir haben EFDD-Anträge vorliegen, die wir morgen – bitte – zurückweisen müssen. Da müssen wir alle zusammenstehen. Ich möchte wirklich allen noch mal ins Gewissen reden, das müssen wir machen, weil sonst die ganze Geschichte nicht Realität wird.

Jetzt ist es an uns, die EPPO zum Erfolg zu machen. Wir müssen die Abstimmung mit dem OLAF, mit Eurojust, mit Europol organisieren. Wir müssen dafür sorgen, dass die EPPO wirklich auch in der Praxis ein Erfolg wird, weil wir nur so auch garantieren können, dass wir eine gute Sache geschaffen haben. Wir haben zwanzig Mitgliedstaaten – sieben noch nicht –, und auch hier ist Druck gefordert. Frau Kommissarin Jourová, bloß keinen Streit vermeiden! Wir müssen Druck auf die sieben Mitgliedstaaten ausüben. Es ist Polen, es ist Ungarn dabei – wichtige Mitgliedstaaten, die nicht gerade zu meinen größten Vorbildern gehören, was den Umgang mit europäischen Geldern betrifft. Wir müssen diese Mitgliedstaaten dazu bringen, bei der EPPO mitzumachen. Wir müssen sie dazu bringen, dass sie den Mehrwert der EPPO sehen, und da können Sie uns auch an Ihrer Seite wissen.

Ich möchte mich noch mal ganz herzlich bedanken. Ich möchte uns auch ermutigen, das OLAF und seine großen Erfahrungen in der transnationalen Verbrechensbekämpfung einzubeziehen. Das OLAF ist die erfahrenste Einrichtung, die wir haben, und natürlich müssen wir hier ganz besonders darauf zugehen und das OLAF mit hineinnehmen in die gesamte Konstruktion. Ich glaube, es ist heute wirklich bahnbrechend, egal um welche Uhrzeit es sich handelt. Nochmals herzlichen Dank, und ich glaube, dass es für uns, für den Haushaltskontrollausschuss, eine große Verpflichtung für die kommenden Monate und Jahre sein wird, dafür zu sorgen, dass wir eine wirklich funktionierende Organisation bekommen.

  Juan Fernando López Aguilar, ponente. – Señora presidenta, esta mañana, hace ya más de doce horas, en esta misma aula plenaria, rendíamos homenaje a Simone Veil, símbolo del primer Parlamento directamente elegido por la ciudadanía europea hace 38 años.

Desde entonces este Parlamento ha crecido, ha madurado. Por fin es un Parlamento legislativo; legisla sobre derechos fundamentales y legisla nada menos que sobre el Derecho penal, una competencia tradicionalmente atribuida con carácter exclusivo a la soberanía de los Estados miembros.

Es el momento de que digamos con toda claridad que este Parlamento importa, que no es un Parlamento de segundo grado; que se lo digamos a los 500 millones de ciudadanos a los que este Parlamento representa y lo digamos con especial coraje, en un momento en el que estamos adoptando una legislación penal que, además, suministra recursos adicionales en la protección de los intereses financieros de la Unión, cuando tan necesarios son para subvenir a los destrozos de la política de austeridad, para suministrar los recursos necesarios para restaurar el malherido modelo social europeo, para que pueda de nuevo cobrar sentido toda la política del modelo social europeo que hizo la mejor Europa.

Creo que es el momento de que este Parlamento reivindique su carácter legislativo, su carácter normativo y vinculante, porque encuadra el Derecho penal y la legislación en materias tan importantes como los derechos fundamentales en la protección de datos de los Parlamentos nacionales de los, todavía hoy, veintiocho Estados miembros; que es un Parlamento que realmente puede mejorar la vida de la ciudadanía y puede suministrar recursos en algo tan importante como es la lucha contra el fraude del IVA transfronterizo, el fraude de gran escala que importa miles de millones al presupuesto europeo, siendo como es un recurso fundamental para la financiación de la Unión Europea. Y lo está haciendo este Parlamento, exigente con la Comisión y exigente con el Consejo.

Estamos poniendo en vigor legislación penal europea. Queremos ahora, por fin, que el Consejo saque adelante la cooperación reforzada de la Fiscalía Europea y completemos la arquitectura querida por el espacio de libertad, justicia y seguridad en Europa.

  Fabio Massimo Castaldo (EFDD), per iscritto. – Una lotta efficace agli interessi finanziari dell'Unione può essere condotta solo in modo integrato. Per questo, la normativa penale relativa deve essere adottata a livello europeo e la relazione in esame, costituisce un primo passo in questa direzione. Le frodi all'IVA, costituiscono una parte importante delle frodi in esame, e sono facilitate proprio dall'esistenza del mercato interno (le cosiddette "frodi carosello"). Il fatto che queste siano incluse nel campo di applicazione della direttiva è molto importante, come pure il fatto che la soglia relativa sia parte degli aspetti soggetti a revisione tra tre anni. Lo stesso vale per le frodi nella gestione degli appalti pubblici, altro grande problema per molti Stati, tra cui il nostro. Il testo costituisce quindi, come detto, solamente un primo passo, ma sicuramente, va nella giusta direzione.

  Monica Macovei (ECR), in writing. – The PIF Directive is vital for the fight against European funds fraud. We have to find the money and return it to the taxpayers. This directive provides for minimum rules concerning the definition of criminal offences and sanctions with regard to combating fraud and other illegal activities, such as money laundering and corruption affecting the Union’s financial interests. This directive will also cover VAT fraud but only serious cross-borders cases of fraud, where the total damage caused is over EUR 10 million. This is a very high threshold considering that VAT fraud affects every EU citizen. The carousel of VAT fraud is well-known and it steals millions of euros every year. Moreover, the directive will not affect the competences of Member States to structure and organise their tax administrations as they see fit to ensure the correct determination, assessment and collection of value added tax, as well as the effective application of VAT law.

  Csaba Molnár (S&D), írásban. – Tisztelt Elnök Úr! Újabb OLAF jelentés, újabb gyalázatos adatok láttak napvilágot arról, hogy az egyes tagállamokban a közpénzek mekkora része válik korrupció áldozatává. Az EU csalás elleni hivatala rekord számú esetet tárt fel tavaly. Magyarországon négyszer annyi uniós forrást kellett visszatéríteni a szabálytalanságok miatt, mint bárhol máshol az Unióban. Az uniós források a mi pénzünk is, olyan pénzek, amiből lehetne iskolát, autópályát és játszóteret építeni. Ezek tűnnek el milliárdos tételben, ezekről olvasunk mindennap olyan híreket, hogy melyik politikus családtagjánál landoltak.

Ezért felháborító, hogy vannak olyan tagállamok, amelyek nem akarnak csatlakozni az Európai Ügyészséghez, amely felgöngyölítené az uniós forrásokkal való visszaéléseket. Az európai ügyészi hivatal biztosítaná azt, hogy az uniós pénzek a magyarok és európaiak érdekét szolgálják, ne pedig a kormányzó kevesekét. Több uniós fővárosból származik az a javaslat, miszerint akik nem fogadják el az európai ügyészséget, illetve nem tarják be a jogállamiság alapjait, ne is kaphassanak uniós forrásokat. Mi ezért 2018-at követően azonnal csatlakoznánk az európai ügyészi hivatalhoz, amellyel nem csak az uniós forrásokat, de inogó európai uniós tagságunkat is biztosíthatnánk.

  Емил Радев (PPE), в писмена форма. – Твърде дълго време европейските средства попадаха в грешни ръце и нямаше силен механизъм за борба срещу измамите с тях. По данни на Европейската комисия през 2010 г. са извършени измами с европейски средства на стойност 600 милиона евро. С приемането на Директивата за защита на финансовите интереси на ЕС държавите членки ще разполагат с нов, модерен и адекватен инструмент, с който да гарантират, че европейските средства отиват по предназначение - в помощ на обикновения европеец, на бизнеса, на общините, а не в джобовете на престъпници.

Имайки предвид, че 80% от евросредствата се управляват на национално ниво, въвеждането на общи определения, криминализирането на европейско ниво на отклоняването на средства, на представянето на фалшиви документи, на изпирането на европейски средства, на активната и пасивната корупция ще подпомогне националните органи да разследват случаите на измами. Включването на ДДС измамите на стойност над 10 млн. евро, извършени в две или повече държави, е голяма победа за Европейския парламент и ще допринесе за още по-ефективна борба срещу този вид престъпление. Сега е време държавите членки да транспонират директивата колкото се може по-бързо, за да може да се сложи край на измамите с парите на европейските граждани.

  Alfred Sant (S&D), in writing. – The road to hell is paved with good intentions. It is sad but probable that current ideas to launch an EU defence plan could bear out this dictum. An EU defence plan can only work if it is based on a clear definition of what the common EU interest is by way of security and defence against external threats from state entities. That definition does not yet exist in a coherent manner. Moreover, such a plan would need a military doctrine explaining how security/defence interests would be ensured, based on pooled or jointly coordinated resources, able to conduct warfare. No such doctrine seems available for the foreseeable future. Worse, according to current thinking, internal and external security are different sides of the same coin. Not true. So the defence plan will likely proceed on the basis of contingent military responses, ad hoc. Though the European industrial-military complex is right to lobby for a harmonised armaments market, this does not justify a ‘defence plan’ and is achievable without it. Likely too, a ‘defence plan’ will overlook the interests of neutral countries while another European dual structure of ins-and-outs takes shape. Is this really worth it? I think not.

  Tadeusz Zwiefka (PPE), na piśmie. – Co roku z unijnej kasy wypływają miliony euro w wyniku wyłudzeń związanych z fałszywie podanymi informacjami we wnioskach o unijne dofinansowanie. Dlatego jestem za przyjęciem tej dyrektywy, która dotyczy przestępstw związanych z nadużyciami finansowymi wpływającymi na interes UE w ramach zamówień publicznych, prania pieniędzy, korupcji, oszustw za VAT i umyślnego sprzeniewierzania funduszy. Ponieważ chodzi o środki mające wspomóc rozwój państw i regionów, nie możemy dopuszczać do sytuacji, w której przeznaczone dla dobra ogółu pieniądze trafiają do kieszeni przestępców. Jako sprawozdawca opinii w Komisji Prawnej miałem za zadanie wypracować definicję urzędnika, która w ramach dyrektywy obejmuje nie tylko urzędników UE i pracowników instytucji państw członkowskich, ale także osoby prywatne, którym zostały przekazane funkcje publiczne związane z wykorzystywaniem środków unijnych. Ta sama definicja powinna także obowiązywać w przypadku działalności w krajach spoza UE, jako że znaczna część funduszy z budżetu unijnego dystrybuowana jest poza jej granicami. Dyrektywa ta będzie także podstawą działania przyszłej Prokuratury Europejskiej, do której, mam nadzieję, akces zgłoszą ostatecznie wszystkie państwa członkowskie.
