  Cecilia Malmström, Member of the Commission. – Mr President, honourable Members, I’m happy to talk tonight about corporate social responsibility. It’s an issue that is dear to my heart personally and to this Commission especially, and I know that many European citizens that you represent also attach great importance to this. I’m happy to update you where we stand on this.

The European Union, including the Member States, have a great track record on corporate social responsibility. I would say that it’s one of the best track records in the world. We have led, our Member States have led and a very large number of our businesses have led, including our small and medium-sized enterprises. And this is not only about ethics and respect for others and the environment, it is about long-term sustainable growth and profits for business: shareholder value.

The Commission has recognised from the start that the EU has a valuable role to play here. We can facilitate the implementation of CSR principles, bringing together companies from across different industries and individual sectors to find common solutions. We can incentivise it, including by setting benchmarks and other requirements, and we can also, if necessary, legislate. In 2011 we issued a communication setting out a range of actions. Among others, these actions have aimed to enhance the visibility of CSR and disseminate good practices; improve company disclosure of social and environmental information; further integrate CSR into education, training and research; emphasise the importance of national and sub-national CSR policies; and better align European and global approaches to corporate social responsibilities. We have adopted policies right across our work, from development to agriculture, to labour rights, to justice.

A major step forward was the 2015 Directive on non-financial disclosure. This allows shareholders to have proper disclosure and put pressure on companies to change practices if necessary, and I would say that our work has delivered results.

In 2014 we carried out a major consultation on CSR. It showed that over two thirds of the respondents were happy with what we have delivered, and that is not just only public sector engagement. Of course there’s always more to be done, and that’s why during this mandate the work has continued. We have continued to mainstream CSR across our policies. In the last year we adopted a revised shareholders’ right directive. We have been giving effect to our new public procurement legislation, paying attention to social and environmental elements, and we are working to finalise guidelines on socially-responsible public procurement. And of course, we adopted here the conflict minerals regulation – we will discuss that tomorrow; I’ll be happy to give you an update then – to ensure responsible trade in four minerals: tin tantalum, tungsten and gold. And only last week we adopt an action plan on sustainable finance. On the basis of the recommendations set out by the high-level expert group on the subject, the Commission is setting out a roadmap to boost the role of finance in achieving well-performing economy that delivers on environmental and social goals. That is just the tip of the iceberg of what we have been doing. We are continuing to engage with business and stakeholders.

Whilst public authorities, of course, have a role to play, the final responsibility must always be with the businesses themselves. CSR must be in their DNA. And we are continuing to engage internationally, both through multilateral fora such as the UN and OECD, and of course bilaterally. We have been developing a good dialogue with Japan, for instance, on these issues, and I expect us to develop more such dialogues, because we want other countries to come up to our levels.

It has been increasingly clear that there is no dividing line between CSR and our wider work on implementing the United Nations sustainable development goals. If you act against companies using timber that has been illegally logged, that is an issue both of the CSR and the SDGs. If you act against the import of materials produced in sweatshop conditions in a third country, that is an issue of corporate social responsibility and sustainable development goals, and it’s true of our work on business and human rights as well.

So under this Commission, we are taking a holistic and integrated approach. We are putting our work at the heart of our implementation of the SDGs. Whether you label them CSR or SDG doesn’t really matter; the matter is of course that you take the most effective and proportionate action to address a situation. That can be through legislation, but it can also be through promoting industry-led standards. Under our 2016 communication on SDGs we have set up a multi-stakeholder platform, made up of stakeholders from business, trade unions, NGOs and others, and I expect that within this platform there will be a working group on CSR. That started its work in January only, and it continues to meet. It will give us valuable input and ideas how to take this work further. We have encouraged it to look at the progress we have already achieved and give us advice on what more needs to be done.

So we are looking very much forward to receive the input, carrying on also our own stocktaking exercise of what has been done and what more can be done, and the result of this work will feed into the autumn communication of the SDGs. So with this, I hope I updated you on an issue I know is very important to you as well, and I’m looking forward to the discussion.

  Alberto Cirio, a nome del gruppo PPE. – Signor Presidente, onorevoli colleghi, grazie Commissario della relazione.

Io vorrei solo, Commissario, che Lei avesse ben chiaro che l'argomento di oggi sulla responsabilità sociale delle imprese è stato sollecitato da un caso specifico, che è stato oggetto di un'interrogazione orale cofirmata da 69 europarlamentari italiani, su un caso specifico che si chiama caso Embraco. Lo dico anche ringraziando la delegazione dei lavoratori di Embraco, che ci hanno raggiunti dopo quindici ore di pullman dall'Italia questa mattina, che stanno seguendo i nostri lavori.

Perché, Commissario, la situazione è questa: Embraco è un'azienda che c'è in Italia, che c'è in Piemonte, è un'azienda che fa parte del gruppo Whirlpool, ed è un'azienda che, nonostante non stia attraversando un momento di crisi, ma abbia la situazione economica favorevole, decide di spostarsi e decide di delocalizzare. Il problema è che decide di spostarsi non al di fuori dell'Unione europea, ma all'interno dell'Unione europea, e precisamente in Slovacchia, dove il costo del lavoro è inferiore.

Allora noi dobbiamo capire, Commissario, qual è la posizione della Commissione. Uno, se è accettabile che un'azienda che sta bene possa spostarsi e mettere in crisi i 500 lavoratori che vengono licenziati per spostarsi altrove. Due, se questo altrove può essere in Europa. L'Europa è nata per creare ricchezza, non per spostarla da un paese all'altro. E tre – e chiudo, Commissario – noi dobbiamo capire se questi paesi europei hanno utilizzato fondi europei per creare situazioni di agevolazione a queste imprese per spostarsi, perché questo sarebbe davvero gravissimo, perché questi sono soldi dei cittadini europei, anche di quei cittadini, di quei 500 lavoratori, che ora rischiano di perdere il posto.

Come loro, il gruppo Italia Online, sempre in Piemonte, sta mettendo a rischio altri 500 posti di lavoro. Io credo che se l'Europa vuole essere credibile, deve avere una parola chiara in questo senso.

  Daniele Viotti, a nome del gruppo S&D. – Signor Presidente, onorevoli colleghi, anch'io voglio portare la mia solidarietà alle lavoratrici e ai lavoratori della Embraco, che sono qui presenti e che sono a Torino a lottare per i loro posti di lavoro, e anche alle lavoratrici e ai lavoratori di Italia Online che nelle stesse ore, negli stessi giorni, stanno patendo le stesse sofferenze che stanno patendo questi lavoratori.

Però bisogna anche essere molto chiari, perché questa interrogazione orale che noi avevamo presentato oggi e questa discussione doveva chiudersi con una risoluzione, una risoluzione del Parlamento in cui si chiedevano alla Commissione delle misure molto precise. Purtroppo domani noi non avremo il voto in questo Parlamento per colpa del Partito Popolare Europeo e per colpa delle destre, che non hanno voluto assumere, insieme a noi, una responsabilità di fronte alle cittadine e ai cittadini, alle lavoratrici e ai lavoratori.

Perché noi volevamo fare una risoluzione in cui si chiedeva alla Commissione innanzitutto di dare delle risposte precise su cosa succede con i fondi strutturali europei, se questi fondi strutturali vengono utilizzati da alcuni paesi per permettere la ricollocazione, volevamo chiedere alla Commissione di darci conto di come le aziende lavorano e come le aziende rispettano la responsabilità sociale, e volevamo naturalmente anche chiedere alla Commissione di rispondere su quello che sta succedendo in questi casi specifici. Purtroppo questo non potrà avvenire domani.

Io sono convinto che l'Europa abbia fatto molte cose in questi ultimi tre o quattro anni, le abbia fatte per le imprese e le abbia fatte anche per creare posti di lavoro, ma è il momento che quest'Europa, la Commissione europea e il Consiglio incomincino a interessarsi anche degli interessi delle lavoratrici e dei lavoratori.

  Anthea McIntyre, on behalf of the ECR Group. – Mr President, corporate social responsibility (CSR) has been defined as the responsibility of companies for their impact upon society. It refers to companies voluntarily going beyond what the law requires to achieve social and environmental objectives during the course of its business activities.

The Commissioner has told us how well companies of all sizes across the EU are leading the way in the development of CSR policies. Many companies are progressively integrating CSR into their company strategies on a voluntary basis, and businesses which acknowledge that they are a part of the community where they employ people are to be welcomed and encouraged.

In my own region of the West Midlands we have a brilliant example of CSR: Cadbury’s, the well-known chocolate company developed Bourneville, a model village on the south side of Birmingham for its factory workers to live. It was described as one of the nicest places to live in Britain. They put social responsibility at the heart of their company’s ethos. CSR is not just a benefit to society, it benefits the company too, often helping them to compete in the labour market and to become an employer of choice.

I would like to see the Commission and Member States continue to promote the voluntary take-up of CSR initiatives. But let’s ensure that companies always retain the flexibility and the freedom to shape their own CSR policy according to their specific circumstances and the needs of their employees.

  Enrique Calvet Chambon, en nombre del Grupo ALDE. – Señor presidente, muchas gracias, señora comisaria, no solo hablo en nombre del Grupo ALDE, sino que da la bendita casualidad de que soy el coordinador encargado de la elaboración de una propuesta de Resolución común sobre el tema de la responsabilidad social de las empresas.

La realidad de que no se haya llegado a un acuerdo para votar mañana es que todos los Grupos, que hemos tenido 72 horas para trabajar sobre ese tema, hemos visto que había posibilidad de alcanzar acuerdos si nos dejan trabajar un poco más de tiempo.

Evidentemente, la posición del Grupo ALDE es que no está el Parlamento para tratar un problema concreto de una empresa —imagínense ustedes cuántas empresas hay—, sino para hablar de potenciar, de mejorar esa situación win-win que es la responsabilidad social de las empresas. Se trata de un excelente instrumento de las empresas que crea una situación win-win porque permite mejorar el diálogo social, permite a las empresas, sin duda alguna, mejorar su productividad, su competitividad y su imagen, y, a la vez, evidentemente, tiene unas repercusiones sociales muy favorables.

Por lo tanto, vamos a desarrollar, a adaptar, a mejorar lo que ya dijo, por ejemplo, la Comisión en 2013 sobre la responsabilidad social de las empresas. Sí he de decir que no conviene transformar el concepto, y ahí vamos a debatir bien hasta dónde puede llegar. Es un instrumento en manos de las empresas y es un instrumento para reaccionar socialmente ante las decisiones estratégicas de las empresas, pero no es un instrumento que tenga que fijar la estrategia de las empresas, sino que se va a adaptar de la manera más social; ni es un instrumento que jamás puede utilizarse para impedir la movilidad ni la libre instalación de las empresas ni sus estrategias a largo plazo y menos cuando se trata de ir de Europa a Europa. Eso también es verdad.

Reforcemos la responsabilidad social de las empresas, pero no la transformemos en un obstáculo a la creación de una Europa muy móvil, muy diversa y muy competente.

  Marco Affronte, a nome del gruppo Verts/ALE. –Signor Presidente, onorevoli colleghi, il problema della collocazione delle aziende è un problema ampio, nasce a causa di un sistema che abbiamo costruito, il sistema della globalizzazione di un mercato aperto e libero e che è sovrano su tutto quanto.

Il problema però è anche come l'Unione europea risponde a questo tipo di problemi e come risponde di fronte ai lavoratori della Whirlpool e dell'Embraco che sono qui ad ascoltare oggi questo dibattito. E noi come Parlamento forse non abbiamo la responsabilità di dover dare delle risposte concrete, ma almeno potevamo avere una risoluzione che dicesse come noi vogliamo rispondere a questo tipo di problematiche.

Risoluzione che invece domani non avremo, perché ci siamo presi un mese di tempo per pensarci, risoluzione che dovrebbe avere dei punti fermi per dire quali sono le risposte a questi problemi, per esempio, una tassa minima comune che sia condivisa fra tutti i paesi per evitare che i paesi si facciano concorrenza fra loro rubandosi le aziende e per esempio un uso chiaro, pulito e corretto dei fondi europei per evitare che le aziende che prendono questi fondi poi se ne scappino in un altro paese, cosa che appunto sta succedendo continuamente.

Queste sono le risposte che oggi forse i lavoratori dell'Embraco volevano sentirsi dire e che domani invece non avranno.

  Patrick Le Hyaric, au nom du groupe GUE/NGL. – Monsieur le Président, Madame la Commissaire, pour fonctionner, une entreprise bénéficie de nombreux moyens publics offerts par la collectivité: l’école et la formation, les services de santé et de protection sociale, les transports publics, les routes et des infrastructures diverses, et parfois même les crédits européens y contribuent.

Ces entreprises ont donc, vis-à-vis de la société et de leurs salariés, une responsabilité sociale, territoriale et écologique. Or, elles se préoccupent évidemment plus de leur taux de rendement au détriment de l’intérêt général. Nous devons donc définir un cadre contraignant fixant les responsabilités sociales. La RSE ne peut pas être un concept creux et sans efficacité comme j’en entends parler ici. Les délocalisations ou les réductions d’effectifs devraient être bloquées dès lors qu’il s’agit d’augmenter les profits boursiers. Lorsqu’il s’agit de modernisation technologique ou numérique qui fait augmenter la productivité, il faudrait encourager la réduction du temps de travail et favoriser des mises en formation.

La responsabilité sociale, c’est aussi un nouveau partage de la valeur, donc l’amélioration des salaires et le respect des entreprises sous-traitantes. Ceci doit nous conduire à créer un salaire minimum. C’est aussi payer ses contributions au bien commun, alors qu’une étude vient de montrer que les impôts des multinationales ont diminué de 9 % depuis 2008.

Oui, il y a bien urgence à fixer un cadre efficace, pas creux comme on l’entend ici, dans l’intérêt de toute la société.

  Tiziana Beghin, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, signora Commissaria, piuttosto che della responsabilità sociale delle imprese, questa sera bisognerebbe discutere della responsabilità sociale dell'Europa. Perché, come hanno già spiegato i miei colleghi, il fatto che l'Embraco tenti di trasferirsi in Slovacchia e mandare a casa 500 lavoratori è un problema, non tanto perché questa azienda ha necessità di trasferirsi per qualche motivo, perché è già in attivo, il problema è che è la struttura stessa dell'Europa che permette e incentiva questi comportamenti. Ed è inutile trovare soluzioni palliative, bisogna risolvere il problema alla radice.

Forse Bratislava ha usato i fondi europei per favorire sgravi fiscali, ma non sarebbe questo, e non è questo il punto. La Slovacchia è più competitiva dell'Italia anche perché, pur facendo parte dell'euro, ha una tassazione inferiore e un costo del lavoro minore.

Se l'Europa incentiva la circolazione del capitale tra Stati così diversi, dovrebbe almeno valutarne gli impatti sull'occupazione e sull'economia, e ovviamente attuare concrete misure compensative per le persone che perdono il lavoro.

La risposta dell'Europa è però troppo debole, e questo non mi stupisce, visto che nemmeno qui, dentro al Parlamento europeo, riusciamo a trovare un compromesso e votare domani una risoluzione sul caso Embraco. E vorrei che i lavoratori qui presenti sapessero che devono ringraziare l'ostruzionismo del Partito Popolare, dell'ECR, dell'ALDE, che cercano di cancellare ogni riferimento al caso Embraco.

Tra nove mesi la tregua negoziata a favore dei lavoratori di Embraco finirà, e queste 500 persone che sono qui questa sera, 500 famiglie, si troveranno di nuovo di fronte allo spettro della disoccupazione. Ecco, per allora, signora Commissaria, dovrà essere trovata una soluzione.

L'Europa deve porre fine alla concorrenza fiscale e sociale tra i suoi paesi, altrimenti inizierà una corsa al ribasso dove a perderci saremo tutti noi.

  Mario Borghezio, a nome del gruppo ENF. – Signor Presidente, onorevoli colleghi, c'è molta malafede in questo dibattito, la malafede di chi si è dimenticato di aver votato a cuor leggero per l'estensione dell'Europa a questi paesi dell'Est, che hanno una legislazione sociale e una situazione economica produttiva molto diversa e concorrenziale.

Si è innescata una guerra fra popoli, anziché fare l'Europa dei popoli, per gli interessi di chi voleva sfruttare questo allargamento all'Est per motivi finanziari. E allora, cara signora commissario Malmström, Lei non deve venire qui a raccontarci, come fa da anni, le solite balle sulle risposte quando ci sono queste crisi. Lei deve riconoscere gli errori gravissimi che ha commesso questa Europa dei banchieri.

Avete eletto presidente di questo governo europeo il teorico dell'evasione fiscale multinazionale, che vuole continuare evidentemente con voi a realizzare queste politiche di sopraffazione dell'economia reale di chi lavora e produce, piccoli imprenditori e gli operai che ce l'hanno in quel posto, è una vergogna, vi dovreste vergognare di fronte a questa gente, anziché continuare a fare i vostri giochi, con i vostri partiti complici che non hanno nemmeno il coraggio di scrivere nelle risoluzioni il nome di questa fabbrica, il nome, perché nella mia Torino la parola operaio si scrive con la "O" maiuscola, vergogna!

  Danuta Jazłowiecka (PPE). – Panie Przewodniczący, zanim rozpocznę wystąpienie, chciałabym prosić, żeby uspokojono galerię. Proszę Państwa, Państwo są tutaj tylko słuchaczami i nie powinni przeszkadzać nam w dyskusji. Będę Państwu bardzo wdzięczna.

Panie Przewodniczący! Tworzenie zachęt dla biznesu, aby był odpowiedzialny społecznie, jest niezwykle ważne. Szczególnie w dzisiejszych czasach, kiedy pogoń za zyskiem przesłania inne równie ważne aspekty. Przedsiębiorstwa, a szczególnie te większe, stanowią często integralną część danego obszaru geograficznego i stają się jednym z istotnych źródeł zatrudnienia i dochodu. Na szczęście coraz częściej przedsiębiorstwa tworzą rozmaite programy w ramach społecznej odpowiedzialności biznesu. Mam tego przykłady również w moim regionie.

Jestem jednak przekonana, że tworzenie programu w ramach społecznej odpowiedzialności biznesu powinno wynikać z woli danego przedsiębiorstwa. Nie powinno się wprowadzać takiego obowiązku legislacją europejską. Powinniśmy raczej skupiać się na zachętach dla przedsiębiorców, które mogą przyjmować różną formę – na przykład zachęt podatkowych, a także wizerunkowych. Należy zwiększyć świadomość konsumentów i przekonywać ich, że warto kupować produkty czy korzystać z usług przedsiębiorstw promujących dobre warunki zatrudnienia, ochronę środowiska czy wspierających lokalną społeczność.

Zaskoczyła mnie propozycja, by w ramach społecznej odpowiedzialności biznesu wprowadzić zakaz relokacji firm z jednego kraju do innego. Decyzja o modelu biznesowym oraz o miejscu działalności należy do firm. Jest to podstawowa, zagwarantowana traktatami wolność w ramach Unii Europejskiej. Uważam, że powinniśmy więcej uwagi poświęcić instrumentom, dzięki którym jesteśmy w stanie niwelować skutki relokacji i zapewnić pracownikom przekwalifikowanie lub inne atrakcyjne zatrudnienie. Europa ma instrumenty do wykorzystania w tym celu. Jednym z nich jest fundusz społeczny. Jego efektywne wykorzystanie może zapewnić równowagę między ochroną pracowników i swobodą zarządzania firmą.

  Tiziana Beghin (EFDD), Domanda "cartellino blu". – Collega, io vorrei chiederle – spero che sia stato un errore di traduzione – vorrei chiederle di chiedere scusa alle persone che ha appellato come "solo spettatori". Vorrei che si rendesse conto che quelle sono prima di tutto persone che stanno perdendo il posto di lavoro per queste regole, che effettivamente sono sui trattati: Lei ha parlato di libertà di stabilimento. Vorrei capire quale ricchezza crea, in una Unione europea, togliere il lavoro e il sostentamento a cinquecento famiglie per spostarle da un'altra parte, dal Suo punto di vista.

  Danuta Jazłowiecka (PPE), odpowiedź na pytanie zadane przez podniesienie niebieskiej kartki. – Mówiąc o słuchaczach, odniosłam się do hałasu, jaki powodowali słuchacze na galerii. Natomiast jeżeli chodzi o Pani pytanie, uważam, że bardzo ważne jest, byśmy grali w otwarte karty. Jeżeli na danym rynku firma ma problemy z utrzymaniem pracowników, zwalnia ich stopniowo po pięć, dziesięć osób i nie może skorzystać z żadnego innego instrumentu, należy wykorzystać instrumenty zapewnione przez Unię Europejską – na przykład fundusz społeczny, który pozwoli na przekwalifikowanie zwalnianych pracowników. Bardzo dużo przykładów w Europie pokazuje, że osoby te są wówczas jeszcze bardziej zadowolone z pracy, którą wykonują.

  Agnes Jongerius (S&D). – Mr President, I want to talk about two things tonight. First, I want the Commission to investigate cases where companies decide to relocate their production within the EU. We need to make sure that EU funds have not been used in such a way that they are actually creating competition between Member States.

Secondly, it is unacceptable that large companies can pretend to be socially responsible by developing social initiatives, or through charity, when, on the other hand, they are not paying the taxes they owe to society. I heard the Commissioner mention a roadmap, but can I please ask for an ambitious new action plan on corporate social responsibility (CSR) with legal requirements, with stronger reporting obligations and with more effective control mechanisms?

To come back to the question of taxes, this action plan should also include the disclosure of tax payments in CSR reporting. It is time to expose this hypocrisy, and for that I am counting on the Commission and its proposal before the end of the year.

  Heidi Hautala (Verts/ALE). – Mr President, Commissioner, I would also like to use this opportunity, a little bit like Ms Jongerius, to raise the concern that the Commission is not acting, even if the Council and Parliament have both called for such a comprehensive action plan on responsible business conduct. And I think most of us don’t understand why the Commission is not going to do this, because now, in the absence of actions at EU level, the Member States are acting. For instance, we see that France already has put in place a law on duty of vigilance; the Netherlands is fighting against child labour; and others are following: the UK, Switzerland and so on. We need a level playing field so that all companies would have to follow the same rules on corporate social responsibility. And by the way, I think this notion of corporate social responsibility is already a bit outdated. We should talk about corporate accountability, which is a broader subject, and we need European-level actions.

  Lola Sánchez Caldentey (GUE/NGL). – Señor presidente, promover el desarrollo sostenible, combatir la generación de residuos, proteger la biodiversidad, etcétera, etcétera. Estos son valores de responsabilidad social de Carrefour, pero podrían ser los de Mercadona, los de Embraco, los de Inditex o los de muchas otras.

La realidad es muy diferente. Muchas siguen transfiriendo actividades a países con mano de obra más barata, como el ejemplo de Embraco, que cerrará su filial en Italia para irse a Eslovaquia. Hacer campañas de marketing es totalmente legítimo, pero no confundamos publicidad con regulación, porque si lo hacemos, damos un paso más hacia el desastre.

Hay empresas que miran hacia otro lado cuando sus subcontratas usan mano de obra esclava. Es lamentable, pero «es el mundo, son las reglas del juego», me dirán muchos de ustedes. Precisamente eso es lo que hay que hacer: cambiar las reglas del juego, o, más bien, ponerle reglas al juego, porque ahora no existen. Estamos como en la selva.

No podemos dejar la vida de la gente y la vida sobre la tierra en manos de la buena voluntad de las empresas. Necesitamos leyes, leyes vinculantes, que hagan responsables a las empresas por las consecuencias de su actividad sobre la sociedad y sobre el mundo, y para que, si hay violaciones, por supuesto haya sanciones.

  Patrick O'Flynn (EFDD). – Mr President, it is not unreasonable to expect major companies to pay a fair share of tax and be aware of their effect on the societies in which they operate. After all, individuals with far less power and wealth are expected to meet these basic benchmarks.

The EU’s approach to corporate social responsibility is, in fact, not all that well developed. For many years the EU served effectively as a facilitator for tax-dodging by corporations, enabling smaller Member States, such as Luxembourg or Ireland, to strike sweetheart deals that eroded the tax bases of larger members. It is now attempting to construct a new system that will make profit-shifting and other aggressive avoidance more difficult within the EU, but this would be better done globally by the OECD. Other measures to improve corporate responsibility can be implemented at a national level, so long as governments are not shorn of powers to do so. For example, rules limiting the salary of the highest-paid employee of a corporation to a fixed multiple of the lowest-paid employee could be put to national electorates in elections.

Too often in recent years, the corporate sector has taken refuge behind high-profile, politically-correct sponsorship schemes which provide a sheen of good publicity, which is then used to camouflage a generally ruthless approach on such issues as importing cheap labour rather than training local labour. A survey published on Monday by the Financial Times showed that, over the past decade, the effective tax rate paid by multinational corporations has plummeted, even as the tax ramp on workers has got worse.

All of us on the right of centre in politics would do well, I think, to recognise that nothing has done more to undermine the standing of free-enterprise economics than the excesses of multinational corporations. Unless there is big improvement in their behaviour, it is likely to give radical leftists a way into power, bringing with them all kinds of prosperity-destroying ideas.

  Romana Tomc (PPE). – Veseli me, da je zavedanje o pomenu družbeno odgovornega obnašanja doseglo veliko podjetij, ki delujejo v Evropski uniji. Ne še čisto vsa, prav gotovo pa vsa tista, ki izkazujejo dobre rezultate poslovanja.

Ta se namreč zavedajo, da dolgoročnega poslovnega uspeha ni mogoče doseči, ne da bi pri svojem poslovanju upoštevali vplive na okolje in na ljudi.

Vendar družbena odgovornost ni nekaj, kar bi bilo mogoče uveljaviti čez noč. Gre za filozofijo, ki zahteva čas. Zato je pomembno, da o tem govorimo in poudarjamo pozitivne učinke, ki jih seveda ni malo. Podjetja, ki so družbeno odgovorna, so načeloma bolj uspešna na trgu, nudijo boljša delovna mesta in se bolj odgovorno obnašajo do varovanja okolja.

Kot članica Odbora za zaposlovanje me zanima predvsem vidik, povezan z zaposlenimi. Na tem področju se pozitivni rezultati kažejo v večji pripadnosti zaposlenih, večji motivaciji, manj bolniških odsotnosti in to vse seveda spet vodi v skupni boljši rezultat.

Zavedati se moramo tudi tega, da je ponekod družbena odgovornost zelo spodbujena z ukrepi države, z davčnimi olajšavami. In mi kot snovalci političnih smernic moramo podpirati dobre prakse na področju družbene odgovornosti, vendar opozarjam, moramo pri tem paziti, da podjetja ne obremenimo z novimi zahtevami in novimi obveznostmi. Tako bomo pridobili vsi: podjetja, zaposleni, okolje in družba kot celota.

  Evelyn Regner (S&D). – Herr Präsident, sehr geehrte Frau Malmström! Soziale Verantwortung von Unternehmen darf nicht bei Transparenz und freiwilligen Verhaltenskodizes aufhören. Was in Italien passiert ist, zeigt wieder mal deutlich: Wir brauchen einen europaweiten Rahmen zur Einbeziehung der Belegschaft in Unternehmensentscheidungen. Die Existenz von fast 500 Arbeitnehmern und ihren Familien wurde mit einem Schlag vernichtet. Wie kann die Kommission es rechtfertigen, dass es noch immer keine Richtlinie für Information und Konsultation für ganz Europa gibt?

Die Kommission muss sich auch im Rahmen der Debatte über die Zukunft der Europäischen Union Gedanken machen, wie wir den europäischen Rechtsrahmen für multinationale Unternehmen besser gestalten wollen. Die Jahrzehnte, in denen die Europäische Union allein den Shareholder-Zugang gestärkt hat, müssen vorbei sein! Die bis heute gelebte soziale Verantwortung der großen Konzerne folgt dem Verständnis eines Milton Friedman der siebziger Jahre des letzten Jahrhunderts. Er meinte, die CSR bestehe allein aus der Bereitstellung von Jobs und Steuern. Wie wir sehen, wird nicht einmal mehr das heute gelebt. Also brauchen wir diesen europaweiten Rahmen. Sehr geehrte Frau Malmström, setzen Sie sich dafür ein!

  Olga Sehnalová (S&D). – Pane předsedající, společenská odpovědnost firem samozřejmě není PR charita. Společenskou odpovědností firem rozumím vedle financování veřejně prospěšných projektů, firemních, environmentálních či sociálních politik i to, jakým způsobem svou činností ovlivňují atmosféru ve společnosti.

Bavme se tedy i o dvojích standardech. O pracovních podmínkách v mateřských a dceřiných firmách, o vztazích mezi produktivitou práce a mzdami, o placení či neplacení daní. Bavme se tom, zda firmy nevytvářejí zaměstnance a spotřebitele první a druhé kategorie, a to nejen z pohledu třetích zemí, ale i zde, v Evropské unii. I to může mít vliv na vztah lidí ke společnosti, ve které žijeme. Čeština má jedno přiléhavé doporučení: „Zamést si před vlastním prahem“.

  Sergio Gaetano Cofferati (S&D). – Signor Presidente, onorevoli colleghi, signora Commissario, come ha sentito incombe un dramma su 497 lavoratrici e lavoratori italiani. Potrebbero essere di qualsiasi altro paese europeo. Quello che conta è che questo pericolo lo corrono perché le regole europee non sono regole sufficienti.

Jacques Delors parlò per la prima volta di responsabilità sociale nel Libro bianco del 1993, chiedendo alle imprese comportamenti responsabili e chiedendo al Parlamento, già all'epoca, di definire delle norme che fossero efficaci.

Oggi non abbiamo queste norme. È vero che sono state riscritte più volte quelle che riguardano la responsabilità sociale, e l'abbiamo fatto anche di recente. Però c'è un vulnus: non sono obbligatorie. E quando queste regole sono semplicemente facoltative e mettono in discussione solo la reputazione delle imprese che non le rispettano, succede quello che stiamo commentando.

Perché Whirlpool ed Embraco hanno dei bellissimi volumi, che pubblicano tutti gli anni, sulla loro responsabilità sociale, dicono che sono sostenibili le loro attività, che sono socialmente e ambientalmente responsabili. Non è così! Dicono che hanno un ottimo rapporto con i territori e con le associazioni che li organizzano e li rappresentano. Non è così! Occorre cambiare le norme relative alla responsabilità sociale.

Poi io credo che sarebbe molto utile una cosa, un atto politico. La Commissione intervenga su Whirlpool. Contano molto di più i fatti, anche quelli piccoli o apparentemente piccoli, di tante dichiarazioni di principio. Se convocate l'azienda e chiedete all'azienda di cambiare direzione di marcia, rimettendo le cose al loro posto, avrete fatto un'eccezione rispetto alla regola, ma un atto politico del quale vi daranno atto molte persone.

  Ramón Jáuregui Atondo (S&D). – Señor presidente, han pasado ya casi veinte años desde que se publicó el Libro Verde, el primer gran documento que la Unión Europea elaboró para el fomento de la responsabilidad social de las empresas. Durante los diez primeros años, señora comisaria, la Unión Europea hizo muchas cosas y las hizo bien; en los últimos siete u ocho años, no ha hecho casi nada, casi nada.

La Unión Europea ha dejado de ser el instrumento de fomento de la responsabilidad social y la experiencia nos demuestra que, desgraciadamente, la voluntariedad se ha acabado convirtiendo en una especie de política en favor del marketing social y no de la responsabilidad social.

Aquí hay un problema grave, porque los ciudadanos, los trabajadores que nos acompañan hoy no creen en la responsabilidad de las empresas si no hay verdaderamente coherencia entre lo que es responsabilidad social y lo que es su comportamiento laboral.

Y esta es la demanda que yo quiero hacer: hace falta una política europea de fomento de la responsabilidad social; hace falta una política integral en favor de la responsabilidad social de las empresas en todos los ámbitos de su actividad laboral, fiscal, social, etcétera.

  Alessandra Mussolini (PPE). – Signor Presidente, onorevoli colleghi, i lavoratori dell'Embraco-Whirlpool non hanno solamente lo spettro del licenziamento a dicembre prossimo, loro hanno visto dei tagli ai loro stipendi di 300 euro, non hanno più la mensa, devono mangiare freddo, non hanno più i mezzi per andare al lavoro, vanno con i loro mezzi pagandoseli da soli.

Questa è una cosa gravissima. Quindi noi chiediamo, oltre all'unità sulla risoluzione che dobbiamo fare, molto forte, che sia interrotta, sospesa, cancellata qualsiasi iniziativa negativa contro i lavoratori. Perché noi dobbiamo smetterla con lo shopping fiscale in Europa, con lo shopping salariale, non possiamo parlare di questo: è gravissimo!

Qual è la responsabilità sociale di fronte a persone che hanno 55-58 anni? È difficile trovare lavoro a questa età. C'è una flessibilità in uscita molto facile, ma è difficilissimo avere una possibilità di entrata e di ricollocarsi.

Allora questa è ruberia sociale, si prende e si porta, magari anche con fondi pubblici regionali o addirittura dell'Unione europea. Bisogna interrompere qualsiasi azione negativa nei confronti di questi lavoratori che sono stati mandati via solo per un applauso. È gravissimo, Presidente!

  Nicola Caputo (S&D). – Signor Presidente, onorevoli colleghi, quello che sta accadendo all'azienda Embraco si chiama dumping sociale per salari più bassi, dumping fiscale per aliquote inferiori, ed è un comportamento deprecabile e irresponsabile perché non punta a valorizzare le risorse umane, ma a licenziare.

Embraco, che in passato ha beneficiato di sostegno e finanziamenti pubblici, dichiara di aderire ad un codice etico e ai principi del global compact delle Nazioni Unite, salvo poi dimostrare una pratica aziendale tutt'altro che improntata ai principi di responsabilità sociale.

La responsabilità sociale delle imprese deve divenire invece elemento fondamentale delle politiche europee ed essere un requisito indispensabile per accedere ai fondi pubblici e per partecipare ad appalti. I fondi europei non possono essere usati per trasferire posti di lavoro.

Mi aspetto quindi che la Commissione europea adotti provvedimenti esemplari, qualora dovesse essere confermato che gli incentivi messi in campo dal governo slovacco costituiscono una violazione delle norme sugli aiuti di Stato. I sussidi pubblici non possono in alcun modo avvantaggiare alcuni paesi membri a scapito di altri all'interno del mercato unico.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, εταιρική κοινωνική ευθύνη σημαίνει ότι οι επιχειρήσεις πρέπει να φορολογούνται εκεί όπου βγάζουν τα κέρδη. Και φυσικά αυτό δεν συμβαίνει, διότι η πολυεθνικές αξιοποιούν τους φορολογικούς παραδείσους, και έτσι φοροδιαφεύγουν, φοροαποφεύγουν. Δισεκατομμύρια πλέον δεν πηγαίνουν στους προϋπολογισμούς των κρατών μελών.

Αλλά βέβαια σε αυτό σιγοντάρει και το ECOFIN, το οποίο με πρόσφατη απόφασή του στις 23 Ιανουαρίου έβγαλε τον Παναμά από τη λίστα των φορολογικών παραδείσων, και αυτό με τη συμφωνία της ελληνικής κυβέρνησης, του κυρίου Τσακαλώτου, και μάλιστα χθες συνέχισε το ίδιο πράγμα: Πάλι με σύμφωνη γνώμη του κυρίου Τσακαλώτου και της Ελλάδας, το ECOFIN αφαίρεσε άλλες τρεις χώρες από τη μαύρη λίστα των φορολογικών παραδείσων, μεταξύ των οποίων και τα νησιά Μάρσαλ. Είναι δυνατόν να συνεχιστεί αυτή η κατάσταση;!

Από κει και πέρα μνημείο κοινωνικής ανευθυνότητας των επιχειρήσεων είναι φυσικά οι μετεγκαταστάσεις. Αφού πήραν τα χρήματα της Ευρωπαϊκής Ένωσης, μετεγκαθίστανται πλέον σε άλλες περιοχές και αφήνουν χιλιάδες ανέργους. Κλασσικό παράδειγμα η Embraco, που έφυγε από την Ιταλία για τη Σλοβακία.

  Kateřina Konečná (GUE/NGL). – Pane předsedající, jsem přesvědčena, že téma společenské odpovědnosti firem je jedno z těch vůbec nejzásadnějších, které bychom měli v jednadvacátém století vyřešit. Považuji za naprosto nepopiratelný fakt, že stejně tak jako každý jednotlivec a stát, tak i firmy a korporace mají obrovskou odpovědnost za stav tohoto světa. Pokud budou firmy degradovat životní prostředí a zneužívat levné pracovní síly, tak se nám tady bude těžko hovořit o lidských právech a ochraně klimatu. Pokud nebudou firmy a korporace platit daně a budou je raději „ulívat“ do daňových rájů, pak tady budeme mít další a další vyšetřovací komise. Daně budou platit ti, kteří „ulívat“ peníze neumí, a budeme řešit nedostatek prostředků na důchody. Toto není udržitelný stav, toto je v centru budoucích krizí, toto ukazuje na nespravedlnost současného systému. A my musíme konat a to hned.

  Bogdan Andrzej Zdrojewski (PPE). – Panie Przewodniczący! Oświadczenie Komisji chyba nie zostało zrozumiane. Mam wrażenie, że interpretacja tego dokumentu jest zbyt często rozszerzająca, a w niektórych podanych egzemplifikacjach niezbyt precyzyjna. Odpowiedzialność, o której mówimy jako o odpowiedzialności społecznej za aktywność firm europejskich i podwykonawców na zewnątrz, poza Europą, jak i ze względu na skutki uzyskiwane tu w Europie, musi być mocno zrewidowana. Mam wrażenie, że ten dokument powinien być bardziej adekwatny, bardziej aktualny i jednocześnie lepiej odpowiadający zasadzie, która jest powszechnie przyjęta – że odpowiedzialność firm to nie jest żadna łaska, że ewentualne skutki społeczne nie oznaczają czynienia na rzecz swoich pracobiorców jakiegoś nadzwyczajnego wysiłku. To jest po prostu przewidywanie określonych skutków, które mają bardzo szerokie, bardzo globalne znaczenie i takie też efekty aktywności. Natomiast na koniec dodam tylko jedną rzecz. Nie może być tak, że wymaga się tego od Europy, od podmiotów europejskich, a nie stosuje wobec podmiotów zewnętrznych.

  Julie Ward (S&D). – Mr President, the EU’s policy on corporate social responsibility should include a gender aspect. Here are some specific measures the Commission can take. Firstly, encourage corporations to increase the representation of women and LGBTIAQ+ in management positions and at all levels. Secondly, support lifelong learning for women at work, including trade union learning, particularly in male dominated sectors. Thirdly, ensure adequate work conditions and rights for women and LGBTIAQ+ people throughout the supply chains. Fourthly, avoid sourcing material from conflict areas where there is widespread gender-based violence.

With regard to ethics and CSR, can I applaud the tireless work of the ‘Art Not Oil’ coalition whose powerful culture and sustained campaign depicting oil soaked birds was successful in persuading the Tate Art Gallery to dump the multinational BP.

  Michaela Šojdrová (PPE). – Pane předsedající, společenská odpovědnost firem je stále populárnější téma. Klade důraz na to, aby podniky při své činnosti dobrovolně zohledňovaly ochranu lidských práv, životního prostředí a další společenská kritéria. Jen chci připomenout, že to není nic nového. Již před devadesáti lety firma Tomáše a Jana Baťových věděla, že se musí o své zaměstnance starat, pokud má být dlouhodobě udržitelná. Nešlo jim totiž jen o svůj vlastní zisk.

Společenská odpovědnost firem by měla zůstat převážně dobrovolná. Nemůžeme přece firmám přikázat, že musí podnikat pouze na určitém konkrétním místě. Já ale rozumím kolegům z Itálie, rozumím také zaměstnancům, kteří se sem přišli prezentovat, rozumím jejich obavám a jejich pohnutkám, nicméně myslím, že to je především v tomto případě italská vláda a vlády národních států, které se musí angažovat se svými pobídkami a podmínkami pro výhodné podnikání firem.

  Cecilia Malmström, Member of the Commission. – Mr President, we are discussing many different, very important issues today. The subject of this debate, as communicated to the Commission, was corporate social responsibility. Now we are on a much wider agenda. As I said, the European Union does a lot on corporate social responsibility, inside and outside Europe. We can always do more, of course, and that is why we have set up this multi-stakeholder platform to give us input and ideas, and we are also carrying out an internal assessment to see whether there are loopholes or things we can do better. And I have taken good note of things you said.

The granting of regional investment aid, however, that involves the relocation of jobs from elsewhere in the EU is subject to strict Commission control. The state aid rules provide safeguards to prevent Member States from using public money to incentivise the relocation of jobs from one country in the EU to another. That is at the heart of fair competition in the internal market, and it is why, as long ago as 2014, we introduced specific conditions to ensure that regional investment aid cannot be granted to incentivise the relocation of jobs and business activities from one country to another. Arrangements were strengthened in 2017 to ensure that these rules work well in practice.

The company the honourable Members are referring to today has not received any support under regional development funds in Italy. We have contacted Slovakia to investigate whether any investment aid was given to Embraco from them, and we are still awaiting a response. We, as the Commission, can act under state aid rules only if companies or sectors get a selective advantage that is not available for everyone, and we work to ensure that the general labour and taxation rules in Europe work for everybody.

Should you have any indication that state aid might have led to relocation, my colleague Commissioner Vestager and her staff are ready to have a look at the relevant information. And, as I said, we are working constantly in a dialogue, not only with big, small and medium-sized companies but also with NGOs, with stakeholders and with trade unions and labour organisations, to see how we can endeavour to improve corporate social responsibility.

Then on the tax issue, that is a totally different issue – related, I agree, to a certain extent, but subject to other types of activity and legislation – which was discussed in this Chamber earlier today, I think.
