  Merja Kyllönen, Rapporteur. – Mr President, I am a very pragmatic Finnish MEP who always wants to know and understand how the legislation that we create can work on a daily basis. I have worked for almost 12 years with transport legislation, so I dare to say that I have also got to know what works in this area and what does not. The report is the result of long and intense negotiations in the Committee on Transport and Tourism (TRAN).

The result is a balanced and fair report with enforceable and smart rules and careful consideration of the cross-border nature of international road transport. We did check the other opportunities: we counted salaries, working hours, prices of loads with specialists, and came to the conclusion that without huge bureaucratic burden, it is impossible to add the Posting of Workers Regulation to international transport and transit in a fair game. So there is a real reason why the lex specialis needs to exist.

Whatever we decide tomorrow, it will shape the way in which international road transport will be performed within the EU. We either make sensible workable legislation, or create chaos if we choose that. We need to do it with understanding what we are doing, so please consider this.

The posting rules are legally and practically inapplicable to drivers who work on a daily, or even hourly, basis in different Member States. Why would we knowingly make legislation that does not work? The TRAN report is the result of intense discussions with relevant stakeholders from both the employees’ and the employers’ sides. The TRAN report respects the highly mobile character of international transport, but imposes posting on cabotage and combined transport from day one to prevent unfair competition on the domestic markets. This is a significant improvement to the situation today. Only international transport and transit is excluded, and there are several good reasons for why they are excluded. But you all need to understand that this doesn’t mean that drivers from countries with lower living standards working in international transport operations are out of social and economic protection. We already have existing legislation such as Rome I: you just need to insert the enforcement in your own Member States. You also need to understand that the general posting of workers was never intended for mobile professions such as drivers, pilots, air crew, train drivers, seafarers and inland waterway workers in international transport.

The absolute majority of transport organisations and companies support TRAN’s, opinion as they all know that it can really work. The TRAN report restricts red tape and safeguards SMEs’ interests, leads to better enforcement and social protection, and respects the very special nature of a highly mobile workforce. We want to end up making legislation that will make it obligatory to apply up to 20 different national legislations a month with up to 50 different minimum wages, depending on the seniority of the driver, the truck, on the goods transported, and so on. This is what applying the posting rules to the drivers of international transport does. It is impossible to apply it in practice, and the transport companies and drivers themselves know it. We would create risk, pushing all the drivers into bogus self-employment, so let’s not do that.

  Wim van de Camp, Rapporteur. – Voorzitter, als je over EU-transportbeleid spreekt, dan spreek je over het toonbeeld van de interne markt. Wij willen als Europees Parlement vrij verkeer van goederen en personen zonder al te veel administratieve overlast. Maar wij willen ook een sociaal beleid en een sociaal beleid dat de chauffeurs in ieder geval ondersteunt en helpt. Maar zoals mevrouw Kyllönen al zei, we hebben een mobiele markt en de mobiele markt vraagt meer flexibiliteit.

Ik wil hier nogmaals herhalen dat de EVP-fractie van mening is dat het pakket dat de Transportcommissie heeft voorgesteld, waarbij we de drie dossiers (namelijk de detachering, de cabotage en de rij- en rusttijden) in een evenwichtige balans hebben samengevoegd, dat dat een evenwichtig pakket is.

Maar voorzitter, wij zijn niet blind. We hebben natuurlijk de stemming van juni als een nederlaag ervaren en wij moeten bewegen. Ook de EMPL-commissie heeft een duidelijke opvatting over wat hier gaat en moet gebeuren. In mijn dossier over de rij- en rusttijden hebben we een aantal amendementen overgenomen van EMPL, die hopelijk de zaak meer in balans kunnen brengen en die morgen ook leiden tot een positief stemresultaat. Ik heb de referentieperiode van vier weken teruggebracht naar twee weken omdat wij de rust van de chauffeurs fatsoenlijk en evenwichtig willen hebben.

En dan, Voorzitter, de parkeerplaatsen. Ik moet u eerlijk zeggen dat ik merk dat vele mensen niet begrijpen wat in mijn verslag over die parkeerplaatsen wordt gezegd. Wij respecteren de uitspraak van het Europees Hof: normaliter geen rust langs snelwegen op slechte parkeerplaatsen. Je mag alleen de rust, ook de weekendrust, doorbrengen in goede parkeerplaatsen die voorzien zijn van alle veiligheids- en sanitaire maatregelen. Het blijft dus een uitzondering om op de parkeerplaatsen te slapen en niet de regel. Het is misschien goed in deze tijden van fake nieuws om dat nog eens even te herhalen. Ik doe met name een beroep op mijn collega's van de S&D-fractie, die een eerder compromis op dit punt hebben gesteund en waarop ikzelf heb gesteund en die vervolgens nu lijken af te haken.

Voorzitter, een speciaal element is het onderscheid tussen vrachtverkeer en personenvervoer. Personen zijn geen containers en containers zijn geen personen. Op een aantal punten hebben wij een onderscheid aangebracht opdat die twee stromen fatsoenlijk, maar ook sociaal, naast elkaar kunnen functioneren.

Dan tot slot dit, Voorzitter: als wij morgen niet tot een akkoord kunnen komen, zal de liberalisering van de markt zich ongewijzigd voortzetten. Wij zien nu reeds de nodige transportbedrijven uit Oekraïne, Belarus en Turkije zich op de Europese markt bewegen zonder enige vorm van sociale bescherming, zonder enige vorm van interne marktregulering. En dat moeten wij niet willen.

  Ismail Ertug, Berichterstatter. – Herr Präsident, liebe Kolleginnen und Kollegen, Frau Kommissarin! Zunächst einmal geht mein Dank an die Kollegen Berichterstatter der anderen Dossiers und an alle Schattenberichterstatter, denn sie wissen ganz genau, was wir in den letzten Wochen und Monaten geleistet haben und wie schwierig es war, tatsächlich am Ende auch zu den Kompromissen zu kommen.

Ich denke, dass wir hier in diesem Hohen Haus eine Entscheidung zu treffen haben, wie nämlich der Transportsektor in der nächsten Dekade organisiert wird. Und ich glaube auch, dass das Schicksal von drei Millionen Fahrerinnen und hauptsächlich Fahrern auf dem Spiel steht. Die Frage von Beginn an war und ist, dass wir ein level playing field wollen und gleichzeitig auch keine Möglichkeit zulassen sollten, dass Sozialdumping zu einem Geschäftsmodell wird.

Zu den dossierübergreifenden Errungenschaften dieses Hauses will ich erwähnen, dass wir eine frühere Einführung des sogenannten intelligenten Fahrtenschreibers haben werden, nach unserer Auffassung ab dem Jahr 2022. Und wir haben es auch geschafft, dossierübergreifend zu vereinbaren, dass nationale elektronische Register eingeführt werden, die auf europäischer Ebene durch das ERRU zusammengefasst werden. Denn eines ist, glaube ich, klar: dass die besten Regeln nichts helfen, wenn wir sie nicht umsetzen und kontrollieren können.

Zu dem Posting-Dossier geht, wie gesagt, mein Dank in besonderer Weise an die Kollegin Merja Kyllönen. Ich denke, dass die Entsenderichtlinie allen Arbeitnehmerinnen und Arbeitnehmern zugutekommen muss, und ich glaube nicht, dass wir hier mit dem Mobilitätsbereich einen Präzedenzfall schaffen sollten. Denn was kommt als Nächstes? Vielleicht das Handwerk oder auch die Pflege? Das dürfen wir nicht machen. Deshalb: Lassen Sie uns das mit hineinnehmen!

Und wenn wir uns über einen Kompromiss unterhalten, dann steht eben dieses sogenannte dänische Modell auf dem Tablett. Und das, würde ich meinen, könnten wir alle ruhigen Gewissens entscheiden, denn es verhindert Sozialdumping, ist besser kontrollierbar, gibt weniger bürokratische Hürden und hilft den Unternehmen, die ihre Arbeit ehrlich machen und ihre Leute ordentlich bezahlen.

Bei den Lenk- und Ruhezeiten unterstützen meine Fraktion und ich größtenteils den Vorschlag des Beschäftigungsausschusses. Denn es hat keinen Sinn, die Lenkzeiten unendlich auszuweiten, was in vielen Bereichen ja auch vom Berichterstatter verhindert worden ist.

Wir können auch positiv vermerken, dass die Fahrerinnen und Fahrer alle drei Wochen nach Hause fahren sollten. Das große Problem auf den europäischen Autobahnen besteht heutzutage ja darin, dass wir Modelle haben, die drei Monate Arbeit fern von zu Hause vorsehen und einen Monat Urlaub zu Hause ermöglichen. Das kann im 21. Jahrhundert nicht die Antwort der Europäischen Union für die Bürgerinnen und Bürger sein. Deshalb, meine ich, ist das der Weg, den wir gehen sollten. Auch die Einbeziehung der sogenannten leichten Nutzfahrzeuge ist richtig, denn wir sehen immer mehr eine Verlagerung weg von den großen Lkw hin zu den sogenannten Sprinterklassen, die ohne Tacho, ohne Lenk- und Ruhezeiten, ohne jegliche Kontrolle auf europäischen Autobahnen ihr Unwesen treiben. Deshalb haben wir auch, wenn ich die Kabotage abschließend nennen darf, die Kabotage gesteuert, und wir haben sie dort, wo sie zu einem Wildwuchs geführt hat, auch eingehegt und mit Restriktionen belegt. Es wird weiterhin eine Regelung geben, die letztendlich die Briefkastenfirmen verhindern wird, und wir haben auch neue Zulassungskriterien für die leichten Nutzfahrzeuge durchgesetzt.

Abschließend kann man sagen, dass wir all den Unternehmen, deren Geschäftsmodell darauf beruht, sich durch Sozialdumping Vorteile zu generieren, dass wir diesem Geschäftsmodell klare Kante zeigen müssen.

Abschließend will ich nochmals meinem Vorgänger, unserem Kollegen Jens Nilsson danken, der leider vor kurzem verstorben ist.

  Martina Dlabajová, zpravodajka Výboru pro zaměstnanost a sociální věci. – Pane předsedající, již delší dobu s velkým politováním pozoruji, že se diskuze o balíčku mobility změnila v čirý ideologický boj a bohužel ve výboru EMPL ještě více než jinde. Málokdo si ale uvědomil, že ve hře nejsou jen řidiči a dopravci. Populistická řešení ohrožují základní principy EU, náš společný trh a společnou budoucnost.

Podvodům na trhu mezinárodní silniční dopravy nezabráníme uplatňováním stejných pravidel, která byla ušita na míru třeba stavebnictví. Nejen že to je v praxi neproveditelné, ale zároveň to způsobí obrovské škody na vnitřním trhu a ohrozí dopravní služby.

Ty největší problémy v dopravě, které se vztahují ke kabotáži, řidičům-nomádům, letter-box companies a vymahatelnosti pravidel, podchytil Výbor pro dopravu. Tam se na rozdíl od Výboru pro zaměstnanost a sociální věci podařilo nalézt řešení, které zajišťuje dostatečnou vyváženost. Vyzývám proto všechny, aby nepodporovali politikaření a nedodržování předjednaných dohod.

  Georges Bach, Verfasser der Stellungnahme des mitberatenden Ausschusses für Beschäftigung und soziale Angelegenheiten. – Herr Präsident, Frau Kommissarin! Als Berichterstatter im Beschäftigungsausschuss war ich mit der Mehrheit der Meinung, dass eine weitere Flexibilisierung nicht notwendig sei. Das heißt, eine weitere Deregulierung, eine Liberalisierung der Lenk- und Ruhezeiten ist nicht angebracht. Wir haben flexible Zeiten, wir haben genügend Ausnahmeregelungen, und deshalb könnten wir es eigentlich dabei belassen. Deshalb bin ich froh, dass wir die Möglichkeit haben, als Beschäftigungsausschuss die Vorschläge noch mal vorzubringen. Ich danke auch dem Koordinator des TRAN-Ausschusses, dass er verschiedene Kompromisse gefunden hat.

Zur Entsendung: Zur Entsendung bin ich der Meinung, dass die Fahrer natürlich Teil des funktionierenden Binnenmarktes sind und dass sie unbedingt als entsendete Arbeitnehmer anerkannt werden müssen. Das heißt, wieso soll ausgerechnet ihnen der gleiche Lohn für die gleiche Arbeit am gleichen Ort vorenthalten werden? Und wieso sollen wir ausgerechnet in diesem Sektor Sozialdumping legalisieren?

  Violeta Bulc, Member of the Commission. – Mr President, thank you for organising today’s debate about three very important parts of the so-called Mobility Package 1. Let me stress that the social and market aspects of road transport are two sides of the same coin. That is why these legislative proposals have been put forward jointly, and it is why they should continue to be discussed and adopted together. If one of them fails, the interlinked social and market problems will not be solved. In other words, it is truly a ‘package’ approach.

First, allow me to say few words on the posting of workers in road transport. Thank you, Ms Kyllönen, for your constant efforts to find solutions on this very sensitive and difficult topic. The sector needs rules on posting which are clear, fair and well adapted to the highly mobile nature of transport activities. In short, we really need this lex specialis.

I am glad to see that the report is comprehensive on the enforcement measures of posting. I welcome your ideas on the further use of digital solutions to make compliance and controls easier. As you do, we support a tight list of requirements to ensure legal certainty. I equally welcome your amendments aimed at reinforcing the principle of co-liability for infringements of the posting rules throughout the operational chain.

It is more difficult to find a balanced solution on when these posting rules should apply. For the Commission, there is no doubt that cabotage operations should be subject to posting rules from the very first day, and the proposed clarification that transit does not constitute posting is also very welcome. When it comes to the application of posting rules to international service, I want to make it clear that the Commission supports neither full exclusion nor full inclusion. As the Commission sees it, we need to distinguish between international operations that are very occasional and those where drivers spend substantial amounts of time in the host country.

Let me now comment briefly on the amendments on driving and rest-time rules and on tachographs – thanking Mr de Camp who had to work on a huge number of amendments. I am glad that Parliament and the Commission seem to share the same ambition of making the social legislation fit to address the needs of workers and companies in the road transport sector. It is crucial to provide for adequate resting conditions for drivers and to ensure they can return home regularly – in the interest not only of better working conditions but also of road safety. In this context, suitable parking and resting infrastructure is essential. Therefore the Commission sees some merits in the rapporteur’s proposal on dedicated parking areas where drivers could spend rest time in a comfortable, safe and secure environment. The work of drivers, operators and enforcers will certainly be facilitated by swifter introduction of smart tachographs.

Enforcement authorities would also benefit greatly from real-time access to relevant databases such as the European Register of Road Transport Undertakings (ERRU), and I therefore welcome the amendments introducing those necessary measures. However, there are three issues on which I would call for caution. First, in relation to rest-time rules applicable to passenger transport: allowing bus drivers to delay their daily rest or to take it in shorter parts could jeopardise passenger safety. In addition, such derogations would make controls more complex. Road safety should always remain as first priority. Second, in contrast to the situation with regular weekly rest, spending reduced weekly rests in a vehicle has not been identified as a problem during our public consultation and impact assessments. So we do not see a need to change the existing rules here.

Third, on the extension of the scope of the social rules to include light commercial vehicles below 3.5 tonnes, the Commission has proposed the inclusion of such small vehicles within the scope of the rules on access to the profession. It is important to remain proportionate in our approach.

Finally, turning to Mr Ertug’s report on access to the profession and access to the market, I would like to thank the rapporteur for his work on many issues addressed in his report. I believe there is a broad consensus, in particular, on stepping up the fight against letterbox companies, with reinforced criteria to determine where hauliers must be legally established; on regulating light commercial vehicles involved in international transport so that those vehicles are not used to circumvent our legislation; and also on accelerating digitalisation, using electronic tools which should become standard in this sector.

We generally welcome the solutions proposed on these issues but there are two aspects on which we have some concerns. First, on cabotage, the Commission proposal aims at fighting illegal cabotage and improving the enforcibility of EU rules without changing the existing level of market access. Some amendments, however, are very restrictive and could discourage cabotage – with a negative impact on the efficiency of logistics networks and the environment. They would also make the rules much more complex and difficult to enforce. Second, on the establishment criteria, we fully support obliging hauliers to manage their activity from their Member State of establishment but we disagree with obliging them to conduct loading and unloading with a certain frequency in that same Member State. Such a new obligation could have a negative impact, particularly by increasing empty runs.

To conclude, I would like to underline the point that, for this mobility package, time is of the essence – and I mean it! The sector is urgently awaiting clear, enforceable and fair EU rules. It cannot function smoothly in a patchwork of uncoordinated and inefficient national rules, so the status quo is therefore not an option. We are talking about the development of a single market. Let’s not go backwards.

I know this sense of urgency is largely shared within this House, and the timetable is intended to have the new rules adopted before your elections. It is, however, possible to find a way forward and I feel that, if we stay at the table and talk and negotiate, we have a chance to move on and to give European citizens and businesses what they need in order to stay competitive and fair, to contribute to climate-change action and, of course, to continue developing their operations.

  Verónica Lope Fontagné, ponente de opinión de la Comisión de Empleo y Asuntos Sociales. – Señor presidente, como ponente de opinión de la Comisión de Empleo y Asuntos Sociales, reconozco que el texto de la Comisión de Transportes y Turismo ha conseguido un equilibrio entre las distintas realidades existentes en la Unión Europea. No es lo mismo cruzar toda la Unión Europea desde España, Portugal o Polonia que operar desde Francia, Bélgica o Alemania, donde las distancias que tienen que recorrer los transportistas son mucho más cortas.

La Directiva sobre el desplazamiento de trabajadores se aplica al cabotaje desde el día uno, por lo que la remuneración percibida será la misma que la del trabajador local, así que no es cierto que los trabajadores queden desprotegidos.

Además, la obligación de volver al Estado miembro de establecimiento junto con unos mayores y mejores controles ayudarán a luchar contra el cabotaje de larga duración y contra las denominadas «empresas buzón», que son el verdadero problema.

Por supuesto que es importante defender a los trabajadores – para eso trabajamos –, pero lo que no podemos hacer es utilizarlo como un pretexto para fines proteccionistas. De lo contrario, iríamos en contra del mercado único, de la libre prestación de servicios, del libre comercio y, en definitiva, contra los valores que defiende la Unión Europea.

  Andor Deli, on behalf of the PPE Group. – Mr President, we should not be debating as if we had a blank slate, or as if we were at the start of the process. Tomorrow we shall have the final votes. Indeed, we in the Committee on Transport and Tourism have worked very hard and managed to achieve a very good compromise package, which will prevent fragmentation of the transport market and give protection to companies, workers and, last but not least, consumers – and by that I mean the citizens of Europe.

We also received a lot of letters in support of the TRAN Committee position from all parts of Europe, from Romania to Denmark and also from Germany, which clearly proves that the TRAN position is valid and balanced. I would call on all colleagues to support the TRAN position tomorrow during the vote. The transport sector is a highly mobile sector. It cannot fit into the regular posting of workers’ regime. We must not play with the transport companies, as that might be fatal for the competitiveness of the European industry and would jeopardise jobs and core fundamental freedoms of the European internal market. Also, politically speaking, the TRAN Committee position could help to move western and eastern, and northern and southern, parts of Europe closer together, and that is clearly essential at this moment in time. Otherwise I am afraid that we might make the divide even worse.

  Kathleen Van Brempt, on behalf of the S&D Group. – Mr President, let me first be very glad that we have this discussion and a plenary vote tomorrow. It’s about democracy; it’s not about one committee versus another committee. Second, let me outline why that is so important: it is important for the work of the internal market, but more so for the protection of our people working in that sector. That brings me to the driving and rest time: I think it’s extremely important that we have the two—week reference – and I thank the rapporteur for going along with our Group on that. But also make sure that their weekend rest is outside of the cabin, Mr van de Camp – that is extremely important. Second, on the posting, Ms Kyllönen, we cannot follow your line and leave five million EU workers out of the posting. I think people in this sector are equal people who deserve protection as well.

And last, let me thank Ismail Ertug, who found a very good compromise on the cabotage, and I also thank our former rapporteur, Mr Jens Nilsson, who did a wonderful job on that as well.

  Kosma Złotowski, w imieniu grupy ECR. – Panie Przewodniczący! Szanowna Pani Komisarz! Właściwie mógłbym powiedzieć wszystko to, co powiedział pan poseł Delii, i nie będę się już powtarzał, bo chcę teraz zwrócić uwagę na jeszcze inny aspekt tej sprawy. Otóż dwa razy tutaj padło określenie dumping socjalny. To jest zarzut wobec pracowników z Europy Wschodniej, że stosują dumping socjalny. Cóż to jest dumping? Dumping zachodzi wtedy, gdy ktoś sprzedaje towar poniżej ceny jego wytworzenia. U nas, na wschodzie Europy praca jest jeszcze tańsza, dlatego że i wszystkie inne produkty są tańsze, życie jest tańsze. Dlaczego nie możemy konkurować również płacą? To jest pierwsze pytanie.

I drugie pytanie. Pan Jean-Claude Juncker powiedział na początku kadencji „ta sama praca, ta sama płaca”, ale odwróćmy to i powiedzmy „ta sama płaca za tę samą pracę u tego samego pracodawcy”, i wtedy niech kasjerka w Auchan w Paryżu zarabia tyle samo co ta w Bydgoszczy albo odwrotnie. To znaczy, że w drugą stronę można wykorzystywać różnice płacy, a w tę stronę nie? To jest droga dwukierunkowa i proszę Panią Komisarz, aby wzięła to pod uwagę.

  Pavel Telička, on behalf of the ALDE Group. – Mr President, I will not speak as shadow to one of the files. I will speak primarily as a coordinator – as someone that was present in the majority of the debates, in a number of the agreements, a number of the deals. This is not the time to put in danger social rights. This is not the time to put at risk businesses, including small businesses. This is not the time to put at risk the internal market, and therefore growth and jobs, but many of the amendments are doing exactly that. I think that we should take that into account. We should provide support to the Committee on Transport (TRAN) arrangements, because this did form a complex solution.

Ms Van Brempt, you have referred to your colleague Mr Ismail Ertug. He will tell you that if it were not for me, we would have never had the agreement on cabotage. But at the same time, we have made it clear that this is linked to posting, so that we don’t establish obstacles to the functioning of the internal market. How do we want to calculate – I mean, in terms of hours – the salary if a truck crosses the border of three countries in five or seven hours? Impossible.

So let’s give it a chance. We’ve got a good deal. We’ve got a compromise. Let’s support it. That’s the only way if we don’t want to endanger social rights, businesses and the internal market.

  Karima Delli, au nom du groupe Verts/ALE. – Monsieur le Président, Madame la Commissaire, chers collègues, depuis quelque temps, nous croulons sous les fake news, vous savez, ces fausses informations propagées sur l’internet. Certains, ici, s’en font même les relais. Que nous disent-ils sur la réforme sociale du transport routier? Ils nous disent: «nous allons protéger les salariés. Comment? C’est tout simple : en allongeant leur temps de travail et en fractionnant leur temps de repos». C’est cela que vous appelez «protéger les salariés»? Première fake news. Ils disent mieux. Ils veulent protéger les salariés en rognant les quelques droits sociaux conquis au niveau européen comme le détachement des travailleurs. Deuxième fake news. Puis, ils nous disent: «on va protéger les conditions de travail des salariés». Vous savez comment? En les faisant dormir dans leur cabine, ce qui est pourtant contraire à l’avis de la Cour de justice.

Mes chers collègues, si vous tenez tant au repos sur le lieu de travail, montrez l’exemple. Chaque nuit passée à Bruxelles ou à Strasbourg, dormez dans votre bureau puisque, nous aussi, eurodéputés, nous avons des banquettes à disposition.

La vérité, c’est que certains voudraient, avant tout, faire des routiers des salariés de seconde zone. Pire, des esclaves modernes dans un marché européen open bar, sans règles ni lois. Ce n’est pas seulement un danger pour des millions de salariés du transport routier en Europe, c’est dangereux pour nous tous et nous toutes, car un conducteur fatigué, c’est un danger public sur la route qui met des vies en péril.

Enfin, je vous mets en garde, chers collègues: votre démarche est politiquement dangereuse, car la réponse des peuples à la jungle sociale, c’est la colère.

Alors, demain, il va falloir choisir entre l’Europe qui divise ou l’Europe qui protège. Maintenant, la balle est dans votre camp.

  Marie-Pierre Vieu, au nom du groupe GUE/NGL. – Monsieur le Président, d’abord, je tiens à saluer la campagne des syndicats de routiers qui nous alertent depuis des mois sur leurs conditions de travail, sur la pénibilité, sur l’exploitation parce que 32 degrés sur l’aire d’autoroute de Weimar dans des cabines sans climatisation, ce n’est pas du social, c’est de l’exploitation.

Ce vote est important, car il s’agit de choisir le modèle que nous voulons pour le transport routier. Soit nous renforçons le choix du dumping social qui est celui de la logique des textes qui nous sont proposés et cela aboutit à l’exclusion de la large majorité des routiers du statut de travailleurs détachés, à l’allongement du temps de travail, à plus de précarité, soit nous faisons le choix du progrès et alors c’est lutter contre les abus, c’est sécuriser les parcours face à la concurrence prédatrice, c’est décider d’aller vers un modèle ambitieux pour le transport routier européen.

Nous voulons le respect du principe à «travail égal, salaire égal», avec le détachement au premier jour, l’interdiction du repos en cabine et le renforcement des contrôles sur route.

J’appelle chacun à prendre ses responsabilités et à défendre les amendements de la commission emploi ainsi que ceux déposés par mon groupe concernant le détachement, le temps de travail et le cabotage.

  Margot Parker, on behalf of the EFDD Group. – Mr President, this mobility package really worries me. I have received a deluge of emails from charities and constituents expressing their concern about the Commission’s proposed definition of travel for non—commercial purposes. The proposed definition would mean that charities such as the Red Cross, Scope and Mencap would be seriously affected. This would mean vulnerable EU citizens left out of society. I am only relieved that this elected House has proposed an adequate amendment to change the unelected Commission proposal.

  Marie-Christine Arnautu, au nom du groupe ENF. – Monsieur le Président, le paquet mobilité est révélateur de la nature des institutions bruxelloises, hypocrites, aveuglées par l’idéologie du marché unique et soumises par-dessus tout au profit, au détriment des travailleurs de l’Union.

Les orgueilleuses élites européistes, sûres du triomphe de leur Babel consumériste, n’ont pas voulu attendre la convergence économique et sociale entre des pays aux économies avancées et ceux traînant au pied le boulet de 45 années de socialisme. Le résultat est l’instauration d’une lutte entre les travailleurs de l’Est et ceux de l’Ouest. Chômeurs à l’ouest, esclaves à l’est: voilà le choix qu’impose l’Union. Oui, esclaves, car à 400 euros par mois, qui ici ferait le travail de ces chauffeurs sillonnant l’Europe au profit de grands groupes de transports financiarisés?

Hypocrites, car quand la Commission européenne prétend protéger les chauffeurs, elle en dégrade les conditions de travail, au détriment même de la sécurité routière, car quand la Commission prétend lutter contre les abus du cabotage en Europe de l’Ouest, s’apparentant d’ailleurs à de la piraterie entrepreneuriale, elle propose de le libéraliser sur 5 jours.

Quant à l’application déjà largement insuffisante du statut de travailleurs détachés, votre vœu est qu’il concerne le moins de travailleurs possible, le moins souvent possible et, pour comble, avec le soutien d’un rapporteur qui se prétend de gauche radicale. Le libéralisme libertaire teinté de bons sentiments, c’est bien le poison.

Diamétralement opposé à ces positions, qui avaient encore été aggravées par la commission des transports, notre groupe ENL a proposé des amendements afin de mettre fin à l’exploitation des chauffeurs de l’Est européen. Nous refusons la mise à mort de nos entreprises de transport et la mise au chômage de nos chauffeurs par un dumping social, non seulement permis, mais encouragé par les règles européennes. Et nous appuierons, sans esprit partisan, tous les amendements allant en ce sens. Je crois que la crainte du raz-de-marée annoncé aux élections européennes de mai prochain, de ceux que vous appelez les populistes, aura au moins le mérite de contraindre les élus du système à défendre, pour une fois, les intérêts des petites entreprises et des... Κυριαρχία και συγκέντρωση κεφαλαίων στηριγμένη στη στυγνή εκμετάλλευση εκατομμυρίων μισθωτών οδηγών που εργάζονται κυριολεκτικά με κίνδυνο ζωής σε απαράδεκτες συνθήκες εντατικοποίησης, υπό την απειλή απόλυσης, με ατελείωτες ώρες στο τιμόνι, πολυήμερες απουσίες από την οικογένειά τους, με μισθούς ψίχουλα και χωρίς συλλογικές συμβάσεις, αναλαμβάνοντας αστική και ποινική ευθύνη για ατυχήματα όπου ουσιαστικά ωθούνται υπό την πίεση των εργοδοτών για έγκαιρη παράδοση ή υπέρβαρα φορτία. Τα ευχολόγια του Ευρωκοινοβουλίου δεν αντιμετωπίζουν την κατάσταση, αλλά ανοίγουν παράθυρα με εξαιρέσεις σε κανόνες ασφαλείας, με ελέγχους σφραγίδα, με ευελιξία στις ώρες εργασίας και ανάπαυσης, με απώλεια εργατικών δικαιωμάτων, απόσπαση υπέρ της εργοδοσίας. Για όλους τους οδηγούς, εργασία ισοδύναμη με εφτάωρο, πενθήμερο, θεώρηση του χρόνου αναμονής και άλλων εργασιών ως εργάσιμου, τακτικές ικανοποιητικές περιόδους ανάπαυσης στον τόπο κατοικίας, συλλογικές συμβάσεις με ικανοποιητικούς μισθούς, με αποκλειστικά δημόσιες μεταφορές.

  Elżbieta Katarzyna Łukacijewska (PPE). – Panie Przewodniczący! Pani Komisarz! Myślę, że jutro podczas głosowania odpowiemy sobie tak naprawdę na pytanie, jakiej chcemy Europy. Czy chcemy wspierać wspólny rynek? Czy chcemy wspierać konkurencyjność? Czy chcemy wspierać swobodę przepływu towarów i usług? Czy jednak jesteśmy za wspieraniem protekcjonizmu, biurokracji i ograniczeniem konkurencyjności, bo, proszę Państwa, część z Państwa, mówiąc o ochronie praw kierowców, tak naprawdę chce likwidacji konkurencyjności, bo jest wam nie po drodze z tym, że inne firmy są lepsze – powiedzmy sobie to na tej sali uczciwie.

Propozycje, które wyszły z Komisji Transportu, są wyważone – uwzględniają wszystkie uwagi. Eliminujemy nadużycia i, proszę Państwa, firmy transportowe, organizacje transportowe, nie tylko z Europy Wschodniej, ale i z Europy Zachodniej, ze wszystkich krajów mówią: poprzyjcie propozycje i kompromis Komisji Transportu, inaczej będziemy obciążeni niepotrzebną biurokracją. Małe i średnie przedsiębiorstwa sobie z tą biurokracją nie poradzą. Konsumenci będą musieli płacić wyższe ceny za towary i usługi.

Proszę Państwa! Bądźmy odpowiedzialni przed konsumentami, przed wyborcami i twórzmy prawo, które jest przejrzyste, które można zrewidować, kontrolować, i nie wymyślajmy przepisów, które spowodują, że wiele małych i średnich przedsiębiorstw upadnie.

  Agnes Jongerius (S&D). – Voorzitter, het was in deze zaal dat Jean-Claude Juncker drieënhalf jaar geleden aankondigde te streven naar een triple A sociaal Europa en veel mensen waren voor. In een sociaal Europa passen geen eerste- en tweedeklaswerknemers. We willen dus ook niet dat de chauffeurs in Europa tot tweedeklaswerknemers worden verklaard. Het is duidelijk in deze voorstellen dat het transitvervoer wordt uitgezonderd van de detacheringsregels en we zijn bereid om over het Deense model te spreken. Er is dus ruimte voor een compromis.

Dat is er niet als het gaat om de rij- en rusttijden, want ook vrachtwagenchauffeurs en buschauffeurs hebben recht op voldoende rust. Wekenlang onderweg zijn en nauwelijks pauze hebben is slopend, het is slecht voor de gezondheid en het is slecht voor de veiligheid voor iedereen op de weg. Het is om die reden dat we de EMPL-voorstellen opnieuw op tafel gelegd hebben en dat ik u oproep daarvoor te stemmen.

  Roberts Zīle (ECR). – Mr President, we know that the committees have proportional representation from our political families. That is why the Committee on Transport and Tourism, when we discussed it, we did it very substantially with a mandate of all the political groups. We took into account that there are rich and poor countries, and we took into account the high market areas in Europe and the low market areas in Europe, and we also know that some Member States are tens of – and some are several thousand – kilometres from the high market areas.

We did everything with a good understanding on a political level. For example, Merja Kyllönen is on the Left side and I am on the Right side, we have both been Ministers of Transport, and we took a reasonable compromise on all those issues. That is why I ask you to trust the TRAN Committee – we did compromise very well on all three dossiers; nobody is completely 100% happy, but it is a good balance. Please trust us as a committee, because the way the TRAN Committee is working was developed over several years, and it is very cooperative, not seeing what kind of political views we have. At the same time, we would like to keep it as a package, and please don’t separate those issues. Otherwise, we will have a cocktail of protectionism, a fragmentation of the single market in the haulage business, and have argumentation of so-called drivers’ social rights, which is often actually not true. So, please be serious at the vote tomorrow.

  Izaskun Bilbao Barandica (ALDE). – Señor presidente, señora comisaria, este informe y el paquete de transporte en su conjunto son imprescindibles para acabar con la fragmentación que afecta a este sector. Necesitamos clarificar y armonizar la aplicación de las normas, acabar con el dumping social, mejorar las condiciones de trabajo de los profesionales, contribuir a la seguridad vial y preparar el sector para los cambios que vienen de la mano de la descarbonización y la aplicación intensiva de tecnología para combinar de modo más eficiente los modos de transporte.

Desde la Directiva relativa a la movilidad de los trabajadores aportamos a esos objetivos la exclusión del transporte internacional del ámbito de aplicación y la obligación de que los conductores que realicen cabotaje trabajen desde el primer día en las condiciones reguladas para el sector en el país en el que desarrollan el servicio. Hemos prohibido de facto las empresas buzón. Igualmente, queremos que los incumplimientos de las normas repercutan en la reputación de las empresas y sus posibilidades de acceso al mercado.

Apreciamos los avances en estandarización de procedimientos, automatización y reducción de las cargas administrativas, pero seguimos pensando que el transporte por carretera necesita una agencia europea.

  Terry Reintke (Verts/ALE). – Mr President, the European Union is founded on fundamental principles; equal treatment is one of them. In the vote tomorrow, we can show workers from North to South, and from East to West, that this means something to us. They will look to this plenary and ask themselves: will the European Union defend our rights? Not in an abstract way, not when we talk about the pillar of social rights somewhere in Gothenburg, signing a declaration or having a good photo opportunity, but really in a way that will affect their everyday lives and working conditions.

To me it is clear: drivers are not second-class workers in this Union. When it comes to posting, they deserve exactly the same rights as any other workers in the EU. Tomorrow we have the chance to stand up for those rights for hard-working people, for fair pay, and for their working conditions; and we should stand up also for the fundamental principle of the European Union that is equal treatment. In order to build a European internal market, so to speak a European labour market that safeguards freedom of movement and the provision of services as well as fair working conditions and fair competition, we have to find workable solutions based on principles. Equal treatment has to be one of them. Let us show that to workers tomorrow in the vote.

  João Pimenta Lopes (GUE/NGL). – Senhor Presidente, a realidade do setor do transporte rodoviário traduz uma realidade de brutal exploração dos trabalhadores: elevadíssimos níveis de precariedade e muito baixos salários, onde se denunciam práticas ilegais de pagamento ao quilómetro, à tonelagem ou à viagem, e pesadas jornadas de trabalho para responder às necessidades dos grandes grupos económicos.

Limita-se o direito ao destacamento e impõe-se o isolamento pessoal e familiar, em longos períodos de serviço, que algumas propostas agravam. Negligenciam-se as justas necessidades de descanso e ignoram-se os elevados níveis de stress e de desgaste físico e psicológico a que os trabalhadores estão sujeitos. As propostas em discussão visam, no essencial, o aprofundamento dos mecanismos de exploração dos trabalhadores, a maximização do lucro e a concentração do capital em benefício das grandes empresas e multinacionais do setor ou de setores que dependam do transporte rodoviário, nomeadamente para as importações e as exportações.

Em nome do mercado único, promovem o nivelamento por baixo das condições de vida e de trabalho na Europa, aumentando as desigualdades, a exclusão e a pobreza, opções a que, lamentavelmente, o Governo português se associou.

  Marian-Jean Marinescu (PPE). – Domnule președinte, doamnă comisar, v-am mai spus și altă dată: aceste propuneri nu ar fi trebuit să existe. Eu cred că orice atac la Curtea de Justiție a Uniunii Europene le-ar desființa fără niciun fel de problemă, pentru că aceste propuneri merg împotriva unor elemente fundamentale ale Uniunii Europene: circulația liberă a capitalului, a serviciilor, a forței de muncă.

Am auzit aici despre dumping social. Eu cred că propunerea dumneavoastră face protecționism pentru anumite categorii. Am auzit de șoferi de mâna a doua, de mâna întâi. Da, vor exista șoferii protejați din anumite state – de mâna întâi – și șoferi neprotejați din punct de vedere „piață” din alte state – șoferi de mâna a doua. Vor exista creșteri de prețuri, pentru că beneficiarii vor suferi, pentru că cei care nu vor mai avea concurență, companiile de transport, vor ridica prețurile. Deci, va exista birocrație. Un șofer va fi plătit cu șapte-opt salarii, dacă merge din Portugalia până în Lituania și sunt foarte curios dacă șoferul din Germania, când trece prin România, va fi plătit cu salariul din România.

Singurul motiv pentru care susțin compromisurile din TRAN, care sunt, totuși, bune, este să eliminăm abuzurile făcute în acest moment de unele administrații naționale. Deci: să votăm compromisurile din Comisia TRAN!

  Inés Ayala Sender (S&D). – Señor presidente, habíamos conseguido y hemos conseguido un compromiso precisamente entre los trabajadores de la periferia y los trabajadores del centro, es decir que sabemos que en la carretera el problema real no son solo los salarios, sino los precios. Y los precios, desde luego, no los ponemos en la periferia: son los cargadores, son los distribuidores, los supermercados, que están en el centro, los que imponen los precios.

A eso, de momento, señora comisaria, no tenemos una gran respuesta y alguna de nuestras propuestas – y yo agradezco a la señora Kyllönen que la tuviera en cuenta – ha sido rechazada.

El compromiso que tenemos justamente intentaba, por todos los medios, ser un compromiso entre las necesidades de unos y otros, a favor de la exclusión del tránsito y del transporte internacional bilateral con la vuelta precisamente para poder cargar. Pero, por primera vez – y todos estábamos de acuerdo –, aceptábamos la aplicación de la Directiva sobre el desplazamiento de los trabajadores al cabotaje desde el primer día, y eso sabiendo que a algunos de los Estados miembros nos iba a costar enormemente.

También hemos luchado por la no criminalización de los conductores, es decir, reducir los controles a pie de carretera y, en cambio, hacerlos en las empresas y por parte de las autoridades.

Estamos a favor de la agencia europea y, desde luego, por la plataforma de la mutua confianza para que no haya discriminación tampoco en los trabajadores del exterior.

  Evžen Tošenovský (ECR). – Pane předsedající, paní komisařko, volný pohyb zboží patří mezi základní svobody Evropské unie a k jejímu naplňování zkrátka Evropa potřebuje mezinárodní silniční dopravu. Musíme pokročit v její liberalizaci a modernizaci pravidel. Je proto velká škoda, že zpravodajům na minulém plénu nebyl udělen mandát.

Kompromis schválený Výborem pro dopravu a cestovní ruch byl vyvážený a hlavně respektoval skutečnost, že tento sektor je specifický a potřebuje a vyžaduje speciální pravidla, speciální právní úpravu. Jinak řečeno, obecná pravidla o vysílání pracovníků by se neměla plně vztahovat na tranzitní a mezinárodní silniční dopravu.

  Gesine Meissner (ALDE). – Herr Präsident, Frau Kommissarin, liebe Kolleginnen und Kollegen! Worum geht es hierbei, was ist das Ziel dieses Pakets? Das Ziel ist es, aktuell passende Konditionen für den Warentransport per Lkw in Europa zu schaffen. Das gilt teilweise auch für Busse, aber dazu komme ich später noch.

Zur Erinnerung: Wir haben als eine der Grundregeln in der EU die freie Bewegung für Menschen, Waren und Dienstleistungen – und auch darum geht es hier – zu fairen europäischen Regeln. Nun ist es so: Es geht auch um den Mangelberuf Lkw-Fahrer oder –Fahrerin. Wir brauchen diese Menschen auch in Zukunft, und sie sollen natürlich faire Bedingungen bekommen. Das wollen wir damit sicherstellen. Die meisten Arbeitgeber behandeln ihre Leute übrigens durchaus gut, aber es gibt schwarze Schafe, und das müssen wir bearbeiten.

Ich spreche speziell über die Lenk- und Ruhezeiten. Dafür haben wir viele gute Sachen vorgeschlagen, was das Schlafen in der Kabine auf zertifizierten Parkplätzen zum Beispiel betrifft, die Einbeziehung leichter Nutzfahrzeuge und vieles mehr. Wir brauchen aber auch einige Ausnahmen, und auf die will ich jetzt besonders kommen: Tachografenpflicht zum Beispiel für Handwerker nur im Umkreis von 150 km, Asphalt muss ausgebracht werden, wenn er fertig ist, das betrifft den Straßenbau. Und als Letztes: Busfahrer sind keine Lkw-Fahrer. Sie brauchen andere Regeln, wenn sie schon im gleichen Gesetz bearbeitet werden. Personenbeförderung ist etwas anderes als Warentransport.

  Keith Taylor (Verts/ALE). – Mr President, I believe that Parliament is being sold a pup when it is told that we need new regulations on drivers’ hours and rest periods to give more flexibility. I’m concerned that flexibility is all one way: in favour of the operators and against the drivers’ welfare and road safety, given that driver fatigue plays a major role in traffic accidents and these regulations are possibly extending the reference period for calculating working time. Allowing rest in cabs will mean more stressful time for drivers in and around their vehicles, and more time between weekly rests.

These changes will also allow coach drivers to work continuously for 12 days, which is one of the reasons why I argued successfully for account to be taken of drivers’ – all drivers’ – duty time. In our meeting with drivers from across Europe we heard about the additional tasks that they are expected to do, like route planning, cleaning etc. Now is the time, fellow colleagues, to show who matters most: the professional drivers and the travelling public or the operators. We’ve got a number of amendments with recorded votes, and I ask for your support and for the amendments from the Committee on Employment and Social Affairs.

  Rina Ronja Kari (GUE/NGL). – Hr. formand! Flere uger i lastbilens førerhus uden et ordentligt hvil uden for lastbilen, og en dårlig løn, som man næsten ikke kan leve af, det er nogle af de vigtigste spørgsmål, når vi behandler Kommissionens forslag til en vejpakke. Og svaret skal være klart: Nej, det er ikke i orden! Nej, der er ikke brug for dårligere regler! Der er derimod brug for bedre rettigheder og bedre regler for chaufførerne. Det er jo også derfor, at fagbevægelsen har forsøgt at råbe os op. Kære kolleger, vi skal lytte til dem. Den sociale dumping på vejene er i høj grad et resultat af EU’s indre marked og en unfair konkurrence – og det skal stoppes! I Udvalget om Beskæftigelse inviterede vi chaufførerne og fagforeningerne indenfor. Vi havde en rigtig dialog med dem om, hvilke problemer de oplever ude på vejene. Det er derfor, at Udvalget om Beskæftigelse har stillet så vigtige ændringsforslag. Vi tager deres problemer alvorligt. Kære kolleger: Lyt til dem! Lyt til chaufførerne! Lyt til fagforeningerne! Stem ja til ændringsforslag!

Ich möchte mich bei Euch ganz herzlich bedanken – dafür bedanken, dass Ihr die Notwendigkeit erkannt habt, diese politisch heiklen Berichte im Plenum zu behandeln, anstatt zuzulassen, dass eine umstrittene Ausschussabstimmung zur Grundlage für das Verhandlungsmandat wird. Endlich und erst nach der Ablehnung des Mandats wurden die Bedenken vieler von uns ernst genommen. Es gibt jetzt echte Kompromissvorschläge, die das TRAN-Ergebnis noch verbessern. Diese Bereitschaft hat zuvor komplett gefehlt. Doch besser spät als nie.

Wenn auch Ihr nicht wollt, dass Lkw-Fahrerinnen und —Fahrer für Tiefstlöhne und ohne soziale Absicherung quer durch Europa fahren, wenn Ihr wie ich wollt, dass Sozialdumping und Nomadentum der Vergangenheit angehören, wenn auch Ihr faire und transparente Spielregeln nicht nur beim Fußball, sondern vor allem in der realen Welt wollt, dann lasst uns bitte gemeinsam diese Kompromisse unterstützen. Sie ermöglichen vor allem den kleinen und mittelständischen, den redlichen Transportunternehmen ihre Existenz heute und morgen, und das unter fairen Wettbewerbsbedingungen, ohne dabei unnötigen Verwaltungsaufwand zu schaffen. Das heißt: Bitte stimmt für eine Einschränkung der Kabotage pro Mitgliedstaat von 48 Stunden mit einer Cooling-off-Periode, für die Einbeziehung des internationalen Transports in die Entsenderichtlinie nach einer konkreten Zeitspanne, für effizientere Kontrollen, für die besondere Situation der Reisebusbranche sowie für die Erweiterung der bestehenden Ausnahmen zu Lenk- und Ruhezeiten.

  Evelyn Regner (S&D). – Herr Präsident, Frau Kommissarin! Lkw-Fahrer verdienen anständige Arbeitsbedingungen. Lkw-Fahrer dürfen und sollen keine Beschäftigten zweiter Klasse sein. Ich habe in den letzten Wochen unzählige Gespräche mit Lkw-Fahrern selbst geführt, war bei ihnen auf der Straße, und was sieht man da? Fahrzeiten von 15 Stunden am Stück, mit Amphetaminen aufgeputscht zum Durchhalten sind etliche von ihnen. Monatelanges Schlafen im Lkw, und dann werden sie auch noch oft mit Stundenlöhnen von um die drei Euro abgespeist. Ist das fair, ist das gerecht? Nein!

sIn einem fortschrittlichen, in einem sozialen Europa erwarte ich mir das nicht. Das dürfen wir nicht zulassen. Deshalb soll die Entsende-Richtlinie auch für Lkw-Fahrer vom ersten Tag an gelten, so wie wir das im Beschäftigungsausschuss auch abgestimmt haben. Keine Schlupflöcher, bitte. Insbesondere an jene Kollegen der Europäischen Volkspartei möchte ich mich wenden: Auch Ausnahmen von zehn Tagen sind unmenschlich, nicht anständig.

Направените предложения са скандални, нелогични и целят едно единствено нещо – да фалират предприемачите в Източна Европа, защото в Западна Европа няма шофьори на камиони. И това е причината за тези лобистки промени, да се опитва да се открадне този бизнес.

Искате да се спи в хотели, хотели няма. Искате да се спи на охраняеми паркинги, няма охраняеми паркинги и застраховките не важат. Искате да се прибират хората на 3 седмици, откъде накъде ще казвате на някой къде да бъде след три седмици. Като Ви го казахме това, казахте, че искате камионите да се прибират на три седмици. Защо, уважаеми, да не би камионите да тъгуват за своите приятели камиони, за да искат да се прибират?

Твърдите, че сте зелени. Какво ще стане като тези хиляди камиони се движат из Европа, горейки тонове нафта, замърсявайки околната среда и затваряйки пътищата. Това ли е зеленото? Не, това е лицемерие. Трябва да се гласува против тези поправки, защото те разделят Европейския съюз. Твърдите, че искате силен Съюз, а го разделяте на две! Срамота.

  Dominique Riquet (ALDE). – Monsieur le Président, Madame la Commissaire, une minute pour évoquer trois directives: je pense que c’est une solution originale pour le problème des interprètes. On devrait persévérer dans cette voie.

Pour ce qui concerne le problème du temps de travail, je pense que nous avons le choix, cela a été exposé, entre les conditions de travail et la sécurité routière d’un côté, et le marché de l’autre. D’ailleurs tout le monde est d’accord sur le sujet. Nous, nous ne choisirons pas le marché contre les travailleurs. Je précise d’ailleurs, par rapport à ce que je viens d’entendre, que si ses conditions et ses émoluments étaient si forts, il n’y aurait pas de crise du recrutement et si nous avons du mal à trouver des chauffeurs, c’est probablement que les conditions sont dures et les salaires maigres.

On peut trouver, je pense, une synergie et des compromis sur le temps de travail et le cabotage, mais je ferai quand même une remarque en ce qui concerne le détachement: si l’exclusion pure et simple du détachement est une position de compromis, quelle était la position radicale? Dans ces conditions, je suis quand même un peu émerveillé qu’on présente le bout de l’arc-en-ciel comme l’arc-en-ciel lui-même. Un peu de raison serait nécessaire.

  Danuta Jazłowiecka (PPE). – Panie Przewodniczący! Powiedzmy jeszcze raz, co oznacza wprowadzenie zasad delegowania do transportu międzynarodowego. Jest to jeden wielki chaos prawny. Jest to wprowadzenie obowiązku stosowania tylko w jednym miesiącu nawet do 20 różnych prawodawstw narodowych czy do 50 różnych wynagrodzeń. Weźmy przykład trasy jednego kierowcy, który w ciągu tygodnia przejeżdża przez 5 państw członkowskich i taką trasę robi 3 razy w miesiącu. Jego wynagrodzenie będzie zależne od ilości godzin spędzonych w danym państwie, danym regionie, landzie. Oznacza to, że jeżeli nagle stanie w korku w Luksemburgu, jego wynagrodzenie będzie musiało być odpowiednio podniesione. A jeśli będzie musiał tam przenocować? Ilu dodatkowych pracowników administracyjnych będzie musiało na bieżąco obliczać wynagrodzenia w małych i średnich przedsiębiorstwach? A co z kontraktami na konkretną kwotę za usługę? Co z cenami przywożonych produktów? Skoro transport międzynarodowy chcemy objąć delegowaniem, po co nam lex specialis?

Tym, którzy myślą, że objęcie transportu delegowaniem od dnia drugiego, trzeciego czy czwartego coś zmieni, mówię: nie, nic nie zmieni. Jeden dzień równa się 6 godzin. Wyobrażacie sobie firmę transportową w Europie, która w państwach unijnych spędza w miesiącu jedynie 12, 18 czy 24 godziny ze względu na restrykcje delegowania? Chcemy, by w pozostałe dni pracowały firmy spoza Unii Europejskiej? Z pewnością nie chcą tego firmy także z Europy Zachodniej. Od tygodni dostajemy apele od ogromnej liczby organizacji reprezentujących firmy z Europy Zachodniej: Francji, Niemiec, Danii, Holandii, Finlandii, Portugalii, Hiszpanii, Irlandii, Belgii czy Wielkiej Brytanii, czy też z Europy Środkowo-Wschodniej. Wszystkie one wzywają do wyłączenia transportu międzynarodowego spod zasad delegowania. Posłuchajmy ich głosu, poprzyjmy sprawozdanie komisji TRAN.

  Isabella De Monte (S&D). – Signor Presidente, onorevoli colleghi, signora Commissaria, sono convinta che difendere i diritti dei lavoratori significhi garantire loro non solo condizioni economiche adeguate ma soprattutto condizioni di vita lavorativa e personale soddisfacenti.

Il lavoro che ha portato a termine la commissione TRAN si è basato proprio su questo principio: abbiamo cercato di fare un passo avanti rispetto alla situazione attuale, che ritengo non dignitosa per gli autisti, costretti a riposare ai bordi delle strade per mesi e in condizioni precarie.

Credo, inoltre, come sostenuto anche dalla commissione EMPL, che sia importante sottolineare la sostanziale differenza che esiste tra il trasporto di beni e il trasporto di passeggeri: quest'ultimo dovrebbe godere di maggiore flessibilità, proprio per le sue caratteristiche, soprattutto nel settore turistico.

Sono convinta che la normativa debba essere cambiata: l'idea di mantenere lo status quo non può essere considerata una vittoria da parte di chi sostiene di avere a cuore gli interessi dei lavoratori.

La collega prima diceva che, andando con gli autisti, si è resa conto che ci sono delle norme non rispettate. Allora, se noi pensiamo che oggi questa situazione ci basti, facciamo purtroppo un grave errore e penso che anche l'applicazione immediata del tachigrafo può essere utile a superare questa situazione che oggi, credo, non solo come gruppo ma come deputati, dobbiamo considerare superata.

  Matthijs van Miltenburg (ALDE). – Voorzitter, het mobiliteitspakket brengt helaas nieuwe breuklijnen in Europa aan het licht, breuklijnen tussen Oost- en West-Europa, tussen landen in de periferie en landen die centraal gelegen zijn. Maar Voorzitter, is het niet juist de rol van dit Europees Parlement om die breuklijnen te overbruggen? Een eensgezind Parlement kan een krachtig signaal afgeven aan een verdeelde Raad.

Natuurlijk, het compromis zoals dat is uitgewerkt in de Transportcommissie kent imperfecties. Maar de schoonheid van het compromis is de balans tussen de interne markt en sociale werkomstandigheden voor alle Europese chauffeurs. Internationale transporteurs en chauffeurs krijgen de lusten van de interne markt, maar niet de administratieve lasten. Ook beëindigen we het ongewilde nomadenbestaan van chauffeurs en starten we met een slimme tachograaf.

Voorzitter, de titel van het mobiliteitspakket is “Europe on the move”. Laten we beweging in het dossier brengen door ons achter het mandaat van de Transportcommissie te scharen en te gaan onderhandelen. Let's move on.

  Deirdre Clune (PPE). – Mr President, I would like to thank the Commissioner for outlining the urgency surrounding this EU mobility package. We have three files here from the Committee on Transport and they need to be taken and looked at as a whole package. We can’t pick pieces from one or the other.

As has been said, international transport, by its nature, is international and a highly mobile workers’ posting is not suitable to workers, as has been outlined by many colleagues here working in the transport sector. I think we should, all of us, look at the reasons why and the work that went into it in the Committee in getting to the point of these compromises. They were not easily attained.

We have a debate here between east and west, and peripheral and central Europe. But the single market should allow all Members access to that market, regardless of their geographical placement or regardless of the level of wages that they pay in their country. I’d ask everybody here to look at the compromises that have been won in the Committee on Transport by a significant majority there and vote to support those tomorrow.

  Ole Christensen (S&D). – Hr formand! I morgen træffer vi en beslutning, som har stor betydning for chauffører i hele Europa. I forhold til køre-/hviletid har vi to muligheder: Vi kan forbedre arbejdsvilkårene for chaufførerne, eller vi kan vælge at gøre arbejdsforholdene på landevejene endnu værre, end de er i dag. For mig er valget let, og det er der to grunde til: For det første skal vi ikke finde os i, at chauffører skal leve en nomadetilværelse, hvor de bor i deres lastbil og camperer på parkeringspladser rundt om i Europa under kummerlige forhold. Når chauffører holder weekend, skal de selvfølgelig ikke sove i lastbilen, de skal hjem til familien, hvis de ønsker det. For det andet skal vi ikke acceptere, at chauffører presses til at arbejde 20 dage i træk med kun to fridage. Vi skal kæmpe imod social dumping og unfair konkurrence. Derfor vil jeg anbefale jer alle, at I stemmer for ændringsforslagene fra Udvalget for Beskæftigelse. Det skylder vi chaufførerne!

  Ivo Belet (PPE). – Voorzitter, waarover gaat het hier in dit dossier? Het gaat in essentie – Commissaris, u weet het even goed als wij – over twee zaken. Het gaat over de veiligheid op de weg en het gaat over de aanpak van de sociale dumping. Die twee zaken gaan uiteraard hand in hand.

Het is een goede zaak dat we op internationaal transport die verplichte slimme tachograaf invoeren en versneld invoeren en dat we dat ook doen voor de bestelbusjes om zo de achterpoortjes te sluiten. Anderzijds, is het onze plicht om paal en perk te stellen – collega Christensen zei het zonet – terecht paal en perk te stellen aan die sociale wantoestanden in de transportsector. Ook vrachtwagenchauffeurs hebben rechten en verdienen ons volle respect voor het werk dat ze doen. Ze hebben het recht om een weekend thuis of in een fatsoenlijk hotel door te brengen in plaats van op een of andere gure parking.

Vandaag is die regeling al het geval in België, ook in Duitsland en andere lidstaten. We willen echt niet dat die regeling wordt ondergraven. Een cabine van twee meter op twee is niet de ideale plaats om een weekend door te brengen. Die maatregelen zijn essentieel vanuit sociaal oogpunt en ook vanuit het oogpunt van de veiligheid op de weg.

  Bogusław Liberadzki (S&D). – Panie Przewodniczący! Nasłuchałem się tutaj – muszę przyznać – trochę bajek. Na przykład: pracownik nie śpi w biurze, ale w domu. Tylko że pracownik nie pilnuje ciężarówki i ładunku, a kierowca musi pilnować. Niech Pani pójdzie do Calais – w swoim państwie, we Francji – i zobaczy, czy tam może sobie kierowca po prostu pójść do hotelu.

Druga uwaga. Ktoś powiedział, że zarabia rocznie kilkadziesiąt euro. W Polsce kierowcy zarabiają między 1 400 a 2 000 euro miesięcznie.

Trzecia uwaga. Ja rozumiem, że tak się bardzo sympatycznie mówi „ta sama płaca za tę samą pracę”. Dobrze, Pani Komisarz, w takim razie i te same stawki. Dlaczego w Niemczech firma niemiecka dostaje 2 euro, firma polska – 1,60 euro? Proszę bardzo, te same stawki za tonokilometr w Niemczech czy we Francji i będziemy mówić „ta sama praca, ta sama płaca”. Powinniśmy poprzeć sprawozdanie i kompromisy pani Kyllönen, która wykonała wspaniałą robotę. Ja jej za to dziękuję i gratuluję.

  Ivica Tolić (PPE). – Poštovani predsjedavajući, prije svega želim odati priznanje izvjestiteljima i izvjestiteljima u sjeni koji su radili na paketu mobilnosti.

Podržavam postignute kompromise te ih ocjenjujem jako dobrima uzimajući u obzir kompleksnost teme.

Vrlo je važno da tržište rada bude uređeno na odgovarajući način i da se prepoznaju sva pravila koja je potrebno zaštititi kod upućenih radnika, uključujući minimalnu plaću, ali ako bi se Direktivom o upućenim radnicima obuhvatile transportne operacije osim same kabotaže, time bi se dovela u pitanje pravna sigurnost osoba koje žele obavljati svoju registriranu djelatnost.

Iako je Europska unija zajednica, normalno je da svaka zemlja želi zaštititi svoj teritorij i očuvati konkurentnost svojih poduzeća, međutim nije prihvatljivo da to rezultira ograničavanjem poduzetničkih sloboda drugih članica.

Što se tiče kabotaže, smatram da se trenutnim prijedlogom postiže glavna svrha, tj. izbjegavanje praznih vožnji uz zaštitu od narušavanja tržišta države domaćina. Pozivam sve da prihvate ovaj paket mobilnosti.

  Christine Revault d’Allonnes Bonnefoy (S&D). – Monsieur le Président, l’enjeu central de ce paquet «mobilité» est clair, c’est de lutter contre la dégradation continue des conditions de travail désastreuses de millions de chauffeurs routiers.

Accepterons-nous d’autoriser que les chauffeurs routiers passent plus de deux semaines dans leur cabine sans un repos hebdomadaire normal? Accepterons-nous d’autoriser que les chauffeurs de bus puissent conduire douze jours consécutifs sans un repos hebdomadaire? Accepterons-nous de légaliser le repos des chauffeurs dans leur cabine contre l’avis même de la Cour de justice de l’Union européenne? Posez-vous les questions, chers collègues. Accepteriez-vous de dormir dans vos bureaux après une journée de travail éprouvante? Accepteriez-vous que vos collaborateurs passent leur week-end de repos dans le bureau?

Les chauffeurs routiers sont en colère, et ils ont raison de l’être. Ils sont en colère parce que, bien installés dans leurs sièges confortables, certains députés européens, qui n’ont aucune idée de la dureté du métier de chauffeur routier, osent leur demander de prendre leur repos en cabine et de conduire deux semaines sans aucun repos hebdomadaire normal de 45 heures. Ils ont raison de venir manifester ici pour se battre pour leurs droits. C’est l’avenir de leur profession qui est en jeu.

De telles propositions doivent être combattues ardemment et nous, socialistes et démocrates, ferons tout pour faire que des mesures qui améliorent les droits de tous les travailleurs soient adoptées.

  Markus Ferber (PPE). – Herr Präsident! Unser Ziel bei der morgigen Abstimmung sollte es sein, einen ausgewogenen Kompromiss zu finden, der zum einen die europäischen Fahrer im Straßengüterverkehr schützt und zum anderen den freien Warenverkehr innerhalb der Europäischen Union auch weiterhin möglich macht. Wir sollten uns dabei auch nicht von nationalen Interessen oder gar protektionistischen Gedanken leiten lassen. Zu starke Einschränkungen im internationalen Transport würden die Logistikprozesse langsamer und teurer machen, einen hohen bürokratischen Aufwand für die Unternehmen bedeuten und letztendlich den freien Warenverkehr hemmen. Es ist eine Reihe von Änderungsanträgen dabei, die diesen Kompromiss suchen, und ich hoffe, dass die morgen auch Unterstützung finden.

Ich will aber auch ausdrücklich sagen: Busverkehr ist Busverkehr, und Lkw-Verkehr ist Lkw-Verkehr. Ich finde es gut, dass wir jetzt den Versuch machen, die Dinge voneinander zu trennen. Und wir sollten auch aufpassen, dass wir dort, wo wir internationalen Transport meinen, den auch adressieren und nicht plötzlich die Handwerker treffen. Ich hoffe, dass diese Ausnahmen Unterstützung finden.

  Claudia Țapardel (S&D). – Dragi colegi, pachetul privind mobilitatea ridică întrebări legitime cu privire la impactul asupra pieței europene a transporturilor. În calitate de for legiuitor, ne revine însă răspunderea de a crea o legislație care să protejeze interesele întregului bloc comunitar, nu doar ale statelor occidentale. Consider că mandatul dat în Comisia TRAN nu este perfect, dar este unul legitim și echilibrat, care răspunde realităților de pe piața europeană a transporturilor.

Includerea transportului internațional, un sector hipermobil, sub Directiva privind detașarea lucrătorilor va crea poveri administrative și economice care ar duce la falimentul mai multor companii din est. Sute de mii de locuri de muncă vor fi pierdute.

În ceea ce privește cabotajul, consider că reducerea timpilor acestuia va conduce la distorsionarea pieței în avantajul companiilor din vest, ceea ce este inacceptabil. Este esențial să respectăm timpii de odihnă, însă nu cred că trebuie să impunem locația în care șoferii să se odihnească sau obligativitatea întoarcerii camionului, care nu este o resursă umană, la trei săptămâni acasă. Susțin însă o agenție europeană pentru transportul rutier.

  Андрей Новаков (PPE). – г-н Председател, г-жо Комисар, вече дори не става въпрос за транспорт. Става въпрос за това, че с гласът си утре, този Парламент ще покаже накъде се е запътил Европейският съюз. Към основни ценности, за които е създаден, като единния пазар, като свободното движение на хора и на стоки или по друг път – към насаждане на протекционизъм и ограничаване на свободната инициатива.

Ако изберем втория път и не последваме постигнатото споразумение в Комисия по транспорт, посланието за всички хора ще е ясно. Днес е международният транспорт, утре може да бъде всичко останало, Шенген, Еврозона. Има единен пазар, ама само за някои държави членки, каквито ние решим тук.

Аз няма да участвам в това и няма да дам гласът си за създаването на нова желязна завеса. Да посегнем на цял бранш, само защото фирмите в него са регистрирани прекалено на Изток, прекалено на Север или в периферията на Европейския съюз. Призовавам всички колеги да не допускаме тази грешка и утре да подкрепим изключването на международните шофьори от Директивата за командировани работници и подкрепим постигнатото в комисията по транспорт.

  Marita Ulvskog (S&D). –Herr talman! Fru kommissionär! Vi befinner oss i ett vägskäl, ska vägtransporterna i EU vara undantagna från de schyssta villkor för arbetstagare som vi driver på andra områden? Tål chaufförer av tung trafik mer än alla andra? Naturligtvis inte.

Vi kan inte ha ett EU där kapplöpningen neråt med pressade priser, ovärdiga arbetsmiljöer och dumpade löner ska vara normen. Samtidigt måste vi ju garantera såväl chaufförernas som allas vår säkerhet längs vägarna. Att de inte sätts före enskilda företag som vill utnyttja människor till att köra flera veckor i sträck, boende i sina lastbilar, utan rimlig vila: så kan vi inte ha det.

Och så skulle också min vän och kollega EU-parlamentarikern Jens Nilsson, som avled för kort tid sedan, har formulerat det om han hade varit här: så kan vi inte ha det.

Alors que notre unité n’a jamais été autant nécessaire pour faire face à l’instabilité mondiale grandissante, les clivages au sein même de l’Europe n’ont jamais été aussi nombreux.

Le transport routier caractérise bien cette situation. Pour la France, ce sont plus de 30 000 entreprises, près de 400 000 emplois, qui se retrouvent en concurrence déloyale avec des transporteurs étrangers, pourtant eux-mêmes européens.

Avec ces textes sur le paquet mobilité, nous partions d’une vision voulant plus de libéralisation au moment même où l’on attend de nous que des règles plus justes soient mises en œuvre.

C’est pourquoi nous nous opposerons à tout texte qui ne viendrait pas améliorer une situation ou qui renforcerait la concurrence déloyale, ou encore qui ne permettrait pas aux chauffeurs de travailler dans des conditions plus décentes et plus équitables.

  Siôn Simon (S&D). – Mr President, I would like to make three points in my one minute, so I am going to speak quickly. Firstly, on the procedural question: the cabotage issue was dealt with conclusively in the Committee on Employment and Social Affairs (EMPL) and in the Committee on Transport and Tourism (TRAN). There is a real consensus on cabotage. I appeal to Members of this House: do not vandalise what was a good piece of agreement and negotiation as vindication for other elements of this package which you might not agree with. Where we do agree, leave it alone and let the agreement be.

Secondly, on the substantive issues: just to note, these are really serious issues – low pay, dangerous lacks of rest time, people working weeks and months away from home. Let us take in good faith that we all here want to solve those issues, and what we differ on perhaps is how to do that and the speed at which we do it because of where we come from.

  Romana Tomc (PPE). – Nesprejemljivo je, v kakšnih razmerah delajo vozniki, ne vedno, ampak zelo pogosto, zato potrebujemo jasna pravila, ki jih bodo zaščitila. Jasno pa je tudi, da transportni sektor ne more imeti zaradi svoje specifike popolnoma enakih pravil kot drugi sektorji.

Vendar moramo biti pri tem seveda tudi previdni. Preveč stroga pravila bi namreč dosegla ravno nasprotni učinek. Ti vozniki bi lahko ostali brez dela.

Posebej me skrbi, da bi pod krinko zaščite voznikov na prefinjen način vplivali na zmanjšanje konkurence. Dejstvo je, da bo za transportna podjetja iz vzhodne Evrope to velik zalogaj.

Torej imamo moj odločen „da” večji zaščiti zaposlenih in prav tako odločen „ne” protekcionizmu. Menim, da je ta kompromis, ki ga imamo na mizi in ki so ga dosegli v odboru, dober in odpravlja vse te pomisleke.

  Emilian Pavel (S&D). – Domnule președinte, doamnă comisar, vreau să spun că raportorii din Comisia TRAN au făcut o treabă foarte bună și vreau să mă alătur aici colegului meu, care a spus să nu vandalizăm cabotajul. Eu spun: haideți să nu vandalizăm acest pachet din TRAN, care acoperă totuși prioritățile ambelor părți (dacă trebuie să vorbim de două părți)!

Se încearcă aici inducerea în eroare a unor colegi prin faptul că modelul TRAN sau compromisul din TRAN ar fi unul care permite aceste practici nelegale, despre care se vorbea. Complet greșit, dragi colegi. Se mai spune că sunt companii care practică salarii mici, care nu protejează angajații. Aceste companii sunt exact din vestul Europei și practică prin subsidiare la noi, în țările periferice, aceste metode. Pe aceia trebuie să îi atacăm și trebuie să îi protejăm pe cei din IMM-uri, care încearcă să corespundă legislației actuale.

Nu uitați, dragi colegi: suntem toți în Europa și nu ne trebuie granițe suplimentare, ne trebuie granițe mai puține.

  Michaela Šojdrová (PPE). – Pane předsedající, já velmi oceňuji kompromisní návrh výboru TRAN a vyzývám k jeho podpoře. Považuji jej za velmi vyvážený, a to jak z hlediska sociální ochrany řidičů, tak také z hlediska zachování volného pohybu služeb. Tento kompromis v mnoha ohledech zlepšuje sociální ochranu řidičů, například po týdenní pracovní době řidiči mají nárok na odpočinek mimo kabinu a budou ho moci trávit jen výjimečně v kabině, pokud je parkoviště dostatečně vybavené. Nejde jen o pohodlí, ale jde také o bezpečnost na silnicích. Transparentnost a vymahatelnost těchto nových pravidel by měla být zajištěna urychlením povinného používání chytrých tachografů od roku 2022.

Dámy a pánové, vynětí dopravního sektoru ze směrnice o vysílání pracovníků je zásadní změna, která má zabránit vzniku nových administrativních bariér. A pokud nám jde skutečně o budování volného pohybu služeb a pracovníků, pak bychom měli tento kompromis podpořit.

  Richard Sulík (ECR). – Herr Präsident! Frau Regner hat vorhin gesagt, dass die Fahrer auch 15 Stunden fahren müssen. Später hat sie dann zugegeben, dass das schon nach heutigen Gesetzen verboten ist, aber in Wirklichkeit trotzdem geschieht. Aber da geht es doch nur darum, dass eben die Polizei in den westlichen Ländern nicht in der Lage ist, dieses Fahrverbot, das es heute schon gibt, durchzusetzen. Deswegen sind die Argumente scheinheilig, dass wir neue Regeln, neue Gesetze, neue Richtlinien brauchen, wenn wir schon die heutigen, die existierenden nicht einhalten können. Hier geht es nicht um den Schutz der Fahrer oder um den Schutz der Arbeiter, die von Osteuropa nach Westeuropa kommen. Hier geht es um den Schutz der eigenen Märkte, und das finde ich völlig unkorrekt und sehr scheinheilig.

Wenn die Abgeordneten wirklich die Menschen schützen möchten, dann würden sie verlangen, dass ein Industriearbeiter in der Slowakei bei Volkswagen genauso viel verdient wie ein Industriearbeiter in Deutschland, der bei Volkswagen arbeitet. Aber das wollen sie ja nicht.

  Jérôme Lavrilleux (PPE). – Monsieur le Président, je ne vais pas surprendre mes collègues du PPE en rappelant que mon inspiration est le Social Paper, la position sociale du groupe PPE et c’est pour cela que je suivrai plutôt les résultats de la commission de l’emploi et des affaires sociales et non pas ceux de la commission des transports et du tourisme.

Je pense que l’Europe doit s’acheminer vers un mieux—disant social et non vers un moins—disant social, comme c’est malheureusement trop souvent le cas. Et je pense qu’en tant que petit-fils et arrière-petit-fils de ce que l’on appelait, à l’époque, un camionneur, je manquerais à mon devoir de mémoire envers lui si je prenais une position différente de celle que je m’apprête à prendre.

Donc, j’incite, mais je sais que l’ensemble de mes collègues de la délégation française au sein du PPE auront la même position, à soutenir les textes issus de la commission de l’emploi et des affaires sociales et non pas ceux qui sont issus de la commission des transports et du tourisme.

  Nicola Caputo (S&D). – Signor Presidente, onorevoli colleghi, dal pacchetto "mobilità" viene fuori l'immagine di un'Europa senza futuro, divisa e sorda alle richieste di equità e di aiuto di migliaia di imprenditori e lavoratori del settore del trasporto merci.

La commissione TRAN ha votato contro l'estensione del principio "stessa paga per lo stesso lavoro" nelle attività di cabotaggio stradale anche ai trasporti internazionali, che quindi restano completamente soggetti alle retribuzioni del paese in cui è assunto l'autista, favorendo il dumping sociale e la concorrenza sleale delle imprese.

Anche le regole sui tempi di riposo dei conducenti, ritorno a casa o in un altro luogo a loro scelta, almeno una volta ogni tre settimane, non possono essere considerate sufficientemente stringenti. Il pacchetto "mobilità", riducendo i tempi di riposo, aumenta di fatto quelli di guida degli autisti di camion e autobus a lunga percorrenza e peggiora le condizioni di distacco transnazionale.

È dunque lampante il drammatico impatto che potrebbe avere il pacchetto sulla sicurezza stradale nella vita reale.

  Paloma López Bermejo (GUE/NGL). – Señor presidente, voy a repetir nuevamente que lo que tenemos entre manos, con parte del paquete de movilidad, son las condiciones laborales de uno de los sectores más precarios de la Unión Europea. Y podemos mejorarlas o empeorarlas. Esto es precisamente lo que vamos a votar mañana. Quienes trabajan en este sector lo hacen cobrando salarios cada día más bajos, alejados del principio de «A igual trabajo, igual salario». ¡Y qué hablar del resto de sus condiciones!

Estos trabajadores duermen en las cabinas, apenas dos metros cuadrados, situadas encima de los motores de camiones que llevan horas circulando. ¿Han intentado ustedes descansar en lugares así, a temperaturas absolutamente insoportables?

La fatiga que sufren estos trabajadores implica un problema de salud laboral, pero también de seguridad vial. Piensen en la potencia y en la envergadura de un tráiler de tres ejes. Todo esto, seguridad y condiciones laborales, no se corrige con mayor flexibilidad en los tiempos de conducción y descanso.

Escuchen a los trabajadores y a sus sindicatos. Puede parecer increíble, pero ellos son expertos en la materia.

  Daniela Aiuto (EFDD). – Signor Presidente, onorevoli colleghi, il Parlamento europeo ha domani un'opportunità storica per determinare le sorti dell'autotrasporto europeo.

La posta in gioco è ovviamente molto alta: parliamo delle condizioni inaccettabili in cui gli autotrasportatori europei sono costretti a lavorare, trascorrendo la loro intera vita su un camion, lontano da casa. Migliaia di persone costrette a mangiare, dormire e vivere di fatto su un mezzo in un continuo viaggio itinerante per tutta l'Europa, senza avere la possibilità di programmare una propria vita personale al di fuori del proprio lavoro. Una vera e propria moderna schiavitù.

Mi domando come sia possibile che l'Aula sia addirittura divisa e non si schieri all'unisono a difesa della categoria e contro il dumping sociale, nonché contro la continua concorrenza sleale che sta costringendo sempre più imprese a chiudere l'attività.

Domani quest'Aula avrà un'occasione unica per ripristinare la dignità del lavoro dell'autotrasporto. In mancanza, il ricordo di questo fallimento resterà impresso nella memoria di questa legislatura.

  Maria Grapini (S&D). – Domnule președinte, doamnă comisar, stimați colegi, chiar dacă suntem puțini aici, vreau să spun următorul lucru: eu nu sunt mulțumită de compromisurile la care am ajuns la TRAN, dar este soluția pe care o putem avea acum să mergem cu tot pachetul. Ce înseamnă să mergem cu un singur raport? Înseamnă un dezastru și credeți-mă. Haideți să nu mai fim populiști! Toți ne gândim la lucrători, dar haideți să ne gândim pe termen lung! Ce înseamnă falimentarea unor companii din foarte multe state? Ce înseamnă falimentarea unor IMM-uri? Lipsa unor locuri de muncă. Și ce se întâmplă cu acei șoferi? Vor fi angajați de căsuțele poștale și vor fi plătiți tot la fel de prost ca și acum, da?

Deci, hai să nu mai fim lupul moralist! Eu propun ca mâine să votăm acest pachet sau, dacă nu, respingem în bloc și o luăm de la capăt, doamnă comisar. Nu se poate să fragmentăm piața, nu se poate să nu avem o concurență și o competiție, nu se poate să nu ținem cont de subsidiaritate. Salariile sunt subsidiaritate. Dumping fac companiile din vest când angajează din est și stau acolo și plătesc la salariile din est.

  Violeta Bulc, Member of the Commission. – Mr President, I would like to thank everyone for this very fruitful and very dynamic debate. We have taken very good note of your comments and I would like to react to a few of them.

First, I hope I have already made it very clear that the Commission does not support the exclusion of international services from posting rules entirely. However, these rules have to be applied taking into account the highly mobile nature of the sector and need to be implemented in a proportional manner.

Any extreme proposal would be contrary to the objectives of the EU laws and principles. This is why the Commission proposed introducing a three-day threshold for cumulative presence of drivers in a month. It would allow proper protection of drivers while avoiding unnecessary administrative burdens.

Application of posting crews to international service from the first hour would, on the contrary, create red tape without real benefits for drivers. It would simply be unenforceable. Please keep in mind that thresholds already exist in the Posting Directive for other sectors which are less mobile.

Next, yes, you are right, drivers are not second-class and that is why a balanced approach to the issues on the table is essential – a balanced approach. Neither of the proposals leads to exploitation. On the contrary, they lead to fairness and enforcement that rewards those that want to play the game within the law.

Please keep in mind that we have been focusing our debate today only on the three remaining issues but there are many measures on which there is a broad consensus within this House, but also among Member States and between social partners. Like you, we have been consulting – unions, hauliers, operators, Member States and other associations. We should not forget the large number of improvements for the functioning of the transport market, for drivers’ working conditions, for better enforcement as well as for simplification through four levels of digitalisation.

I respect the very diversified views and different points of view from different stakeholders in this House. But now it is time to come together and find a way forward that will lead to the conclusion of this file. And we can only do that if we really sincerely engage and understand that we cannot stay fixed on our own position and not move.

Whatever the deal is, it must make the rules proportionate, enforceable and transparent. This will help to restore trust and to ensure the smooth functioning of the internal road transport market. What is at stake here is the fairness and the competitiveness of a vital sector of our economy, but also the credibility of our institutions. I hope we have learned from past experience. Inaction can only fuel populism and be destructive. So please bring all your wisdom to the negotiating table, so that we can find a reasonable agreement before the next European elections.

I am very much looking forward to your positive vote tomorrow and a possibility to engage as soon as possible in a trilogue and deliver on these files.

  Merja Kyllönen, Rapporteur. – Mr President, thank you for this fruitful discussion. It has been eye opening. I am quite sad that this ‘same salary for the same job’ does not happen in this House, either. Not the same salary for staff, trainees and APAs; not the same salary and equal rest time for translators; not the same taxpaying for each Member State by MEPs, so maybe before the next election this will change.

Tomorrow, with TRAN’s solution, we can stop the practice of nomadic drivers in a way that ensures that the driver knows his or her salary beforehand. We can ensure effective enforcement of the posting rules in a way that promotes socially responsible behaviour by all actors in the whole delivery chain. The proper functioning of the internal market needs smart and enforceable common rules. The companies who operate on those markets need to know that they can follow the rules. The workers need the companies to have a job, starting from the driver, transport company, consigner, distributor, consignee, producer and, in the end, even the consumer.

We need to know the effects on the whole chain, and actually the legislation which we have built in the Committee on Transport and Tourism is a position which we have checked in this whole chain. We are not just politicians running for the next election, but also responsible legislators, so don’t forget that when you are pushing the button tomorrow. Vote for the TRAN Committee report. It is a balanced solution.

  Ismail Ertug, Rapporteur. – Mr President, I think everything has been said. It is not necessary to discuss once again all the details and all the contents, but I can tell you that tomorrow is important because we have to solve this issue of nomadic drivers; these kinds of Wild West operations must be solved.

Second, no protectionism within the European Union. Third, the level playing field must be ensured and guaranteed. Fourth, we have to prevent this social dumping. All three dossiers, all of them, each of them, will provide this in a good way, but it depends on the details. I think the details are very spread within this Parliament; there are positions from east to west and from north to south, but in the end I think it goes in the right direction when we support the drivers through a good, proper life for the drivers and giving them and guaranteeing them a good social life also.

For the companies too. We have to secure and we have to guarantee that even the companies, the SMEs, must have the chance to live, must have the chance to earn some money, and not just the big hauliers and the big logistics companies. They should not earn all the money, which is the case at the moment.

The pressure on the sector is very high and I will try tomorrow with my Group to facilitate that a bit more, but I cannot guarantee that this will be, in the end, the situation or the position which could be the best for all colleagues here in the Parliament. I have to thank the Commission and my colleagues as rapporteurs and shadow rapporteurs. Let us vote and see what will come out tomorrow.

  Krzysztof Hetman (PPE), na piśmie. – Przy tak skomplikowanych i złożonych zagadnieniach jak transport międzynarodowy wypracowanie kompromisu, który nie tylko równoważyłby prawa i obowiązki każdej ze stron, ale także brał pod uwagę różnice w warunkach pracy, prawa i zwyczaje wszystkich krajów członkowskich, jest niezwykle trudne. Dlatego przy tworzeniu tego prawa nadrzędną zasadą musi być zdrowy rozsądek, a nie partykularne interesy tylko jednej ze stron.

Jestem zdania, że taki właśnie rozsądny kompromis udało się wypracować w Komisji Transportu. Zdecydowanie popieram wyłączenie sektora transportu międzynarodowego z zakresu dyrektywy o delegowaniu pracowników ze względu na unikalny, wysoce mobilny charakter tych operacji. W przeciwnym razie obciążenie administracyjne byłoby ogromne, nieproporcjonalne do teoretycznych korzyści, jakie miałby rzekomo odnieść kierowca. Tylko dobre egzekwowanie istniejących zasad i ewentualne nowe lex specialis może zagwarantować, że firmy transportowe będą mogły nadal świadczyć swoje usługi na wspólnym rynku, a prawa kierowców do odpowiedniej płacy, warunków pracy i wypoczynku będą egzekwowane.

  Ádám Kósa (PPE), írásban. – Nem szabad megengedni, hogy az „egyenlő munkáért egyenlő bér” alapelvét a nyugati, protekcionista politikusok kampányfogásként használják az ideiglenesen külföldön dolgozó, versenyképesebb munkavállalók kiszorítására. A fuvarozó-szállítmányozási ágazat versenyképes, modernizált járműparkkal rendelkező magyar cégei is extra kiadásokkal és további, adminisztratív terhekkel szembesülhetnek a vezetési időre, szünetekre és pihenőidőre vonatkozó követelmények szigorítása miatt. Ha a vezető nem töltheti pihenőidejét a kamion fülkéjében, hanem fizetett szálláshelyen kell megszállnia, akkor nemcsak a sofőrök számára is komfortos kamionok iránti kereslet csappanhat meg, hanem a logisztikai ipar egésze is többletköltségekre készülhet fel a növekvő szállásköltségek és a megváltozó üzemgazdaságossági méret miatt is. Ez várhatóan a többi vállalkozás számára is további költségemelkedést fog jelenteni, mint ahogyan a vásárlók számára is árnövekedést okozhat Európa-szerte.

Eközben hiteles, szakmai adatbázis alapján Németországban, az EU gazdasági-ipari központjában mindössze 13 olyan őrzött és szállást biztosító pihenőhely van, ami alkalmas lenne az új szabályok szerinti pihenőidő eltöltésére és a járművek biztonságos őrzésére, miközben közel 13 millió nagyteljesítményű tehergépjármű fut az EU útjain.

  Henna Virkkunen (PPE), kirjallinen. – Sujuva ja esteetön sisämarkkina on Euroopan talouden perusta. Myös liikenteen osalta on pyrittävä kohti yhtenäistä sisämarkkinaa ja mahdollisimman vapaata liikkuvuutta. Nyt käsiteltävällä liikkuvuuspaketilla pyritään uudistamaan EU:n maanteiden tavaraliikenteen sääntöjä tieliikenteen, lähetettyjen kuljettajien ja kuljettajien lepotaukojen osalta.

On tärkeää puuttua laittomiin käytäntöihin ja tehostaa sääntöjen toimeenpanoa. Olen harmissani siitä, että moni jäsenmaa pyrkii nyt rakentamaan keinotekoisia esteitä vapaalle liikkuvuudelle ja yhtenäiselle sisämarkkinalle. Se on väärä suunta. Tavarakuljetuksia on sujuvoitettava, hallinnollista taakkaa vähennettävä ja käytäntöjä selkeyttävä. Kuljettajien sosiaalisista oikeuksista tulee huolehtia paremman valvonnan ja jäsenmaiden tehostetun yhteistyön kautta. Vastuuta ei voi vierittää kuljettajalle vaan se kuuluu kuljetusyritykselle.

Valitettavasti täytyy todeta, että näissä direktiiveissä on aivan liian vähän huomioitu digitaalisuuden ja automatisaation tuomat muutokset liikenteeseen. Automatisaatio tulee vaikuttamaan esimerkiksi kuljettajien työhön merkittävästi ja nykymuotoinen jäykkä työ- ja lepoaikojen sääntely voi tuoda aikamoisia esteitä työn järkevään organisointiin ja logistiikan suunnitteluun jatkossa. Jatkotyössä pitäisi ottaa huomattavasti innovatiivisempi ote. Tärkeää olisi keskittyä digitaalisten kuljetustilausjärjestelmien edistämiseen. Tilausjärjestelmien digitalisointi edistää palvelujen saatavuutta läpi sisämarkkinoiden, lisää toiminnan läpinäkyvyyttä ja helpottaa valvontaa.

Liikenne tuottaa viidenneksen päästöistä ja liikennemäärien ennustetaan tulevaisuudessa merkittävästi kasvavan. Samaan aikaan kun päästöjä on muilla sektoreilla saatu leikattua, liikennesektorilla ne ovat vain kasvaneet. Koko kuljetusketjun ympäristöystävällisyyttä ja tehokkuutta on tuntuvasti lisättävä. Tavarakuljetuksissa pitää välttää tyhjiä tai puolityhjiä kuljetuksia.
