– den Bericht von Kinga Gál im Namen des Ausschusses für bürgerliche Freiheiten, Justiz und Inneres über den Vorschlag für eine Verordnung des Europäischen Parlaments und des Rates über ein Europäisches Reiseinformations- und -genehmigungssystem (ETIAS) und zur Änderung der Verordnungen (EU) Nr. 515/2014, (EU) 2016/399, (EU) 2016/794 und (EU) 2016/1624 (COM(2016)0731 - C8-0466/2016 - 2016/0357A(COD)) (A8-0322/2017) und

  Kinga Gál, előadó. – Elnök asszony! Évente 30 millió utas érkezik az Európai Unióba 59 vízummentes országból, akikről megérkezésük előtt a hatóságok nem rendelkeznek semmilyen információval. A turistákat, valamint az üzleti célból érkezőket szívesen látjuk Európában. Azok viszont, akik terrorcselekmények, vagy egyéb bűncselekmények elkövetése céljából érkeznek, már jóval beutazásuk előtt beazonosításra kell kerüljenek. Ezt teszi lehetővé az új Európai Utasinformációs és Engedélyezési Rendszer.

Jelen pillanatban nincsenek előzetes információink a schengeni külső határhoz vízummentesen érkező látogatók tekintetében. Ezt az információhiányt hivatott orvosolni az ETIAS, hiszen jelenleg a schengeni térség külső határain szolgáló határőröknek kell meghozniuk ezt a döntést, anélkül, hogy ebben előzetes értékelés a segítségükre lenne. Egyértelmű, hogy nincs meg a megfelelő idő a külső határokon a megfelelő ellenőrzések és keresztellenőrzések elvégzéséhez. Tehát kellett egy olyan rendszer, amely hatékonyabb és gyorsabb kockázatelemzést tesz lehetővé. Ezáltal lehetővé válik a külső határokon való hosszas várakozási idő elkerülése is.

Határaink biztosítása és polgáraink védelme elsődleges prioritást jelent számunkra. Az ETIAS információhiányt szüntet meg azáltal, hogy lehetővé teszi a vízummentes kérelmezők adatainak keresztellenőrzését a többi rendszerünkkel. Ez az automatizált rendszer azonosítja a schengeni térségbe vízummentesen beutazó látogatókhoz fűződő biztonsági, illegális, migrációs és járványügyi kockázatokat. Ugyanakkor összhangban áll az emberi jogi és adatvédelmi szempontokkal, és nem terheli túlzottan az Unióba igyekvők vízummentességét élvező harmadik országok állampolgárait. Ezen utazók számára bizonyosságot jelent, hogy amennyiben rendelkeznek ETIAS-engedéllyel, problémamentesen átléphetik majd az uniós határt. Ez egy egyszerű, gyors, olcsó és eredményes eszköz lesz, amely semmiképp nem minősül vízumnak.

A minél egyszerűbb eljárás megalkotásával az volt a célunk, hogy Európa nyitott maradjon azok előtt, akik turisztikai, üzleti szándékkal érkeznek, de egyben váljon biztonságosabbá is. Három szempont vezérelt a tárgyalások során, nem akartam bonyolultabb eljárás létrehozni, mint a vízumkérelmezők esetében, hiszen ez pont a vízummentesség lényegét venné el. Megpróbáltam megtartani az ETIAS, a Schengeni Információs Rendszer, valamint a határregisztrációs rendszer közötti koherenciát. Nem akartam túlterhelni a mechanizmust, így használhatatlanná tenni.

Szerintem ezeket mind sikerült a tárgyalások során elérni. A Parlamentből kapott mandátumot nagymértékben sikerült érvényesíteni, és nyugodt szívvel mondhatom, hogy az ETIAS működése mindig az alapvető jogok és személyes adatok védelmének maradéktalan tiszteletben tartása mellett fog zajlani.

Mindezért szeretném megköszönni az észt és bolgár elnökségnek, a Bizottságnak, de mindenekelőtt árnyékelőadó kollégáimnak, Guillaume asszonynak, Stevens asszonynak, Deprez úrnak, Vergiat asszonynak a dossziéhoz való konstruktív hozzáállásukat, és a jó légkörben zajló együttműködést.

Szeretném továbbá megköszöni a politikai tanácsadóknak, Katrin Hubernek a LIBE titkárságról, illetve az asszisztenseknek is a hosszas, kitartó és nehéz munkát. Másfél év alatt négy politikai trilógus és 26 technikai egyeztetés eredményeként született meg ez az ideiglenes megállapodás előbb az észt, majd a végleges megállapodás a bolgár elnökség alatt, és végül eredményesen tudtunk zárni a dossziét. Úgy gondolom, az ETIAS az iskolapéldája a jó társjogalkotásnak.

  Dimitris Avramopoulos, Member of the Commission. – Madam President, I would like to tell you that, personally, I am very happy that we have reached this point after a lot of work together. We are now debating, and tomorrow you will vote to adopt, the European Travel Information and Authorisation System (ETIAS), a milestone in our common work.

Together with you and the Council, we jointly agreed to work together to prioritise the legislative work of initiatives where European citizens are clearly expecting us to deliver concrete results. For this, I would like to express my thanks to our rapporteur, Ms Gál, the shadow rapporteurs, and all those involved, for their hard work on this file.

Migration and security are at the very top of our citizens’ concerns, as we see in survey after survey. One of the challenges we identified was to close our information gap on visa-free travellers, while in parallel facilitating legitimate travel. ETIAS was therefore an immediate priority. Today we deliver on this priority.

Let me recall and highlight a few aspects about ETIAS and its concrete benefits. First, it will strengthen internal security and the quality of Schengen border management. Today, border guards have limited time and information when making their assessment on entry. They have no prior information on visa-exempt travellers, especially at land borders. With ETIAS they will benefit from an additional and broader security and migration risk assessment than at the border crossing point, and before the traveller arrives at the Schengen borders. With this system in place we should also see a decrease in the number of refusals of entry at the borders.

In addition to the system contributing to the reduction of migratory risks, persons that pose a security risk will be identified and denied travel authorisation before they arrive. Anyone who is denied authorisation will not waste time and money travelling to Schengen border crossing points. This will also reduce the cost of return for carriers, which will have to repatriate fewer passengers from air, sea and land borders.

Second, while enhancing border management and internal security, ETIAS will at the same time also facilitate travel for visa-exempt third country nationals. Applying for a travel application will be quick, simple and cheap and will not require more than a travel document, credit card and access to the internet. The vast majority of applicants will receive a positive reply within minutes. If additional information or documentation were to be needed, or even the need to have an interview, different possibilities will be offered, taking into account the situation of the traveller.

Third, and this is a crucial point, the system will also help to safeguard our visa liberalisation policy, something which is, of course, a key component of the European Union’s external policy. Several visa liberalisation dialogues are progressing with EU neighbours. Visa liberalisation is also an important tool to promote reforms in partner countries and contribute to overall stability and good cooperation with third countries.

ETIAS is, of course, not a visa, but it will compensate in a relatively light way for the loss of information on travellers who were previously visa-required and hence present in the Visa Information System (VIS). With our Visa Information System, the proposal we made last May will ensure also that ETIAS and the VIS work smoothly together and there is no information gap leading to migratory or security risks, all in full respect of fundamental rights.

Please let me now touch upon some of the data protection aspects of the agreement – what data is collected, its retention and how it is protected. The robustness of the risk assessments to be performed by the system is, of course, related to the data collected and to the checks performed against other systems. The outcome on this point is very balanced. It will allow ETIAS to achieve its objectives and functions efficiently while at the same time minimising the data collected. The system will not require the collection of additional information other than what is strictly necessary. I appreciate Parliament’s contribution to striking a constructive agreement with the Council on this point.

As regards now data retention, the agreement is fully in line with the European Parliament’s proposal on extending the retention period only if the applicant freely and explicitly consents. In terms of data protection, the proposal was built to be fully compatible with our new data protection framework. As you know, the extensive discussions reflect a delineation between the General Data Protection Regulation and the Police Directive without affecting their scope of application. Data is protected against risk of abuse. Access is restricted to specific persons within designated competent authorities. Transfer of data to third parties is prohibited, except for exceptional cases where the entry/exit system would not already contain necessary data.

Travellers have the right to access, rectification and deletion of their personal data stored in ETIAS. Supervision is provided by the European Data Protection Supervisor and independent national supervisory authorities. The system will be built in accordance with the principles of data protection by design and by default. Moreover, the Fundamental Rights Guidance Board will, at the suggestion of you, the European Parliament, reinforce and advise the ETIAS screening board by appraising and issuing opinions on the impact on fundamental rights and of implementing ETIAS screening rules.

Today, we are ready to pursue our joint commitment to the full and continue to deliver results for the benefit of our citizens. We should rapidly start to develop ETIAS so that it is up and running in 2021. I am looking forward to the debate today, and thank you for your continued commitment to truly European initiatives which enhance our external border management, ensuring more safety for our citizens.

  Gérard Deprez, rapporteur pour avis de la commission des budgets. – Madame la Présidente, Monsieur le Commissaire, je félicite tout d’abord notre collègue Kinga Gál pour le remarquable travail que nous avons eu l’occasion d’accomplir avec elle.

La proposition dont nous discutons aujourd’hui est importante, parce qu’elle concerne potentiellement 1,4 milliard de citoyens venant d’une soixantaine de pays, qui sont exemptés de l’obligation de visa, et elle concerne réellement chaque année 30 à 40 millions de personnes qui entrent sur le territoire de l’Union européenne. Le système proposé est simple: tout ressortissant d’un pays tiers, dispensé de l’obligation de visa, devra disposer demain d’une autorisation préalable avant de se présenter aux frontières de l’Union.

Première question: une telle mesure est-elle nécessaire? À notre avis, oui. Parmi les 30 à 40 millions de personnes qui sont désireuses d’entrer dans l’Union chaque année, certaines peuvent représenter un risque réel pour la sécurité intérieure, un risque migratoire ou un risque pour la santé publique par la diffusion d’épidémies. ETIAS est donc un plus pour la sécurité intérieure, pour le contrôle des frontières, parce qu’il permet de repérer à temps les risques potentiels. C’est aussi un plus pour les voyageurs eux-mêmes. Sait-on qu’il y a actuellement chaque année près de 300 000 personnes qui sont refoulées aux frontières de l’Union, alors qu’elles ont déjà supporté les frais de leur voyage? ETIAS diminuera considérablement ce nombre.

Deuxième question: cette mesure est-elle insupportable sur le plan bureaucratique? À l’évidence, non. Il suffira aux voyageurs d’introduire une demande en ligne en remplissant un formulaire standard et 95 % des demandeurs recevront une réponse positive dans les minutes qui suivent.

Troisième question: cette mesure est-elle excessivement coûteuse pour les voyageurs? Cela peut se discuter, mais 7 euros par personne pour une autorisation qui sera valable pendant 3 ans ne nous semble pas excessif. À titre de comparaison, le prix d’un visa est de 60 euros.

Et enfin – et le commissaire a insisté sur ce point – cette mesure respecte les droits fondamentaux. Les données personnelles ne sont conservées que pendant la durée de validité de l’autorisation. Aucune question sensible n’est autorisée. Un comité d’éthique est institué pour vérifier que les indicateurs de risque sont nécessaires et proportionnés et un droit d’appel contre une décision de refus est instauré. Pour toutes ces raisons, mon groupe votera résolument en faveur du projet ETIAS.

L-ETIAS aħna nqabbluha mal-ESTA tal-Istati Uniti, hemm min jgħid li aħjar, għaliex aħna ħloqna sistema li permezz tagħha b’mod awtomatiku tkun tista’ ssir analiżi li jekk persuna minn pajjiż terz li ma jkollhiex bżonn viża imma li tkun trid tidħol fl-Ewropa toħloq problema jew theddida għas-sigurtà taċ-ċittadini Ewropej qabel ma l-persuna tkun waslet fil-fruntieri. Dan ifisser li aħna nkunu nafu min ser jaqsam lejn l-Ewropa qabel ma jaslu fil-fruntieri tagħna. L-immaniġjar ta’ din is-sistema jsir online u minn fuq mobile. Din hija waħda mil-liġijiet Ewropej l-aktar importanti fejn tidħol is-sigurtà, u jiena kburija li l-Grupp tal-Partit Popolari Ewropew kien katalist f’dan, u rrid nirringrazzja minn qalbi lir-Rapporteure tal-paċenzja tagħha, kif ukoll lill-Kummissarju Avramopoulos li qasmu t-tnejn li huma l-għarfien tagħhom dwar is-suġġett magħna.

Dak li qed isir ifisser bidla fir-regoli kif naffrontaw is-sigurtà fl-Ewropa. Għandna għodda essenzjali li ħloqna fosthom dan huwa l-iżjed importanti.

  Sylvie Guillaume, au nom du groupe S&D. – Madame la Présidente, je salue Kinga Gál et les rapporteurs, mais surtout je veux saluer nos assistants, qui ont participé à d’innombrables réunions techniques, et à qui on doit vraiment tout le respect. Il y a eu en effet des négociations tout à fait intenses sur ce dossier jugé prioritaire par la commission des libertés civiles, de la justice et des affaires intérieures et le Conseil, qui se sont mis d’accord pour créer cette autorisation de voyage pour les ressortissants de pays tiers exemptés de visa, sur le modèle de l’ESTA aux États-Unis. Ces ressortissants devront demander une autorisation ETIAS en ligne en donnant des informations sur eux—mêmes et leur voyage. Je fais une petite parenthèse sur du vécu, j’espère que les arnaques en ligne pour l’obtention d’ETIAS seront moins nombreuses que pour l’obtention de l’ESTA. Je ferme la parenthèse de vécu. Ce système sera censé vérifier, avant que les voyageurs n’arrivent, s’ils représentent ou pas un risque pour la sécurité publique, la santé publique ou en matière d’immigration irrégulière. Aujourd’hui, munis de leur seul titre d’identité, ces risques sont évalués dans des délais qui sont parfois contraints à la frontière. La Commission a donc imaginé ce nouveau système comme une pré-autorisation, une évaluation en amont, en quelque sorte.

Dit comme cela, une fois qu’on admet la nécessité de contrôles aux frontières extérieures, ce qui est mon cas, tout a l’air fluide, mais j’ai tout de même émis quelques réserves sur ce système. Certaines ont pu se solder par l’ajout de garanties, comme c’est le cas sur certains domaines, d’autres relèvent plutôt de la forme des négociations européennes sur la sécurité.

Sur le fond, comme tout système d’information européen, mon groupe politique a travaillé en étant préoccupé par ces objectifs, mais surtout par son impact sur les droits des demandeurs et la protection de leurs données. Ainsi, grâce à notre initiative, il a été ajouté au système un organe d’évaluation et de recommandation, un guidance board, qui est composé d’experts indépendants chargés de vérifier que celui-ci n’entraîne pas de violation des droits fondamentaux des voyageurs. Nous avons aussi garanti qu’il n’y ait pas de rétention systématique des données des voyageurs, ce qui est conforme à l’arrêt de la Cour de justice sur l’accord PNR UE-Canada. Cet outil prendra la forme d’une base de données gérée par l’Union et ses États membres. Les entreprises de transport et les garde-frontières devront vérifier que chacun des voyageurs concernés dispose d’un ETIAS avant de le laisser partir ou entrer dans l’Europe.

Ce système sera colossal à mettre en œuvre. Quand on voit les difficultés d’un certain nombre d’États membres à appliquer le PNR européen dans les délais prévus, on peut émettre quelques doutes sur la date de mise en œuvre opérationnelle d’ETIAS.

Mon plus grand regret sur ce texte concerne les velléités des États membres d’élargir les objectifs du système. ETIAS était conçu comme une simple autorisation de voyage, or le Conseil a proposé, par exemple, d’en faire un détecteur de mensonges.

Il souhaitait que chaque voyageur déclare l’adresse de son premier séjour et qu’à la frontière, les garde-frontières puissent demander l’adresse où se rendrait la personne et vérifier dans le système si celle-ci était conforme à ce qui avait été déclaré lors de la première demande en ligne. Le Parlement a heureusement réussi à éviter cette machine infernale.

Je conclus en soulignant que ces négociations européennes devraient vraiment privilégier les réflexions et les conceptions stratégiques pour créer des textes applicables et respectueux des personnes.

  Helga Stevens, namens de ECR-Fractie. – Voorzitter, ik ben blij dat morgen over het Ethias-dossier wordt gestemd, nadat we er maanden hard aan hebben gewerkt. Het werd immers samen met het inreis-uitrreissysteem in een studie geïdentificeerd als een belangrijke ontbrekende schakel in de Europese grensbewaking.

Dit systeem zal hopelijk vanaf 2021 buitenlanders die geen visum nodig hebben om naar Europa te komen, vooraf screenen. Een automatische bevraging van Europese en internationale databanken moet de veiligheidsdiensten een totaalbeeld geven. Zo zal iemand die geseind staat via het Schengen Informatie Systeem, niet meer onopgemerkt kunnen afreizen naar de Schengenlanden.

Maar het systeem is meer dan het consulteren van databanken. Het tracht ook risico's te voorspellen met slimme algoritmes en statistiek. Goed nieuws voor de belastingbetaler: het systeem is zelfbedruipend, want de aanvragers betalen 7 EUR voor hun elektronisch verzoek. In de meeste gevallen krijgen de verzoekers binnen de tien minuten een beslissing. Het systeem is immers volautomatisch en enkel bij mogelijke identiteitsverwarring of een hit wordt de aanvraag manueel nagekeken. Een toelating geldt voor drie jaar.

Het systeem moet grenswachters ondersteunen die ter plekke aan de grens de beslissing moeten nemen om iemand al dan niet toe te laten. Via Ethias kunnen ze zien of een toelating werd afgeleverd en of een bijkomende controle nodig is.

De N-VA is zeer tevreden dat ook politiediensten en immigratieautoriteiten het systeem elk binnen hun mandaat zullen kunnen consulteren. Zo dichten we een belangrijke lacune in de bewaking van onze buitengrenzen. Europa wordt weer wat veiliger.

  Romeo Franz, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin, liebe Kolleginnen und Kollegen! Nicht erst seit dem Treffen des Europäischen Rates letztes Wochenende wird die vorgebliche Absicherung der EU-Außengrenzen für Symbolpolitik und Schmierenkomödien benutzt. Bei ETIAS haben wir es mit einer Symbolpolitik zu tun, die gleichzeitig gefährlich, teuer und unwirksam ist.

ETIAS führt ein Visum durch die Hintertür ein. Und die Antragstellerinnen und Antragsteller müssen sogar mehr Daten abgeben als andere für einen Visumantrag!

ETIAS ist teuer: Sogar die Kommission geht von Entwicklungskosten in Höhe von 212 Millionen Euro und jährlichen Kosten von 80 Millionen Euro aus. Das Geld fehlt bei ordentlicher Polizeiarbeit und bei Grenzbeamten.

ETIAS ist gefährlich: Die Entscheidung darüber, ob jemand ein Risiko darstellt, wird in vielen Fällen einem Algorithmus überlassen, der völlig unklar arbeitet und nicht näher spezifiziert ist. Das ist automatische Diskriminierung und widerspricht unserem Bericht über Big Data und Grundrechte, den dieses Haus vor einem Jahr mit breiter Mehrheit verabschiedet hat.

Und zuletzt: ETIAS ist unwirksam. Ein Abgleich mit Datenbanken wie dem Schengener Informationssystem findet bereits jetzt bei der Einreise statt. Der Mehrwert von ETIAS sind die zusätzlichen Daten, die nun auch ausgewertet werden sollen. Diese kommen aber von den Reisenden selbst, die fröhlich die Unwahrheit sagen können.

Wir Grüne werden solch eine teure, uneffektive, gefährliche Symbolpolitik nicht mittragen. Daher lehnen wir ETIAS ab.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Madame la Présidente, ETIAS est l’un des derniers volets du paquet «Frontières».

Il va parachever la construction de l’Europe forteresse, ériger des murs électroniques en sus des murs physiques et des barbelés déjà mis en place. Grâce au système d’entrée et de sortie, tout ressortissant de pays tiers entrant dans l’Union européenne sera désormais recensé, fiché, suivi à la trace. Pour le moment, seuls y échappaient ceux qui n’avaient pas besoin de visa. ETIAS y remédie en créant pour eux ce que j’appelle un visa low cost, un visa qui ne dit pas son nom, une autorisation de voyage payante, sur le modèle de ce qui existe aux États-Unis et en Australie.

Les données fournies sont même sur certains points, plus nombreuses, voire plus intrusives que pour un visa, donc plus attentatoires à la protection des données, plus dangereuses pour les risques de profilage, sans parler de la coopération policière avec des pays tiers non sûrs. Et pour cela, on a inventé une nouvelle procédure institutionnelle consistant à donner un mandat politique à nos collaborateurs pour qu’ils parachèvent la négociation technique pendant près de 6 mois après l’accord politique. Tout cela aurait mérité mieux.

Décidément, ces frontières intelligentes ne le sont pas. L’Union européenne continue de se renier, donnant des gages à l’extrême droite au détriment des droits et des libertés, des principes de nécessité et de proportionnalité, sans que l’efficacité du point de vue de la sécurité soit prouvée, mais pour un coût exorbitant dont quelques lobbies militaro—sécuritaires sauront profiter, ici et ailleurs. Cela me navre, Monsieur le Commissaire, et pour nous, c’est non et encore non.

  Gilles Lebreton, au nom du groupe ENF. – Madame la Présidente, l’espace Schengen est ouvert à tous les vents. L’Union européenne prend enfin conscience des dangers que cela représente, notamment en matière de sécurité. C’est pourquoi elle veut mettre en place ce système ETIAS, qui permettra d’obtenir des renseignements personnels sur les ressortissants de 62 États, dont l’Arabie saoudite, dispensée de visa pour entrer dans l’espace Schengen. Cela concernera près de 40 millions de personnes entrant dans l’espace Schengen chaque année.

J’approuve évidemment cette mesure de précaution élémentaire, mais je m’étonne qu’il ait fallu attendre 2018 pour la mettre en œuvre. D’autre part, et surtout, mon approbation d’ETIAS ne signifie pas que je succombe au charme supposé de l’espace Schengen. ETIAS n’est selon moi qu’un pis-aller. La véritable solution pour assurer la sécurité des États européens est de rétablir les contrôles aux frontières nationales.

  Κωνσταντίνος Παπαδάκης (NI). – Κυρία Πρόεδρε, οι επικίνδυνες αποφάσεις της τελευταίας συνόδου κορυφής συνιστούν μνημείο αντιδραστικότητας, ενισχύουν το υπάρχον πλέγμα κατασταλτικών μηχανισμών της Ευρωπαϊκής Ένωσης που επεκτείνει και η εν λόγω έκθεση, τόσο στα σύνορα, όσο και στην ενδοχώρα κάθε κράτους μέλους. Είχαμε μέχρι τώρα την ελευθερία - τη λεγόμενη - της Σένγκεν, με το όργιο φακελώματος με όλες τις σύγχρονες τεχνολογικές μεθόδους, δακτυλικά αποτυπώματα, βιομετρικά δεδομένα και τα λοιπά και τώρα με το ΕΤΙΑS. Η δε βίζα, που είχε καταργηθεί για τους ταξιδιώτες τρίτων χωρών, επανέρχεται με τη μορφή άδειας, την οποία μάλιστα η συνοριοφυλακή μπορεί και αυτή ακόμα να την απορρίψει.

Μέχρι αποδείξεως του εναντίου, στην ουσία τυλίγονται άνθρωποι σε μια κόλλα χαρτί, στο όνομα της καταπολέμησης της τρομοκρατίας, της αποκαλούμενης παράνομης μετανάστευσης, της σκόπιμα θολής και αυθαίρετης έννοιας της ριζοσπαστικοποίησης. Άλλωστε, εκμηδενίζονται και τα ποσοστά προσφύγων, διωκόμενων ανθρώπων, που δικαιούνται πολιτικό άσυλο και διεθνή προστασία. Εδώ λοιπόν και τώρα, να καταργηθούν οι τρομονόμοι και όλο το ευρωενωσιακό αντιλαϊκό πλέγμα καταστολής και φακελώματος που και η κυβέρνηση ΣΥΡΙΖΑ-ΑΝΕΛ στην Ελλάδα τηρεί απαρέγκλιτα.

  Agustín Díaz de Mera García Consuegra (PPE). – Señora presidenta, señor comisario, el sistema SEIAV someterá a un control de seguridad detallado a cada solicitante para determinar si se le autoriza la entrada a cualquier país del espacio Schengen. El SEIAV, además de utilizarse para fines de turismo y empresariales, también permitirá a las personas visitar los países del espacio Schengen por motivos médicos o de tránsito. Además, será obligatorio para todos los países que estén exentos del visado Schengen.

Países como los Estados Unidos o Canadá cuentan con sistemas muy parecidos, que se han revelado muy útiles. Hablo del eTA o del ESTA. La finalidad última del SEIAV es la seguridad. El terrorismo que nos ha atacado en los últimos años nos obliga a tomar medidas que ayuden a la identificación de las personas que puedan representar un riesgo antes de su llegada a las fronteras de la Unión. Esta identificación será posible gracias a la comparativa que se realice entre los datos recogidos en el SEIAV y los datos almacenados en las bases Europol. En el mismo sentido, Europol podrá consultar las bases de datos del SEIAV para utilizarlas como un instrumento de detección de amenazas y otras operaciones.

Este sistema, señorías, va a formar parte del paquete de interoperabilidad. El SEIAV, junto con el SIS, el VIS, Eurodac, el sistema de entradas y salidas, el ECRIS, Europol e Interpol. El SEIAV es una pieza fundamental en el portal de búsqueda europeo. Esto pondrá fin a las lagunas de información y garantizará rápidamente la identificación completa del denominado «sujeto amenaza».

Aunque, por otra parte, señor comisario, señora ponente Kinga Gál, el SEIAV en sí mismo es un instrumento básico para continuar con las mejoras de los sistemas de información y control de las fronteras, y para mejorar también su seguridad.

  Tanja Fajon (S&D). – Spoštovani predsedujoči komisar! Pred nami je še en zakonodajni sveženj, ki je namenjen varnosti in krepitvi zunanjih meja Unije. A kako učinkovito in na čigav račun, se sprašujem.

Sistem ETIAS bo od potnika v zameno za plačilo zahteval pridobitev predhodnega dovoljenja za potovanje, ki pa ne bo dovoljenje za vstop. Sistem bo tako imel velike posledice na samo potovanje in prestopanje schengenske meje ter na temeljne pravice, zlasti do zasebnosti.

Tovrstnih ukrepov smo bili v Parlamentu v zadnjih letih prisiljeni sprejeti že veliko, in sicer v zameno za ohranjanje odprte Evrope in odpravo kontrol na notranjih mejah. Sprašujem se, ali je ETIAS res potreben oziroma kakšen je cilj.

V pogajanjih številna vprašanja niso bila ustrezno razrešena. Zaenkrat nimamo zadostnih zagotovil, da ETIAS ne bo služil kot diskriminatorno orodje, ki bo na podlagi vprašljivih algoritmov številnim brez pravega razloga preprečil potovanje v Unijo. Prav tako ne vemo, kako bo sistem deloval v praksi, zlasti na kopenskih mejah. Tovrstnih izkušenj niti najbolj varnostno orientirane države, kot so ZDA, nimajo.

Kako bo Komisija preprečila kolaps na meji, ki smo mu bili priča ob uveljavitvi sistematičnega pregleda potnikov v bazah podatkov na slovensko-hrvaških mejah aprila lani?

Sama imam glede ETIASA pomisleke, zlasti za posledice, ki jih bo sistem prinesel tudi za regijo Zahodnega Balkana. V času priprave zato Komisiji polagam na srce, da resnično preuči vse učinke in ne hiti z uveljavljanjem takega sistema, ki ga bo težko izvajati v praksi.

  Monica Macovei (ECR). – Domnule președinte, 1,4 miliarde de persoane din 60 de țări pot intra în Uniunea Europeană fără vize. În ultimii ani, s-a dovedit că o parte dintre aceste persoane nu vin să respecte și nu respectă normele și valorile europene. De aceea, s-a creat ETIAS. Este un sistem care va autoriza intrarea acestora în Uniune. În procesul de autorizare, sistemul ETIAS va stabili dacă prezența persoanei respective pe teritoriul nostru reprezintă un pericol pentru siguranța cetățenilor, pentru sănătate sau dacă este vorba despre o migrație ilegală – desigur, și dacă este un pericol pentru starea de legalitate și nu ne vin criminali.

ETIAS va verifica fiecare cerere în bazele de date europene care conțin informații despre circulația în și din Uniunea Europeană a diferitelor persoane. De asemenea, va avea acces și va lucra alături de agențiile europene tocmai pentru a ajuta la identificarea persoanelor căutate, pentru a fi arestate în vederea extrădării, de exemplu, sau a persoanelor dispărute, a minorilor pe care îi căutăm și sunt victime ale traficului de ființe umane sau a persoanelor care se sustrag procedurilor judiciare.

Aș mai face o mențiune. Dacă sunt cozi la frontiere, așa cum am auzit – da, sunt în unele țări –, atunci este pentru că statele respective nu au cumpărat scannerele care să facă fluiditatea cursului intrării sau ieșirii dintr-un stat și care să verifice în bazele de date pe o singură interfață toate aceste informații. Atunci toate lucrurile merg bine. Dacă rămânem cu ghișee, atunci nu vor merge bine.

  Carlos Coelho (PPE). – Senhor Presidente, Senhor Comissário Avramopoulos, Caras e Caros Colegas, já em 2015, a propósito da Agenda Europeia para a Segurança, defendi que a nossa prioridade deviam ser os três grandes sistemas da União existentes: o Sistema de Informação de Schengen – o SIS –, o Eurodac e o VIS – o Sistema de Informação sobre Vistos.

A segurança dos cidadãos, a liberdade de circulação dos europeus e a integridade do espaço Schengen preservam-se através do reforço e da melhor utilização destes sistemas: um Eurodac melhorado e reformado para refletir os novos desafios ligados principalmente ao asilo, um Sistema de Informação de Schengen reforçado e melhor utilizado para refletir os novos desafios de segurança e, por fim, um Sistema de Informação sobre os Vistos, o VIS, reformado para refletir os desafios da mobilidade e migração.

Em vez de novos e múltiplos sistemas de informação, o nosso investimento e o nosso esforço deveriam ser centrados nos sistemas existentes, como, aliás, resultava claro das avaliações de Schengen.

O Eurodac está prestes a ver a sua reforma concluída. A reforma do sistema de informação de Schengen, na qual tive a honra de ser o vosso relator, acaba de ser concluída. Com a reforma do VIS, para a qual terei também a honra de ser relator deste Parlamento, iremos fechar este ciclo de reformas.

Obviamente que permaneço crítico relativamente ao método seguido e ao frenesim legislativo nesta área, que resulta da excessiva reatividade da Comissão aos pedidos dos Estados-Membros.

A despeito de tudo isto, o trabalho levado a cabo pela relatora Kinga Gál foi notável. O compromisso alcançado reflete bem a posição maioritária deste Parlamento. Mas sejamos claros: o desenvolvimento e a implementação deste sistema irão levantar inúmeros desafios, nomeadamente de cumprimento dos custos orçamentados. O escrutínio deste sistema, como de todo o pacote de sistemas de informação, terá de ser rigoroso.

  Brando Benifei (S&D). – Signor Presidente, onorevoli colleghi, saluto il gruppo di visitatori italiani che ci ascolta dalla tribuna. L'introduzione di un sistema di ingresso per i cittadini di paesi esenti da visto è stata voluta dagli Stati membri per rafforzare le frontiere esterne dell'UE, sulla scia delle paure legate a sicurezza e immigrazione.

La proposta della Commissione poneva seri rischi di profilazione dei cittadini non europei, non in coerenza con le norme sul trattamento dei dati e con i nostri stessi diritti fondamentali. In commissione AFET abbiamo posto inoltre il problema dell'impatto sulle relazioni diplomatiche e sul turismo, una questione che ci pare sottovalutata e che invece deve essere tenuta in grande considerazione.

Il testo è migliorato ma soltanto in parte: l'eliminazione delle domande sul livello di istruzione e occupazione e l'attenzione all'accessibilità del sito per i disabili sono certamente positive, così come il più forte riferimento alle norme sulla privacy e l'istituzione di una commissione etica.

Continua però a preoccupare che sia un algoritmo a dover valutare la possibilità ipotetica che una persona commetta un reato grave o decida di immigrare irregolarmente: questo rimane un concetto inaccettabile e quindi il Parlamento dovrà continuare a vigilare sull'implementazione.

  Ruža Tomašić (ECR). – Poštovani predsjedavajući, želimo li Europu koja je u svakom smislu sigurno okruženje za njezine građane i sve one koji u njoj pronalaze utočište, unaprjeđenje informatičkih rješenja za kontrolu i nadzor granica od velike je važnosti.

Europski sustav za informacije o putovanjima i njihovom odobrenju, kroz naprednu će računalnu platformu omogućiti brzu i učinkovitu razmjenu informacija važnih za sprječavanje prijetnji za sigurnost građana i javno zdravlje.

Dijelim stajalište s izvjestiteljicom da je maksimalnu valjanost odobrenja putovanja potrebno skratiti u odnosu na prijedlog Komisije, a predložene tri godine smatram sasvim razumnim rokom u postojećem zahtjevnom sigurnosnom kontekstu, u kojem je poželjno češće provjeravati putnike.

  Tomáš Zdechovský (PPE). – Pane předsedající, vytvoření evropské obdoby amerického systému ESTA je z mého pohledu určitě důležité a žádané. Obdobný systém doposud na evropské úrovni není a je to škoda, protože ESTA je důkazem, že má přidanou hodnotu a zrychluje ty žádosti o vstup do amerického prostoru.

Já jsem pro systém ETIAS a podporuji řešení, které navrhuje kolegyně Gálová, neboť zapadá do evropské strategie v oblasti bezpečnosti a následně i migrace, jak zmínil pan komisař. Ve světle politiky bezpečnosti, migrace a víz je tento systém opravdu potřebný a vzhledem k tomu, že jej bude možné do budoucna propojit i s dalšími systémy, jako jsou vízový a informační systém nebo systém vstupů a výstupů nebo mezinárodní policejní databáze, je určitě tento systém důležitý nejenom pro cestování, ale má naprosto klíčový význam v oblasti bezpečnosti. Z těchto důvodů, vážený pane předsedající, chci, aby tento návrh nařízení a jeho následná implementace byly co nejrychleji projednány. Je také důležité, aby byly co nejrychleji projednány i technické požadavky na tento systém a tento systém byl spuštěn. Taktéž podporuji poplatek ve výši 7 EUR a opravdu se směju všem jeho kritikům. Myslím si, že ten poplatek bude směřován do rozvoje toho systému a zvýší se tak jeho lepší vývoj a implementace.

Podle mě je systém ETIAS velmi dobrým a udržitelným nástrojem a myslím si, vážený pane komisaři, že čím dříve budou tento systém a toto nařízení implementovány, tím lépe.

  Doru-Claudian Frunzulică (S&D). – Mr President, I welcome the outcome of the report as it improves the proposal to create a European Travel Information and Authorisation System (ETIAS), mimicking the Electronic System for Travel Authorisation (ESTA) system in the United States. The system will be used to determine whether travellers from visa—free countries will be allowed to enter the territory of the European Union.

While Europol does not belong to the Schengen acquis and whereas ETIAS will fully belong to it, I welcome that Europol is being strengthened by extending its tasks, especially the responsibility to develop and host the ETIAS watch list. I support the call for the management board, after consulting the European Data Protection Supervisor (EDPS), to adopt guidelines further specifying the procedure for the processing of information for the purpose of the ETIAS watch list.

I also share the opinion that it is important to increase institutional cooperation by ensuring that Europol shares information with ETIAS as regards any terrorist offences and ensuring direct consultation through the ETIAS National Unit of the Member States responsible in cases falling under Europol’s mandate. This is very important when it comes to fighting terrorism.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, το ευρωπαϊκό σύστημα πληροφοριών και άδειας ταξιδίου θεωρώ ότι έρχεται να καλύψει τα τεράστια λάθη και τις αδυναμίες που έγιναν, κύριε Αβραμόπουλε, καθώς αφαιρέσατε μια σειρά χώρες οι οποίες υποχρεούνταν να πάρουν βίζα. Κλασική περίπτωση το Κόσοβο, ή άλλες αραβικές χώρες οι οποίες είναι ύποπτες για θέματα τρομοκρατίας. Επομένως, δεν θεωρώ ότι επί της ουσίας θα κάνετε κάτι το ιδιαίτερο. Δεύτερον, οι περισσότεροι που διαπράττουν τρομοκρατικές δράσεις στην Ευρώπη είναι πολίτες της Ευρωπαϊκής Ένωσης και αυτό το έχουμε δει. Τρίτον, τα στοιχεία τα οποία θα μαζέψετε στην ουσία θα δημιουργήσουν ένα τεράστιο φακέλωμα. Τέταρτον, δεν θεωρώ ότι καλύπτει το σύστημα αυτό, μια και αφήνετε έξω όσους μεταφέρουν με τουριστικά λεωφορεία επί τρία χρόνια και δεν έχουν καμία υποχρέωση συνεργασίας.

Επιπλέον, στη Σάμο, αν είναι κάποιοι να πάνε πρέπει να πάρουν αυτή την άδεια. Την ώρα όμως που θα έρχονται δεκάδες βάρκες με παράνομους μετανάστες, θα αποβιβάζονται και θα παραμένουν στην περιοχή κάνοντας μία αίτηση ασύλου. Επομένως, αντιλαμβάνεστε την τεράστια αντίφαση. Οι νόμιμοι που θέλουν να έρθουν στην Ευρωπαϊκή Ένωση θα ζητάνε άδεια και οι παράνομοι θα συνεχίσουν να έρχονται με τις βάρκες στα νησιά του Αιγαίου. Δείτε, λοιπόν, τις τεράστιες αντιφάσεις.

  Dimitris Avramopoulos, Member of the Commission. – Mr President, it is needless to repeat that external borders management is at the very core of our work to enhance security and improve our management of migration. Together, we are implementing initiatives which make a clear difference in that domain. At the European External Action Service (EEAS), we promote mobility between the Schengen area and third countries, while contributing to the fight against terrorism and serious crimes and safeguarding fundamental rights.

In this context, I welcome the fact that you have recently reached an agreement with the Council on eu-LISA and SIS. On SIS, one of the main priorities of the ETIAS rapporteur was to ensure coherence between SIS and ETIAS. A big effort on this was made during the negotiation on ETIAS.

The Visa Information System (VIS) together with ETIAS and the recently adopted entry—exit system will together form part of a single platform for third—country nationals visiting the European Union. ETIAS will fill a significant information gap on visa exempt travellers. The VIS proposal will close the gap on long—stay document holders. Together, the three systems will allow verifications of third—country nationals crossing our external borders into the Schengen area for short and long stays. It is therefore of paramount importance that the development of the three systems is synchronised, as ETIAS provides for interoperability with our other EU information systems for borders, migration and security. It not only brings added value, in itself, but also reinforces the added value of other EU information systems.

The reinforced eu-LISA will be the beating heart of our work to develop these systems, put them into effect and ensure their smooth and seamless functioning. For these reasons, I call on you to reach a swift agreement with the Council on the VIS proposal so that together we can add the last missing piece of the new EU information platform for borders and security.

I am looking forward to the start of the development of ETIAS and the other information systems we have in the pipeline. You will remember that it was one of my priorities from the very first moment I was designated Commissioner responsible for security and migration. I am more than happy to share the responsibility with you and, most importantly, to share the results that we achieve. I encourage you to support these important pieces of legislation when you vote later tomorrow.

  Kinga Gál, Rapporteur. – Elnök úr, Biztos úr! Köszönöm a kollégák támogató hozzászólásait, és el kell mondanom azoknak, akik aggodalmukat fejezték ki a rendszerrel kapcsolatban, hogy biztosítani szeretném őket arról, hogy a tárgyalások során minden aggodalmat igyekeztünk valamilyen módon orvosolni, és a Parlament olyan szöveget tudott elfogadtatni, ami gyakorlatilag minden reményt felülmúlt. Úgyhogy ebben szerintem mindent megtettünk, a Nyugat-Balkán érdekeinek figyelembevételét úgyszintén, és hozzátenném Marias úrnak, hogy nem, nem történhet meg az, hogy vízummentes országból érkező állampolgár rosszabb helyzetbe kerüljön, mint egy illegális bevándorló. De hát éppen ezért van szükség arra, hogy rendesen és normális módon alkalmazzák a jogszabályokat.

Az ETIAS az egyike lesz ezeknek a jogszabályoknak, amelyeket a biztonság területén a társjogalkotók az utóbbi időben megalkottak, és csak az intelligens határellenőrzés, valamint az átjárható uniós információs adatbázisok által vehetjük fel a harcot a bűnözők és a terroristák folyamatosan változó módszereivel. Többet kell tudnunk arról, hogy ki és milyen szándékkal érkezik, valamint arról, hogy ki az, aki bűncselekményeket követ el az Unió határain belül és kívül.

A holnapi napon három szavazásra kerül sor az ETIAS mentén: az egyik a rendelet, amelyet két részre kellett szedni, mivel új feladatokat ruház az Europolra, ezért az Europol-rendelet módosítása is szükségessé vált. Ugyanakkor az ETIAS rendelettel nem módosíthattuk az Europol rendeletet, mert a részt vevő államok nem azonosak. A harmadik szavazást pedig a Tanács és a Parlament közös nyilatkozatáról lesz, amely pusztán arra szolgál, hogy gyorsítsa a schengeni társult országok ETIAS-ban való részvételének folyamatát. Ehhez a három szavazáshoz kérem a kollégák támogatását, és remélem, ezt megkapom a holnapi napon. Köszönöm!

  Claudia Țapardel (S&D), in writing. – Security has been a constant theme on the EU’s agenda within the last years and that is why concrete actions have to be taken in this sense. In the light of the recent challenges that the EU is currently facing, especially in terms of migration, it is clear that there is a need for a new approach regarding border security.

The European Travel Information and Authorization System – a completely electronic system – will allow and keep track of visitors from countries who do not need a visa to enter Schengen. ETIAS will undergo a detailed security check of each applicant to determine whether they could be allowed to enter any Schengen country. Thus, the travel authorisation system will gather, keep track of and update necessary information regarding visitors, to determine whether it is safe for them to enter Schengen countries.

I fully support the proposal and I am convinced that implementing ETIAS is another important step in protecting EU’s external borders. Moreover, I consider that this system is in the best interest of European citizens, while maintaining a balance between their safety and protection of their rights and freedom of movement.
