  Președintele. – Următorul punct de pe ordinea de zi este dezbaterea privind raportul domnului Juan Fernando López Aguilar, în numele Comisiei pentru libertăți civile, justiție și afaceri interne, conținând recomandări adresate Comisiei privind vizele umanitare (2017/2270(INL)) (A8-0328/0000).

  Juan Fernando López Aguilar, ponente. – Señor presidente, comisario, el 90 % de los seres humanos que han llegado a la Unión Europea en demanda de asilo y han conseguido interponer su demanda lo han hecho habiendo llegado irregularmente. La razón es muy simple, y es que no se les dio ninguna oportunidad de hacerlo regularmente. No existió ninguna opción, ninguna vía legal de acceso seguro; de modo que quienes lo consiguieron son los supervivientes de una aventura terrible, en la que lo arriesgaron todo y, a menudo, lo perdieron. Arriesgaron la vida y la de los seres queridos y, a menudo, la han perdido.

Treinta mil muertes en el Mediterráneo. Y una y otra vez que hemos debatido este hecho escalofriante en el Parlamento Europeo nos hemos llenado la boca de la palabra «vergüenza», urgiendo a la Comisión y al Consejo una respuesta. Pero este Parlamento está dispuesto a apoyar esa respuesta, a promover esa respuesta. Y esta iniciativa legislativa del Parlamento Europeo es parte de la respuesta. Constituye un intento de abrir una vía legal para que los demandantes de asilo y refugio, o de algún tipo de protección humanitaria, puedan acudir en sus países de origen o de tránsito a algún consulado o embajada de la Unión Europea y plantear legítimamente su pretensión de acceso regular a la Unión Europea, sin necesidad de exponerse a las mafias que trafican con personas, a las redes de tráfico ilícito y explotación de seres humanos, que violan sistemáticamente los derechos fundamentales y se ensañan con las personas más vulnerables: las mujeres y los niños indefensos.

Esta respuesta humanitaria forma parte de la demanda sostenida del Parlamento Europeo. La hemos suscrito y votado por amplias mayorías en este Parlamento Europeo una y otra vez en nuestras resoluciones más significativas. La de 12 de abril del año 2016, una Resolución que pedía una aproximación holística, es decir, comprehensiva de todos los elementos del hecho migratorio y de la demanda de asilo y refugio, en cumplimiento del Derecho europeo, que ordena responsabilidad común y gestión compartida de las fronteras exteriores, de los flujos migratorios y de las demandas de asilo.

En tanto llega ese sistema europeo común de asilo, haremos lo correcto apoyando una iniciativa que pide a la Comisión que adopte la necesaria medida para ofrecer ese marco común normativo europeo a los Estados miembros, que les permita dar cobertura a la posibilidad, de manera ordenada, de abrir la puerta legal que nos ha venido demandando durante años el conjunto de organizaciones no gubernamentales, asociaciones humanitarias, expertos legales, colegios de abogados y hasta iglesias, que piden a la Unión Europea que esté a la altura de su promesa y que haga algo para superar el divorcio, que es terrible y lamentable, entre su promesa, entre las ambiciones proclamadas en la letra de sus Tratados —y particularmente en el espacio de libertad, justicia y seguridad— y lo que ha sido su rendimiento hasta la fecha.

Por tanto, señorías, pido apoyo mañana para esta iniciativa legislativa que pretende abrir una vía legal, un cauce legal, a través de este instrumento de visado humanitario destinado a los potenciales demandantes de asilo y a las personas requeridas de protección humanitaria. Que puedan hacerlo legalmente sin perder la vida en el empeño.

  Christos Stylianides, Member of the Commission. – Mr President, the Commission has been carefully following the work on the report on European humanitarian visas, prepared by the rapporteur, Mr López Aguilar.

We take note of the calls on the Commission to make a proposal on a European humanitarian visa by the end of March 2019. We also believe that in order to better manage migration comprehensively, we need to enhance legal and safe avenues to the EU for third-country nationals in need of international protection.

Increasing resettlement from Turkey or Niger is part of the solution to engaging with third countries and reducing irregular arrivals. At the same time, we believe that the greatest potential for reaching this common objective lies, at this point in time, in the swift adoption of the Union Resettlement Framework Regulation proposed by the Commission in July 2016. It will be the first legislative instrument of its kind to better coordinate Member States’ resettlement efforts, which until now have been the result of a combination of national or international programmes.

I commend the efforts of Parliament that have contributed greatly towards reaching a common position within the Council. But both co-legislators need to take the last steps to transform the preliminary agreement into the final adoption of the proposal.

The Commission stands ready to provide all the support needed. We believe it is of utmost importance not to risk complicating the adoption of the Union Resettlement Framework Regulation, which now requires our full attention. It seems therefore appropriate that the Commission includes in the evaluation of the future Union Resettlement Framework Regulation an assessment of whether or not it covers, as intended, the main legal and safe avenues for international protection in the EU.

  João Pimenta Lopes, relator de parecer da Comissão dos Direitos da Mulher e da Igualdade de Oportunidades. – Senhor Presidente, tomo a vez da minha colega Malin Björk, que hoje não pode aqui estar presente. Aproximadamente 90% dos que recebem proteção internacional na União Europeia chegam por meios irregulares. Desde 2000, 30 000 mortos na travessia de fronteiras; 17 000 no Mediterrâneo, só desde 2014.

Na UE construíram-se cerca de 1 000 quilómetros de muros. A União Europeia não pode desresponsabilizar-se das causas desta gravíssima crise humanitária. No lugar de solidariedade impõe maiores restrições ao pedido de proteção internacional. Os requerentes de asilo obrigam-se a arriscar as vidas para chegar a lugar seguro, colocando—se nas mãos de redes de tráfico de seres humanos. São as mulheres, as crianças e as pessoas LGBT que mais vulneráveis estão em qualquer fase do processo migratório, têm mais dificuldades no acesso aos instrumentos de proteção e são particularmente sujeitas à violência física, psicológica e sexual, quantas vezes arrastadas para redes de exploração sexual e trabalho escravo.

Os vistos humanitários, ainda que insuficientes, devem materializar respostas ágeis que garantam os mecanismos, as estruturas e os meios técnicos e humanos necessários à proteção dos envolvidos, com particular atenção para os mais vulneráveis - mulheres e crianças.

  Heinz K. Becker, im Namen der PPE-Fraktion. – Herr Präsident! Ich möchte mich ganz herzlich einmal vorweg für den großen Einsatz des Berichterstatters bedanken. Er hat dieses Projekt lange schon intensiv verfolgt, und wir hatten auch konstruktive Gespräche, obgleich wir seitens der Europäischen Volkspartei keine Freude mit diesem Dossier von Anfang an hatten, so wie auch der Rat schon die ersten Versionen des Visa Code abgelehnt hat und der Trilog gescheitert ist, weil das humanitäre Visum nicht so einfach zu handhaben ist.

Erstens einmal gibt es dieses humanitäre Visum bereits bei vielen Mitgliedstaaten. Zweitens einmal ist der Vorschlag des Berichterstatters insofern problematisch, als er einen Zugang auf EU-Territorium erlaubt, ohne dass geklärt ist, ob ein Asylrecht besteht oder nicht. Und der dritte Punkt ist, dass die Vorschläge hinsichtlich Botschaften und Gesandtschaften tatsächlich möglicherweise diese Institutionen massiv überlasten könnten.

Nun hat der Berichterstatter dafür gesorgt, dass diese Empfehlungen non-binding sind, also nicht verpflichtend für die Mitgliedstaaten. Jetzt bleibt nur mehr übrig, ob im parallel verhandelten Visa Code tatsächlich eine Änderung erfolgt und die readmission of illegal migrants passiert, ja oder nein. Das haben wir noch nicht. Daher kann ich im Augenblick eine Zustimmung meiner Fraktion nicht zusagen.

  Cécile Kashetu Kyenge, a nome del gruppo S&D. – Signor Presidente, onorevoli colleghi, ringrazio anch'io il collega López Aguilar. Abbiamo appena terminato la discussione sul Global Compact e della necessità, se non urgenza, di creare delle vie legali, ordinate e sicure d'ingresso nell'Unione europea.

Dall'inizio di questa legislatura, il Parlamento non si è sottratto alle sue responsabilità. Già con la risoluzione sull'approccio olistico quest'Aula ha con vigore reclamato la necessità di ricorrere ai visti umanitari per chi necessita di protezione internazionale, chiedendo alla Commissione disposizioni più specifiche. La commissione LIBE ha reiterato questa domanda, adottando gli emendamenti sui visti umanitari all'interno del codice visti, che come sappiamo è tristemente naufragato a seguito del rifiuto del Consiglio nel procedere nei negoziati e il conseguente ritiro della proposta.

Ora la Commissione non può tirarsi indietro. La data limite di marzo 2019 non deve essere vista come un ultimatum, ma al contrario come una grande opportunità di dare una risposta significativa a coloro che necessitano di protezione internazionale e soccombono per realizzare questo diritto. Solo una proposta ambiziosa riuscirà a garantire dei canali sicuri e legali e consolidare le basi di una politica migratoria che ruoti attorno ai diritti e alla dignità delle persone.

  Jussi Halla-aho, on behalf of the ECR Group. – Mr President, the ECR Group does not support the idea of a humanitarian visa. The problem is that the asylum system is being abused on a massive scale as a channel of economic migration. The humanitarian visa would only make things worse. It would increase the overall number of applications and, as we have seen, it is very difficult to repatriate even those whose application has been rejected. There are many practical issues. Who exactly would be entitled to a humanitarian visa? How could we ensure that all Member States would apply the same criteria and that there would be no weak links as there are today? How could we prevent holders of humanitarian visas from disappearing in the Schengen area, and so on?

  Bodil Valero, för Verts/ALE-gruppen. – Herr talman! Medelhavet är dödligare än någonsin enligt UNHCR:s rapport från den 3 september i år. När rapporten skrevs hade hittills 1 600 människor mist sina liv eller rapporterats saknade på vägen mot Europa under året. UNHCR hävdar att fler omkommer nu, trots att färre faktiskt flyr, och uppmanar oss att skapa fler lagliga vägar för flyktingar.

Man måste ju fråga sig vad EU har gjort för fel när fler dör på väg till Europa, trots att färre faktiskt flyr. Ett argument för Turkiet-överenskommelsen, taggtrådsstängsel vid EU:s externa gränser och diverse andra påhitt för att få människor att välja bort Europa som potentiellt flyktalternativ var just att de snällt skulle vänta i flyktingläger utanför, för att sedan få komma lagligt hit, dock utan några som helst faktiska utsikter att få komma lagligt. Resultatet blev nya och farligare flyktalternativ, slavliknande förhållanden i den libyska öknen etc.

Här i parlamentet har vi i många år hävdat att humanitära visum behövs för att rädda människoliv och slå sönder människosmugglarnas marknad, men rådet har totalvägrat. Rådets svar på problemet är i stället hårdare bevakning av våra gränser och överenskommelser med andra länder att ta emot alla dem som medlemsländerna vill skicka tillbaka. Föredraganden har självklart vårt gröna stöd i morgon.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, ce dossier sur les visas humanitaires est tristement représentatif des évolutions européennes sur les migrations. Sous la pression des nationalistes de l’extrême droite, les pays européens déshonorent les valeurs de l’accueil, alors que notre histoire, notamment à l’Ouest, est nourrie de mouvements de personnes fuyant la misère, les persécutions, les pogroms et les conflits. Cinquante millions d’Européens ont ainsi migré entre le milieu du XIXe siècle et la première guerre mondiale, et cela a continué ensuite jusqu’à la chute du mur de Berlin.

Qu’en est-il aujourd’hui? L’Europe accueille 6 % des réfugiés dans le monde, soit un réfugié pour 1 000 habitants. Au Liban, les réfugiés représentent plus de 25 % de la population. Et c’est nous qui accueillerions toute la misère du monde? Au moins 37 000 personnes identifiées – et sans doute beaucoup plus – sont mortes en Méditerranée. Il s’agissait pour la plupart de demandeurs d’asile. Ces personnes sont mortes faute de voies régulières, faute de visas humanitaires notamment. Eh oui! 90 % des personnes à qui les États ont accordé une protection internationale sont arrivées de façon irrégulière, avec les risques que l’on sait. Les réinstallations, Monsieur le Commissaire, ne sont pas à la hauteur, et ce n’est même pas le sujet. Certains de ceux qui nous gouvernent auront un jour à rendre compte de leur incurie face à cette crise mondiale des réfugiés.

Je remercie M. López Aguilar pour sa ténacité. Le rapport n’est pas à la hauteur de mes espoirs. Les États membres refusent toute discussion au motif que ces visas existent déjà au niveau national. Or, nous avons besoin sur ce sujet, comme sur d’autres, de solidarité européenne et nous acceptons le mélange comme vous nous y avez invités, Monsieur le Commissaire.

  Laura Ferrara, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, garantire vie legali di accesso all'Unione europea per chi ha diritto alla protezione internazionale è il primo passo per contrastare i trafficanti di esseri umani e per superare la più grande contraddizione che abbiamo oggi nell'Unione europea, ovvero voler contrastare l'immigrazione irregolare senza offrire un'alternativa legale.

Un sistema di visti che non si presti ad abusi e consenta di accedere al territorio europeo per presentare una domanda di asilo contribuirebbe a creare le condizioni per scardinare il business di scafisti e trafficanti, aumentare anche la sicurezza dei paesi di destinazione e avere in definitiva una gestione dei flussi migratori più ordinata e dignitosa. Tale sistema rappresenterebbe un passo coraggioso e coerente compiuto dall'Unione europea per essere all'altezza dei valori su cui è fondata e verrebbe incontro ai paesi di prima linea, come ad esempio l'Italia e la Grecia, che sono usati spesso come paesi di ingresso e di transito, ma dove poi si è costretti a rimanere a causa del fallimentare regolamento di Dublino.

  Seán Kelly (PPE). – Mr President, I think that having a system for additional humanitarian visas across Member States is a good idea and should be welcomed. A number of requests for the establishment of such a system have been made and the Committee on Civil Liberties, Justice and Home Affairs (LIBE) has duly adopted the own initiative report containing these recommendations after long negotiations.

However, the provision of safe and legal pathways on a Union—wide basis for entry into European territory has yet to occur. Currently humanitarian visas are governed by the national law of Member States and there is no Union—wide obligation in place. This situation leads to high human social and economic costs. We are all aware of the effects of the migrant crisis, both in terms of the deaths caused and the strain on budgetary requirements for search and rescue operations and asylum procedures. Faced with a death toll of 30 000 migrants on European borders since 2000, Parliament has rightfully decided to proceed despite the Commission’s reluctance. The humanitarian visa framework is a good mechanism to reduce the death toll and combat smuggling, particularly since 90% of migrants enter Union territory through irregular means. However, the report still leaves enough autonomy with the Member State to decide on the categories of persons that will be involved in the visa system.

The EU must stand by its treaty obligations and its human rights commitments in respect of guaranteeing the right of asylum. I think this is a good proposal worthy of consideration.

  Tomáš Zdechovský (PPE). – Pane předsedající, mám jenom technickou poznámku. Kolegové tady nejsou z důvodu, že je současně hlasování na zvláštním výboru TERR. A bohužel to hlasování, hlasuje se o dvou tisících pozměňovacích návrzích, bude končit za pět minut. Tak bych vás chtěl všechny požádat, jestli by mohli kolegové potom, až přijdou, tady vystoupit.

Vážený pane komisaři, já bych chtěl k této tematice říci, že všichni víme, že Evropská unie nedokázala efektivně reagovat na migrační krizi. Nezvládli jsme nekontrolovaný příliš migrantů a uprchlíků, kteří se do Evropské unie dostávali nezřídka bez dokladů a řádného prověření. V roce 2015 jsem opakovaně navštívil jak uprchlické tábory v Řecku, tak v Itálii, tak na cestě skrze Balkán. Bylo vidět, že Evropská unie nedokáže efektivně rozeznávat, kdo na azyl má právo a kdo nemá. Poté, co byl umožněn vstup na území Evropské unie příslušníkům států třetích zemí, všichni, kteří tehdy měli takzvaný syrský pas, přestože tento syrský pas mohl být zfalšovaný, byli pokládáni za uprchlíky.

Tato situace se nesmí opakovat. Nástroj, kterým jsme měli reagovat na celou krizi, měli být humanitární víza. Já si myslím, že tento nápad je velmi dobrý, ale bohužel jsme zase zůstali na půl cesty. Je potřeba tento nápad ještě přepracovat a dopracovat.

  Elly Schlein (S&D). – Signor Presidente, onorevoli colleghi, volevo anzitutto ringraziare il collega Juan Fernando López Aguilar per la passione e per la determinazione con cui da anni porta avanti questa giusta battaglia.

I nazionalisti di tutta Europa ci raccontano che noi non possiamo accogliere tutti i migranti e che solo chi arriva legalmente può rimanere sul territorio dell'Unione. Mentono sapendo di mentire. Sono pochissimi i canali legali per l'accesso all'Unione europea e la mancanza di vie sicure per quelli che cercano protezione in Europa è la maggiore carenza delle nostre politiche migratorie.

Non ci sono molti modi per evitare le morti in mare o nel deserto, ma anche per contrastare – perché questa sembra l'ossessione dei governi europei – i trafficanti di esseri umani, per distruggerne il business, come dicono loro. C'è un unico modo ed è quello di creare un'alternativa legale, vie legali e sicure per l'accesso in Europa. Per questo il Parlamento, anche davanti alla riluttanza del Consiglio, sta mettendo finalmente sul tavolo questa proposta per un visto umanitario europeo. E spero davvero che troverà la grande maggioranza di quest'Aula in sostegno.

  Branislav Škripek (ECR). – Pán predsedajúci, Salmen Abedi bol európskym občanom líbyjského pôvodu, ktorý minulý rok v máji spáchal samovražedný útok na koncerte v Manchestri. Tento teroristický čin si vyžiadal 22 ľudských životov a 139 osôb bolo zranených, a to z veľkej časti mladiství a deti. Predtým bol v Sýrii a do Európy sa vrátil za pomoci britského kráľovského námorníctva počas záchrannej misie. Jeho monitorovanie zo strany britských spravodajských služieb ohľadom podozrenia z napojenia na ISIS bolo pozastavené mesiac pred útokom v Manchestri. Ak tento urýchlený pokus o záchranu viedol k toľkému nešťastiu, a taktiež mám dôkaz, že viac ako 88-tisíc schengenských a zdravotných víz bolo vystavených líbyjským občanom zo strany Malty, prečo premýšľame nad zavedením ďalšieho „cestovného dokumentu”, ktorý umožní osobám vstup do európskeho priestoru bez dôkladného posúdenia ich žiadosti?

Tento návrh je nebezpečný, zbytočný a postavený na veľmi chabých právnych základoch. Jeho výsledkom bude ešte väčšie preťaženie systému tisíckami žiadostí.

  Teresa Jiménez-Becerril Barrio (PPE). – Señor presidente, el lunes de la semana pasada fue un día trágico en las costas de Andalucía, mi región. La costa atlántica de Cádiz (en Los Caños de Meca, playa donde yo estoy habitualmente) fue una tumba abierta para diecinueve inmigrantes, que murieron allí. Iban en una patera cuarenta personas —once menores— sin saber nadar, sin chalecos salvavidas.

Ese mismo lunes, en Melilla, trece inmigrantes perdieron la vida. La Guardia Civil y Salvamento Marítimo redoblan sus esfuerzos, pero es difícil salvar a quienes entran a miles por el Mediterráneo occidental.

El 90 % de los solicitantes de asilo llegan de manera irregular; muchos de ellos son menores no acompañados, mujeres embarazadas, violadas, que son obligadas a prostituirse para pagar el viaje.

Europa necesita poner freno al mercado de seres humanos. Europa necesita una estrategia a corto y a medio plazo sobre inmigración. Si no existen opciones legales, van a seguir viniendo, van a ser víctimas del tráfico de personas, los traficantes son quienes lo van a aprovechar.

Hay que darles opciones legales, como el visado humanitario bien aplicado, porque así se podrá garantizar en los Estados miembros el tránsito legal, controlar a quien entra en Europa y comprobar los antecedentes, por si hay problemas de seguridad.

Europa tiene que ser fiel a sus valores. Solidaridad y responsabilidad son dos caras de la misma moneda.

  Innocenzo Leontini (PPE). – Signor Presidente, onorevoli colleghi, fino ad oggi la questione dei visti umanitari è stata discussa ampiamente nel contesto dell'Unione europea, ma senza raggiungere risultati concreti. Per questo motivo, di fronte all'inerzia della Commissione europea, il Parlamento ha deciso di procedere alla stesura di questa relazione di iniziativa legislativa, con la quale si chiede alla Commissione di presentare entro il 31 marzo del 2019 una proposta di regolamento.

L'obiettivo condiviso è quello di definire disposizioni comuni sulle procedure e di precisare a quali condizioni ogni Stato membro deve subordinare la possibilità di rilascio del visto umanitario europeo alle persone che necessitano di protezione. In tal modo, le persone che abbisognano di protezione possono entrare nel territorio dello Stato membro che ha rilasciato il visto umanitario allo scopo esclusivo di presentare in quello Stato una domanda di protezione internazionale.

Attualmente si stima che il 90 % di coloro che hanno ottenuto protezione internazionale abbia raggiunto l'Unione illegalmente. Inoltre, il costo stimato degli attraversamenti irregolari in termini di vite umane è stato di almeno 30 000 decessi alle frontiere dell'Unione europea dall'inizio del 2000. Anche per questi motivi sono necessari percorsi sicuri e legali verso l'Europa.

Sono fermamente convinto che i visti umanitari siano un ottimo mezzo per fare fronte all'intollerabile bilancio delle vittime nel Mediterraneo, per combattere realmente il traffico di essere umani e per gestire l'arrivo legale, la ricezione dignitosa e l'equo trattamento delle domande di asilo.

  Ruža Tomašić (ECR). – Poštovani predsjedavajući, osobe koje su u svojim matičnim državama izložene rizicima gonjenja ili nanošenja ozbiljne štete zaslužuju najveći stupanj zaštite. Također, u kontekstu masovnih migracija i pokušaja prelazaka granica Europske unije potrebno je osigurati siguran i brži ulazak osoba koje doista mogu dokazati svoje tvrdnje.

Uvođenje humanitarne vize moglo bi biti odgovarajuće rješenje, naravno, uz uvjet da ulazak bude omogućen isključivo radi podnošenja zahtjeva za međunarodnu zaštitu u državi izdavateljici.

Međutim, držim da bi financijski teret koji bi proizlazio iz takvih postupaka trebale snositi isključivo države izdavateljice, a nikako proračun Unije. Protiv sam harmonizacije prava Europske unije jer smatram da pitanje migracija i viza trebaju biti u primarnoj nadležnosti individualnih država članica Unije budući da svaka od njih sama najbolje poznaje svoje specifične uvjete i mogućnosti u danom trenutku.

  Kateřina Konečná (GUE/NGL). – Pane předsedající, v souvislosti s humanitárními vízy považuji za zcela zásadní zdůraznit jednu věc. V souladu s rozsudkem Soudního dvora nejsou členské státy podle právních předpisů Evropské unie povinny vydávat humanitární víza, ale mohou tak učinit svobodně na základě svého vnitrostátního práva.

Nebavíme se teď tedy o žádném povinném mechanismu, ale o tom, aby jednotlivé členské státy měly možnost analyzovat, kdo je opravdu humanitárním uprchlíkem a kdo se jen chopil příležitosti si polepšit. Tento princip dobrovolnosti je po letech trapného omílání povinných kvót osvěžující a přijatelný. Česká republika si musí sama určit, komu dá vízum a umožní mu vstup do země. Uprchlíci již nesmí podporovat organizovaný zločin provozovaný převaděči a nesmí se násilně drát přes evropské hranice. Měli by v nejbližším bezpečném státu požádat o humanitární vízum a vyčkávat rozhodnutí suverénního státu členské země Evropské unie.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, να επισημάνουμε για μία ακόμη φορά ότι η μετανάστευση δεν είναι φυσικό φαινόμενο. Προκαλείται λόγω της φτώχειας, η οποία επίσης δεν είναι φυσικό φαινόμενο. Άρα, λοιπόν, πρέπει να αντιμετωπίσουμε τη φτώχεια για να σταματήσει η μετανάστευση και -κυρίως- η παράνομη μετανάστευση. Οι πρόσφυγες έρχονται διότι υπάρχουν πόλεμοι. Ας αγωνιστούμε για την ειρήνη, προκειμένου να περιορίσουμε τον αριθμό των προσφύγων. Η Ελλάδα δέχεται τεράστια πίεση, με χιλιάδες πρόσφυγες και παράνομους μετανάστες. Όλοι αυτοί αξιοποιούν τη διαδικασία που υπάρχει, καταχρώνται το δικαίωμα για άσυλο και παραμένουν για τρία τουλάχιστον χρόνια στην Ελλάδα μέχρι να εκδικαστεί η υπόθεσή τους σχετικά με το άσυλο. Ας μην ξεχνάμε ότι το Δικαστήριο, στην απόφαση για την υπόθεση C-386/16, επισήμανε ότι η χορήγηση βίζας για ανθρωπιστικούς λόγους είναι μια δυνατότητα για τα κράτη και όχι μια υποχρέωση. Μάλιστα, υπάρχει ένα πολύ σημαντικό παράδειγμα, όπου χριστιανοί προερχόμενοι από το Χαλέπι είχαν πάει στο Βέλγιο και έκαναν αίτηση χορήγησης βίζας για ανθρωπιστικούς λόγους. Αντιλαμβάνεστε, λοιπόν, ότι δεν πρέπει απλώς να δημιουργήσουμε ένα νέο κίνητρο, στο πλαίσιο του οποίου οι πλούσιοι παράνομοι μετανάστες θα περνούν για δήθεν ανθρωπιστικούς λόγους στην Ευρώπη, ενώ οι φτωχοί παράνομοι μετανάστες απλά θα επιχειρούν να περάσουν παράνομα.

I note that we share the same objective: to provide legal pathways to persons in need of international protection. For this, we need to adopt our proposal to set up a European resettlement framework, as part of the overall reform of the Common European Asylum System.

These legislative proposals need to be adopted as a matter of priority. Let me reiterate the Commission’s continued readiness to support the co-legislators with a view to achieving a reform of the Common European Asylum System and, in particular, the swift adoption of the Union Resettlement Framework Regulation.

  Juan Fernando López Aguilar, ponente. – Señor presidente, señor comisario, agradezco grandemente las intervenciones, las opiniones y, particularmente, aquellas que han adelantado voluntad de apoyo, en representación de los respectivos grupos parlamentarios de este Parlamento Europeo, a la iniciativa.

Pero quiero añadir alguna consideración, porque, en primer lugar, he escuchado objeciones que intentan diluir la evidencia de que, aunque algunos Estados miembros tienen prácticas ejemplares y legislación al respecto, otros no las tienen. Y lo relevante es que no existe un marco europeo. No existe un marco común europeo que pueda asentar la posibilidad de que, en consulados y embajadas, se puedan dispensar visados humanitarios que permitan esa entrada legal a quienes, de todos modos, lo van a arriesgar y perderlo todo en el empeño.

Nos hablaba Hannah Arendt, una filósofa memorable del siglo XX, de que tan importante como tener derechos o más es el derecho a poder ejercer los derechos. Es el derecho a tener el derecho. Y de nada vale que exista un derecho al asilo si para poder ejercerlo en territorio europeo —que lo reconoce en su Carta de Derechos Fundamentales de la Unión Europea, y evidentemente no lo reconoce a los europeos sino a los desesperados de países terceros— hayan de arriesgar la vida o perderla en el intento. Es una situación insostenible. La hemos denunciado muchas veces y, lo peor, hemos escuchado cómo se nos denuncia por parte de todos los interlocutores que han sido escuchados en este Parlamento Europeo durante años: organizaciones no gubernamentales, profesiones legales, activistas de los derechos humanos.

Va siendo hora de que respondamos. No es verdad que incentive el negocio de la explotación de personas. Al contrario, desmantela parte del llamado business model, parte del llamado «modelo de negocio» de las mafias. Porque ofrece a algunas personas, que de otro modo se arrojarán en los brazos de esos tráficos ilícitos, una oportunidad de intentarlo sin necesidad de arriesgarse y de someterse a la humillación o a la explotación de esos tráficos ilícitos que violan de manera brutal y sin escrúpulos los derechos fundamentales de los más vulnerables: las mujeres y los niños. Los hemos echado de menos tantas veces en nuestros discursos en el Parlamento Europeo. Va siendo hora de que hagamos algo.

Y por eso, agradezco particularmente las voces que he escuchado del Grupo Popular, porque desmienten que el Grupo Popular no tenga una sensibilidad con respecto a este asunto —como escuché en el primer turno procedente del Grupo, lo que me preocupa—, y agradezco que seamos capaces de estar a la altura de este desafío que se prolonga durante mucho tiempo construyendo la mayoría necesaria para decirle a la Comisión que va siendo hora de que incorpore al rompecabezas de la respuesta, sin simplificación ninguna, también esta herramienta.

El hecho migratorio es complejo, inabarcable, global. Está ahí para quedarse y ninguna de las herramientas puede valer por sí sola. El reasentamiento es un programa válido, avalado por el Alto Comisionado de Naciones Unidas para los Refugiados, pero tiene sus limitaciones subjetivas, cuantitativas y de países de origen. Se trata de acompañar el reasentamiento también con este instrumento además de con esa aproximación, que queríamos holística, que comprenda el llamado «hecho migratorio» en los países de origen, en los de tránsito y en los de destino. Pero, sobre todo, permita a las personas que se sienten desesperadas, perseguidas, con su seguridad, su dignidad y su integridad amenazadas de manera inminente, acercarse a una ventana amiga: la de las delegaciones en el exterior de la Unión Europea, sabiendo que la Unión Europea está a la altura de su promesa, de su compromiso con los derechos fundamentales de las personas más vulnerables.

Por tanto, pido mañana el esfuerzo de aproximar el voto para esta iniciativa, que es una llamada a la Comisión para que provea el instrumento normativo que necesitamos.

  Tamás Deutsch (PPE), írásban. – Elnök Úr! A humanitárius célú vízumok bevezetését kezdeményező jelentés lehetővé tenné, hogy az Európai Unión kívüli külképviseleteken gyorsított és egyszerűsített eljárásban kapjanak vízumot Európába harmadik országbeli bevándorlók. Egészen elképesztő módon ezt a beutazási engedélyt anélkül adnák meg, hogy alapos és körültekintő vizsgálatra kerülne sor a bevándorlók személyazonosságát, valamint menekültstátuszra való jogosultságát illetően. A jelentés elfogadásával az Unió tulajdonképpen lemondana az előzetes ellenőrzés jogáról, megkerülné a határvédelmet és a nemzeti hatóságok bevándorlási, menekültügyi kérdésekben való jogait. A javaslat azt mutatja, hogy az Európai Parlament egy újabb, minden józanságot nélkülöző elgondolással állt elő, és ahelyett, hogy megoldaná a problémát, az Unióba akarja hozni azt. Az a brüsszeli törekvés, hogy Európát bevándorló-övezetté alakítsák minél több menekült befogadásával, teljességgel elfogadhatatlan, ezért úgy gondolom, hogy a jelenleg tárgyalt javaslatot a lehető leghatározottabban el kell utasítani.

  Kinga Gál (PPE), írásban. – Az EP a józanság legcsekélyebb jelét sem mutatva olyan kezdeményezéssel állt elő, amely a migránsok tömegeit kívánja Európába juttatni az úgynevezett humanitárius vízumok segítségével. Az Európai Parlament humanitáriusvízum-javaslata azt szeretné elérni, hogy a migránsok uniós konzulátusokon kapott vízum segítségével beutazhassanak az Európai Unió területére, és csak utána folytassák le a menekültügyi eljárást velük szemben. Ez több szempontból is problémás. Egyrészt minden illegális migránsnak vízumot adna, hogy azok beutazzanak átfogó biztonsági ellenőrzés nélkül Európába. Ezáltal a migrációs problémát Európa területére helyezné át. Másrészt emberek tízezrei özönlenék el az EU tagállamainak konzulátusait, amire konzulátusaink semmilyen formában nincsenek felkészülve. Ez ismét egy olyan, a realitásoktól elrugaszkodott javaslat, amely ahelyett, hogy a problémát orvosolná, azt importálja az Unió területére. Ezért számunkra ez a javaslat elfogadhatatlan.

  Dietmar Köster (S&D), schriftlich. – Es gibt derzeit für Menschen auf der Flucht so gut wie keine Möglichkeit, legal in ein EU-Land einzureisen. Sie werden deswegen dazu gezwungen, Schlepper zu bezahlen und auf gefährlichen Fluchtrouten ihr Leben zu riskieren. Tausende sterben jährlich in der Sahara, im Mittelmeer und anderswo.

Wir müssen endlich legale Einreisewege in die EU schaffen. Eine Möglichkeit sind humanitäre Visa. Diese Forderung wurde vom Europäischen Parlament bereits in mehreren Entschließungen zum Ausdruck gebracht. Die EU beruht auf dem Prinzip der Achtung der Menschenwürde und gründet sich auf humanitäre Werte. Diese Werte müssen auch für Nicht-EU-Bürger*innen gelten.

Wir Abgeordneten müssen deswegen dem Initiativbericht des Parlaments unbedingt zustimmen, denn humanitäre Visa tragen dazu bei, Flucht sicherer zu machen. Dies wäre ein wichtiger Schritt, um unseren eigenen Ansprüchen an die Achtung der Menschenwürde gerecht zu werden.

  Vladimír Maňka (S&D), písomne. – Európsky parlament žiada Komisiu, aby do marca 2019 predložila legislatívny návrh o európskych humanitárnych vízach. Dnes platia v členských krajinách rôzne vnútroštátne úpravy a postupy. Spoločná legislatívna úprava stanoví minimálny rozsah spoločných štandardov pri udeľovaní, vydávaní a administrácii humanitárnych víz. Zjednotené postupy podporia koordinovanú politiku Únie a eliminujú organizovanú trestnú činnosť pri prevádzačstve. Humanitárne víza by sa mali dotýkať výlučne osôb žiadajúcich o medzinárodnoprávnu ochranu, a to z dôvodu vystavenia mučeniu alebo inému neľudskému a ponižujúcemu zaobchádzaniu. Humanitárne víza by sa mali vydávať ako jednotná nálepka registrovaná vo vízovom informačnom systéme. Mali by ich držiteľom umožniť vstup na územie členského štátu, ktorý ich vydal, a to výhradne na účely podania žiadosti o medzinárodnú ochranu v danom členskom štáte. Udeľovanie humanitárnych víz sa nesmie automaticky uplatňovať na rodinných príslušníkov žiadateľov. Títo môžu po posúdení podliehať azylovej politike s ohľadom na vnútroštátne pravidlá členských krajín. Preto pokladám za dôležité, aby budúce nariadenie dôsledne definovalo humanitárne víza a rešpektovalo oddelenie humanitárnych víz od ostatných víz azylovej politiky, ktorá musí naďalej zohľadňovať pravidlá členských krajín.

  Christine Revault d’Allonnes Bonnefoy (S&D), par écrit. – Si les États membres ont cédé à la rhétorique populiste concernant les réfugiés et si une partie de ce Parlement rejette l’inclusion des migrants dans nos sociétés, je vais défendre une toute autre vision. Ces personnes cherchent seulement à obtenir une protection et une vie meilleure en des temps de guerres et de conflits. Mais pour ce faire, ils risquent leurs vies sur la route de l’asile et en Méditerranée et font appel à des passeurs qui ne sont rien d’autre que des trafiquants d’êtres humains. Ils risquent l’exploitation, les mauvais traitements et les abus. Tout le monde se rappelle les images d’enfants assoiffés et affamés en Libye. Cette situation est inhumaine et absurde, car le droit européen ne dispose, à ce stade, d’aucune provision pour y remédier. Voilà pourquoi je plaide pour un visa humanitaire européen qui permettrait aux migrants de voyager en sécurité ainsi que de lutter définitivement contre le trafic abject des passeurs qui s’enrichissent de l’absence de voies légales. J’appelle l’ensemble des députés européens à voter ce rapport, afin d’officiellement appeler la Commission à légiférer en la matière avant mars 2019.

  Josef Weidenholzer (S&D), schriftlich. – Mit dem wichtigen legislativen Initiativbericht fordern wir die Kommission auf, auf der Grundlage von Artikel 77 Absatz 2 Buchstabe a des Vertrags über die Arbeitsweise der Europäischen Union (AEUV) bis zum 31. März 2019 einen legislativen Vorschlag für eine Verordnung zur „Schaffung eines europäischen Visums aus humanitären Gründen“ vorzulegen. Damit soll eine rechtliche Grundlage geschaffen werden, damit Mitgliedstaaten ein europäisches Visum aus humanitären Gründen an Personen, die internationalen Schutz suchen, erteilen. Visa aus humanitären Gründen stellen eine wichtige und längst überfällige Ergänzung dar. Es sollte längst die Möglichkeit bestehen, Anträge auf internationalen Schutz schon vor Ort (zum Beispiel bei Botschaften) zu stellen. Das ist nicht romantisch, sondern vernünftig. Damit kommen wir unserer Verantwortung als Gesetzgeber, pragmatische Lösungen zu finden, nach.
