  Othmar Karas, Berichterstatter. – Frau Präsidentin, Herr Vizepräsident, meine Damen und Herren! Es ist schon eigenartig: Vor zehn Jahren habe ich zwei große Berichte über die Ursachen und Auswirkungen der größten Finanz- und Sozialkrise mit einer Französin, mit Pervenche Berès, gemacht. Die letzte Wahlperiode habe ich beendet mit einem Bericht über die Überprüfung der Troika in den Programmländern mit einem Franzosen, mit Liêm Hoang-Ngoc. Und heute legen wir drei Berichte wieder gemeinsam vor, wieder mit einer Französin, Pervenche Berès, und es sind Deine letzten Berichte.

Zur selben Zeit stürzt die Notre-Dame ein. Wir alle könnten uns heute über die Berichte freuen. Trotzdem sind wir alle traurig. Denn wenn die Notre-Dame einstürzt und nicht nur brennt, ist ein Teil von uns eingestürzt, denn wir sind Europa. Wir sind Teil der Europäischen Union. Wir haben beide immer versucht, die ideologischen Grenzen zu überwinden und das Gemeinsame in den Mittelpunkt zu stellen. Wir haben immer versucht, die Sacharbeit über das Gegeneinander zu stellen. Deshalb waren wir erfolgreich. Und ich möchte Dir dafür danken, Pervenche, für Deine Arbeit an einem Tag der Traurigkeit. Das eine geht gerade unter, das andere entsteht. Aber ich hoffe, dass die gemeinsame Kraft Europas auch die Notre-Dame wieder aufbauen kann. Vielleicht nicht mehr so, wie sie einmal war. Aber wir dürfen nie aufgeben. Und die heutigen drei Berichte, die wir gemeinsam machen, sind schon ein Meilenstein. Ich danke Dir und allen Schattenberichterstattern dafür.

Wir schaffen neue Kompetenzen der Aufsichtsbehörden durch eine Bündelung von neuen Aufsichts- und Kontrollbefugnissen gegen Geldwäsche und Terrorismusfinanzierung, eine direkte europäische Aufsicht über bestimmte grenzüberschreitende Finanzgeschäfte, weniger Bürokratie und eine bessere Berücksichtigung von unterschiedlichen Größen, Risikoprofilen und Komplexitäten, mehr aufsichtsrechtliche Konvergenz durch bessere Instrumente und neue – no-action letters – und Koordinierungsgruppen, mehr Verbraucherschutz und die Berücksichtigung von nachhaltigen Risikofaktoren, mehr Mitsprache der Aufsichtsbehörden bei Entscheidungen über die Regeln von Drittstaaten und eine stärkere demokratische Rechenschaftspflicht gegenüber dem Europäischen Parlament.

Wir stärken die Governance durch mehr Effizienz und schnellere Entscheidungen und eine Vermeidung von Interessenskonflikten, mehr Aufgaben und Befugnisse des Vorsitzes sowie eine stärkere Rolle des Europäischen Parlaments. Wir schreiben mit dem Blick auf das neue EU-Budget fest, dass endlich ausreichende Ressourcen und Personal zur Verfügung zu stellen sind, und hoffen, dass die Mitgliedstaaten unserem Aufruf folgen. Und wir verbessern die Makroaufsicht, um systemische Risken aller Art künftig besser zu erkennen.

Die Berichte können sich sehen lassen. Sie sind nur deshalb qualitativ so ein Fortschritt, weil wir alle zusammengearbeitet haben. Möge diese Zusammenarbeit über ideologische Grenzen hinweg auch den Wahlkampf überdauern und die Politik des nächsten Parlaments bestimmen.

  Pervenche Berès, rapporteure. – Madame la Présidente, Monsieur le Vice-président, cher Othmar Karas, c’est effectivement la deuxième fois que nous coopérons et je crois qu’en effet, nous avons aussi bien coopéré que la première fois.

La Commission avait mis sur la table une bonne proposition, cohérente. Si les États membres veulent une union des marchés des capitaux, alors il faut renforcer les autorités de supervision. Il n’est peut-être pas indispensable d’attendre la prochaine crise pour se rendre compte que, quand on développe un marché, il vaut mieux avoir un gendarme pour surveiller ce marché, quelle que soit la qualité des intervenants.

Cher Othmar Karas, lorsque vous avez pris la responsabilité de ce rapport à mes côtés, l’enfant n’allait effectivement pas très bien. Certains le considéraient même comme mort, parmi les États membres, certains s’en réjouissaient, mais nous l’avons sauvé. Nous avons fait en sorte que les États membres ne puissent pas se servir du prétexte – qui leur était politiquement utile – des progrès en matière de lutte contre le blanchiment d’argent pour s’en contenter, mais qu’ils assument bien qu’on ne pouvait pas faire de vrais progrès en matière de lutte contre le blanchiment d’argent sans aller de l’avant sur l’essentiel, c’est-à-dire que les autorités de supervision européennes soient réellement en mesure d’exercer leurs compétences.

Chose peut-être moins difficile, mais c’est selon moi une étape que nous devons saluer, nous avons aussi enregistré des progrès sur l’intégration d’un mandat lié à la durabilité. Les autorités de supervision, qu’elles relèvent du domaine bancaire, de l’assurance ou des valeurs mobilières, devront examiner la durabilité des modèles mis en œuvre par les institutions.

De la même manière, en matière de protection des consommateurs, nous avons franchi une étape importante pour l’étendre dans le domaine de la banque et de l’assurance sur la base des pouvoirs qui existent pour l’autorité de supervision des valeurs mobilières. J’estime que c’est une bonne avancée. Enfin, à l’initiative de certains de nos collègues, nous avons introduit une coordination des enquêtes mystères, ce qui est un bon moyen de protéger les consommateurs.

Par ailleurs, pour chacune des autorités, nous avons amélioré un dispositif, en l’occurrence autour de l’Autorité bancaire, pour lutter contre le blanchiment d’argent: c’était normal et juste, en attendant d’avoir une autorité réellement indépendante et une meilleure coordination.

Dans le domaine de l’assurance, nous avons tenu compte de la réalité. Trop souvent, dans ce secteur, des entreprises coquilles sont utilisées pour ne pas respecter les droits des consommateurs dans d’autres États membres: l’AEAPP aura des pouvoirs renforcés dans ce domaine et je ne peux que m’en réjouir.

Enfin, l’autorité des valeurs mobilières, l’ESMA, aura davantage de pouvoir d’intervention en ce qui concerne les fournisseurs de déclaration de données et les transactions sur les marchés financiers ou en matière d’indices de référence.

Toutefois, le cœur de la bataille, c’était évidemment la question de la gouvernance. Sur ce point, nous avons apporté des améliorations utiles à la prise de décision pour qu’elle soit mieux éclairée, notamment en cas de risque de conflit d’intérêts. Les présidents des autorités européennes de supervision pourront trancher en cas de difficulté à dégager des majorités et auront droit à une procédure d’approbation tacite pour la convergence de la supervision, le lancement de procédures en cas de violation du droit de l’Union et le règlement des différends entre les autorités nationales compétentes dans des situations transfrontalières.

De la même manière, les autorités seront obligées de mettre en place des groupes de coordination lorsque cinq autorités nationales compétentes le leur demanderont. Mais soyons honnêtes, et je pense, Monsieur le Vice-président, que vous serez obligé de partager mon diagnostic: il y a une certaine hypocrisie de la part du Conseil. Celui-ci souhaite toujours mettre en place cette union des marchés des capitaux, dont on sait qu’elle peut être utile au financement de l’économie réelle, mais lorsque nous voulons renforcer cette gouvernance, on nous dit qu’il faut conserver des autorités de supervision qui soient des «Member States driven institutions». Il y a là une limite qu’il faudra un jour dépasser: engrangeons ce que nous avons aujourd’hui, mais sachons que ce n’est qu’une étape.

  Valdis Dombrovskis, Vice-President of the Commission. – Madam President, the review of the European system of financial supervision is an important building block for achieving a genuine capital markets union. Therefore I am pleased that the co-legislators managed to find a political agreement on this very difficult package within just a few weeks during the trilogues in February and March. This allows this House to vote on this important legislative package still before the recess and brings much needed certainty for financial supervision in general and for the European supervisory authorities in particular.

However, I must share the diagnosis that the level of ambition of the political agreement on a number of elements is indeed lower than initially proposed by the Commission.

Nevertheless, this result would not have been possible without the very constructive attitude from Parliament during the negotiations. Parliament has shown in those negotiations that it’s fully aware of the key role of the European supervisory authorities in achieving real market integration. So I would like to say thank you and congratulate the co-rapporteurs, Ms Berès and Mr Karas, for this work and for this achievement. And of course I hope for a positive vote in plenary.

In my view this political agreement is a significant step towards complementing the Single Rulebook by more convergence of supervisory practices across the EU. Moreover, as a political agreement it is an important step forward to improve the EU’s anti-money laundering framework, broadly matching the ambition of the amended Commission proposal of September 2018. The new rules will confer new powers on the European Banking Authority in anti-money laundering supervision of the financial sector.

The three European supervisory authorities (the ESAs) have a key role in achieving convergence of supervisory outcomes and to ensure a level playing field for financial institutions and investors in the EU. Supervisory convergence is a precondition for a fully-fledged capital markets union. Truly integrated capital markets can only work properly to the benefit of the economy and consumers if rules are applied in a similar way in all Member States.

I welcome that the agreement will equip the three ESAs with new and improved instruments to foster convergence in how the European financial sector is supervised. In particular, I hope that the peer reviews of supervisors will be more effective after this review. Moreover, newly established coordination groups will bring differences in supervisory approaches to light and will allow supervisors to cooperate in order to tackle prudential and level-playing-field concerns.

Finally consistent supervisory outcomes are also facilitated by some additional powers for ESMA, for direct supervision of certain benchmarks and reporting services.

I also welcome the strength and focus of the three authorities on consumer protection, on environmental, social and corporate governance considerations in finance, and on financial technology.

Regarding governance, the agreement will contribute to more effective decision-making within the ESAs and I’m confident that the reinforcement of the chairperson’s role and powers will help to improve their governance.

Finally, the legislators will equip the three ESAs with the necessary resources for the agreed tasks, even if industry funding originally proposed by the Commission was not agreed.

I also welcome the political agreement reached on 21 March on the European Systemic Risk Board (ESRB) Regulation. The ESRB plays an important role within the European system of financial supervision in ensuring the stability of the financial system in the EU. This agreement will secure the further improved effectiveness of the ESRB.

The compromise found in political trilogues takes on board the majority of the amendments put forward by Parliament, as well as the Council. In particular, it requires the ESRB to carry out public consultations on a more systemic basis and strengthens its accountability. Furthermore, the compromise raises the visibility of the ESRB by giving a stronger role to the vice-chairs and the head of secretariat in the external representation of the ESRB. And as requested by Parliament, the new regulation also strengthens protection for whistle-blowers.

For the anti-money laundering (AML) part of the reform, I would like to hand over to my colleague Vĕra Jourová.

  Věra Jourová, Member of the Commission. – Madam President, the Commission considers it a priority to put in place all remaining building blocks for a Capital Markets Union and to complete the Banking Union. An important element of this picture is to have a working solution to many of the problems witnessed in the prevention and fight against money laundering and terrorist financing in the financial sector, given the serious cases we recently had in Europe involving European banks.

As you know, this proposal of 2017 was further developed in September 2018 with a distinct element to better address anti-money laundering and redefine the role of the three supervisory agencies in this respect. We are very pleased that political agreement was reached on this very important file. The new rules will ensure that powers related to the prevention and mitigation of risks of money laundering in the financial sector will be centralised at the European Banking Authority. The new legal framework will strengthen its mandate for collecting, analysing and further disseminating information to ensure that all relevant authorities effectively and consistently supervise the risks of money laundering and that they cooperate and share information.

The authority’s power to act where union law is breached has also been clarified and enhanced so as to guarantee that action can be taken immediately when anti-money laundering rules are broken at national level. This agreement required very intense work and a strong commitment by all the parties. I would like to thank the European Parliament and the Romanian Presidency for their efforts to reach an agreement in such a short timeframe. It is indeed reassuring to have seen the three institutions united to achieve improvements in this very important field.

  Danuta Maria Hübner, rapporteur for the opinion of the Committee on Constitutional Affairs. – Madam President, the European system of financial supervision has built upon a very specific institutional structure, which draws on a very broad membership, including national central banks, supervisors and EU institutions. In my view, it has also proven to be an efficient coordination platform and also an information hub for the monitoring of the risk from a EU-wide perspective, but there was a clear need to review the regulation in order to take into account the evolving context as well as recent institutional changes, in particular related to the Banking Union and the building up of the Capital Markets Union.

I agree with Commissioner Dombrovskis that we could have gone further with the change, but we have made, I think, true progress when it comes to enhanced scrutiny tools, democratic accountability, enhanced transparency and independence. They have been addressed during the negotiations as they eventually increased the impact of the ESRB actions.

  Sirpa Pietikäinen, on behalf of the PPE Group. – Madam President, throughout the 11 years I have been a Member of the European Parliament, we have had numerous discussions about European common supervision of financial markets and also about the Capital Markets Union. If we want to create a prosperous Europe, we need to create a common capital market, and if we are about to create a common capital market and to lessen our financial risks, what we need is indeed a proper European financial supervision of different institutions.

While I’m congratulating both of the rapporteurs for pushing the Member States further and about the significant steps that we have taken in this direction, unfortunately, I have to take up the issue that we are not yet in that place, and it is really hard and heart-breaking for me to see the resistance from the Member States on creating a proper European financial supervision. That should be the singular unit acting at Member State level and acting at the European level. I do not see the interest of different Member State cultures or different attitudes towards supervision, because here, if anywhere, the short-sighted national interest is not only a burial for Europe, but it is a burial for Member States themselves and the prosperity of our nations.

  Neena Gill, on behalf of the S&D Group. –Thank you, Madam President. I rise to speak on a report that has been long in hibernation and I had almost given up ever having an opportunity to speak on it, so my congratulations to the co-rapporteurs Ms Pervenche Berès and Mr Othmar Karas.

These European supervisory authorities (ESA) reforms are an important step forward as a Single Rulebook with a consistent supervisory approach across the EU by the European supervisory authorities, and will, I believe, contribute significantly to well-functioning of the capital markets. But what is critical is that this reform will entrust the ESAs with greater consumer protection powers that will ensure that toxic financial products will be prohibited, and with additional responsibilities in their mandate on environmental, social and governance factors.

However, I am concerned that this exercise could become meaningless if we do not tackle the issue of money laundering with greater vigour, so I welcome the comments by Commissioner Jourová. European banks have lost EUR 20 billion in stock market value in the last six months, due to money laundering. Banking regulators need to show real ambition in addressing this. Given the powers to tackle this increase significantly, I am mindful that we still have not struck the right balance between the European level and the national level. This is, of course, a very fine line, but it does mean that the Member States have to move on from the status quo. That has been a recipe for a disaster and led to the last financial crisis. Banks and national supervisors must change their behaviour substantially, significantly, if the capital markets union is to become a reality, serving the real economy and EU savers.

  Νότης Μαριάς, εξ ονόματος της ομάδας ECR. – Κυρία Πρόεδρε, ο κύριος Karas αναφέρθηκε προηγουμένως στην έκθεση που είχε καταρτίσει πριν από δύο-τρία χρόνια —ίσως και πιο πριν— για τον ρόλο της τρόικας στην Ελλάδα και νομίζω ότι αυτή ήταν μια σημαντική έκθεση. Ωστόσο, τα συμπεράσματα που βγήκαν δεν είχαν κάποιο απτό αποτέλεσμα, δεδομένου ότι η τρόικα συνέχισε την ίδια δουλειά στην Ελλάδα και, ταυτόχρονα, δεν υπήρξε καμία αποζημίωση του ελληνικού λαού για όσα υπέστη. Για τη ζημιά την οποία συνομολόγησε ακόμη και ο κύριος Dijsselbloem σε ερώτηση που του έκανα και είπε ότι τα μέτρα που ελήφθησαν στην Ελλάδα έσωσαν, στην ουσία, το ευρώ και τις ξένες τράπεζες και όχι τον ελληνικό λαό. Είναι σίγουρο ότι χρειάζεται η εποπτεία και είναι σίγουρο ότι χρειάζονται μέτρα —όπως ειπώθηκε από την Επιτροπή— για την αντιμετώπιση του ξεπλύματος του βρώμικου χρήματος. Εκεί βρίσκεται το κλειδί. Πρέπει να αντιμετωπίσουμε όλες αυτές τις πρακτικές αν θέλουμε να έχουμε δημοκρατία στην Ευρωπαϊκή Ένωση, αν θέλουμε να λειτουργεί σοβαρά το εποπτικό σύστημα και αν θέλουμε πραγματικά να παταχθεί αυτή η μάστιγα που λέγεται βρώμικο χρήμα.

  Matt Carthy, on behalf of the GUE/NGL Group. – Madam President, as the Commissioners will know, progressive voices across Europe opposed the capital markets union (CMU) project, and they do so because it aims to sideline the problems in the EU’s banking sector by massively expanding the shadow banking sector and deregulating cross-border finance. This introduces in itself unacceptable new risks and dangers to financial stability.

But it has to be said that as far as this review is concerned, our Group thinks that the expansion of the powers of the EU supervisory authorities to accompany the deepening of the CMU is absolutely necessary. In some cases we acknowledge that the opposition of certain Member States to expanding the powers of the European supervisory authorities (ESAs) throughout this process has been based on legitimate concerns. But in other cases though, it was based on a reluctance to actually subject a shadow banking and funds sector that thrives on secrecy and on an almost total lack of oversight to any kind of supervision at all.

It’s this secrecy and lack of supervision that actually allows the mis—selling of financial products and money laundering to thrive. The boost in powers for the ESAs, therefore, is something I welcome, but the outcome of the negotiations is far from ideal and should have been, and could have been, more ambitious. We don’t just need to increase supervision. We need to reduce the massive volume of trade in complex financial products that takes place in the shadows and that threatens the financial stability of our entire economy.

  Sven Giegold, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin! Dieser Bericht zur Reform der europäischen Finanzaufsicht zeigt den Wert europäischer Institutionen. Die Europäische Kommission hat einen starken Bericht vorgelegt und gefordert, dass wir eine gemeinsamere Aufsicht der europäischen Finanzmärkte bekommen. Das Europäische Parlament hat mit der Mehrheit von Christdemokraten, Sozialdemokraten, Liberalen und Grünen starke Vorschläge vorgelegt, wie wir da noch weiterkommen, gerade auch im Hinblick auf Verbraucherschutz, Geldwäsche und nachhaltige Finanzmärkte. Da sind jetzt auch große Fortschritte erreicht worden.

Aber es gehört zur traurigen Realität, dass die Mitgliedstaaten beim Thema Bankenunion und Kapitalmarktunion davon sonntags reden, aber werktags das Gegenteil betreiben. Und deshalb ist es auch so, dass die internen Entscheidungsstrukturen nach wie vor nicht europäisch genug sind und wir deshalb immer noch einen langen Weg haben zu einer echten Kapitalmarktunion. Es ist ganz bitter, dass die deutsche Bundesregierung hier auf der falschen Seite stand.

  Paul Tang (S&D). – Madam President, the European supervisors have been troubled by many issues – too little staff, too little resources, fragmentation, national demarcations – and Member States have been keen to sustain this troubled situation. I, therefore, commend the rapporteurs for having been able to defend the common European interests. Indeed, a common European supervision is essential for a common European capital market that allows us to share risks and make our economies more resilient.

As with the banking package we discussed earlier tonight, the supervisory structures have to learn from past mistakes and to anticipate future developments, and one of these developments is Brexit. To what extent does Brexit trigger a race to the bottom? The answer very much depends on how much we are prepared to stand together. A stronger supervisory framework in Europe is therefore needed to cope with the consequences of Brexit, but also the emergence of fintech, new legislation on sustainable finance, the fight against money laundering and terrorist finance, and it’s good that the deal addresses these issues.

But one word on sustainable finance, because I think there is a role the supervisors they need to play. We know that the risk of climate change and climate change policy are not priced in right now, not on the bank balance sheets, not on the balance sheets of insurances and pension funds and not by credit rating. And they will have an impact on the financial sector. Therefore, the supervisors should take the lead and take the mandate that had been given to them and to press on, making sure that these risks are priced in, and that the financial sector is prepared for the future in the short run, but also in the medium and long run.

All in all, the new proposals are very timely and I congratulate the rapporteurs for striking a deal which addresses these challenges in the future and striking this deal under difficult circumstances.

As has been said, though the outcome is not as ambitious as I, and surely some of you, would have hoped for, I’m still convinced that this political agreement will help us to achieve more supervisory convergence in the future. It is a crucial step on our way to a genuine capital markets union, so once again, thank you to the rapporteurs, Ms Berès and Mr Karas, and let me ask you once again to lend your support to this outcome with your vote tomorrow.

Ich möchte unseren europäischen Bürgerinnen und Bürgern, die uns vielleicht zusehen, sagen, dass wir in dieser letzten Sitzungswoche des Europäischen Parlaments alleine heute 13 verschiedene Berichte des Wirtschafts- und Währungsausschusses behandeln, die wir morgen zur Abstimmung bringen. Wir haben vor acht Jahren begonnen, durch ein europäisches Aufsichtssystem auf die globalen Finanzkrisen zu reagieren, und morgen beschließen wir mit den drei Berichten jetzt eine umfassende Reform, um dieses System zukunftsfit zu machen. Wir erreichen damit einen weiteren Baustein auf dem Weg zur Vollendung der Kapitalmarktunion und zur Vertiefung der Wirtschafts- und Währungsunion.

Das ist eine gute Nachricht für die europäischen Bürgerinnen und Bürger, die Realwirtschaft, Investitionen, Arbeitsplätze und das Wachstum in Europa. Das zeigt, dass wir handlungsfähig sind, dass wir zu Lösungen fähig sind, wenn wir zusammenhalten. Und ich möchte in diesem Moment schon auch sagen, dass ich mich bei dem Vorgänger für den Bericht, den ich übernommen habe, bei Burkhard Balz, für die Vorarbeiten recht herzlich bedanke und Ihnen allen für die gute Zusammenarbeit danke.

  Pervenche Berès, rapporteure. – Madame la Présidente, je voudrais remercier l’ensemble de nos collègues pour le ton qu’ils ont adopté durant ce débat. Car, au fond, Monsieur le Vice-président, je crois que tous nos collègues, quel que soit le banc sur lequel ils siègent dans cet hémicycle, ont partagé une partie de la frustration des corapporteurs.

Ce Parlement a voulu soutenir la Commission, il a voulu aller très loin et, finalement, nous nous sommes heurtés au mur du Conseil. Et au Conseil, j’entends des arguments incroyables, selon lesquels lorsque vous avez une activité transfrontalière – par exemple si vous émettez des prospectus ou si vous dotez votre compagnie d’assurance d’un modèle interne, c’est-à-dire que vous êtes une grosse compagnie d’assurance –, ce serait l’autorité nationale compétente qui, au nom de la proximité et de la subsidiarité, serait la mieux placée pour évaluer les risques. Je crois que le Conseil fait erreur.

Avec Othmar Karas, nous nous sommes battus pour arracher, morceau par morceau, ce que nous avons obtenu aujourd’hui. Il appartiendra à nos successeurs d’examiner cette question du prospectus, de faire en sorte que les modèles internes ne restent pas sous le seul regard d’une autorité nationale compétente, et de réglementer, s’agissant des pays tiers, les plateformes de négociation ou les dépositaires centraux de titres.

L’essentiel, c’est peut-être, à la veille des élections européennes, que nos concitoyens se rendent compte, lorsqu’ils cherchent l’esprit européen, lorsqu’ils cherchent cette capacité à élaborer ensemble des solutions européennes pour ce marché qui est le nôtre, que c’est dans cet hémicycle, en travaillant d’arrache-pied sous l’impulsion des propositions de la Commission, que nous sommes le plus efficace dans l’intérêt des citoyens.
