  Πρόεδρος. – Το πρώτο σημείο στην ημερήσια διάταξη είναι η συζήτηση επί επτά προτάσεων ψηφίσματος σχετικά με την κατάσταση στην Τουρκία, ιδίως την απομάκρυνση εκλεγμένων δημάρχων (2019/2821(RSP)).

Πριν κηρύξω την έναρξη αυτής της συζήτησης, θα ήθελα να σας ανακοινώσω ότι, κατά τη διάρκεια της συνόδου της Ολομέλειας αυτή την εβδομάδα, δοκιμάζεται η λειτουργία ενός νέου συστήματος που επιτρέπει στους βουλευτές να εγγράφονται ηλεκτρονικά για τη διαδικασία catch-the eye και για τη διαδικασία ερώτησης με γαλάζια κάρτα.

Έχετε ήδη λάβει μέσω ηλεκτρονικού ταχυδρομείου πληροφορίες σχετικά με τη χρήση αυτού του συστήματος και στα έδρανά σας υπάρχουν και οι σχετικές γραπτές οδηγίες. Μπορείτε να υποβάλετε το αίτημά σας για παρέμβαση στη συζήτηση, χρησιμοποιώντας τα ειδικά πλήκτρα στο μηχάνημα ηλεκτρονικής ψηφοφορίας.

Σημειώστε επίσης ότι, παράλληλα με τη χρήση του ηλεκτρονικού συστήματος, θα υπάρχει επίσης η δυνατότητα να υποβάλετε το αίτημά σας με τη συνήθη πρακτική (δηλαδή, υψώνοντας ένα λευκό φύλλο χαρτιού ή υποβάλλοντας αυτοπροσώπως το αίτημα κατά την έναρξη της συζήτησης στους συναδέλφους της Ολομέλειας για τη διαδικασία «catch-the-eye»· και υψώνοντας μια γαλάζια κάρτα για τη διαδικασία της «ερώτησης με γαλάζια κάρτα»).

Το ηλεκτρονικό αυτό σύστημα θα δοκιμαστεί κατά τη διάρκεια διαφόρων συζητήσεων.

Για αυτό, θα ήθελα να σας υπενθυμίσω να έχετε πάντα μαζί σας την κάρτα ψηφοφορίας για να μπορείτε να χρησιμοποιείτε το σύστημα.

Το σύστημα αυτό θα δοκιμαστεί και στη διάρκεια της συζήτησης που ξεκινά αμέσως τώρα και όπως προείπα είναι η κατάσταση στην Τουρκία και ιδίως η απομάκρυνση εκλεγμένων δημάρχων.

  Sergey Lagodinsky, Verfasser. – Herr Präsident, liebe Kolleginnen, liebe Kollegen! Wenn ich Ihnen einen Rat geben darf: Gehen Sie einen Block weiter zum Sitzungssaal des Europäischen Gerichtshofs für Menschenrechte und hören Sie sich die Anhörungen dort an! Ich habe das gestern gemacht. Da geht es nicht um Entschließungen, da geht es um Menschen und um ihre Freiheit. Ich habe gestern in die Augen von Frau Demirtaş schauen können, der Frau, die um die Freiheit ihres Mannes kämpft.

Heute geht es nicht um Demirtaş, es geht um vier Bürgermeister und Bürgermeisterinnen aus der Türkei, die abgesetzt worden sind, obwohl sie demokratisch gewählt worden sind. Heute geht es um Adnan Selçuk Mızraklı, um Ahmet Türk, um Bedia Özgökçe.

Heute geht es aber um mehr als 400 weitere Menschen ohne Amt und Würden, die genauso verhaftet worden sind in dieser Verhaftungswelle. Heute geht es auch um Canan Kaftancıoğlu, um die CHP-Vorsitzende in Istanbul, die wegen eines Tweets aus dem Jahre 2012 – 2012! – verurteilt worden ist. Und ja, heute in dieser Entschließung geht es auch um die Sicherheit von Menschenrechtsverteidigern, von Menschen, die sich für andere Menschen einsetzen und ihre Freiheit und ihre Sicherheit riskieren. Zum Beispiel Veysel Ok, der gerade gestern verurteilt worden ist, weil er die Justiz beleidigt hat, als Anwalt die Justiz nicht beleidigen durfte.

Es geht aber in dieser Entschließung auch um viel mehr: Es geht um die Beziehungen zwischen der EU und der Türkei. Wie stellen wir uns die Zukunft dieser Beziehung vor? Diese Zukunft ist schwierig, aber in dieser Zukunft kann es nicht dazu kommen, dass 20 % aller Insassen in türkischen Gefängnissen wegen Terrorvorwürfen die Zeit dort absitzen, ohne dass diese Vorwürfe richtig belegt sind.

Diese Zukunft muss aber europäisch bleiben. Und darum lohnt es sich, auch mit der türkischen Regierung zu streiten, denn die Gesellschaft in der Türkei ist bunt, ist freiheitsliebend. Es lohnt sich, um ihre Menschenrechte zu kämpfen.

Ich weiß, dass hier nicht alle dieser Ansicht sind, aber ich glaube, dass es wichtig ist, die europäische Perspektive mit der Türkei weiter zu verteidigen. Diese Perspektive wird aber auf einer klaren gemeinsamen Grundlage aufgebaut, und diese Grundlage ist Respekt füreinander, aber auch unbedingter Respekt für Menschenrechte und Rechtsstaatlichkeit. Darum geht es in dieser Entschließung.

  Nacho Sánchez Amor, Autor. – Señor presidente, quiero mostrar mi satisfacción por el hecho de que haya sido fácil llegar a un acuerdo en esta propuesta de Resolución con los otros grupos, y yo creo que ha sido fácil llegar a un acuerdo porque el grado de deterioro de los derechos humanos cada vez hace más difícil buscar coartadas o justificaciones a lo que está pasando en Turquía. Es obvio, ya para todo el mundo, que el sistema penal turco es un dispositivo utilizado y, a veces, diseñado para acallar la crítica política. En este momento, los grupos estamos preocupados por lo que ha pasado con la destitución gubernativa/administrativa de varios alcaldes y su sustitución por el mismo Gobierno, por mandatarios no elegidos designados por el Ejecutivo. Quiero subrayar que no se trata de limitaciones de los derechos tras un proceso judicial. No, se trata de la simple remoción de un alcalde, recién elegido por sus conciudadanos, por parte del Gobierno, es decir, por parte de un partido competidor, y la designación para ese puesto de un mandatario de ese mismo partido.

No hay, por tanto, ni proceso, ni juez, ni garantías. Y, además, ese procedimiento se utiliza para amenazar a otros alcaldes, como ha sido el caso del alcalde socialdemócrata de Estambul, que ha tenido que ganar dos veces las elecciones para que el poder haya entendido que su apoyo popular era mucho mayor. Pero quiero señalar, que, además, con el caso de estos alcaldes del HDP no se trata de una cuestión de solidaridad partidaria, lo que hacemos es una defensa de la democracia local en Turquía, sean cuales sean las siglas de los alcaldes que se vean afectados por estas situaciones.

Miren, señorías, están pasando muchas cosas en Turquía. La inseguridad del poder para mantener el control de la sociedad es cada vez más obvia. Yo creo que la Unión Europea tiene que repasar sus mecanismos de trabajo en Turquía, porque cada vez se abren en el país más espacios de esperanza.

  Abir Al-Sahlani, författare. – Herr talman, ärade kollegor! Jag vill börja med att tacka alla grupper och deras representanter för ett jättebra samarbete och goda förhandlingar där vi höll den här resolutionen väldigt fokuserad på det som är viktigt och som pågår just nu.

Den här resolutionen handlar inte bara om det faktum att CHP:s lokala ordförande i Istanbul, som vann valet i staden Istanbul, har fått nio år och åtta månaders fängelse för inlägg på sociala medier. Inlägg som i andra länder inte hade fått några juridiska påföljder. Det handlar också om de avsatta borgmästarna i städerna Diyarbakir, Mardin och Van. Den här resolutionen pekar också på en oro vi har från Europaparlamentets håll kring den djupare, bredare problematiken med demokratins utmaningar, med människorättsförföljelse, med förföljelse av oppositionspolitiker, av maktmissbruk, av missbruk av användningen av antiterrorlagstiftningen.

Turkiet är ett viktigt land för EU. Men det kommer också att vara en central utmaning i EU:s utrikespolitik. Jag hoppas att vi inte kommer att behöva ha en lång rad av sådana här resolutioner om Turkiet. Men jag är beredd och Renew-gruppen är beredd att om och om igen ta upp Turkiet på dagordningen när man kränker mänskliga rättigheter, när man kränker rättsstatens principer och de demokratiska principerna. Jag hoppas att vi här i Europaparlamentet idag röstar ”ja” till den här resolutionen och jag hoppas att vi stödjer den demokratiska utvecklingen i Turkiet och de demokratiska krafterna.

  Özlem Demirel, Verfasserin. – Herr Präsident, meine Damen und Herren! Es gab in der Tat eine Kommunalwahl in der Türkei. Die Bevölkerung hat gewählt, hat sich entschieden. Und was passierte im Anschluss? Die gewählten Bürgermeisterinnen und Bürgermeister konnten ihr Amt nicht ausüben, die Kommunen wurden unter Zwangsverwaltung gestellt. Ich sage ganz klar: Das ist undemokratisch, das ist inakzeptabel, und das müssen wir auch genau so aussprechen.

Doch nicht nur das; die AKP-Regierung greift auch verstärkt PolitikerInnen der CHP an. Frau Canan Kaftancıoğlu wurde schon genannt, die Vorsitzende der CHP Istanbul, die wegen irgendwelcher Tweets – ich wiederhole: wegen irgendwelcher Tweets – zu knapp zehn Jahren Haft verurteilt wurde. Welch ein Wahnsinn!

Derzeit sind in der Türkei zum Beispiel über 5 000 HDP-Mitglieder hinter Gittern: verhaftete Journalisten, Oppositionelle, KritikerInnen. Denen geht es nicht gut. Zu den bekanntesten dieser Politikerinnen und Politiker zählt Selahattin Demirtaş; dem gehört natürlich auch meine Solidarität.

Das alles passiert, und Herr Erdoğan agiert derzeit nicht aus der Situation der Stärke heraus, sondern eher aus der Schwäche, denn bei den Kommunalwahlen haben wir ganz klar gesehen: Er hatte eine Niederlage, die Opposition hat sich zusammengeschlossen, und es kann sich etwas ändern in der Türkei.

Aber es sind nicht nur Rechtsstaatlichkeit und die Frage von Meinungs- und Pressefreiheit in der Türkei in Gefahr. Es gibt noch so vieles mehr. Wussten Sie zum Beispiel, dass die Türkei zu den Ländern mit den meisten Frauenmorden zählt? Wussten Sie, dass die Türkei steigende Zahlen an Vergewaltigungen von Kindern in religiösen Einrichtungen hat, dass in der Türkei tagtäglich ArbeiterInnen bei Betriebsunfällen sterben? Wussten Sie, dass es massive Repressionen gegenüber Gewerkschafterinnen und Gewerkschaftern gibt, betriebliche Organisationen unterbunden werden? Das alles ist vehement für uns, und wir müssen dem mehr Aufmerksamkeit schenken.

Die Türkei macht eine Krise durch, eine wirtschaftliche und politische Krise, und diese Krisen befruchten sich gegenseitig. Ich kann deshalb nur sagen: Der Bevölkerung geht es schlechter. Herrn Erdoğan geht es nur um Machterhalt. Deshalb: Lassen Sie uns der Türkei in den kommenden Monaten noch mehr Aufmerksamkeit schenken, und fangen wir bei unserer Politik an! Ändern wir unsere Politik, verlassen wir die Heuchelei, kündigen wir zum Beispiel den Flüchtlingspakt, denn es müssen auch immer mehr Menschen aus der Türkei hierher fliehen, weil sie keine Existenzgrundlage mehr haben!

  Michaela Šojdrová, Autorka. – Pane předsedající, já bych chtěla poděkovat všem spolupředkladatelům tohoto usnesení za spolupráci, ze které bylo jasně vidět, že nám jde o podporu demokratických sil v Turecku a o lidská a politická práva. Současný postoj vlády překračuje všechny meze vůči Kurdům. Dlouhodobě je situace Kurdů v Turecku komplikovaná, ale to, co se tam děje, to skutečně vyžaduje naši akutní akci, náš apel na tureckou vládu, že takovýmto způsobem nemůže postupovat jako člen Rady Evropy, jako člen NATO. Ano, PKK je organizace, kterou i Evropská unie považuje za teroristickou, ale to neznamená, že Turecko může uplatňovat kolektivní vinu vůči všem kurdským politikům. To je prostě přístup, který by mohl vést ve svém důsledku k další genocidě. Turecká vláda je sama proti sobě. Měla by se snažit najít nějaké východisko pro pokojné vztahy s Kurdy. A neměla by porušovat své vlastní zákony tak, jak to uvádí naše usnesení. Uvádíme tam konkrétní jména starostů, kteří byli odvoláni, nahrazeni starosty, kteří jsou z vládní strany. Nejde tady ale jen Kurdy a o stranu HDP. Turecká vláda tlačí také na opoziční republikány, a proto zde říkáme jasně, že s tímto faktem se nesmíříme, a Erdogan musí počítat s tím, že v demokratické společnosti může zvítězit opozice, to je prostě normální. Opozice má svá práva a měla by mít právo vykonávat mandát.

A dovolte mi ještě jednu poznámku. Nejenom Evropský soud pro lidská práva, ale je zde také nová budova turecké ambasády při Radě Evropy i její konzulát, který plánují určitě využívat, ale jestli nebudou ctít lidská práva, závazky vůči Radě Evropy, pak tato nádherná budova je budována zbytečně. Měli by si to uvážit.

  Λευτέρης Χριστοφόρου, εξ ονόματος της ομάδας PPE. – Κύριε Πρόεδρε, πιστεύω ότι τα τελευταία χρόνια κατέστη πλέον κανόνας η βία, η παραβίαση των ανθρωπίνων δικαιωμάτων, η τρομοκρατία εντός και εκτός Τουρκίας. Και είμαι εξ εκείνων που πιστεύουν ότι το θέμα με την παραβίαση των νόμων και των κανόνων για τους εκλεγμένους δημάρχους είναι, απλώς, συνέχεια πολλών άλλων παραβιάσεων που μετέτρεψαν την Τουρκία σε μια ανοιχτή χώρα φυλακής, βίας και τρομοκρατίας· μιας τρομοκρατίας η οποία δεν περιορίζεται μόνο στην Τουρκία αλλά εξάγεται και στις γειτονικές χώρες.

Αγαπητέ κύριε Πρόεδρε, ολόκληρη η χώρα μου υφίσταται τη βία και την τρομοκρατία, τις παραβιάσεις των ανθρωπίνων δικαιωμάτων, το σκληρό πρόσωπο της επεκτατικής πολιτικής της κατοχικής Τουρκίας εδώ και σαράντα πέντε χρόνια στην Κύπρο. Και για αυτό σήμερα, αν πραγματικά θέλουμε να συμβάλουμε όχι μόνο με ένα ακόμα ψήφισμα αλλά με πραγματικό έργο ως Ευρωκοινοβούλιο και ως δημοκρατικά εκλεγμένοι βουλευτές, πρέπει να βροντοφωνάξουμε και να στείλουμε με συγκεκριμένα μέτρα το μήνυμα: «Μηδενική ανοχή στην Τουρκία!».

Το Ευρωπαϊκό Κοινοβούλιο και η Ευρωπαϊκή Ένωση έχουν λάβει συγκεκριμένα μέτρα για άλλες χώρες και εντός της Ευρωπαϊκής Ένωσης αλλά και εκτός της Ευρωπαϊκής Ένωσης, χωρίς να ορρωδούν, εφαρμόζοντας αρχές και αξίες. Δεν πρόκειται να εφαρμόσουμε εκπτώσεις και υποχωρήσεις απέναντι στην Τουρκία. Και αν θέλουμε πραγματικά να το κάνουμε πράξη, οφείλουμε όλοι εμείς –διότι φαντάζομαι ότι κανένας από εσάς δεν ανέχεται να υφίσταται η χώρα του αυτό που υφίσταται η δική μου χώρα ούτε ανέχεται αυτές τις παραβιάσεις ανθρωπίνων δικαιωμάτων– οφείλουμε, επαναλαμβάνω, να προχωρήσουμε στο πάγωμα των ενταξιακών κονδυλίων της Τουρκίας. Κανένα ευρώ σε αυτή τη χώρα που τρομοκρατεί εντός και εκτός Τουρκίας! Καμία στήριξη, καμία βοήθεια, καμία ουσιαστική συμπαράσταση προς όλους αυτούς οι οποίοι πραγματικά δημιουργούν πρόβλημα και αστάθεια εντός και εντός Τουρκίας!

Πιστεύω ακράδαντα ότι και αυτό το ψήφισμα δεν πρόκειται να συγκινήσει τον κύριο Ερντογάν. Ο κύριος Ερντογάν εξαρτάται σε μεγάλο και σημαντικό βαθμό από την Ευρωπαϊκή Ένωση και όσο και αν εκβιάζει και αν απειλεί στην Κύπρο με την παραβίαση της Αποκλειστικής Οικονομικής Ζώνης, με την καταπάτηση ψηφισμάτων για την Αμμόχωστο και με τον εκβιασμό για το μεταναστευτικό, να ξέρετε, κύριε Πρόεδρε, ότι η Τουρκία εξαρτάται σε πολλαπλάσιο βαθμό από την Ευρωπαϊκή Ένωση και το πάγωμα των κονδυλίων, καθώς και το πάγωμα των οικονομικών και εμπορικών σχέσεων είναι αυτό που θα υποχρεώσει πραγματικά την Τουρκία να «ανακρούσει πρύμνα» και να σεβαστεί τα ανθρώπινα δικαιώματα.

  Isabel Santos, em nome do Grupo S&D. – Senhora Presidente, a escalada de ataques, por parte das autoridades turcas, à liberdade de imprensa, aos ativistas de direitos humanos e aos opositores políticos tem sido motivo de uma apreensão contínua e crescente ao longo dos anos.

Os recentes atos persecutórios contra eleitos locais, numa clara tentativa de reverter os resultados das eleições de 31 de março, resultando na detenção e na substituição de presidentes de câmara que, em sufrágio, atingiram maiorias absolutas, por administradores não eleitos e as intimidações dirigidas a outros eleitos locais não podem deixar de ser alvo do nosso mais vivo repúdio.

O desrespeito pelo voto expresso dos cidadãos constitui uma linha vermelha cuja ultrapassagem jamais pode ser tolerada. A condenação de Kaftancıoğlu - que se entende como uma clara reação à vitória do CHP em Istambul - não pode deixar de ser alvo da nossa indignação. A legislação antiterrorismo e a lei criminal não podem ser utilizadas com vista ao silenciamento e ao afastamento de críticos do poder instituído.

A União Europeia não pode tolerar a tentativa de esmagamento da vontade popular de mudança e as constantes violações do Estado de Direito na Turquia.

  Ramona Strugariu, în numele grupului Renew. – Domnule președinte, după 17 ani la putere, fundația regimului lui Erdogan începe să se clatine. Alegerile din iunie au fost un semn foarte clar în acest sens: a pierdut controlul în șapte din cele zece mari municipalități ale Turciei. Condamnarea unor lideri ai opoziției la zece ani de închisoare pentru terorism și insulte aduse președintelui înseamnă răzbunare. Nu este nimic altceva decât o răzbunare, așa cum sunt hărțuirea și condamnările împotriva celor care își exprimă liber opinia pe rețelele sociale sau împotriva jurnaliștilor. Erdogan disprețuiește democrația, drepturile omului și opțiunile politice ale cetățenilor săi. Cea mai vie și recentă dovadă este înlăturarea primarilor aleși din Diyarbakır, Mardin și Van. Trebuie să fim foarte fermi în orice discuție sau negociere cu Turcia și să oprim ipocrizia. Condiționați finanțarea și parteneriatele economice de respectarea drepturilor omului, nu doar pentru Erdogan, ci pentru toate regimurile nedemocratice care zdrobesc libertatea.

  Alice Kuhnke, för Verts/ALE-gruppen. – Herr talman! Den Europeiska unionen som institution och vi parlamentariker som folkvalda representanter, vi måste säga som det är. Det som pågår och har pågått under år, månader och många, många långa tider i Turkiet är ett brott mot de mänskliga rättigheterna och mot internationella överenskommelser. Hundratals demokratiskt valda borgmästare och politiker, studenter, akademiker och politiska aktivister som har använt sin demokratiska rätt att höja sin röst, har fängslats och anklagas för terrorism och för att vara fiender till Turkiet.

Vi gröna, vi uppmanar de turkiska myndigheterna att omedelbart och utan villkor frige de arresterade och släppa anklagelserna mot dem. Och vi påminner Erdoğan om att vi ser dig. Vi ser vad du gör och vi kommer att fortsätta att göra motstånd eftersom historien har lärt oss att vi inte har något annat val.

  Bernhard Zimniok, im Namen der ID-Fraktion. – Herr Präsident, meine Damen und Herren! In der Türkei spitzt sich die Lage wieder einmal zu. Erdoğan agiert wieder einmal als absoluter Herrscher und droht nun der EU mit einem neuen Migrantenansturm – das ist Erpressung 2.0.

Er geht mit Härte gegen die Opposition vor, führt gegen die Kurden einen Krieg im eigenen Land, und das gipfelt nun in seinem Herrschaftsanspruch mit der Absetzung von demokratisch gewählten Bürgermeistern. Als offizieller Grund wird meistens die Unterstützung der PKK genannt. Die heftige Kritik der Opposition, des ehemaligen Ministerpräsidenten Davutoğlu und des früheren Staatspräsidenten Gül zeigen ganz deutlich den vorgeschobenen Charakter dieser offiziellen Begründungen.

Die EU muss nun dieses undemokratische Verhalten und seine Drohungen nicht nur – wie sonst üblich – wie ein Maulheld verurteilen, sondern endlich die nötigen Konsequenzen ziehen. Daher fordere ich die EU-Kommission eindringlich auf: Beenden Sie endlich die Beitrittsverhandlungen mit der Türkei – ein für allemal! Die Türkei gehört nicht zu Europa.

  Jan Zahradil, za skupinu ECR. – Pane předsedající, já jsem byl od roku 2004 15 let členem Výboru přidružení EU a Turecka, ale letos jsem poprvé do tohoto výboru nevstoupil, prostě proto, že mi připadá, že rozhovory o členství Turecka v EU se dostaly do slepé uličky. A to říkám jako někdo, kdo Turecko tradičně podporoval, ale musel jsem svůj názor změnit. Jedním z těch bodů, kdy k tomu obratu došlo, byla situace po potlačení neúspěšného převratu, kdy došlo k velkým čistkám v armádě, v justici, ve státní administrativě, v akademické sféře i v médiích. A ty represe skutečně dosáhly nebývalého stupně a teď tedy zažíváme něco podobného i při útoku toho vládního režimu nebo vládní strany na demokraticky zvolené politiky a já myslím, že si musíme říci, že je to opravdu nepřijatelné. A mám takový pocit, že by bylo na místě chovat se férově, přestat si s Tureckem hrát na schovávanou a říci si, že za těchto podmínek, za této situace prostě nemůžeme uvažovat o členství Turecka v Evropské unii a říct to také naplno.

Demokratisk valgte kurdiske borgmestre tvangsfjernes, den venstreorienterede prokurdiske præsidentkandidat og tidligere partiformand, Selahattin Demirtaş, sidder fængslet. Hans eneste forbrydelse er at have brugt sin ytringsfrihed. Ligeledes sidder tusinder af borgmestre, parlamentarikere og medlemmer af HDP-partiet fængslet. Kære kollegaer, undertrykkelsen i Tyrkiet skal have konsekvenser. Erdogans brud på grundlæggende demokratiske rettigheder skal ikke accepteres, der skal handles. Kære kollegaer, EUs milliardstøtte til Tyrkiet bør stoppes, indtil grundlæggende demokratiske rettigheder er sikret, det fortjener befolkningen i Tyrkiet, det fortjener den demokratiske opposition i Tyrkiet, og det fortjener de europæiske skatteborgere.

  Annunziata Mary Rees-Mogg (NI). – Mr President, thank you to the 452 321 East Midlands voters who put their faith in the Brexit Party. Today’s so-called debate regards the state of democracy in the Kurdish areas in the south and east of Turkey. Understandably, it is of concern to us all to see democracy called into question in our neighbour. It is surely bizarre then that the EU has still not ruled out Turkish accession to its supposedly democratic Union. Of course, the real hypocrisy is calling for free and fair democracy in non-EU countries such as Turkey, whilst trying to undermine voters’ wishes in their own Member States.

Just yesterday, British MEPs from less successful parties were calling for a further delay to Brexit ‘to sort it out’. They mean to undo the will of the British people. It is sad when members of this aspirational federation preach one thing to Turkey, and simultaneously betray their own members’ democratic mandate.

  Tomislav Sokol (PPE). – Poštovani predsjedavajući, svi znamo da je Turska izuzetno važan susjed Europskoj uniji. Osim pitanja gospodarske razmjena, pitanja migracija o kojemu smo već dosta čuli, također je izuzetno važan i utjecaj Turske na područje jugoistočne Europe, pogotovo Bosne i Hercegovine. Turska već godinama proijcira svoj utjecaj u Bosni i Hercegovini, prvenstveno kroz bošnjačke stranke, i to je nešto što se definitivno ne može i ne smije ni na koji način zanemariti. Nažalost, europski put Bosne i Hercegovine je u velikoj mjeri ugrožen od određenih političkih stranaka tamo, ugrožen je od onih koji ne poštuju odluke Ustavnog suda i koji zapravo uskraćuju i onemogućavaju vladavinu prava dokidanjem ravnopravnosti jednog od konstitutivnih naroda, a to je hrvatski. Nažalost, takva situacija ima veze i s tom projekcijom interesa i moći o kojoj sam govorio.

Što se same Turske tiče, nažalost zadnjih godina tamo nalazimo situaciju gdje postoji sumrak demokracije, gdje zapravo imamo unazađivanje i degradaciju temeljnih ljudskih prava, demokracije i vladavine prava i ustavnog poretka, a to se posebno intenziviralo nakon neuspješnog državnog udara 2016. Imali smo situaciju čistke nepoćudnih kadrova u obrazovnom sustavu, medijima, u pravosuđu, a vrhunac toga je ovo o čemu govorimo danas, a to je smjena legalno izabranih lokalnih čelnika i zamjena onih instaliranih s vrha. Nažalost, ova degradacija nije dobra, ova degradacija pokazuje da Turska odstupa od svih onih načela koja je uspostavio još osnivač moderne turske republike Kemal Atatürk, a to su demokracija, vladavina prava i jedna moderna sekularna država koja je kao takva i podnijela kandidaturu za Europsku uniju.

Kako bi Turska mogla ostati u dobrim odnosima s Europskom unijom, kako bi se ti susjedski odnosi mogli razvijati, bitno je da se Turska vrati onim standardima koji su uspostavljeni prije, da se onemogućava ovakve situacije smjene izabranih dužnosnika, da se Turska vrati demokraciji, vladavini prava i da se onemogući demografsko postupanje vladajuće stranke i njenog predsjednika.

  Eero Heinäluoma (S&D). – Arvoisa puhemies, Turkki on todellakin meille äärimmäisen tärkeä naapuri, se on sitä poliittisesti, taloudellisesti ja myös kansalaisten kanssakäymisen kannalta.

Vierailin viikko sitten Turkissa ja tapasin ihmisiä, jotka olivat yhtä aikaa optimistisia, tulevaisuudenuskoisia, he näkivät poliittisen muutoksen mahdollisuuden demokratian ja vaalien kautta ja toisaalta olivat huolissaan siitä, mitä he näkevät juuri keskushallinnon toimenpiteenä demokraattisesti valittuja paikallisia päättäjiä, pormestareita kohtaan.

Turkki on hakenut EU:n jäsenyyttä. Se on Euroopan neuvoston jäsen. Se on sitoutunut noudattamaan demokraattisia periaatteita omassa hallinnossaan ja vaalien tuloksia. Me emme siis voi vaieten sivuuttaa sitä, mitä Turkissa on tapahtunut. Emme voi hyväksyä laillisesti valittujen pormestareiden syrjäyttämistä.

Turkkilaiset katsovat meihin. Hyväksymällä parlamentin vahvan kannanoton annamme selvän viestin niin Turkin hallinnolle kuin Turkin kansalaisille: me olemme demokratian tukena myös Turkissa.

  Bernard Guetta (Renew). – Monsieur le Président, mes chers collègues, je poserai deux questions.

Pourquoi le niveau de répression ne recule-t-il jamais en Turquie? Pourquoi M. Erdogan en est-il maintenant à faire destituer des maires élus dont le seul tort est d'être kurde? Cet acharnement, cette frénésie, semblent a priori incompréhensibles, si ce n’est que l'espoir renaît en Turquie, comme deux de nos collègues viennent de le rappeler.

Ankara est passé à l'opposition, Istanbul a amplifié son premier vote en faveur d'un jeune et brillant kémaliste, le mécontentement social grandit jusque dans l'électorat de l'AKP et, dernier désaveu pour ce président, trois des plus grandes figures de son propre parti viennent d'en claquer la porte pour aller fonder de nouvelles formations. M. Erdogan est inquiet, il a des raisons de l'être, c'est pour cela qu'il frappe de plus en plus aveuglément, et c'est pour cela que notre Parlement, mes chers collègues, se doit tant de défendre encore et toujours les démocrates de ce pays.

  François Alfonsi (Verts/ALE). – Monsieur le Président, la résolution d’urgence sur la situation en Turquie dont nous débattons est motivée par les nouvelles et graves atteintes à la démocratie, commises par le régime de M. Erdogan.

La révocation arbitraire des autorités municipales des trois grandes villes du Kurdistan, pour la seule raison de l’orientation politique de ceux qui ont été choisis par les électeurs, est profondément choquante. Il faut bien sûr réagir avec force. Notre résolution confortera l’espoir de ceux qui, en Turquie, luttent pour la démocratie.

Mais notre Parlement doit aussi prendre conscience que ces faits ont un cadre politique bien défini, celui de la lutte du peuple kurde pour la reconnaissance de ses droits historiques. Le basculement de la Turquie vers des dérives antidémocratiques toujours plus inquiétantes est lié au refus du dialogue au sein de l’État turc sur l’avenir institutionnel du Kurdistan, qui aspire à une véritable autonomie politique. Ce dialogue est indispensable si l’on veut construire demain une démocratie durable en Turquie. L’Europe peut et doit contribuer à ce qu’il puisse être établi.

  Danilo Oscar Lancini (ID). – Signor Presidente, onorevoli colleghi, non deve passare sotto silenzio l'ennesima purga del premier turco Erdoğan, che questa volta coinvolge i sindaci delle tre più importanti città curde, eletti democraticamente e con ampie maggioranze. Questi sindaci, accusati in maniera sommaria di essere legati ai gruppi separatisti armati del PKK, sono stati rimossi e sostituiti da governatori graditi al governo centrale.

Anch'io sono stato sindaco e conosco bene il legame di fiducia che c'è con i cittadini. Sono quindi indignato perché, ancora una volta, Erdoğan pensa di poter calpestare impunemente la volontà popolare.

L'Unione europea, attraverso la Presidente della Commissione e l'Alto rappresentante per la politica estera, deve rispondere con atti concreti a un leader che non manca mai di minacciare l'Occidente, reprimere le libertà fondamentali del popolo e alimentare il peggior radicalismo islamico.

La procedura di adesione della Turchia all'Unione europea, vista anche la totale mancanza di progressi nei negoziati e la questione sempre aperta di Cipro del Nord, non va solo soppressa ma, a mio modesto parere e se vogliamo essere coerenti con i principi di democrazia e libertà su cui si fonda questa nostra Europa, deve essere dichiarata conclusa e respinta.

  Γιώργος Γεωργίου (GUE/NGL). – Κύριε Πρόεδρε, κυρίες και κύριοι συνάδελφοι, κάθε φορά που συζητούμε για την Τουρκία έρχεται στο μυαλό μου μια εικόνα: από τη μια ο κύριος Ερντογάν να κρατάει με βλοσυρό ύφος στο ένα χέρι τα τέσσερα εκατομμύρια πρόσφυγες και στο άλλο χέρι τους εμπορικούς ισολογισμούς της χώρας του μαζί με τις ευρωπαϊκές χώρες και να τα ανεμίζει απειλητικά απέναντι στους Ευρωπαίους ηγέτες. Και αυτοί να παραμένουν σκυφτοί και γονατισμένοι. Όσο δεν αλλάζει αυτή η εικόνα, η Τουρκία θα διολισθαίνει στον αυταρχισμό. Θα συνεχίζει να κρατά όμηρο την Κύπρο, να καταστρατηγεί τη δημοκρατία, να περιορίζει τις ελευθερίες, να παραμερίζει και να διώχνει δημάρχους ακόμα και πρωθυπουργούς, να διώκει και Τούρκους και Κούρδους είτε είναι πολιτικοί είτε είναι δημοσιογράφοι είτε είναι διανοούμενοι.

Κυρία von der Leyen και λοιποί Ευρωπαίοι αξιωματούχοι, αλλάξτε αυτή την εικόνα, αν θέλετε και αν μπορείτε, για να τελειώνουμε επιτέλους με όλα αυτά τα ντροπιαστικά.

  Ιωάννης Λαγός (NI). – Κύριε Πρόεδρε, ακούω για δημοκρατικές ευαισθησίες και για διάφορα τέτοια πράγματα μέσα σε αυτή την αίθουσα. Και βέβαια έχετε απόλυτο δίκιο να μιλάτε για αυτά που συμβαίνουν στην Τουρκία.

Όμως εγώ θα ήθελα να σας μιλήσω ως ένας άνθρωπος που έχει βιώσει αυτά τα πράγματα. Ξέρετε έχω εκλεγεί βουλευτής τέσσερις φορές τα τελευταία χρόνια στο ελληνικό Κοινοβούλιο. Όμως πριν από έξι χρόνια υπήρξε μια παράνομη και άδικη δίωξη εις βάρος μας - εμένα, του επικεφαλής του κόμματος που τότε ανήκα και άλλων πέντε βουλευτών. Μπήκαμε στη φυλακή για δεκαοκτώ μήνες και μείναμε εκεί παράνομα μετά από παρεμβάσεις του τότε πρωθυπουργού της χώρας Αντώνη Σαμαρά και με πιέσεις που ασκήθηκαν σε εισαγγελείς, σύμφωνα με οπτικοακουστικό υλικό, το οποίο υπάρχει και το οποίο είναι στη διάθεσή σας και στη διάθεση όποιου έχει αμφιβολίες για όλα αυτά. Αυτά λοιπόν είναι κατάφωρες παραβιάσεις των ανθρωπίνων δικαιωμάτων και εκλεγμένων βουλευτών.

Όσον δε αφορά την Τουρκία, η στάση της, φυσικά, είναι απαράδεκτη. Η Τουρκία πρέπει να τιμωρηθεί. Η Τουρκία ποτέ δεν ήταν και ποτέ δεν θα είναι μέλος της Ευρωπαϊκής Ένωσης. Και το πρόβλημα δεν είναι ο Ερντογάν στην Τουρκία. Είναι η ίδια η Τουρκία. Έτσι έχει μάθει να φέρεται και να καταπατά όλες τις διεθνείς συμβάσεις και όλους τους νόμους κάνοντας μόνο ότι αυτή θέλει.

  Μανώλης Κεφαλογιάννης (PPE). – Κύριε Πρόεδρε, η αντικατάσταση των τριών δημοκρατικά εκλεγμένων δημάρχων δεν παραβιάζει τη βούληση των πολιτών των τριών πόλεων της Τουρκίας. Παραβιάζει την ίδια τη δημοκρατία. Η Τουρκία, ιδίως μετά το πραξικόπημα του 2016, ρέπει προς ένα ιδιότυπο αυταρχισμό, που δεν συνάδει με τις αρχές και τις αξίες της Ευρωπαϊκής Ένωσης. Η Τουρκία δεν σέβεται τις αρχές του κράτους δικαίου και της δημοκρατίας. Δεν σέβεται τις σχέσεις καλής γειτονίας. Δεν σέβεται τα κυριαρχικά δικαιώματα των γειτόνων της, όπως, παραδείγματος χάρη, την Αποκλειστική Οικονομική Ζώνη της Κύπρου και της Ελλάδος, που παραβιάζονται κατάφωρα όλο αυτό το διάστημα.

Η Ευρωπαϊκή Ένωση πρέπει να αναλάβει συγκεκριμένη δράση. Η Ευρώπη επιθυμεί μια δημοκρατική Τουρκία στην Ευρώπη. Δεν επιθυμεί όμως τη συμπεριφορά μιας χώρας που απειλεί την Ευρώπη, που δεν σέβεται την Ευρώπη. Με το σημερινό ψήφισμα καταδικάζουμε μια ακόμα αντιδημοκρατική στάση και ενέργεια της τουρκικής ηγεσίας και του κυρίου Ερντογάν προσωπικά.

  Evin Incir (S&D). – Herr talman! I går var jag åhörare på rättegången mot Selahattin Demirtaş, alltså den före detta kurdiska HDP-medordförande, mot turkiska staten vid Europadomstolen för de mänskliga rättigheterna. Där framgick det tydligt av Europarådets MR-kommissionär att det finns minst sagt allvarliga brister i det turkiska rättssystemet.

Enligt The Committee to Protect Journalists sammanställning från 2018 har Turkiet flest fängslade journalister i hela världen. Dessutom för ett par veckor sedan tvångsavsattes de tre HDP-borgmästarna i de kurdiska städerna Diyarbakir, Mardin och Van, mindre än fem månader efter lokalvalen i Turkiet. Och under just den här sessionen fick jag ett SMS om att i går så tvångsavsattes ännu fler borgmästare i Diyarbakir-provinsen. Som många andra anklagas de för terrorism fastän dom med fredliga medel arbetat för demokrati och alla folks frihet i landet.

Det är viktigt att vi i Europaparlamentet, som är viktig röst i kampen för en demokratisk och jämlik värld, höjer våra röster och kräver att alla politiska fångar och samvetsfångar släpps fria.

  Markus Buchheit (ID). – Herr Präsident! Die EU wird an die Türkei nach wie vor 1,18 Milliarden EUR an Beitrittshilfen bis zum nächsten Jahr überweisen, statt diese Gespräche endlich abzubrechen. Dies auch – und gerade – vor dem Hintergrund des sogenannten Flüchtlingsabkommens mit Erdoğan, das aus der Unfähigkeit und der Unwilligkeit zur eigenen Grenzsicherung geboren wurde. Ob und wenn ja, in welchem Maße dieses Türkei-Abkommen tatsächlich zum Rückgang der Migrationsströme beigetragen hat, ist nach wie vor fraglich, und das trotz insgesamt sechs Milliarden Euro an europäischen Zahlungen.

Und nun droht die Türkei erneut mit einem Rückzug aus diesem Abkommen. Wir sehen, was mit den Bürgermeistern in der Türkei passiert ist. Einigen hier scheint es quasi Freude zu machen, sich permanent erpressen zu lassen. Die Europäische Union lässt sich am Nasenring durch die Manege führen.

Die Mehrheit der Bürger teilt diese masochistischen Neigungen nicht. Sie wünscht Klarheit und keine Aufnahme der Türkei in die EU.

Ich fordere auch Sie auf: Beenden Sie die Beitrittsgespräche sofort, stoppen Sie die Zahlungen und schaffen Sie endlich klare Verhältnisse im Umgang mit einem Despoten!

  James Wells (NI). – Mr President, while we debate this worrying situation I would like to highlight EU hypocrisy on the question of democracy. Municipal elections took place across Turkey earlier this year, which led to the opposition party winning in Istanbul. However, at an AKP party meeting Mr Erdogan said re-running the vote was the best step for Turkey to solve its problems within a framework of democracy and law.

Most of us were outraged on this, rightly so. In fact, our very own Guy Verhofstadt said: ‘this is an outrageous decision that highlights Turkey is drifting towards dictatorship, and that under such leadership accession talks are impossible.’ So whilst, on the one hand, the EU’s lead Brexit coordinator says a country cannot join the EU for overturning an election, on the other hand, he gives his support to the Lib Dems via attending their party conference to overturn a democratic election in the UK.

  Sara Skyttedal (PPE). – Herr talman! I teorin finns det många anledningar att visa tålamod gentemot Turkiet. Det är ett formellt kandidatland som också har avhjälpt och spelat en stor roll i den migrationskris som har utmanat våra medlemsländer. Men till slut kommer man till en situation där tålamodet tryter. Många är vi som har hoppats på en positiv utveckling i Turkiet och att de demokratiska institutionerna ska stabiliseras. Efter kuppförsöket 2016 har situationen blivit alltmer ohållbar. Erdoğan och AKP visar inga tecken på att förändring väntar åt ett annat håll.

Vi lever i en tid där det finns en risk att vi inte fäster någon vikt vid när vi får till synes repetitiva nyhetsuppdateringar om samma land. Min oro är att notiser om urholkandet av rättsstaten, nedmonterandet av demokratiska institutioner och fängslandet av oliktänkande inte ens får vår uppmärksamhet, i tider när vi av våra skärmar hela tiden blir överrösta av meddelanden och gilla-markeringar.

Avsättandet av borgmästare som valdes den 31 mars i år är bara det senaste av exempel på hur Erdoğan tänjer på gränserna och prövar vårt tålamod. Ett exempel som inte ska gå obemärkt förbi. För Turkiet är inte vilket land som helst; Turkiet är ett kandidatland för att bli medlem i den Europeiska unionen och det måste finnas en gräns för hur långt bort från de demokratiska principerna man kan röra sig och fortfarande anses vara på väg mot ett fullgott EU-medlemskap.

  Brando Benifei (S&D). – Signor Presidente, onorevoli colleghi, Erdoğan ci ha abituati, purtroppo, ad azioni molto gravi, come la rimozione di sindaci appena eletti democraticamente, laddove il risultato non gli fosse congeniale, a maggior ragione se curdi o vicini ai curdi, nella regione del Sud Est in particolare, dimostrando ancora una volta che il voto per lui non è che un simulacro di una democrazia che in parte non c'è più.

Come può chiamarsi democrazia quella in cui un leader delle opposizioni, Selahattin Demirtaş, è in carcere da quasi tre anni per motivi politici e non viene consentito a deputati come me e altri colleghi di visitarlo, come abbiamo cercato di fare con una missione nel 2016?

Per questi e molti altri motivi nel lavoro sugli strumenti finanziari dell'Unione europea in questi anni abbiamo dato segnali molto forti ad Ankara, sottraendo fondi europei proprio nelle zone colpite da una rimozione autoritaria dei sindaci, tagliando in modo drastico le risorse destinate al paese in quanto candidato all'adesione, redirigendo quelle restanti verso la società civile che lotta ogni giorno per i diritti e le libertà fondamentali.

Erdoğan se ne faccia una ragione: non smetteremo mai di contrastare il suo autoritarismo, sosterremo la società turca che è ancora viva e che chiede un forte cambiamento. Non le volteremo le spalle.

  Mara Bizzotto (ID). – Signor Presidente, onorevoli colleghi, come ci insegna la storia la Turchia non è mai stata, non è e non sarà mai Europa.

Oggi la Turchia è un paese di 80 milioni di musulmani, dove la democrazia, la libertà e i diritti umani sono quotidianamente violati dalla dittatura islamista di Erdoğan.

In questi anni l'Europa ha regalato miliardi di euro alla Turchia, favorendo un paese che è contro la democrazia europea, contro i nostri valori e contro la nostra libertà. Vi ricordo che più volte il dittatore Erdoğan ha minacciato di portare guerre di religione dentro i nostri paesi e dentro le nostre città.

Cari colleghi, è ora di smetterla con questo falso buonismo. Dobbiamo avere il coraggio di dirlo forte e chiaro: l'Unione europea deve interrompere subito, subito e per sempre, i negoziati per l'entrata della Turchia in Europa.

  Λουκάς Φούρλας (PPE). – Κύριε Πρόεδρε, έχω ακούσει σήμερα πάρα πολλές διαπιστώσεις, πάρα πολλά συμπεράσματα. Νομίζω ότι έφτασε η ώρα για μέτρα. Είναι η μόνη γλώσσα που καταλαβαίνει η Τουρκία. Αυτό είναι ξεκάθαρο. Έχω σχεδόν την ίδια ηλικία με την εισβολή των Τούρκων στην πατρίδα μου. Και σας το λέω πολύ ειλικρινά, ως Κύπριος Ευρωβουλευτής, ότι έχω κουραστεί, έχω «χορτάσει» από φραστική συμπαράσταση, από ψηφίσματα, τα οποία η Τουρκία πετά στον κάλαθο των αχρήστων. Είμαστε έτοιμοι ως Ευρωπαϊκή Ένωση να λάβουμε αποφασιστικά μέτρα διότι είναι η μόνη γλώσσα που καταλαβαίνει ο Ερντογάν; Ας το πράξουμε! Νομίζω έφτασε η ώρα να το κάνουμε.

Θύμα της πολιτικής αυτής που συζητούμε σήμερα είναι και η χώρα μου. Τα τουρκικά γεωτρύπανα αυτή την ώρα που μιλούμε, αγνοώντας το δίκαιο και τους νόμους, με την υποστήριξη του Πολεμικού Ναυτικού έχουν περικυκλώσει την πατρίδα μου. Την ίδια ώρα προχωρούν σε εποικισμό της Αμμοχώστου αγνοώντας κάθε ψήφισμα των Ηνωμένων Εθνών. Κυρίες και κύριοι συνάδελφοι, αυτή η πειρατική συμπεριφορά δεν πρέπει να γίνει αποδεκτή από κανέναν.

Ζητώ να ενώσετε τις δυνάμεις σας μαζί μας, ώστε να ληφθούν μέτρα για να επιφέρουν κόστος στο καθεστώς Ερντογάν. Πρέπει επιτέλους να σταλεί ξεκάθαρο μήνυμα στην Άγκυρα πως η κάθε παράνομη ενέργεια θα έχει κόστος και αυτό που χρειαζόμαστε είναι συνεργασία και ειρήνη και όχι τουρκικά «νταηλίκια». Σας καλώ να σταθείτε στο πλευρό μας, λαμβάνοντας ουσιαστικά και αποτελεσματικά μέτρα αντιμετώπισης της τουρκικής πειρατείας στο εσωτερικό της Τουρκίας και στο εξωτερικό.

  Κώστας Μαυρίδης (S&D). – Κύριε Πρόεδρε, η καθαίρεση των τριών Κούρδων δημάρχων θέτει ένα ουσιαστικό ερώτημα που πρέπει να απαντήσουμε όλοι μας: έχει η σημερινή Τουρκία δημοκρατικό πολίτευμα; Ανεξαρτήτως απόψεων, η απάντηση δόθηκε χθες ενώπιον του Ευρωπαϊκού Δικαστηρίου Ανθρωπίνων Δικαιωμάτων. Δόθηκε με νομικά τεκμηριωμένη άποψη από την αρμόδια Επίτροπο Ανθρωπίνων Δικαιωμάτων του Συμβουλίου της Ευρώπης, η οποία διαπίστωσε ότι στην Τουρκία υπάρχει συστηματική αποτυχία για ανεξάρτητη και αμερόληπτη απονομή δικαιοσύνης.

Το ερώτημα, λοιπόν, για μας είναι το εξής: μπορεί σε μια χώρα να χρησιμοποιείται η δικαιοσύνη ως εργαλείο από την κυβέρνηση και ταυτοχρόνως η χώρα αυτή να είναι δημοκρατία; Άρα λοιπόν, το καθεστώς Ερντογάν, το οποίο χρησιμοποιεί τη δικαστική εξουσία ως εργαλείο, είναι το ίδιο που παρεμβαίνει στη Βουλγαρία, στη Βοσνία, αλλά δυστυχώς και στη χώρα μου, στο βόρειο κατεχόμενο μέρος της Κύπρου, το οποίο μάλιστα πρόσφατα επιχειρεί να ισλαμοποιήσει με βάναυσο τρόπο.

Το ερώτημα λοιπόν για μας, κύριε Πρόεδρε, είναι: θα εκδώσουμε άλλο ένα ψήφισμα ή θα προχωρήσουμε σε μέτρα που να έχουν κόστος;

  Philippe Olivier (ID). – Monsieur le Président, récemment, le président turc, M. Erdogan, a brandi la menace de laisser se déverser sur l’Europe une vague migratoire s’il ne recevait pas des fonds supplémentaires. Nous payons là l’erreur coupable d’avoir délégué à d’autres notre protection vitale.

M. Erdogan, qui se voit comme un sultan du nouvel empire ottoman, sait que la politique est un rapport de force. Il est coutumier de ces comportements peu amicaux. Il s’en prend à la Grèce ou à Chypre, et lorsqu’un de nos collègues le fait remarquer dans cet hémicycle, l’Assemblée ne l’entend pas. Il instrumentalise les diasporas turques dans nos pays et l’Union européenne tourne la tête.

La situation que nous vivons avec la Turquie est éloquente: l’UE a fait de l’Europe l’empire de la faiblesse. Mais surtout, en détruisant nos protections frontalières, l’UE a désarmé nos nations et les a placées sous la menace d’une submersion migratoire aujourd’hui utilisée comme une arme de destruction massive. Ce n’est pas simplement une faute, c’est une forfaiture.

  Δημήτρης Παπαδάκης (S&D). – Κύριε Πρόεδρε, είμαστε στο ίδιο έργο θεατές: η Τουρκία να προκαλεί και να προσβάλλει βάναυσα κάθε έννοια σεβασμού των ανθρωπίνων δικαιωμάτων και των ευρωπαϊκών αξιών και εμείς ως Ευρώπη να αναλωνόμαστε σε θεωρητικές διακηρύξεις και ψηφίσματα, χωρίς η Τουρκία να συμμορφώνεται στις εκκλήσεις μας.

Ποια είναι τα αποτελέσματα απέναντι σε αυτές τις πολιτικές; Να αντικαθιστά με διοικητικές αποφάσεις δημοκρατικά εκλεγμένους δημάρχους με τη συνήθη κατηγορία υπόθαλψης της τρομοκρατίας και να τους αντικαθιστά με κρατικά όργανα. Να συνεχίζει εδώ και τρία χρόνια την παράνομη κράτηση του ηγέτη του HDP Σελαχατίν Ντεμιρτάς. Να φυλακίζει δημοσιογράφους και να ποινικοποιεί κάθε μη αρεστή πολιτική δραστηριότητα. Να εισβάλλει στην ΑΟΖ κράτους μέλους της Ευρωπαϊκής Ένωσης και να απειλεί με εποικισμό την πόλη της Αμμοχώστου.

  Pierfrancesco Majorino (S&D). – Signor Presidente, onorevoli colleghi, è assolutamente evidente a tutti, ed è emerso nel corso della discussione, l'enorme involuzione autoritaria che sta vivendo in questi anni la Turchia.

La rimozione dei tre sindaci, tutti dell'HDP, di Diyarbakır, Mardin e Van è purtroppo solo il più recente episodio della battaglia che il governo turco sta conducendo contro le principali fonti di dissenso interno: accademici, giuristi, difensori dei diritti umani, oppositori politici, membri eletti del Parlamento e delle istituzioni locali, tra cui anche tanti cittadini di fede islamica. Tutte voci scomode e contrastate.

Dunque quello che rimane di un grande e importante paese sta vivendo oggi una crisi democratica e civile estremamente preoccupante, anche considerando il ruolo geopolitico che la Turchia svolge a livello internazionale. Una crisi che l'Europa e la sua diplomazia non possono ignorare. E c'è anche da chiedersi, in questo quadro, se è possibile proseguire nella gestione esternalizzata di un pezzo dei nostri confini, affidando alla Turchia la gestione, nei fatti, di una parte della vicenda dei profughi senza alcuna garanzia di umanità o di rispetto dei diritti umani.

След десетилетия на нарушаване на човешките права, на арестуване на журналисти, на вкарването им в затвора, след като се меси във вътрешните работи на много държави, включително на България, след като е ясно на всички, че г-н Ердоган е чисто и просто един диктатор, най-сетне в тази зала открихте, че той нарушава човешките права. Както се казва, забележителен политически нюх! Поздравления!

Както е казал мъдрият български народ „По-добре късно, отколкото никога“. Да, Ердоган е диктатор. Да, нарушава изборните права. Да, вкарва журналисти в затвора. Всички го знаем това нещо и продължавате да му давате пари. Милиарди се изсипаха в Турция, за да може той да продължава да върши тези неща – милиарди европейски пари, пари на европейските данъкоплатци. Това е странно лицемерие, неразбираемо за мен.

Давам Ви още един пример. В момента един голям немски концерн, „Фолксваген“, преговаря с Турция да изнесе завода си там – при нарушаването на човешките права, при незаконната държавна помощ, при това, че Турция замърсява въздуха и не спазва никакви екологични норми. Отново европейски концерн ще излее милиарди там. Това е недопустимо, нередно. Това е лицемерие и двоен стандарт.

  Stanislav Polčák (PPE). – Pane předsedající, i já se připojuji v odsouzení tohoto jednání, tedy sesazení demokraticky zvolených starostů v Turecku, ke svým kolegům. Myslím, že jsme svědky širšího jevu porušování základních lidských práv v Turecku. A je třeba říci, že Turecko se zavázalo tato práva dodržovat, je stranou Úmluvy o ochraně lidských práv a svobod v rámci Rady Evropy. Namísto toho, aby dodržovalo tato základní lidská práva, tak vidíme falešná obvinění, jsme svědky odsouzení a samozřejmě porušování těch nejzákladnějších práv, nejen těch, o kterých jsem zde hovořil, ať je to svoboda projevu, právo na zákonný soud, ale samozřejmě i porušování práv na samosprávu. Turecko rovněž podepsalo Chartu místní samosprávy, která je součástí okruhu Rady Evropy. V rámci Rady Evropy jsou ty nástroje, jak mohou tlačit státy v rámci Rady Evropy na Turecko, omezené. Ale my ty nástroje máme a pojďme se je zkusit použít.

  Julie Ward (S&D). – Mr President, the removal of three recently elected HDP mayors by the Turkish authorities follows a previous two-and-a-half-year-long government appointed trustee rule in Kurdish municipalities, which not only severely circumvented local democracy, but also devastated municipal infrastructures with embezzlement, cronyism and bribery. Since their election in May, the HDP mayors had worked to bring their municipalities back to a functional state by paying debts and restoring essential services, including the payment of workers’ salaries.

I am proud to be a friend of HDP. I have visited Diyarbakir many times and I was shocked to see the militarisation of the city under AKP administration, the town hall surrounded by razor wire and barricades, and armoured vehicles and soldiers everywhere. I tried to imagine if this was my city and I was simply trying to pay my council tax; we would be outraged. These communities need our solidarity, which is why I’m encouraging Labour mayors to join a twinning project with Kurdish mayors. As the removed mayors say, ‘We feel empowered when we hear voices of solidarity from across borders’.

  Manu Pineda (GUE/NGL). – Señor presidente, las alcaldías de Diyarbakir, Van y Mardin han sido intervenidas por el Gobierno de Erdogan. Para apuntalar su régimen se destituye y encarcela a alcaldes, activistas de izquierdas, feministas, maestros críticos y cualquier forma de disidencia. Y todo esto ocurre con el silencio cómplice de la Unión Europea.

Solo para la gestión de fronteras hemos entregado más de dos mil millones de euros a Erdogan. La cifra es más alta si incluimos los fondos de vecindad y los propios fondos que recibe como candidato a entrar en la Unión Europea. Y esta ayuda tiene un añadido claro: que la Unión Europea mire hacia otro lado cuando el Gobierno de la AKP ataque los derechos de la mayoría.

Es imprescindible que toda la cooperación de la Unión Europea con Turquía, incluidas las negociaciones de acceso a la Unión, se congelen hasta que Turquía cumpla con los estándares más básicos de derechos humanos, empezando por la liberación de todos los presos políticos.

Mientras la Unión Europea siga poniendo sus intereses económicos o sus políticas migratorias xenófobas por encima de los derechos de los pueblos turco y kurdo, ni este Parlamento ni ninguna institución comunitaria podrán dar lecciones de derechos humanos a Erdogan.

  Marianne Thyssen, Member of the Commission. – Mr President, I would like to thank honourable Members for this timely debate, which unfortunately proves that the concerns previously discussed in this plenary on the rule of law situation in Turkey are still relevant.

Turkey’s local elections in March and June witnessed a voter turnout that the people of Turkey can rightly be proud of. However, ensuring that democracy goes well beyond the balloting process on voting day requires a political environment with freedom of expression and respect for plurality. It is central that elected representatives are able to exercise their political mandate freely and without fear of repression, dismissal or detention.

Following the March elections, we saw the decision to declare elected mayors ineligible to assume office and to give mayoral mandates to the candidates with the second highest number of votes. As High Representative Mogherini and Commissioner Hahn expressed, this undermines the electoral process and goes against the core aim of ensuring that the will of the people prevails. The respect for democratic outcomes was further put into question with the suspension last month of the mayors of the cities of Mardin, Van and Diyarbakir, who were replaced by state governors. This deprives voters of political representation at local level and seriously damages democracy.

Turkey must repeal measures that inhibit local democracy. This follows clearly from the recommendations of the Venice Commission and from Turkey’s obligations as a member of the Council of Europe. As we have said to the Turkish authorities multiple times, we are conscious of Turkey’s security challenges and its right to fight terrorism. However, those security challenges cannot justify dismissals for political reasons, applying broad anti-terror or criminal legislation.

Unfortunately, the negative developments in the rule of law are not limited to the recent local elections. There are still a large number of journalists, writers, academics, politicians and human rights defenders in detention in Turkey, for instance, Osman Kavala, who has been detained for almost two years, or Selahattin Demirtaş whose case was heard yesterday by the Grand Chamber of the European Court of Human Rights. We’ve also seen a dramatic increase in prosecutions for insulting the President, as exemplified by the case of Canan Kaftancioğlu.

The European Union has consistently called upon Turkey to ensure the respect of fundamental freedoms in accordance with Turkey’s obligations as a candidate country and as a member of the Council of Europe. This is not just about Turkey’s status as a candidate country. It is also about the kind of country Turkish citizens want and deserve, a country with stronger institutions, a more inclusive country and a country where they can all find their place and contribute to Turkish society’s collective progress.

In the European Union we will continue to work to support a strong, free, safe, prosperous and democratic Turkey as a key neighbour and partner in our region, not just as a candidate country. It is in our shared interest to contribute to this and all Turkish citizens should know that they can count on the European Union.

  Monika Beňová (S&D), in writing. – The Turkish Interior Ministry’s removal of three democratically elected mayors in the major municipalities of the Kurdish regions due to terrorism-related charges is worrying. All three mayors were active members in People’s Democratic Party (HDP), an opposition party to the ruling government. The motive of the violation of the rights of these mayors remains unclear. Nonetheless, it fits well into the pattern of persecution and consolidation of power against the Kurdish population and opposition to the standing government. The Turkish authorities made a regrettable decision, which stands as a demonstration of ignorance of free and fair expression of the will of the Turkish people. The countries around the world and the EU, call on the Turkish authorities to reinstate the mayors of Diyarbakır, Van and Mardin, if the charges against them are proven unfounded. The mayors must be afforded fair a due legal process.

  Bettina Vollath (S&D), schriftlich. – Die Lage in der Türkei bereitet Sorgen; die Türkei hat den Pfad der Demokratie verlassen. Das willkürliche Vorgehen gegen demokratisch gewählte Bürgermeisterinnen und Bürgermeister ist mit der Europäischen Menschenrechtskonvention nicht vereinbar, sondern stellt vielmehr einen klaren Bruch der Europäischen Menschenrechtskonvention dar. Auch die Türkei hat die Urteile des Europäischen Gerichtshofs für Menschenrechte zu befolgen. Schockierend ist, dass der Oppositionsführer und Präsidentschaftskandidat Selahattin Demirtaş nach wie vor in Haft sitzt – ein Justizskandal, den das Europäische Parlament heute mit der Entschließung deutlich kritisiert hat.

  Ryszard Czarnecki, autor. – Panie Przewodniczący! Pani Komisarz! Zabieram głos jako współautor tej ważnej rezolucji, rezolucji, która jest ponad podziałami. Ja niedawno, kilka miesięcy temu, spotkałem się z panią premier Bangladeszu Sheikh Hasiną Wajed. Mówiliśmy o tym, że to biedne, choć wielkie (większe niż Rosja w sensie demograficznym) państwo przyjęło setki tysięcy uchodźców właśnie ludu Rohingja z Mjanmy. Jest to więc problem nie tylko Mjanmy/Birmy, ale także krajów sąsiednich. Myślę, że dzisiejszy nasz głos w tej sprawie jest potrzebny, jest ważny, będzie na pewno słyszany. Jest to zresztą kolejna rezolucja Parlamentu Europejskiego w tej sprawie, ale nie dość nigdy mówić o prawach człowieka i o respektowaniu rzeczy zupełnie fundamentalnych, jak prawo do wyznawania własnej wiary.

  Heidi Hautala, author. – Mr President, this is not the first time this House has debated the situation of the Rohingya in Myanmar, has called for a stop to the human tragedy, and urged the world to take action. This is not a crisis that began with the exodus in August 2017: over a million Rohingya refugees have fled violence in Myanmar in successive waves of displacement since the early 1990s. The vast majority of those who have fled and reached Bangladesh are women and children, and more than 40% are under age 12. Many walked for days through the forest to reach safety, including pregnant women, young children, the sick and the elderly.

Too many children are growing up in Kutupalong and Nayapara refugee camps in the Cox’s Bazar district. The refugee settlement has become the largest refugee camp in the world, with more than 600 000 people living in an area of just 13 km2. For many children, those are the only places they have ever known, and they are vulnerable to disease and lack sufficient access to education. This is heart—breaking. The world that is watching owes these children a duty of care.

We all remember that in 2018 the UN independent fact—finding mission concluded that crimes against humanity and possibly genocide had been committed against the Rohingya. In its further report in 2019 the UN fact—finding mission reported severe ongoing sexual and gender—based violence, including systematic rape, gang rape and forced sexual acts by the Myanmar military and security forces against Rohingya women, children and transgender people. Yet, the authorities in Myanmar refused to investigate seriously human rights violations against Rohingya and to hold the perpetrators accountable.

Not only that, Myanmar continues to deny that these rights violations ever occurred in the first place – claims that are contradicted by extensive good-quality evidence and individual witness accounts. The highest-ranking military, who supervised the attacks against the Rohingya population, remain in their posts. Myanmar has so far refused to allow a UN Human Rights Council fact—finding mission to enter the country. Despite the Government of Myanmar having withdrawn cooperation with the UN special rapporteur, the special rapporteur continues to seek to engage and assist with human rights issues.

So it is high time for action.

The Council has prolonged its restrictive measures in place in Myanmar for one year. These measures include asset freezes and travel bans on 14 senior military and other security officials of Myanmar. The decision of the International Criminal Court to open a preliminary investigation into crimes, under the court’s jurisdiction, committed against the Rohingya population is a welcome step towards accountability. Peace does not come without justice. The perpetrators of these most serious crimes must be held accountable.

  Neena Gill, author. – Mr President, since hundreds and thousands of Rohingya were forced out of their homes through mass atrocities and repeated acts of humiliation and violence in Myanmar, nearly one million people are still living in camps in Cox’s Bazar, struggling for safety, survival and dignity as refugees in Bangladesh. More than 25 000 children are out of school and 97% of those aged 15 to 18 do not attend any type of educational facility. They need our action and our support now more than ever.

Sadly their plight has fallen down our list of priorities, and, as one of the instigators of this resolution, I urge the EU: we must find a solution and end this crisis. Bangladesh cannot be left alone to cope with large numbers of refugees. We have to engage in dialogue with our partners in the Association of Southeast Asian Nations (ASEAN) to ensure the Rohingya people’s rights are upheld, so they can start living their lives normally, where women and girls are safe and children have access to education.

  Urmas Paet, author. – Mr President, the latest UN fact-finding mission on Myanmar warned that the approximately 600 000 Rohingya who remain in Myanmar live under the threat of genocide. The crimes against humanity and war crimes against ethnic communities by the Myanmar army continue, and the army and the Government enjoy impunity for their crimes.

The Rohingya in Myanmar are being discriminated against and denied their basic rights, and are subjected to arbitrary arrests, lack of freedom of movement and limited health care. The more than 700 000 Rohingya refugees in Bangladesh, who have fled the violence and genocide in Myanmar, are also facing serious problems as the refugee camps are overcrowded, have unsanitary conditions and provide limited access to maternal and health care for women and children. The children lack access to education and there is a rising problem of human and sex trafficking.

EU and other international organisations must work towards gaining access to the conflict areas and places of segregation in Myanmar, in order to deliver aid and to monitor the situation on the ground. We must continue stressing the need for Myanmar to give citizenship and full civil rights to the Rohingya. Investigation of the human rights violations must take place and perpetrators must be held accountable. The EU must seriously consider using the tools it has – by way of extending entry bans, targeted sanctions and freezing of assets – to influence the Myanmar Government and military to stop these atrocities, and should finally review the trade preferences that benefit Myanmar.

  Marisa Matias, Autora. – Senhor Presidente, também como autora desta resolução quero sublinhar a importância de o Parlamento Europeu se manifestar em relação ao que tem sido a violação dos direitos humanos do povo rohingya, mas também a violência sexual contra mulheres e crianças.

É uma questão fundamental e, denunciar, é efetivamente importante. Mas a União Europeia tem que fazer mais do que denunciar e, por isso, eu apelo aos colegas que, por favor, reconsiderem novamente o que não consideraram nas negociações desta resolução conjunta, que é levar em conta o relatório da missão internacional e independente que refere e insta a comunidade internacional a pôr termo às relações com as forças militares do Mianmar, mas também com a vasta rede de empresas que estas forças controlam e das quais dependem.

Esta missão internacional considera que as receitas que estas forças militares obtêm, através de acordos comerciais nacionais e estrangeiros, reforçaram, de forma significativa, a sua capacidade de cometer impunemente violações graves dos direitos humanos.

A União Europeia tem relações preferenciais no nível comercial. Os direitos humanos não estão à venda. Por favor, apelo-vos. Incluam isto, porque mais que denunciar é assumir a responsabilidade.

  Tomáš Zdechovský, Autor. – Pane předsedající, paní komisařko, dovolte mi vyjádřit jednu věc. V oblasti lidských práv je Evropská unie motorem a je motorem celého světa. Neznám totiž žádnou demokratickou instituci, která by se tak často vyjadřovala k lidským právům a apelovala na vyšetření válečných zločinů, jako je např. Evropský parlament a další evropské instituce. A proč to děláme? Protože nám nejsou lhostejné osudy desítek nebo stovek tisíců lidí, kteří dnes trpí v Myanmaru. Toto není první rezoluce, je to několikátá rezoluce. A já musím říct, že za Evropskou lidovou stranu velmi často vyjednávám podobné lidskoprávní rezoluce, ale málokdy se ty strany tak na všem shodnou, jako bylo v případě této rezoluce, která naprosto jasně apeluje – my chceme vyšetření zločinů, kterých se dopouští myanmarští vojáci na Rohingyích. My chceme opravdu řešit situaci stovek tisíců lidí, kteří dnes jsou bez jakéhokoliv vzdělání, kteří jsou bez jakékoliv pomoci, kteří jsou v otřesných podmínkách někde na ostrovech nebo v částech, které jim vyhradily okolní státy. My chceme, aby se ta situace už nadále nezhoršovala. Chceme otevřený dialog, který se možná myanmarské vládě nebude líbit, ale chceme s ní hovořit o řešení této humanitární krize a o celé situaci, a proto apelujeme na Evropskou komisi, která má ty účinné nástroje v ruce, aby skutečně se situací Rohingyů začala něco dělat. Aby byla tím motorem, který k sobě vezme další státy a zkusí vytvořit něco, co tuto situaci začne po sedmi letech konečně řešit.

  David Lega, on behalf of the PPE Group. – Mr President, since 2000 more than 700 000 of the Rohingya people have been forced to abandon their homes in Myanmar to become refugees in Bangladesh, and we know that the armed forces continue to cause widespread terror in the Rohingya community through committing appalling human rights violations. These include killings burnings of villages and systematic gender-based violence. We know that the Myanmar authorities enabled these crimes by continuously turning a blind eye and by refusing to hold those responsible accountable.

By creating telecommunication blackouts in the northern and central parts of Rakhine state, making media coverage and access impossible, and by refusing to collaborate with UN mechanisms. And we also know that approximately 40% of the Rohingya refugees situated in camps in Bangladesh are children, who are now forced to grow up in overcrowded refugee camps, without hope and without a future. I myself did a field trip to Myanmar together with UNICEF two years ago, and without access to formal education the future of Rohingya children is disappearing right before their eyes. The politicians of Myanmar are not protecting the Rohingya people either. Mr President, we all know the saying, ‘all it takes for evil to triumph is for good men to do nothing’.

Last century Europe suffered the horrible consequences of the Holocaust, when good men did nothing. In the case of the Rohingyas, the politicians of Myanmar need to do more and we need to do more.

  Maria Arena, au nom du groupe S&D. – Monsieur le Président, ce lundi, les experts de la mission des Nations unies présentaient un rapport qui confirme que 600 000 Rohingyas vivent sous la menace d’un génocide au Myanmar.

Il y a un an, ces mêmes experts faisaient état d’actes génocidaires à l’égard des Rohingyas. Depuis août 2017, 740 000 Rohingyas ont dû fuir le Myanmar pour le Bangladesh. Les Rohingyas, aujourd’hui, représentent la minorité la plus persécutée au monde et le plus grand groupe apatride.

Mettre en lumière ces injustices, nous en avons beaucoup parlé, est bien entendu important. Mettre en lumière ces crimes est important pour nous, mais ce n’est pas suffisant.

Nous appelons donc à ce que l’Union, mais aussi la communauté internationale, plaide pour que les responsables de ces crimes répondent de leurs actes. Nous appelons à ce que l’Union et la communauté internationale puissent prendre des sanctions, notamment à l’égard des 100 officiers impliqués dans ces crimes et cités dans le rapport des Nations unies. Nous appelons à revoir la relation commerciale avec le Myanmar, à la lumière de ce crime contre l’humanité.

  Phil Bennion, on behalf of the Renew Group. – Mr President, the Rohingya are one of the ethnic and religious groups in Myanmar that were not given official status as an ethnic identity, and, as a result, not issued with identity documents. Since 2011, the ethnic conflict with the Rohingya, fuelled by religious and ethnic leaders, has been escalated by the Myanmar military, who are not under the control of the Government.

Allegations of crimes against humanity and ethnic cleansing have been raised by the UN Secretary-General, and in 2017 I also brought the issue to the executive of Liberal International through an urgency resolution. The cooperation and support of Bangladesh has been welcomed, but I have felt it necessary this week to complain to the Bangladeshi Ambassador about recent restrictions to rights and freedoms at the camp in Cox’s Bazar.

I believe that the Rohingya should have full rights to citizenship in Myanmar. It has been their home and country for generations. They can’t possibly be asked to state that they are foreigners. The return of the Rohingya refugees and internally displaced persons in a safe and dignified manner, as citizens of Myanmar, the reconstruction of their villages and the restitution of their land are all imperative. I want to see the Myanmar Government fulfil its obligations under international law to protect all individuals on its soil, whatever their race or religion.

  Nosheena Mobarik, on behalf of the ECR Group. – Mr President, the Rohingya tragedy is becoming another of the many unresolved human rights issues which the UN can add to its list. Bangladesh, clearly struggling with its own challenges, has been left with the fallout of its neighbour’s ghastly actions. The process of proof of identity – cataloguing that of refugees – has resulted in 3 450 people being given approval by the Myanmar authorities to return. At this rate, it would take Bangladesh hundreds of years to get through close to a million displaced people on their doorstep, and those identified would have to be willing to return without a guarantee of their safety and security.

The UN must take meaningful measures to restore the basic human rights and freedoms of the Rohingya, whose ancestors have lived in Rakhine State for close to 1 000 years, and those guilty of crimes against humanity must be brought to justice. I call on this House to stand by our principles and support this resolution.

  Julie Ward (S&D). – Mr President, two years on and time stands still for over a million persecuted Rohingya refugees who are unable to return to a land that is their home, after the violence they have faced. The recently failed attempt to repatriate refugees to Myanmar demonstrates the inadequacy of the return conditions. The Myanmar Government must create conditions that can enable safe, dignified and voluntary returns.

According to the International Rescue Committee, there are a million Rohingya refugees surviving purely on humanitarian aid. So I urge the EU and the international community to create a medium—term plan to deal with the impact of this crisis, and to call on Myanmar to address the root causes, including systematic persecution and violence. There must be no military impunity for the grave human rights violations committed against the Rohingya community. There must be sustainable conditions to enable the community to thrive, and not merely to survive, after the suffering they have faced.

Finally, I’d like to pay tribute to my Labour colleagues Afzal Khan and Wajid Khan for all their work on this issue.

  Adam Bielan (ECR). – Panie Przewodniczący! Niewątpliwie największą prześladowaną grupą religijną na świecie są chrześcijanie. Prześladowania chrześcijan obejmują już w tej chwili 128 państw. Parlament Europejski dotąd zajmował się – i mam nadzieję, że w tej kadencji jeszcze bardziej intensywnie będzie się zajmował – obroną praw chrześcijan, ale jeżeli chcemy być wiarygodni w obronie praw chrześcijan, musimy zwracać uwagę również na prześladowania innych grup religijnych. Niewątpliwie jedną z najbardziej prześladowanych grup religijno-etnicznych jest lud Rohingja. Prześladowania, które rozpoczęły się kilkadziesiąt lat temu, niestety są również kontynuowane po okresie demokratyzacji Mjanmy. Wszyscy liczyliśmy, że po 2015 roku, kiedy Narodowa Liga na rzecz Demokracji przejęła władzę w Mjanmie, te prześladowania ustaną. Niestety ponad 700 tysięcy osób zostało wypchniętych z Mjanmy do Bangladeszu już od 2017 roku, a 600 tysięcy, które pozostało w Mjanmie, wciąż jest prześladowanych.

Mjanma jest potencjalnie bardzo bogatym krajem ze względu na złoża, bogactwa naturalne. Jest również geostrategicznie niezwykle ważnym krajem, stąd nasilona aktywność takich potęg światowych jak Chiny, Rosja, Stany Zjednoczone i Unia Europejska, ale Mjanma nie wróci na należne jej miejsce w społeczności międzynarodowej, jeżeli nie rozwiąże tego problemu.

  Caterina Chinnici (S&D). – Signor Presidente, onorevoli colleghi, l'ufficio del procuratore presso la Corte penale internazionale dell'Aja nel luglio scorso ha avviato la procedura per indagare su crimini contro l'umanità proprio con riferimento alla situazione dei rohingya in Myanmar, che rappresenta una fra le peggiori crisi umanitarie nella quale, ancora una volta, i bambini sono i più colpiti.

Secondo l'UNICEF, a luglio 2019, oltre 500 mila bambini rohingya si trovavano rifugiati in Bangladesh in condizioni igienico-sanitarie disastrose, esposti al rischio di violenze, sfruttamento e abusi di ogni genere.

Fin dagli anni '90 molti bambini rohingya nati in Myanmar non hanno ricevuto alcun certificato di nascita, in piena violazione della convenzione ONU sui diritti sul fanciullo, che pure il Myanmar ha firmato. Una negazione dei diritti civili che comporta l'impossibilità di ottenere documenti d'identità, di avere accesso all'assistenza sanitaria e all'istruzione e che crea ostacoli anche nell'accesso allo status di rifugiato, rischiando quindi di creare una generazione di ghost children.

L'Unione europea deve quindi intervenire con fermezza per garantire alla popolazione dei rohingya il pieno rispetto dei diritti fondamentali.

W poniedziałek opublikowany został raport przygotowany przez niezależnych ekspertów ONZ, w którym znalazły się bardzo niepokojące informacje dotyczące sytuacji ludności Rohingja w Mjanmie. Zagrożenie ludobójstwem tej części ludności, która została jeszcze na terenie kraju, wydaje się być większe niż kiedykolwiek. Autorzy raportu konkludują też, że do tej pory rząd Mjanmy nie zrobił nic, by przerwać krąg przemocy.

Dlatego też społeczność międzynarodowa na czele z Unią Europejską, ONZ i organizacjami humanitarnymi musi podjąć wspólne, skoordynowane działania, aby nałożyć silną presję na tych, którzy odpowiadają za zbrodnie i prześladowania. Muszą oni zostać pociągnięci do odpowiedzialności i odpowiedzieć przed wymiarem sprawiedliwości za swoje czyny. Ponadto organizacjom humanitarnym oraz organizacjom obrońców praw człowieka powinno się jak najszybciej zapewnić dostęp do kraju, aby mogły nieść pomoc potrzebującym oraz monitorować sytuację na miejscu.

Bavíme se o vyhánění lidí, jejich ponižování, porušování základních lidských práv a páchání zločinů proti lidskosti. Dnes je ohroženo více než 600 000 lidí jednáním, které se skutečně ocitá na hranici genocidy. Je to bezprecedentní situace a myslím si, že my musíme pomoci za prvé Bangladéši, který na svém území hostí 1 milion lidí, a to ve spolupráci s organizací ASEAN. Samozřejmě musíme žádat okamžitou pomoc pro uprchlíky, vyšetření těchto zločinů a žádat o rychlou akci právě evropské instituce, protože v jednání s Myanmarem musí náš hlas jednoznačně zaznít a zaznít tak, že tyto zločiny proti lidskosti budou vyšetřeny a viníci budou hnáni ke spravedlnosti.

  Marianne Thyssen, Member of the Commission. – Mr President, it has been over two years since the horrible events in the Rakhine State of Myanmar forced more than 750 000 Rohingya to flee to Bangladesh. There are now more than one million Rohingya refugees in Cox’s Bazar, making it the largest refugee camp in the world.

This is a major refugee crisis with a significant risk of radicalisation inside the camps. The situation inside the camps is deteriorating. More than 500 000 children remain without access to education. The prospects for a rapid return of the refugees into Myanmar, in a safe, dignified and voluntary manner, are increasingly unlikely. This was shown by the failure of the recent second attempt for the repatriation of 3 450 refugees, since no one agreed to return to Myanmar due to the lack of conditions conducive for returns.

The situation, in addition to being an urgent humanitarian crisis, is evolving into a longer-term political and security challenge. Therefore, we need to intensify discussions on the prospects for refugees, the Cox’s Bazar security situation, the livelihood and education opportunities in the camps, the access to health and justice, the impact on the host communities and, of course, the Joint Response Plan funding.

The European Union will continue to call for sustainable solutions for the Rohingya, and for the Myanmar authorities to ensure that conditions are met for safe, dignified and voluntary returns. This can be achieved only by implementing the recommendations of the Advisory Commission on Rakhine State, which the Government of Myanmar has endorsed. These issues were raised with the Myanmar Government at the Human Rights Dialogue held in Yangon in June 2019, co-chaired by the EU Special Representative for Human Rights, Eamon Gilmore.

Within the ongoing Everything But Arms enhanced monitoring, and all relevant bilateral meetings, the European Union is urging Myanmar to contribute to the creation of conditions conducive to the safe, voluntary and dignified return of Rohingya refugees to their place of origin.

At the same time, the European Union will continue advocating for the accountability of those who have committed serious abuses of human rights. The Union has already imposed restrictive measures on 14 individuals and will continue to review regularly the sanctions regime.

In conclusion, the European Union will continue to help alleviate the plight of the Rohingya in Bangladesh and will keep engaging with the Myanmar authorities to facilitate their return.

  Dominique Bilde (ID), par écrit. – La situation des Rohingyas constitue une crise humanitaire majeure, puisque 740 000 Rohingyas ont fui vers le Bangladesh et quelque 276 000 vivraient dans des camps.

Au-delà de l’émotion que suscite naturellement ce drame, il importe d’aborder cette question sous l’ensemble de ses aspects, sans nier, en particulier, l’influence croissante de l’islam radical sur cette population. Le leader même de l’État islamique n’avait-il pas en 2014 qualifié la région de Rakhine de clef pour le djihad ?

Il est évident que l’Union européenne, qui accorde une aide au développement, une aide humanitaire ainsi que des préférences commerciales au Myanmar, a un certain droit de regard sur les violations des droits de l’homme dans ce pays. Il s’agit non seulement des Rohingyas, mais aussi des chrétiens, qui selon un rapport de la commission sur la liberté religieuse internationale des États-Unis en 2016, subiraient eux aussi un certain nombre de vexations.

En juillet dernier, un pasteur protestant ayant témoigné auprès du président américain Donald Trump aurait par ailleurs fait l’objet de poursuites dans son pays. C’est donc l’ensemble de ces éléments qu’il convient de considérer sans parti pris, et en ayant à cœur le soutien aux victimes.

  Anna Fotyga, author. – Mr President, I pay tribute to the women of Iran, to their courage, resolve and determination, not only in the fight for women’s rights, but also in speaking out in defence of the whole society against the regime. One of the major opposition movements in Iran, the National Council of Resistance of Iran, is led by a woman as well.

Recently, many women were sentenced to a long time in prison for just protesting against the compulsory wearing of the hijab, but also women with dual nationality, both EU and Iranian, as well, arm in arm with men, are suffering because of persecution there. We appeal for their immediate release.

  Hannah Neumann, Verfasserin. – Herr Präsident, Kolleginnen und Kollegen! Viele von Ihnen kennen diese Tradition sicherlich, am Internationalen Frauentag, dem 8. März, Blumen an Frauen zu verschenken. Es ist ein friedliches – ich muss sagen, mir selber manchmal zu friedliches – Zeichen für die Rechte der Frauen. Eigentlich – denn am 8. März dieses Jahres haben Frauen im Iran, in Teheran, in der Metro Blumen verschenkt.

In Teheran sind in der Metro das erste und das letzte Abteil für Frauen reserviert, und drei Frauen nahmen dort ihren Schleier ab und haben ihr Anliegen sehr deutlich zum Ausdruck gebracht. Sie haben gesagt: Ich hoffe, dass wir mit und ohne Schleier eines Tages gemeinsam auf der Straße in Teheran im Iran marschieren können, denn im Iran ist genug Platz für alle IranerInnen da. Man sieht auf einem Video, das in den sozialen Medien geteilt wurde, wie Frauen mit und ohne Schleier sich umarmen, wie es Applaus gibt. Die Spannung und auch ein Gefühl des Aufbruchs sind richtig zu spüren.

Und was war die Reaktion des iranischen Regimes? Inhaftierung, Schikane, Gefängnis bis zu 24 Jahren. Und das ist nicht der einzige Fall. Nasrin Sotudeh, die von uns hier im Parlament den Sacharow-Preis bekommen hat, wurde selbst zu 33 Jahren und 148 Peitschenhieben verurteilt, weil sie Frauen wie die in der Metro vor Gericht verteidigt hat.

Eines zeigen uns diese Strafen ganz deutlich: Das iranische Regime fühlt sich von diesen mutigen Frauen bedroht.

Ja, die Lage in der Region ist wahrlich kompliziert, und sie wurde in den letzten Tagen nochmal komplizierter. Aber ich finde, gerade dann, wenn das mit Gut und Böse nicht so einfach ist, müssen wir hier an der Seite der Menschen stehen, die sich für Menschenrechte starkmachen, die im Iran gegen Diskriminierung von Frauen kämpfen, wie die Frauen in der Metro, gegen Diskriminierung wie ein ungerechtes Scheidungssystem, wie sexuelle Gewalt. Und da gibt es noch so viel anderes Unrecht.

Wenn anderswo die Rechte von Menschen missachtet werden, dann dürfen wir hier in diesem Haus nicht schweigen. Deswegen: Lasst uns gemeinsam nachher für diese Entschließung und für die Frauen im Iran unterzeichnen!

  Jytte Guteland, författare. – Herr talman, fru kommissionär! Förra veckan fylldes av rapporter om Sahar Khodayaris hemska och fruktansvärt onödiga död till följd av skadorna efter att ha tänt eld på sig själv. Hon gjorde det i desperation efter att ha blivit gripen och riskerat brutalt fängelsestraff när hon ville se en fotbollsmatch, något som är så naturligt och som alla människor skulle ha rätt till. Det är en sådan fruktansvärt tragisk händelse och min solidaritet och vårt parlaments solidaritet med hennes familj är där i dag. Vi tänker på henne.

Debatten i dag handlar om situationen för kvinnorättskämpar och om fängslade EU-medborgare med dubbla medborgarskap i Iran. Vi skickar nu ett tydligt budskap om att situationen för kvinnor som kämpar för mänskliga rättigheter i Iran måste förbättras. Många har blivit fängslade endast för att de har stått upp mot diskrimineringen. Vi talar om fall där det är människorättskämpar, kvinnorättsförsvarare, advokater, journalister, fackliga aktivister och miljöaktivister som sitter fängslade utan rättegång år efter år, månad efter månad med ett stort lidande som följd. Vi tar upp fallen med Mojgan Keshavarz, Nasrin Sotoudeh och Narges Mohammadi. Vi upprepar vårt tydliga krav om att Ahmad Reza Jalali och andra fängslade personer med dubbla medborgarskap omedelbart måste friges och att man måste få en rättvis behandling.

  María Soraya Rodríguez Ramos, autora. – Señor presidente, debatimos una Resolución de urgencia para pedir la inmediata liberación de todas las mujeres activistas condenadas en Irán y también para que sean liberados los ciudadanos con doble nacionalidad europea e iraní, que están ahora mismo en condiciones dramáticas en las cárceles de Irán, sin comunicación ni acceso con sus abogados ni con sus familias.

Las tres últimas mujeres condenadas lo fueron por un vídeo que se hizo viral el pasado 8 de marzo, en el que, quitándose el velo, repartían flores y decían a las mujeres que ojalá pudieran caminar juntas en Irán, unas con velo, otras sin él, pero fruto de una decisión libre y propia. Este fue su delito, un delito considerado como atentado contra la seguridad nacional, por el que han sido condenadas a más de veintitrés años de cárcel, en un juicio sin garantías, sin tener acceso a la elección de abogado.

Las autoridades iraníes han abierto una verdadera campaña de acoso y persecución contra las mujeres activistas, contra las abogadas que defienden sus derechos, contra las periodistas que difunden sus actos. Y ellas han dicho que van a seguir hacia adelante, que sienten que ya llevan demasiado tiempo viviendo en una cárcel: lo que es su país para ellas. Que van a defender su derecho, su libertad y el futuro de sus hijas.

Por eso, hoy es importante que este Parlamento lance un mensaje muy claro. Por una parte, a la Comisión, para decirle que, en el diálogo político con Irán, la Unión Europea debe tener una prioridad política, que es la defensa de los derechos humanos, de las mujeres y de las niñas iraníes. Pero también un mensaje muy claro a las mujeres iraníes, para decirles que no están solas, que el Parlamento Europeo está con ellas y que vamos a estar con todas las que están hoy resistiendo, en las cárceles y en las calles.

  Željana Zovko, author. – Mr President, the Iranian authorities continue to criminalise human rights activism. Journalists, lawyers and activists are constantly facing harassment, arrests and prosecution for their peaceful work.

With this resolution, the European Parliament is calling upon Iran to suppress all these sentences and immediately and unconditionally release all human rights defenders and all EU-Iran dual nationals who are arbitrarily detained.

Three Iranian women appeared in a video while protesting against the compulsory wearing of veils. The protest was peaceful and advocated for women’s right to choose whether to wear the hijab or not. These three women have been convicted and sentenced to between 16 and 23 years’ imprisonment. The authorities reasoned that they were acting against national security and promoting moral corruption and prostitution. This case is a clear example of an extremely disproportionate punishment. Moreover, these women were arrested although they were solely exercising their right of freedom of expression – one of the core rights of every human being.

In another case, an Iranian woman set herself on fire in protest at her arrest because she wanted to watch a football match in a stadium. Besides this violation of women’s rights, the joint resolution also reacts to Iranian measures taken against several EU-Iran dual nationals. These persons have been arrested on the basis of vague or unspecified charges and sentenced without a fair trial. It is clear that Iran is severely violating human rights, and we – as a democratic body that represents those imprisoned European citizens – have a moral duty to support them and to react in a resolute manner.

This House is constituted to protect all European citizens wherever they are. Iran is one of the founding states of the United Nations, and has ratified multiple legally binding treaties under international law, focusing on respect for human rights. However, reality shows that they don’t respect these obligations. With this resolution, we urge the Iranian authorities to halt their repressive actions and to implement the internationally agreed standards.

Colleagues, please show your support for these arbitrarily imprisoned women and European Union citizens, and send a strong message to the authorities in Iran.

  Cornelia Ernst, Verfasserin. – Herr Präsident, meine Damen und Herren! Ich dürfte eine der wenigen Abgeordneten hier sein, die die Menschenrechtsaktivisten und Anwältin Nasrin Sotudeh in Teheran kennenlernen durfte – 2013 nach ihrer Entlassung. Drei Jahre später wurde sie wieder verurteilt und 2018 wieder verhaftet. Im März 2019 erhielt sie nun das Urteil: 33 Jahre Haft dafür, dass sie Frauen, die den Kopftuchzwang ablehnen und dagegen protestiert haben, unterstützt hat.

Angesichts solcher Schandurteile dürfen wir nicht schweigen! Egal, was sonst im Iran passiert: Wir dürfen nicht schweigen! Internationale Solidarität braucht jede einzelne dieser verhafteten Frauen – auch die, deren Namen wir nicht kennen.

An die Adresse der iranischen Regierung will ich eigentlich nur eines sagen: Man kann den zivilisatorischen Fortschritt auf Dauer nicht beiseiteschieben, man kann ihn nicht aufhalten. Man kann ihn verzögern, man kann dessen Repräsentantinnen einsperren, man kann sie mundtot machen – das kann man alles tun, aber die Idee von Freiheit und Gleichheit, die kann man nicht ausrotten – weder per Gesetz noch mit Gewalt.

Das ist so, weil uns das als Menschen ausmacht, unsere universellen Rechte begründet. Ob in meiner Heimatstadt Dresden, ob in Hongkong oder Teheran – die Zukunft des Irans sind die Frauen, niemand sonst, und daran wird auch ein Revolutionsführer nichts ändern.

Crimes punished there that are not crimes in our world. Traditionally Shia societies prided themselves on being more liberal than some other creeds, but today Iran is a country which executes one of the greatest numbers of its citizens, while its justice system doesn’t meet any criteria that we would recognise.

Medieval mullahs pass harsh sentences on people who, according to our standards, have not committed crimes at all. I think I am right in saying that Iran has the death penalty for homosexuality, for example. So I would like to associate myself fully with all the voices that have been heard here in defence of the victims of Iran’s unfair justice system, and particularly the women who have been targeted by it.

But Iran is also a geopolitical challenge today. We have just had attacks on Saudi oil facilities, and I don’t think those drones and those missiles were built by some rebels in the mountains. That equipment came from somewhere, and Saudi Arabia has made a case for it being supplied by the Islamic Republic of Iran. A few weeks ago, we had an attack on tankers anchored in the mouth of the Strait of Hormuz.

It looks to me like the theocratic regime is trying to provoke the United States into an armed attack, and I just hope that neither the United States nor we allow ourselves to be provoked, because we have been provoked before and I don’t like the consequences.

  Tonino Picula, u ime kluba S&D. – Poštovani predsjedavajući, neprihvatljivo je da ženama prijeti zatvor zbog pokušaja gledanja utakmice na stadionu, dugogodišnja kazna zatvora zbog mirnog protesta radi nametnutog stila oblačenja darivanjem cvijeća na Dan žena. Zatvorske kazne se uz to dodatno kažnjavaju bičevanjem.

Posebno zabrinjavajuća su učestala uhićenja i optužbe protiv žena, često državljanke Europske unije, koje se bore za pravo izbora i načina života koji žele. Čak i kad se suočavaju s ovako neprimjerenim optužbama i kaznama, svi zatvorenici moraju imati pravo na odvjetnika i zdravstvenu skrb u zatvorima. Temeljna ljudska prava ne smiju biti otuđena pod izlikom drugačijih tradicionalnih i kulturnih običaja. Ona moraju biti neotuđiva, bez obzira gdje se zahtijevaju. Iran treba konačno uskladiti svoje zakonodavstvo s konvencijama o ljudskim pravima čiji je potpisnik, a Europska unija mora ovaj problem aktivno držati na agendi cjelokupnih bilateralnih i multilateralnih odnosa s Iranom.

  Luisa Porritt, on behalf of the Renew Group. – Mr President, my constituent, Nazanin Zaghari-Ratcliffe, a dual EU—Iranian national, has been unlawfully imprisoned for more than 1 200 days. Having initially been refused access to a trial for months, she then faced one by a kangaroo court that was neither free nor fair. In prison Nazanin has often been deprived of proper medical assistance. She is no longer allowed international phone calls and can only see her five-year-old daughter, Gabriella, once a month. This treatment is tantamount to state hostage-taking. Nazanin has previously gone on hunger strikes and has warned she may do so again if she continues to be deprived of her fundamental human rights.

Her husband, Richard, has recently pointed out that the dominance of Brexit means her case has fallen off the UK Government’s agenda. As Foreign Secretary, Boris Johnson also contributed to making her situation worse and has failed to meet with Richard since becoming Prime Minister.

In circumstances such as these, the EU must make its voice heard. Nazanin is not alone. Other EU dual nationals suffer from violations of their human rights in Iranian prisons and are denied free and fair trials. Colleagues, it is our duty to stand up for their protection at home and abroad. Please support this urgency.

  Ernest Urtasun, en nombre del Grupo Verts/ALE. – Señor presidente, la situación de las mujeres en Irán es cada vez más preocupante y este Parlamento no puede dejar de denunciarlo. Uno de los últimos casos alarmantes es la trágica muerte de la joven de veintinueve años, Sahar Jodayarí, que decidió prenderse fuego ante una posible condena de seis meses de cárcel por haber intentado acceder a un partido de fútbol disfrazada de hombre.

Irán es el único país del mundo que prohíbe la entrada de mujeres en los estadios, pero, desde luego, esta no es —ni mucho menos— la única discriminación. Desde enero del año pasado, al menos treinta y dos personas han sido detenidas, y diez, encarceladas, por protestar contra el uso del velo obligatorio, lo que supone una violación manifiesta de su derecho a manifestarse como ejercicio de la libertad de expresión.

Por ello, exigimos la liberación de todas las personas detenidas y encarceladas arbitrariamente por ejercer sus derechos fundamentales. Además, las mujeres iraníes siguen fuertemente discriminadas en cuestiones de estatus personal relacionadas con el matrimonio, el divorcio, la herencia y la cuestión de los hijos, y están marginadas en el ámbito económico. La discriminación en los sectores público y privado debe llegar a su fin. Esperamos que nuestro llamamiento de hoy, desde aquí, sirva para que la Unión Europea y sus Estados miembros prioricen la protección de las defensoras de los derechos humanos en Irán.

Todos queremos que el acuerdo nuclear con Irán funcione y tenga viabilidad, y creo que estamos haciendo muchos esfuerzos desde la Unión Europea para que eso sea así. Los tambores de guerra deben quedar lejos y debemos poner todos nuestra energía para que eso funcione, pero eso debe ir estrechamente vinculado a la defensa de los derechos humanos en el país.

No podemos apartar eso porque ahora necesitamos que el plan nuclear salga adelante. Las dos cosas deben ir de la mano, y es por ello que pedimos, en una idea también de que el feminismo impregne el conjunto de la política exterior de la Unión Europea, que los derechos de las mujeres en Irán sean priorizados en todas nuestras relaciones con el país.

  Silvia Sardone, a nome del gruppo ID. – Signor Presidente, onorevoli colleghi, forse non tutti sanno che le donne in Iran, fino agli anni '70, erano come noi, si vestivano come noi e potevano accedere all'educazione esattamente come noi. Poi a un certo punto, nel 1979, è arrivato il regime, si è creata la Repubblica islamica e, in nome della religione, i diritti delle donne sono stati totalmente calpestati, portandole nel Medioevo. Considerate che le nazionali femminili di basket, calcio o pallavolo oramai giocano con il velo. Poi qualcuno vi verrà a raccontare che il velo è una scelta, ma non è così! Il velo è oppressione, è sottomissione, le donne non vogliono mettersi il velo, non vogliono coprirsi.

Noi siamo fermamente dalla parte degli attivisti che, quotidianamente, lavorano per difendere i diritti e gridano quello che sta succedendo, cercano in qualche modo di combattere la sottomissione della donna in quei paesi. L'Europa, devo dire, troppo spesso per buonismo, o anche un po' per paura, è stata zitta, non è intervenuta in tutti quei paesi islamici che sottomettono costantemente i diritti della donna.

Penso che noi non possiamo girare la testa, dobbiamo combattere per le donne e non possiamo assolutamente stare in silenzio.

  Witold Jan Waszczykowski, on behalf of the ECR Group. – Mr President, as a former Polish ambassador to Iran, I have to say that I’m not very happy that we have to discuss today this misbehaviour by the Iranian authorities. I would prefer to discuss the contribution of Iranian culture to our civilisation.

In a time of growing tension in the Persian Gulf, we expect Iran to play a more constructive role in this region. Especially, we expect that Iran will respect the human rights of Iranian citizens and those living in or visiting the country. We also expect Iran to stop its policy of arbitrary detentions and immediately and unconditionally to release all the EU dual nationals and human rights defenders, especially women’s rights promoters.

Finally, we hope that Iran will refrain from offensive policies in the region. If Iran truly wishes to keep friendly relations with the European Union, it needs to change its policy urgently and to stick to international norms and standards.

  Mick Wallace, on behalf of the GUE/NGL Group. – Mr President, while we know that women play a prominent role in Iran in a way that would put Saudi Arabia to shame, we also know that Iran has no defence on many of these issues relating to women’s rights, and things must change.

But to erase all mention of the illegal US sanctions against Iran is to ignore the world that these women and children must live in. We all know that economic sanctions hit the poor. It’s a slow form of torture to hit the weak – children and women – the most. To claim to champion the human rights of a people, while refusing even to acknowledge, let alone criticise, a brutal economic sanctions regime against the same people speaks volumes about the political nature of that concern for human rights.

Iran is under siege from many international players at the moment and we need to work with them to help them out of the impasse. It’s in our interest too. The motion, as it stands, is just another political weapon against Iran and, unless our amendments are accepted, my Group will be opposing this motion.

  Belinda De Lucy (NI). – Mr President, I’d like to first say I stand with those courageous women peacefully protesting for their rights in Iran. But as Iran grows bolder in its provocations, it appears the EU’s deal with Iran is failing in its objectives. Even its most important signatory, the United States, has pulled out. British citizens are the subject of kidnapping, solitary confinement and barbarity. Our citizens have become pawns in this geopolitical game and yet the EU remains the biggest global champion of the Iran nuclear deal with cynical commercial undertones. Iran benefits from EU investment while it continues to prop up terrorist groups in the region.

And while the EU rightly speaks about the human rights atrocities, what does speaking do?

It is sanctions, not words, that are needed or Iran will be emboldened further. But the names of just some of those languishing in Iranian prison cells need to be spoken. Our citizens who live in fear and isolation right now, real people like Jolie King and Mark Firkin, Nazanin Zaghari-Ratcliffe, Kylie Moore-Gilbert, Anoosheh Ashoori and Morad Tahbaz. It’s time to act now.

  Rosa Estaràs Ferragut (PPE). – Señor presidente, una vez más, Irán ocupa y es protagonista de un debate siempre bajo el mismo común denominador: la conculcación de los derechos humanos. Periodistas, defensores de los derechos humanos, minorías, discapacitados, mujeres, activistas, personas con doble nacionalidad, todos ellos sufren acoso, juicios injustos, torturas, arrestos arbitrarios, y ello simplemente por realizar su trabajo y por defender los derechos humanos. No pueden realizarlo sin amenazas y sin vejaciones ni intimidación.

Son muchos los casos —aquí se han mencionado— de esas torturas y de gente que ha sufrido. Me gustaría centrarme en el caso de la Chica Azul, en Sahar Jodayarí; esa chica de azul, de veintinueve años, cuyo delito fue ser mujer. Apasionada del fútbol, vestida de azul, el color de su equipo, el Esteghlal, se disfrazó de hombre para acudir al estadio a ver a su equipo preferido.

Pero los gobernantes de su país prohíben y no permiten a las mujeres acudir a los estadios —el único país del mundo—. Se inmoló ante el tribunal de Teherán, al entender que sería encarcelada. Su único delito —como dije— es ser mujer en un país donde los hombres determinan la vida de las mujeres y las privan de sus derechos humanos básicos.

Desgarradora es la trágica muerte, como desgarrador es el terrible desprecio de las autoridades iraníes hacia los derechos de las mujeres. Desde el inicio de la revolución, más de 120 000 personas han sido ejecutadas. Periodistas Sin Fronteras dice que Irán es la mayor cárcel del mundo de mujeres periodistas.

Necesitamos una respuesta nada silenciosa ante tanta opresión y, por eso, la comisaria Thyssen, que tiene una especial sensibilidad, nos ayudará a gritar un grito de paz, un grito de ayuda. La muerte de Sahar no puede ser, en ningún caso, en vano.

Las mujeres iraníes son valientes, son muchas y están decididas a luchar por conquistar sus derechos. No podemos dejarlas solas. Ellas son, de verdad, la verdadera revolución islámica. Y Europa tiene que hacer gala de su galardón por la paz y estar a su lado.

  Maria Arena (S&D). – Monsieur le Président, les discriminations à l'égard des femmes en Iran sont une réalité quotidienne.

Quand une femme, et je pense particulièrement à Sahar Khodayari, préfère s'immoler plutôt que d'être jugée par un tribunal révolutionnaire pour avoir osé mettre les pieds dans un stade de foot, nous comprenons à quel point les femmes sont privées des bases essentielles de leurs droits fondamentaux.

Une société qui ne garantit pas les droits à la moitié de sa population ne peut grandir, ne peut prétendre au développement.

Malheureusement, l'Iran n'est pas unique et on pourrait citer ici tous les États en infraction en matière de droits des femmes. La liste serait bien longue et j'aurais besoin de plus d'une minute pour pouvoir les citer. Mais l'Iran est un partenaire de l'Union. L'Union a défendu, a été l'initiatrice de l'accord sur le nucléaire avec l'Iran. Il peut sembler incongru à certains de parler du droit des femmes quand on parle d'un accord nucléaire. Pourtant l'Union doit saisir tous les instruments dont elle dispose pour lutter contre la plus grande des injustices au monde qui est de priver la moitié de l'humanité de ses droits les plus élémentaires, à savoir le droit des femmes.

  Phil Bennion (Renew). – Mr President, the state of human rights in the Islamic Republic of Iran has often been criticised. Freedom of speech and expression is severely restricted, and it is no secret that the Iranian authorities have been engaging in a severe clampdown on journalists and advocates of human rights.

This imprisonment and the level of unfair trials we see are particularly predominant amongst the ethnic minority groups in Iran, including the Ahvaz Arabs, the Kurds and the Baloch populations, and these groups form a substantial part of the population.

Now Nazanin Zaghari-Ratcliffe is a dual EU-Iranian national. She is a British citizen. She has been unlawfully imprisoned in Iran, having been refused a trial or access to any legal assistance for months. She was then found guilty of espionage after a very, very short and unfair trial. I met her husband, Richard Ratcliffe, recently when we shared a platform in Geneva. He struck me as a good man of deep integrity, who is courageously leading a campaign to try to free his wife.

In the more geopolitical sense, in 2018 the US withdrew its support for the Joint Comprehensive Plan of Action (JCPOA) and imposed sanctions, whereas the European Union has maintained its support for the agreement. Has not this been a clear sign to Iran that the EU can be a potential friend?

I urge Iran to immediately release all those named in this resolution. I also want to urge Iran to rethink its policies and approach to human rights, and particularly freedom of speech and expression. In this way, we can create the foundation for a normalisation of relations between Iran and the EU.

  Jérôme Rivière (ID). – Monsieur le Président, oui, il faut condamner et dénoncer tous ces pays qui oppriment les femmes: l'Iran, bien sûr, comme évoqué dans cette résolution, mais aussi l'Arabie saoudite et le Pakistan. Comment ne pas se souvenir des persécutions subies par Asia Bibi?

La réalité, c'est que tous les pays qui ont inscrit la charia comme un texte juridique fondamental oppriment les femmes. C'est l'usage de ce texte qui doit être fermement condamné. Mme von der Leyen a choisi de nommer un commissaire à la protection de notre mode de vie européen. L'une des premières protections sera de dénoncer ce texte, la charia, pour qu'aucune communauté n'en revendique l'usage en Europe.

Nous voterons ce texte. Il vaut mieux une petite avancée, un petit pas, plutôt qu'aucun texte. Mais faute de nommer le véritable problème, nous restons des facilitateurs de l'oppression des femmes dans de trop nombreux pays.

  Assita Kanko (ECR). – Mr President, she liked soccer, maybe she was in love with someone, and enjoyed specific scents or food. Her name is Sahar Khodayari. She was also known as the Blue Girl, the colour of her favourite soccer team. Facing a jail sentence for trying to watch a soccer game, which is forbidden for women in her country – as another Flemish Iranian, Darya Safai, has been telling the world – the 29—year—old Iranian set herself on fire two weeks ago in front of the Islamic Revolutionary Court of Tehran.

In Iran, human rights defenders, or people like her who just want to enjoy freedom, face harassment, prosecution and detention. Protecting women’s rights is not a crime. Since January 2018, 32 people have been arrested in Iran, and at least 10 imprisoned, for protesting against the mandatory wearing of the hijab. The compulsory dress code is a violation of human rights and women’s dignity. In the past three years, 30 EU dual nationals have been unjustly arrested – like, for example, Professor Ahmad Reza Jalali who was also a visiting professor at the Free University Brussels (VUB).

After all the resolutions, Council conclusions and so on, the High Representative of the Union for Foreign Affairs and Security Policy stressed, earlier this year, that dialogue is the only way, but it’s not enough. It was not for Khodayari: she is dead because she liked soccer and was 29. It was not for Jalali: he’s in jail and sick. Many others are threatened.

  Eugenia Rodríguez Palop (GUE/NGL). – Señor presidente; «Os haré sufrir a todas»: estas fueron las palabras del juez que condenó a tres mujeres iraníes por protestar pacíficamente contra el uso obligatorio del velo islámico. Condenadas a largas penas de cárcel en un juicio sin garantías y previamente golpeadas y torturadas.

Desde enero de 2018 decenas de mujeres han sido arrestadas en Irán por protestar contra el uso obligatorio del velo, y más de cincuenta personas detenidas en su lucha por los derechos de las mujeres. El hiyab obligatorio es un puro apartheid de género, una imposición discriminatoria que marca la vida de miles de niñas y mujeres.

Pero no hay cultura, identidad nacional o creencia religiosa que pueda utilizarse para violar nuestra dignidad y nuestros derechos. Ni para vestirnos ni para desvestirnos.

Queremos que se inste a las autoridades iraníes a anular las condenas y liberar a las defensoras detenidas arbitrariamente; a garantizar su acceso a la justicia y a proteger su derecho a la libertad de expresión, manifestación y no discriminación.

Nosotras no pensamos que las mujeres que se cubren son sumisas y las que no lo hacen están empoderadas. Lo que queremos es que se dejen de usar nuestros cuerpos como símbolos religiosos y banderas patrias en cualquier rincón del mundo.

  Matthew Patten (NI). – Mr President, every day Nazanin Zaghari—Ratcliffe, Aras Amiri and other UK citizens languish in Iranian jails is a tragedy for them and their families. The EU and our Parliament is complicit in this tragedy: our hands are stained. The EU promised Iran that it would get round American sanctions. Fourteen months on, the Instrument in Support of Trade Exchanges (INSTEX) is still an empty promise.

EU sanctions led to UK Marines in Gibraltar impounding an Iranian oil tanker, only for the EU to demand it be freed to carry on its sanction—busting voyage to Syria. When the UK asked the EU for support to protect shipping in the Straits of Hormuz it refused. The EU’s desperation to have the foreign policy trappings of a national state is like watching Pinocchio wanting to be a real boy. It’s too easily led, it’s full of deceit and it has no conscience. Can you imagine the disaster if it had its own army?

And what about this Parliament. I’m a member of the Parliament’s Delegation for relations with Iran. I wrote to Parliament in July asking for the Iranian delegation to meet urgently. I had no response. I tried again: zero response. Seventy days have passed in this session and still the Parliament’s Delegation for relations with Iran has not met: 70 days rotting in jail for Nazanin, Aras and many more. It’s a tragedy. Our hands are stained.

  Jackie Jones (S&D). – Mr President, women’s lives are under threat in many different countries, we know this, but in Iran we’ve had the Iranian Revolutionary Courts in recent months substantially ratchet up their punishments for even modest peaceful acts of protest by women, human rights defenders in particular. For what? For being a woman, for not wearing a hijab, or headscarf, watching a football match – or trying to – at a stadium, handing-out flowers on International Women’s Day.

The women, many of them with dual nationalities that are EU, are being targeted with dire consequences. For example women journalists on BBC Persia are subjected to sexualised slander, women human rights defenders are denied access to legal representation. They are arrested at peaceful Labour Day marches. There is a long list in this resolution of names, including Nazanin, as has been mentioned many times here already, of extreme punishments, of years and years in prisons, lack of medical care and lack of access to legal representatives.

Now these human rights offences are of the highest order, and we must call it out and we must do something about it. Iran must cease and desist and we must make sure that women have their full rights enforced wherever occurrences of human rights offences take place.

  Christophe Grudler (Renew). – Monsieur le Président, Mesdames, Messieurs, chers collègues, je veux saluer le courage de tous les défenseurs des droits des femmes en Iran, qui dénoncent pacifiquement la répression continue qu’elles subissent en raison de l’exercice de leur droit à la liberté d’expression et de leur opposition au voile obligatoire.

En 2018, en Iran, une centaine de femmes ont été arrêtées pour de telles actions. Elles sont toujours en détention. Au moins cinq d’entre elles ont une double nationalité, Union européenne-Iran. Considérées comme des ennemies de l’État, elles sont privées d’accès à la justice. Nous demandons à la justice iranienne leur libération immédiate et inconditionnelle.

Enfin, nous demandons à nos États membres présents à Téhéran de tout mettre en œuvre pour obtenir la liste complète des personnes emprisonnées ayant une double nationalité Union européenne-Iran, de les soutenir et de les protéger, notamment par des visites en prison, des déclarations publiques et des démarches diplomatiques pour obtenir leur libération rapide.

  Isabella Tovaglieri (ID). – Signor Presidente, onorevoli colleghi, in Iran le discriminazioni, le intimidazioni e le repressioni contro le donne si sono inasprite da quando le donne iraniane hanno deciso di diffondere in tutto il mondo, attraverso il web, gli abusi della cosiddetta "polizia morale", gli arresti, le sopraffazioni e le percosse di cui sono vittima ogni giorno.

L'Europa, che si fonda su valori di libertà e di responsabilità, non può accettare queste violazioni dei diritti umani, praticate da un sistema politico arcaico e ipocrita che utilizza la religione islamica per imporre il proprio potere.

Questo fanatismo sta diffondendo anche nelle città europee la sottocultura del sopruso sulle donne, con la complicità di una miope politica di sinistra che si batte per il diritto al velo in Europa come se fosse un privilegio anziché un'imposizione.

Non possiamo rassegnarci all'alibi della diversità culturale. Salvaguardare i nostri valori di civiltà è un atto che si impone.

La solidarietà dell'Europa alle donne iraniane deve estendersi quindi a tutte le donne di religione islamica presenti in Occidente, perché la loro libertà è la libertà e la sicurezza del nostro domani.

  Ryszard Czarnecki (ECR). – Panie Przewodniczący! Naród irański ma długą, wspaniałą historię. To naród starożytny i tym bardziej powinniśmy wymagać od niego respektu dla kobiet. Czy to nie paradoks - mówię to jako historyk - że przed czterdziestoma, pięćdziesięcioma laty, za czasów szacha Rezy Pahlawiego, kobiety w Iranie miały więcej praw niż obecnie. Tutaj nastąpił regres, to smutne. Oczywiście mówiąc o prawach kobiet w Iranie, powinniśmy szczególnie wsłuchiwać się w głos kobiet, które w Iranie były, z Iranu wyjechały i świadczą pewną prawdę o tym, co się tam dzieje. Także w Parlamencie Europejskim mieliśmy szereg konferencji z udziałem właśnie takich kobiet, między innymi pani Radżawi. Pamiętajmy też o tych, którzy są Irańczykami dla Iranu, a obywatelami naszych krajów dla państw członkowskich Unii - o tych, którzy mają podwójne obywatelstwo. O wszystkich nich musimy pamiętać i musimy dbać o ich prawa.

  Evelyn Regner (S&D). – Herr Präsident! 70 % der iranischen Frauen sind gegen die strengen Bekleidungsvorschriften im Land. Das geht aus einer Studie des staatlichen Parlamentarischen Forschungszentrums des Irans selbst hervor. Immer mehr Frauen protestieren gegen Gesetze der Zwangsverschleierung und verteidigen das Recht jeder Frau zu entscheiden, was sie tragen will, ohne Angst vor Belästigung, Gewalt oder gar Inhaftierung. Seit Jänner 2018 sind Dutzende FrauenrechtlerInnen, darunter auch Männer, festgenommen und als Kriminelle behandelt worden.

Friedlicher Protest ist ein Menschenrecht und gehört in jeder Gesellschaft dazu. Vier mutige Frauen – Saba Kord-Afshari, Mojgan Keshavarz, Yasaman Aryani und Monireh Arabshahi – haben friedlich gegen das diskriminierende Verschleierungsgesetz des Irans protestiert und sind zu skandalösen 16 bis 24 Jahren an Gefängnisstrafe verurteilt worden. Das ist nicht hinnehmbar, das ist nicht akzeptabel. Wir fordern die unverzügliche Freilassung dieser Frauenrechtlerinnen.

  Karin Karlsbro (Renew). – Herr talman! Under de senaste månaderna har de iranska myndigheterna tagit ytterligare steg för att förvärra förtrycket mot kvinnor i Iran. I april i år greps till exempel kvinnorättsaktivisterna Mojgan Keshavarz, Monireh Arabshahi och Yasaman Ariyani efter att de har lagt ut en video på sig själva där de utan slöja delar ut blommor till resenärerna i tunnelbanan i Iran. För denna så kallade förseelse – att dela ut blommor i kläder de själva hade valt – dömdes de till mellan 16 och 24 års fängelse.

Europaparlamentet måste enat fördöma den kvinnofientliga regimen i Iran. EU ska alltid vara en kristallklar röst för flickors och kvinnors mänskliga fri- och rättigheter. Det är 2019 nu! Alla måste ha makt över sina egna liv och sin egen kropp!

  Charlie Weimers (ECR). – Herr talman! Tänk att din syster bränner sig till döds i protest mot en regim som kvävt all hennes livsglädje. Tänk att din dotter döms till 20 års fängelse bara för sin vägran att bära slöja. Du skulle uppskatta omvärldens stöd. Istället bär världens första feministiska regering slöja på besök i Iran. På svensk mark accepteras den iranske utrikesministerns vägran att ta sin kvinnliga motpart i hand. När vi konservativa påtalar att i Sverige har vi tagit kvinnor i hand sedan urminnes tider avfärdas vi med okunniga påståenden om att iranier inte tar kvinnor i hand, vilket är rent nonsens.

Kvinnor som förtrycks i islams namn förtjänar omvärldens helhjärtade stöd. Därför måste vi stå upp för västerländska värderingar i mötet med den barbariska regimen i Teheran och vi måste sluta bära symbolen för kvinnoförtryck bara för att vara mullorna till lags!

  Dietmar Köster (S&D). – Herr Präsident, liebe Kolleginnen und Kollegen! Frauen werden im Iran in nahezu allen gesellschaftlichen Bereichen massiv diskriminiert. Das gilt unter anderem in Hinsicht auf das Rechtssystem im Iran – also die Scharia, die auch die Todesstrafe vorsieht. Das klerikal-diktatorische Regime basiert auf männlicher Herrschaft islamistischer Fundamentalisten und ihrem Frauenhass. Das schließt die Gleichstellung der Geschlechter und die Rechte von Minderheiten und Andersdenkender gezielt aus.

Die Fälle der iranischen Aktivistinnen verdeutlichen die Abscheulichkeit eines solchen Systems. Jahrzehntelange Haft und Dutzende von Peitschenhieben für Frauen, die sich für Menschenrechte starkmachen, das ist inakzeptabel!

All dies zeigt: Solange diese klerikale Diktatur vorherrscht, in der Frauen gewaltsam unterdrückt werden, sind die Bedingungen für eine friedliche Koexistenz der Staaten im Nahen und Mittleren Osten nicht gegeben.

  Petras Auštrevičius (Renew). – Mr President, allow me to start by expressing my deepest respect for, and solidarity with, all Iranian human rights defenders. I’m especially touched by the bravery of Iranian women, who choose such a peaceful way to claim their rights, giving flowers to other women in underground trains and discussing their rights. To some extent it reminds me of our peaceful resistance to the Soviet occupation, especially with the Baltic Way – only we achieved freedom, while Iranian colleagues have been sentenced to prison, with sentences of unimaginable length.

The impact of continuing human rights violations and the suppression and intimidation of opposition and journalists has long overreached the borders of Iran. It causes regional instability and threatens global security and the economy.

I call on the Iranian Government to respect human rights and fundamental freedoms, in accordance with international human rights standards and international instruments ratified by that country. I also urge the Council to review the European position on Iran by considering additional sanctions.

  Jadwiga Wiśniewska (ECR). – Panie Przewodniczący! Sytuacja kobiet w Iranie jest niezwykle trudna. Muszą walczyć o prawa podstawowe. Kamienowanie jest jedną z metod egzekucji przewidzianych przez islamskie prawo karne. Gdy zostaną zgwałcone, są karane na równi z gwałcicielem. Pozbawione praw wyborczych i prawnie zmuszane do noszenia hidżabu, kobiety irańskie potrzebują wsparcia. Irańscy obrońcy praw kobiet, w tym obywatele Unii, za działania, które nie mają nawet znamion przestępstwa, skazywani są na długoletnie kary więzienia. Pretekstem do takich kar jest na przykład kontakt z przedstawicielami Unii Europejskiej, ONZ czy kontakt z mediami.

Rząd irański dąży do zacieśnienia stosunków z Unią Europejską, więc powinien zostać wezwany do przestrzegania praw człowieka, zaprzestania kryminalizacji obrony praw kobiet, a także szanowania praw obywateli Unii Europejskiej.

  Samira Rafaela (Renew). – Mr President, three Iranian women’s rights activists disappeared and were sentenced to 16 and 22 years in prison. And their crime you ask? Taking the liberty to decide for themselves what to wear. In reality, this is about a regime of men scared of women claiming their rights and demanding equality. This latest incident is not an isolated one. The Iranian regime has a long history of human rights abuses. There have been thousands of sham court cases, many of which even led to the death penalty.

Madam Commissioner, I urge you and the High Representative to do everything in your power to have these courageous women’s rights defenders released immediately. No government should arrest and imprison women for what they wear, not in Iran and not in Europe. We don’t need men in power to tell us what to wear.

  Juan Fernando López Aguilar (S&D). – Señor presidente, ¿cuál es el sentido de este debate habitual en el Parlamento Europeo, la mañana de los jueves, en el Pleno, acerca de violaciones flagrantes de los derechos fundamentales? Expresar las prioridades y los valores de la ciudadanía a la que representamos y determinar la política exterior de la Comisión y de la Unión Europea en su conjunto, con una Resolución que, en este caso ‑y es raro‑, tiene la unanimidad en la expresión de la condena que merece la violación sistemática y flagrante de los derechos de las mujeres y su discriminación en Irán.

Se han comentado casos pavorosos de manera elocuente: una mujer que se suicida dramáticamente después de haber asistido a un estadio de fútbol disfrazada de hombre, porque sabe que va a ser condenada; mujeres que padecen penas inhumanas y castigos degradantes de manera sistemática. La Unión Europea ha hecho un esfuerzo por mantener el acuerdo nuclear iraní, ha ejercido su diplomacia, haciendo valer sus prioridades. Eso no disminuye, sino al contrario, refuerza la autoridad moral para exigir en la política exterior hacia Irán la cesación de la violación y persecución sistemática de los derechos de las mujeres.

  Clare Daly (GUE/NGL). – Mr President, I too stand shoulder to shoulder with women struggling for human rights and equality in Iran. I fully support calling for the release of those women in prison for their political and protest activity to advance women’s rights in Iran, and indeed their right to wear whatever they like. And I absolutely condemn the death penalty, including on those under age. But I have to say that I do find the motion imbalanced at a time when tone is important, at a time when Iran is under siege from many international players.

We had somebody come in here today and tell us that Iran is trying to provoke a war with the USA – when it’s the USA which has torn up the nuclear deal, when it is the USA that is crippling the economy of Iran and causing immense harm to women and children. So, in that sense, we all know Iran has to change – they’re not the only ones – but of course they know this and I welcome the fact that there is now an equal number of women as clerics in the Iranian Parliament. I’m looking forward to a time when there are more, but this motion won’t help unless we include the amendments on the sanctions.

  Seán Kelly (PPE). – Mr President, I just wanted to concur with what has been said by many speakers. The situation of women in Iran is unacceptable, and particularly from the point of view of the European Union, when I was a member of the Iranian delegation in the last mandate, we worked very hard to keep the nuclear accord in place, and the European Union stuck its neck out in that regard, but that must be reciprocated.

As has been said, by particularly allowing women the freedom they deserve, and as one MEP said, men in Iran should not be telling women what to wear. I also concur with my colleague, Clare Daly, on the obligations of the United States in relation to Iran, and the nuclear accord. It was they who pulled out of it, and that was done despite the fact that there was an agreement done with the previous president, President Obama, so that in itself is also a cause for condemnation.

  Ben Habib (NI). – Mr President, I’m absolutely staggered by the debate I’ve heard this morning. The greatest ally the European Union Member States have had in history is the United States of America.

When the USA rightly imposed sanctions on Iran, the European Union actively went about trying to undermine those sanctions by setting up a subsidiary, a special purpose vehicle to step around the sanctions. Thankfully that failed. In June this year, the USA asked for support in the Straits of Hormuz, and EU Member States turned it down. You won’t forget that, in July, a British ship was taken by the Iranians, something which might not have happened had the EU supported American efforts.

And now we have all this virtue-signalling in this inept Chamber, and no action taken by the European Union to support the greatest ally this country has ever had. And, one more thing, the EU does not put enough money into NATO and yet it is putting money into a new European defence force. It’s completely wrong.

Get your priorities right. Get behind the United States of America.

  Julie Ward (S&D). – Mr President, I’ve met Richard Ratcliffe, the husband of dual national, Nazanin Zaghari—Ratcliffe, who’s led the three—year campaign for her release from prison in Iran, even going on hunger strike earlier this year in solidarity with his wrongfully incarcerated wife.

Nazanin is alone in a country that refuses to recognise her dual citizenship, forces her into solitary confinement and holds the threat of a second trial and conviction over her head. The appalling conditions she endures are undeniably inhumane and must come to an end.

Nazanin is a prisoner alongside UK resident Aras Amiri, who was jailed last year while visiting family in Iran, whilst dual British—Iranian national, Kamil Ahmadi – a hugely respected academic and campaigner dedicated to ending FGM – was recently detained in Iran on unknown charges. Dual nationals, European citizens, must not be forgotten, but neither should they be put in further danger through careless words. And I refer here to the unfortunate and misleading statements made by Boris Johnson when he was Foreign Secretary. We deserve better than this.

  Marianne Thyssen, Member of the Commission. – Mr President, our commitment to support human rights defenders, including women’s rights defenders, is a fundamental part of our human rights policy. Unfortunately, in too many countries, including Iran, women continue to face threats and abuse because they are human rights defenders or simply because they are women. They receive defamatory comments and slander. They face hatred, harassment, intimidation and incitement to violence, often of a sexual nature, or they face imprisonment for standing up for their basic rights.

In this context, I would like to express how deeply saddened I am by the fate of Sahar Khodayari, who earlier this month set herself on fire after learning that she faced a prison sentence for trying to attend a football match, and who died in the hospital from her wounds. Her tragic death is the heart-breaking aftermath of an appalling contempt for women’s rights. No woman should fear imprisonment for attending a sporting event.

Every year, on 8 May, the international community marks International Women’s Day. For the European Union, this is a time to pay tribute to acts of courage and determination by ordinary women around the world who have played an extraordinary role in the history of their countries and communities. In the joint statement that the EU published on 8 May this year, we stated that we are committed to giving all women and girls equal access to health services, education and economic empowerment and opportunities to shape their own future. We will never stop fighting for true equality for all, inside and outside the European Union, to make sure that progress achieved is not undone.

Our commitment to support human rights defenders, including women’s rights defenders, also applies to our work in Iran. In the context of the regular, high-level political dialogue with Iran that aims to advance bilateral cooperation in a number of areas of mutual interest, the European Union has been consistently raising issues of human rights. We have regularly engaged with the authorities to demand that human rights defenders, including women, must not be subjected to harassment or detention.

We have been vocal in this demand, for instance in the case of the 2012 Sakharov Prize laureate Nasrin Sotoudeh, who was sentenced to long periods of imprisonment because of her advocacy for fundamental human rights.

And we continue to be vocal, including in international fora such as the United Nations Human Rights Council. The rights of women and girls are also likely to figure prominently during Iran’s upcoming Universal Periodic Review in November.

I am acutely aware that the focus of this debate also extends to the situation of EU dual nationals imprisoned in Iran. There again I would like to be clear: the practice of detaining and imprisoning individuals, such as the UK Iranian citizen Nazanin Zaghari-Ratcliffe, solely on account of their nationality is contrary to the International Covenant on Civil and Political Rights, which Iran has ratified and is bound to uphold. Iran’s continued practice of detaining dual nationals clearly breaches the commitment that no one shall be subject to arbitrary arrest or detention.

As the European Union, we will continue to call for the release of all EU-Iranian dual nationals and all Iranian human rights defenders. We also call on Iran to ensure that no individual is detained arbitrarily, and that detainees are not subject to any form of mistreatment. Detainees should also have timely access to a lawyer of their own choosing, and to adequate medical care.

Honourable Members, thank you for this debate. I can tell you that we are encouraged by the attention paid to these issues by the Members of the European Parliament and we will continue our efforts to work together with you to support human rights defenders across the world.

Wir bemühen uns hier, die Dinge möglichst effizient in einem möglichst zügigen Tempo abzuwickeln. Wir bemerken immer am Anfang der Wahlperiode, dass Kollegen sich eher beschweren, dass es zu schnell geht, und am Ende der Wahlperiode beschweren sich Kollegen eher, dass es zu langsam geht. Ich kann Ihnen versichern, dass ich mein übliches Tempo heute schon ein bisschen reduziert habe.   Michaela Šojdrová (PPE). – Pane předsedající, jsem ráda, že Evropský parlament se jasně postavil proti patentovatelnosti nových druhů rostlin a zvířat vzniklých biologickými způsoby, tedy klasickým šlechtěním. Vyslali jsme tak jasný signál Radě i Komisi, aby se zasadily o vyjasnění této právní komplikace. Je důležité ovlivnit Evropský patentový úřad, aby znovu obnovil právní jistotu a zájem šlechtitelů, zemědělců i veřejnosti. Opak by totiž znemožnil volné využití biologických materiálů pro další výzkum a šlechtění. To není v zájmu nikoho z nás, aby jinak volně dostupné biologické zdroje podléhaly přísné průmyslové patentové ochraně stejně jako v dalších odvětvích. Z toho důvodu jsme usnesení podpořila a apeluji na ostatní členské státy, aby aktivně pomohly vyřešit současný nejasný právní stav.

  Stanislav Polčák (PPE). – Pane předsedající, děkuji za udělení slova a zjednání pořádku v této sněmovně. Já chci na začátku objasnit své vysvětlení v tomto bodu. Podpořil jsem jej, protože podle mého názoru patentovatelnost biologických rostlin nebo živočichů, kteří jsou výsledkem určitého šlechtění, je skutečně za hranou. Veřejný zájem jednoznačně ukazuje na to, že tato patentovatelnost by neměla být přípustná. Tento Parlament se vždy zasazoval o ochranu duševního vlastnictví. Ochrana autorských práv, dalších práv, která jsou příbuzná autorským právům, je pro nás vlastní. Na druhou stranu myslím si, že to musí mít jasně dané hranice a veřejný zájem na dostupnosti využití právě biologických zdrojů je jednoznačný. Proto já jsem tento návrh usnesení podpořil i jako jasnou instrukci právě Evropskému patentovému úřadu a také posílení právní jistoty.

  Sheila Ritchie (Renew). – Mr President, the issue of patenting living organisms actually came as an entire shock to me. OK, my prior naivety. I’m gobsmacked that resources and seeds that have been developed or passed on as traditional or public knowledge can be turned into knowledge owned by large corporations. It’s vital that that knowledge is available to small farmers and plant breeders.

The patenting of natural plant developments, in addition to allowing corporations to own knowledge, making it inaccessible to farmers, often conflicts with indigenous knowledge and the rights of indigenous people, the sustainability of local ecosystems and even the ability of nations to provide food security and to protect the global environment. Large transnational corporations effectively steal the knowledge of natural plants used for generations by local people without their knowledge and without their consent. The farmers find the only way to get it is to buy it.

  Juozas Olekas (S&D) . – Gerbiamas Pirmininke, augalų įvairovė yra puikus šaltinis naujų perspektyvių veislių kūrimui. Bet, kuriant naujas veisles, skirtas augalinio maisto gamybai, klimato pokyčiams valdyti, jos nepakanka. Reikalingi naujausi mokslo ir pažangių technologijų pasiekimai. Patentuota augalo medžiaga gali būti reikalinga pranašaus saugaus maisto gamybai. Bet patento savininkas gali nesuteikti licencijos tokios medžiagos naudojimui, kuriant kitas naujas augalų veisles. Tokios nuostatos netaikomos, suteikiant augalų veislėms teisinę apsaugą, kai augalų veislės gali būti naudojamos tolimesnei selekcijai ir jas tobulinant. Selekcininkai neturėtų būti priklausomi nuo patento savininko, kai tai susiję su patentuotu augalo išradimu. Todėl aš pritariu nuostatai, kad augalų veislės dalims, genams nebūtų galimybių suteikti patentus, kad patentų biuras turėtų aiškias gaires. Ačiū.

  Daniel Hannan (ECR). – Mr President, the advances in plant breeding and plant technology are the central fact of this generation. We’re becoming better and better at getting more yield out of smaller territory. The result of this is not only that we are able to feed the world in a way that a generation ago would have seemed unimaginable, it is not only that we have disproved all of the dire predictions of mass starvation that were habitually being made in the ‘70s and ‘80s, it is that we are allowing nature to pour back in, we’re allowing for a huge revival of reforestation and of previously endangered species as the territory needed to sustain our population dwindles.

The European Union should be at the forefront of this technology, but as so often a combination of luddite politicians and vested interests mean that we’re cutting ourselves off, particularly from advances in genetic modification. Britain, I hope, will be outside the EU at the forefront of this technology, but I hope our neighbours will rush to follow us in due course.

  Dominique Bilde (ID). – Monsieur le Président, cette résolution partiale ne fait en tout cas pas honneur à la mémoire des victimes du totalitarisme. Tout d'abord, il est évident que le souvenir du dernier conflit mondial est aujourd'hui détourné à des fins politiques, faute pour l'Union européenne de pouvoir asseoir sa légitimité sur un quelconque soutien populaire.

Quoi de plus opportun, en effet, alors que d'élection en élection, le rejet des peuples s'affirme, que de se raccrocher à la légende rose d'une Union européenne gage de paix sur le continent. En réalité, les Européens doivent leur libération, non pas à une camarilla de fonctionnaires bruxellois, mais aux États-Unis, et, pour reprendre les propos du général de Gaulle, à la Russie éternelle.

Le déni de l'Histoire qui transpire à chaque ligne de ce texte n'effacera jamais le sang des quelque 20 millions de Russes sacrifiés pour que l'Europe vive. Ainsi, cette résolution relève des mêmes réécritures de l'Histoire qu'elle prétend dénoncer comme propres aux régimes dictatoriaux, un constat qui nous interpelle quant à la nature de cette Union dont la dérive autoritaire devient de plus en plus évidente.

  Ангел Джамбазки (ECR). – Колеги, подкрепих резолюцията в памет на жертвите на тоталитарните режими, защото вярвам в историческата памет. Наред с другите забранени вече от историята, изтрити от историята недемократични режими трябва да бъдат помнени и престъпленията на болшевишкия такъв. Източна Европа беше под болшевишки ботуш и терор в продължение на близо половин век.

Давам пример с престъпната безумна идея да бъде разделена българската нация и да бъде изкуствено създадена с методите на терора македонската такава на българска територия. Затова тези престъпления трябва да бъдат осъждани и символите им, каквито са сърпът, чукът и петолъчката, също трябва да бъдат забранявани като символи на тоталитарен и недемократичен режим.

Mes čia, atstovaudami Europos žmones, turime viltį sukurti geresnę Europą, bet tai nėra nieko naujo. Tokias pat viltis turėjo prieš aštuoniasdešimt metų ir mūsų tėvai bei seneliai. Tačiau du tironai visas jas nubraukė, pasirašydami slaptuosius protokolus ir pasidalindami Europą, sukeldami žiauriausią Europos istorijoje karą. Masinės žudynės, holokaustas, tremtys. Mano tėvai ir seneliai kartu su dešimtimis tūkstančių Lietuvos žmonių taip pat buvo išvežti į Sibirą gyvuliniuose vagonuose. Aš ten gimiau. Dar beveik dešimtmetį po karo mes su ginklu rankose kovėmės už laisvę. Kaip matosi iš pasisakymų čia, šioje salėje, daliai iš jūsų apie šį laikotarpį už geležinės uždangos dar visai mažai žinoma. Todėl, norint būti teisingiems prieš savo vaikus ir anūkus bei sukurti teisingesnę laimingesnę Europą, mes negalime leisti pasikartoti panašioms tragedijoms.

  Claire Fox (NI). – Mr President, I voted against this resolution not because I don’t care about historical remembrance, but I care too much about historical facts and memory to allow them to be turned into a revisionist political football to push the EU’s contemporary agenda. This motion treats Europe and European history with disdain by flattening European history into the EU’s history. It hijacks the brave fight against fascism and the horrors of the Holocaust – by the way, you managed to forget the Jews in this motion – to push simplistic propaganda points about EU federalism and expansionism.

European history is not EU history. The Renaissance, the Enlightenment, European arts and philosophy were the home and the clarion call of free speech, self—determination, nation states, national sovereignty and democracy. Those values this Parliament chooses to forget. I won’t. That’s why I oppose this motion, which was nothing more than political propaganda.

  Rory Palmer (S&D). – Mr President, I think one of the most important clauses of the resolution we’ve approved today in the Parliament, and which I supported, is the importance of ensuring young people and future generations know and understand what happened during the darkest days of Europe’s past.

And in voting for this resolution, I pay particular tribute to the work of the National Holocaust Centre and Museum in the East Midlands, and the Holocaust Education Trust in the UK, who do vital work to ensure that young people and school students understand what happened and understand their role, and can be empowered to tackle hate and prejudice today.

I also pay particular tribute to holocaust survivors who make it their personal mission today to ensure that those young people and all of us today understand the significance of what happened and can help empower all of us to ensure that when we say ‘never again’, we truly mean never again.

  Loránt Vincze (PPE). – Elnök Úr, Képviselőtársak! Európának emlékeznie kell, hogy a huszadik század emberiség elleni rémtettei soha többé ne ismétlődjenek meg, se a nácizmus, se a kommunizmus. Közép- és Kelet-Európa országai máig küzdenek ötven év kommunista és szocialista diktatúra romboló hatásaival. Romániában az én nemzedékemet csak részben érintette, de szüleim és nagyszüleim életét derékba törte a kommunista diktatúra. A jóvátétel ugyan kevés vigasz, de az is lassú és hiányos. A történelmi egyházaktól és a nemzeti kisebbségektől elkobzott ingatlanvagyon visszaszolgáltatása – annak ellenére, hogy törvény szabályozza – még nem ért véget.

Fontos emlékeztetni a tagállamokat, hogy az ingatlan-visszajuttatási törvényeket alkalmazzák azonnal és maradéktalanul. Európa keleti felében 50 év lemaradását kell fejlesztésekkel és mentalitásváltásban is behoznunk. Az Európai Unió Kohéziós Alapjai éppen ezt teszik a kelet-európai felzárkóztatásban, de ezzel párhuzamosan a „soha többé ne forduljon elő” gondolatát folyamatosan ápolni és átörökíteni kell a következő generációra. Ma ezt tettük ebben a Házban.

  Antony Hook (Renew). – Mr President, I was pleased to support this motion to remember the victims of totalitarianism. For many of us this is very personal. My wife’s grandfather was an Auschwitz survivor and it chills me to the bone that things could easily have been very different, and my wife and my daughter would not exist. My own grandfathers were a paratrooper who fought in the war and a railwayman who had to keep trains at the docks moving while bombs fell from the sky.

We Europeans are united by history, by memory and resolve to make a better future. But I voted for the motion in spite of one reservation, which was that the motion speaks only of brutality by Europeans against other Europeans on the continent of Europe. The weight of our history is that Europeans have committed atrocities elsewhere too. There are Europeans today whose ancestors come from Asia, Africa and the Americas, and we must be clear that all atrocities are to be remembered. All our ancestors matter. Our Europe is part of the globe.

  Daniel Hannan (ECR). – Mr President, 80 years ago, half a million Red Army troops backed by 5 000 tanks, 2 000 combat aircraft, smashed their way into Poland in a surprise attack. Masters of dezinformatsiya, they had first spread the story that they were coming to help their Slavic Brothers against the Nazis, but their intentions soon became clear.

When the Nazi and Soviet armies met at Brest-Litovsk, they staged a joint parade. The two generals Guderian and Krivoshein had a slap-up lunch at which the Soviets invited the German journalists to join them in Moscow after the victory over capitalist Albion.

The amnesia, the selective amnesia, that parts of the modern Left have about the Nazi—Soviet pact, is an extraordinary monument to the follies of human nature. We keep being told that the Red Army liberated us, that the Western theatre was just a sideshow, that it was really thanks to Stalin that fascism was defeated. Can we really have forgotten that for fully a third of the conflict they were on the same side? The only real victors here were the Left who ...

  Tatjana Ždanoka (Verts/ALE). – Mr President, I voted against the resolution as a whole even though I was in favour of certain paragraphs. I am against the whole approach of equating the Nazis to communist regimes. There is only one devil and the absolute devil is Nazi ideology.

I am against the primitivisation of the approach to the history of World War II demonstrated by this resolution.

Where is Munich? Forgotten. Where are the bilateral treaties concluded well before 23 August 1939? My family had to make sacrifices because of the Nazis; my family had to make sacrifices because of deportations.

I repeat: there is only one devil and it is Nazi ideology.

  Julie Ward (S&D). – Mr President, as a member of the Culture and Education Committee for the past five years, and now as a vice-chair of that same committee, I always seek to raise awareness of remembrance of our difficult history, whether that be through Erasmus+, the European Solidarity Corps or Creative Europe projects.

I am here partly because my mother’s cousin, Kenny Chatfield, lies in a grave in northern France – shot down, aged 18, fighting fascism.

The European Union is first and foremost a peace project, born out of the idea that Europe could not afford another world war. The material and human cost was immense, and we’ve moved from mass displacement and destruction across Europe to striving for peace and prosperity through common endeavour, cooperation and collaboration between European countries. These turning points in the past century should be told and understood across all Member States. Therefore I encourage those projects which themselves encourage tolerance, mutual understanding, intercultural dialogue and reconciliation.

  Michaela Šojdrová (PPE). – Pane předsedající, já jsem podpořila usnesení o provádění legislativy proti praní špinavých peněz, protože tato problematika je velmi důležitá. Známe kauzy jako Panama Papers a také teroristické útoky v Evropě, které byly částečně financovány prostřednictvím právě praní špinavých peněz, to dokazují. Je smutné, že stále deset evropských států neimplementovalo čtvrtou směrnici proti praní špinavých peněz. Jsem ráda, že v této situaci Česká republika mezi nimi není. Pátá směrnice a její požadavky v podobě přísnějších režimů ověřování identity a nároků na banky jsou jistě na místě. Je nutné, aby členské státy daly větší prostředky svým finančně-analytickým útvarům, které by si zároveň měly lépe vyměňovat informace. Bohužel, i zde platí, že praní peněz nezná hranice, a to v explicitním i v přeneseném slova smyslu. Takže mezinárodní spolupráce na úrovni EU je globálně nezbytná.

  Manon Aubry (GUE/NGL). – Monsieur le Président, cette résolution est importante. Un pour cent du PIB européen est impliqué dans des activités financières suspectes. C'est l'équivalent du budget annuel de l'Union européenne. Les fraudeurs du Fisc et les organisations criminelles ou terroristes dépendent des relais bancaires douteux, c'est pourquoi la lutte contre le blanchiment doit être menée avec la plus grande fermeté.

Le scandale de la Danske Bank et tous les autres impliqués dans une affaire de blanchiment de plus de 200 milliards d'euros a révélé la faiblesse des capacités d'intervention en la matière de l'Union européenne. L'Autorité bancaire européenne a montré toute son impuissance en ne prenant aucune sanction. La résolution transpartisane que j'ai cosignée marque, je l'espère, une première étape importante dans la volonté de renforcer les outils de la lutte contre le blanchiment au niveau européen. Il faudra bien sûr aller plus loin, et on ne pourra agir efficacement sans établir une liste exhaustive de paradis fiscaux, parce que beaucoup de ces paradis fiscaux notoires se trouvent au sein même de l'Union européenne. Sans s'attaquer à eux, toute politique sera vouée à l'échec.

  Ангел Джамбазки (ECR). – Колеги, гласувах „въздържал се“, тъй като разбирам и подкрепям важността на борбата с прането на пари, но същевременно смятам, че някои елементи са в конфликт със сферите на компетентностите на държавите членки. Отново виждам предложение за създаване на агенция, която отново да се бори с този и други проблеми. Но дали поредната агенция и създаване на бюрократични процедури ще бъдат решението? Според мен – не. И отговорът трябва да бъде категорично „не“.

Трябва да бъдем много внимателни и да се придържаме към техническите и законодателните елементи на борбата с прането на пари, без те да се използват като инструменти за постигане на политически цели срещу отделни държави, какъвто пример имаме в случаите с Унгария и с Полша.

  President. – The next item is the debate on the Commission statement on threats to the status of volunteer firefighters in the European Union (2019/2806(RSP)).

  Marianne Thyssen, Member of the Commission. – Madam President, the title of this statement reflects the preoccupation that exists among the fire services in several Member States, notably in France, about the impact on volunteer firefighters of a judgment of the Court of Justice of the European Union last year in the Matzak case. I understand those worries and I hope I can assuage them at least to some extent. Of course, the Commission cannot speak for, or bind, the Court, but I can reassure you that we are following the situation of emergency services, including volunteer firefighters, very closely.

Firefighters are a key element of emergency and civil protection services everywhere in Europe. Across the European Union, firefighting services are made up of a mixture of professional or career firefighters and volunteers. The composition of firefighting services varies greatly among different Member States. For instance, 80% of French firefighters are volunteers. The numbers are even higher in countries such as Germany or Austria, but in other countries, like Greece or Bulgaria, the firefighting workforce is almost entirely professionalised. To be clear, the Matzak judgment does not oblige Member States to have a particular mix of career firefighters and volunteer firefighters. It certainly does not oblige Member States to get rid of volunteer firefighters altogether or always to treat volunteers in exactly the same way as career professionals.

The central issue of the Matzak judgment was about resting time and, more specifically, the entitlement to resting time for firefighters who, while on standby, are obliged, first, to live and stay permanently near to the fire station and, second, to respond to a call and reach the fire station within eight minutes. The Court concluded that, given these specific constraints, Mr Matzak’s standby time should be counted as working time for the purpose of the Working Time Directive and should not be seen as free time.

Most of the ensuing debate about the Matzak case has been centered on the notion of ‘worker’. However, on that point the judgment said nothing new. A long line of case law makes clear that, under EU law, whether someone is considered a worker depends on the circumstances. Somebody who pursues real and genuine activities, who is subordinated to another person and who is remunerated in return, is a worker for the purposes of this piece of law. In the case of Mr Matzak, the Court concluded that, in his particular circumstances, these conditions were met.

Following the judgment, various stakeholders jumped to the conclusion that EU law had made it impossible to have volunteer firefighters, but I believe this conclusion is incorrect. Let me be clear: there is no one—size—fits—all reply to the question of the status of volunteer firefighters under the Working Time Directive. Each specific case needs to be assessed against the criteria for qualification as a worker established by the Court, and, if the Working Time Directive does apply, its provisions on resting time should be respected.

But the Working Time Directive offers a lot of flexibility for sectors such as firefighting and emergency services. For instance, derogations from daily and weekly rests are possible, of course, if compensatory rest is provided. Member States may also allow workers to opt out of the 48 hour average maximum working time under certain conditions, and in exceptional circumstances, such as natural or technological disasters, attacks or major incidents, the directive can be disapplied altogether.

In summary, each case must be examined on its own merits to ensure that the status of volunteer is not used to circumvent European labour law. The Matzak judgment does not mean that every volunteer firefighter in the European Union automatically qualifies as a worker and, in any event, the Working Time Directive provides for flexibility to accommodate the needs of emergency services, such as fire services, without denying the firefighters protection of their health and safety.

  Anne Sander, au nom du groupe PPE. – Madame la Présidente, Madame la Commissaire, chers collègues, feux de forêts, inondations, accidents, sauvetage, assistance à la personne... la liste des services prodigués par les sapeurs-pompiers volontaires est longue et se rallonge d’année en année.

Les événements de cet été nous ont bien rappelé que leur intervention est indispensable dans notre quotidien, pour assurer la protection à la fois des citoyens, des entreprises et des espaces ruraux.

Les pompiers volontaires participent également à créer du lien social, notamment dans les zones rurales. Leur engagement citoyen, altruiste, est indispensable pour une Europe plus solidaire.

Dans l’Union européenne, parmi les 3 millions et demi de sapeurs-pompiers, on compte de nombreux volontaires. En France, ces volontaires constituent 80 % des effectifs. Ils réalisent à eux seuls les deux tiers du temps d’intervention des services de protection.

Chers collègues, je voudrais ici tirer la sonnette d’alarme, car ce modèle nous semble en danger. Un arrêt de la Cour de justice de l’Union européenne, rendu en février 2018, a qualifié de temps de travail la situation d’un sapeur-pompier volontaire belge en garde à domicile. Les périodes d’astreinte de ce pompier volontaire ont été reconnues comme du temps de travail et lui ont été dédommagées.

Si cet arrêt fait jurisprudence, cela devra être précisé, mais nous craignons que cette brèche mène à une possible intégration des pompiers volontaires dans le champ de la directive «temps de travail». Les obligations que fixe cette directive en termes de temps de repos, de travail, mais aussi de congés rendraient donc incompatible l’activité de sapeurs-pompiers volontaires avec un emploi salarié.

Il y a donc un véritable risque que le volontariat soit confondu avec une charge de travail. Si tel était le cas, cela sonnerait la fin de notre modèle de secours. Cela mettrait également à mal l’engagement citoyen libre que représente le volontariat. Les conséquences de cette situation seraient dramatiques en raison de l’insécurité juridique.

L’Europe, bien entendu, est censée promouvoir les formes de volontariat et garantir la sécurité des citoyens. On se retrouve là avec une situation où ce serait tout l’inverse. Voilà pourquoi nous nous mobilisons, je me mobilise, avec mes collègues présents aujourd’hui, mais aussi avec l’ensemble de mes collègues du groupe PPE, et nous demandons que la portée de cette directive soit clarifiée. Nous demandons à la Commission européenne de mettre en œuvre des actions concrètes, un cadre pour restaurer la sécurité juridique du système des sapeurs-pompiers volontaires.

  Milan Brglez, v imenu skupine S&D. – Najlepša hvala, gospa predsedujoča, spoštovane in spoštovani.

Čeprav gre za zadnjo razpravo na tem plenarnem zasedanju, je ena ključnih. Posebej za socialistke in socialiste ter socialne demokratke in socialne demokrate. Zadeva namreč solidarnost kot našo temeljno vrednoto in tudi temeljno vrednoto Evropske unije, kot je navedena v 2. členu Pogodbe o Evropski uniji, ter seveda poslanstvu prostovoljne pomoči drugim. Ti dve skupaj res lahko tvorita evropski način življenja.

V številnih državah Evropske unije so prostovoljni gasilci steber varstva pred naravnimi in drugimi nesrečami. Prostovoljstvo na tem področju ima dolgo tradicijo. V Sloveniji tako letos praznujemo že 150 let prostovoljnih gasilcev in smo tudi država znotraj Evropske unije, ki ima največ prostovoljnih gasilcev glede na število prebivalcev, 150 000 vseh, 50 000 operativnih. Pravzaprav prostovoljni gasilci v nekaterih državah članicah predstavljajo celo do 90 % ali celo več vseh gasilcev.

In je to kombiniranje prostovoljnih in poklicnih enot šele tisto, ki omogoča odziv in pomoč v primeru požarov, naravnih nesreč, poplav, primerih težkih prometnih nesreč ter drugih stisk ljudi. In to tako v urbanih središčih kot na podeželju. Hkrati se pa gasilci v Evropi in širše uvrščajo v poklicno skupino ljudi, ki jim ljudje najbolj zaupajo. Zato so ključen del civilne zaščite, ker zagotavljajo osebno varnost prebivalcev ter prispevajo k javni varnosti.

Seveda obstajajo razlike med nacionalnimi sistemi in načini organiziranja prostovoljnega gasilstva, povsod pa to predstavlja plemenito poslanstvo. Posameznice in posamezniki ga opravljajo v prostem času in brez plačila oz. nadomestila kot bistvenega elementa delovnega razmerja. Ker za svoje plemenito delo oz. poslanstvo niso plačani, še posebej zaslužijo naše priznanje, pohvalo in zahvalo.

Varstvo in zaščita pred požari ter drugimi nesrečami je v osnovi pristojnost držav članic. S svojimi odločitvami in zakonodajnimi akti pa tudi poslanci Evropskega parlamenta posredno ali nehote vplivamo na status prostovoljnih gasilcev v Evropi. Ne zgolj pozitivno.

Direktiva Evropskega parlamenta in Sveta iz leta 2003 o določenih vidikih organizacije delovnega časa je bila sprejeta z namenom zaščite delavcev v Evropski uniji. Določa minimalne varnostne in zdravstvene standarde pri organizaciji delovnega časa v vseh državah članicah, kar je velik napredek glede zaščite pravic delavcev v Evropski uniji.

Izvajanje direktive, še posebej po odločitvi Sodišča v primeru Matzak iz maja 2018, v skladu s katero se čas dežurstva na domu tudi za prostovoljne gasilce, ki so zaposleni pri zasebnikih, šteje v delovni čas, pomeni, da bi lahko prostovoljke in prostovoljci zlahka presegli 48-urni delovni čas, torej maksimalni 48-urni delovni čas na teden, ter zahtevanih 11 ur dnevnega počitka. To je veliko tveganje za sisteme varstva pred naravnimi in drugimi nesrečami v članicah, saj bi lahko bilo prostovoljstvo onemogočeno.

Vendar pa kot socialni demokrat sem prepričan, da sta obstoječa zaščita in definicija delavcev ter prihodnja zaščita in spodbujanje prostovoljstva enako pomembni in se medsebojno ne izključujeta. Enega ne moremo žrtvovati v imenu drugega. Pravna pravila moramo kvečjemu izboljšati, da se oboje krepi.

Namreč, naravne in druge nesreče ne poznajo delovnika. Nepredvidljive so po obsegu in času. Nikoli ne bo dovolj poklicnih enot, še posebej izven urbanih središč. Zato moramo narediti vse, da se prostovoljstvo obdrži.

Omogočiti je treba usklajevanje poklicnih obveznosti in poslanstva prostovoljnega gasilca ali gasilke, z ukrepi spodbujati njihovo zaposlovanje ter skrbeti za njihovo opremljenost.

Mehanizem Evropske unije na področju civilne zaščite, projekt RescEU, ter še posebej koordinacijski center za krizno upravljanje, so dobrodošli za odzivanje na velike nesreče, zagotavljanje učinkovite solidarnosti med državami članicami in izmenjavo dobrih praks. Z njimi smo dobili rezervo na ravni Evropske unije, ki dopolnjuje nacionalne sisteme ter omogoča usklajevanje ali koordinacijo in delitev virov. Nujno pa je spoštovati načelo subsidiarnosti in preprečiti centralizacijo. Izogniti se je treba prekomerni regulaciji, upoštevati nacionalne tradicije in ne posegati v sisteme, ki dobro delujejo in jim ljudje zaupajo.

Z optimizmom me navdaja, da kandidat za komisarja za krizno upravljanje Janez Lenarčič zelo dobro pozna pomen in vlogo prostovoljnih gasilcev. Verjamem, da bodo prostovoljne gasilke in gasilci pod njegovim vodstvom resorja ustrezno umeščeni v okvir mehanizmov EU ter da bo v sodelovanju z državami članicami in drugimi članicami in člani Komisije prišlo do izboljšanja njihovega statusa.

Moram pa poudariti, da prostovoljstvo ni oblika dela. Zaradi dilem, ki so nastale z direktivo iz leta 2003 ter odločitvijo Sodišča EU, ne smemo spreminjati direktive in definicije delavca ali sprejemati izjem za posamezne države ali skupine držav. Zlasti pa ne smemo daljšati maksimalnega delovnega časa, temveč se kvečjemu zavzemati za njegovo skrajšanje na 35-urni tedenski delovnik.

Zato predlagam, da se pogovorimo o posebni direktivi, ki bi pokrila civilno angažiranje za storitve javne varnosti. Znotraj nje pa poskrbimo, da bodo primerno opredeljeni status, varnostni ter zdravstveni standardi ter možnost spodbud ali nagrajevanja tudi za prostovoljne gasilce in gasilke.

Prostovoljni gasilci namreč toliko prispevajo k naši družbi, da jim je družba in smo jim tudi mi kot poslanci Evropske unije dolžni nekaj dati nazaj.

  Ulrike Müller, im Namen der Renew-Fraktion. – Frau Präsidentin, Frau Kommissarin, liebe Kolleginnen und Kollegen! Im Grunde kann ich meinen Vorrednern zustimmen: Eine solche neue, separate Richtlinie müssen wir tatsächlich prüfen, und ich wäre froh, wenn wir hier Planungssicherheit für unsere Feuerwehren finden können.

In meinem Mitgliedstaat, in Deutschland, gibt es derzeit 1,1 Millionen aktive Feuerwehrleute; 95 % davon gehören der Freiwilligen Feuerwehr an. Es gibt nur etwa 100 Berufsfeuerwehren, aber 24 000 Freiwillige Feuerwehren. Ich selbst komme aus einer sehr ländlich geprägten Region im Oberallgäu; die nächste Berufsfeuerwehr befindet sich 150 Kilometer entfernt in Augsburg.

Das Ehrenamt beschränkt sich aber nicht nur auf die Feuerwehren. In ganz Deutschland gibt es 1,8 Millionen ehrenamtliche Helfer im Katastrophenschutz, bei der Feuerwehr und in den Rettungsdiensten. In meinem Bundesland, Bayern, sind 470 000 Rettungskräfte; davon sind 450 000 ehrenamtlich und freiwillig.

Diese Zahlen führen anschaulich vor Augen, dass das ehrenamtliche Engagement das Rückgrat unseres Feuerwehr- und Rettungswesens bildet. Aber nicht nur das. Gerade in den ländlichen Regionen spielt die Freiwillige Feuerwehr einen Mittelpunkt im sozialen Leben. Der Austausch aller Altersgruppen untereinander in allen gesellschaftlichen Schichten wird hier gezielt gepflegt. Dieses Engagement müssen wir deshalb fördern und schützen. Ehrenamt soll erfüllen und darf nicht frustrieren.

Nun haben wir diese europäische Arbeitszeitrichtlinie – meine Vorgänger sind darauf eingegangen –, und wir müssen natürlich feststellen, dass die freiwillige Arbeitszeit mit der Arbeitszeit aus den Erwerbsberufen nicht verrechnet werden darf. Das wäre eine Gefahr für unser komplettes Rettungssystem. In Deutschland sind wir viele Jahre davon ausgegangen, dass die Freiwilligendienste eben nicht in diesen Anwendungsbereich fallen. Und nun haben wir dieses Gerichtsurteil, das uns wieder große Sorgen bereitet, weil wir die Freiwillige Feuerwehr nicht als Arbeiter im Sinne eines normalen Berufslebens definieren dürfen.

Wir brauchen Rechtssicherheit, und wir brauchen Klarheit für unsere Freiwillige Feuerwehr. Leider ist es so, dass wir hier jetzt im Moment überhaupt nicht weiterkommen, und es bleibt uns und allen Ehrenamtlichen nur diese vage Aussicht, dass wir auf europäischer Ebene hier tatsächlich Lösungen finden.

Unser System der Freiwilligendienste hat sich bewährt und übernimmt eine wichtige Funktion im gewachsenen sozialen Gefüge. Wir müssen deshalb endlich handfeste Lösungen finden, damit das ehrenamtliche Engagement ohne Wenn und Aber europäisch weiter möglich bleibt.

  Guido Reil, im Namen der ID-Fraktion. – Frau Präsidentin, Frau Kommissarin, liebe anwesende vierzehn Mitglieder dieses Parlaments! Ich grüße Sie, und ich grüße ganz besonders herzlich die anwesenden Vertreter der freiwilligen Feuerwehr. Schön, dass ihr den weiten Weg nach Straßburg gefunden habt, um für euer Ehrenamt zu kämpfen.

Worüber reden wir heute? Wir reden über die Zukunft der freiwilligen Feuerwehr in Europa, und damit reden wir über die Sicherheit von Europa. Ich bin neu hier, und ich habe damit gerechnet, dass hier einiges beschlossen und diskutiert wird, was den Menschen in Europa nicht immer hilft, sondern schadet. Aber dass es so krass ist, konnte ich mir ehrlich gesagt in meinen übelsten Alpträumen nicht vorstellen. Ich frage mich auch gerade, was die Vertreter der freiwilligen Feuerwehr denken, wenn sie sehen, dass über dieses wichtige Thema hier um kurz nach drei mit vierzehn Abgeordneten diskutiert wird. Also haben die nicht mehr verdient? Haben die nicht mehr Aufmerksamkeit, nicht mehr Unterstützung verdient?

Also worüber reden wir? In Deutschland engagieren sich 1,1 Millionen Menschen in der Feuerwehr, 95 % ehrenamtlich – fünf-und-neun-zig Prozent!

Diese Menschen werden gebraucht. Sie leisten eine unglaublich wichtige Arbeit. Da geht es nicht nur um Sicherheit, da geht es auch um das gesellschaftliche Leben. Sie sind der Kern des gesellschaftlichen und kulturellen Lebens im kompletten ländlichen Raum. Dieses Engagement braucht Unterstützung und verdient unsere Unterstützung. Wir reden ständig davon, dass wir das Ehrenamt fördern wollen, und jetzt machen wir genau das Gegenteil. Wenn wir über das Thema Anrechnung von Arbeitszeiten auf ehrenamtliche Tätigkeiten reden: Wo fangen wir an, und wo hören wir auf?

Was ist mit dem Schützenkönig, der während des Festes auf dem Thron sitzt – verbringt er da seine Arbeitszeit? Was ist mit den Vertretern der Karnevalsvereine? Was ist mit Trainern, die Jugendmannschaften trainieren? Verbringen die da ihre Arbeitszeit? Das sind Themen, die grundsätzlich geklärt werden müssen und die mich wütend machen, dass wir überhaupt über so einen Quatsch sprechen.

Wir reden über völlig weltfremde Themen, die da draußen niemanden interessieren. Wir machen hier Probleme, wir erzeugen selbst Probleme, und das ist der Kern der EU. Ich fordere hier ganz klar: Finger weg von der freiwilligen Feuerwehr, Finger weg vom Ehrenamt, sofort! Glück auf!

  Joachim Stanisław Brudziński, w imieniu grupy ECR. – Pani Przewodnicząca! Jest takie polskie powiedzenie: „Dłużej klasztora jak przeora”. Pierwsze wzmianki o ochotniczej straży pożarnej, o tym, jak obywatele, ludzie potrafili skrzykiwać się, aby sobie nawzajem pomóc, jeżeli chodzi o Polskę, sięgają średniowiecza.

Dzisiejsze OSP, czyli Ochotnicza Straż Pożarna, ma w tej nowożytnej historii naszego kraju i Europy już ponad sto lat. Ta dyskusja, która ma tutaj miejsce, pokazuje, że czasami – jak mówi inne z kolei polskie powiedzenie – staramy się wylać dziecko z kąpielą. Zostawmy w spokoju tych, którzy od wieków potrafili radzić sobie również ze swoim czasem, tym czasem, który w sposób dobrowolny poświęcają na rzecz ratowania zdrowia, życia, dorobku własnego czy też sąsiadów.

Ja posłużę się liczbami. W Polsce jest ponad 16 tysięcy Ochotniczych Straży Pożarnych, z czego ponad 4 300 jednostek dzisiaj działa w ramach Krajowego Systemu Ratowniczo-Gaśniczego, czyli wspierają tę straż profesjonalną, państwową. To ponad 225 tysięcy strażaków-ratowników mogących brać udział w bezpośrednich działaniach ratowniczych. Łącznie Ochotnicze Straże Pożarne zrzeszają w Polsce prawie 700 tysięcy ludzi, w tym – co warte podkreślenia – 82 tysiące to dzieci i młodzież, bo tak jak była tutaj mowa, też na przykładzie innych krajów, te ochotnicze straże pożarne niejednokrotnie w swoich małych ojczyznach, w swoich gminach, w miejscowościach, gdzie działają, szczególnie na obszarach wiejskich, są takim ośrodkiem kulturotwórczym i tworzącym też więzi społeczne.

Rząd, który miałem zaszczyt reprezentować jako minister spraw wewnętrznych, odpowiedzialny również za straż pożarną, rząd Prawa i Sprawiedliwości w Polsce po raz pierwszy objął Ochotnicze Straże Pożarne programem modernizacji służb mundurowych. Po raz pierwszy ujednoliciliśmy przepisy prawne w taki sposób, aby można było wspierać Ochotnicze Straże Pożarne. Kończąc, chciałbym powiedzieć staropolskim zwyczajem druhnom i druhom Ochotniczych Straży Pożarnych: Szczęść Boże! I niech Wasz patron, święty Florian, ma Was zawsze w swojej opiece.

  Anne-Sophie Pelletier, au nom du groupe GUE/NGL. –Madame la Présidente, aujourd'hui, dans cet hémicycle, je suis ravie parce que nous essayons de rendre des invisibles visibles. Nos regards sont habitués aux pompiers, nous ne les voyons plus! Je parle d'hommes et de femmes que chacun de nous a probablement déjà croisés dans chacun de nos États membres, arrêtés au bord de la route ou alors noircis par des fumées d’incendie.

C'est grâce à leur force de vocation et de dévouement que tout cela est possible. De qui parlons-nous, alors? Comme je le disais, d'hommes et de femmes qui, partout, répondent aux appels de détresse, dans les grandes villes, les petits villages, par tous les temps, qu'il pleuve, qu'il neige, qu'il vente. À chaque moment, quand vous, vos proches ou vos amis, tous les citoyens et les citoyennes, auront besoin d'un secours, ils seront là, bienveillants; ils seront là, peut-être, pour sauver votre vie. Ces hommes et ces femmes, ce sont donc les pompiers. Hier encore, chers collègues, si vous avez pris les transports en commun comme moi pour venir au Parlement, vous n'avez pas pu échapper à cette une qui crie leur détresse.

Chers collègues, aujourd'hui, ces pompiers, nos pompiers voient rouge et c'est, je pense, le moment de les remercier dans cet hémicycle et de leur rendre hommage. J’ajoute qu’en France, il y a une grève des pompiers, et je leur apporte mon indéfectible soutien.

En France, comme dans la plupart de nos États membres, la grande majorité (80 %) des interventions sont menées par des équipes volontaires. Certes, les volontaires perçoivent une indemnité, c'est la moindre des choses! Mais quand allons-nous leur apporter véritablement la reconnaissance qu'ils méritent? Pendant leur service, ils ne bénéficient d’aucune cotisation retraite, d’aucune cotisation pour les risques qu'ils encourent, ni d’aucun statut protecteur. Nous ne pouvons accepter que ces hommes et ces femmes soient taillables et corvéables à merci, et je vous assure, chers collègues, que leur sécurité est de notre responsabilité.

Avant-hier, je discutais avec un sapeur-pompier des Pyrénées-Atlantiques. Il m’a raconté l’histoire d’un jeune sapeur-pompier volontaire de 21 ans qui a été brûlé aux mains, aux bras et aux cuisses en tentant de sauver ses collègues d'un incendie mortel. Aujourd'hui, ce jeune sapeur-pompier volontaire doit rembourser 9000 euros. Pourquoi? Parce que l'expertise médicale a considéré que ce n'était pas dans le cadre de son travail! Je vous pose la question: si c'était vous qu'il avait sauvé, vous qui, aujourd'hui, êtes assis confortablement dans votre fauteuil... mettez-vous à sa place! Double peine assurée, vous seriez à la fois touché dans votre chair et dans votre portefeuille, simplement pour avoir fait votre devoir.

Revenons donc sur le statut de volontariat. Effectivement, ce statut vient d'être remis en cause par un arrêt de la Cour de justice européenne, qui reconnaît la qualification de travailleurs, conformément à la directive sur la limitation du temps de travail. Nous ne pouvons qu'apprécier la trajectoire qu'elle indique. Toutefois, ce changement de statut implique un changement en profondeur de l'organisation des sapeurs-pompiers. Et beaucoup, je les vois, en appellent déjà à une exception à la directive. Alors, à ceux-là, à ces grands explorateurs à têtes de profit, je dis qu’ils se trompent fortement. Le statut de volontaire n'est pas la solution. Il faut en revenir au service et au bien commun. Pour terminer, je dirai que ceux qui nous protègent aujourd'hui ont besoin que nous les protégions, de sorte que leur devise, qui est «sauver ou périr», ne devienne jamais «sauver et périr».

  Sylvie Brunet (Renew). – Madame la Présidente, Madame la Commissaire, chers collègues, je tiens tout d’abord à remercier la Commission de cette communication, qui était fort attendue, en ce qui me concerne, sur ce sujet sensible, au vu des enjeux qui sont actuellement ceux des acteurs du modèle de secours.

Dans cette intervention d’aujourd’hui, qui est ma première intervention – puisque je suis une toute nouvelle députée – en séance plénière, en tant que députée européenne, permettez-moi d’insister sur trois points.

Mon premier point me permet de rappeler qu’il y a environ 3,5 millions de sapeurs-pompiers volontaires dans l’Union européenne et je tiens à saluer leur engagement au service de tous, comme l’ont fait mes collègues, à l’heure où les dérèglements climatiques entraînent, hélas, de plus en plus de catastrophes naturelles.

C’est ainsi qu’il faut bien mesurer l’émoi provoqué par l’arrêt Matzac. Cet arrêt de la Cour, en considérant le temps de volontariat de certaines catégories de sapeurs-pompiers effectuant une garde à domicile comme du temps de travail, a pu surprendre tout en concernant une situation bien spécifique, qui n’est pas celle de tous les sapeurs-pompiers volontaires. Dans ce contexte, il est évident que cette première clarification est plus que bienvenue – merci pour cela, Madame la Commissaire.

J’en viens à mon second point. Je vous ai écoutée attentivement, Madame la Commissaire. J’ai bien noté que, selon la Commission, il fallait tenir compte des spécificités des modèles nationaux. J’ai également entendu que vous aviez rappelé, à juste titre, l’importance du principe de subsidiarité en cette matière. Je m’en réjouis. Cette approche devrait permettre de préserver l’organisation matérielle de nos services de secours et de garder intacte la possibilité de mobiliser des hommes et des femmes en situation d’urgence dans toute l’Union européenne. C’est bien évidemment cette préservation que j’appelle de mes vœux.

Enfin, mon troisième point est d’ordre plus général. Le débat de ce jour constitue l’occasion de rappeler la nécessité impérieuse de soutenir les mécanismes de protection civile par les instruments européens appropriés. Nous devons davantage encourager la coordination de nos systèmes de secours. Il nous faut consolider le mécanisme européen de sécurité civile, mutualiser nos moyens et nos scénarios de secours en cas de crise, ainsi que partager nos expertises.

Pour conclure, je souhaiterais exprimer mon soulagement à la suite de cet échange en plénière, aujourd’hui. Préservons ces modèles nationaux de sécurité civile, dont certains sont plus particulièrement fondés sur l’altruisme et le volontariat, qui fonctionnent bien et garantissent la proximité territoriale des secours. En même temps, dynamisons l’action de l’Union européenne par les leviers et au niveau où elle est efficace.

C’est pour cette Europe-là que je m’engage, celle qui protège toujours mieux ses citoyens, celle qui soutient les différentes formes d’engagement dans la société, celle qui leur permet d’exprimer concrètement ce qu’est la solidarité et le don de soi pour la collectivité.

  André Rougé (ID). – Madame la présidente, chers mais trop rares collègues, courage et dévouement, devise des sapeurs-pompiers volontaires, ces deux mots sont là pour nous rappeler, si besoin était, que chaque jour, des femmes et des hommes sapeurs-pompiers volontaires et professionnels sont prêts au sacrifice de leur vie pour sauver les nôtres. Chaque jour, des Français, agriculteurs, artisans, entrepreneurs de TPE et PME entre autres, endossent l'uniforme pour nous venir en aide.

Pour autant, le courage et le dévouement de cet engagement généreux pour la collectivité est bien mal récompensé. Chaque jour nos pompiers sont agressés en intervention. Nos sapeurs-pompiers volontaires se sentent bien seuls et bien mal considérés. Leur situation ne semble pas s'être améliorée depuis la dernière intervention de Marine Le Pen sur le sujet l'an passé.

La jurisprudence de la Cour de justice de l'Union européenne rendra impossible la conciliation de leurs services et d'une activité professionnelle. Pour des raisons comptables, budgétaires et surtout citoyennes, la professionnalisation intégrale ne doit pas être concevable. Les secours au quotidien et en temps de crise ne seront plus assurés comme ils le sont aujourd'hui, au détriment des Français et de la résilience de notre société.

Le modèle français de sécurité civile est basé sur le volontariat, qui représente 80 pour cent des effectifs de sapeurs-pompiers en France. Toute professionnalisation n'étant ni souhaitable, ni envisageable, il est donc indispensable d'adopter une directive spécifique durant cette nouvelle mandature européenne. Au-delà du débat juridique, l'enjeu est politique et civique, il concerne d'autres pays européens. Il s'agit là d'un choix de valeurs et de société. Un sapeur-pompier volontaire s'engage aujourd'hui par choix pour protéger ses concitoyens et son territoire.

Dans le contexte de l'accélération et de l'augmentation des crises de sécurité civile, il est plus que jamais nécessaire de pouvoir compter sur l'engagement citoyen des sapeurs-pompiers volontaires partout en Europe. C'est pourquoi au groupe ID et au Rassemblement national que préside Marine Le Pen, nous adhérons aux propositions de la Fédération nationale des sapeurs-pompiers de France.

Ja chcę podziękować pani komisarz, po pierwsze, za wyrazy szacunku dla ochotniczych straży pożarnych i za podkreślenie różnorodności sposobu funkcjonowania ochotniczych straży pożarnych w Unii Europejskiej. Myślę, że przeregulowanie może tylko wolontariatowi i stowarzyszeniom – bo tak w Polsce funkcjonuje ochotnicza straż pożarna – zwyczajnie zaszkodzić. Nasze dyskusje powinniśmy przenieść do wewnątrz swoich krajów.

Ja mam zaszczyt reprezentować Polskę i mogę powiedzieć, że w ciągu ostatnich trzech lat znacznie wzrosły nakłady. To są właśnie te decyzje i czyny wsparcia, i podkreślenie tego szacunku dla ochotniczych straży pożarnych. To są pieniądze i wzrost o 30%...

  Ангел Джамбазки (ECR). – Г-жо Председател, уважаеми колеги, уважаема г-жо Комисар, през последните няколко години сме свидетели на много инциденти, свързани със сигурността и застрашаващи живота на гражданите на нашите държави. Особено последните месеци и седмици бяхме свидетели на мащабни пожари, които изпепеляват по пътя си имоти, имущество и застрашават живота на гражданите.

В помощ на редовно служещите пожарникари често се присъединяват и доброволци. Самият аз съм доброволец и съм участвал в гасенето на горски пожари и знам от първо лице колко е трудна тази задача и колко е трудна тази работа. Не трябва да позволяваме регулацията в законодателството на европейско равнище да застрашава статута, живота и здравето на доброволците-пожарникари в страните членки.

През 2018 година Съдът на Европейския съюз в свое дело определя, че времето, което белгийски гражданин прекарва като пожарникар-доброволец, трябва да се зачита като работно време. Това води до прецедент в някои от страните членки, в които доброволчеството е регулирано на национално ниво и на практика би означавало, че пожарникарите-доброволци ще имат по две работни места. Мисля, че на всички е ясно до какви проблеми може да доведе всичко това.

Директива 2003/88 относно аспектите на организацията на работното време е договаряна и изготвена в различен контекст от днешния, като нейната цел в никой случай не би трябвало да бъде да заплашва или да демотивира доброволците, а да защитава правата на уязвимите служители. При цялото ми уважение към дейността на Европейския съд смятам, че не бива да оставяме да ни ръководят тълкувания на Съда, особено по този казус, който вместо да внесе правна яснота, създава правен хаос в множество страни членки и то в сфери, свързани със защитата на здравето и живота на гражданите и околната среда.

Смятам, че трябва да работим за постигане на решение по този въпрос, така че да се избегне създадената заплаха върху статута и мотивацията на пожарникарите-доброволци.

Rzeczywiście nie jest nas tutaj dzisiaj wielu na tej sali, ale pochodzimy z różnych grup politycznych i z różnych krajów, i wszyscy właściwie mówimy to samo. Bo rzeczywiście jednostki ochotniczych straży pożarnych to ważny element systemu bezpieczeństwa we wszystkich państwach członkowskich. Służba ta jest przykładem odwagi i poświęcenia niesionego bezinteresownie i często z narażeniem życia. Ale to także jest wspaniały przykład budowy kapitału społecznego, a o to nam chodzi.

W wielu miejscowościach w moim regionie, w moim okręgu wyborczym, historia takich jednostek sięga początku XIX wieku, na przykład w Nakle, w Rynarzewie czy w Kcyni, gdzie straż ma już ponad dwieście lat.

Szanowni Państwo! Skoro taka zgoda tutaj na tej sali panuje, to chciałbym podkreślić, Pani Komisarz, że zgadzam się z socjalistycznym posłem panem Brglezem, który powiedział, że dużo otrzymujemy od strażaków i dużo musimy im dać.

  Marianne Thyssen, Member of the Commission. – Madam President, honourable Members, I have listened attentively to your interventions and I hope I was able to allay some of the worries that have been expressed concerning the status of volunteer firefighters in the European Union.

Volunteer firefighters are a pillar of emergency and civil protection services in many Member States and their contribution to the efficiency of those services is undisputed. I can add that I have a great personal respect for their commitment.

The organisation and the functioning of firefighting services is and remains a competence of individual Member States and each Member State has its own specificities and needs. But it is important to protect the health and safety of volunteers and to ensure that the status of volunteer is not used to circumvent labour law where such law is applicable.

As I explained in my introduction, the existing rules offer the flexibility to organise this.

Now, from my side, I am happy to facilitate contacts between different Member States that might be affected by the Matzak ruling of the Court of Justice so that there is a platform to discuss solutions that were found in many Member States.

A specific directive for civil protection has been proposed by the French Senate and by the Fédération nationale des sapeurs-pompiers. I doubt whether this is really necessary, or whether this is the best solution, but you understand that as a member of the outgoing Commission, I cannot commit the next Commission to initiate such a proposal. But I’m happy that I could give you some elements – the key elements, I think – to take a well-informed position in the discussion that you will for sure continue with my successor.

  Klemen Grošelj (Renew), pisno. – Vloga in pomen prostovoljnih gasilcev in drugih prostovoljcev v sistemu varstva pred naravnimi in drugimi nesrečami se zaradi vse hujših posledic naravnih in drugih nesreč povečuje.

Pozivam Komisijo, naj se loti priprave evropskega pravnega okvira, s katerim se bo ustrezno in pravično uredil njihov položaj. Dejstvo je, da zaradi podnebnih sprememb postajajo posledice naravnih nesreč vse hujše in obsežnejše, delo prostovoljnih gasilcev in tudi drugih prostovoljcev v sistemih kriznega odzivanja pa vse zahtevnejše in odgovornejše. Zato mora temu slediti tudi ureditev njihovega položaja, predvsem ureditev njihovega ekonomsko-socialnega in pravnega položaja.

V ospredju je seveda vprašanje odnosa z delodajalci, kjer moramo najti ustrezno sistemsko rešitev razmerja med prostovoljnim gasilcem in njegovim delodajalcem. Seveda pa to ni edina dilema, gre tudi za vprašanje pravne odgovornosti, zavarovanja za z reševanji povezanimi tveganji itd.

Zato še enkrat pozivam Komisijo, da se tega vprašanja loti prednostno.

  Karol Karski (ECR), na piśmie. – Strażacy to grupa zawodowa, która niezmiennie od lat cieszy się ogromnym, jeśli nie największym, zaufaniem społecznym. Wynika to m.in. z tego, że na strażaków możemy liczyć nie tylko w przypadku pożarów, klęsk żywiołowych, katastrof, lecz także wielu innych zagrożeń.

Kilka miesięcy temu, właśnie tu w Strasburgu delegacja Prawa i Sprawiedliwości zorganizowała wystawę, która była ilustracją prawdziwej europejskiej solidarności – bohaterskich polskich strażaków, którzy w ubiegłym roku pomagali w akcji gaszenia pożarów w Szwecji.

W mojej Ojczyźnie, Polsce, ochotnicze straże pożarne odgrywają ogromną rolę, zwłaszcza w codziennym życiu małych, lokalnych społeczności. To wokół nich często koncentrują się nie tylko akcje ratownicze, ale także wydarzenia oświatowo-kulturalne czy sportowe. Ta rola została uznana przez Rząd Rzeczypospolitej Polskiej, który objął ochotnicze straże pożarne wsparciem ustawowym, co umożliwi nie tylko propagowanie zasad udzielania pierwszej pomocy, ale także ochrony i prewencji przeciwpożarowej. Regularnie przekazywane są także znaczące środki na sprzęt oraz szkolenia dla strażaków-ochotników. Mamy świadomość, że to oni niejednokrotnie ratowali ludzkie zdrowie i życie, a te wartości nie mają ceny. Dlatego ich postawa zasługuje na najwyższy szacunek i wsparcie.

  Ádám Kósa (PPE), írásban. – Az önkéntes tűzoltó egyesületek, az önkéntes mentőszolgálatok és a polgári védelem tagjai nagyon fontos szerepet töltenek be egész Európában és így Magyarországon is. Önkéntesen, saját munkájuk mellett, szabad idejükben védik emberek életét, egészségét, anyagi értékeiket, a lakosság alapvető ellátását, a természeti környezetet, a természeti értékeket. Komoly szakértelmet igénylő és sokszor veszélyes munkájuk nagy elszántságot igényel, teljesítményük tiszteletre méltó. A nemzeti sajátosságok és szokások mentén eltérőek az EU tagországaiban a rájuk vonatkozó szabályok, így munkaidejük szabályozása is. Fontos azonban, hogy a szubszidiaritás elvét tiszteletben tartva ez így is maradjon, és a tagállamok maguk dönthessék el, melyek az önkéntes munkavégzés feltételei és milyen óraszámban végezhető ez a fontos tevékenység és milyen hosszú pihenőidőre jogosultak.

Megragadom az alkalmat és kiemelem itt azt is, hogy Magyarországon az okostelefonokra, valamint táblagépekre kifejlesztett, országosan és ingyenesen elérhető veszélyhelyzeti tájékoztató rendszert (VÉSZ) használók friss ismeretekhez juthatnak a lakóhelyük, az úti céljuk által érintett területek, figyelt útvonalak, megyék, vagy akár az egész ország aktuális helyzetéről, tűzesetekről, balesetekről, áramkimaradásról vagy a meteorológia által kiadott figyelmeztető és riasztási jelzésekről. Az applikáció használatával megelőzhetők a balesetek, növelhető a felhasználó biztonsága.

  Leszek Miller (S&D), na piśmie. – Ochotnicze straże pożarne są niewątpliwie bardzo ważnym elementem w systemie ratowniczym większości państw członkowskich UE. Ich członkami są odpowiednio przeszkolone kobiety i mężczyźni, którzy w ramach powierzonych zadań najczęściej jako pierwsi niosą ofiarną pomoc poszkodowanym na miejscu zdarzenia. Ściśle współdziałają również z innymi służbami w celu zapewnienia bezpieczeństwa obywateli na terenie swego działania (miasta, gminy) lub obszarów sąsiednich.

W województwie wielkopolskim w Polsce, którego mieszkańcy powierzyli mi mandat posła do PE, funkcjonuje ponad 1 800 jednostek OSP zrzeszających blisko 96 tys. ochotników. Większość z nich stanowią wprawdzie mężczyźni, jednak drużyny kobiece są również bardzo liczne, gdyż skupiają ponad 2,5 tys. członkiń. Warto podkreślić, że w Wielkopolsce funkcjonuje również ponad 1 000 młodzieżowych drużyn pożarniczych z 13,4 tys. członków, w tym blisko 5 tys. dziewcząt.

Uważam, że ciężka praca ochotniczych straży pożarnych zasługuje na najwyższe uznanie. Z tym większym niepokojem przyjmuję informację o zagrożeniach, jakie mogą wynikać dla statusu służb ochotniczej straży pożarnej w Unii Europejskiej. Jestem głęboko przekonany, że powinniśmy podejmować wszelkie działania, by status strażaka ochotnika w UE pozostał nienaruszony. Co więcej, Komisja Europejska i Parlament powinny pamiętać, że skuteczność działania ochotniczych straży jest uzależniona w dużym stopniu od tego, czy dysponują specjalistycznym sprzętem przeciwpożarowym i czy są właściwie dofinansowane.
