 Subject:  Compensation for the closure of the Castor project
 Answer in writing 

Royal Decree Law 13/2014 enacted by the Spanish Government, adopting urgent measures relating to the gas supply system and the ownership of nuclear power plants, recognises that compensation of EUR 1 350 729 is payable to Escal Ugs, S.L., the holder of the concession to operate the Castor underground natural gas storage facility. Payment of this compensation has now been enforced by Enagás Transporte, S.A.U., the company entrusted with administering the facilities, where operations have been suspended indefinitely.

By reason of the payment obligation established under the aforementioned royal decree law, Enagás Transporte S.A.U. will be the holder of a collection right over the gas supply system, payable out of the billing for gas supply system access tolls and charges over a period of 30 years until the full amount has been paid.

1. Taking into account that the facilities were never operational, does the Commission consider it appropriate for the concession holder to be paid this compensation?

2. Does the Commission consider that this compensation may constitute a state aid that is incompatible with Article 107 of the TFEU?

3. Does the Commission intend to launch an enquiry to clarify whether this compensation is in compliance with European legislation?
