 Subject:  Law on Public Safety
 Answer in writing 

Following the Spanish Parliament’s approval of the Law on Public Safety, a bill opposed by a broad majority of Spanish society, including the police union, the Sindicato Unificado de Policía, we believe that this law infringes the fundamental rights of freedom of assembly and peaceful protest recognised in Articles 11 and 12 of the EU Charter of Fundamental Rights, together with Article 49 regarding the proportionality of offences and penalties.

For its part, the amendment to the Law on Foreigners covering on-the-spot removals infringes Article 18 of the Charter.

For all these reasons, we denounce the non-democratic nature of the law and urge the EU to protect the rights of European citizens.

1. Does the Commission believe that this law upholds the above rights?

2. Does the Commission intend to take action to prevent the legalisation of ‘fast-track returns’, which are at odds with international and EC law?
