Wohnungsbau GmbH in Coburg is controlled by the City of Coburg and performs works contracts for the city. A registered association holds a share of 0.9%. The association is involved on a cultural level and has no form of economic interest.

Does Wohnungsbau GmbH have to compete for works contracts for the City of Coburg in a public procurement procedure because a private investor (the association) has a share in the company?

Does Directive 2014/24/EU, which is designed to prevent competitive advantages for private investors by prescribing public procurement procedures, apply in the case of Wohnungsbau GmbH?

Are the judgments delivered in cases C-26/03 and C-574/12, which involved mixed-economy undertakings, relevant?
