According to Article 13 of Directive 2000/43/EC,(1) Member States shall designate a body or bodies for the promotion of equal treatment of all persons without discrimination on the grounds of racial or ethnic origin. The competences of these bodies must include: providing independent assistance to victims of discrimination in pursuing their complaints about discrimination, conducting independent surveys concerning discrimination, and publishing independent reports and making recommendations on any issue relating to such discrimination.

The Commission monitors strictly the correct transposition of this provision.(2)

Spain has complied with its obligations under Article 13 of Directive 2000/43/EC to designate the body for the promotion of equal treatment on the grounds of racial or ethnic origin by assigning officially the related competences to the ‘Consejo para la Promoción de la Igualdad de Trato y no Discriminación de las Personas por el Origen Racial o Étnico’(3).

All 28 Member States have designated a body or bodies for the promotion of equal treatment on the grounds of racial or ethnic origin within the meaning of the directive.

Regarding the implementation of Directive 2000/43/EC, the Commission would refer the Honourable Members to its report on the application of the two antidiscrimination directives.(4)
