 Subject:  Fraudulent payments in Spain to people who are not farmers
 Answer in writing 

The complaint before the European Commission, recorded under No CHAP(2015)00540, alleges that Spain has been making payments under the single payment scheme to legal and natural persons who have leased out their lands to farmers, but these legal and natural persons have retained the single payment rights and applied for the aid payments in relation to the lands that they have leased out to farmers.

The initial allocation of Basic Payment Scheme rights to people who, although they do not meet the conditions established in the provisions of Article 33(1) of Regulation (EC) No 73/2009 of the Council due to the fact that they are not farmers, have been receiving aid in breach of the provisions of the aforementioned Regulation, is particularly relevant here in 2015, if one takes into consideration the fact that the provisions of Article 26 of Regulation (EU) No 1307/2013 shall be applicable.

Does the Commission intend to use the powers attributed to it by virtue of Article 17(1) of the Treaty on European Union to recover the direct aid payments made to people who were not farmers and to halt the spread of this manner of artificially creating the conditions for obtaining benefits under the Basic Payment Scheme by the Spanish government?
