Commission Implementing Regulation (EU) 2015/1998(1) requires that a crew identification card of a crew member employed by a Union air carrier may only be issued to a person that has successfully completed a background check that covers, amongst others, criminal records in all states of residence during at least the preceding five years. The regulation does not foresee exemptions for crew members that are nationals of third countries or that resided in third countries during the preceding five years if they are employed by a Union air carrier.

In its inspections of the appropriate authorities in the different Member States the Commission verifies that background checks cover the legal requirements irrespective of the nationality and places of residence in the preceding five years of the applicant.

The Commission will contact the European Free Trade Association (EFTA) Surveillance Authority that is mandated to monitor the application of the abovementioned Regulation in Norway in order to ensure that background checks carried out by the Norwegian authorities comply with the legal requirements.
