 Subject:  Implementing Directive 2011/7/EU of the European Parliament and of the Council on combating late payment in commercial transactions in other Member States
 Answer in writing 

1. How was Directive 2011/7/EU of the EP and of the Council on combating late payment in commercial transactions of 16 February 2011 (OJ L 2011.48.1) implemented in other Member States, in particular with respect to the method used to pay out the sum of EUR 40 (lump sum/reimbursement of expenses/redressing damages) and to the identification of all conditions that must be met in order to receive compensation?2. Must the person demanding payment of the sum of EUR 40 prove that costs have actually been incurred in recovering the debt?3. Is there case-law from national courts concerning the recovery of the sum of EUR 40 and the application of the directive? Please indicate the database of judgments, provided that it is generally available, or provide the case-law.
