Parliamentary questions
PDF 101kWORD 15k
12 October 2016
Question for written answer E-007696-16
to the Commission
Rule 130
Richard Sulík (ECR)

Subject:  Loi Macron — lack of an adequate answer
 Answer in writing

Following the Commission’s failure to give an answer to either of the two questions posed in parliamentary Question P-005990/2016 — it simply referred to the replies given to other parliamentary questions, which were in fact related in terms of topic but not in terms of content — I would like once again to ask for a reaction to the following questions.

From 1 July 2016, the French regulation on the minimum wage, the Loi Macron, has been in effect, which stipulates that a driver — who may be an employee whose employment relationship is governed by law other than by French law — must be paid the minimum wage specified by French law when loading or unloading goods in France. In addition, employers must meet a number of administrative obligations related to this, which are a drain on their staff and finances.

— Is the Commission aware that the application of this regulation has been suspended, or that France is failing to conduct checks on compliance with this regulation?— Will the Commission proceed swiftly with the infringement proceedings that have been initiated than in the case of the analogous German regulation? In other words, does the Commission expect to take the next step before a whole year has gone by since dispatch of the letter of formal notice?
