 Subject:  Exclusion of local action group
 Answer in writing 

By Order No 507 of 8 November 2016 the Regional Administrative Court of Apulia allowed the appeal by the Municipal Council of Monopoli against the Regional Government of Apulia and the Managing Authority for the Rural Development Programme 2014-2020 on its exclusion from the European Agricultural Fund for Rural Development.

Subsequent to this decision, the call for the selection and formation of new local action groups remains at a standstill.

It is feared that this will result in a delay of several months and block around EUR 100 million in funding.

In reply to a question and in an official press release, the Apulia Regional Government's Minister responsible for agriculture said that: ‘an article in the partnership agreement, read calmly, would seem to say that areas B of the new institution may also be eligible. Obviously, I do not apportion the blame for this on our organisation, because this particular method of interpretation has been imposed on us in some specific correspondence from the European Commission…’ and that the European Commission has always ‘guided the regional government in defining eligible territories, through its non-negotiable instructions’.

Can the Commission make known the contents of the correspondence from the Commission referred to here, and what were the non-negotiable instructions that determined the exclusion of some municipalities in Apulia and their subsequent appeal? If this correspondence is confidential, can the Commission give details of the instructions it gave the Apulia Regional Government?
