The Court of Justice of the European Union judgment upheld the appeal brought by the Council of the European Union and set aside the judgment of the General Court delivered on 10 December 2015. Therefore, the Council Decision concluding the European Union-Morocco Agricultural Agreement remains valid.

The European Union is naturally obliged to abide by the judgment and is therefore carrying out a thorough analysis of the considerations of the judgment. Technical discussions are ongoing to map out the way forward.

However, it should be clarified that there is no prohibition, embargo or ban on imports of products from Western Sahara into the European Union.

The EU recalls its support to the UN Secretary-General’s efforts to achieve a just, lasting and mutually acceptable political solution, which will provide for the self-determination of the people of Western Sahara in the context of arrangements consistent with the principles and purposes of the Charter of the UN.
