 Subject:  Processing of personal data and health-related innovation
 Answer in writing 

On 31 March 2016, IBM signed an agreement to set up the Watson Health European Center of Excellence in Milan, one stage in that process being to acquire healthcare data held by Lombardy Region and the Italian Medicines Agency. The public have not been told how these data are to be used.

Under Regulation (EU) No 2016/679 genetic or biometric data and data concerning a person’s health may not be processed except in ten specific cases. These include cases where the data subject has given his or her explicit consent; cases where processing is necessary for the purposes of preventive or occupational medicine; and cases where processing is necessary for reasons of public interest in the area of public health, such as ‘ensuring high standards of quality and safety of healthcare and of medicinal products or medical devices’.

— Could the use of cognitive computing systems in the health field jeopardise the rights and freedoms of natural persons?— What safeguards should be applied in order to ensure that data are processed properly and transparently without adversely affecting data subjects?— Does the Commission know whether Italy has continued to enforce conditions as regards the processing of genetic, biometric, or health-related data or whether it has added any further conditions?
