 Subject:  Spanish Government agreement with the pharmaceutical industry and access to autonomous financing for the autonomous communities
 Answer in writing 

In December 2016, the Spanish Ministry of Finance and Public Service and the Ministry of Health, Social Services and Equality signed an agreement with the pharmaceutical industry aimed at helping to ensure the sustainability of pharmaceutical and health spending by seeking to guarantee fixed spending on original medicines by means of incentives(1).

The Autonomous Liquidity Fund that was set up to finance the autonomous communities (a financing scheme that is currently under review owing to the underfinancing of certain autonomous communities and the resulting unfairness) lists the signing of the above agreement as one of the conditions that must be met in order to receive funding (see Spanish Government orders PRE/710/2016 (point 1A) and PRA/360/2017(2).

This requirement could represent a twofold breach of competition law: 1. the rules of the European internal market, since it guarantees a fixed market for the industry, and 2. in relation to competition with the generics industry. It also prevents the autonomous communities from adopting other measures to cut back on pharmaceutical spending.

What action provided for in European legislation will the Commission take to ensure that Spain remedies this situation?
