 Subject:  Restriction of freight traffic along the Brenner Pass
 Answer in writing 

The Austrian Government has recently announced its intention to introduce measures to contain freight traffic across the Brenner Pass. If implemented, this proposal would hugely penalise the transport and manufacturing sectors in both Italy and Europe.

Furthermore, possible restrictions on freight traffic across the Brenner Pass would be an unacceptable limitation of one of the four fundamental freedoms on which the European Union is based, namely freedom of movement of goods.

With this in mind, can the Commission say whether it deems the Austrian Government’s proposal to be compatible with the freedom of movement of goods established by the Treaties?

Does the Commission not agree that this proposal will cause the same damage as that which led to its decision to reject the ecopoints system, considered to be detrimental to the free movement of goods?

Will it impose penalties on the Member State in question, in order to prevent the Italian and European transport and manufacturing sectors from being undermined and damaged by measures which run counter to EU principles?
