Article 20 of the Tobacco Products Directive(1) introduced for the first time EU-wide safety and quality rules for electronic cigarettes and refill containers. It also sets out requirements for nicotine containing liquid, including the prohibition of certain additives.

However, the directive does not harmonise all aspects of electronic cigarettes or refill containers, including flavourings and the composition of nicotine-free refill liquids.

Moreover, the directive does not harmonise the rules on domestic sales arrangements of electronic cigarettes. Member States therefore remain free to regulate such matters provided that national measures always comply with the Treaty on the Functioning of the European Union(2).

Italy has not submitted a notification under Directive (EU) 2015/1535(3) of draft measures limiting the free movement of refill liquids for electronic cigarettes.

As regards cross-border sales, the Tobacco Products Directive expressly authorises Member States to prohibit such sales in respect of electronic cigarettes and refill containers.

The nature of the specific measures imposed on the sale of the substances concerned mentioned by the Honourable Member would determine whether or not they are subject to the rules set out in the directive or whether they remain subject to rules on the Treaty more generally.
