The Commission is not informed about the composting plant project mentioned by the Honourable Member and cannot state whether it is compatible with Directive 92/43/EEC(1) (‘Habitats Directive’) and Directive 2009/147/EC(2) (‘Birds Directive’). In accordance with Article 6(3) of the Habitats Directive, it is a duty of the national authorities to assess, on a case by case basis, whether a project could have significant negative effects on a Natura 2000 site in view of its conservation objectives and to authorise it only after having ascertained that it will not adversely affect the integrity of the site. If it is determined that a project will adversely affect the site, the national authorities may still authorise it if the conditions for a derogation set out in Article 6(4) of the Habitats Directive are met.
