Not all civil aircraft are equipped with a fuel jettisoning system. This system is only required when the aircraft is not capable to meet certain certification specifications and for a good number of models it remains an option as it allows the aircraft to land faster than it would have taken it in case it had to burn the fuel, which may be an essential benefit from the safety perspective in certain circumstances.

The procedures concerning fuel jettisoning, including the minimum altitude from which fuel is considered to evaporate, that operators have to comply with, are laid down in Regulation (EU) No 965/2012. Where fuel can be jettisoned has to be decided by the Member State.

Taking into account the preventive and protective measures mentioned above and their importance from a safety perspective, the evidence available does not appear to be sufficient at this stage to indicate added value of undertaking specific actions by the Commission to prevent fuel from being jettisoned by civil aircraft.

Military Aircraft operations are under the regulatory control of the Member States and, while the Member States are encouraged to ensure that such activities have due regard as far as practicable to the objectives of the regulation on common rules in the field of civil aviation and its implementing rules, the Commission is not empowered to act in this area.
