The Commission's decision(1) approved the scheme notified by Italy in 2016 relating to the provision of rail freight transport services, with the specific aim of supporting intermodality.

The Commission found that the scheme was in line with the conditions set out in the Railway Guidelines(2) for the compatibility with the internal market of state aid .in the form of compensation of infrastructure charges and reduction of external costs.

These conditions entail specific limitations on the total amounts of aid that can be lawfully disbursed to one beneficiary from different sources, as well as ceilings on the disbursed aid. In addition, according to paragraph 110 of the Railway Guidelines, the aid has to be reflected in the price demanded from shippers.

Railway undertakings committed therefore to reflect the compensations in the rates charged to the shippers, and the Italian authorities would monitor the implementation. The available data at the time of the decision showed that railway undertakings effectively passed on to the market a significant part of the subsidies(3).

In view of the above, the information from the Honourable Member does not give indications of a possible breach of the state aid rules.
