Question for written answer E-002149-18
to the Commission
Rule 130
David Casa (PPE)

 Subject:  Compatibility with EC law
 Answer in writing

In the light of the ongoing public debate on the need to consider the introduction of legislation against strategic lawsuits against public participation (SLAPPs), can the Commission state whether individual Member States are precluded under EC law from introducing anti-SLAPP legislation at national level, and in particular whether they are precluded from doing so under Regulation (EU) No 1215/2012 and/or under the European Enforcement Order Regulation (EC) No 805/2004, or indeed under any other EU act?
