Note 3 to CETA Annex 19-5 caters for the possibility of negotiations with a view to extending mutual market access commitments in the area of public procurement.

Such negotiations would presuppose that the procurements to which access is granted to Canadian bidders under the same conditions as EU bidders be covered by the EU acquis on public procurement. As a matter of principle, the EU does not make a commitment in a bilateral Free Trade Agreement (FTA) that would result in the EU Directives having to be modified.

No such negotiations have been initiated and no plans exist at this time to start them.
