1. As guardian of the Treaties, the Commission performed conformity checks in order to assess the compatibility of national transposition measures with the provisions and obligations of the directive 2010/63/EU(1).

As the Commission pointed out in its reply to Written Question P-000292/2018, investigations into correct transposition of Directive 2010/63/EU were opened against several Member States. For the remaining Member States, the necessity of an investigation has not yet been established and the verification of the national transposition measures is still ongoing.

2. Following amendments of national legislation and/or explanations received from the national authorities, two of the opened investigations have been closed(2). In addition to the 4 Member States(3) against which infringement procedures were already initiated, the Commission decided on 19 July 2018 to open infringement procedures against six Member States(4) regarding shortcomings in their enactment of Directive 2010/63/EU into domestic law.(5)

The Commission will continue the verification of the national transposition measures for other Member States and will take the appropriate action to ensure that the directive is correctly transposed.

3. As mentioned above, the Commission initiated an infringement procedure against Germany on 19 July 2018.
