 Subject:  Possible infringements of EC law specifically in relation to the ‘Pedemontana Veneta’ expressway
 Answer in writing 

Question P-003606-17 cited the report(1) by the Court of Auditors which highlighted the risk of infringements of EC law regarding the construction of the Pedemontana Veneta expressway in relation to project financing. The Commission replied to this question.

In the more recent decision No 5/2018/G(2) from the Court of Auditors on 21 March 2018, these risks were confirmed. The summary of the decision states that ‘the amendments to the concession report also appear problematic with regard to EU competition rules’.

In the light of the above, can the Commission say, specifically in relation to the Pedemontana Veneta expressway (and not to its counterpart being constructed in Lombardy), whether, following its protracted discussions with the Italian authorities, it has finally acquired the elements necessary to initiate an infringement procedure on the specific case of the Pedemontana Veneta expressway being built in the Veneto region, particularly with regard to the rules on state aid?

Given the information provided in the new decision, can the Commission also say if it plans to initiate an infringement procedure? What other actions is it taking or does it plan to implement to ensure the correct application of EC law?
