 Subject:  Implications of Achmea ruling for Vattenfall v Germany
 Answer in writing 

1. Does the Commission intend to request an opinion of the Court of Justice of the European Union (CJEU) as to the applicability of the Achmea ruling (C-284/16) to the Vattenfall v Germany arbitration proceedings at the International Centre for Settlement of Investment Disputes (ICSID)?

2. Has the Commission held talks with the German and/or Swedish Government(s) with a view to Sweden and Germany jointly requesting an opinion of the CJEU as to the applicability of the Achmea ruling (C-284/16) to the Vattenfall v Germany ICSID arbitration proceedings?

3. Will the Commission consider initiating infringement proceedings against Sweden if Vattenfall, which is owned by the Swedish State, continues to pursue its complaint against Germany at the ICSID?
